		<official-title>To amend the National Defense Authorization Act for
		  Fiscal Year 2012 to provide for the trial of covered persons detained in the
		  United States pursuant to the Authorization for Use of Military Force and to
		  repeal the requirement for military custody.</official-title>

		<section id="H2384FC9CE2224090B155A5834F25D4FF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Due Process and Military Detention
			 Amendments Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H40C635654BD84EC5A012854176AE8C61"><enum>2.</enum><header>Disposition of
			 covered persons detained in the United States pursuant to the Authorization for
			 Use of Military Force</header><text display-inline="no-display-inline">Section
			 1021 of the National Defense Authorization Act for Fiscal Year 2012 is
			 amended—</text>
			<paragraph id="HC788647EEF1B45BC999A4FC462FCD8BD"><enum>(1)</enum><text>in subsection (c),
			 by striking <quote>The disposition</quote> and inserting <quote>Except as
			 provided in subsection (g), the disposition</quote>; and</text>
			</paragraph><paragraph id="HEC69AA002B474332897B8E19AE3C7366"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HF9B8534FC1494A94885AB874C4D7D739" style="OLC">
					<subsection id="H7036309AA0894A1892BF613DEBBF643C"><enum>(g)</enum><header>Disposition of
				covered persons detained in the United States</header><text display-inline="yes-display-inline">In the case of a covered person who is
				detained in the United States pursuant to the Authorization for Use of Military
				Force, disposition under the law of war shall only mean the transfer of the
				person for trial and proceedings by a court established under Article III of
				the Constitution of the United States or by an appropriate State court. Such
				trial and proceedings shall have all the due process as provided for under the
				Constitution of the United
				States.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H25D584AD214645579626D123B3A5DFE8"><enum>3.</enum><header>Repeal of
			 requirement for military custody</header>
			<subsection id="H412DFE45619D4ED1818384D9D0E89675"><enum>(a)</enum><header>Repeal</header><text display-inline="yes-display-inline">Section 1022 of the National Defense
			 Authorization Act for Fiscal Year 2012 is hereby repealed.</text>
			</subsection><subsection id="HD830B5236CCD4A40AF0B6C7572685DBA"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 1029(b) of such Act is amended by striking
			 <quote>applies to</quote> and all that follows through <quote>any other
			 person</quote> and inserting <quote>applies to any person</quote>.</text>
