<legis-type>AN ACT</legis-type> 
<official-title display="yes">To intensify efforts to identify, prevent, and recover payment error, waste, fraud, and abuse within Federal spending.</official-title>

<section commented="no" display-inline="no-display-inline" id="H981B3DE185C44EB0A35C355482DCC4AF" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improper Payments Elimination and Recovery Improvement Act of 2012</short-title></quote>.</text> </section> 
<section commented="no" display-inline="no-display-inline" id="HFEDBB83B7EB1457CA1A18F7D365DB17F" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H18603DD497C94BE4954DB6664414B8C8"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>agency</term> means an executive agency as that term is defined under section 102 of title 31, United States Code;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H2D98D37509D1439EB5F99A48ABDC662A"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>improper payment</term> has the meaning given that term in section 2(g) of the Improper Payments Information Act of 2002 (31 U.S.C. 3321 note), as redesignated by section 3(a)(1) of this Act; and</text> </paragraph> 
<paragraph id="H3A95ACA367C340B6A7BE55C109DC800D"><enum>(3)</enum><text>the term <term>State</term> means each State of the United States, the District of Columbia, each territory or possession of the United States, and each federally recognized Indian tribe.</text> </paragraph></section> 
<section commented="no" display-inline="no-display-inline" id="HE74180471A2E4544A0691830C5DC25DC" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Improving the Determination of Improper Payments By Federal Agencies</header> 
<subsection commented="no" display-inline="no-display-inline" id="H5364B75902694AE7A4C888C1BC4731B2"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 2 of the Improper Payments Information Act of 2002 (31 U.S.C. 3321 note) is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HAEA575C9622640648E3B904AAC0FFB04"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (b) through (g) as subsections (c) through (h), respectively;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H5FAF728D67264467B7EE640D9269E85B"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the following:</text> 
<quoted-block display-inline="no-display-inline" id="HBF85B132E25349ECB4B09FC72B24CD06" style="OLC"> 
<subsection commented="no" display-inline="no-display-inline" id="H0C4190EF457C4113A31FE54858F41F54"><enum>(b)</enum><header display-inline="yes-display-inline">Improving the determination of improper payments</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H37F91F8F0B554C55BA53FE6D7C139FB4"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall on an annual basis—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HFA1819B8F1AA48219FF4B679A0091AF4"><enum>(A)</enum><text display-inline="yes-display-inline">identify a list of high-priority Federal programs for greater levels of oversight and review—</text> 
<clause commented="no" display-inline="no-display-inline" id="H60562A3BC19B4FFF8216A7ABC8697588"><enum>(i)</enum><text display-inline="yes-display-inline">in which the highest dollar value or highest rate of improper payments occur; or</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H398435C4F2434FCC98337AA46982B211"><enum>(ii)</enum><text display-inline="yes-display-inline">for which there is a higher risk of improper payments; and</text> </clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H85137F5923D84B568565B556C71EFB9C"><enum>(B)</enum><text display-inline="yes-display-inline">in coordination with the agency responsible for administering the high-priority program, establish annual targets and semi-annual or quarterly actions for reducing improper payments associated with each high-priority program.</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H352D66CBB71F438C894DBA8444E97754"><enum>(2)</enum><header display-inline="yes-display-inline">Report on high-priority improper payments</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7FF24D4D4DE84307A8BB070B910EF007"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to Federal privacy policies and to the extent permitted by law, each agency with a program identified under paragraph (1)(A) on an annual basis shall submit to the Inspector General of that agency, and make available to the public (including availability through the Internet), a report on that program.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HE1B6264F76F142D287C9D3D11CB19C8A"><enum>(B)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each report under this paragraph—</text> 
<clause commented="no" display-inline="no-display-inline" id="H54CA1063209146EFA623EB0AEA1F6505"><enum>(i)</enum><text display-inline="yes-display-inline">shall describe—</text> 
<subclause commented="no" display-inline="no-display-inline" id="HF8E69470F2AD4D2FBB0A65849A6A4F42"><enum>(I)</enum><text display-inline="yes-display-inline">any action the agency—</text> 
<item commented="no" display-inline="no-display-inline" id="H071B5A6F2BCE4C1289B4FE093C739BCC"><enum>(aa)</enum><text display-inline="yes-display-inline">has taken or plans to take to recover improper payments; and</text> </item> 
