		<official-title>To amend the Lacey Act Amendments of 1981 to repeal
		  certain provisions relating to criminal penalties and violations of foreign
		  laws, and for other purposes.</official-title>

		<section id="H7DE21774608C4F90A50BD29FC8FB9DA1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Freedom from Over-Criminalization and
			 Unjust Seizures Act of 2012</short-title></quote>.</text>
		</section><section id="H0A6C19F1ADA9492598DF950A3716138B"><enum>2.</enum><header>Criminal
			 penalties</header>
			<subsection id="H5BC31520A6A948C19CFEB550BA204511"><enum>(a)</enum><header>Prohibited
			 acts</header><text>Section 3(a) of the Lacey Act Amendments of 1981 (16 U.S.C.
			 3372(a)) is amended—</text>
				<paragraph id="HEC9E6BCC654D4CA1940CCF6C60590B35"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="H86140E2C694F47E2BCE27F5C62D067EF"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>or in violation of any foreign law</quote>; and</text>
					</subparagraph><subparagraph id="H2F71C1DFBD094A9B9A4FE99ABB63A6B6"><enum>(B)</enum><text>in subparagraph
			 (B)—</text>
						<clause id="H301A2CFB36E44A1F8EEC2DFEB8D216B9"><enum>(i)</enum><text>in
			 clause (i), by striking <quote>, or any foreign law,</quote>;</text>
						</clause><clause id="HBBD6E439697142B98545CB620F892BDD"><enum>(ii)</enum><text>in
			 clause (ii), by striking <quote>or any foreign law</quote>; and</text>
						</clause><clause id="HFF2DBEE11BAE4E798DFF1CE6F4AE032C"><enum>(iii)</enum><text>in
			 clause (iii), by striking <quote>, or under any foreign law,</quote>;
			 and</text>
						</clause></subparagraph></paragraph><paragraph id="HAAE37569DC9B4834ABD5483208AA2464"><enum>(2)</enum><text>in paragraph
			 (3)—</text>
					<subparagraph id="H048C40F76AEA4BF8A1DC6302518AC6A0"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>foreign law or </quote>; and</text>
					</subparagraph><subparagraph id="H4B4038A6267043AAB0868D214E0CC973"><enum>(B)</enum><text>in subparagraph
			 (B)—</text>
						<clause id="HA0929F0ACB694D03AA03AA2AD9BE5AC0"><enum>(i)</enum><text>in
			 clause (i), by striking <quote>, or any foreign law,</quote>;</text>
						</clause><clause id="HEA955694DC4142299342DAE335D5A41C"><enum>(ii)</enum><text>in
			 clause (ii), by striking <quote>or any foreign law</quote>; and</text>
						</clause><clause id="HCB336ABF5C374E4EA4D4E4DF97306113"><enum>(iii)</enum><text>in
			 clause (iii), by striking <quote>, or under any foreign law, </quote>.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H1DDC6023DFC04B568AA7180AE6D77DC9"><enum>(b)</enum><header>Penalties</header><text>Section
			 4 of the Lacey Act Amendments of 1981 (16 U.S.C. 3373) is amended—</text>
				<paragraph id="H1106859C36EE41E0981D7EA2EC27C55C"><enum>(1)</enum><text>in subsection (a),
			 by striking paragraph (1) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H2E3F44D197AE47829F7CF0410E798151" style="OLC">
						<paragraph id="H69132075AD1D4611AAD5C01A860FBB8F"><enum>(1)</enum><header>Assessment</header>
							<subparagraph id="H724DC96171C848B68D53FAA20E2522CE"><enum>(A)</enum><header>In
				general</header><text>Any person who engages in conduct prohibited by any
				provision of this Act (other than subsections (b), (d), and (f) of section 3)
				and in the exercise of due care should know that the fish, wildlife, or plants
				were taken, possessed, transported, or sold in violation of, or in a manner
				unlawful under, any underlying law, treaty, or regulation, and any person who
				knowingly violates subsection (d) or (f) of section 3, may be assessed a civil
				penalty by the Secretary for each violation in accordance with subparagraph (B)
				or (C), as applicable.</text>
							</subparagraph><subparagraph id="H47210BC467C34B9885E577B9B0BF9D9F"><enum>(B)</enum><header>Market value of
				less than $350</header><text>If a violation under subparagraph (A) involves
				fish or wildlife or plants with a market value of less than $350 and involves
				only the transportation, acquisition, or receipt of fish, wildlife, or plants
				taken or possessed in violation of any law, treaty, or regulation of the United
