		<section id="H05CBF678BF3B41F9AB1E031AE71AFDD5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Enhancing Exports Through Entrepreneurship Act of
			 2012</short-title></quote>.</text>
		</section><section id="H8CB8DBEFF8CF4A94B737915D7145845F"><enum>2.</enum><header>Small business
			 tax credit for costs associated with expanding export markets</header>
			<subsection id="H9A27C53891F0415494450E3DF83FD0DF"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subpart D of part IV
			 of subchapter A of chapter 1 of the Internal Revenue Code of 1986 is amended by
			 adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HE624031230C440C4818365321FD93582" style="OLC">
					<section id="HD70021D57F4747228D8F6ADEB4C18222"><enum>45S.</enum><header>Credit for
				small business costs of expanding export markets</header>
						<subsection id="H2F5E500C67A54E4888043B8C455CD0B4"><enum>(a)</enum><header>In
				general</header><text>For purposes of section 38, in the case of a qualified
				small business, the small business export expansion credit for any taxable year
				is an amount equal to 25 percent of the export expansion expenses of the
				taxpayer paid or incurred during the taxable year.</text>
						</subsection><subsection id="H619A3FB9A92448FDBC6DDD4A33B25EB4"><enum>(b)</enum><header>Export expansion
				expenses</header><text>For purposes of this section, the term <term>export
				expansion expenses</term> means amounts paid or incurred by the taxpayer for
				the purpose of increasing the amount of goods sold for consumption, or services
				provided, outside the United States. Such term shall not include the cost of
				goods sold (and similar amounts with respect to services provided).</text>
						</subsection><subsection id="H5829F690B09E4D6C9136C88828C7CECA"><enum>(c)</enum><header>Qualified small
				business</header><text>For purposes of this section, the term <term>qualified
				small business</term> means a small business concern within the meaning of
				section 3 of the Small Business
				Act.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HDF500D98387749F5B80BF05CF1898B6E"><enum>(b)</enum><header>Credit To be
			 part of general business credit</header>
				<paragraph id="HCD890A8A6CA540C8BCC615FED4A2FD1A"><enum>(1)</enum><header>In
			 general</header><text>Subsection (b) of section 38 of such Code is amended by
			 striking <quote>plus</quote> at the end of paragraph (35), by striking the
			 period at the end of paragraph (36) and inserting <quote>, plus</quote>, and by
			 adding at the end the following new paragraph:</text>
					<quoted-block id="H1AB8DE0490084389A9810BEC50A6C542" style="OLC">
						<paragraph id="H300AA90051044EB0A5A9C73A3DDC55D8"><enum>(37)</enum><text>in the case of a
				qualified small business (as defined in section 45S(c)), the small business
				export expansion credit determined under section
				45S(a).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H7FF954E9AB874635B143E95D6572E9E0"><enum>(2)</enum><header>Credit allowable
			 against alternative minimum tax</header><text>Subparagraph (B) of section
			 38(c)(4) of such Code is amended by redesignating clauses (vii) through (ix) as
			 clauses (viii) through (x), respectively, and by inserting after clause (vi)
			 the following new clause:</text>

						<clause id="H6630555C72A34855838044BE54B98925"><enum>(vii)</enum><text>the credit
				determined under section
				45S,</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HE2542DACBF1D471985191193F2A2F9B1"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of sections for subpart D of part IV of
			 subchapter A of chapter 1 of such Code is amended by adding at the end the
			 following new item:</text>

				markets.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H46A2D3865E1847778F1CF524D25F9BD3"><enum>(d)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to taxable years beginning after the date of the
			 enactment of this Act.</text>
			</subsection></section><section id="H1162DD2231A44A0EA0777EAE52EDB610"><enum>3.</enum><header>Availability of
			 essential trade information</header><text display-inline="no-display-inline">Section 22(c)(7) of the Small Business Act
			 (15 U.S.C. 649(c)(7)) is amended—</text>
			<paragraph id="HA6FF0332483C418AB5B8525E879F8E3E"><enum>(1)</enum><text>in subparagraph
			 (C) by striking <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="HC059DF2D4EC14E0998187EAA17F39A8C"><enum>(2)</enum><text>in subparagraph
			 (D) by inserting <quote>and</quote> after the semicolon; and</text>
			</paragraph><paragraph id="HBEBBB2469AEB4ADA8DA8AC4BC9FC9FEB"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H8A268020F6C1404F80097266553B4B47" style="OLC">
