		<section id="H1BA36F3211B744AF96CC01F75280C797" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Regulatory Accountability and Economic
			 Freedom Act of 2012</short-title></quote>.</text>
		</section><title id="H3FDCD7C02E544C4BA451A2733D95ECE9"><enum>I</enum><header>Regulatory
			 Accountability</header>
			<section id="HB15E8DA1ACAC42BFB5879FCAD3D22034"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 551 of title 5, United States Code,
			 is amended—</text>
				<paragraph id="H84DD76458FC54AADAA120F0B4EED4258"><enum>(1)</enum><text>in paragraph (13),
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H640CC69623314D458C8B2E3A75FBFAE5"><enum>(2)</enum><text>in paragraph (14),
			 by striking the period at the end and inserting a semicolon; and</text>
				</paragraph><paragraph id="HC051C8A99C044FA9AC03D50E3562C59A"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H5028F34696D34DBBB8C2FF200C7D8DAD" style="OLC">
						<paragraph id="H0DD1535BC7A0478B81F642E875BB82D1"><enum>(15)</enum><text><term>major
				rule</term> means any rule that the Administrator of the Office of Information
				and Regulatory Affairs determines is likely to impose—</text>
							<subparagraph id="HDA2F7E0387B94ACFAE9197CAA8194E24"><enum>(A)</enum><text>an annual effect
				on the economy of $100,000,000 or more, adjusted annually for inflation;</text>
							</subparagraph><subparagraph id="H80238E29B7BF47AAAC7B7B046BAA8186"><enum>(B)</enum><text>a major increase
				in costs or prices for consumers, individual industries, Federal, State, local,
				or tribal government agencies, or geographic regions;</text>
							</subparagraph><subparagraph id="H28A883811A3544DEB52B55219B6AAF21"><enum>(C)</enum><text>significant
				adverse effects on competition, employment, investment, productivity,
				innovation, or on the ability of United States-based enterprises to compete
				with foreign-based enterprises in domestic and export markets; or</text>
							</subparagraph><subparagraph id="HACECDC34F5494CD481BD4798CA931B1B"><enum>(D)</enum><text>significant
				impacts on multiple sectors of the economy; and</text>
							</subparagraph></paragraph><paragraph id="H1E9F69C4B4DE405EA90768A742A7CF4D"><enum>(16)</enum><text><term>high-impact
				rule</term> means any rule that the Administrator of the Office of Information
				and Regulatory Affairs determines is likely to impose an annual cost on the
				economy of $1,000,000,000 or more, adjusted annually for
				inflation.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H41C460685D294BD2A7B70872E458CCFE"><enum>102.</enum><header>Rule
			 making</header>
				<subsection id="H3ED690FD3BD44A7092172F7A7496569F"><enum>(a)</enum><text>Section 553(a) of
			 title 5, United States Code, is amended by striking <quote>(a) This section
			 applies</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">Applicability</header-in-text>.—This section
			 applies</quote>.</text>
				</subsection><subsection id="HA20656589F9E44FF83337FCDA0993A3D"><enum>(b)</enum><text>Section 553 of
			 title 5, United States Code, is amended by striking subsections (b) through (c)
			 and inserting the following:</text>
					<quoted-block id="HA2AC919C87A945589785D33CB3055249" style="OLC">
						<subsection id="HEB952978DEF04FCEB040CBE97BCF2AF2"><enum>(b)</enum><header>Rule making
				considerations</header><text>In a rule making, an agency shall make all
				preliminary and final factual determinations based on evidence and consider, in
				addition to other applicable considerations, the following:</text>
							<paragraph id="H378F81B1ED5B4F61BD14AD04DA8526BB"><enum>(1)</enum><text>The legal
				authority under which a rule may be proposed, including whether a rule making
				is required by statute, and if so, whether by a specific date, or whether the
				agency has discretion to commence a rule making.</text>
							</paragraph><paragraph id="H08DD8CE5BEC44F8897309C4DFE14BC62"><enum>(2)</enum><text>Other statutory
				considerations applicable to whether the agency can or should propose a rule or
				undertake other agency action.</text>
							</paragraph><paragraph id="H869FF35D64BD4CA3BA6C68D599DD66A2"><enum>(3)</enum><text>The specific
				nature and significance of the problem the agency may address with a rule
				(including the degree and nature of risks the problem poses and the priority of
				addressing those risks compared to other matters or activities within the
				agency’s jurisdiction), whether the problem warrants new agency action, and the
				countervailing risks that may be posed by alternatives for new agency
				action.</text>
							</paragraph><paragraph id="H01BDC88CB3244337980DF37641450D95"><enum>(4)</enum><text>Whether existing
				rules have created or contributed to the problem the agency may address with a
				rule and whether those rules could be amended or rescinded to address the
				problem in whole or part.</text>
							</paragraph><paragraph id="HECFEF130484A412F8F9B10CB4E8AEDB4"><enum>(5)</enum><text>Any reasonable
				alternatives for a new rule or other response identified by the agency or
				interested persons, including not only responses that mandate particular
				conduct or manners of compliance, but also—</text>
								<subparagraph id="H229E08703EAE45BAAF200D4BB0169D48"><enum>(A)</enum><text>the alternative of
				no Federal response;</text>
								</subparagraph><subparagraph id="HFC223271309B447BAE0BD036E13ED4D2"><enum>(B)</enum><text>amending or
				rescinding existing rules;</text>
								</subparagraph><subparagraph id="H77517E54B8A14F689F6B899CF923208A"><enum>(C)</enum><text>potential
				regional, State, local, or tribal regulatory action or other responses that
				could be taken in lieu of agency action; and</text>
								</subparagraph><subparagraph id="H6D440691E35545CE88EFE30D2257CD3D"><enum>(D)</enum><text>potential
				responses that—</text>
									<clause id="HD1A3801483AD44978D8DC69EA59D4248"><enum>(i)</enum><text>specify
				performance objectives rather than conduct or manners of compliance;</text>
									</clause><clause id="H72684CA7ECDA41B8B1A12982615CE854"><enum>(ii)</enum><text>establish
				economic incentives to encourage desired behavior;</text>
									</clause><clause id="H5E66E499A3EC40FD9CC333B69DE50894"><enum>(iii)</enum><text>provide
				information upon which choices can be made by the public; or</text>
									</clause><clause id="HC7EECE92C32343CE81E2CDBCDC1225D2"><enum>(iv)</enum><text>incorporate other
				innovative alternatives rather than agency actions that specify conduct or
				manners of compliance.</text>
									</clause></subparagraph></paragraph><paragraph id="H66EFB091C9FE45178209427DE56DB7E9"><enum>(6)</enum><text>Notwithstanding
				any other provision of law—</text>
								<subparagraph id="H0EE7F99EC1814F83BE12F55FC8A97E5E"><enum>(A)</enum><text display-inline="yes-display-inline">the potential costs and benefits associated
				with potential alternative rules and other responses considered under section
				553(b)(5), including direct, indirect, and cumulative costs and benefits and
				estimated impacts on jobs (including an estimate of the net gain or loss in
				domestic jobs), economic growth, innovation, and economic
				competitiveness;</text>
								</subparagraph><subparagraph id="H53063FB9BCE64567A8A1D57C19E9F016"><enum>(B)</enum><text>means to increase
				the cost-effectiveness of any Federal response; and</text>
								</subparagraph><subparagraph id="H7B1D251A96AA4903A037E70F5842A17F"><enum>(C)</enum><text>incentives for
				innovation, consistency, predictability, lower costs of enforcement and
				compliance (to Government entities, regulated entities, and the public), and
				flexibility.</text>
								</subparagraph></paragraph></subsection><subsection id="HBB432D921759453E8CF267DEA18BD70A"><enum>(c)</enum><header>Advance notice
				of proposed rule making for major rules, high-Impact rules, and rules involving