				States, tribal law, or any law or regulation of a State, the penalty assessed
				under subparagraph (A) for the violation shall not exceed the lesser of—</text>
								<clause id="H35582844E92C4C739EE8FA3EDD6822B1"><enum>(i)</enum><text>the maximum amount
				of the penalty provided for violation of the law or regulation; or</text>
								</clause><clause id="HF45355B9456945818F4AED5AF332D16D"><enum>(ii)</enum><text>$10,000.</text>
								</clause></subparagraph><subparagraph id="H6A9443173C75456481CA1526E8898A8A"><enum>(C)</enum><header>Other
				violations</header><text>For any violation under subparagraph (A) that is not
				described in subparagraph (B), the penalty assessed under that subparagraph
				shall not exceed $200,000.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF4B1E48C9DE04BA4B0B74E4723164F5C"><enum>(2)</enum><text>by striking
			 subsections (d) and (e).</text>
				</paragraph></subsection><subsection id="H82EAC044334549C08EFBB268D84B65A8"><enum>(c)</enum><header>Forfeiture</header><text>Section
			 5 of the Lacey Act Amendments of 1981 (16 U.S.C. 3374) is amended—</text>
				<paragraph id="H0EDCF4DBC04946CF8C2D79F733A316BA"><enum>(1)</enum><text>by striking
			 subsections (a) and (b) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H1603E20459DC44AEAF84B6A558047096" style="OLC">
						<subsection id="H6645454A8F104B1FB02C6A2E063921F0"><enum>(a)</enum><header>In
				general</header><text>All fish, wildlife, or plants imported, exported,
				transported, sold, received, acquired, or purchased in violation of section 3
				(other than subsection (b) of that section), or any regulation issued under
				that section, shall be subject to forfeiture to the United States
				notwithstanding any culpability requirements for civil penalty assessment under
				section
				4.</text>
						</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HE5586B25BB184F8683F7FB8037AA742D"><enum>(2)</enum><text>by redesignating
			 subsections (c) and (d) as subsections (b) and (c), respectively; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAC2E8C11CD5946FDBE530A06EE2A52C9"><enum>(3)</enum><text>in subsection (b)
			 (as redesignated), by striking <quote>convicted of an offense, or assessed a
			 civil penalty,</quote> and inserting <quote>assessed a civil
			 penalty</quote>.</text>
				</paragraph></subsection><subsection id="H36D39847645F49CCB5E706DFE4C71DB1"><enum>(d)</enum><header>Enforcement</header>
				<paragraph id="H5F7CE4484BCE4422960418E730E51DD4"><enum>(1)</enum><header>In
			 general</header><text>Section 6 of the Lacey Act Amendments of 1981 (16 U.S.C.
			 3375) is amended—</text>
					<subparagraph id="H9D36D95653944DB28D3A3B1B3DED2CA0"><enum>(A)</enum><text>by striking
			 subsection (b);</text>
					</subparagraph><subparagraph id="H982BD37473B24CC3B6AE4F35DAF22FB6"><enum>(B)</enum><text>by redesignating
			 subsections (c) and (d) as subsections (b) and (c), respectively;</text>
					</subparagraph><subparagraph id="H2451B8188E494FAB9B512DAAEAC0A8C7"><enum>(C)</enum><text>in subsection (b)
			 (as redesignated), by striking the third sentence; and</text>
					</subparagraph><subparagraph id="HA4E37A8D243843C4969FAE27EBE304A3"><enum>(D)</enum><text>in the first
			 sentence of subsection (c) (as redesignated)—</text>
						<clause id="HE6FC27C89A594F9DAFB900A7ECB427AA"><enum>(i)</enum><text>by
			 striking <quote>an arrest, a criminal conviction, civil penalty assessment, or
			 forfeiture of property</quote> and inserting <quote>a civil penalty assessment
			 or forfeiture of property</quote>; and</text>
						</clause><clause id="H217179653DF346E785439C1EDB8C916F"><enum>(ii)</enum><text>by
			 striking <quote>or criminal</quote>.</text>
						</clause></subparagraph></paragraph><paragraph id="HC88C0D1394C54DEF8B152979BDBF8A8C"><enum>(2)</enum><header>Conforming
			 amendments</header>
					<subparagraph id="H241C16A68BDE4FBDB4B51FF7375C7D3E"><enum>(A)</enum><text>Section 3(c)(3) of
			 the Fish and Wildlife Improvement Act of 1978 (16 U.S.C. 742l(c)(3)) is amended
			 by striking <quote>section 6(d) of the Lacey Act Amendments of 1981 (16 U.S.C.
