		<section id="H9CC779CFCC304198924225F019AC4F62" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Yerington Land Conveyance and
			 Sustainable Development Act</short-title></quote>.</text>
		</section><section id="HE5BDF0DD021942A69EC266AEDF76AB19"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="H3A6B0267D3C146D6BDB870655F929423"><enum>(1)</enum><text>the city of Yerington,
			 Nevada, which has an unemployment rate of 16 percent, has the highest
			 unemployment rate in the State of Nevada;</text>
			</paragraph><paragraph id="H32235B463A9E4A90B28ACB5170C9888D"><enum>(2)</enum><text>for over 4 years, the
			 city of Yerington and Lyon County, Nevada, have been working with private
			 business partners to develop a sustainable development plan that would enable
			 all parties to benefit from the use of private land adjacent to the city of
			 Yerington for potential commercial and industrial development, mining
			 activities, recreation opportunities, and the expansion of community and
			 cultural events;</text>
			</paragraph><paragraph id="HBB38C4AEF43540938D80F8EAB5F75B79"><enum>(3)</enum><text>the sustainable
			 development plan referred to in paragraph (2) requires the conveyance of
			 certain Federal land administered by the Bureau of Land Management to the City
			 for consideration in an amount equal to the fair market value of the Federal
			 land;</text>
			</paragraph><paragraph id="H8874DAF3523A4E73ADA7DE1024D742E8"><enum>(4)</enum><text>the Federal land to be
			 conveyed to the City under the sustainable development plan has very few
			 environmental, historical, wildlife, or cultural resources of value to the
			 public, but is appropriate for responsible development;</text>
			</paragraph><paragraph id="HCCD8B031F52F47878101F044F82E1208"><enum>(5)</enum><text>the Federal land that
			 would be conveyed to the City under the sustainable development plan—</text>
				<subparagraph id="HC823F2CC48BE405A99639FC2CF0C2BA4"><enum>(A)</enum><text>is adjacent to the
			 boundaries of the City; and</text>
				</subparagraph><subparagraph id="HD91A6D18FF3D47C78948DC6DB361E6EA"><enum>(B)</enum><text>would be used—</text>
					<clause id="H1299B4B4C0024FFFB38AB705ACA4BF54"><enum>(i)</enum><text>to enhance recreational,
			 cultural, commercial, and industrial development opportunities in the
			 City;</text>
					</clause><clause id="H94C7E8BB52244F4D85F09DAF04FED3CB"><enum>(ii)</enum><text>for future economic
			 development, regional use, and as an open space buffer to the City; and</text>
					</clause><clause id="HE64C31089521434AA77CB8E8C0B8A557"><enum>(iii)</enum><text>to allow the City to
			 provide critical infrastructure services;</text>
					</clause></subparagraph></paragraph><paragraph id="H3983FCD99CF44A3F840750590B93D7E7"><enum>(6)</enum><text>commercial and industrial
			 development of the Federal land would enable the community to benefit from the
			 transportation, power, and water infrastructure that would be put in place with
			 the concurrent development of commercial and industrial operations;</text>
			</paragraph><paragraph id="HC2B4C42EE73B4322A0F9F05398C17460"><enum>(7)</enum><text>the conveyance of the
			 Federal land would—</text>
				<subparagraph id="HC0C18CA548BC46DFADA0CE2B6DE9DC78"><enum>(A)</enum><text>help the City and County
			 to grow; and</text>
				</subparagraph><subparagraph id="HCF0299382312421CBFE45FFFD659F7B1"><enum>(B)</enum><text>provide additional tax
			 revenue to the City and County;</text>
				</subparagraph></paragraph><paragraph id="HAD007378391B4A0D9175D97026987F58"><enum>(8)</enum><text>industrial and commercial
			 development of the Federal land would create thousands of long-term,
			 high-paying jobs for the City and County; and</text>
			</paragraph><paragraph id="H381343F82D354009A99AAD76078A2BD8"><enum>(9)</enum><text>the Lyon County
			 Commission and the City unanimously approved resolutions in support of the
			 conveyance of the Federal land because the conveyance would facilitate a
			 sustainable model for long-term economic and industrial development.</text>
			</paragraph></section><section id="HAD8AE395DCE847A0A09BFE870C908F97"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
			<paragraph id="H7A12AF443BD449EA904949AAA6C121A1"><enum>(1)</enum><header>City</header><text>The
			 term <term>City</term> means the city of Yerington, Nevada.</text>
