<section id="H9843D67C56D54267A4040E3869951756" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Contractor Opportunity Protection Act of 2012</short-title></quote>.</text></section>
<section id="H3B220C72A5E74C54949B4716F23D9812"><enum>2.</enum><header>Consolidation of provisions relating to contract bundling</header><text display-inline="no-display-inline">Section 44 of the Small Business Act (15 U.S.C. 657q) is amended to read as follows:</text>

<section id="H02680F93DA064D209BF7A7EF58A50F22"><enum>44.</enum><header>Contract bundling</header>
<subsection id="HF2AC600391CA44CDA7192525626635BB"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text>
<paragraph display-inline="no-display-inline" id="HED373AED43EE412E9692963150593AAB"><enum>(1)</enum><header>Bundled contract</header><text display-inline="yes-display-inline">The term <quote>bundled contract</quote>—</text>
<subparagraph id="HBF2AE6BAA0E34CB3B12F174BDC836198"><enum>(A)</enum><text display-inline="yes-display-inline">means a contract that is entered into to meet procurement requirements that are combined in a bundling of contract requirements, without regard to whether a study of the effects of the solicitation on Federal officers or employees has been made; and</text></subparagraph>
<subparagraph id="HE4B73D946C7A469DACA0EEF70D712A81"><enum>(B)</enum><text>does not include—</text>
<clause id="HEC30CC234E1A41C7AA594F9CD8745546"><enum>(i)</enum><text display-inline="yes-display-inline">a contract with an aggregate dollar value below the dollar threshold; or</text></clause>
<clause id="H17BB9D9FB2F94C27BF6B268128CE9354"><enum>(ii)</enum><text>a single award contract for the acquisition of a weapons system acquired through a major defense acquisition.</text></clause></subparagraph></paragraph>
<paragraph id="HCE91F4594EEC4853B95AABFA5DD5A96A"><enum>(2)</enum><header>Bundling methodology</header><text display-inline="yes-display-inline">The term <quote>bundling methodology</quote> means—</text>
<subparagraph id="HA390D0C3FD734146901F1B55DE2EC6B7"><enum>(A)</enum><text>a solicitation to obtain offers for a single contract or a multiple award contract;</text></subparagraph>
<subparagraph id="H6CEEFC8B483B4D19A293C83CFD0EA47B"><enum>(B)</enum><text>a solicitation of offers for the issuance of a task or a delivery order under an existing single or multiple award contract; or</text></subparagraph>
<subparagraph id="H910B148219C64DD1AFF9D274A8872294"><enum>(C)</enum><text>the creation of any new procurement requirements that permits a combination of contract requirements, including any combination of contract requirements or order requirements.</text></subparagraph></paragraph>
<paragraph id="HCF747674CC794AA5A2201F4FEC836A58"><enum>(3)</enum><header>Bundling of contract requirements</header><text>The term <quote>bundling of contract requirements</quote>, with respect to the contract requirements of a Federal agency—</text>
<subparagraph id="HC7564DAA38E54C27A62F672F2E7432AF"><enum>(A)</enum><text display-inline="yes-display-inline">means the use of any bundling methodology to satisfy 2 or more procurement requirements for new or existing goods or services provided to or performed for the Federal agency, including any construction services, that is likely to be unsuitable for award to a small-business concern due to—</text>
<clause id="H97B79BD7D86A4F48948053C846801DE3"><enum>(i)</enum><text display-inline="yes-display-inline">the diversity, size, or specialized nature of the elements of the performance specified;</text></clause>
<clause id="H9BC54EA0073C4FDD9CE709C2055BC1F5"><enum>(ii)</enum><text>the aggregate dollar value of the anticipated award;</text></clause>
<clause id="HF5468D780AA740AAB4DF2783771BD677"><enum>(iii)</enum><text>the geographical dispersion of the contract performance sites; or</text></clause>
<clause id="HB96F6476FC1B484BB17D491598663754"><enum>(iv)</enum><text>any combination of the factors described in clauses (i), (ii), and (iii); and</text></clause></subparagraph>
<subparagraph id="H312158AC6FC44D5FB1794871235F3664"><enum>(B)</enum><text display-inline="yes-display-inline">does not include the use of a bundling methodology for an anticipated award with an aggregate dollar value below the dollar threshold.</text></subparagraph></paragraph>
<paragraph id="H82EC77CFF9064CD08A1A3A53615EF231"><enum>(4)</enum><header>Chief Acquisition Officer</header><text>The term <term>Chief Acquisition Officer</term> means the employee of a Federal agency designated as the Chief Acquisition Officer for the Federal agency under section 16(a) of the Office of Federal Procurement Policy Act (41 U.S.C. 1702(a)).</text></paragraph>