				novel legal or policy issues</header><text>In the case of a rule making for a
				major rule or high-impact rule or a rule that involves a novel legal or policy
				issue arising out of statutory mandates, not later than 90 days before a notice
				of proposed rule making is published in the Federal Register, an agency shall
				publish advance notice of proposed rule making in the Federal Register. In
				publishing such advance notice, the agency shall—</text>
							<paragraph id="H82174BCB618F4091BD99C593907AACFB"><enum>(1)</enum><text>include a written
				statement identifying, at a minimum—</text>
								<subparagraph id="HD3DCA58B8A964F748B7DBB5DB00E53A8"><enum>(A)</enum><text>the nature and
				significance of the problem the agency may address with a rule, including data
				and other evidence and information on which the agency expects to rely for the
				proposed rule;</text>
								</subparagraph><subparagraph id="HB2278D96CB1D4C0DBDB444FDAB1E5782"><enum>(B)</enum><text>the legal
				authority under which a rule may be proposed, including whether a rule making
				is required by statute, and if so, whether by a specific date, or whether the
				agency has discretion to commence a rule making;</text>
								</subparagraph><subparagraph id="H5A02E60967FF40529B0225ED159A7C56"><enum>(C)</enum><text>preliminary
				information available to the agency concerning the other considerations
				specified in subsection (b);</text>
								</subparagraph><subparagraph id="H1B0C3A484DF2427E913A6EEB9DFAAC04"><enum>(D)</enum><text display-inline="yes-display-inline">an explanation of how addressing the
				problem will help the agency meet its performance goals reported to Congress
				under the Government Performance and Results Act; and</text>
								</subparagraph><subparagraph id="H0381E57DD2D24BCAAE2CEDCD3A1408C1"><enum>(E)</enum><text>in the case of a
				rule that involves a novel legal or policy issue arising out of statutory
				mandates, the nature of and potential reasons to adopt the novel legal or
				policy position upon which the agency may base a proposed rule;</text>
								</subparagraph></paragraph><paragraph id="H0D6A215903D243F899F2FD5D931F05BC"><enum>(2)</enum><text>make publicly
				available any data used in any cost-benefit analysis conducted by the agency
				for purposes of the rule making;</text>
							</paragraph><paragraph id="H5B57FA3A2EEA4F7287FA682BA75DDEA0"><enum>(3)</enum><text>solicit written
				data, views or argument from interested persons concerning the information and
				issues addressed in the advance notice; and</text>
							</paragraph><paragraph id="H1C6D206AC93E4E94BE599D774F2BC5C7"><enum>(4)</enum><text>provide for a
				period of not fewer than 60 days for interested persons to submit such written
				data, views, or argument to the
				agency.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H9DA46FA62B8F4D90A02E93816E99061B"><enum>103.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act to sections 553 of title 5, United States Code, shall not apply to any
			 rule makings pending or completed on the date of enactment of this Act.</text>
			</section></title><title id="H2CA1CDD4D8F846CD9BC52993371F092D"><enum>II</enum><header>Congressional
			 Review of Agency Rule Making</header>
			<section commented="no" id="HA26F1743449A4AF98F500D09D25E2A8A"><enum>201.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to increase
			 accountability for and transparency in the Federal regulatory process. Section
			 1 of article I of the United States Constitution grants all legislative powers
			 to Congress. Over time, Congress has excessively delegated its constitutional
			 charge while failing to conduct appropriate oversight and retain accountability
			 for the content of the laws it passes. By requiring a vote in Congress, the
			 REINS Act will result in more carefully drafted and detailed legislation, an
			 improved regulatory process, and a legislative branch that is truly accountable
			 to the American people for the laws imposed upon them.</text>
			</section><section id="H786F16B11CD248D3B9A1B402EC582958"><enum>202.</enum><header>Congressional
			 review of agency rule making</header><text display-inline="no-display-inline">Chapter 8 of title 5, United States Code, is
			 amended to read as follows:</text>

						<section commented="no" display-inline="no-display-inline" id="HB1F99B11E9314628A875AC0657CAE2C8" section-type="subsequent-section"><enum>801.</enum><header display-inline="yes-display-inline">Congressional review</header>
							<subsection commented="no" display-inline="no-display-inline" id="H5A9E4F7B4ABF4BE38A6560C7381650C9"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HA64DEEBEE05F46BF8932ECBE7AB554D2"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H1DF4B95E28CA42D9AB062979BF042D30"><enum>(A)</enum><text display-inline="yes-display-inline">Before a rule may take effect, the Federal
				agency promulgating such rule shall submit to each House of the Congress and to
				the Comptroller General a report containing—</text>
										<clause commented="no" display-inline="no-display-inline" id="HEAB78CDC181E476A9CA7C72FCF692451" indent="up2"><enum>(i)</enum><text display-inline="yes-display-inline">a copy of the rule;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HCEF92E4FA24648E1ABBC3608CEDF3DFF" indent="up2"><enum>(ii)</enum><text display-inline="yes-display-inline">a
				concise general statement relating to the rule;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H5C4D0E3E35DA465A85E5EAC5712E29A3" indent="up2"><enum>(iii)</enum><text display-inline="yes-display-inline">a classification of the rule as a major or
				nonmajor rule, including an explanation of the classification specifically
				addressing each criteria for a major rule contained within sections 804(2)(A),
				804(2)(B), and 804(2)(C);</text>
										</clause><clause id="HC528DE84C351413A8ECA98D7BFF61FED" indent="up2"><enum>(iv)</enum><text>a list of any other related
				regulatory actions intended to implement the same statutory provision or
				regulatory objective as well as the individual and aggregate economic effects
				of those actions; and</text>
										</clause><clause id="H7DDBF627D36F44508054F1556E6E228B" indent="up2"><enum>(v)</enum><text>the proposed effective date of the
				rule.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H802C6419B72145AF8F6D20D1815B5031" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">On the date of the submission of the report
				under subparagraph (A), the Federal agency promulgating the rule shall submit
				to the Comptroller General and make available to each House of Congress—</text>
										<clause commented="no" display-inline="no-display-inline" id="H5322C7DC64E442ADB1B6DC18DEE89BF0"><enum>(i)</enum><text display-inline="yes-display-inline">a complete copy of the cost-benefit
				analysis of the rule, if any, including an analysis of any jobs added or lost,
				differentiating between public and private sector jobs;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HBF4A1F2408884AE5B1C7D64759D947A8"><enum>(ii)</enum><text display-inline="yes-display-inline">the agency’s actions pursuant to sections
				603, 604, 605, 607, and 609 of this title;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HE314572B5F794415AA18599A2B4C2AA9"><enum>(iii)</enum><text display-inline="yes-display-inline">the agency’s actions pursuant to sections
				202, 203, 204, and 205 of the Unfunded Mandates Reform Act of 1995; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H79076025D15C418889931915F3A29F85"><enum>(iv)</enum><text display-inline="yes-display-inline">any other relevant information or
				requirements under any other Act and any relevant Executive orders.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9FF0291D8F2443C59C0AF028D3CBAAC1" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">Upon receipt of a report submitted under