			</paragraph><paragraph id="H1339E26BBE624BC395DE8CABED724E9C"><enum>(2)</enum><header>Federal
			 land</header><text>The term <term>Federal land</term> means the land located in
			 Lyon County and Mineral County, Nevada, that is identified on the map as
			 <quote>City of Yerington Sustainable Development Conveyance
			 Lands</quote>.</text>
			</paragraph><paragraph id="H9A8D966B31B9420FA9BC04BE84432F62"><enum>(3)</enum><header>Map</header><text display-inline="yes-display-inline">The term <term>map</term> means the map
			 entitled <quote>Yerington Land Conveyance and Sustainable Development
			 Act</quote> and dated May 31, 2012.</text>
			</paragraph><paragraph id="H0A3E631803C14E22911902002192321F"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph></section><section id="H5607BFEF2B654F67B40AAC609BC8C0FB"><enum>4.</enum><header>Conveyances of land to
			 City of Yerington, Nevada</header>
			<subsection id="HD4FDEBF3E7824756927978C807054832"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 90
			 days after the date of enactment of this title, subject to valid existing
			 rights, and notwithstanding the land use planning requirements of sections 202
			 and 203 of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1712,
			 1713), the Secretary shall convey to the City, subject to the City’s agreement
			 and in exchange for consideration in an amount equal to the fair market value
			 of the Federal land, all right, title, and interest of the United States in and
			 to the Federal land identified on the map.</text>
			</subsection><subsection id="HC6BAD740C97448ED835CEF20A6C5C356"><enum>(b)</enum><header>Appraisal To determine
			 of fair market value</header><text>The Secretary shall determine the fair
			 market value of the Federal land to be conveyed—</text>
				<paragraph id="H07711D36CA274297A99D604DEFF04D61"><enum>(1)</enum><text>in accordance with the
			 <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of
			 1976</act-name> (43 U.S.C. 1701 et seq.); and</text>
				</paragraph><paragraph id="H1377DB1889A448A3A98FEAE44BC3C9F3"><enum>(2)</enum><text>based on an appraisal
			 that is conducted in accordance with nationally recognized appraisal standards,
			 including—</text>
					<subparagraph id="HD1C68D1B93EA49FA9EAFE91236530E90"><enum>(A)</enum><text>the Uniform Appraisal
			 Standards for Federal Land Acquisition; and</text>
					</subparagraph><subparagraph id="H6DB3A307C67C44E68EF9DED0D19C2DC2"><enum>(B)</enum><text>the Uniform Standards of
			 Professional Appraisal Practice.</text>
					</subparagraph></paragraph></subsection><subsection id="HFBEA0D3A614345CAA8FFC2F6FD46EA0C"><enum>(c)</enum><header>Availability of
			 map</header><text>The map shall be on file and available for public inspection
			 in the appropriate offices of the Bureau of Land Management.</text>
			</subsection><subsection id="HAFDB909BC60A40939210C5E9745D9363"><enum>(d)</enum><header>Applicable
			 law</header><text>Beginning on the date on which the Federal land is conveyed
			 to the City, the development of and conduct of activities on the Federal land
			 shall be subject to all applicable Federal laws (including regulations).</text>
			</subsection><subsection id="HCFD11FD0181144B1B73C548C10F8D50D"><enum>(e)</enum><header>Administrative
			 costs</header><text>The City shall be responsible for all survey, appraisal,
			 and other administrative costs associated with the conveyance of the Federal
			 land to the City under this title.</text>
			</subsection></section><section display-inline="no-display-inline" id="HE9BA22EB8B6C4656886C15B5F386DB70" section-type="subsequent-section"><enum>5.</enum><header>Release of the United
			 States</header><text display-inline="no-display-inline">Upon making the
			 conveyance under section 4, notwithstanding any other provision of law, the
			 United States is released from any and all liabilities or claims of any kind or
			 nature arising from the presence, release, or threat of release of any
			 hazardous substance, pollutant, contaminant, petroleum product (or derivative
			 of a petroleum product of any kind), solid waste, mine materials or mining
			 related features (including tailings, overburden, waste rock, mill remnants,
			 pits, or other hazards resulting from the presence of mining related features)
			 on the Federal Land in existence on or before the date of the
			 conveyance.</text>