<paragraph commented="no" id="H9A4C429AA7324F07B85380A68829CAE6"><enum>(5)</enum><header>Contract</header><text>The term <quote>contract</quote> includes, for purposes of this section, any task order made pursuant to an indefinite quantity, indefinite delivery contract.</text></paragraph>
<paragraph id="H902B04F9E40B4903A3A83C69A8C2D415"><enum>(6)</enum><header>Contract bundling</header><text>The term <quote>contract bundling</quote> means the process by which a bundled contract is created.</text></paragraph>
<paragraph id="H775CE6AA2B5F411BB66A9B72F7E82975"><enum>(7)</enum><header>Dollar threshold</header><text display-inline="yes-display-inline">The term <quote>dollar threshold</quote> means—</text>
<subparagraph id="HC36D404447224C9A81680CB214E83440"><enum>(A)</enum><text>in the case of a contract for construction, $5,000,000; and</text></subparagraph>
<subparagraph id="H812ECD8F66BE4FDBA2B9A9CC9F7F5527"><enum>(B)</enum><text>in any other case, $2,000,000.</text></subparagraph></paragraph>
<paragraph id="H79D52EA1309C4CA4AFD866B12DCCB082"><enum>(8)</enum><header>Major Defense Acquisition Program</header><text display-inline="yes-display-inline">The term <quote>major defense acquisition program</quote> has the meaning given in section 2430(a) of title 10, United States Code.</text></paragraph>
<paragraph id="H2B056886C4A04774B63647C6B01290AA"><enum>(9)</enum><header>Previously bundled contract</header><text>The term <quote>previously bundled contract</quote> means a contract that is the successor to a contract that required a bundling analysis, contract for which any of the successor contract were designated as a consolidated contract or bundled contract in the Federal procurement database, or a contract for which the Administrator designated the prior contract as a bundled contract.</text></paragraph>
<paragraph id="H4C0E6AFCE2B648B9B54DD08B9EEFFC6E"><enum>(10)</enum><header>Procurement activity</header><text>The term <quote>procurement activity</quote> means the Federal agency or office thereof acquiring goods or services.</text></paragraph>
<paragraph id="H8E87C4B8722C4525852C97FE718F8CB2"><enum>(11)</enum><header>Procurement requirement</header><text display-inline="yes-display-inline">The term <quote>procurement requirement</quote> means a determination by an agency that a specified good or service is needed to satisfy the mission of the agency.</text></paragraph>
<paragraph id="H3807BBF76F5041B1866B857780C62BA6"><enum>(12)</enum><header>Senior procurement executive</header><text display-inline="yes-display-inline">The term <term>senior procurement executive</term> means an official designated under section 16(c) of the Office of Federal Procurement Policy Act (41 U.S.C. 1702(c)) as the senior procurement executive for a Federal agency.</text></paragraph></subsection>
<subsection id="H74C718DD03E84AA6B5F6171DA7482ECB"><enum>(b)</enum><header>Policy</header><text display-inline="yes-display-inline">The head of each Federal agency shall ensure that the decisions made by the Federal agency regarding contract bundling are made with a view to providing small business concerns with the maximum practicable opportunities to participate as prime contractors and subcontractors in the procurements of the Federal agency.</text></subsection>
<subsection display-inline="no-display-inline" id="H53880344AA4D428F8D0216F179B09B1A"><enum>(c)</enum><header>Contract Bundling</header>
<paragraph id="H999EDBC230594672BE4D0E70140F11ED"><enum>(1)</enum><header>Proposed procurements</header><text display-inline="yes-display-inline">Paragraphs (2) through (4) shall apply to to a proposed procurement if the proposed procurement—</text>
<subparagraph id="HD9858E2F9F6C441EB839078107A27377"><enum>(A)</enum><text display-inline="yes-display-inline">would adversely affect one or more small business concerns, including the potential loss of an existing contract;</text></subparagraph>
<subparagraph id="H0113BA56F4EF4A73A2C09F6A8EDD4C83"><enum>(B)</enum><text display-inline="yes-display-inline">includes, in its statement of work, goods or services—</text>
<clause id="H675F539C52634C7186591398AD3CB74E"><enum>(i)</enum>
<subclause commented="no" display-inline="yes-display-inline" id="HBBC09527BC0B4CBA82C93C3BF97FDF87"><enum>(I)</enum><text>currently being performed by a small business; and</text></subclause>
<subclause id="H1BA5019CEF294557BA7C38AEF54E2912" indent="up1"><enum>(II)</enum><text>if the proposed procurement is in a quantity or estimated dollar value the magnitude of which renders small business prime contract participation unlikely; or</text></subclause></clause>
<clause id="H1F0ACAE4E28F4C22B4236D23E2123A87"><enum>(ii)</enum>