				subparagraph (A), each House shall provide copies of the report to the chairman
				and ranking member of each standing committee with jurisdiction under the rules
				of the House of Representatives or the Senate to report a bill to amend the
				provision of law under which the rule is issued.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H213372D4DA9D4D33B62624EDFCDF15A1" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H2D3A5E1842B54A0DB3BEA51D9620090A"><enum>(A)</enum><text display-inline="yes-display-inline">The Comptroller General shall provide a
				report on each major rule to the committees of jurisdiction by the end of 15
				calendar days after the submission or publication date as provided in section
				802(b)(2). The report of the Comptroller General shall include an assessment of
				the agency’s compliance with procedural steps required by paragraph
				(1)(B).</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA2355EE5B54D4D978C2E7FBAAC4FC346" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Federal agencies shall cooperate with the
				Comptroller General by providing information relevant to the Comptroller
				General’s report under subparagraph (A).</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H688514747ABC4359A6635745CA7024B2" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">A
				major rule relating to a report submitted under paragraph (1) shall take effect
				upon enactment of a joint resolution of approval described in section 802 or as
				provided for in the rule following enactment of a joint resolution of approval
				described in section 802, whichever is later.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB443C298FFD648F9AE797CDC567DBA69" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">A
				nonmajor rule shall take effect as provided by section 803 after submission to
				Congress under paragraph (1).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H03C1A150A32B4E79A86C6655DD87B111" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">If a joint resolution of approval relating
				to a major rule is not enacted within the period provided in subsection (b)(2),
				then a joint resolution of approval relating to the same rule may not be
				considered under this chapter in the same Congress by either the House of
				Representatives or the Senate.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H78F379872DEC464E936F1FE27363F8C0"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HDFF0FAF3B44E4DD9B45F4FB745F594B9"><enum>(1)</enum><text display-inline="yes-display-inline">A major rule shall not take effect unless
				the Congress enacts a joint resolution of approval described under section
				802.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H34C6AF4E0F9D420BAC639B895BD04756" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If a joint resolution described in
				subsection (a) is not enacted into law by the end of 70 session days or
				legislative days, as applicable, beginning on the date on which the report
				referred to in section 801(a)(1)(A) is received by Congress (excluding days
				either House of Congress is adjourned for more than 3 days during a session of
				Congress), then the rule described in that resolution shall be deemed not to be
				approved and such rule shall not take effect.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3FE152F498E44ADEBE4BECE5B1D3AA2E"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HC8A020F20C864F36BAB421CCAEA573A7"><enum>(1)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				section (except subject to paragraph (3)), a major rule may take effect for one
				90-calendar-day period if the President makes a determination under paragraph
				(2) and submits written notice of such determination to the Congress.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7E473BBCBF634BFA872F95AEAE5875A8" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Paragraph (1) applies to a determination
				made by the President by Executive order that the major rule should take effect
				because such rule is—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HF1DEB809BA7645D2BDD21E44BC6D2428"><enum>(A)</enum><text display-inline="yes-display-inline">necessary because of an imminent threat to
				health or safety or other emergency;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H214B682657664386A4F5403CFB0B4C8C"><enum>(B)</enum><text display-inline="yes-display-inline">necessary for the enforcement of criminal
				laws;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2B9A693373AC46A6812CCAF49A5833C5"><enum>(C)</enum><text display-inline="yes-display-inline">necessary for national security; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1A1AFF7B4A614CD2AFE937287CA4701E"><enum>(D)</enum><text display-inline="yes-display-inline">issued pursuant to any statute implementing
				an international trade agreement.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H474D3D21105B4CF194E53B60B217529D" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">An exercise by the President of the
				authority under this subsection shall have no effect on the procedures under
				section 802.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H61A133180A33445094310F17DC2BC153"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HDDA9E7393C5F4FA08AB4AD0833E0107E"><enum>(1)</enum><text display-inline="yes-display-inline">In addition to the opportunity for review
				otherwise provided under this chapter, in the case of any rule for which a
				report was submitted in accordance with subsection (a)(1)(A) during the period
				beginning on the date occurring—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H8CDAF4BFEE7F4C78906916869DC25713" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of the Senate, 60 session days,
				or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H18C64E78B0BB41D289D9E52271D6A0C4" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of the House of
				Representatives, 60 legislative days,</text>
									</subparagraph></paragraph><continuation-text commented="no" continuation-text-level="subsection">before the date the Congress is
				scheduled to adjourn a session of Congress through the date on which the same
				or succeeding Congress first convenes its next session, sections 802 and 803
				shall apply to such rule in the succeeding session of Congress.</continuation-text><paragraph commented="no" display-inline="no-display-inline" id="HC6864A8153854BC89D4254406A232BF8" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HF149606C16C14FE5ABA623C96D1F3276"><enum>(A)</enum><text display-inline="yes-display-inline">In applying sections 802 and 803 for
				purposes of such additional review, a rule described under paragraph (1) shall
				be treated as though—</text>
										<clause commented="no" display-inline="no-display-inline" id="H1B5BB61113D543C39BC3138FB48A18A6" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">such rule were published in the Federal
				Register on—</text>
											<subclause commented="no" display-inline="no-display-inline" id="H3543AB96D50A4FECB31E664B2437198D"><enum>(I)</enum><text display-inline="yes-display-inline">in the case of the Senate, the 15th session
				day, or</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="H50C7BEB6FE20422DB6F8104708B8B60E"><enum>(II)</enum><text display-inline="yes-display-inline">in the case of the House of
				Representatives, the 15th legislative day,</text>
											</subclause><continuation-text commented="no" continuation-text-level="clause">after the succeeding session of Congress
				first convenes; and</continuation-text></clause><clause commented="no" display-inline="no-display-inline" id="H770351C28B01466E9094AF6E79A12D90" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">a
