		<title id="H7A15648C8765489CB233FB1CE5B3D37D"><enum>I</enum><header>Refinery
			 Streamlined Permitting</header>
			<section display-inline="no-display-inline" id="H1989FBD3661F41F486679391D5E32A88" section-type="subsequent-section"><enum>101.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Refinery Streamlined Permitting
			 Act of 2012</short-title></quote>.</text>
			</section><section id="H583CAFBB2049466C97784707CDB579E5" section-type="subsequent-section"><enum>102.</enum><header>Review process
			 streamlining</header>
				<subsection id="HF3102BDF0977407FBCF86FADAB7CB4FB"><enum>(a)</enum><header>Assistance to
			 States</header><text display-inline="yes-display-inline">The Secretary of
			 Energy shall offer to States assistance to enable the States to assign
			 responsibilities delegated to the States, under Federal laws relating to the
			 construction or expansion of a petroleum refining facility, in a coordinated
			 and expeditious manner.</text>
				</subsection><subsection id="HA29878F50FD146B89CC79315D3DB848C"><enum>(b)</enum><header>Memorandum of
			 understanding</header><text>All Federal agencies, and all State agencies to
			 which responsibilities are delegated under Federal law, responsible for
			 approving a permit or other Federal authorization for the construction or
			 expansion of a petroleum refining facility shall enter into a memorandum of
			 understanding with respect to that facility, or proposed facility, that clearly
			 defines all actions required to be taken for Federal permit review and
			 approval. The memorandum of understanding shall identify areas where Federal
			 and State agencies can exercise discretion, and where multiple levels of review
			 on permitting decisions can be coordinated, to enable a more expeditious review
			 process.</text>
				</subsection><subsection id="HA830EF8E982A4AE28D3C086DA246EFC7"><enum>(c)</enum><header>Approval
			 deadline</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of law, a Federal agency, and a State agency to which
			 responsibilities are delegated under Federal law, shall take final action to
			 approve or disapprove an application under Federal law for the construction or
			 expansion of a petroleum refining facility not later than 1 year after receipt
			 of a complete application for such approval.</text>
				</subsection><subsection id="HAE6369F62863419DBF4703F2297E06E8"><enum>(d)</enum><header>Priority
			 projects</header><text display-inline="yes-display-inline">A Federal agency,
			 and a State agency to which responsibilities are delegated under Federal law,
			 shall give high priority to expediting an application under Federal law for the
			 construction or expansion of a petroleum refining facility that would—</text>
					<paragraph id="H2271EAFABF394868A9039A3602903B5D"><enum>(1)</enum><text>allow for
			 production of cleaner burning fuel;</text>
					</paragraph><paragraph id="H5A5F5E2C85A948B4846116FC0209A5E4"><enum>(2)</enum><text>result in
			 increased refining capacity; or</text>
					</paragraph><paragraph id="HE54D5351ACE1416E8E8375207F52F86F"><enum>(3)</enum><text>result in a
			 reduction in a refinery’s pollution output.</text>
					</paragraph></subsection></section><section id="HE16F15D11BDA412A9ED88173320FB64F"><enum>103.</enum><header>Statement of
			 energy effects</header>
				<subsection id="H62A9B7604DE64D088252F00297F9A4B6"><enum>(a)</enum><header>Preparation</header>
					<paragraph id="H8363A383CDAB4EEB811F08D9FD016C99"><enum>(1)</enum><header>Requirement</header><text>An
			 agency shall prepare and submit a Statement of Energy Effects to the
			 Administrator of the Office of Information and Regulatory Affairs, Office of
			 Management and Budget, for each proposed significant energy action.</text>
					</paragraph><paragraph id="H001DA44FB6354EB2BF32CC3E11E03631"><enum>(2)</enum><header>Contents</header><text>A
			 Statement of Energy Effects shall consist of a detailed statement by the agency
			 responsible for the significant energy action relating to—</text>
						<subparagraph id="HC5FE6B963C8B437AA389D609FB2AFF7A"><enum>(A)</enum><text>any adverse
