		<official-title>To amend the Americans with Disabilities Act of 1990 to
		  prohibit the Attorney General from administering or enforcing certain
		  accessibility regulations relating to pools at public accommodations or
		  provided by public entities.</official-title>

		<section id="HE86AE5CDB95D44D684C0339E8F9B6375" section-type="section-one"><enum>1.</enum><header>Regulations regarding pools
			 provided by public entities</header><text display-inline="no-display-inline">Section 204 of the Americans with
			 Disabilities Act of 1990 (42 U.S.C. 12134) is amended by adding at the end the
			 following:</text>

				<subsection id="H8DB08D8D4B0F4899BB7DD08C09C5AAC5"><enum>(d)</enum><header>Regulations
				regarding pools provided by public entities</header>
					<paragraph id="H1E6E37E9E2BE419E810B027AAB4D114E"><enum>(1)</enum><header>Definitions</header>
						<subparagraph id="H429F24BF084041B797E52792EF4134F2"><enum>(A)</enum><header>Covered
				regulation</header><text display-inline="yes-display-inline">The term
				<term>covered regulation</term> means the portions of part 35 of title 28, Code
				of Federal Regulations, that were added under the final rule issued by the
				Attorney General entitled <quote>Nondiscrimination on the Basis of Disability
				in State and Local Government Services</quote>, 75 Fed. Reg. 56164 (September
				15, 2010).</text>
						</subparagraph><subparagraph id="H5F88F7ABA785489D97A1F63D5F01A3A3"><enum>(B)</enum><header>Pool</header><text>The
				term <term>pool</term> means a swimming pool, wading pool, sauna, steam room,
				spa, wave pool, lazy river, sand bottom pool, or other water amusement, within
				the meaning of part 36 of title 28, Code of Federal Regulations.</text>
						</subparagraph></paragraph><paragraph id="H968F4AE2E04B412FAE2E5C8417462908"><enum>(2)</enum><header>Prohibition</header><text>Neither
				the Attorney General nor any official of the Federal Government shall have
				authority, under this subtitle or any other provision of Federal law, to
				administer or enforce a covered regulation, with respect to a pool provided by
				a public entity and covered by this
				subtitle.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			 regarding pools at public accommodations</header><text display-inline="no-display-inline">Section 306 of the Americans with
			 Disabilities Act of 1990 (42 U.S.C. 12186) is amended by adding at the end the
			 following:</text>

				regarding pools at public accommodations</header>
					<paragraph id="H1626BBB3554845699E91F2C6C8895D26"><enum>(1)</enum><header>Definitions</header>
						<subparagraph id="H97682332D24748338B6AF14DFDC24C5E"><enum>(A)</enum><header>Covered
				regulation</header><text display-inline="yes-display-inline">The term
				<term>covered regulation</term> means the portions of part 36 of title 28, Code
				of Federal Regulations, that were added under the final rule issued by the
				Attorney General entitled <quote>Nondiscrimination on the Basis of Disability
				by Public Accommodations and in Commercial Facilities</quote>, 75 Fed. Reg.
				56236 (September 15, 2010).</text>
						</subparagraph><subparagraph id="H1B628D4A00C94A2E8FDF43DFBFDD06B3"><enum>(B)</enum><header>Pool</header><text>The
				term <term>pool</term> means a swimming pool, wading pool, sauna, steam room,
				spa, wave pool, lazy river, sand bottom pool, or other water amusement, within
				the meaning of part 36 of title 28, Code of Federal Regulations.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2DC9ED4569A9412AA829F8F890B85F1A"><enum>(2)</enum><header>Prohibition</header><text>Neither
				the Attorney General nor any official of the Federal Government shall have
				authority, under this title or any other provision of Federal law, to
				administer or enforce a covered regulation, with respect to a pool at a public
				accommodation.</text>
