			 political intelligence</header>

			 political intelligence activities under Lobbying Disclosure Act</header>
				<subsection id="HF601110670DF4F99BB092EE36560D96D"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 3 of the Lobbying Disclosure Act of
			 1995 (2 U.S.C. 1602) is amended—</text>
					<paragraph id="H91AECA21F1694A77BE0E89B5E2A6ED88"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
						<subparagraph id="HA726CEFE3294407CBD5B4A748F5D35DB"><enum>(A)</enum><text>by inserting after
			 <quote>lobbying activities</quote> each place that term appears the following:
			 <quote>or political intelligence activities</quote>; and</text>
						</subparagraph><subparagraph id="HED834DF01A5B4201AAA6CD91494DB263"><enum>(B)</enum><text>by inserting after
			 <quote>lobbyists</quote> the following: <quote>or political intelligence
			 consultants</quote>; and</text>
						</subparagraph></paragraph><paragraph id="H6758BD4C0B264D4E9A4DB7BFE18C8C17"><enum>(2)</enum><text>by adding at the
			 end the following new paragraphs:</text>

							<paragraph id="H602BFBA978E240BF83C95489885247BC"><enum>(17)</enum><header>Political
				intelligence activities</header><text>The term <term>political intelligence
				activities</term> means political intelligence contacts and efforts in support
				of such contacts, including preparation and planning activities, research, and
				other background work that is intended, at the time it is performed, for use in
				such contacts, and coordination with such contacts and efforts of
				others.</text>
							</paragraph><paragraph id="HC00D119F344C4AFBB567C5DFEC0349D0"><enum>(18)</enum><header>Political
				intelligence contact</header>
								<subparagraph id="HD11E5E22DD384B18ACF5D5C65674C48D"><enum>(A)</enum><header>Definition</header><text display-inline="yes-display-inline">The term <term>political intelligence
				contact</term> means any oral or written communication (including an electronic
				communication) to or from a covered executive branch official or a covered
				legislative branch official, the information derived from which is intended for
				use in analyzing securities or commodities markets, or in informing investment
				decisions, and which is made on behalf of a client with regard to—</text>
									<clause id="HA4AC0DEDBC2049569FB8E5B0B5C6E59C"><enum>(i)</enum><text>the formulation,
				modification, or adoption of Federal legislation (including legislative
				proposals);</text>
									</clause><clause id="H4F9C1C78CB254D2499871880EFD6EB06"><enum>(ii)</enum><text display-inline="yes-display-inline">the formulation, modification, or adoption
				of a Federal rule, regulation, Executive order, or any other program, policy,
				or position of the United States Government; or</text>
									</clause><clause id="H654DAE00741D4B06994D549ACA246B37"><enum>(iii)</enum><text>the
				administration or execution of a Federal program or policy (including the
				negotiation, award, or administration of a Federal contract, grant, loan,
				permit, or license).</text>
									</clause></subparagraph><subparagraph id="H250073206F9745588946B81E957D7AFA"><enum>(B)</enum><header>Exception</header><text>The
				term <term>political intelligence contact</term> does not include a
				communication that is made by or to a representative of the media if the
				purpose of the communication is gathering and disseminating news and
				information to the public.</text>
								</subparagraph></paragraph><paragraph id="H3B895A6DEFAE41428C556B5A3C52FEA5"><enum>(19)</enum><header>Political
				intelligence firm</header><text>The term <term>political intelligence
				firm</term> means a person or entity that has 1 or more employees who are
				political intelligence consultants to a client other than that person or
				entity.</text>
							</paragraph><paragraph id="HB31CE64340DC4851960289E7A8730A74"><enum>(20)</enum><header>Political
				intelligence consultant</header><text>The term <term>political intelligence
				consultant</term> means any individual who is employed or retained by a client
				for financial or other compensation for services that include one or more
				political intelligence
				contacts.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HA8760000C43B439FB801AE0412B768EE"><enum>(b)</enum><header>Registration
			 requirement</header><text display-inline="yes-display-inline">Section 4 of the
			 Lobbying Disclosure Act of 1995 (2 U.S.C. 1603) is amended—</text>
					<paragraph id="H66C166C91DB5477E90347BCB3612AA36"><enum>(1)</enum><text>in subsection
			 (a)—</text>
						<subparagraph id="HB17F6335922B4D5D8CD9FAACA41C035C"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
							<clause id="H660327558C6647368D088D8998D43545"><enum>(i)</enum><text>by
			 inserting after <quote>whichever is earlier,</quote> the following: <quote>or a
			 political intelligence consultant first makes a political intelligence
			 contact,</quote>; and</text>
							</clause><clause id="HB9B4B310B54940DD93E025C98FC2431B"><enum>(ii)</enum><text>by
			 inserting after <quote>such lobbyist</quote> each place that term appears the
			 following: <quote>or consultant</quote>;</text>

