		<official-title>To amend the Lacey Act Amendments of 1981 to clarify
		  provisions enacted by the Captive Wildlife Safety Act, to further the
		  conservation of certain wildlife species, and for other
		  purposes.</official-title>

		<section id="HBEC8CCA0DB794BB79F596864A7FB987A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Big Cats and Public Safety Protection
			 Act</short-title></quote>.</text>
		</section><section id="H4BCBDDDBAE04492ABFA7D44FD8958301"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="H5FA42626D99B403FA69972D467C79024"><enum>(1)</enum><text display-inline="yes-display-inline">The global illicit trade in wildlife may be
			 worth up to $20,000,000,000 annually and the value of United States legal
			 wildlife trade was recently estimated at $2,800,000,000 annually.</text>
			</paragraph><paragraph id="HF93610EA4A724BBF96A7F7055AFE0B0A"><enum>(2)</enum><text>The illegal trade
			 in prohibited wildlife species (as that term is defined in the Lacey Act
			 Amendments of 1981) stimulates demand and expands markets in which those
			 species can be illegally sold.</text>
			</paragraph><paragraph id="HFDBDB0A7006643C4B69C64FEA733A1F9"><enum>(3)</enum><text>The private
			 ownership of and commerce in prohibited wildlife species has a substantial and
			 detrimental effect on the health and general welfare of the American people and
			 on the species themselves.</text>
			</paragraph><paragraph id="H6B5624004BD74EDC99129E9AAA33125D"><enum>(4)</enum><text>Activities related
			 to prohibited wildlife species that are not an integral part of the interstate
			 or foreign commerce in such species, such as private ownership and possession,
			 nonetheless have a substantial and direct effect upon interstate commerce
			 because—</text>
				<subparagraph id="HE79945AA351D4B5CA2C62EC39C6FE040"><enum>(A)</enum><text>after breeding,
			 many prohibited wildlife species are transported in interstate commerce;
			 and</text>
				</subparagraph><subparagraph id="HFD6A3AB825A84B5E8F6F82D61F271994"><enum>(B)</enum><text>privately owned
			 prohibited wildlife species have been transported in interstate commerce before
			 transfer of ownership.</text>
				</subparagraph></paragraph><paragraph id="H79AC4A94FA1E4091B6B84155037779E4"><enum>(5)</enum><text>Private ownership
			 of prohibited wildlife species contributes to swelling the interstate traffic
			 in those species.</text>
			</paragraph><paragraph id="HAD11E8B66812482DA0DA528749181D4F"><enum>(6)</enum><text>Prohibited
			 wildlife species in private ownership or possession, or distributed intrastate,
			 are fungible commodities that cannot be differentiated from prohibited wildlife
			 species possessed or distributed interstate. Thus, it is not feasible to
			 distinguish, in terms of control, between prohibited wildlife species in
			 private ownership or possession or distributed intrastate and prohibited
			 wildlife species possessed and distributed interstate.</text>
			</paragraph><paragraph id="H6086D3D296954861931E30E9CFFCD5DD"><enum>(7)</enum><text>Federal control of
			 the intrastate private ownership and breeding of prohibited wildlife species is
			 essential to the effective control of the interstate incidents of traffic in
			 such species.</text>
			</paragraph><paragraph id="H42293A5818674DE1A4E47E3E9BCF25E3"><enum>(8)</enum><text>The United States
			 is a party to the Convention on International Trade in Endangered Species of
			 Wild Fauna and Flora, which was designed to protect species of wild fauna and
			 flora against over-exploitation through international trade.</text>
			</paragraph></section><section id="H283D5D7F3350448C9F374F3F58A18F30"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 2 of the Lacey Act Amendments of
			 1981 (16 U.S.C. 3371) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H3C518B9EE58A4938BB5F620D10E396D0" style="OLC">
				<subsection id="id273E660418204F968ECB63C24EE40E5E"><enum>(l)</enum><header>Breed</header><text display-inline="yes-display-inline">The term <term>breed</term> means to
				facilitate the reproduction of a prohibited wildlife species for commercial
				use.</text>
				</subsection><after-quoted-block>. </after-quoted-block></quoted-block>
		</section><section id="HDA815BDC390C4A8CBC836C661C893882"><enum>4.</enum><header>Prohibitions</header><text display-inline="no-display-inline">Section 3(a) of such Act (16 U.S.C. 3372(a))
			 is amended—</text>
