		<official-title>To amend the National Defense Authorization Act for
		  Fiscal Year 2012 to provide clarification of the relationship of certain
		  constitutional rights to provisions of law relating to the military detention
		  of certain covered person.</official-title>

		<section id="H7DA1FBC5FCAD416FA09F62E24C023173" section-type="section-one"><enum>1.</enum><header>Clarification of relationship
			 of constitutional rights to provisions of law relating to the military
			 detention of certain covered persons</header><text display-inline="no-display-inline">The National Defense Authorization Act for
			 Fiscal Year 2012 (Public Law 112–81) is amended—</text>
			<paragraph id="H5BCAF03DA8E4412CB9A5FC7578AC3D68"><enum>(1)</enum><text>in section 1021,
			 by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H140CD045BD694E73A1D233B525D266F7" style="OLC">
					<subsection id="HAAB2BD0FCA104BAB867FB44B5CB535F3"><enum>(g)</enum><header>Preservation of
				constitutional rights</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				section, the writ of habeas corpus shall remain available to any individual
				detained within the United States and no American citizen or lawful resident
				may be detained without all the rights of due process to include, but not
				limited to—</text>
						<paragraph id="H3FEC7F079FB24004BFAB2D57B01DCADC"><enum>(1)</enum><text>the right to a
				speedy and public trial by an impartial jury;</text>
						</paragraph><paragraph id="H58B96D5687B240E0860BDC2F9AC31ABC"><enum>(2)</enum><text>the right to be
				informed of the nature of the accusation;</text>
						</paragraph><paragraph id="H3AC99F0A77BA418A82B02881850FA2F2"><enum>(3)</enum><text>the right to be
				confronted with the witnesses against them;</text>
						</paragraph><paragraph id="HC80AF25D00EA4646B7D516AFC5CB1301"><enum>(4)</enum><text>the right to have
				compulsory process for obtaining witnesses in their favor;</text>
						</paragraph><paragraph id="H6511CB2A0C4F45679FBF0013486E0C24"><enum>(5)</enum><text>the right to have
				the assistance of legal counsel; and</text>
						</paragraph><paragraph id="H9DDA70198FC54B1A83D37AB76BBE0C9C"><enum>(6)</enum><text>all other rights
				afforded to them by the Constitution of the United
				States.</text>
						</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H09E36665A6CF4B0AAE9A4DCF1E75CD43"><enum>(2)</enum><text>in section 1022,
			 by adding at the end the following new subsection:</text>

					<subsection id="H843C6CF7038D4E3185B5C1CB828DA39C"><enum>(f)</enum><header>Preservation of
				constitutional rights</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				section, the writ of habeas corpus shall remain available to any individual
