<legis-type>AN ACT</legis-type> 
<official-title display="yes">To prevent the introduction into commerce of unsafe drywall, to ensure the manufacturer of drywall is readily identifiable, to ensure that problematic drywall removed from homes is not reused, and for other purposes. </official-title>

<section id="H2F5941620903429CA6CDC677A5FD9422" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Drywall Safety Act of 2012</short-title></quote>.</text></section>
<section id="H326AEB86C5E148C998E361B441E3859C"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
<paragraph id="H6F8D7550C5044A74868F83C3F7BAADE8"><enum>(1)</enum><text>the Secretary of Commerce should insist that the Government of the People’s Republic of China, which has ownership interests in the companies that manufactured and exported problematic drywall to the United States, facilitate a meeting between the companies and representatives of the United States Government on remedying homeowners that have problematic drywall in their homes; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HEAADBEAE541C44F39EAB601274C2355F"><enum>(2)</enum><text>the Secretary of Commerce should insist that the Government of the People’s Republic of China direct the companies that manufactured and exported problematic drywall to submit to jurisdiction in United States Federal Courts and comply with any decisions issued by the Courts for homeowners with problematic drywall.</text></paragraph></section>
<section id="HB0230D860E3F4B6F96482A757DBF4D26"><enum>3.</enum><header>Drywall labeling requirement</header>
<subsection id="H4CF5B445854C4528909745B4B07CD410"><enum>(a)</enum><header>Labeling requirement</header><text>Beginning 180 days after the date of the enactment of this Act, the gypsum board labeling provisions of standard ASTM C1264–11 of ASTM International, as in effect on the day before the date of the enactment of this Act, shall be treated as a rule promulgated by the Consumer Product Safety Commission under section 14(c) of the Consumer Product Safety Act (15 U.S.C. 2063(c)).</text></subsection>
<subsection id="H0EE27561B1D64840B8FD449FEE666D75"><enum>(b)</enum><header>Revision of standard</header><text display-inline="yes-display-inline">If the gypsum board labeling provisions of the standard referred to in subsection (a) are revised on or after the date of the enactment of this Act, ASTM International shall notify the Commission of such revision no later than 60 days after final approval of the revision by ASTM International. The revised provisions shall be treated as a rule promulgated by the Commission under section 14(c) of such Act (15 U.S.C. 2063(c)), in lieu of the prior version, effective 180 days after the Commission is notified of the revision (or such later date as the Commission considers appropriate), unless within 90 days after receiving that notice the Commission determines that the revised provisions do not adequately identify gypsum board by manufacturer and month and year of manufacture, in which case the Commission shall continue to enforce the prior version.</text></subsection></section>
<section id="H4723FAA56949407A8799B06A1F730C5D"><enum>4.</enum><header>Sulfur content in drywall standard</header>
<subsection id="HEB85FC1990A74A829FD6475A23CEC2B0"><enum>(a)</enum><header>Rule on sulfur content in drywall required</header><text display-inline="yes-display-inline">Except as provided in subsection (c), not later than 2 years after the date of the enactment of this Act, the Consumer Product Safety Commission shall promulgate a final rule pertaining to drywall manufactured or imported for use in the United States that limits sulfur content to a level not associated with elevated rates of corrosion in the home.</text></subsection>
<subsection id="H5A4631EDA30A4E2381A3D6A5E7DB7B87"><enum>(b)</enum><header>Rule making; consumer product safety standard</header><text>A rule under subsection (a)—</text>
<paragraph id="HA4D2FDFE8BEC4285B45CAF87BA182B81"><enum>(1)</enum><text>shall be promulgated in accordance with section 553 of title 5, United States Code; and</text></paragraph>
<paragraph commented="no" id="H52F086B3797542659170F1EC9697DE6E"><enum>(2)</enum><text display-inline="yes-display-inline">shall be treated as a consumer product safety rule promulgated under section 9 of the Consumer Product Safety Act (15 U.S.C. 2058).</text></paragraph></subsection>
<subsection id="H906DAD5AD6E947CE956BD5A94C21D4F8"><enum>(c)</enum><header>Exception</header>
