		<official-title>To provide standards for determining whether the
		  substantial restoration of the natural quiet and experience of the Grand Canyon
		  National Park has been achieved and to clarify regulatory authority with
		  respect to commercial air tours operating over the Park.</official-title>

		<section id="H101DEBA16361446D885EFCE8B6373867" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Grand Canyon Tourism Jobs Protection
			 Act of 2012</short-title></quote>.</text>
		</section><section id="H4EC9560E64234EB7BF77EB4A4E1AA41D"><enum>2.</enum><header>Overflights in
			 Grand Canyon National Park</header>
			<subsection id="H6351E7F74F45411C973460B840726217"><enum>(a)</enum><header>Determinations
			 with respect to substantial restoration of natural quiet and
			 experience</header>
				<paragraph id="H92A6AEF9361E4913AD0020BC138EC3EF"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law, for purposes
			 of section 3(b)(1) of Public Law 100–91 (16 U.S.C. 1a–1 note), the substantial
			 restoration of the natural quiet and experience of the Grand Canyon National
			 Park (in this subsection referred to as the ‘‘Park’’) shall be considered to be
			 achieved in the Park if, for at least 75 percent of each day, 50 percent of the
			 Park is free of sound produced by commercial air tour operations that have an
			 allocation to conduct commercial air tours in the Park as of the date of the
			 enactment of this Act.</text>
				</paragraph><paragraph id="H1A708E4CBBEA46339845201D628CC56C"><enum>(2)</enum><header>Considerations</header>
					<subparagraph id="HBB99FF5F61EA48378AF46C794BACC1C3"><enum>(A)</enum><header>In
			 general</header><text>For purposes of determining whether substantial
			 restoration of the natural quiet and experience of the Park has been achieved
			 in accordance with paragraph (1), the Secretary of the Interior (in this
			 section referred to as the ‘‘Secretary’’) shall use—</text>
						<clause id="H809B283065814839B885B48F8B787FD0"><enum>(i)</enum><text>the
			 2-zone system for the Park in effect on the date of the enactment of this Act
			 to assess impacts relating to subsectional restoration of natural quiet at the
			 Park, including—</text>
							<subclause id="H7EA520DD2C3643E68F0918EE1C54A0FF"><enum>(I)</enum><text>the thresholds for
			 noticeability and audibility; and</text>
							</subclause><subclause id="HE77D921C19DD45B7927CDCA9A71B6FB3"><enum>(II)</enum><text>the distribution
			 of land between the 2 zones; and</text>
							</subclause></clause><clause id="HAFEE43DDF3FE4BBABE9B2E47BFA9A289"><enum>(ii)</enum><text>noise modeling
			 science that is—</text>
							<subclause id="HB3E59DE1FBE74EB0AC7F48CD35DCFD5F"><enum>(I)</enum><text>developed for use
			 at the Park, specifically Integrated Noise Model Version 6.2;</text>
							</subclause><subclause id="HF4A2C561E3724760A715AE299DD7643F"><enum>(II)</enum><text>validated by
			 reasonable standards for conducting field observations of model results;
			 and</text>
							</subclause><subclause id="HBFF2AF6EAB7240D8B0618531FDFF7D79"><enum>(III)</enum><text>accepted and
			 validated by the Federal Interagency Committee on Aviation Noise.</text>
							</subclause></clause></subparagraph><subparagraph id="H31ABF45B44644659A3384323D000EFD4"><enum>(B)</enum><header>Sound from other
			 sources</header><text>The Secretary shall not consider sound produced by
			 sources other than commercial air tour operations, including sound emitted by
			 other types of aircraft operations or other noise sources, for purposes
			 of—</text>
						<clause id="H85E3CDA2F86D4585BF4076C4D4BC65FF"><enum>(i)</enum><text>making
			 recommendations, developing a final plan, or issuing regulations relating to
			 commercial air tour operations in the Park; or</text>
						</clause><clause id="H2C1B177259A24B80A3AB97DD20027E17"><enum>(ii)</enum><text>determining under
			 paragraph (1) whether substantial restoration of the natural quiet and
			 experience of the Park has been achieved.</text>
						</clause></subparagraph></paragraph><paragraph id="H711B37935F824AC2BFD62986FF469848"><enum>(3)</enum><header>Continued
			 monitoring</header><text>The Secretary shall continue monitoring noise from
			 aircraft operating over the Park below 17,999 feet MSL to ensure continued
			 compliance with the substantial restoration of natural quiet and experience in
			 the Park.</text>
				</paragraph><paragraph id="HA25C7BDADD5F4986A270A6FA2480AD99"><enum>(4)</enum><header>Day
			 defined</header><text>For purposes of this subsection, the term
			 <term>day</term> means the hours between 7:00 a.m. and 7:00 p.m.</text>
				</paragraph></subsection></section></legis-body>