			 effects on energy supply, distribution, or use (including a shortfall in
			 supply, price increases, and increased use of foreign supplies) should the
			 proposal be implemented; and</text>
						</subparagraph><subparagraph id="H0C680C2BF35A4EE1A18D5B4F7222DC54"><enum>(B)</enum><text>reasonable
			 alternatives to the action with adverse energy effects, and the expected
			 effects of such alternatives on energy supply, distribution, and use.</text>
						</subparagraph></paragraph><paragraph id="H14C7D2FA5C1B45F0BE3B9277AAA0F7E7"><enum>(3)</enum><header>Guidance and
			 consultation</header><text>The Administrator of the Office of Information and
			 Regulatory Affairs shall provide guidance to the agencies on the implementation
			 of this section and shall consult with other agencies as appropriate in the
			 implementation of this section.</text>
					</paragraph></subsection><subsection id="HC6730BD7411443D1874FB600574BE9AD"><enum>(b)</enum><header>Publication</header><text>Agencies
			 shall publish their Statements of Energy Effects, or a summary thereof, in each
			 related Notice of Proposed Rulemaking and in any resulting Final Rule.</text>
				</subsection><subsection id="HD243DEC7F9FE4F24A8AF21656373EB4A"><enum>(c)</enum><header>Definitions</header><text>For
			 purposes of this section—</text>
					<paragraph id="H9487C3E589424AC9B42533C53370C0D5"><enum>(1)</enum><text>the term
			 <quote>agency</quote> has the meaning given that term in section 3502(1) of
			 title 44, United States Code, except that the term does not include an
			 independent regulatory agency, as defined in paragraph (5) of that section;
			 and</text>
					</paragraph><paragraph id="H79D8CFD4E69A48199762AA4ED76123C4"><enum>(2)</enum><text>the term
			 <quote>significant energy action</quote> means any action by an agency that is
			 expected to lead to promulgation of a final rule or regulation and that—</text>
						<subparagraph id="H3F4066580231424D954A770FF6987F0C"><enum>(A)</enum><text>is likely to have
			 a significant adverse effect on the supply, distribution, or use of energy;
			 or</text>
						</subparagraph><subparagraph id="H6836DD4329B04257A9D70A3D06236D3F"><enum>(B)</enum><text>is designated by
			 the Administrator of the Office of Information and Regulatory Affairs as a
			 significant energy action.</text>
						</subparagraph></paragraph></subsection></section></title><title id="HBC4AECEC9C2F4253B0761CF239093CE4"><enum>II</enum><header>Refining Capacity
			 on Closed Military Installations </header>
			<section id="H464B52449FAF46CBB88A1D997A434B54" section-type="subsequent-section"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this title—</text>
				<paragraph id="H823F6740E03042D4B1EB501BBBDC2E8B"><enum>(1)</enum><text>the term
			 <term>base closure law</term> means the Defense Base Closure and Realignment
			 Act of 1990 (part A of title XXIX of Public Law 101–510; 10 U.S.C. 2687 note)
			 and title II of the Defense Authorization Amendments and Base Closure and
			 Realignment Act (Public Law 100–526; 10 U.S.C. 2687 note);</text>
				</paragraph><paragraph id="H33790FF8E26848DF8738A14D3EB43336"><enum>(2)</enum><text>the term
			 <term>closed military installation</term> means a military installation closed
			 or approved for closure pursuant to a base closure law;</text>
				</paragraph><paragraph id="HB75A45D172124AE0B954D22218B851D2"><enum>(3)</enum><text>the term
			 <quote>designated refinery</quote> means a refinery designated under section
			 202(a);</text>
				</paragraph><paragraph id="HB1245E466DAF432B9D560237E125CB7B"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>Federal refinery
			 authorization</term>—</text>
					<subparagraph display-inline="no-display-inline" id="H04711E0489684E5B8B37D15DFB037326"><enum>(A)</enum><text>means any
			 authorization required under Federal law, whether administered by a Federal or
			 State administrative agency or official, with respect to siting, construction,
			 expansion, or operation of a refinery; and</text>
					</subparagraph><subparagraph id="HC89E9E886F15471998CDC7D6D19DDAE2"><enum>(B)</enum><text>includes any