<item commented="no" display-inline="no-display-inline" id="H64E9EEF98AFC4B0E861580BA38008EF5"><enum>(bb)</enum><text display-inline="yes-display-inline">intends to take to prevent future improper payments; and</text> </item></subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="HA2E7F9FC8B674C9DB6A88FA4DA1835BE"><enum>(ii)</enum><text display-inline="yes-display-inline">shall not include any referrals the agency made or anticipates making to the Department of Justice, or any information provided in connection with such referrals.</text> </clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HDCB009D7603F4E82A8428751C463AF4A"><enum>(C)</enum><header display-inline="yes-display-inline">Public availability on central website</header><text display-inline="yes-display-inline">The Office of Management and Budget shall make each report submitted under this paragraph available on a central website.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF69F692358C447629CE770405D2B8BA4"><enum>(D)</enum><header display-inline="yes-display-inline">Availability of information to Inspector General</header><text display-inline="yes-display-inline">Subparagraph (B)(ii) shall not prohibit any referral or information being made available to an Inspector General as otherwise provided by law.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H066ED6338FB04F86B575B78D8EE523ED"><enum>(E)</enum><header display-inline="yes-display-inline">Assessment and recommendations</header><text display-inline="yes-display-inline">The Inspector General of each agency that submits a report under this paragraph shall, for each program of the agency that is identified under paragraph (1)(A)—</text> 
<clause commented="no" display-inline="no-display-inline" id="HC5FDD2178EC44BB58D1BEF298A98DC1A"><enum>(i)</enum><text display-inline="yes-display-inline">review—</text> 
<subclause commented="no" display-inline="no-display-inline" id="H69CA1FC5D7C646E8851EAEC7659261F7"><enum>(I)</enum><text display-inline="yes-display-inline">the assessment of the level of risk associated with the program, and the quality of the improper payment estimates and methodology of the agency relating to the program; and</text> </subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H785908DA339D4F5FBE41DB0003CDE20A"><enum>(II)</enum><text display-inline="yes-display-inline">the oversight or financial controls to identify and prevent improper payments under the program; and</text> </subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="H63816D5DD3E14E7790DACB6BAD3328BF"><enum>(ii)</enum><text display-inline="yes-display-inline">submit to Congress recommendations, which may be included in another report submitted by the Inspector General to Congress, for modifying any plans of the agency relating to the program, including improvements for improper payments determination and estimation methodology.</text> </clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H54D920AE62FC4F6E8C6C3C4CF340650F"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (d) (as redesignated by paragraph (1) of this subsection), by striking <quote>subsection (b)</quote> each place that term appears and inserting <quote>subsection (c)</quote>;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HAADC2EE00A6048E0A3578A065F69CB31"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (e) (as redesignated by paragraph (1) of this subsection), by striking <quote>subsection (b)</quote> and inserting <quote>subsection (c)</quote>; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HC9C7A51282F34BFC8D36288C539949DC"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (g)(3) (as redesignated by paragraph (1) of this subsection), by inserting <quote>or a Federal employee</quote> after <quote>non-Federal person or entity</quote>.</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H8B1B963FCCED4246B4D3AE73AADF9C5D"><enum>(b)</enum><header display-inline="yes-display-inline">Improved estimates</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H3C6A708F09FA411E86CCB4EF858663D4"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Director of the Office of Management and Budget shall provide guidance to agencies for improving the estimates of improper payments under the Improper Payments Information Act of 2002 (31 U.S.C. 3321 note).</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HFA709F87777E4D8E89779E238AA5BAB6"><enum>(2)</enum><header display-inline="yes-display-inline">Guidance</header><text display-inline="yes-display-inline">Guidance under this subsection shall—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7D79DC3BEF50412B8DB390D43F9F6792"><enum>(A)</enum><text display-inline="yes-display-inline">strengthen the estimation process of agencies by setting standards for agencies to follow in determining the underlying validity of sampled payments to ensure amounts being billed, paid, or obligated for payment are proper;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HED0D4A4141064F78B79361530057BD74"><enum>(B)</enum><text display-inline="yes-display-inline">instruct agencies to give the persons or entities performing improper payments estimates access to all necessary payment data, including