			<paragraph id="HC6A04FE111924509824AEE21E40CECD2"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
				<subparagraph id="H010CCCF0B3834B47B4FB900D6F42EB5F"><enum>(A)</enum><text>by adding
			 <quote>or</quote> after the semicolon at the end of subparagraph (A);
			 and</text>
				</subparagraph><subparagraph id="HA56BA5DCB41D4656B4677334F8BA5EFA"><enum>(B)</enum><text>by striking
			 subparagraph (C);</text>
				</subparagraph></paragraph><paragraph id="HDDD7FBDD9A444A779EA48C3122CE066B"><enum>(2)</enum><text>by striking
			 <quote>or</quote> after the semicolon at the end of paragraph (3), by
			 redesignating paragraph (4) as paragraph (5), and by inserting after paragraph
			 (3) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H8D37C5FD332D4926925DD1BF954958D5" style="OLC">
					<paragraph id="H3D928D3043774E4BB0F182180D4FA27C"><enum>(4)</enum><text display-inline="yes-display-inline">subject to subsection (e), to import,
				export, transport, sell, receive, acquire, purchase, breed, possess, or own any
				prohibited wildlife species; or</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HB42FAABD5B8E470D86EA234BFA5A7EC1"><enum>(3)</enum><text>in paragraph (5),
			 as so redesignated, by striking <quote>(1) through (3)</quote> and inserting
			 <quote>(1) through (4)</quote>.</text>
			</paragraph></section><section id="HC08EE3F5DD28449F8E370C81992B92ED"><enum>5.</enum><header>Nonapplicability
			 of offenses</header>
			<subsection id="H0ACB9FA4D18E48E9A49B1776B377EFAE"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 3(e) of such
			 Act (16 U.S.C. 3372(e)) is amended—</text>
				<paragraph id="HF259063250E848FDA3566C83E48A5367"><enum>(1)</enum><text>by amending
			 paragraph (1) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H404043436F0B4A549F1999AE60D401F3" style="OLC">
						<paragraph id="HF42861A092694B71A9189B703083B4C3"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subsection (a)(4)
				does not apply to—</text>
							<subparagraph id="HAF18F7FAF379470AADE7DD81076245B2"><enum>(A)</enum><text>importation,
				exportation, transportation, sale, receipt, acquisition, breeding, possession,
				ownership, or purchase of an animal of a prohibited wildlife species, by a
				person that, under regulations prescribed under paragraph (3), is described in
				subparagraph (A), (B), (C), or (D) paragraph (2) with respect to that species;
				and</text>
							</subparagraph><subparagraph id="H7E208BBCF08A47C08D95961637A3832A"><enum>(B)</enum><text>transportation,
				possession, or ownership of an animal of a prohibited wildlife species, by a
				person that, under regulations prescribed under paragraph (3), is described in
				subparagraph (E) of paragraph (2) with respect to that
				animal.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF6969465290743CE9C0003B1AF6A85DD"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="H8D93B0A383B8466C9AB8211E0ED7F2BF"><enum>(A)</enum><text>by amending
			 subparagraph (A) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H0C16C84FCE314C21BF9C9E241AA13570" style="OLC">
							<subparagraph id="H6D51660AA73C406A912BFF7C667BF3FD"><enum>(A)</enum><text display-inline="yes-display-inline">is a zoo accredited by the Association of
				Zoos and Aquariums;</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H3B195E20C95448F2A3DD53617FD4692B"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (C)—</text>
						<clause id="HB4D77CD40CE6446EA531853BA858EF1E"><enum>(i)</enum><text>by
			 striking <quote>is an accredited</quote>;</text>
						</clause><clause id="HCC02F895EED945D88279F6A50E564D0E"><enum>(ii)</enum><text>in
			 clause (iii), by striking <quote>and</quote>;</text>
						</clause><clause id="H9F7BFAE6081C46409D00770A37D3C647"><enum>(iii)</enum><text>in
			 clause (iv), by striking <quote>or</quote> and inserting <quote>and</quote>;
			 and</text>
						</clause><clause id="H72A772AD493D43C694C5DB07076BD381"><enum>(iv)</enum><text>by
			 adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="H11915FA7F9E4410E8EC36E1729D4F1BE" style="OLC">
								<clause id="H901C6729AAD5415DAAA2E63BBA231554"><enum>(v)</enum><text display-inline="yes-display-inline">does not allow the transport and display of
				animals
				off-site;</text>
								</clause><after-quoted-block>;</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="H893FAD648A9D46CFA74869AA4060CF5A"><enum>(C)</enum><text>in subparagraph
			 (D), by striking the period at the end and inserting <quote>; or</quote>;