				report on such rule were submitted to Congress under subsection (a)(1) on such
				date.</text>
										</clause></subparagraph><subparagraph id="H54BE6CFFCC184F9092EB2B77A54F004B" indent="up1"><enum>(B)</enum><text>Nothing in this paragraph shall be
				construed to affect the requirement under subsection (a)(1) that a report shall
				be submitted to Congress before a rule can take effect.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDBC55A87AAAC46129AA8A0E405661CBC" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">A
				rule described under paragraph (1) shall take effect as otherwise provided by
				law (including other subsections of this section).</text>
								</paragraph></subsection></section><section id="H39B951C82D8045D999398FCF8E29ED4E"><enum>802.</enum><header>Congressional
				approval procedure for major rules</header>
							<subsection id="H61D481F0A3764828BC1A99A7C659A20E"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H3F3AC6EB899549BE935838E674D83E69"><enum>(1)</enum><text>For purposes of this
				section, the term <term>joint resolution</term> means only a joint resolution
				addressing a report classifying a rule as major pursuant to section
				801(a)(1)(A)(iii) that—</text>
									<subparagraph id="H867E81A2E32844E5879DF17FEA4A750E" indent="up1"><enum>(A)</enum><text>bears no preamble;</text>
									</subparagraph><subparagraph id="H5AD4F8D8B0CB41F3A11F3A442B764D30" indent="up1"><enum>(B)</enum><text>bears the following title (with blanks
				filled as appropriate): <quote>Approving the rule submitted by ___ relating to
				___.</quote>;</text>
									</subparagraph><subparagraph id="HCFE0564B2E4D4B10943C4AED1AA0E71F" indent="up1"><enum>(C)</enum><text>includes after its resolving clause
				only the following (with blanks filled as appropriate): <quote>That Congress
				approves the rule submitted by ___ relating to ___.</quote>; and</text>
									</subparagraph><subparagraph id="HC50C952F66FD42F7AE39F3F46966C955" indent="up1"><enum>(D)</enum><text>is introduced pursuant to paragraph
				(2).</text>
									</subparagraph></paragraph><paragraph id="H390ADB94FCC44018B89F499333C79611" indent="up1"><enum>(2)</enum><text>After a House of Congress receives a
				report classifying a rule as major pursuant to section 801(a)(1)(A)(iii), the
				majority leader of that House (or his or her respective designee) shall
				introduce (by request, if appropriate) a joint resolution described in
				paragraph (1)—</text>
									<subparagraph id="H3D37697523A84B7388817DE7C2E13C4A"><enum>(A)</enum><text>in the case of the House of
				Representatives, within three legislative days; and</text>
									</subparagraph><subparagraph id="HCA94EE9C78F745ACBB10CA889E7BE738"><enum>(B)</enum><text>in the case of the Senate, within
				three session days.</text>
									</subparagraph></paragraph><paragraph id="HA66B9C8760A54493B658DE2A9D363D9C" indent="up1"><enum>(3)</enum><text>A joint resolution described in
				paragraph (1) shall not be subject to amendment at any stage of
				proceeding.</text>
								</paragraph></subsection><subsection id="H825BBD46C1C147DA8B248B5A1669BDCB"><enum>(b)</enum><text>A joint resolution
				described in subsection (a) shall be referred in each House of Congress to the
				committees having jurisdiction over the provision of law under which the rule
				is issued.</text>
							</subsection><subsection id="H8B5920BB52A749ECA8636E11D63CAFB2"><enum>(c)</enum><text display-inline="yes-display-inline">In the Senate, if the committee or
				committees to which a joint resolution described in subsection (a) has been
				referred have not reported it at the end of 15 session days after its
				introduction, such committee or committees shall be automatically discharged
				from further consideration of the resolution and it shall be placed on the
				calendar. A vote on final passage of the resolution shall be taken on or before
				the close of the 15th session day after the resolution is reported by the
				committee or committees to which it was referred, or after such committee or
				committees have been discharged from further consideration of the
				resolution.</text>
							</subsection><subsection id="H889F7944726F4BCEA00B7DE107F767B3"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H139130E7F2ED4FE6976E4F0AB52EFAFC"><enum>(1)</enum><text>In the Senate, when the
				committee or committees to which a joint resolution is referred have reported,
				or when a committee or committees are discharged (under subsection (c)) from
				further consideration of a joint resolution described in subsection (a), it is
				at any time thereafter in order (even though a previous motion to the same
				effect has been disagreed to) for a motion to proceed to the consideration of
				the joint resolution, and all points of order against the joint resolution (and
				against consideration of the joint resolution) are waived. The motion is not
				subject to amendment, or to a motion to postpone, or to a motion to proceed to
				the consideration of other business. A motion to reconsider the vote by which
				the motion is agreed to or disagreed to shall not be in order. If a motion to
				proceed to the consideration of the joint resolution is agreed to, the joint
				resolution shall remain the unfinished business of the Senate until disposed
				of.</text>
								</paragraph><paragraph id="HF555DD0F3B8346558BBD97E7E20FB65B" indent="up1"><enum>(2)</enum><text>In the Senate, debate on the joint
				resolution, and on all debatable motions and appeals in connection therewith,
				shall be limited to not more than 2 hours, which shall be divided equally
				between those favoring and those opposing the joint resolution. A motion to
				further limit debate is in order and not debatable. An amendment to, or a
				motion to postpone, or a motion to proceed to the consideration of other
				business, or a motion to recommit the joint resolution is not in order.</text>
								</paragraph><paragraph id="HACC6B1DA0078440883ECDAD3B72C15F3" indent="up1"><enum>(3)</enum><text>In the Senate, immediately following
				the conclusion of the debate on a joint resolution described in subsection (a),
				and a single quorum call at the conclusion of the debate if requested in
				accordance with the rules of the Senate, the vote on final passage of the joint
				resolution shall occur.</text>
								</paragraph><paragraph id="HE224B65FEFAB47CE822EFE0CC8E5E74E" indent="up1"><enum>(4)</enum><text>Appeals from the decisions of the
				Chair relating to the application of the rules of the Senate to the procedure
				relating to a joint resolution described in subsection (a) shall be decided
				without debate.</text>
								</paragraph></subsection><subsection id="H6812C018A74E4F418614A8AFC06E377A"><enum>(e)</enum><text display-inline="yes-display-inline">In the House of Representatives, if any
				committee to which a joint resolution described in subsection (a) has been
				referred has not reported it to the House at the end of 15 legislative days
				after its introduction, such committee shall be discharged from further
				consideration of the joint resolution, and it shall be placed on the
				appropriate calendar. On the second and fourth Thursdays of each month it shall
				be in order at any time for the Speaker to recognize a Member who favors
				passage of a joint resolution that has appeared on the calendar for at least 5
				legislative days to call up that joint resolution for immediate consideration
				in the House without intervention of any point of order. When so called up a
				joint resolution shall be considered as read and shall be debatable for 1 hour
				equally divided and controlled by the proponent and an opponent, and the
				previous question shall be considered as ordered to its passage without
				intervening motion. It shall not be in order to reconsider the vote on passage.