<subclause commented="no" display-inline="yes-display-inline" id="H901678C870FE401FB5A6C60BCBA699C9"><enum>(I)</enum><text>that are of a type that the Administrator through market research can demonstrate that two or more small businesses are capable of performing; and</text></subclause>
<subclause id="HE86D4FB7824845E3801172A56BB4AB91" indent="up1"><enum>(II)</enum><text>if the proposed procurement would be combined with other requirements for goods and services;</text></subclause></clause></subparagraph>
<subparagraph id="H2BFADBAC4BF8420D8692831042B3A31B"><enum>(C)</enum><text>is for construction and—</text>
<clause id="H3826DF4C8BFC4D0E98AA477A42BFF891"><enum>(i)</enum><text>seeks to package or combine discrete construction projects; or</text></clause>
<clause id="H0B68A80C32094D0F954D1BDEB4D72080"><enum>(ii)</enum><text>the value of the goods or services subject to the contract exceeds the dollar threshold; or</text></clause></subparagraph>
<subparagraph id="HDCFC23F152AE48A0BF960CACC8227D8B"><enum>(D)</enum><text>is determined by the Administrator to have a solicitation that involves an unnecessary or unjustified bundling of contract requirements.</text></subparagraph></paragraph>
<paragraph id="H0DCA231674D549A0B06AD2D163D5D2C3"><enum>(2)</enum><header>Responsibility of the Procurement Activity</header><text display-inline="yes-display-inline">At least 45 days prior to the issuance of a solicitation, the Procurement Activity shall notify and provide a copy of the proposed procurement to the procurement center representative assigned to the Procurement Activity. The 45-day notification process under this paragraph shall occur concurrently with other processing steps required prior to issuance of the solicitation. The notice shall include a statement setting forth the proposed procurement strategy required by subsection (e), and—</text>
<subparagraph id="HE5D1DA6880F44E1BB663C4EFA9390E92"><enum>(A)</enum><text display-inline="yes-display-inline">explaining why the proposed acquisition cannot be further divided into reasonably small lots or discrete tasks in order to permit offers by small business concerns;</text></subparagraph>
<subparagraph id="H3BE09211C3754F7C9B0E7833C26B7D8D"><enum>(B)</enum><text display-inline="yes-display-inline">listing, if applicable, the incumbent contractors disaggregated by and including names, addresses, and whether or not the contractor is a small business concern;</text></subparagraph>
<subparagraph id="HAC90DB2980284E9DB69E5575F7598191"><enum>(C)</enum><text display-inline="yes-display-inline">describing the industries that might be interested in bidding on the contract requirements;</text></subparagraph>
<subparagraph id="H4612B8DD938A470B84027D63165805F9"><enum>(D)</enum><text display-inline="yes-display-inline">delineating the number of small business concerns listed in the industry categories that could be excluded from future bidding if the contract is a bundled contract, including any small business bidders that had bid on previous procurement requirements that are included in the bundling of contract requirements;</text></subparagraph>
<subparagraph id="HF2288D8F8E5D4FC29635105BD4C8CB3D"><enum>(E)</enum><text>delineating the number of existing small business concerns whose contracts will cease if the contract bundling proceeds;</text></subparagraph>
<subparagraph id="HC214E2646E744456BD61317A60ECBAB0"><enum>(F)</enum><text>explaining why the delivery schedules cannot be established on a realistic basis that will encourage small business participation to the extent consistent with the actual requirements of the Government;</text></subparagraph>
<subparagraph id="H2F028020F9B9484C9A072947F095964E"><enum>(G)</enum><text display-inline="yes-display-inline">explaining why the proposed acquisition cannot be offered so as to make small business participation likely;</text></subparagraph>
<subparagraph id="HA1749F2FC5844B7DBB59A9284BE666F2"><enum>(H)</enum><text display-inline="yes-display-inline">explaining why construction cannot be procured as separate discrete projects; and</text></subparagraph>
<subparagraph id="H2FA19E1B5B5E4597A254FC25FF4B566E"><enum>(I)</enum><text display-inline="yes-display-inline">explaining why the agency has determined that the bundled contract is necessary and justified.</text></subparagraph></paragraph>
<paragraph id="H838244FEAA4545C6B73642017DF19615"><enum>(3)</enum><header>Publication of notice statement</header><text display-inline="yes-display-inline">Concurrently, the statement required in paragraph (2) shall be published in the Federal contracting opportunities database.</text></paragraph>