			 and</text>
					</subparagraph><subparagraph id="H916625C136784E80A72A9BDE644DF9D0"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H74F47457BE964F4FBADAE81F8762783A" style="OLC">
							<subparagraph id="H9B8CE1E3D6994E52AD0B60C5D60F2955"><enum>(E)</enum><text display-inline="yes-display-inline">is in possession of one or more animals of
				the prohibited wildlife species, that—</text>
								<clause id="H7FD5391E399349229EE909FDA0D229BE"><enum>(i)</enum><text>were born before
				the date of enactment of <short-title>this
				subparagraph</short-title>; and</text>
								</clause><clause id="H7DF409968E1344689410EFB64B002DE9"><enum>(ii)</enum><text>are registered
				with the Animal and Plant Health Inspection Service within 6 months after the
				date of promulgation of regulations implementing this subparagraph by the
				Secretary of the Interior and the Secretary of
				Agriculture.</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="HBA4FE47ADA334799B122B2A230A69018"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
			 enactment of this Act the Secretary of the Interior, acting through the United
			 States Fish and Wildlife Service, and the Secretary of Agriculture, acting
			 through the Animal and Plant Health Inspection Service, shall promulgate
			 regulations implementing the amendments made by this section.</text>
			</subsection></section><section id="H9E6A91532D644856AB273B4B19C1C2A3"><enum>6.</enum><header>Penalties</header>
			<subsection id="H52C683CCFE4442F7A43799272F0A7042"><enum>(a)</enum><header>Civil
			 penalties</header><text display-inline="yes-display-inline">Section 4(a)(1) of
			 such Act (16 U.S.C. 3373(a)(1)) is amended—</text>
				<paragraph id="H551397876ECD4AF6ADC017B3BDBAEE3E"><enum>(1)</enum><text>by inserting
			 <quote>(a)(4),</quote> after <quote>subsections</quote>; and</text>
				</paragraph><paragraph id="HF6FABAF0E95D4108AC8B7315141DE985"><enum>(2)</enum><text>by striking
			 <quote>subsection (d)</quote> and inserting <quote>subsection (a)(4),
			 (d),</quote>.</text>
				</paragraph></subsection><subsection id="H0819447542C44736A75B105EA990FB60"><enum>(b)</enum><header>Criminal
			 penalties</header><text>Section 4(d) of such Act (16 U.S.C. 3373(d)) is
			 amended—</text>
				<paragraph id="H2C9BEF6537B541BDBF5023056C47D780"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="H545505DF58FC428E994EAD683C5414C8"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>or</quote> after the comma at the end;</text>
					</subparagraph><subparagraph id="H9ECA5B82000741B4ABF7A630E8D4D6C6"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by adding
			 <quote>or</quote> after the comma at the end; and</text>
					</subparagraph><subparagraph id="H5E0CC78B374140A3A2221A0FFBA8F8E7"><enum>(C)</enum><text>by inserting after
			 subparagraph (B) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H0AFCE904B5444C9599B3834A07F8DDA1" style="OLC">
							<subparagraph id="H4969D984E7554C9186A87B566A2885C1"><enum>(C)</enum><text display-inline="yes-display-inline">knowingly violates paragraph (4) of section
				3(a),</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H6A4958A9EF5A41AC8707B26D309F35CC"><enum>(2)</enum><text>in paragraph (2),
			 by inserting <quote>, or in the exercise of due care should know that the
			 conduct violates paragraph (4) of section 3(a),</quote> after <quote>treaty or
			 regulation</quote>.</text>
				</paragraph></subsection></section><section id="H9E08A0A8100F4BBBBC36B946C821AA87"><enum>7.</enum><header>Forfeiture</header><text display-inline="no-display-inline">Section 5(a) of such Act (16 U.S.C. 3374(a))
			 is amended—</text>
			<paragraph id="H8B0EB177685A47F281D25C1017D45D5E"><enum>(1)</enum><text>in paragraph (1),
			 by inserting <quote>bred, possessed, owned,</quote> after
			 <quote>acquired,</quote>; and</text>
			</paragraph><paragraph id="H836F0E79B4E64237BB4234A073DD012B"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
				<subparagraph id="HD571795DEAFE471B90AB8C100C43A81F"><enum>(A)</enum><text>by inserting
			 <quote>breeding, possessing, owning,</quote> after <quote>acquiring,</quote>;
			 and</text>
				</subparagraph><subparagraph id="H51E671157724405187AC5D6DB43B8DCC"><enum>(B)</enum><text>by inserting
			 <quote>or involved the breeding, possession, or ownership of a prohibited
			 wildlife species</quote>.</text>
				</subparagraph></paragraph></section></legis-body>