					<subparagraph id="H75E6F5DA46C746C0BC04F21E90628326"><enum>(E)</enum><text display-inline="yes-display-inline">compiling in a format that is accessible
				and able to be understood by the owners of small business concerns, making
				available to appropriate partner entities (including small business development
				centers, women’s business centers, chapters of the Service Corps of Retired
				Executives, Veterans Business Outreach Centers, and Export Assistance Centers),
				and updating each year a document that contains—</text>
						<clause id="H4A0918AB5F6F47ACAB41A357D6CBF8FE"><enum>(i)</enum><text>the tariff
				schedules of all foreign countries (organized by industry sector); and</text>
						</clause><clause id="HD0CA14EE1BC04CD786027B520C7CAD03"><enum>(ii)</enum><text display-inline="yes-display-inline">for each of the 50 foreign countries to
				which the highest total value of United States goods and services are exported
				(as determined by the Associate Administrator), information on the demand for
				goods and services in the country, including an identification of the 10
				industry sectors with respect to which the highest total value of United States
				goods and services are exported to the country (as determined by the Associate
				Administrator);</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HF56D550BC2C6423BB34D3DF1ECA4936A"><enum>4.</enum><header>Foreign customer
			 matchmaking</header><text display-inline="no-display-inline">Section 22(c) of
			 the Small Business Act (15 U.S.C. 649(c)) is amended—</text>
			<paragraph id="H61DBF666FFDD46ED95DD37379B41CC6C"><enum>(1)</enum><text>in paragraph (12)
			 by striking <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="HFC5946307EAC4DB1A094650FE25A989F"><enum>(2)</enum><text>in paragraph (13)
			 by striking the period and inserting <quote>; and</quote>; and</text>
			</paragraph><paragraph id="H6C79FBFCFC34486D8A8FDA732793D74D"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HA92ECC63D1E441F79F6BD9C1DB2CAE9E" style="OLC">
					<paragraph id="H935CE464A3C346DDBB88D443F5070D5F"><enum>(14)</enum><text display-inline="yes-display-inline">in coordination with the Department of
				Commerce and other appropriate Federal departments and agencies, identify and
				advertise to small business concerns programs and services that facilitate the
				matching of foreign customers to small business concerns, including—</text>
						<subparagraph id="H927E5D581B7E49DF90CB74FAB1ED7E31"><enum>(A)</enum><text>any program
				administered by a Federal department or agency that assists small business
				concerns to identify and meet with foreign buyers, partners, or sales
				representatives; and</text>
						</subparagraph><subparagraph id="HC0AA528A4CBF4A0B849977E0A86722E6"><enum>(B)</enum><text>any service of a
				Federal department or agency that assists small business concerns to
				participate in personalized business matchmaking, trade missions, reverse trade
				missions, or trade
				shows.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HED9E8C24F49340E09E6D7009DBF6DF2E" section-type="subsequent-section"><enum>5.</enum><header>Loans to small
			 businesses by the export-import bank</header><text display-inline="no-display-inline">Section 2(b)(1)(E)(v) of the Export-Import
			 Bank Act of 1945 (12 U.S.C. 635(b)(1)(E)(v)) is amended—</text>
			<paragraph id="H048244B2C830452FB44CBA1C80C11B55"><enum>(1)</enum><text>in the first
			 sentence, by inserting <quote>, and from the aggregate loan authority available
			 to it, an amount to so finance such exports which shall be not less than 30
			 percent of such authority for each fiscal year</quote> before the period;
			 and</text>
			</paragraph><paragraph id="HD1F8656E0FCD4082847E3755C374F940"><enum>(2)</enum><text>by adding at the
			 end the following new sentence: <quote>The Bank shall charge interest and fees
			 to the extent necessary to fully offset the costs of making loans under this
			 clause.</quote>.</text>
			</paragraph></section><section id="HA9C6B79C11BB43D3B462168922324D99" section-type="subsequent-section"><enum>6.</enum><header>Increase in small
			 business investment by Overseas Private Investment Corporation</header>
			<subsection id="H09C875BC506A4E0292E54C2513A5E284"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title IV of chapter 2
			 of part I of the Foreign Assistance Act of 1961 is amended—</text>
				<paragraph id="H88F1EDD45ADF4C63A56034114AF187A1"><enum>(1)</enum><text display-inline="yes-display-inline">in section 231(e)(2) (22 U.S.C.