				If a vote on final passage of the joint resolution has not been taken by the
				third Thursday on which the Speaker may recognize a Member under this
				subsection, such vote shall be taken on that day.</text>
							</subsection><subsection id="HF84C9106E37A40F99DEB8EAEA32405AA"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H40D41C585E154EEB8BF8935828008B5D"><enum>(1)</enum><text>If, before passing a
				joint resolution described in subsection (a), one House receives from the other
				a joint resolution having the same text, then—</text>
									<subparagraph id="H2C1514540D604E7C8FD438AAC372FB6E" indent="up1"><enum>(A)</enum><text>the joint resolution of the other
				House shall not be referred to a committee; and</text>
									</subparagraph><subparagraph id="H23FB1DEE95864EE9A4BFF74B4E12DF1B" indent="up1"><enum>(B)</enum><text>the procedure in the receiving House
				shall be the same as if no joint resolution had been received from the other
				House until the vote on passage, when the joint resolution received from the
				other House shall supplant the joint resolution of the receiving House.</text>
									</subparagraph></paragraph><paragraph id="HE97189408A414470BB09117D62D1D5E9" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">This subsection shall not apply to the
				House of Representatives if the joint resolution received from the Senate is a
				revenue measure.</text>
								</paragraph></subsection><subsection commented="no" id="H0D14007870EF424DB4E1459D19468AB1"><enum>(g)</enum><text>If either House
				has not taken a vote on final passage of the joint resolution by the last day
				of the period described in section 801(b)(2), then such vote shall be taken on
				that day.</text>
							</subsection><subsection id="H28849C99AA1B4C7C814C7BAF2E54E8CD"><enum>(h)</enum><text>This section and
				section 803 are enacted by Congress—</text>
								<paragraph id="H2E75B37D7CD14702BCF8AC587BCEBABB"><enum>(1)</enum><text>as an exercise of
				the rule making power of the Senate and House of Representatives, respectively,
				and as such is deemed to be part of the rules of each House, respectively, but
				applicable only with respect to the procedure to be followed in that House in
				the case of a joint resolution described in subsection (a) and superseding
				other rules only where explicitly so; and</text>
								</paragraph><paragraph id="H6CCF123864004222A0B1D85BEB96CD56"><enum>(2)</enum><text>with full
				recognition of the Constitutional right of either House to change the rules (so
				far as they relate to the procedure of that House) at any time, in the same
				manner and to the same extent as in the case of any other rule of that
				House.</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H9D1882A04F55484BB2ED13A66FED80CB" section-type="subsequent-section"><enum>803.</enum><header display-inline="yes-display-inline">Congressional disapproval procedure for
				nonmajor rules</header>
							<subsection commented="no" display-inline="no-display-inline" id="H1B16596939E64A2892A1898B6C1C2300"><enum>(a)</enum><text display-inline="yes-display-inline">For purposes of this section, the term
				<term>joint resolution</term> means only a joint resolution introduced in the
				period beginning on the date on which the report referred to in section
				801(a)(1)(A) is received by Congress and ending 60 days thereafter (excluding
				days either House of Congress is adjourned for more than 3 days during a
				session of Congress), the matter after the resolving clause of which is as
				follows: <quote>That Congress disapproves the nonmajor rule submitted by the
				___ relating to ___ , and such rule shall have no force or effect.</quote> (The
				blank spaces being appropriately filled in).</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H3E5BE3D8F2B14CFBBD42C9640C3975FE"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HA015B7FF616A43C4A4BEA02DCD6DD162"><enum>(1)</enum><text display-inline="yes-display-inline">A joint resolution described in subsection
				(a) shall be referred to the committees in each House of Congress with
				jurisdiction.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC8D3EC6481944C25BE089EA2D0BC1A80" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of this section, the term
				submission or publication date means the later of the date on which—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H904E1B8ABE2F473E88D5DE8DC26520E4"><enum>(A)</enum><text display-inline="yes-display-inline">the Congress receives the report submitted
				under section 801(a)(1); or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAECBC47A142443D4A7C84E553D57CD7E"><enum>(B)</enum><text display-inline="yes-display-inline">the nonmajor rule is published in the
				Federal Register, if so published.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HBB25E8DF7677489287F3E25A406EA3E9"><enum>(c)</enum><text display-inline="yes-display-inline">In the Senate, if the committee to which is
				referred a joint resolution described in subsection (a) has not reported such
				joint resolution (or an identical joint resolution) at the end of 15 session
				days after the date of introduction of the joint resolution, such committee may
				be discharged from further consideration of such joint resolution upon a
				petition supported in writing by 30 Members of the Senate, and such joint
				resolution shall be placed on the calendar.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="HAFBACFC7B1B14E12ABA706B872E37F02"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HCF137859293A462A92D6FB095A1609C6"><enum>(1)</enum><text display-inline="yes-display-inline">In the Senate, when the committee to which
				a joint resolution is referred has reported, or when a committee is discharged
				(under subsection (c)) from further consideration of a joint resolution
				described in subsection (a), it is at any time thereafter in order (even though
				a previous motion to the same effect has been disagreed to) for a motion to
				proceed to the consideration of the joint resolution, and all points of order
				against the joint resolution (and against consideration of the joint
				resolution) are waived. The motion is not subject to amendment, or to a motion
				to postpone, or to a motion to proceed to the consideration of other business.
