		<legis-type>A BILL</legis-type>
		<official-title>To amend the provisions of title 5, United States Code,
		  which are commonly referred to as the <quote>Hatch Act</quote> to eliminate the
		  provision preventing certain State and local employees from seeking elective
		  office, clarify the application of certain provisions to the District of
		  Columbia, and modify the penalties which may be imposed for certain violations
		  under subchapter III of chapter 73 of that title.</official-title>

		<section id="H06BEE2D323644A649E971C4E3D60D3F5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Hatch Act Modernization Act of
			 2012</short-title></quote>.</text>
		</section><section id="H3573EBE739214D59A2451E7A9EF2D038"><enum>2.</enum><header>Permitting State
			 and local employees to be candidates for elective office</header>
			<subsection id="HAD3C5008D12145848679DD1DDFB9EAED"><enum>(a)</enum><header>In
			 general</header><text>Section 1502(a) of title 5, United States Code, is
			 amended—</text>
				<paragraph id="H43BBB11908BC484F83DF9A67AEC704F2"><enum>(1)</enum><text>in paragraph (1),
			 by adding <quote>or</quote> after the semicolon;</text>
				</paragraph><paragraph id="H9F5230355440449188462B7B4EA21ED1"><enum>(2)</enum><text>in paragraph (2),
			 by striking <quote>purposes; or</quote> and inserting <quote>purposes.</quote>;
			 and</text>
				</paragraph><paragraph id="H384E3FB73737420B8385630A59473B38"><enum>(3)</enum><text>by striking
			 paragraph (3).</text>
				</paragraph></subsection><subsection id="HEE0EA235A4EF4DA385FEAFC051E5720B"><enum>(b)</enum><header>Technical and
			 conforming amendments</header>
				<paragraph id="HC751693364954AB3BE4C2808F5166B90"><enum>(1)</enum><header>Reference to
			 State and local officials</header><text>Section 1502 of title 5, United States
			 Code, is amended by striking subsection (c).</text>
				</paragraph><paragraph id="H655B61AE931946CD912FAECCF56029A7"><enum>(2)</enum><header>Nonpartisan
			 candidacies</header>
					<subparagraph id="HCC86F1589D2F4B298A8DBCFBA242233A"><enum>(A)</enum><header>In
			 general</header><text>Section 1503 of title 5, United States Code, is
			 repealed.</text>
					</subparagraph><subparagraph commented="no" id="H599A4B1B1280425C8CAFF66726A3B215"><enum>(B)</enum><header>Table of
			 sections</header><text>The item relating to section 1503 in the table of
			 sections for chapter 15 of title 5, United States Code, is repealed.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H7B84C859698B4A0A844F740C679D51C4"><enum>3.</enum><header display-inline="yes-display-inline">Applicability of provisions relating to
			 State and local employees</header>
			<subsection commented="no" display-inline="no-display-inline" id="HA543BA72D4284468A12218D0EB1A034A"><enum>(a)</enum><header>State or local
			 agency</header><text display-inline="yes-display-inline">Section 1501(2) of
			 title 5, United States Code, is amended by inserting <quote>, or the District
			 of Columbia, or an agency or department thereof </quote> before the
			 semicolon.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H3CC0A54A74704236878DCB724ABD7CDD"><enum>(b)</enum><header>State or local
			 officer or employee</header><text display-inline="yes-display-inline">Section
			 1501(4) of title 5, United States Code, is amended by striking subparagraph (B)
			 and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H67A8BBBB7D17433EAF49BF22889BF823" style="OLC">
					<subparagraph id="H26BA599C887042E98C81D045AA225E3D"><enum>(B)</enum><text>an individual
				employed by an educational or research institution, establishment, agency, or
				system which is supported in whole or in part by—</text>
						<clause id="H4FF1154B44524F6CAA7B59D9FC31603B"><enum>(i)</enum><text>a
				State or political subdivision thereof;</text>
						</clause><clause id="H53078CBE31A14A4AAC150F0500918F2D"><enum>(ii)</enum><text>the District of
				Columbia; or</text>