			 2191(e)(2)), by striking <quote>30 percent</quote> and inserting <quote>40
			 percent</quote>;</text>
				</paragraph><paragraph id="H93A09D4798234C619EF19921F6F13555"><enum>(2)</enum><text display-inline="yes-display-inline">in section 233(b) (22 U.S.C. 2193(b)), by
			 striking <quote>two of the eight</quote> and inserting <quote>three of the
			 eight</quote>; and</text>
				</paragraph><paragraph id="H3DF50E8AD1894FCB903C8441B9419CE6"><enum>(3)</enum><text display-inline="yes-display-inline">in section 240(a) (22 U.S.C. 2200(a)), by
			 striking <quote>50 percent</quote> and inserting <quote>60
			 percent</quote>.</text>
				</paragraph></subsection><subsection id="H67A3B0BBC25D4C1991A0438D46F1CC21"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) take effect on the
			 date of the enactment of this Act and apply with respect each fiscal year
			 beginning on or after such date of enactment.</text>
			</subsection></section><section id="H2910FF5C4E0B4BCAA6A99A2018DE31A5"><enum>7.</enum><header>Limitations on
			 duties that apply to certain goods and services imported into the United States
			 for use by small business concerns</header>
			<subsection id="HCAA4E407D2124EF2AAA68BA8F8ACB7FE"><enum>(a)</enum><header>Limitation on
			 HTS duties</header><text display-inline="yes-display-inline">Notwithstanding
			 any other provision of law, the rate of duty under the HTS that applies to a
			 covered good or covered service that is imported into the United States shall
			 not exceed the lesser of—</text>
				<paragraph id="HE1B58F14E8BC4EC3B25EDDA3E14D2264"><enum>(1)</enum><text>the rate of duty
			 that applies to the good or service on the date on which the good or service is
			 purchased by a small business concern; or</text>
				</paragraph><paragraph id="H606F336905784A948B19861124DB3941"><enum>(2)</enum><text>the rate of duty
			 that applies to the good or service at the time of entry.</text>
				</paragraph></subsection><subsection id="HFD709EE4B0234F119BAF2D385BCDF386"><enum>(b)</enum><header>Limitation on
			 additional duties</header>
				<paragraph id="H36E0500919764A5C9803DD7A14381A47"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law, no additional
			 duty described in paragraph (2) shall apply with respect to a covered good or
			 covered service that is imported into the United States.</text>
				</paragraph><paragraph id="H497DE323A3B749E6B73E2B0C587D9813"><enum>(2)</enum><header>Additional
			 duties</header><text>An additional duty described in this paragraph is—</text>
					<subparagraph id="H5BC66EB5B1D54E2789E2DE3F30D1CDF9"><enum>(A)</enum><text>a countervailing
			 duty imposed under subtitle A of title VII of the Tariff Act of 1930 (19 U.S.C.