<paragraph id="HE81BF02B5F7A472A9B3B5F801B6267D9"><enum>(4)</enum><header>Recompetition of a previously bundled contract</header><text display-inline="yes-display-inline">If the proposed procurement is a previously bundled contract, that is to be recompeted as a bundled contract, the Administrator shall determine, with the assistance of the agency proposing the procurement—</text>
<subparagraph id="H9D9B183DACB74244BA790075DCF2482C"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of savings and benefits (in accordance with subsection (d)) achieved under the bundling of contract requirements;</text></subparagraph>
<subparagraph id="H1E649CDDFFB74F348AA36AFE6E1419D4"><enum>(B)</enum><text display-inline="yes-display-inline">whether such savings and benefits will continue to be realized if the contract remains bundled, and whether such savings and benefits would be greater if the procurement requirements were divided into separate solicitations suitable for award to small business concerns;</text></subparagraph>
<subparagraph id="HCB2B7C4B19AE409CB4B8ECA5C7DA04F9"><enum>(C)</enum><text display-inline="yes-display-inline">the dollar value of subcontracts awarded to small business concerns under the bundled contract, disaggregated by North American Industrial Classification System Code;</text></subparagraph>
<subparagraph id="H74AC5CA3E23143369BBFB20A85FC90DF"><enum>(D)</enum><text display-inline="yes-display-inline">the percentage of subcontract dollars awarded to small businesses under the bundled contract, disaggregated by North American Industrial Classification System Code; and</text></subparagraph>
<subparagraph id="HBAEFC9DC72A349ADA1390700479A5FC2"><enum>(E)</enum><text display-inline="yes-display-inline">the dollar amount and percentage of prime contract dollars awarded to small businesses in the primary North American Industrial Classification System Code for that bundled contract during each of the two fiscal years preceding the award of the bundled contract and during each fiscal year of the performance of the bundled contract.</text></subparagraph></paragraph>
<paragraph id="H560D1E8ACDC64A378336722E0E560C3F"><enum>(5)</enum><header>Failure to provide notice</header>
<subparagraph id="HE055965D54C64911B581003919138724"><enum>(A)</enum><header>No notification received</header><text>If no notification of the proposed procurement or accompanying statement is received, but the Administrator determines that the proposed procurement is a proposed procurement described in paragraph (1), then the Administrator shall require that such a statement of work be completed by the Procurement Activity and sent to the procurement center representative and postpone the solicitation process for at least 10 days but not more than 45 days to allow the Administrator to review the statement and make recommendations as described in this section before the procurement process is continued.</text></subparagraph>
<subparagraph id="HDA3C04292ED4413398D0DE99B23893F5"><enum>(B)</enum><header>No work continued</header><text>If the Administrator requires a Procurement Activity to provide a statement of work pursuant to subparagraph (A), the Procurement Activity shall not be permitted to continue with the procurement until such time as the Procurement Activity complies with the requirements of subparagraph (A). </text></subparagraph></paragraph>
<paragraph id="H5B4BE94A91BF4D80AD8AC832EAC6444B"><enum>(6)</enum><header>Responsibility of the procurement center representative</header><text display-inline="yes-display-inline">Within 15 days after receipt of the proposed procurement and accompanying statement, if the procurement center representative believes that the procurement as proposed will render small business prime contract participation unlikely, the representative shall recommend to the Procurement Activity alternative procurement methods which would increase small business prime contracting opportunities.</text></paragraph>
<paragraph id="H8D29F9578B0F4D81AC5626C9CB05F186"><enum>(7)</enum><header>Disagreement between the Administrator and the Procurement Activity</header>
<subparagraph id="HDFF0DA80ECF845788AC640FC50029BA0"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator may take action under this paragraph to further the interests of small businesses if—</text>
<clause id="H86AD533696AE4BFB8710E9AA4AF489F0"><enum>(i)</enum><text>a small business concern would be adversely affected, directly or indirectly, by the proposed procurement, and that small business concern or a trade association representing such small business concern so requests; or</text></clause>
<clause id="H40A0552987E143BDB5389C2D20ED66D8"><enum>(ii)</enum><text>if the Administrator determines that a small business concern would be adversely affected, directly or indirectly, by the proposed procurement.</text></clause></subparagraph>