				A motion to reconsider the vote by which the motion is agreed to or disagreed
				to shall not be in order. If a motion to proceed to the consideration of the
				joint resolution is agreed to, the joint resolution shall remain the unfinished
				business of the Senate until disposed of.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6F945D1D7AB047869C13D029733C4326" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In the Senate, debate on the joint
				resolution, and on all debatable motions and appeals in connection therewith,
				shall be limited to not more than 10 hours, which shall be divided equally
				between those favoring and those opposing the joint resolution. A motion to
				further limit debate is in order and not debatable. An amendment to, or a
				motion to postpone, or a motion to proceed to the consideration of other
				business, or a motion to recommit the joint resolution is not in order.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2833AFA0FF9C4F2088CC62232F6A5955" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In the Senate, immediately following the
				conclusion of the debate on a joint resolution described in subsection (a), and
				a single quorum call at the conclusion of the debate if requested in accordance
				with the rules of the Senate, the vote on final passage of the joint resolution
				shall occur.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H42735FC35CF54330B71144766F99EE5B" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Appeals from the decisions of the Chair
				relating to the application of the rules of the Senate to the procedure
				relating to a joint resolution described in subsection (a) shall be decided
				without debate.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H29D4AE1E1DE24BA4A72B400D7B751DD5"><enum>(e)</enum><text display-inline="yes-display-inline">In the Senate the procedure specified in
				subsection (c) or (d) shall not apply to the consideration of a joint
				resolution respecting a nonmajor rule—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="H14B62CC13905434ABA20F674738671B7"><enum>(1)</enum><text display-inline="yes-display-inline">after the expiration of the 60 session days
				beginning with the applicable submission or publication date, or</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5C9732AFA44D4D1E8A1E03D4E5C2A09B"><enum>(2)</enum><text display-inline="yes-display-inline">if the report under section 801(a)(1)(A)
				was submitted during the period referred to in section 801(d)(1), after the
				expiration of the 60 session days beginning on the 15th session day after the
				succeeding session of Congress first convenes.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFE740731B9E14EBFAA8BCC4694C06FE3"><enum>(f)</enum><text display-inline="yes-display-inline">If, before the passage by one House of a
				joint resolution of that House described in subsection (a), that House receives
				from the other House a joint resolution described in subsection (a), then the
				following procedures shall apply:</text>
								<paragraph id="H223C8191229E43BEAC435B6EE549E4A0"><enum>(1)</enum><text>The joint
				resolution of the other House shall not be referred to a committee.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD149E38A4B3D48F08BE2E6479242C957"><enum>(2)</enum><text display-inline="yes-display-inline">With respect to a joint resolution
				described in subsection (a) of the House receiving the joint resolution—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HDF205EB4158F4B0B8E774563805AAC9A"><enum>(A)</enum><text display-inline="yes-display-inline">the procedure in that House shall be the
				same as if no joint resolution had been received from the other House;
				but</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC3B37DA4176744C68D7B8CCE47D9CC1F"><enum>(B)</enum><text display-inline="yes-display-inline">the vote on final passage shall be on the
				joint resolution of the other House.</text>
									</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H159FE7428E3A49028982B51CDF255BCB" section-type="subsequent-section"><enum>804.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">For purposes of this chapter—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="H0AE9CB773002406AB05DDF166BEA570B"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>Federal agency</term> means
				any agency as that term is defined in section 551(1).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8631AF803DB4491AACC163942EC5BF4B"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>major rule</term> means any
				rule, including an interim final rule, that the Administrator of the Office of
				Information and Regulatory Affairs of the Office of Management and Budget finds
				has resulted in or is likely to result in—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="HA65DC40EC18843A4919DED496A77CC6B"><enum>(A)</enum><text display-inline="yes-display-inline">an annual effect on the economy of
				$100,000,000 or more;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE7FF58596A354A38B46B2104CD36310D"><enum>(B)</enum><text display-inline="yes-display-inline">a major increase in costs or prices for
				consumers, individual industries, Federal, State, or local government agencies,
				or geographic regions; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1A21556E991748D0AA1A19F47341D2F4"><enum>(C)</enum><text display-inline="yes-display-inline">significant adverse effects on competition,
				employment, investment, productivity, innovation, or on the ability of United
				States-based enterprises to compete with foreign-based enterprises in domestic
				and export markets.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1D910895AFBA465088D13D38640FDDBF"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>nonmajor rule</term> means
				any rule that is not a major rule.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H152A0A5135984374A112AE9942CA4AD1"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>rule</term> has the meaning
				given such term in section 551, except that such term does not include—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H5E5296E8D4694863AB4C076580B65E91"><enum>(A)</enum><text display-inline="yes-display-inline">any rule of particular applicability,
				including a rule that approves or prescribes for the future rates, wages,
				prices, services, or allowances therefore, corporate or financial structures,
				reorganizations, mergers, or acquisitions thereof, or accounting practices or
				disclosures bearing on any of the foregoing;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD522F2553A6442829DA4734B2160FC27"><enum>(B)</enum><text display-inline="yes-display-inline">any rule relating to agency management or
				personnel; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFB635BB40A28431EAE5A212F34D9E666"><enum>(C)</enum><text display-inline="yes-display-inline">any rule of agency organization, procedure,
				or practice that does not substantially affect the rights or obligations of
				non-agency parties.</text>
								</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="H229C1207E4C3497B971D5DA92033D412" section-type="subsequent-section"><enum>805.</enum><header display-inline="yes-display-inline">Judicial review</header>
							<subsection id="H9CD6D544B743409EBF04217FE23D12AD"><enum>(a)</enum><text display-inline="yes-display-inline">No determination, finding, action, or
				omission under this chapter shall be subject to judicial review.</text>
							</subsection><subsection id="HC8D39E6692D84919AE4B8C40D7BA2A14"><enum>(b)</enum><text display-inline="yes-display-inline">Notwithstanding subsection (a), a court may
				determine whether a Federal agency has completed the necessary requirements
				under this chapter for a rule to take effect.</text>
							</subsection><subsection id="H0EB23EF95D05420180A5B97B210C2768"><enum>(c)</enum><text display-inline="yes-display-inline">The enactment of a joint resolution of
				approval under section 802 shall not be interpreted to serve as a grant or
				modification of statutory authority by Congress for the promulgation of a rule,
				shall not extinguish or affect any claim, whether substantive or procedural,
				against any alleged defect in a rule, and shall not form part of the record
				before the court in any judicial proceeding concerning a rule except for