			 by inserting after <quote>lobbyists</quote> each place that term appears the
			 following: <quote>or political intelligence consultants</quote>; and</text>
						</subparagraph><subparagraph id="H5478FD28DD6E4B6FB9C56291F1651E60"><enum>(C)</enum><text>in paragraph
			 (3)(A)—</text>

			 Lobbying Disclosure Act of 1995 (2 U.S.C. 1604) is amended—</text>

			 by inserting after <quote>lobbying activities</quote> the following: <quote>and
			 political intelligence activities</quote>;</text>

			 enforcement</header><text>Section 6(a) of the Lobbying Disclosure Act of 1995
			 (2 U.S.C. 1605) is amended—</text>

			 (3)(A), by inserting after <quote>lobbying firms,</quote> the following:
			 <quote>political intelligence consultants, political intelligence
			 firms,</quote>;</text>

			 by striking <quote>or lobbying firm</quote> and inserting <quote>, lobbying

					</paragraph></subsection><subsection id="HD800F1FE6AD2451386D7F826E4909A71"><enum>(e)</enum><header>Rules of
			 construction</header><text>Section 8(b) of the Lobbying Disclosure Act of 1995
			 (2 U.S.C. 1607(b)) is amended by striking <quote>or lobbying contacts</quote>
			 and inserting <quote>, lobbying contacts, political intelligence activities, or
			 political intelligence contacts</quote>.</text>
				</subsection><subsection id="H9722B4D6F1DB4FD5ADA757F66D92CD08"><enum>(f)</enum><header>Identification
			 of clients and covered officials</header><text display-inline="yes-display-inline">Section 14 of the Lobbying Disclosure Act
			 of 1995 (2 U.S.C. 1609) is amended—</text>
					<paragraph id="HBB589F0D72F443F3AB5ACD519D4BD9A5"><enum>(1)</enum><text>in subsection
			 (a)—</text>

			 and reports by Comptroller General</header><text display-inline="yes-display-inline">Section 26 of the Lobbying Disclosure Act
			 of 1995 (2 U.S.C. 1614) is amended—</text>

					</paragraph></subsection></section><section id="H26FE4058FAEC4C98A7DC859EED40A278"><enum>102.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this title shall apply with respect to any political intelligence contact (as