			 permits, special use authorizations, certifications, opinions, or other
			 approvals required under Federal law with respect to siting, construction,
			 expansion, or operation of a refinery;</text>
					</subparagraph></paragraph><paragraph id="HD37AC0C3A80441EC9287C09501DAB4CD"><enum>(5)</enum><text>the term
			 <term>refinery</term> means—</text>
					<subparagraph id="H6D4E416319AE4005A48EFD647AF93531"><enum>(A)</enum><text>a facility
			 designed and operated to receive, load, unload, store, transport, process, and
			 refine crude oil by any chemical or physical process, including distillation,
			 fluid catalytic cracking, hydrocracking, coking, alkylation, etherification,
			 polymerization, catalytic reforming, isomerization, hydrotreating, blending,
			 and any combination thereof, in order to produce gasoline or other fuel;
			 or</text>
					</subparagraph><subparagraph id="H4BA4FE289BAF4B129B495D369C23329F"><enum>(B)</enum><text>a facility
			 designed and operated to receive, load, unload, store, transport, process, and
			 refine coal by any chemical or physical process, including liquefaction, in
			 order to produce gasoline, diesel, or other liquid fuel as its primary output;</text>
					</subparagraph></paragraph><paragraph id="HEE6AE86110C241C9B0CC969EA065BBCB"><enum>(6)</enum><text>the term
			 <term>Secretary</term> means the Secretary of Energy; and</text>
				</paragraph><paragraph id="H165068F8D23542548253B7EACC85D0A2"><enum>(7)</enum><text>the term
			 <term>State</term> means a State, the District of Columbia, the Commonwealth of
			 Puerto Rico, and any other territory or possession of the United States.</text>
				</paragraph></section><section id="H591DD944E86B4474BEE6A3F57C85F0BC"><enum>202.</enum><header>State
			 participation and presidential designation</header>
				<subsection id="HB0F332DA952D4970A21BEB0D4F1FF1BB"><enum>(a)</enum><header>Designation
			 requirement</header><text>Not later than 90 days after the date of enactment of
			 this Act, the President shall designate no less than 3 closed military
			 installations, or portions thereof, subject to subsection (c)(2), that are
			 appropriate for the purposes of siting a refinery.</text>
				</subsection><subsection id="HFA3B35F2FB5C423DBAD48BB77AA5B803"><enum>(b)</enum><header>Analysis of
			 refinery sites</header><text>In considering any site for possible designation
			 under subsection (a), the President shall conduct an analysis of—</text>
					<paragraph id="H7BE1DA9D4C1747B4A4A76AE678B5474C"><enum>(1)</enum><text>the availability
			 of crude oil supplies to the site, including supplies from domestic production
			 of shale oil and tar sands and other strategic unconventional fuels;</text>
					</paragraph><paragraph id="H5FE2B3E263E244BA97E2B27DD3F5B638"><enum>(2)</enum><text>the distribution
			 of the Nation’s refined petroleum product demand;</text>
					</paragraph><paragraph id="H7F72DE3A2F6C46568C2786696E6A9BB8"><enum>(3)</enum><text>whether such site
			 is in close proximity to substantial pipeline infrastructure, including both
			 crude oil and refined petroleum product pipelines, and potential infrastructure
			 feasibility;</text>
					</paragraph><paragraph id="H09A9B589095A4CD9853B591FE07EF9B1"><enum>(4)</enum><text>the need to
			 diversify the geographical location of the domestic refining capacity;</text>
					</paragraph><paragraph id="H78FB1A854CBC4F79AAD05D5AF2FE1347"><enum>(5)</enum><text>the effect that
			 increased refined petroleum products from a refinery on that site may have on
			 the price and supply of gasoline to consumers;</text>
					</paragraph><paragraph id="H0A8057D733C947E3A36F9ACF86AAB499"><enum>(6)</enum><text>the impact of
			 locating a refinery on the site on the readiness and operations of the Armed
			 Forces; and</text>
					</paragraph><paragraph id="HB0278354570D4A84855852F4B8A9C7CE"><enum>(7)</enum><text>such other factors
			 as the President considers appropriate.</text>
					</paragraph></subsection><subsection id="H666A65B894634F2FB7907C2F138F4A4A"><enum>(c)</enum><header>Sale or
			 disposal</header>