<subparagraph id="H26369F10F4794AFD996624BA04B4E19E"><enum>(B)</enum><header>Appeal to agency head</header><text>First, the proposed procurement shall be submitted for determination to the head of the contracting agency by the Administrator.</text></subparagraph>
<subparagraph id="HBE798F74BA064A438627925A8D39AEA1"><enum>(C)</enum><header>Failure to agree</header><text>Whenever the Administrator and the head of the contracting agency fail to agree—</text>
<clause id="H8639A56928AE403CB418403475859AE2"><enum>(i)</enum><text>the Administrator, within ten days after such decision, may file an appeal with the appropriate agency board of contract appeals;</text></clause>
<clause id="H3B9632D3DD404D4BB7007631466759B1"><enum>(ii)</enum><text display-inline="yes-display-inline">the board shall provide the Administrator and the head of the contracting agency the opportunity to provide their views on the disputed contract, except that no oral testimony or oral argument shall be permitted;</text></clause>
<clause id="H5FFD4764BC4B4EEBA7A5B1243CAD831C"><enum>(iii)</enum><text>the board shall permit interested bidders to intervene; and</text></clause>
<clause id="H3ED2F7AC595048EFAE16B34BC278F4CB"><enum>(iv)</enum><text>the board shall render its decision, which shall be final agency action for purposes of chapter 7 of title 5, United States Code, within 30 days after the appeal has been filed.</text></clause></subparagraph>
<subparagraph id="HCC7367B865A3462AB7772BAC5FF340B6"><enum>(D)</enum><header>Appeal by affected small business concern to GAO</header><text display-inline="yes-display-inline">If the Administrator takes no action pursuant to subparagraph (C), a small business concern that would be adversely affected, directly or indirectly, by the procurement as proposed, or a trade association that includes such a small business concern as a member, may file a protest with the Government Accountability Office. If the protest is filed by a trade association, the trade association shall not be required to identify a specific member in connection with the protest.</text></subparagraph></paragraph></subsection>
<subsection display-inline="no-display-inline" id="H620A001AE1D24462941A78AF52BB574A"><enum>(d)</enum><header>Market research</header>
<paragraph id="H307A5224027D4D28B9656EFF6A196732"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Before proceeding with an acquisition strategy that could lead to bundled contracts, the head of an agency shall conduct market research to determine whether bundling of the requirements is necessary and justified.</text></paragraph>
<paragraph id="H48B506EACB6141D1A5A541DB453AA3A7"><enum>(2)</enum><header>Factors</header><text display-inline="yes-display-inline">For purposes of subsection (c)(1), a bundled contract is necessary and justified if the bundling of contract requirements will result in substantial measurable benefits in excess of those benefits resulting from a procurement of the contract requirements that does not involve contract bundling.</text></paragraph>
<paragraph id="H104FD7DBAFC94E7BA9A230F4AA8568C2"><enum>(3)</enum><header>Benefits</header><text display-inline="yes-display-inline">For the purposes of bundling of contract requirements, benefits described in paragraph (2) may include the following:</text>
<subparagraph id="H844F938EAA6940E8BBFEB024BAD74398"><enum>(A)</enum><text display-inline="yes-display-inline">Cost savings.</text></subparagraph>
<subparagraph id="H10BFACA8BB1D45939FD593ADB395B3A8"><enum>(B)</enum><text>Quality improvements.</text></subparagraph>
<subparagraph id="H1C10C1471D8F44FD92BC3CEDC2D072A5"><enum>(C)</enum><text>Reduction in acquisition cycle times.</text></subparagraph>
<subparagraph id="H54ADB107B2A54B43B6C054128F06C1C7"><enum>(D)</enum><text>Better terms and conditions.</text></subparagraph>
<subparagraph id="H2B5BE87EF13040DFB8615E6F48686C42"><enum>(E)</enum><text>Any other benefits.</text></subparagraph></paragraph>
<paragraph id="HEAC0B88D942440F6898D7EA3908E27AE"><enum>(4)</enum><header>Reduction of costs not determinative</header><text display-inline="yes-display-inline">For purposes of this subsection:</text>
<subparagraph id="H0D2ECE02828C4D05901A504575BC5808"><enum>(A)</enum><text>Cost savings shall not include any reduction in the use of military interdepartmental purchase requests or any similar transfer funds among Federal agencies for the use of a contract issued by another Federal agency.</text></subparagraph>