access to relevant documentation;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8289C152BC5E41FDA7B81D3E54EB502B"><enum>(C)</enum><text display-inline="yes-display-inline">explicitly bar agencies from relying on self-reporting by the recipients of agency payments as the sole source basis for improper payments estimates;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H2FF254B261754D8E81AFC02031D74342"><enum>(D)</enum><text display-inline="yes-display-inline">require agencies to include all identified improper payments in the reported estimate, regardless of whether the improper payment in question has been or is being recovered;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H3D38502A25144DEA94D428DCD4E5D158"><enum>(E)</enum><text display-inline="yes-display-inline">include payments to employees, including salary, locality pay, travel pay, purchase card use, and other employee payments, as subject to risk assessment and, where appropriate, improper payment estimation; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HCCABDE9E939F45B186B27F1D9BD27B93"><enum>(F)</enum><text display-inline="yes-display-inline">require agencies to tailor their corrective actions for the high-priority programs identified under section 2(b)(1)(A) of the Improper Payments Information Act of 2002 (31 U.S.C. 3321 note) to better reflect the unique processes, procedures, and risks involved in each specific program.</text> </subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H682B7A7D4B9D41A0B215086D196F8383"><enum>(c)</enum><header display-inline="yes-display-inline">Technical and conforming amendments</header><text display-inline="yes-display-inline">The Improper Payments Elimination and Recovery Act of 2010 (Public Law 111–204; 31 U.S.C. 3321 note) is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HAF1FE9445E8344D1AD0A3581F4422E55"><enum>(1)</enum><text display-inline="yes-display-inline">in section 2(h)(1), by striking <quote>section 2(f)</quote> and all that follows and inserting <quote>section 2(g) of the Improper Payments Information Act of 2002 (31 U.S.C. 3321 note).</quote>; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H7692DE7069DB4FBD845C4383F2FAB66D"><enum>(2)</enum><text display-inline="yes-display-inline">in section 3(a)—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HE41C6561CB6541F897A54592FB9BC48E"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>section 2(f)</quote> and all that follows and inserting <quote>section 2(g) of the Improper Payments Information Act of 2002 (31 U.S.C. 3321 note).</quote>; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0B428601B22E461098032F7A87A4B568"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text> 
<clause commented="no" display-inline="no-display-inline" id="H9C2E4071FF1B4BE486682EEE225B0967"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>section 2(b)</quote> each place it appears and inserting <quote>section 2(c)</quote>; and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H15438EA999CA4B73848AF3E36FE1FAA8"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>section 2(c)</quote> each place it appears and inserting <quote>section 2(d)</quote>.</text> </clause></subparagraph></paragraph></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H289C4AA209E148A49FA025182818EA8B" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Improper Payments Information</header><text display-inline="no-display-inline">Section 2(a)(3)(A)(ii) of the Improper Payments Information Act of 2002 (31 U.S.C. 3321 note) is amended by striking <quote>with respect to fiscal years following September 30th of a fiscal year beginning before fiscal year 2013 as determined by the Office of Management and Budget</quote> and inserting <quote>with respect to fiscal year 2014 and each fiscal year thereafter</quote>.</text> </section> 
<section commented="no" display-inline="no-display-inline" id="HEDF16E7CEEB7411AB24DF799212C7D7F" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Do not pay initiative</header> 
<subsection commented="no" display-inline="no-display-inline" id="HD517A28B7EB4427BA4701AA344475131"><enum>(a)</enum><header display-inline="yes-display-inline">Prepayment and preaward procedures</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HFC6F469F2D15439885A3DB8F34E0EB19"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each agency shall review prepayment and preaward procedures and ensure that a thorough review of available databases with relevant information on eligibility occurs to determine program or award eligibility and prevent improper payments before the release of any Federal funds.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HCFA38684258B454CB59D8D38EE003976"><enum>(2)</enum><header display-inline="yes-display-inline">Databases</header><text display-inline="yes-display-inline">At a minimum and before issuing any payment and award, each agency shall review as appropriate the following databases to verify eligibility of the payment and award:</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0B5BF10E17DE4A47966A9034011F8E4D"><enum>(A)</enum><text display-inline="yes-display-inline">The Death Master File of the Social Security Administration.