					<paragraph id="HE2BF59D240374456B364F47738C9D146"><enum>(1)</enum><header>Designation</header><text>Except
			 as provided in paragraph (2), until the expiration of 2 years after the date of
			 enactment of this Act, the Federal Government shall not sell or otherwise
			 dispose of the military installations designated pursuant to subsection
			 (a).</text>
					</paragraph><paragraph id="H5394199E8BCD43C8934F201F91F2BC6A"><enum>(2)</enum><header>Governor’s
			 objection</header><text>No site may be used for a refinery under this title if,
			 not later than 60 days after designation of the site under subsection (a), the
			 Governor of the State in which the site is located transmits to the President
			 an objection to the designation, unless, not later than 60 days after the
			 President receives such objection, the Congress has by law overridden the
			 objection.</text>
					</paragraph></subsection><subsection id="H007C270900674E76B4E213E76E149B02"><enum>(d)</enum><header>Redevelopment
			 authority</header><text>With respect to a closed military installation, or
			 portion thereof, designated by the President as a potentially suitable refinery
			 site pursuant to subsection (a)—</text>
					<paragraph id="H922E895CF5544CAFAA608B75E360B27C"><enum>(1)</enum><text>the redevelopment
			 authority for the installation, in preparing or revising the redevelopment plan
			 for the installation, shall consider the feasibility and practicability of
			 siting a refinery on the installation; and</text>
					</paragraph><paragraph id="H66274EF613D04B45922264B1E3819274"><enum>(2)</enum><text>the Secretary of
			 Defense, in managing and disposing of real property at the installation
			 pursuant to the base closure law applicable to the installation, shall give
			 substantial deference to the recommendations of the redevelopment authority, as
			 contained in the redevelopment plan for the installation, regarding the siting
			 of a refinery on the installation.</text>
					</paragraph></subsection></section><section id="HF83DF292C6A04BA294D52E2CFE03D787"><enum>203.</enum><header>Process
			 coordination and rules of procedure</header>
				<subsection id="HF0B98CA290DF4EF2B3293BC77EBEB6B4"><enum>(a)</enum><header>Designation as
			 Lead Agency</header>
					<paragraph id="HF615BAC60BC64D87801BE7CB36631B7E"><enum>(1)</enum><header>In
			 general</header><text>The Department of Energy shall act as the lead agency for
			 the purposes of coordinating all applicable Federal refinery authorizations and
			 related environmental reviews with respect to a designated refinery.</text>
					</paragraph><paragraph id="H05370C8A7B824836A8529EE6FE61EF49"><enum>(2)</enum><header>Other
			 agencies</header><text>Each Federal and State agency or official required to
			 provide a Federal refinery authorization shall cooperate with the Secretary and
			 comply with the deadlines established by the Secretary.</text>
					</paragraph></subsection><subsection id="H0122EF105F1E417F8FF2F90B426FB93E"><enum>(b)</enum><header>Schedule</header>
					<paragraph id="HF315521D00A549F993DCA97CD87563AF"><enum>(1)</enum><header>Secretary’s
			 authority to set schedule</header><text>The Secretary shall establish a
			 schedule for all Federal refinery authorizations with respect to a designated
			 refinery. In establishing the schedule, the Secretary shall—</text>
						<subparagraph id="H025A636000554CE58AF0257B0C06B0ED"><enum>(A)</enum><text>ensure expeditious
			 completion of all such proceedings; and</text>
						</subparagraph><subparagraph id="H46BF4C6037A849A99E5A78222CBFC992"><enum>(B)</enum><text>accommodate the
			 applicable schedules established by Federal law for such proceedings.</text>
						</subparagraph></paragraph><paragraph id="H577AE6BCDB284DF89F463C40B046D2AC"><enum>(2)</enum><header>Failure to meet
			 schedule</header><text>If a Federal or State administrative agency or official
			 does not complete a proceeding for an approval that is required for a Federal
			 refinery authorization in accordance with the schedule established by the
			 Secretary under this subsection, the applicant may pursue remedies under
			 subsection (d).</text>