<paragraph id="H3C83D94A9EB04191A3E100EABC2AD0A6"><enum>(1)</enum><header>Voluntary standard</header><text display-inline="yes-display-inline">Subsection (a) shall not apply if the Commission determines that—</text>
<subparagraph id="HF63D218E26A248F79C9AE300CF98A7A5"><enum>(A)</enum><text display-inline="yes-display-inline">a voluntary standard pertaining to drywall manufactured or imported for use in the United States limits sulfur content to a level not associated with elevated rates of corrosion in the home;</text></subparagraph>
<subparagraph id="HD9E5171A86DE4483BFDB47FFE1F19267"><enum>(B)</enum><text>such voluntary standard is or will be in effect not later than two years after the date of enactment of this Act; and</text></subparagraph>
<subparagraph id="HC4ECABD89440449B924DC9ED486AFE4B"><enum>(C)</enum><text>such voluntary standard is developed by Subcommittee C11.01 on Specifications and Test Methods for Gypsum Products of ASTM International.</text></subparagraph></paragraph>
<paragraph id="HCE4C4ED6141948B587E4E6F39FA34103"><enum>(2)</enum><header>Federal Register</header><text>Any determination made under paragraph (1) shall be published in the Federal Register.</text></paragraph></subsection>
<subsection id="H6C92766767DB438B97C77CF4D5E91170"><enum>(d)</enum><header>Treatment of voluntary standard for purposes of enforcement</header><text>If the Commission determines that a voluntary standard meets the conditions in subsection (c)(1), the sulfur content limit in such voluntary standard shall be treated as a consumer product safety rule promulgated under section 9 of the Consumer Product Safety Act (15 U.S.C. 2058) beginning on the date that is the later of—</text>
<paragraph id="H10E2C0E64B714F1AB83B08AA79FF9273"><enum>(1)</enum><text>180 days after publication of the Commission’s determination under subsection (c); or</text></paragraph>
<paragraph id="H70D95D8C627C4676A79801B6BB389B7C"><enum>(2)</enum><text>the effective date contained in the voluntary standard.</text></paragraph></subsection>
<subsection id="H98B1BE3DC6814E4BBB2A099A836AFBF9"><enum>(e)</enum><header>Revision of voluntary standard</header><text display-inline="yes-display-inline">If the sulfur content limit of a voluntary standard that met the conditions of subsection (c)(1) is subsequently revised, the organization responsible for the standard shall notify the Commission no later than 60 days after final approval of the revision. The sulfur content limit of the revised voluntary standard shall become enforceable as a Commission rule promulgated under section 9 of the Consumer Product Safety Act (15 U.S.C. 2058), in lieu of the prior version, effective 180 days after the Commission is notified of the revision (or such later date as the Commission considers appropriate), unless within 90 days after receiving that notice the Commission determines that the sulfur content limit of the revised voluntary standard does not meet the requirements of subsection (c)(1)(A), in which case the Commission shall continue to enforce the prior version.</text></subsection>
<subsection id="HC4EF067C82C94876B48E54C19AB046AE"><enum>(f)</enum><header>Future rulemaking</header><text>The Commission, at any time subsequent to publication of the consumer product safety rule required by subsection (a) or a determination under subsection (c), may initiate a rulemaking in accordance with section 553 of title 5, United States Code, to modify the sulfur content limit or to include any provision relating only to the composition or characteristics of drywall that the Commission determines is reasonably necessary to protect public health or safety. Any rule promulgated under this subsection shall be treated as a consumer product safety rule promulgated under section 9 of the Consumer Product Safety Act (15 U.S.C. 2058).</text></subsection></section>
<section commented="no" display-inline="no-display-inline" id="H4F1B00CA3F6C4E12BC9BA3F9809F706B" section-type="subsequent-section"><enum>5.</enum><header>Revision of remediation guidance for drywall disposal required</header><text display-inline="no-display-inline">Not later than 120 days after the date of the enactment of this Act, the Consumer Product Safety Commission shall revise its guidance entitled <quote>Remediation Guidance for Homes with Corrosion from Problem Drywall</quote> to specify that problematic drywall removed from homes pursuant to the guidance should not be reused or used as a component in production of new drywall.</text></section>
