<section id="H8FA4CC480A2948BD9A6FFB202C5977A7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Contracting Oversight for Small Business Jobs Act of 2012</short-title></quote>.</text> </section>
<section id="HA2C2511B997B412F8E3188B152A62BF8"><enum>2.</enum><header>Increased penalties for fraud</header> 
<subsection id="H2CC24B987F264DBFB87CB5276471E55D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 47 of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H840290EC774A49F3A8E384FE837EA629" style="USC"> 
<section id="HFA1A0A49A3C0430FB57374EE12650F0C"><enum>1041.</enum><header>Misrepresentation of status as a small business concern</header> 
<subsection id="H56A4B48DBF9C417D8085F09B8F6C14A2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Whoever knowingly—</text> 
<paragraph id="H602E80504A634A3B827B4321E13A86B5"><enum>(1)</enum><text>falsifies, conceals, or covers up by any trick, scheme, or device a material fact;</text> </paragraph>
<paragraph id="HDF85F55CDDC14E9283E05416747002B1"><enum>(2)</enum><text>makes any materially false, fictitious, or fraudulent statement or representation; or</text> </paragraph>
<paragraph id="H886E546D79FE4AD9B0D9BB7F4A22A552"><enum>(3)</enum><text>makes or uses any false writing or document, including electronically, knowing the same to contain any materially false, fictitious, or fraudulent statement or entry;</text> </paragraph><continuation-text continuation-text-level="subsection">concerning status as a small business concern or compliance with the requirements of the Small Business Act in an effort to obtain, retain, or complete a federal government contract shall be fined $1,000,000 or in a sum equal to twice the amount or value of goods or services under the contract or order, whichever is greater, imprisoned not more than 5 years, or both.</continuation-text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="HDB261A75946F44C1BCB782C4E90FC11A"><enum>(b)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">The table of sections for such chapter is amended by inserting after the item <deleted-phrase reported-display-style="strikethrough" committee-id="HSM00">relating to the following section: </deleted-phrase><added-phrase reported-display-style="italic" committee-id="HSM00">relating to section 1040 the following:</added-phrase></text>

<section id="HACA7F4DDA58845B2A4210DEC632B3E4B"><enum>3.</enum><header>Safe harbor for good faith compliance efforts</header> 
<subsection id="HC8AE1CCA06814F79B636DFE386312A3B"><enum>(a)</enum><header>Small business fraud</header><text display-inline="yes-display-inline">Section 16(d) of the Small Business Act (15 U.S.C. 16(d)) is amended by inserting after paragraph (2) the following:</text> 
<quoted-block display-inline="no-display-inline" id="HA241F8C050C2406E916D20A1906D083B" style="OLC"> 
<paragraph commented="no" id="H1CE3969B99DC4DB3A494F7CE75C8B6E1"><enum>(3)</enum><header><added-phrase reported-display-style="italic" committee-id="HSM00">Limitation on liability</added-phrase></header><text display-inline="yes-display-inline">This subsection shall not apply to any conduct in violation of subsection (a) if the defendant acted in reliance on a written advisory opinion from a licensed attorney who is not an employee of the defendant.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="H9B76781AE7BB495FB7C3F9F52EC15093"><enum>(b)</enum><header>Misrepresentation of status</header><text display-inline="yes-display-inline">Section 1041 of title 18, United States Code, as added by section 2 of this Act, is amended by inserting after subsection (a) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H36E1D21100FB4745ACC9F1F39CE6F44E" style="USC"> 
<subsection id="HC15CF9EAF84C46ACAE25CB3263F7121E"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">This section shall not apply to any conduct in violation of paragraph (2) or (3) of subsection (a) if the defendant acted in reliance on a written advisory opinion from a licensed attorney who is not an employee of the defendant.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="HE998723D835A4CE4B08B7EAA8E391439"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Administrator of the Small Business Administration shall issue rules defining what constitutes an adequate advisory opinion for purposes of section 16(d)(3) of the Small Business Act.</text> </subsection>
<subsection id="HF18117AC20454EB9A026E01B02BDD940"><enum>(d)</enum><header>Small business compliance guide</header><text>Not later than 270 days after the date of enactment of this Act, the Administrator of the Small Business Administration shall issue (pursuant to section 212 of the Small Business Regulatory Enforcement Fairness Act of 1996) a compliance guide to assist business concerns in accurately determining their status as a small business concern. <added-phrase reported-display-style="italic" committee-id="HSM00">On the date that the Administrator issues the compliance guide under this section, the Administrator shall also issue a version of the compliance guide translated into Spanish and such translation may be provided in digital form by the Administrator.</added-phrase></text> </subsection></section>
