		<section id="H9355BA37C78849C1B41A279C909EB6A0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the
			 <quote><short-title>Public Safety Officers’ Benefits
			 Improvements Act of 2012</short-title></quote>.</text>
		</section><section id="H41E0D71E6198437D9063B2FDC5F0C5EA"><enum>2.</enum><header>Benefits for
			 certain nonprofit emergency medical service providers; miscellaneous
			 amendments</header>
			<subsection id="H7FF7269F1F72462C930D458AE1DFC7A7"><enum>(a)</enum><header>In
			 general</header><text>Title I of the Omnibus Crime Control and Safe Streets Act
			 of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3711">42 U.S.C.
			 3711 et seq.</external-xref>) is amended—</text>
				<paragraph id="H1871A2AB16D440D9915584DE4FAE7BF1"><enum>(1)</enum><text>in section 901(a)
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/3791">42 U.S.C.
			 3791(a)</external-xref>)—</text>
					<subparagraph id="HBE12958344C240CD87C4DE98C0DBEF44"><enum>(A)</enum><text>in paragraph (26),
			 by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="HE328F1C2513A467E9976CAE91E3B2626"><enum>(B)</enum><text>in paragraph (27),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="HE034812673834F75A8D3230029D03669"><enum>(C)</enum><text>by adding at the
			 end the following:</text>

					</subparagraph></paragraph><paragraph id="H3A681689084548EA849DB99F73ADB0E5"><enum>(2)</enum><text>in section 1201
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796">42 U.S.C.
			 3796</external-xref>)—</text>
					<subparagraph id="H253EE6A5B89143F28FFEAA771F688127"><enum>(A)</enum><text>in subsection (a),
			 by striking <quote>follows:</quote> and all that follows and inserting the
			 following:</text>

							<text>follows (if the payee indicated is
			 living on the date on which the determination is