							</subparagraph><subparagraph id="H2F58E0577B374F9C8E0A708C70D72354"><enum>(B)</enum><text>directly or
				indirectly, knowingly gives, offers, or promises any thing or things of value
				with an aggregate value of not less than $1,000 to any public official, former
				public official, or person selected to be a public official for or because of
				the official’s or person’s official position;</text>
							</subparagraph><subparagraph id="HA57D503DC9EC42B9AA5C83941380EEC0"><enum>(C)</enum><text>being a public
				official, former public official, or person selected to be a public official,
				directly or indirectly, knowingly demands, seeks, receives, accepts, or agrees
				to receive or accept any thing or things of value with an aggregate value of
				not less than $1,000 for or because of the official’s or person’s official
				position; or</text>
							</subparagraph><subparagraph id="HF50BE91F33954FAAB537646D281732F8"><enum>(D)</enum><text>being a public
				official, former public official, or person selected to be a public official,
				directly or indirectly demands, seeks, receives, accepts, or agrees to receive
				or accept any thing or things of value for or because of any official act
				performed or to be performed by such official or
				person;</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H2DB19BB0115F42BDBD7F75EDFE8448A8"><enum>205.</enum><header>Amendment of
			 the sentencing guidelines relating to certain crimes</header>
				<subsection id="H7E1121B8FD324B159F4A57197688362B"><enum>(a)</enum><header>Directive to
			 sentencing commission</header><text>Pursuant to its authority under section
			 994(p) of title 28, United States Code, and in accordance with this section,
			 the United States Sentencing Commission forthwith shall review and, if
			 appropriate, amend its guidelines and its policy statements applicable to
			 persons convicted of an offense under section 201, 641, 1346A, or 666 of title
			 18, United States Code, in order to reflect the intent of Congress that such
			 penalties meet the requirements in subsection (b) of this section.</text>
				</subsection><subsection id="H99BBE27DA74540CAA275BD33617F463C"><enum>(b)</enum><header>Requirements</header><text>In
			 carrying out this subsection, the Commission shall—</text>
					<paragraph id="H6857A58261F14AF68D2D6366153E34B9"><enum>(1)</enum><text>ensure that the
			 sentencing guidelines and policy statements reflect Congress’s intent that the
			 guidelines and policy statements reflect the serious nature of the offenses
			 described in paragraph (1), the incidence of such offenses, and the need for an
			 effective deterrent and appropriate punishment to prevent such offenses;</text>
					</paragraph><paragraph id="HD59CDE5FA9634BA69F15865018FC7BA9"><enum>(2)</enum><text>consider the
			 extent to which the guidelines may or may not appropriately account for—</text>
						<subparagraph id="H4BBAE612B94E4FD9BF006945C7266B52"><enum>(A)</enum><text>the potential and
			 actual harm to the public and the amount of any loss resulting from the
			 offense;</text>
						</subparagraph><subparagraph id="H0BA9818EE8034BD5BC091B82A411D130"><enum>(B)</enum><text>the level of
			 sophistication and planning involved in the offense;</text>
						</subparagraph><subparagraph id="H8D00445CD8EB47EC900F018EEE8629CE"><enum>(C)</enum><text>whether the
			 offense was committed for purposes of commercial advantage or private financial
			 benefit;</text>
						</subparagraph><subparagraph id="HDBCBC8EAF651418DA51E2528ECE31AF1"><enum>(D)</enum><text>whether the
			 defendant acted with intent to cause either physical or property harm in
			 committing the offense;</text>
						</subparagraph><subparagraph id="HA44890652122411FB2AFB5E5D6633FE7"><enum>(E)</enum><text>the extent to
			 which the offense represented an abuse of trust by the offender and was
			 committed in a manner that undermined public confidence in the Federal, State,
			 or local government; and</text>
						</subparagraph><subparagraph id="H1D28A1C07B6B4E058151E3FC33CAD480"><enum>(F)</enum><text>whether the
			 violation was intended to or had the effect of creating a threat to public
			 health or safety, injury to any person or even death;</text>
						</subparagraph></paragraph><paragraph id="HFAD53F8A9ED2408393ED5497376CDF7D"><enum>(3)</enum><text>assure reasonable
			 consistency with other relevant directives and with other sentencing
			 guidelines;</text>
					</paragraph><paragraph id="H1E3868A0C9FE4E63BFDAE3A2AB79CE7D"><enum>(4)</enum><text>account for any
			 additional aggravating or mitigating circumstances that might justify
			 exceptions to the generally applicable sentencing ranges;</text>
					</paragraph><paragraph id="H99978DF80F2C43DFBED6B59486D98924"><enum>(5)</enum><text>make any necessary
			 conforming changes to the sentencing guidelines; and</text>
					</paragraph><paragraph id="H29463762EED749E2B4F0FD522B2562DC"><enum>(6)</enum><text>assure that the
			 guidelines adequately meet the purposes of sentencing as set forth in section
			 3553(a)(2) of title 18, United States Code.</text>
					</paragraph></subsection></section><section id="H5490C82E47A64BAF8689543B90B59ED2"><enum>206.</enum><header>Extension of
			 statute of limitations for serious public corruption offenses</header>
				<subsection id="H4EDA6886357242B38040C2864FDA2AAA"><enum>(a)</enum><header>In
			 general</header><text>Chapter 213 of title 18, United States Code, is amended
			 by adding at the end the following:</text>