						</clause><clause id="H850A8E7D49374A20BAF0D1817181DD16"><enum>(iii)</enum><text>a recognized
				religious, philanthropic, or cultural
				organization.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H3D289CB103614A3EB79C13237CDB55FD"><enum>(c)</enum><header>Merit Systems
			 Protection Board orders</header><text display-inline="yes-display-inline">Section 1506(a)(2) of title 5, United
			 States Code, is amended by inserting <quote>(or in the case of the District of
			 Columbia, in the District of Columbia)</quote> after <quote>the same
			 State</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HC00D4F1EE4604E41B3F5EA0C77518F85"><enum>(d)</enum><header>Provisions
			 relating to Federal employees made inapplicable</header><text display-inline="yes-display-inline">Section 7322(1) of title 5, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H73E5D0474F7943289797F7AC7ED157CE"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by adding
			 <quote>or</quote> at the end;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H780B71578973443297209B1844C1DD72"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>or</quote> at the end;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDEAABC22A39F406984FCD577075E860F"><enum>(3)</enum><text>by striking
			 subparagraph (C); and</text>
				</paragraph><paragraph id="HF4F5859DDB4E4A35BAC364CCB190447C"><enum>(4)</enum><text>by striking
			 <quote>services;</quote> and inserting <quote>services or an individual
			 employed or holding office in the government of the District of
			 Columbia;</quote>.</text>
				</paragraph></subsection></section><section id="H0560657BE41744EAAF309D2C89ACE8C9"><enum>4.</enum><header>Hatch Act
			 penalties for Federal employees</header><text display-inline="no-display-inline">Chapter 73 of title 5, United States Code,
			 is amended by striking section 7326 and inserting the following:</text>
			<quoted-block id="H5A07304C3E0642D0B8C6EE82748C5EE7" style="USC">
				<section id="HCA119FB26C4F41DCAF234742088D044B"><enum>7326.</enum><header>Penalties</header><text display-inline="no-display-inline">An employee or individual who violates
				section 7323 or 7324 shall be subject to removal, reduction in grade, debarment
				from Federal employment for a period not to exceed 5 years, suspension,
				reprimand, or an assessment of a civil penalty not to exceed
				$1,000.</text>
				</section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H049AE666F91A4DBDB592ED6604EF8CDA"><enum>5.</enum><header>Effective
			 date</header>
			<subsection id="HB3943A0713AF4467B0FF47D1F1695749"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">This Act and the
			 amendments made by this Act shall take effect 30 days after the date of
			 enactment of this Act.</text>
			</subsection><subsection id="H7EC9FFAB9BC54589B0F4DB1E90A861AD"><enum>(b)</enum><header>Applicability
			 rule</header>
				<paragraph id="H26C2F2CC5D1A44E6959491A144983E21"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the amendment made
			 by section 4 shall apply with respect to any violation occurring before, on, or
			 after the effective date of this Act.</text>
				</paragraph><paragraph id="HEF2E8917494A466A893B58E3949D1AB8"><enum>(2)</enum><header>Exception</header><text>The
			 amendment made by section 4 shall not apply with respect to an alleged
			 violation if, before the effective date of this Act—</text>
					<subparagraph id="HDA39A962E3FB477190C5F2F9BF9CAAD1"><enum>(A)</enum><text>the Special
			 Counsel has presented a complaint for disciplinary action, under section 1215
			 of title 5, United States Code, with respect to the alleged violation;
			 or</text>
					</subparagraph><subparagraph id="H2765BF7E6C2C40C8939ED8198BD494C7"><enum>(B)</enum><text>the employee
			 alleged to have committed the violation has entered into a signed settlement
			 agreement with the Special Counsel with respect to the alleged violation.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