<section id="HABC7D67647974AD095354A38C4B05F94"><enum>4.</enum><header>Office of Hearings and Appeals</header> 
<subsection id="H919F5114018A4EDDBDA82E0CA9521CCE"><enum>(a)</enum><header>Chief Hearing Officer</header><text display-inline="yes-display-inline">Section 4(b)(1) of the Small Business Act is amended by adding at the end the following: <quote>One shall be designated at the time of his or her appointment as the Chief Hearing Officer, who shall head and administer the Office of Hearings and Appeals within the Administration.</quote>.</text> </subsection>
<subsection id="H174F4C32C98F4056AAE5EAD62F721C07"><enum>(b)</enum><header>Office of Hearings and Appeals established in Administration</header><text display-inline="yes-display-inline">Section 5 of the Small Business Act (15 U.S.C. 634) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H7AAF9F9CE9D643E29BFFA5206E4FF72E" style="OLC"> 
<subsection id="H2A95312F35BD44AEBC29355A63987396"><enum>(i)</enum><header>Office of Hearings and Appeals</header> 
<paragraph id="HF8CD08B803EC44E88F661794F92DB81F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is established in the Administration an Office of Hearings and Appeals—</text> 
<subparagraph id="H625B991837D148CBA21C5621ECE0F901"><enum>(A)</enum><text>to impartially decide such matters, where Congress designates that a hearing on the record is required or which the Administrator designates by regulation or otherwise; and</text> </subparagraph>
<subparagraph id="H339602F1A8964B9D946E8F27223BF3A3"><enum>(B)</enum><text>which shall contain the Administration’s Freedom of Information/Privacy Acts Office.</text> </subparagraph></paragraph>
<paragraph id="H778E1AF0457044948F1D320FD4D409B8"><enum>(2)</enum><header>Chief Hearing Officer</header><text>The Chief Hearing Officer shall be a career member of the Senior Executive Service and an attorney duly licensed by any State, commonwealth, territory, or the District of Columbia.</text> 
<subparagraph id="H6BD85D9AD6A44416988D9127D2ADDFCA"><enum>(A)</enum><header>Duties</header><text>The Chief Hearing Officer shall—</text> 
<clause id="H9AFCE98B86A347B5A614BC00B24A449A"><enum>(i)</enum><text>serve as the Chief Administrative Law Judge; and</text> </clause>
<clause id="H6AFCA4F127D14452BF88205AB94E6EA0"><enum>(ii)</enum><text>be responsible for the operation and management of the Office of Hearings and Appeals, pursuant to the rules of practice established by the Administrator.</text> </clause></subparagraph>
<subparagraph id="H0C5FC20CC8974B63A08D51E54B3B4367"><enum>(B)</enum><header>Alternative dispute resolution</header><text>The Chief Hearing Officer may also assign a matter for mediation or other means of alternative dispute resolution.</text> </subparagraph></paragraph>
<paragraph commented="no" id="HE52EA585E62D47E5816D5CE353E83D06"><enum>(3)</enum><header>Administrative law judges</header> 
<subparagraph commented="no" id="HF0CDE888B1AA4307ABDC62E6A3EC2F32"><enum>(A)</enum><header>In general</header><text>An administrative law judge shall be an attorney duly licensed by any State, commonwealth, territory, or the District of Columbia.</text> </subparagraph>
<subparagraph id="HC3EB04F742374D539BFFF9BCAED5D820"><enum>(B)</enum><header>Conditions of employment</header>
<clause commented="no" display-inline="yes-display-inline" id="HD92F4F2AF9B242EF84477BA4102CF499"><enum>(i)</enum><text>An administrative law judge shall serve in the excepted service as an employee of the Administration under section 2103 of title 5, United States Code, and under the supervision of the Chief Hearing Officer.</text> </clause>
<clause id="H3E1FDB60CAAE4507A451838A5351A44C" indent="up1"><enum>(ii)</enum><text>Administrative law judge positions shall be classified at Senior Level, as such term is defined in section 5376 of title 5, United States Code.</text> </clause>
<clause id="HA550189D356543409F51137417994659" indent="up1"><enum>(iii)</enum><text>Compensation for administrative law judge positions shall be set in accordance with the pay rates of section 5376 of title 5, United States Code.</text> </clause></subparagraph>
<subparagraph commented="no" id="HB424296769D440D2B2637BC6984B9659"><enum>(C)</enum><header>Treatment of Current Personnel</header><text>An individual serving as a Judge in the Office of Hearings and Appeals (as that position and office are designated in section 134.101 of title 13, Code of Federal Regulations (as in effect on January 1, 2012)) on the effective date of this subsection shall be considered as qualified to be and redesignated as administrative law judges.</text> </subparagraph>
<subparagraph commented="no" id="H9EF522D681EA4521873343620B24C678"><enum>(D)</enum><header>Powers</header><text>An administrative law judge shall have the authority to conduct hearings in accordance with sections 554, 556, and 557 of title 5, United States Code.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>