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H859FB89E2A1443768F35AED0FA733379"><enum>(B)</enum><text display-inline="yes-display-inline">The General Services Administration’s Excluded Parties List System.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H4AE866EC3484449EA477AA693859FF5F"><enum>(C)</enum><text display-inline="yes-display-inline">The Debt Check Database of the Department of the Treasury.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H468DDD47ED394F55A904560F0D48F8F7"><enum>(D)</enum><text display-inline="yes-display-inline">The Credit Alert System or Credit Alert Interactive Voice Response System of the Department of Housing and Urban Development.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H92B5F861124F4AFAAFBA14FBC1F7E96A"><enum>(E)</enum><text display-inline="yes-display-inline">The List of Excluded Individuals/Entities of the Office of Inspector General of the Department of Health and Human Services.</text> </subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H47A37CDE8AE04D2AA40783C8392C162E"><enum>(b)</enum><header display-inline="yes-display-inline">Do not pay Initiative</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H83405AAD69EA40B3BA0E2EFE0C0765FA"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established the Do Not Pay Initiative which shall include—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB36FB1F54BFB429AAB08CEFE370F000A"><enum>(A)</enum><text display-inline="yes-display-inline">use of the databases described under subsection (a)(2); and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB4A4697CE55A4E03952DB0E3F7D5C352"><enum>(B)</enum><text display-inline="yes-display-inline">use of other databases designated by the Director of the Office of Management and Budget in consultation with agencies and in accordance with paragraph (2).</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HEE6CBA8735CD4F56A94ED8F6C0AAB9AB"><enum>(2)</enum><header display-inline="yes-display-inline">Other databases</header><text display-inline="yes-display-inline">In making designations of other databases under paragraph (1)(B), the Director of the Office of Management and Budget shall—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H82CA80A5D374445284D639A42FC739CE"><enum>(A)</enum><text display-inline="yes-display-inline">consider any database that substantially assists in preventing improper payments; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0B11808618844BFD8C9CDB545F78FDD6"><enum>(B)</enum><text display-inline="yes-display-inline">provide public notice and an opportunity for comment before designating a database under paragraph (1)(B).</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HFC3A961599804B51A64B3587F89091E7"><enum>(3)</enum><header display-inline="yes-display-inline">Access and review by agencies</header><text display-inline="yes-display-inline">For purposes of identifying and preventing improper payments, each agency shall have access to, and use of, the Do Not Pay Initiative to verify payment or award eligibility in accordance with subsection (a) when the Director of the Office of Management and Budget determines the Do Not Pay Initiative is appropriately established for the agency.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H1DEEB587D48D498B9F51634744582DD4"><enum>(4)</enum><header display-inline="yes-display-inline">Payment otherwise required</header><text display-inline="yes-display-inline">When using the Do Not Pay Initiative, an agency shall recognize that there may be circumstances under which the law requires a payment or award to be made to a recipient, regardless of whether that recipient is identified as potentially ineligible under the Do Not Pay Initiative.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H404BBE1B87A948F39DABD6FB73E14346"><enum>(5)</enum><header display-inline="yes-display-inline">Annual report</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall submit to Congress an annual report, which may be included as part of another report submitted to Congress by the Director, regarding the operation of the Do Not Pay Initiative, which shall—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7F6952CE2BE84FF09528013C29AF89E2"><enum>(A)</enum><text display-inline="yes-display-inline">include an evaluation of whether the Do Not Pay Initiative has reduced improper payments or improper awards; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HEEA3A50102624C30AB977E9D22BEFD66"><enum>(B)</enum><text display-inline="yes-display-inline">provide the frequency of corrections or identification of incorrect information.</text> </subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H44CF826C6D0F4155A3A76970BBECA95C"><enum>(c)</enum><header display-inline="yes-display-inline">Database integration plan</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Director of the Office of Management and Budget shall provide to the Congress a plan for—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HD2368361FBB04A8AA5B81AA33216FAD7"><enum>(1)</enum><text display-inline="yes-display-inline">inclusion of other databases on the Do Not Pay Initiative;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD38780A3C67E46B590043A72087BD168"><enum>(2)</enum><text display-inline="yes-display-inline">to the extent permitted by law, agency access to the Do Not Pay Initiative; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H69617F2A9DAE4652BD1C4F13BA7FF13C"><enum>(3)</enum><text display-inline="yes-display-inline">the data use agreements described under subsection (e)(2)(D).