		<official-title>To amend title XVI of the Social Security Act to clarify
		  that the value of certain funeral and burial arrangements are not to be
		  considered available resources under the supplemental security income
		  program.</official-title>

		<section display-inline="no-display-inline" id="H6F7E8C6A32FD4CB0B11084A71BE5D11E" section-type="section-one"><enum>1.</enum><header>Certain funeral and burial
			 arrangements not considered resources</header>
			<subsection id="H9F67D604D76C461F826405240FCB1A71"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1613(e)(3) of
			 the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1382b(e)(3)) is amended by adding at the end the following:</text>
				<quoted-block act-name="Social Security Act" id="HA3132372FAA94A8FB285E9A1F14FB188">
					<subparagraph id="HE8FB4D603AEF4E8C8BB4ED10698C61C8" indent="up2"><enum>(C)</enum><text>If—</text>
						<clause id="H3E3E4149FA0F4F56A21825F02ED82A40"><enum>(i)</enum><text>an individual or the individual’s
				spouse enters into an irrevocable contract with a provider of funeral goods and
				services for a funeral;</text>
						</clause><clause id="H6AB5B3BCFE3645A793DDD99B8DF324BA"><enum>(ii)</enum><text>the individual or the individual’s
				spouse funds the contract by paying for the goods and services; and</text>
						</clause><clause id="HADA34C963E5A41DD9338D8BC75B9214D"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HE38A3AFAF00A46E583DDA575ABC1A06A"><enum>(I)</enum><text>the funeral provider
				subsequently places the funds in a trust or in escrow; or</text>
							</subclause><subclause id="HF67FF90435D042A38959B76493BA40FF" indent="up1"><enum>(II)</enum><text>the individual or the individual’s
				spouse establishes an irrevocable trust, and the funeral provider is the named
				beneficiary of the trust,</text>
							</subclause></clause><continuation-text continuation-text-level="subparagraph">then
				the trust or escrow shall not be considered a resource available to the
				individual.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9E751D7450DC44BFB1D19054216B3195"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to payments
			 for supplemental security income benefits under title XVI of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> for months
			 beginning 90 days or more after the date of the enactment of this Act.</text>