<section id="H421DF863973E41DF8B862F8E1F544C8D"><enum>5.</enum><header>Requirement fraudulent businesses be suspended or debarred</header> 
<subsection id="HA1C971C0D6094C7490E77B8877351370"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section <deleted-phrase reported-display-style="strikethrough" committee-id="HSM00">16(d)(2)</deleted-phrase> <added-phrase reported-display-style="italic" committee-id="HSM00">16(d)(2)(C)</added-phrase> of the Small Business Act (15 U.S.C. <deleted-phrase reported-display-style="strikethrough" committee-id="HSM00">645(d)(3)</deleted-phrase> <added-phrase reported-display-style="italic" committee-id="HSM00">645(d)(2)(C)</added-phrase>) is amended by striking <quote>on the basis that such misrepresentation indicates a lack of business integrity that seriously and directly affects the present responsibility to perform any contract awarded by the Federal Government or a subcontract under such a contract</quote> and inserting <quote>if the misrepresentation is established by a preponderance of the evidence (in the case of debarment) or adequate evidence (in the case of suspension)</quote>.</text> </subsection>
<subsection id="H2E6276AA7A874659B7701DF5AD627AAC"><enum>(b)</enum><header>Revision to FAR</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Federal Acquisition Regulation shall be revised to implement the amendment made by this section.</text> </subsection>
<subsection id="H62E57EF4CE874528A220515C19034895"><enum>(c)</enum><header>Publication of procedures regarding suspension and debarment</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Administrator shall publish on the Administration's Web site the standard operating procedures for suspension and debarment in effect, and the name and contact information for the individual designated by the Administrator as the senior individual responsible for suspension and debarment proceedings.</text> </subsection>
<subsection id="H04D8B559C67A4ECAB5865B6F3BF9F985"><enum>(d)</enum><header>Required regulations</header><text>Not later than 270 days after the date of enactment of this Act, the Administrator of the Small Business Administration shall issue regulations defining the term <quote>adequate evidence</quote> for purposes of section 16(d)(2) of the Small Business Act.</text> </subsection></section>
<section id="H4538EFFA6BFD45C0A1B4A0FC3CC00578" section-type="subsequent-section"><enum>6.</enum><header>Annual report on suspensions and debarments proposed by Small Business Administration</header> 
<subsection id="H8905724FCF63477DB1BBB11C0B8FA90E"><enum>(a)</enum><header>Report requirement</header><text display-inline="yes-display-inline">The Administrator of the Small Business Administration shall submit each year to the Committee on Small Business and Entrepreneurship of the Senate, and the Committee on Small Business of the House of Representatives a report on the suspension and debarment actions taken by the Administrator during the year preceding the year of submission of the report.</text> </subsection>
<subsection id="HD28172AD53ED4E96B47B7508EF17BB9D"><enum>(b)</enum><header>Matters covered</header><text>The report required by subsection (a) shall include the following information for the year covered by the report:</text> 
<paragraph id="H045BAC1256EB478AA0D579FDF19BDF13"><enum>(1)</enum><header>Number</header><text>The number of contractors proposed for suspension or debarment.</text> </paragraph>
<paragraph id="H2072106C643743E98B2916A7386DCDC2"><enum>(2)</enum><header>Source</header><text>The office within a Federal agency that originated each proposal for suspension or debarment.</text> </paragraph>
<paragraph id="HC0BC26C6B66840CD8AD6778F19AE55A6"><enum>(3)</enum><header>Reasons</header><text display-inline="yes-display-inline">The reason for each proposal for suspension or debarment.</text> </paragraph>
<paragraph id="H9DF15E2D199845448B150FF66CFA63BB"><enum>(4)</enum><header>Results</header><text>The result of each proposal for suspension or debarment, and the reason for such result.</text> </paragraph>
<paragraph id="H768B83598746417FAA496E20965AC329"><enum>(5)</enum><header>Referrals</header><text>The number of suspensions or debarments referred to the Inspector General of the Small Business Administration or another agency, or to the Attorney General (for purposes of this paragraph, the Administrator may redact identifying information on names of companies or other information in order to protect the integrity of any ongoing criminal or civil investigation).</text> </paragraph></subsection></section>
<section id="H1AF90D15E3E7468D88CD4189D7A55618"><enum>7.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the Administrator of the Small Business Administration should present to the Inspector General of the Administration or the Attorney General any evidence of a violation or potential violation of section 1041, title 18, United States Code, or section 16(d) of the Small Business Act, presented in a proceeding conducted by the Office of Hearings and Appeals established in section 4 of this Act.</text> </section>