</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HAE1F93FA27564E0E8D7FF2516DFD75C6"><enum>(d)</enum><header display-inline="yes-display-inline">Initial working system</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H8B432D253905481C94975CD0F0DF4070"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Director of the Office of Management and Budget shall establish a working system for prepayment and preaward review that includes the Do Not Pay Initiative as described under this section.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HC942A4F933EA400BABAE6B3B31CFE2BC"><enum>(2)</enum><header display-inline="yes-display-inline">Working system</header><text display-inline="yes-display-inline">The working system established under paragraph (1)—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H9709750280F4479B925B4F84735CF9EA"><enum>(A)</enum><text display-inline="yes-display-inline">may be located within an appropriate agency;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8697B635796B4E91A51F4C8DF6845C8B"><enum>(B)</enum><text display-inline="yes-display-inline">shall include not less than 3 agencies as users of the system; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0E623397F6A04DD789D7734C1CD9E6BC"><enum>(C)</enum><text display-inline="yes-display-inline">shall include investigation activities for fraud and systemic improper payments detection through analytic technologies and other techniques, which may include commercial database use or access.</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H71F8641A6C2A45699C684C948CF34C8C"><enum>(3)</enum><header display-inline="yes-display-inline">Application to all agencies</header><text display-inline="yes-display-inline">Not later than June 1, 2013, each agency shall review all payments and awards for all programs of that agency through the system established under this subsection.</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HFB8FAAC07AA14F4D968E988769FBDA2E"><enum>(e)</enum><header display-inline="yes-display-inline">Facilitating data access by Federal agencies and Offices of Inspectors General for purposes of program integrity</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HE517E64D00D54793B89B36A9E0D7C887"><enum>(1)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>Inspector General</term> means any Inspector General described in subparagraph (A), (B), or (I) of section 11(b)(1) of the Inspector General Act of 1978 (5 U.S.C. App.) and any successor Inspector General.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H7CD7F5DB551C4B12B76383A4C76814C1"><enum>(2)</enum><header display-inline="yes-display-inline">Computer matching by Federal agencies for purposes of investigation and prevention of improper payments and fraud</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7C5314FD7C004BA69E04BD4F6E8CF64E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in this paragraph, in accordance with section 552a of title 5, United States Code (commonly known as the Privacy Act of 1974), each Inspector General and the head of each agency may enter into computer matching agreements with other inspectors general and agency heads that allow ongoing data matching (which shall include automated data matching) in order to assist in the detection and prevention of improper payments.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0E767D268035431381DE8467A6D7798D"><enum>(B)</enum><header display-inline="yes-display-inline">Review</header><text display-inline="yes-display-inline">Not later than 60 days after a proposal for an agreement under subparagraph (A) has been presented to a Data Integrity Board established under section 552a(u) of title 5, United States Code, for consideration, the Data Integrity Board shall respond to the proposal.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H33EDB87CA6FA46A1BFBD5DDDBB3CD5EB"><enum>(C)</enum><header display-inline="yes-display-inline">Termination date</header><text display-inline="yes-display-inline">An agreement under subparagraph (A)—</text> 
<clause commented="no" display-inline="no-display-inline" id="H136807EF30DE49BFA592D9790137B32F"><enum>(i)</enum><text display-inline="yes-display-inline">shall have a termination date of less than 3 years; and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H2BC419889EF64A86842BD211DCB7C320"><enum>(ii)</enum><text display-inline="yes-display-inline">during the 3-month period ending on the date on which the agreement is scheduled to terminate, may be renewed by the agencies entering the agreement for not more than 3 years.