				666;</text>
							</paragraph><paragraph id="H2B2C793B4D934934B0920259D5A42D81"><enum>(2)</enum><text>section 1341 or
				1343, when charged in conjunction with section 1346 and where the offense
				involves a scheme or artifice to deprive another of the intangible right of
				honest services of a public official;</text>
							</paragraph><paragraph id="HDCCBC7DAD09E4E3AAA3F0EF175AC1878"><enum>(3)</enum><text>section 1951, if
				the offense involves extortion under color of official right;</text>
							</paragraph><paragraph id="HD0BA12C6E07E48FAAA53994D76839987"><enum>(4)</enum><text>section 1952, to
				the extent that the unlawful activity involves bribery; or</text>
							</paragraph><paragraph id="HBBF0DDCFE030481692EA8301BB179BCC"><enum>(5)</enum><text>section 1962, to
				the extent that the racketeering activity involves bribery chargeable under
				State law, involves a violation of section 201 or 666, section 1341 or 1343,
				when charged in conjunction with section 1346 and where the offense involves a
				scheme or artifice to deprive another of the intangible right of honest
				services of a public official, or section 1951, if the offense involves
				extortion under color of official
				right.</text>

				official</header><text>The term <term>public official</term> means an officer,
				employee, or elected or appointed representative, or person acting for or on be
				half of the United States, a State, or a subdivision of a State, or any
				department, agency or branch of government thereof, in any official function,
				under or by authority of any such department, agency, or branch of
				government.</text>
								</paragraph><paragraph id="H1736FCA01CD0422C802BB4A3F56F142C"><enum>(3)</enum><header>State</header><text>The
				term <term>State</term> includes a State of the United States, the District of
				Columbia, and any commonwealth, territory, or possession of the United
				States.</text>
								</paragraph><paragraph id="H6AD735F8B62A493D98ABECC6BE4EB579"><enum>(4)</enum><header>Undisclosed
				self-dealing</header><text>The term <term>undisclosed self-dealing</term> means
				that—</text>
									<subparagraph id="H2239EDEAE7CC41A9980FB86203F3D81A"><enum>(A)</enum><text>a public official
				performs an official act for the purpose, in whole or in material part, of
				furthering or benefitting a financial interest, of which the public official
				has knowledge, of—</text>
										<clause id="H4B528490B47042E7B5AD4321A110C75E"><enum>(i)</enum><text>the public
				official;</text>
										</clause><clause id="H2661ABF228324051BF64FCF983079D94"><enum>(ii)</enum><text>the spouse or
				minor child of a public official;</text>
										</clause><clause id="H4F0FB65D07994E7C8360BEDD20602BE8"><enum>(iii)</enum><text>a general
				business partner of the public official;</text>
										</clause><clause id="H722BE0D7D35845788B7FE8043AEF0B2A"><enum>(iv)</enum><text>a
				business or organization in which the public official is serving as an
				employee, officer, director, trustee, or general partner;</text>
										</clause><clause id="HEAB45113E99647928327065883290DF9"><enum>(v)</enum><text>an
				individual, business, or organization with whom the public official is
				negotiating for, or has any arrangement concerning, prospective employment or
				financial compensation; or</text>
										</clause><clause id="H14479216A1794E918B9432363574AC9D"><enum>(vi)</enum><text>an individual,
				business, or organization from whom the public official has received any thing
				or things of value, otherwise than as provided by law for the proper discharge
				of official duty, or by rule or regulation; and</text>
										</clause></subparagraph><subparagraph id="HC9EFF446D4264564937101F09BDBFE07"><enum>(B)</enum><text>the public
				official knowingly falsifies, conceals, or covers up material information that
				is required to be disclosed by any Federal, State, or local statute, rule,
				regulation, or charter applicable to the public official, or the knowing
				failure of the public official to disclose material information in a manner
				that is required by any Federal, State, or local statute, rule, regulation, or
				charter applicable to the public official.</text>
									</subparagraph></paragraph><paragraph id="H3442CE1423374625AC647208A4CE14AA"><enum>(5)</enum><header>Material
				information</header><text>The term <term>material information</term> means
				information—</text>
									<subparagraph id="H7B1B2987E30C44E580374F7041347320"><enum>(A)</enum><text>regarding a
				financial interest of a person described in clauses (i) through (iv) paragraph
				(4)(A); and</text>
									</subparagraph><subparagraph id="H209118C4800844A4BC01104AA780ABAA"><enum>(B)</enum><text>regarding the
				association, connection, or dealings by a public official with an individual,
				business, or organization as described in clauses (iii) through (vi) of
				paragraph
				(4)(A).</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HDAA046E13F30439C9F838E1BA5FA4AB9"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of sections for chapter 63 of title 18,
			 United States Code, is amended by inserting after the item relating to section
			 1346 the following new item:</text>