				purposes of determining whether or not the rule is in effect.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="H00BA3EDA8585474F94C4CB21E1A226FD" section-type="subsequent-section"><enum>806.</enum><header display-inline="yes-display-inline">Exemption for monetary policy</header><text display-inline="no-display-inline">Nothing in this chapter shall apply to rules
				that concern monetary policy proposed or implemented by the Board of Governors
				of the Federal Reserve System or the Federal Open Market Committee.</text>
						</section><section commented="no" display-inline="no-display-inline" id="HC792A310F8AD4F4FA6E78E2EF97C925F" section-type="subsequent-section"><enum>807.</enum><header display-inline="yes-display-inline">Effective date of certain
				rules</header><text display-inline="no-display-inline">Notwithstanding section
				801—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="H00F8DD52865C4C329905DF12070248DB"><enum>(1)</enum><text display-inline="yes-display-inline">any rule that establishes, modifies, opens,
				closes, or conducts a regulatory program for a commercial, recreational, or
				subsistence activity related to hunting, fishing, or camping; or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB52FB50099DD430CBEF52EE702A76935"><enum>(2)</enum><text display-inline="yes-display-inline">any rule other than a major rule which an
				agency for good cause finds (and incorporates the finding and a brief statement
				of reasons therefore in the rule issued) that notice and public procedure
				thereon are impracticable, unnecessary, or contrary to the public
				interest,</text>
							</paragraph></section></chapter><quoted-block-continuation-text quoted-block-continuation-text-level="subsection">shall
				take effect at such time as the Federal agency promulgating the rule
				determines.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HC6F2E24A55444A74A5CB514DA943BC39"><enum>203.</enum><header>Budgetary
			 effects of rules subject to section 802 of title 5, United States
			 Code</header><text display-inline="no-display-inline">Section 257(b)(2) of the
			 Balanced Budget and Emergency Deficit Control Act of 1985 is amended by adding
			 at the end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="HC5BBA3E2B5974E64A4E45918F224832E" style="OLC">
					<subparagraph id="HA78C7AEF7C2A43CB980548B4FE4659DB"><enum>(E)</enum><header>Budgetary
				effects of rules subject to section 802 of title 5, United States
				Code</header><text display-inline="yes-display-inline">Any rules subject to the
				congressional approval procedure set forth in section 802 of chapter 8 of title
				5, United States Code, affecting budget authority, outlays, or receipts shall
				be assumed to be effective unless it is not approved in accordance with such
				section.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="HB9D894303885482FB3915788CBFA7040"><enum>III</enum><header>Elimination of
			 Burdensome Rules</header>
			<section id="H01A0390BA60241B0829487970AC18197"><enum>301.</enum><header>Red Tape
			 Reduction Commission</header>
				<subsection display-inline="no-display-inline" id="H6EB0556475D94D20A4818598B851C45D"><enum>(a)</enum><header>Establishment</header><text>There
			 is established a commission to be known as the <term>United States Red Tape
			 Reduction Commission</term> (in this section referred to as the
			 <term>Commission</term>).</text>
				</subsection><subsection commented="no" id="H6066E2AF1C0B4A1D93CD16B8AF8F5F52"><enum>(b)</enum><header>Duties of
			 Commission</header>
					<paragraph id="HDC390D43A92B4962BD214DC1B5FCD6A0"><enum>(1)</enum><header>In
			 general</header><text>The Commission shall advise the Federal Government on the
			 modification, consolidation, or elimination of Federal regulatory requirements
			 to reduce direct or indirect burdens on businesses in the United States.</text>
					</paragraph><paragraph id="HAFCFF063B8464DEE8DB2EA1C2F40968D"><enum>(2)</enum><header>Public
			 comment</header><text>The Commission shall conduct public hearings at locations
			 throughout the United States and establish a Web site that allows the public to
			 submit comments on hardships in complying with rules and proposals for
			 modification, consolidation, or elimination of such rules.</text>
					</paragraph><paragraph id="HFB015423F16E4CB0A64E84B26C3A34C3"><enum>(3)</enum><header>Prioritization
			 of rules for review</header><text display-inline="yes-display-inline">The
			 Commission shall develop criteria to prioritize rules for review, including the
			 number and nature of public request for review of rules.</text>
					</paragraph><paragraph commented="no" id="H810F139DC06F4AD289EB28B12007A3DD"><enum>(4)</enum><header>Review of
			 rules</header><text display-inline="yes-display-inline">The Commission shall
			 review rules according to criteria developed by the Commission to meet each of
			 the following goals:</text>
						<subparagraph id="H1410627E1F4D4D018BED5150A9565BF9"><enum>(A)</enum><text>A reduction of the
			 burdens of compliance with Federal rules, especially those rules which would
			 have an effect on small businesses.</text>
						</subparagraph><subparagraph id="HE67BAB54B437454090BFA6A02DD6058B"><enum>(B)</enum><text>Elimination of
			 rules or regulatory requirements that have a measurable detrimental effect on
			 growth, innovation, job-creating ability, and global competitiveness of
			 businesses in the United States.</text>
						</subparagraph><subparagraph id="H3BAAFE925FF94F2FB666E703B969A2EB"><enum>(C)</enum><text>Modification of
			 rules to simplify and clarify regulatory requirements.</text>
						</subparagraph><subparagraph id="H156DBA2C8DFC4FBCB4861A539DFFD6A4"><enum>(D)</enum><text>Removal of
			 barriers to the entry of new competitors in the marketplace.</text>
						</subparagraph><subparagraph id="H693EFEE0D9534578B9046D4C4DB99C9E"><enum>(E)</enum><text>Elimination of
			 rules for which ongoing costs exceed the ongoing benefits.</text>
						</subparagraph><subparagraph id="H480C425614AF464CA9A41F200BF3EED9"><enum>(F)</enum><text>Increasing
			 regulatory flexibility by replacement of command and control rules with
			 alternatives, such as performance standards.</text>
						</subparagraph></paragraph></subsection><subsection id="HA3CE95E7D4D14AC2B7B038439EBC6FCB"><enum>(c)</enum><header>Membership</header>
					<paragraph id="HAB36A3BD55E24B7FA32520386724011C"><enum>(1)</enum><header>Number and
			 appointment</header><text>The Commission shall be composed of 8 members
			 appointed by the President by and with the advise and consent of the Senate, 4
			 of which shall represent private industry, including small business
			 interests.</text>
					</paragraph><paragraph id="H9EAC527769D04120BB445BF1622105B8"><enum>(2)</enum><header>Terms</header><text display-inline="yes-display-inline">Each member shall be appointed for a term
			 of one year that may be renewed by the President without the advise and consent
			 of the Senate.</text>
					</paragraph><paragraph id="H9C24D721981C4D51A53FF0C97866051B"><enum>(3)</enum><header>Rates of
			 pay</header><text display-inline="yes-display-inline">The Comptroller General
			 of the United States is authorized to determine rates of pay, not to exceed
			 limits under the Federal Advisory Committee Act, for members for each day
			 (including travel time) during which the member is engaged in the actual
			 performance of the duties vested in the Commission.</text>
					</paragraph><paragraph id="H8ECCA0CCF5444773978AE4912BF30DC2"><enum>(4)</enum><header>Travel
			 expenses</header><text>Members shall receive travel expenses, including per
			 diem in lieu of subsistence, in accordance with sections 5702 and 5703 of title
			 5, United States Code.</text>
					</paragraph><paragraph commented="no" id="H50697DD6EF7F4D28924E6706E37C86DD"><enum>(5)</enum><header>Chairperson</header><text>The
			 Chairperson of the Commission shall be elected by the members. The term of
			 office of the Chairperson shall be one year.</text>
					</paragraph></subsection><subsection id="H74692972EB134E9398715CDF912E3CFA"><enum>(d)</enum><header>Staff of
			 Commission</header><text display-inline="yes-display-inline">The Chairperson of
			 the Commission may hire staff, without regard to the provisions of title 5,
			 United States Code, governing appointments in the competitive service, and
			 without regard to the provisions of chapter 51 and subchapter III of chapter 53
			 of such title relating to classification and General Schedule pay rates, except
			 that no rate of pay fixed under this subsection may exceed the limits under the
			 Federal Advisory Committee Act. The Chairperson of the Commission may fix the