				child who survived the public safety officer, to the surviving spouse of the
				public safety officer;</text>
							</paragraph><paragraph id="H7A8578AF10E34B8B84DC42F83E5393B5"><enum>(2)</enum><text>if there is at
				least 1 child who survived the public safety officer and a surviving spouse of
				the public safety officer, 50 percent to the surviving child (or children, in
				equal shares) and 50 percent to the surviving spouse;</text>
							</paragraph><paragraph id="H40CA7EDCA90D4B969B7A92879230BCFC"><enum>(3)</enum><text>if there is no
				surviving spouse of the public safety officer, to the surviving child (or
				children, in equal shares);</text>
							</paragraph><paragraph id="H9A2C7BB9642240338479366927857D09"><enum>(4)</enum><text>if there is no
				surviving spouse of the public safety officer and no surviving child—</text>
								<subparagraph id="HA287A24D4D9D4369AED0EF7042DF115C"><enum>(A)</enum><text>to the surviving
				individual (or individuals, in shares per the designation, or, otherwise, in
				equal shares) designated by the public safety officer to receive benefits under
				this subsection in the most recently executed designation of beneficiary of the
				public safety officer on file at the time of death with the public safety
				agency, organization, or unit; or</text>
								</subparagraph><subparagraph id="HF855D41E58634FF583CFCEE91720309F"><enum>(B)</enum><text>if there is no
				individual qualifying under subparagraph (A), to the surviving individual (or
				individuals, in equal shares) designated by the public safety officer to
				receive benefits under the most recently executed life insurance policy of the
				public safety officer on file at the time of death with the public safety
				agency, organization, or unit;</text>
								</subparagraph></paragraph><paragraph id="HE056CD02E0C04355888C90CB4476578C"><enum>(5)</enum><text>if there is no
				individual qualifying under paragraph (1), (2), (3), or (4), to the surviving
				parent (or parents, in equal shares) of the public safety officer; or</text>
							</paragraph><paragraph id="H99CC4D9BD289410CB5B46CE9FE884882"><enum>(6)</enum><text>if there is no
				individual qualifying under paragraph (1), (2), (3), (4), or (5), to the
				surviving individual (or individuals, in equal shares) who would qualify under
				the definition of the term <quote>child</quote> under section 1204 but for
				age.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HB121D38A0AA541C0B9B3CD727B895908"><enum>(B)</enum><text>in subsection
			 (b)—</text>
						<clause id="HE0D84247D7554702A0B77C17FAB524F2"><enum>(i)</enum><text>by
			 striking <quote>direct result of a catastrophic</quote> and inserting
			 <quote>direct and proximate result of a personal</quote>;</text>
						</clause><clause id="H5F7E7CB457F4481AA7D7E07E95EE74F3"><enum>(ii)</enum><text>by
			 striking <quote>pay,</quote> and all that follows through <quote>the
			 same</quote> and inserting <quote>pay the same</quote>;</text>
						</clause><clause id="H6C7CA818B57C4079A666CF82ACFDEAAD"><enum>(iii)</enum><text>by
			 striking <quote>in any year</quote> and inserting <quote>to the public safety
			 officer (if living on the date on which the determination is
			 made)</quote>;</text>
						</clause><clause id="HF8B008A46E38402BBA661C015E78F551"><enum>(iv)</enum><text>by
			 striking <quote>in such year, adjusted</quote> and inserting <quote>with
			 respect to the date on which the catastrophic injury occurred, as
			 adjusted</quote>;</text>
						</clause><clause id="H42386E1C5D6E412FB39DB5FBBB85BC0A"><enum>(v)</enum><text>by
			 striking <quote>, to such officer</quote>;</text>
						</clause><clause id="H117F9AC6F369476385C28645853216F5"><enum>(vi)</enum><text>by
			 striking <quote>the total</quote> and all that follows through
			 <quote>For</quote> and inserting <quote>for</quote>; and</text>
						</clause><clause id="H63561E53A8E44E8CB31B6AB334604BF3"><enum>(vii)</enum><text>by
			 striking <quote>That these</quote> and all that follows through the period, and
			 inserting <quote>That the amount payable under this subsection shall be the
			 amount payable as of the date of catastrophic injury of such public safety
			 officer.</quote>;</text>
						</clause></subparagraph><subparagraph id="H948AE9A5B1A64F319277FF5999EB3DEB"><enum>(C)</enum><text>in subsection
			 (f)—</text>
						<clause id="HB13867E72C5646EB83773685472CC2D9"><enum>(i)</enum><text>in
			 paragraph (1), by striking <quote>, as amended (D.C. Code, sec. 4–622);
			 or</quote> and inserting a semicolon;</text>
						</clause><clause id="H52347CED04A54D378844F1E37DADC9BB"><enum>(ii)</enum><text>in
			 paragraph (2)—</text>
							<subclause id="HA4624131594B4213A6EAECE50D0B6BF8"><enum>(I)</enum><text>by striking
			 <quote>. Such beneficiaries shall only receive benefits under such section 8191
			 that</quote> and inserting <quote>, such that beneficiaries shall receive only
			 such benefits under such section 8191 as</quote>; and</text>
							</subclause><subclause id="HDABEAE8125E74CE5B6A722ED78BF4901"><enum>(II)</enum><text>by striking the
			 period at the end and inserting <quote>; or</quote>; and</text>
							</subclause></clause><clause id="HE747CF70AFDE495A885B4AA793A491CF"><enum>(iii)</enum><text>by