			 amendments made by this section apply to acts engaged in on or after the date
			 of the enactment of this Act.</text>
				</subsection></section><section id="H249383D6B40F467C9FB88435649A34EF"><enum>211.</enum><header>Disclosure of
			 information in complaints against judges</header><text display-inline="no-display-inline">Section 360(a) of title 28, United States
			 Code, is amended—</text>
				<paragraph id="H40619E47E10A424790DBF0CB29C5BDCD"><enum>(1)</enum><text>in paragraph (2)
			 by striking <quote>or</quote>;</text>
				</paragraph><paragraph id="H5A32A4272D9645BDA9F8F87C8A9958E3"><enum>(2)</enum><text>in paragraph (3),
			 by striking the period at the end, and inserting <quote>; or</quote>;
			 and</text>
				</paragraph><paragraph id="HF58362DFC96C4282894122B6A5B8F336"><enum>(3)</enum><text>by inserting after
			 paragraph (3) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H7FCBE5DBE75B4CB7BB07ABA32DC96AF3" style="OLC">
						<paragraph id="H7D95176962274274BC60A95BBD7517D0"><enum>(4)</enum><text>such disclosure of

				</paragraph></section><section id="HB560A0F504B84321856A4BEB6C185DBE"><enum>212.</enum><header>Clarification
			 of exemption in certain bribery offenses</header><text display-inline="no-display-inline">Section 666(c) of title 18, United States
			 Code, is amended—</text>
				<paragraph id="HA1B879D9110F4FF88BB5DB2EC5BCCB3D"><enum>(1)</enum><text>by striking
			 <quote>This section does not apply to</quote>; and</text>
				</paragraph><paragraph id="H387C59DA7D944431B54E43082EBB1B59"><enum>(2)</enum><text>by inserting
			 <quote>The term <term>any thing of value</term> that is corruptly solicited,
			 demanded, accepted or agreed to be accepted in subsection (a)(1)(B) or
			 corruptly given, offered, or agreed to be given in subsection (a)(2) shall not
			 include,</quote> before <quote>bona fide salary</quote>.</text>
				</paragraph></section><section id="HE0E9B6AA10824B3288E94DF6B8D1D1E8"><enum>213.</enum><header>Certifications
			 regarding appeals by United States</header><text display-inline="no-display-inline">Section 3731 of title 18, United States
			 Code, is amended by inserting after <quote>United States attorney</quote> the
			 following: <quote>, Deputy Attorney General, Assistant Attorney General, or the
			 Attorney General</quote>.</text>