			 compensation of Commission staff without regard to the provisions of chapter 51
			 and subchapter III of chapter 53 of title 5, United States Code, relating to
			 classification of positions and General Schedule pay rates, except that the
			 rate of pay may not exceed the limits under the Federal Advisory Committee
			 Act.</text>
				</subsection><subsection id="HC13969D095E9409099AFCC885045B398"><enum>(e)</enum><header>Experts and
			 Consultants</header><text display-inline="yes-display-inline">The Commission
			 may procure the services of experts and consultants in accordance with the
			 provisions of section 3109(b) of title 5, United States Code, but at rates for
			 individuals not to exceed the daily equivalent of the highest rate payable
			 under section 5332 of such title.</text>
				</subsection><subsection id="H606CE6310C37455CA950FC45F65B1452"><enum>(f)</enum><header>Contract
			 Authority</header><text display-inline="yes-display-inline">The Commission
			 may—</text>
					<paragraph id="HC3DAB1FDB7084A299E4A80E6F01BE91A"><enum>(1)</enum><text>procure supplies,
			 services, and property by contract in accordance with applicable laws and
			 regulations and to the extent or in such amounts as are provided in
			 appropriations Acts; and</text>
					</paragraph><paragraph id="H5B0EA3CE05E2404BACADF7CFE2A6B171"><enum>(2)</enum><text>enter into
			 contracts with departments, agencies, and instrumentalities of the Federal
			 Government, State agencies, and private firms, institutions, and agencies, for
			 the conduct of research or surveys, the preparation of reports, and other
			 activities necessary for the discharge of the duties of the Commission, to the
			 extent or in such amounts as are provided in appropriations Acts.</text>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="HAB0DCBF4AD9D495480708FB46E2C32A6"><enum>(g)</enum><header>Relationship to
			 Executive Branch</header>
					<paragraph id="H4051E785361B49DBB1995E8A5657EBB8"><enum>(1)</enum><header>Information
			 requests</header><text display-inline="yes-display-inline">The Commission is
			 authorized to secure information, data, estimates, and statistics directly from
			 the various departments, agencies, and establishments of the executive branch
			 of Government, including the Office of Management and Budget, and the
			 regulatory agencies and commissions of the Government. All such departments,
			 agencies, establishments, and regulatory agencies and commissions shall
			 promptly furnish the Commission any available material which the Chairperson of
			 the Commission determines to be necessary in the performance of the
			 Commission’s duties and functions (other than material the disclosure of which
			 would be a violation of law).</text>
					</paragraph><paragraph id="HDBE3673F7BCD42F582003EA72241E5D7"><enum>(2)</enum><header>Use of services,
			 facilities, and personnel</header><text>The Commission is authorized, upon
			 agreement with the head of any such department, agency, establishment, or
			 regulatory agency or commission, to use its services, facilities, and personnel
			 with or without reimbursement, and the head of each such department, agency,
			 establishment, or regulatory agency or commission is authorized to provide the
			 Commission such services, facilities, and personnel.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7B7D9634618042DD977EE7D045D7B849"><enum>(h)</enum><header>Relationship to
			 other agencies of Congress</header><text display-inline="yes-display-inline">In
			 carrying out the duties and functions of the Commission, and for the purpose of
			 coordinating the operations of the Commission with those of other congressional
			 agencies with a view to using most effectively the information, services, and
			 capabilities of all such agencies in carrying out the various responsibilities
			 assigned to each, the Commission is authorized to obtain information, data,
			 estimates, and statistics developed by the Government Accountability Office,
			 the Congressional Budget Office, and the Congressional Research Service, and
			 upon agreement with the Comptroller General, the Director of the Congressional
			 Budget Office, or the Director of the Congressional Research Service to use
			 their services, facilities, and personnel without reimbursement. The
			 Comptroller General and such Directors are authorized to provide the Commission
			 with the information, data, estimates, and statistics, and the services,
			 facilities, and personnel, referred to in the preceding sentence.</text>
				</subsection><subsection commented="no" id="HD89C5E79576341158D8FB470B82579C6"><enum>(i)</enum><header>Assistance to
			 the Congress</header><text display-inline="yes-display-inline">The Commission
			 shall provide to the Committee on Oversight and Government Reform of the House
			 of Representatives and the Committee on Homeland Security and Governmental
			 Affairs of the Senate, information that will assist the committee in the
			 discharge of all matters within its jurisdiction, including information with
			 respect to its jurisdiction over authorization and oversight of the Office of
			 Information and Regulatory Affairs of the Office of Management and
			 Budget.</text>
				</subsection><subsection id="H82274F4ADDB741A1882C0B7F3485C276"><enum>(j)</enum><header>Reports</header>
					<paragraph id="H798321CDB7D74A5A9A6DCFBAA206493F"><enum>(1)</enum><header>Annual
			 reports</header><text display-inline="yes-display-inline">Not later than one
			 year after the date of the enactment of this Act, and annually thereafter for
			 each of the following five years, the Commission, with an affirmative vote of a
			 majority of the members of the Commission, shall submit to the President and
			 the Congress a report on the findings and conclusions of the Commission under
			 subsection (b), together with its recommendations for legislation.</text>
					</paragraph><paragraph commented="no" id="H5A6473AFDFFE4692AC118B38335A3CEF"><enum>(2)</enum><header>Congressional
			 review</header>
						<subparagraph commented="no" id="H058546C7AF814AFEBC60F5455C91766F"><enum>(A)</enum><header>House of
			 Representatives</header><text>Not later than three days after receiving the
			 report pursuant to paragraph (1), in the House of Representatives, the majority
			 leader of the House of Representatives (or his designee) and the minority
			 leader of the House of Representatives (or his designee) shall introduce (by
			 request), a joint resolution implementing the recommendations in the
			 report.</text>
						</subparagraph><subparagraph commented="no" id="HD81C5A4F015D47C792CC378095CA9E18"><enum>(B)</enum><header>Senate</header><text display-inline="yes-display-inline">Not later than three days after receiving
			 the report pursuant to paragraph (1), in the Senate, the majority leader of the
			 Senate (or his designee) and the minority leader of the Senate (or his
			 designee) shall introduce a joint resolution described in subparagraph (A) (by
			 request).</text>
						</subparagraph><subparagraph commented="no" id="HF1B836B1AE7E4C2FA257D6577DD58544"><enum>(C)</enum><header>Applicable
			 procedures</header><text>Such joint resolution shall be deemed to be a joint
			 resolution described under section 802(a) of title 5, United States Code, for
			 purposes of consideration by either House.</text>
						</subparagraph></paragraph><paragraph id="H8335892328BD4ABCA201186B122AB4EC"><enum>(3)</enum><header>Presidential
			 review</header><text>Not later than 30 days after receiving the report pursuant
			 to paragraph (1), the President shall submit a review on such report to the
			 Congress.</text>
					</paragraph><paragraph id="H23A464842BC848E28F676B15353240EE"><enum>(4)</enum><header>Public
			 Availability of Commission Reports</header><text display-inline="yes-display-inline">The Commission shall publish its reports on
			 a public Internet Web site maintained by the Commission.</text>
					</paragraph></subsection><subsection id="H7842A8740A064CB9B16FB4B5EB46B9C2"><enum>(k)</enum><header>Termination</header><text>The
			 Commission shall terminate on the day after the final report is published in
			 the Federal Register pursuant to subsection (i)(4).</text>
				</subsection><subsection id="H11E7D4ECE3FA4A008A5E95189CB95610"><enum>(l)</enum><header>Application of
			 FACA</header><text>The provisions of the Federal Advisory Committee Act (5
			 U.S.C. App) shall apply to the Commission, except as otherwise provided in this
			 Act.</text>
				</subsection></section></title></legis-body>