			 adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="H8D0B2181518A4629911DC42A2DA6072F" style="OLC">
								<paragraph id="HF44954156D4B4679AE3DF40C9522E47B"><enum>(3)</enum><text>payments under the
				September 11th Victim Compensation Fund of 2001 (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note;
				<external-xref legal-doc="public-law" parsable-cite="pl/107/42">Public Law
				107–42</external-xref>).</text>
								</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="H19B1D96D14AC43BEA07AE06486651BF6"><enum>(D)</enum><text>by amending
			 subsection (k) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H13913FA6569E45A5A1403D946267F986" style="OLC">
							<subsection id="H9EC2AA414E364AFDB3E9D937254F2902"><enum>(k)</enum><text>As determined by
				the Bureau, a heart attack, stroke, or vascular rupture suffered by a public
				safety officer shall be presumed to constitute a personal injury within the
				meaning of subsection (a), sustained in the line of duty by the officer and
				directly and proximately resulting in death, if—</text>
								<paragraph id="HC31EF2DD6BDA40439762CBF16839E650"><enum>(1)</enum><text>the public safety
				officer, while on duty—</text>
									<subparagraph id="HA076D940A8A943EEA460CB5F096DAB21"><enum>(A)</enum><text>engages in a
				situation involving nonroutine stressful or strenuous physical law enforcement,
				fire suppression, rescue, hazardous material response, emergency medical
				services, prison security, disaster relief, or other emergency response
				activity; or</text>
									</subparagraph><subparagraph id="H06F3DF95237444358CC8C084A073FD3C"><enum>(B)</enum><text>participates in a
				training exercise involving nonroutine stressful or strenuous physical
				activity;</text>
									</subparagraph></paragraph><paragraph id="H0530C153A37040F28587C7D130B1FEA1"><enum>(2)</enum><text>the heart attack,
				stroke, or vascular rupture commences—</text>
									<subparagraph id="H2D6F84EE8AA845E2BDE6464F242447E6"><enum>(A)</enum><text>while the officer
				is engaged or participating as described in paragraph (1);</text>
									</subparagraph><subparagraph id="HB0F19D6225FE4388B5301250780DCF3F"><enum>(B)</enum><text>while the officer
				remains on that duty after being engaged or participating as described in
				paragraph (1); or</text>
									</subparagraph><subparagraph id="H41BDD2EAF2B54849A179EC50C6379F8C"><enum>(C)</enum><text>not later than 24
				hours after the officer is engaged or participating as described in paragraph
				(1); and</text>
									</subparagraph></paragraph><paragraph id="H3AABBE824F794C16A360B7DE0A6ED82C"><enum>(3)</enum><text>the heart attack,
				stroke, or vascular rupture directly and proximately results in the death of
				the public safety officer,</text>
								</paragraph><continuation-text continuation-text-level="subsection">unless
				competent medical evidence establishes that the heart attack, stroke, or
				vascular rupture was unrelated to the engagement or participation or was
				directly and proximately caused by something other than the mere presence of
				cardiovascular-disease risk factors.</continuation-text></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H258349335FD44FE28FD8187DFBBE8F9B"><enum>(E)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H36EB5C72436741F4AFA8395C5C54C93D" style="OLC">
							<subsection id="HE5C9FA459DA94B80B60F3AB0650F4CBB"><enum>(n)</enum><text>The public safety
				agency, organization, or unit responsible for maintaining on file an executed
				designation of beneficiary or executed life insurance policy for purposes of
				subsection (a)(4) shall maintain the confidentiality of the designation or
				policy in the same manner as the agency, organization, or unit maintains
				personnel or other similar records of the public safety
				officer.</text>
							</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HDCDFE8B51F594A44AD7AE67814373CC2"><enum>(3)</enum><text>in section 1202
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796a">42 U.S.C.
			 3796a</external-xref>)—</text>
					<subparagraph id="HE9B83B2C957241808F6E407FFEF2100C"><enum>(A)</enum><text>by striking
			 <quote>death</quote>, each place it appears except the second place it appears,
			 and inserting <quote>fatal</quote>; and</text>
					</subparagraph><subparagraph id="H19587D2CCB8F417B93ACBF3CBD4E2160"><enum>(B)</enum><text>in paragraph (1),
			 by striking <quote>or catastrophic injury</quote> the second place it appears
			 and inserting <quote>, disability, or injury</quote>;</text>
					</subparagraph></paragraph><paragraph id="H77F6FAB0F0D646ED8A349A16E3C3B063"><enum>(4)</enum><text>in section 1203
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796a-1">42 U.S.C.
			 3796a–1</external-xref>)—</text>
					<subparagraph id="H835E0009E95542CAB02E580816D44FC4"><enum>(A)</enum><text>in the section
			 heading, by striking <quote><header-in-text level="section" style="traditional">who have died in the line of duty</header-in-text></quote>
			 and inserting <quote><header-in-text level="section" style="traditional">who
			 have sustained fatal or catastrophic injury in the line of
			 duty</header-in-text></quote>; and</text>
					</subparagraph><subparagraph id="HADAEA7C499E54C5A9DD215A695DF8C3D"><enum>(B)</enum><text>by striking