</text> </clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HC3BA382958044093BE221BF63CDD1432"><enum>(D)</enum><header display-inline="yes-display-inline">Multiple agencies</header><text display-inline="yes-display-inline">For purposes of this paragraph, section 552a(o)(1) of title 5, United States Code, shall be applied by substituting <quote>between the source agency and the recipient agency or non-Federal agency or an agreement governing multiple agencies</quote> for <quote>between the source agency and the recipient agency or non-Federal agency</quote> in the matter preceding subparagraph (A).</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H2A349530042A432BA6E423FDCD3E857C"><enum>(E)</enum><header display-inline="yes-display-inline">Cost-benefit analysis</header><text display-inline="yes-display-inline">A justification under section 552a(o)(1)(B) of title 5, United States Code, relating to an agreement under subparagraph (A) is not required to contain a specific estimate of any savings under the computer matching agreement.</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H643C0D7D9E884C14A52E6F1A144EAFE3"><enum>(3)</enum><header display-inline="yes-display-inline">Guidance by the Office of Management and Budget</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, and in consultation with the Council of the Inspectors General on Integrity and Efficiency, the Secretary of Health and Human Services, the Commissioner of Social Security, and the head of any other relevant agency, the Director of the Office of Management and Budget shall—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7B81E468EA4C4E638D67E603719DD907"><enum>(A)</enum><text display-inline="yes-display-inline">issue guidance for agencies regarding implementing this subsection, which shall include standards for—</text> 
<clause commented="no" display-inline="no-display-inline" id="HEC123077423D495D818FDD922D525B53"><enum>(i)</enum><text display-inline="yes-display-inline">reimbursement of costs, when necessary, between agencies;</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H9A9B695B9E5044DDB500BFF195F67E7C"><enum>(ii)</enum><text display-inline="yes-display-inline">retention and timely destruction of records in accordance with section 552a(o)(1)(F) of title 5, United States Code; and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H661B7C699CEB4B5C9C924D3A8DCF537A"><enum>(iii)</enum><text display-inline="yes-display-inline">prohibiting duplication and redisclosure of records in accordance with section 552a(o)(1)(H) of title 5, United States Code;</text> </clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H522661C64C97492691767EEFC61CE956"><enum>(B)</enum><text display-inline="yes-display-inline">review the procedures of the Data Integrity Boards established under section 552a(u) of title 5, United States Code, and develop new guidance for the Data Integrity Boards to—</text> 
<clause commented="no" display-inline="no-display-inline" id="H1EB2FD1E6F3248D4AFD6F2651867928C"><enum>(i)</enum><text display-inline="yes-display-inline">improve the effectiveness and responsiveness of the Data Integrity Boards;</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H3D48EF9423D94800818586C2486E8B89"><enum>(ii)</enum><text display-inline="yes-display-inline">ensure privacy protections in accordance with section 552a of title 5, United States Code (commonly known as the Privacy Act of 1974); and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="HBC3A5D51E1EC41548B0D2FF69D13BCBB"><enum>(iii)</enum><text display-inline="yes-display-inline">establish standard matching agreements for use when appropriate; and</text> </clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H2D3C648806F245908B1E315D566D9746"><enum>(C)</enum><text display-inline="yes-display-inline">establish and clarify rules regarding what constitutes making an agreement entered under paragraph (2)(A) available upon request to the public for purposes of section 552a(o)(2)(A)(ii) of title 5, United States Code, which shall include requiring publication of the agreement on a public website.</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H5320C1DBB3254422AD6F366E8D7C56F9"><enum>(4)</enum><header display-inline="yes-display-inline">Corrections</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall establish procedures providing for the correction of data in order to ensure—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H04C81C21694944EF90D3EA795EFF750C"><enum>(A)</enum><text display-inline="yes-display-inline">compliance with section 552a(p) of title 5, United States Code; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HE130A8F9C04B46F0B67674A42E3E6065"><enum>(B)</enum><text display-inline="yes-display-inline">that corrections are made in any Do Not Pay Initiative database and in any relevant source databases designated by the Director of the Office of Management and Budget under subsection (b)(1).</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H31D10B7704C84B34A771104B68098DB2"><enum>(5)</enum><header display-inline="yes-display-inline">Compliance</header><text display-inline="yes-display-inline">The head of each agency, in consultation with the Inspector General of the agency, shall ensure that any information provided to an individual or entity under this subsection is provided in accordance with protocols established under this subsection.