			 3375(d))</quote> and inserting <quote>section 6(c) of the Lacey Act Amendments
			 of 1981 (16 U.S.C. 3375(c))</quote>.</text>
					</subparagraph><subparagraph id="HF6299F4CD5934E4D860EEAF111EBDE97"><enum>(B)</enum><text>Section 503(b) of
			 the Marine Mammal Protection Act of 1972 (16 U.S.C. 1423b(b)) is
			 amended—</text>
						<clause id="H3E12C39ACBC74B77A9B401D1EC19912E"><enum>(i)</enum><text>by
			 striking the subsection designation and heading and all that follows through
			 <quote>The Secretary may utilize</quote> in paragraph (1) and inserting the
			 following:</text>
							<quoted-block display-inline="no-display-inline" id="H51BD941A5B0A48BD8F56FFFC560428BE" style="OLC">
								<subsection id="H7A71ED41C6444B58B9E3DA8B2BB04195"><enum>(b)</enum><header>Utilization of
				other government resources and authorities</header><text>The Secretary may
				utilize</text>
								</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause><clause id="HC0BF41D97F17468A95A452D4D8D62523"><enum>(ii)</enum><text>by
			 striking paragraph (2).</text>
						</clause></subparagraph><subparagraph id="H8BD52484C26243F6B62E4311C2E7762E"><enum>(C)</enum><text>Section 11(d) of
			 the Endangered Species Act of 1973 (16 U.S.C. 1540(d)) is amended in the fourth
			 sentence by striking <quote>section 6(d) of the Lacey Act Amendments of 1981
			 (16 U.S.C. 3375(d))</quote> and inserting <quote>section 6(c) of the Lacey Act
			 Amendments of 1981 (16 U.S.C. 3375(c))</quote>.</text>
					</subparagraph><subparagraph id="H76DD9F181D464383A69835641CED549A"><enum>(D)</enum><text>Section 7(f) of
			 the Rhinoceros and Tiger Conservation Act (16 U.S.C. 5305a(f)) is amended by
			 striking <quote>section 6(d) of the Lacey Act Amendments of 1981 (16 U.S.C.
			 3375(d))</quote> and inserting <quote>section 6(c) of the Lacey Act Amendments
			 of 1981 (16 U.S.C. 3375(c))</quote>.</text>
					</subparagraph><subparagraph id="H899173D07F5B4782AEAD49AC17056ED2"><enum>(E)</enum><text>Section
			 524(c)(4)(A) of title 28, United States Code, is amended by striking
			 <quote>section 6(d) of the Lacey Act Amendments of 1981 (16 U.S.C.
			 3375(d))</quote> and inserting <quote>section 6(c) of the Lacey Act Amendments
			 of 1981 (16 U.S.C. 3375(c))</quote>.</text>
					</subparagraph><subparagraph id="H1AB970FB65134D6D892449B6F900049F"><enum>(F)</enum><text>Section
			 1402(b)(1)(A)(ii) of the Victims of Crime Act of 1984 (42 U.S.C.
			 10601(b)(1)(A)(ii)) is amended by striking <quote>section 6(d) of the Lacey Act
			 Amendments of 1981 (16 U.S.C. 3375(d))</quote> and inserting <quote>section
			 6(c) of the Lacey Act Amendments of 1981 (16 U.S.C. 3375(c))</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H0AEFF759BCEB4139A22EB2E2863CF0D8"><enum>(e)</enum><header>Exceptions</header><text>Section
			 8 of the Lacey Act Amendments of 1981 (16 U.S.C. 3377) is amended by striking
			 subsection (b) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H2262E4C0C9554FC1859A55EBBCE250DA" style="OLC">
					<subsection id="H6622EFA3E1594761A5799D454F9AE02C"><enum>(b)</enum><header>Activities
				regulated by Tuna Convention Acts</header><text>Paragraphs (1), (2)(A), and
				(3)(A) of section 3(a) shall not apply to any activity regulated by the Tuna
				Conventions Act of 1950 (16 U.S.C. 951 et seq.) or the Atlantic Tunas
				Convention Act of 1975 (16 U.S.C. 971 et
				seq.).</text>