					</subparagraph></paragraph><paragraph id="HBF1DD026BA02465D9CECF1910EC82C91"><enum>(5)</enum><text>in section 1204
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796b">42 U.S.C.
			 3796b</external-xref>)—</text>
					<subparagraph id="HBD6DB2F5AE13440BAE4AF6425EECE70C"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>consequences of an injury that</quote> and inserting
			 <quote>an injury, the direct and proximate consequences of
			 which</quote>;</text>
					</subparagraph><subparagraph id="HD8FCE5D3233145C5AD9F92A750F57DBC"><enum>(B)</enum><text>in paragraph
			 (3)—</text>

				officially authorized or licensed to engage in rescue activity or to provide
				emergency medical services; and</text>
								</clause><clause id="H19074802D7014AD796FFA41B7BFB1D6A"><enum>(ii)</enum><text display-inline="yes-display-inline">engages in rescue activities or provides
				emergency medical services as part of an official emergency response
				system;</text>
								</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HB57BFB7655EF4F82B8B94D3F3182341E"><enum>(E)</enum><text>in paragraph
			 (9)—</text>
						<clause id="HB6B5F86B88654CA3A398063BB8E8F1CD"><enum>(i)</enum><text>in
			 subparagraph (A), by striking <quote>as a chaplain, or as a member of a rescue
			 squad or ambulance crew;</quote> and inserting <quote>or as a
			 chaplain;</quote>;</text>

				of emergency medical

						</clause></subparagraph></paragraph><paragraph id="HB6DF3875207D42818D10B15EFA338903"><enum>(6)</enum><text>in section 1205
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796c">42 U.S.C.
			 3796c</external-xref>), by adding at the end the following:</text>

			 by striking <quote>each dependent</quote> each place it appears and inserting
			 <quote>a spouse or child</quote>; and</text>
					</subparagraph><subparagraph id="H9CC9E812AFD44E64B5C9DBD8813785A7"><enum>(B)</enum><text>by striking
			 <quote>dependents</quote> each place it appears and inserting <quote>a
			 person</quote>; and</text>
					</subparagraph></paragraph><paragraph id="HFC71B73151914367A89E7C87355ED04F"><enum>(11)</enum><text>in section
			 1217(3)(A) (<external-xref legal-doc="usc" parsable-cite="usc/42/3796d-6">42
			 U.S.C. 3796d–6(3)(A)</external-xref>), by striking <quote>described in</quote>

			 by inserting <quote>or an entity described in section 1204(7)(B) of the Omnibus
			 Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796b">42 U.S.C. 3796b(7)(B)</external-xref>)</quote>
			 after <quote>employed by such agency</quote>.</text>
			</subsection><subsection id="HDBE099A13DF542F8862204C612B178B1"><enum>(c)</enum><header>Technical and
			 conforming amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/402">Section 402(l)(4)(C)</external-xref>
			 of the Internal Revenue Code of 1986 is amended—</text>
				<paragraph id="HC3E04B7891064982950CE0814981B6E1"><enum>(1)</enum><text>by striking
			 <quote>section 1204(9)(A)</quote> and inserting <quote>section