<subparagraph id="H120D0FE37EDD40748C3CBF36C9A8255E"><enum>(B)</enum><text>The reduction of administrative or personnel costs alone shall not be a justification for bundling of contract requirements unless the cost savings are expected to be substantial in relation to the dollar value of the procurement requirements to be bundled.</text></subparagraph></paragraph>
<paragraph commented="no" id="H7C16C0266EB04EDCB30369CCFD7611E6"><enum>(5)</enum><header>Limitation on acquisition strategy</header><text display-inline="yes-display-inline">The head of a Federal agency may not carry out an acquisition strategy that includes bundled contracts valued in excess of the dollar threshold, unless the senior procurement executive or, if applicable, Chief Acquisition Officer, for the Federal agency, certifies to the head of the Federal agency that steps will be taken to include small business concerns in the acquisition strategy prior to the implementation of such acquisition strategy.</text></paragraph></subsection>
<subsection id="HA3780826EA6B454BB4413C265BB36E88"><enum>(e)</enum><header>Strategy specifications</header><text display-inline="yes-display-inline">If the head of a contracting agency determines that an acquisition plan or proposed procurement strategy will result in a bundled contract, the proposed acquisition plan or procurement strategy shall—</text>
<paragraph id="H1B7648D076794135A833E78893C0CBF0"><enum>(1)</enum><text display-inline="yes-display-inline">identify specifically the benefits anticipated to be derived from the bundling of contract requirements;</text></paragraph>
<paragraph id="HCC14A61C812A4E689AC7C7211206F741"><enum>(2)</enum><text display-inline="yes-display-inline">set forth an assessment of the specific impediments to participation by small business concerns as prime contractors that result from the contract bundling and specify actions designed to maximize small business participation as subcontractors (including suppliers) at various tiers under the contract or contracts that are awarded to meet the requirements; and</text></paragraph>
<paragraph id="H58CEAA7E396548428CC6214694F4264F"><enum>(3)</enum><text>include a specific determination that the anticipated measurable benefits of the proposed bundled contract justify its use.</text></paragraph></subsection>
<subsection id="HA4969E57968F401E9BF447702540BBE6"><enum>(f)</enum><header>Contract teaming</header><text display-inline="yes-display-inline">In the case of a solicitation of offers for a bundled contract that is issued by the head of an agency, a small-business concern may submit an offer that provides for use of a particular team of subcontractors for the performance of the contract. The head of the agency shall evaluate the offer in the same manner as other offers, with due consideration to the capabilities of all of the proposed subcontractors. If a small business concern teams under this paragraph, it shall not affect its status as a small business concern for any other purpose.</text></subsection>
<subsection id="H0359328E618E4BEB98C49A54E6139E8C"><enum>(g)</enum><header>Database, analysis, and annual report regarding contract bundling</header>
<paragraph id="HDB1BF6667EE7451DAF9BBD550D14C05A"><enum>(1)</enum><header>Database</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this subsection, the Administrator shall develop and shall thereafter maintain a database containing data and information regarding—</text>
<subparagraph id="H20DE2A1F4BF64C98939D6D9E9940A297"><enum>(A)</enum><text display-inline="yes-display-inline">each bundled contract awarded by a Federal agency; and</text></subparagraph>
<subparagraph id="H79881BBA119241D6885614B489C91414"><enum>(B)</enum><text display-inline="yes-display-inline">each small business concern that has been displaced as a prime contractor as a result of the award of such a contract.</text></subparagraph></paragraph>
<paragraph id="H593B9DDB92F241C38DE3257D41414374"><enum>(2)</enum><header>Analysis</header><text display-inline="yes-display-inline">For each bundled contract that is to be recompeted, the Administrator shall determine—</text>
<subparagraph id="HF35CB089FF9146898A461B0723019E26"><enum>(A)</enum><text>the amount of savings and benefits realized, in comparison with the savings and benefits anticipated by the analysis required under subsection (d) prior to the contract award; and</text></subparagraph>
<subparagraph id="H05033443CFF045859E20F75BBC88D772"><enum>(B)</enum><text display-inline="yes-display-inline">whether such savings and benefits will continue to be realized if the contract remains bundled, and whether such savings and benefits would be greater if the procurement requirements were divided into separate solicitations suitable for award to small business concerns.</text></subparagraph></paragraph>