					</paragraph></subsection><subsection id="H774AD0F415534F7B91845CB3C92F938D"><enum>(c)</enum><header>Consolidated
			 Record</header><text>The Secretary shall, with the cooperation of Federal and
			 State administrative agencies and officials, maintain a complete consolidated
			 record of all decisions made or actions taken by the Secretary or by a Federal
			 administrative agency or officer (or State administrative agency or officer
			 acting under delegated Federal authority) with respect to any Federal refinery
			 authorization. Such record shall be the record for judicial review under
			 subsection (d) of decisions made or actions taken by Federal and State
			 administrative agencies and officials, except that, if the Court determines
			 that the record does not contain sufficient information, the Court may remand
			 the proceeding to the Secretary for further development of the consolidated
			 record.</text>
				</subsection><subsection id="H5FB832969403411F834CBB5D71C53C64"><enum>(d)</enum><header>Judicial
			 Review</header>
					<paragraph id="H3B15441615454806B2D58B3E93CC1481"><enum>(1)</enum><header>In
			 general</header><text>The United States Court of Appeals for the District of
			 Columbia shall have original and exclusive jurisdiction over any civil action
			 for the review of—</text>
						<subparagraph id="H450FABB473CD44B8BAF1B6A5641ECF02"><enum>(A)</enum><text>an order or
			 action, related to a Federal refinery authorization, by a Federal or State
			 administrative agency or official; and</text>
						</subparagraph><subparagraph id="HD7381F1BD912470A926686BA528FA067"><enum>(B)</enum><text>an alleged failure
			 to act by a Federal or State administrative agency or official acting pursuant
			 to a Federal refinery authorization.</text>
						</subparagraph><continuation-text continuation-text-level="paragraph">The failure
			 of an agency or official to act on a Federal refinery authorization in
			 accordance with the Secretary’s schedule established pursuant to subsection (b)
			 shall be considered inconsistent with Federal law for the purposes of paragraph
			 (2) of this subsection.</continuation-text></paragraph><paragraph id="H630C2F25C4924DE68266A628E04D1792"><enum>(2)</enum><header>Court
			 action</header><text>If the Court finds that an order or action described in
			 paragraph (1)(A) is inconsistent with the Federal law governing such Federal
			 refinery authorization, or that a failure to act as described in paragraph
			 (1)(B) has occurred, and the order, action, or failure to act would prevent the
			 siting, construction, expansion, or operation of the designated refinery, the
			 Court shall remand the proceeding to the agency or official to take appropriate
			 action consistent with the order of the Court. If the Court remands the order,
			 action, or failure to act to the Federal or State administrative agency or
			 official, the Court shall set a reasonable schedule and deadline for the agency
			 or official to act on remand.</text>
					</paragraph><paragraph id="HA944072B86EF4CFBAB8ADDB331360892"><enum>(3)</enum><header>Secretary’s
			 action</header><text>For any civil action brought under this subsection, the
			 Secretary shall promptly file with the Court the consolidated record compiled
			 by the Secretary pursuant to subsection (c).</text>
					</paragraph><paragraph id="HBC7FC7118731436FB9F9383B4B7855E7"><enum>(4)</enum><header>Expedited
			 review</header><text>The Court shall set any civil action brought under this
			 subsection for expedited consideration.</text>
					</paragraph><paragraph id="H024E78DEAD4A472C94F62F33D183B703"><enum>(5)</enum><header>Attorney’s
			 fees</header><text>In any action challenging a Federal refinery authorization
			 that has been granted, reasonable attorney’s fees and other expenses of
			 litigation shall be awarded to the prevailing party. This paragraph shall not
			 apply to any action seeking remedies for denial of a Federal refinery
			 authorization or failure to act on an application for a Federal refinery
			 authorization.</text>
					</paragraph></subsection></section></title></legis-body>
