		<official-title>To amend title XVI of the Social Security Act to clarify
		  that the value of certain funeral and burial arrangements are not to be
		  considered available resources under the supplemental security income
		  program.</official-title>

		<section commented="no" display-inline="no-display-inline" id="HD183D46F57C942538E31FA15C849B77D" section-type="section-one"><enum>1.</enum><header>Certain funeral and burial
			 arrangements not considered resources</header>
			<subsection commented="no" display-inline="no-display-inline" id="H2367FDFAAFC645AB888DF1F821416526"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1613(d) of
			 the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1382b(d)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H99371B85BFD24853B1AB7392F4ADC4A4"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)(B), by inserting <quote>,
			 including a trust or arrangement described in paragraph (5)</quote> after
			 <quote>irrevocable arrangement</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1983408E43344C0387AD734BDE4774FE"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H5A476D5C5456446296541E84230F18D6" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="HBCBC0B10CFF849A583753E7BF6E00BE4" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">If—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="HD051D800F5794657BFD7A6CAB2D9D7C9"><enum>(A)</enum><text>an individual or the individual’s
				spouse enters into an irrevocable contract with a provider of funeral goods and
				services for a funeral; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9B5AFAC4B2214D9194E26DD2B1FDB27B"><enum>(B)</enum><text>the individual or the individual’s
				spouse funds the contract by—</text>
								<clause commented="no" display-inline="no-display-inline" id="H556D8A68273A441B9813221C00C8FC83"><enum>(i)</enum><text>prepaying for the goods and
				services and the funeral provider places the funds in a trust;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H825135D14BE3434DB36241FA8F9B62B0"><enum>(ii)</enum><text>establishing an irrevocable trust
				fully funding the goods and services and the funeral provider is the named
				beneficiary of the trust; or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H16469EEF391F4460B953D464A4A6838E"><enum>(iii)</enum><text>purchasing a life insurance
				policy that provides benefits to pay for the goods and services and irrevocably
				assigning such benefits to—</text>
									<subclause commented="no" display-inline="no-display-inline" id="H58AE70005604403AB207AC8507D164B4"><enum>(I)</enum><text>the funeral provider; or</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="HCE6A07C2C8AB46E7B216A6213238CED7"><enum>(II)</enum><text>an irrevocable trust fully funding the
				goods and services and the funeral provider is the named beneficiary of the
				trust,</text>
									</subclause></clause></subparagraph><continuation-text continuation-text-level="paragraph">then the
				irrevocable contract and the funding arrangement for the irrevocable contract
				shall not be considered a resource available to the individual or the
				individual's
				spouse.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HF50A357AE25E4BC09F2025BE0367B606"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 1613(e)(3)(B) of such Act (42 U.S.C.
			 1382b(e)(3)(B)) is amended by striking <quote>In the case of an irrevocable
			 trust established by an individual, if there are any circumstances under which
			 payment from the trust</quote> and inserting <quote>Except as provided in
			 subsection (d)(5)(B)(ii), if there are any circumstances under which payment
			 from an irrevocable trust established by an individual</quote>.</text>
			</subsection><subsection id="HE69C662DAC2844D68528DDBDC3BE6D82"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to payments
			 for supplemental security income benefits under title XVI of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> for months
			 beginning on or after the date of enactment of this Act.</text>