			 1671 et seq.);</text>
					</subparagraph><subparagraph id="HA7BC18D63E344CC38E3B2EC34AF34E02"><enum>(B)</enum><text display-inline="yes-display-inline">an antidumping duty imposed under subtitle
			 B of title VII of the Tariff Act of 1930 (19 U.S.C. 1673 et seq.); and</text>
					</subparagraph><subparagraph id="H867807C8464243A78FC1422E058F7275"><enum>(C)</enum><text>any other
			 additional duty imposed under any other provision of law.</text>
					</subparagraph></paragraph></subsection><subsection id="H32B4F330AA2549E6871CF500B39F3E03"><enum>(c)</enum><header>Documentation</header><text display-inline="yes-display-inline">The Secretary shall require the importer of
			 a good or service who, for purposes of this section, claims the good or service
			 to be a covered good or covered service, as the case may be, to submit such
			 documentation or other information to the Secretary as may be necessary to
			 verify the accuracy of such claims.</text>
			</subsection><subsection id="H32D7B80C340649BA9BEF50DC6E162205"><enum>(d)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary is authorized to prescribe
			 such rules and regulations as are necessary to carry out the provisions of this
			 section.</text>
			</subsection><subsection id="HCAE43A1E7BDF40EE8F7AA769C0D95195"><enum>(e)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H12207D36FCF24E4B942A9D21B7900F4F"><enum>(1)</enum><header>Covered
			 good</header><text>The term <term>covered good</term> or <term>good</term>
			 means a good that is purchased by a small business concern for use in its
			 regular business operations.</text>
				</paragraph><paragraph id="HB96AF11225014FF1BD0729230D2AEE0E"><enum>(2)</enum><header>Covered
			 service</header><text>The term <term>covered service</term> or
			 <term>service</term> means a service that is purchased by a small business
			 concern for use in its regular business operations.</text>
				</paragraph><paragraph id="H2E41CCD3D4794E7F8EF3721E7F3B6B71"><enum>(3)</enum><header>HTS</header><text>The
			 term <term>HTS</term> means the Harmonized Tariff Schedule of the United
			 States.</text>
				</paragraph><paragraph id="H51F189475F8D477AAB8E78863E52AE51"><enum>(4)</enum><header>Importer</header><text>The
			 term <term>importer</term> means—</text>
					<subparagraph id="HFF2A77BF230A44A3A322E0660F37AC30"><enum>(A)</enum><text display-inline="yes-display-inline">as such term relates to imports of goods,
			 one of the parties eligible to file the required customs entry documentation or
			 information pursuant to section 484(a)(2)(B) of the Tariff Act of 1930 (19
			 U.S.C. 1484(a)(2)(B)); and</text>
					</subparagraph><subparagraph id="HBE64C56304184B19B56D79FB0907B3AD"><enum>(B)</enum><text>as such term
			 relates to imports of services, the importer of the service as defined by the
			 Secretary in rules and regulations promulgated by the Secretary.</text>
					</subparagraph></paragraph><paragraph id="H90FF02591DBA4A78A896DBDE1908595B"><enum>(5)</enum><header>Small business
			 concern</header><text>The term <term>small business concern</term> has the
			 meaning given such term for purposes of the Small Business Act (15 U.S.C. 631
			 et seq.).</text>
				</paragraph><paragraph id="H269D60B3F1DF4E1A8CF7D27D6FF948CE"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Homeland Security.</text>
				</paragraph><paragraph id="H4869E5CE81AB4A9BA2BB4CD7DD38DB16"><enum>(7)</enum><header>Time of
			 entry</header><text display-inline="yes-display-inline">The term <term>time of
			 entry</term> means—</text>
					<subparagraph id="HD090F9A9F5CE48A7BDF8E80916D54057"><enum>(A)</enum><text>as relates to
			 imports of covered goods, the time generally specified in section 484(a)(2)(A)
			 of the Tariff Act of 1930 (19 U.S.C. 1484(a)(2)(A)) and prescribed in
			 regulations (19 C.F.R. 141.68); and</text>
					</subparagraph><subparagraph id="HF5DD4C58A414482CB7ABE08658B363F1"><enum>(B)</enum><text>as relates to
			 imports of services, the time specified by the Secretary in rules and
			 regulations promulgated by the Secretary.</text>
					</subparagraph></paragraph></subsection><subsection id="H65A287CA515D4752AA45B4BBA07F5811"><enum>(f)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">This section takes
			 effect on the date of the enactment of this Act and applies to covered goods
			 and covered services entered, or withdrawn from warehouse for consumption, on
			 or after the 15th day after the date of the enactment of this Act.</text>
			</subsection></section></legis-body>