<paragraph id="HF9278A9B957045D5B94B8612E5CFABFF"><enum>(3)</enum><header>Annual report on contract bundling</header>
<subparagraph id="H44A6CBF95808401987436AEA427EBED2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this paragraph, and annually in March thereafter, the Administrator shall transmit a report on contract bundling to the Committee on Small Business of the House of Representatives and the Committee on Small Business and Entrepreneurship of the Senate.</text></subparagraph>
<subparagraph id="H6767C290FC98466CA2506A3771FA3119"><enum>(B)</enum><header>Contents</header><text display-inline="yes-display-inline">Each report transmitted under subparagraph (A) shall include—</text>
<clause id="H29BB2DF9C6704C23B8133CE7564DD665"><enum>(i)</enum><text>data on the number, arranged by industrial classification, of small business concerns displaced as prime contractors as a result of the award of bundled contracts by Federal agencies; and</text></clause>
<clause id="HE77AEB34BD71469D9481DF6535AC378A"><enum>(ii)</enum><text>a description of the activities with respect to previously bundled contracts of each Federal agency during the preceding year, including—</text>
<subclause id="H999B245E44FC40DB9A2922F4C7DF73C7"><enum>(I)</enum><text>data on the number and total dollar amount of all contract requirements that were bundled; and</text></subclause>
<subclause id="HB7ABCC3FBBC94FE8A57F98FB909F913F"><enum>(II)</enum><text>with respect to each bundled contract, data or information on—</text>
<item id="H872E20529E1149C6AB06D679DBEBB1D2"><enum>(aa)</enum><text>the justification for the bundling of contract requirements;</text></item>
<item id="HF87D9DA2ADD343DA9EBB8A17658E96D3"><enum>(bb)</enum><text display-inline="yes-display-inline">the cost savings realized by bundling the contract requirements over the life of the contract;</text></item>
<item id="HB6C444FE713749A78A514560C7D627F7"><enum>(cc)</enum><text>the extent to which maintaining the bundled status of contract requirements is projected to result in continued cost savings;</text></item>
<item id="H0F6280A2596543AA80845E0DC2A10815"><enum>(dd)</enum><text>the extent to which the bundling of contract requirements complied with the contracting agency’s small business subcontracting plan, including the total dollar value awarded to small business concerns as subcontractors and the total dollar value previously awarded to small business concerns as prime contractors; and</text></item>
<item id="HBD820FCDCA974E11A75A1C062FD68FA5"><enum>(ee)</enum><text>the impact of the bundling of contract requirements on small business concerns unable to compete as prime contractors for the consolidated requirements and on the industries of such small business concerns, including a description of any changes to the proportion of any such industry that is composed of small business concerns.</text></item></subclause></clause></subparagraph></paragraph></subsection>
<subsection display-inline="no-display-inline" id="H5008B475CA354568A63ABE8B35CA2C8C"><enum>(h)</enum><header>Bundling accountability measures</header>
<paragraph id="H939DF5413CB14B419779B3D1843A993A"><enum>(1)</enum><header>Teaming requirements</header><text display-inline="yes-display-inline">Each Federal agency shall include in each solicitation for any multiple award contract above the dollar threshold a provision soliciting bids from any responsible source, including responsible small business concerns and teams or joint ventures of small business concerns.</text></paragraph>
<paragraph id="HA60B31513F7E4BEAA407394D5B4F5AF4"><enum>(2)</enum><header>Policies on reduction of contract bundling</header>
<subparagraph id="H887FB175C2E0475E8374262E5BD7AD02"><enum>(A)</enum><header>In general</header><text>Not later than 270 days after the date of enactment of this subparagraph, the Federal Acquisition Regulatory Council, established under section 25(a) of the Office of Federal Procurement Policy Act (41 U.S.C. 1302(a)), shall amend the Federal Acquisition Regulation issued under section 25 of such Act to—</text>
<clause id="HF90A8FFF985C48BC97C63D508C224890"><enum>(i)</enum><text>establish a Government-wide policy regarding contract bundling;</text></clause>
<clause id="HB4834F29BCA442039A76B0E47320E96D"><enum>(ii)</enum><text>establish a Government-wide policy on the solicitation of contractor teams and joint ventures; and</text></clause>
<clause id="H1BD19205215A489C916E9398BDBD95B3"><enum>(iii)</enum><text>require that the policies established under clauses (i) and (ii) be published on the website of each Federal agency.</text></clause></subparagraph>