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HAB421F8F069946328CFB80523F19FB64"><enum>(6)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to affect the rights of an individual under section 552a(p) of title 5, United States Code.</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H72BE496247F642CD83E18DF8EF629E55"><enum>(f)</enum><header display-inline="yes-display-inline">Development and access to a database of incarcerated individuals</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Attorney General shall submit to Congress recommendations for increasing the use of, access to, and the technical feasibility of using data on the Federal, State, and local conviction and incarceration status of individuals for purposes of identifying and preventing improper payments by Federal agencies and programs and fraud.</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HDD0D710049DD4DCEAB3E494E29598485"><enum>(g)</enum><header display-inline="yes-display-inline">Plan To curb Federal improper payments to deceased individuals by improving the quality and use by Federal agencies of the Social Security Administration death master file</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HAAA10B811463433A880894CD7BD7770E"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">In conjunction with the Commissioner of Social Security and in consultation with relevant stakeholders that have an interest in or responsibility for providing the data, and the States, the Director of the Office of Management and Budget shall establish a plan for improving the quality, accuracy, and timeliness of death data maintained by the Social Security Administration, including death information reported to the Commissioner under section 205(r) of the Social Security Act (42 U.S.C. 405(r)).</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H751212B98FD24B1C898C9F7509C6D915"><enum>(2)</enum><header display-inline="yes-display-inline">Additional actions under plan</header><text display-inline="yes-display-inline">The plan established under this subsection shall include recommended actions by agencies to—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8F905F4589DB4E0087FB75C321873B38"><enum>(A)</enum><text display-inline="yes-display-inline">increase the quality and frequency of access to the Death Master File and other death data;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H22272113753642BA92D9D49B97A7DAAF"><enum>(B)</enum><text display-inline="yes-display-inline">achieve a goal of at least daily access as appropriate;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HA2858096DAB840D7928615B232D1BFAD"><enum>(C)</enum><text display-inline="yes-display-inline">provide for all States and other data providers to use improved and electronic means for providing data;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H42370FE85EE14FC29B6291D18C2BCF2A"><enum>(D)</enum><text display-inline="yes-display-inline">identify improved methods by agencies for determining ineligible payments due to the death of a recipient through proactive verification means; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HCF267F727C8649288A0433F0A14C2977"><enum>(E)</enum><text display-inline="yes-display-inline">address improper payments made by agencies to deceased individuals as part of Federal retirement programs.</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HF011C16BC10B480FAD3914A1D3444726"><enum>(3)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, the Director of the Office of Management and Budget shall submit a report to Congress on the plan established under this subsection, including recommended legislation.</text> </paragraph></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="HDAB57C9638D14B66BC0F7B158487A9EB" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Improving recovery of improper payments</header> 
<subsection commented="no" display-inline="no-display-inline" id="H80A19A0F9F4B4544984832B44734B97D"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this section, the term <term>recovery audit</term> means a recovery audit described under section 2(h) of the Improper Payments Elimination and Recovery Act of 2010 (31 U.S.C. 3301 note).</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H9EB639389BDF4C6CBE70E050018245BD"><enum>(b)</enum><header display-inline="yes-display-inline">Review</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall determine—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H9C73CC7E659148D3BC770A2F976EDDEB"><enum>(1)</enum><text display-inline="yes-display-inline">current and historical rates and amounts of recovery of improper payments (or, in cases in which improper payments are identified solely on the basis of a sample, recovery rates and amounts estimated on the basis of the applicable sample), including a list of agency recovery audit contract programs and specific information of amounts and payments recovered by recovery audit contractors; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H87B924A4391A44958E82BE7BE39D2D67"><enum>(2)</enum><text display-inline="yes-display-inline">targets for recovering improper payments, including specific information on amounts and payments recovered by recovery audit contractors.</text> </paragraph></subsection></section>