				</paragraph></subsection></section><section id="HE1C6FE2BDEE64668AE2F9F7307A0E3C1"><enum>3.</enum><header>Authorization of
			 appropriations; determinations; appeals</header><text display-inline="no-display-inline">The matter under the heading
			 <quote><header-in-text level="appropriations-small" style="OLC">public safety
			 officers benefits</header-in-text></quote> under the heading
			 <quote><header-in-text level="appropriations-intermediate" style="OLC">Office
			 of Justice Programs</header-in-text></quote> under title II of division B of
			 the Consolidated Appropriations Act, 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/161">Public Law
			 110–161</external-xref>; 121 Stat. 1912;
			 <external-xref legal-doc="usc" parsable-cite="usc/42/3796c-2">42 U.S.C.
			 3796c–2</external-xref>) is amended—</text>
			<paragraph id="HD31BB0A4BEFF4BB9BA913D7A56EC8012"><enum>(1)</enum><text>by striking
			 <quote>decisions</quote> and inserting <quote>determinations</quote>;</text>
			</paragraph><paragraph id="HB773AE9EFA174966B46D9DAFD5D2EF45"><enum>(2)</enum><text>by striking
			 <quote>(including those, and any related matters, pending)</quote>; and</text>
			</paragraph><paragraph id="HD9342CB9E15D445EBB1EE04352BFB675"><enum>(3)</enum><text>by striking the
			 period at the end and inserting the following: “: 
			 <proviso><italic>Provided further,</italic></proviso> That, on and
			 after the date of enactment of the Public Safety Officers’ Benefits
			 Improvements Act of 2012, as to each such statute—</text>
				<quoted-block display-inline="no-display-inline" id="H1CA8652B15824DF1BB9C1B5E1F055EF0" style="OLC">
					<paragraph id="HCFBC3AA27D584E2EADDB1784771D8725"><enum>(1)</enum><text>the provisions of
				section 1001(a)(4) of such title I (<external-xref legal-doc="usc" parsable-cite="usc/42/3793">42 U.S.C. 3793(a)(4)</external-xref>) shall
				apply;</text>
					</paragraph><paragraph id="H3ECBEA1DE10D414AB0565E2D07429E75"><enum>(2)</enum><text display-inline="yes-display-inline">payment (other than payment made pursuant
				to section 611 of the Uniting and Strengthening America by Providing
				Appropriate Tools Required to Intercept and Obstruct Terrorism (USA PATRIOT
				ACT) Act of 2001 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796c-1">42 U.S.C. 3796c–1</external-xref>)) shall be
				made only upon a determination by the Bureau that the facts legally warrant the
				payment;</text>
					</paragraph><paragraph id="H6A861A169E78468A93B990EC5F7A88D1"><enum>(3)</enum><text>any reference to
				section 1202 of such title I shall be deemed to be a reference to paragraphs
				(2) and (3) of such section 1202; and</text>
					</paragraph><paragraph id="HD837F58E8A9343338920E8F6DD85AFFD"><enum>(4)</enum><text display-inline="yes-display-inline">a certification submitted under any such
				statute (other than a certification submitted pursuant to section 611 of the
				Uniting and Strengthening America by Providing Appropriate Tools Required to
				Intercept and Obstruct Terrorism (USA PATRIOT ACT) Act of 2001 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796c-1">42 U.S.C.
				3796c–1</external-xref>)) may be accepted by the Bureau as prima facie evidence
				of the facts asserted in the certification:</text>
					</paragraph><quoted-block-continuation-text quoted-block-continuation-text-level="section"><proviso><italic>Provided
				  further,</italic></proviso> That, on and after the date of enactment of the
				Public Safety Officers’ Benefits Improvements Act of 2012, no appeal shall
				bring any final determination of the Bureau before any court for review unless
				notice of appeal is filed (within the time specified herein and in the manner
				prescribed for appeal to United States courts of appeals from United States
				district courts) not later than 90 days after the date on which the Bureau
				serves notice of the final determination: 
				<proviso><italic>Provided further, </italic></proviso> That any
				regulations promulgated by the Bureau under such part (or any such statute)
				before, on, or after the date of enactment of the Public Safety Officers’
				Benefits Improvements Act of 2012 shall apply to any matter pending on, or
				filed or accruing after, the effective date specified in the
				regulations.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HD8AA80983BEE452C9F5BE3112E3CF30A"><enum>4.</enum><header>Effective
			 date</header>
			<subsection id="H7AA669559EBA4178BB3DC94045FB8F23"><enum>(a)</enum><header>In
			 general</header><text>Except as provided in subsection (b), the amendments made
			 by this Act shall—</text>
				<paragraph id="HCC47279665694EDFAA1213D6E4F73091"><enum>(1)</enum><text>take effect on the
			 date of enactment of this Act; and</text>
				</paragraph><paragraph id="H063EA8241A554E77BFDDCAD67DE103E6"><enum>(2)</enum><text>apply to any
			 matter pending, before the Bureau of Justice Assistance or otherwise, on the
			 date of enactment of this Act, or filed or accruing after that date.</text>
				</paragraph></subsection><subsection id="HB1BB6CD7D1EF40F586A5352C78E90E76"><enum>(b)</enum><header>Exceptions</header>
				<paragraph id="HA9067814575B4908905CA61AC8F6748F"><enum>(1)</enum><header>Rescue squads
			 and ambulance crews</header><text>For a member of a rescue squad or ambulance
			 crew (as defined in section 1204(7) of title I of the Omnibus Crime Control and
			 Safe Streets Act of 1968, as amended by this Act), the amendments made by this
			 Act shall apply to injuries sustained on or after June 1, 2009.</text>
				</paragraph><paragraph id="HB245149D4F5B4E09B85CAB66375E7133"><enum>(2)</enum><header>Heart attacks,
			 strokes, and vascular ruptures</header><text>Section 1201(k) of title I of the
			 Omnibus Crime Control and Safe Streets Act of 1968, as amended by this Act,
			 shall apply to heart attacks, strokes, and vascular ruptures sustained on or
			 after December 15, 2003.</text>
				</paragraph></subsection></section></legis-body>