<subparagraph id="H58287B59B6A44C6F99252813448BACF5"><enum>(B)</enum><header>Rationale for contract bundling</header><text>Not later than 30 days after the date on which the head of a Federal agency submits the report required under section 15(h), the head of the Federal agency shall publish on the website of the Federal agency a list and rationale for any bundled contract for which the Federal agency solicited bids or that was awarded by the Federal agency.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HAF581BA2E94D48E18276C93D529B1C2E"><enum>3.</enum><header>Repeal of redundant provisions</header>
<subsection display-inline="no-display-inline" id="HB2923D4CEC2C471D9E4DE77F455A5C04"><enum>(a)</enum><header>Certain provisions regarding contract bundling repealed</header>
<paragraph id="H0BFA29DAEAAB48FE97BF752E2B76DE13"><enum>(1)</enum><text>Section 15(a) of the Small Business Act (15 U.S.C. 644(a)), is amended by striking <quote>If a proposed procurement includes</quote> and all that follows through <quote>the matter shall be submitted for determination to the Secretary or the head of the appropriate department or agency by the Administrator.</quote>.</text></paragraph>
<paragraph id="H7AF9C92B531B4E0C95794A8C7F58D362"><enum>(2)</enum><text>All references in law to such sentences as they were in effect on the date that is one day prior to the effective date of this Act shall be deemed to be references to section 44(d), as added by this Act.</text></paragraph></subsection>
<subsection display-inline="no-display-inline" id="H8065C8106518463E9409E064A7E33CB4"><enum>(b)</enum><header>Certain provisions regarding market research repealed</header>
<paragraph id="HC9D53BD7328B4228BF30410C4C4A29B9"><enum>(1)</enum><text>Paragraphs (2) through (4) of section 15(e) of the Small Business Act (15 U.S.C. 644(e)) are repealed.</text></paragraph>
<paragraph id="H7C2D4BE5045C42979A48F30D63615684"><enum>(2)</enum><text>All references in law to such paragraphs, as in effect on the date that is one day prior to the effective date of this Act, shall be deemed to be references to subsections (d) through (f), respectively, of section 44 of the Small Business Act, as added by this section.</text></paragraph></subsection>
<subsection id="H677D5CA892B64087BB5D866A7516A5CD"><enum>(c)</enum><header>Certain provisions regarding contract bundling database repealed</header>
<paragraph id="H0A05AD7B7FB34D239A13DE581BF0A922"><enum>(1)</enum><text>Paragraph (1) of section 15(p) of the Small Business Act (15 U.S.C. 644(p)) is repealed.</text></paragraph>
<paragraph id="HBDC1B687A97B455E9C3ED7F5A815CF17"><enum>(2)</enum><text>Paragraphs (2) through (4) of section 15(p) of the Small Business Act (15 U.S.C 644(p)) are repealed. All references in law to such paragraphs, as in effect on the date that is one day prior to the effective date of this Act, shall be deemed to be references to paragraphs (1) through (3), respectively, of section 44(h) of the Small Business Act, as added by this Act.</text></paragraph></subsection>
<subsection id="H16A56B3F5351445DA84F5300402E92E8"><enum>(d)</enum><header>Certain provisions regarding bundling accountability measures repealed</header>
<paragraph id="H05BBE790B66C47B68BC8CE51DC1E0F78"><enum>(1)</enum><text>Paragraphs (1) and (2) of section 15(q) of the Small Business Act (15 U.S.C 644(q)) are repealed.</text></paragraph>
<paragraph id="HC3A39C6977534DC3AD40F5950F36D528"><enum>(2)</enum><text>All references in law to such paragraphs, as in effect on the date that is one day prior to the effective date of this Act, shall be deemed to be references to paragraphs (1) and (2), respectively, of section 44(i) of the Small Business Act, as added by this Act.</text></paragraph></subsection>
<subsection id="HF49284B3A0C140C6A59377C55F9B6897"><enum>(e)</enum><header>Certain provisions regarding</header><text display-inline="yes-display-inline">Subsection (o) of section 3 of the Small Business Act (15 U.S.C.) is repealed.</text></subsection></section>
<section id="HDD7BA2EA888E428C82163B5ECFBE7A63"><enum>4.</enum><header>Technical amendments</header><text display-inline="no-display-inline">Section 15 of the Small Business Act (15 U.S.C. 644) is amended—</text>
<paragraph id="H38B81983D47444D0879B93A6A557438D"><enum>(1)</enum><text>in the heading of subsection (p), to read as follows: <quote><header-in-text level="subsection" style="OLC">Access to data.—</header-in-text></quote>; and</text></paragraph>
<paragraph id="H3086BEEE94C3463380D5558915846D98"><enum>(2)</enum><text display-inline="yes-display-inline">in the heading of subsection (q), to read as follows: <quote><header-in-text level="subsection" style="OLC">Reports related to procurement center representatives.—</header-in-text></quote>.</text></paragraph></section>
