		  legal representation to parents and legal guardians with respect to child

		<section id="HC80B4B9DF7FB4155821FBBDFEA150D04" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Enhancing the Quality of Parental
			 Legal Representation Act of 2011</short-title></quote>.</text>
		</section><section id="H9E5415194689421A92E641EA3D7AE84A"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H843A1E5E71CC48F8A63183765F0887A3"><enum>(1)</enum><text display-inline="yes-display-inline">In the Strengthening Abuse and Neglect
			 Courts Act of 2000, the Congress found that “under both Federal and State law,
			 the courts play a crucial and essential role in the Nation’s child welfare
			 system and in ensuring safety, stability, and permanence for abused and
			 neglected children under the supervision of that system”.</text>
			</paragraph><paragraph id="HDFF369B927D7470A8AE145CCC652CE22"><enum>(2)</enum><text>Child outcomes are
			 improved and courts function more effectively when all parties have quality
			 legal representation. Analysis of data from programs in New York and Michigan
			 revealed that more than 50 percent of children avoided unnecessary foster care
			 placement when all parties received high quality representation. According to
			 the American Bar Association, a pilot program in the State of Washington to
			 improve representation for parents resulted in “a 53.3 percent increase in the
			 rate of reunification”.</text>
			</paragraph><paragraph id="H23965B383A97486AAD0865FBC38827AE"><enum>(3)</enum><text>In New York,
			 children placed in foster care whose parents receive high quality legal
			 representation spent on average 4.5 months in placement compared to a statewide
			 average of 2<fraction>½</fraction> years and re-entry rates of 1 percent
			 compared to 15 percent statewide.</text>
			</paragraph><paragraph id="H62C42CBE36C7498BADFB9E6030F83381"><enum>(4)</enum><text>According to the
			 American Bar Association, the cost per family for high quality legal services
			 in New York was approximately $6,000 over the life of a case as compared to
			 anywhere from $29,000 to $66,000 for 1 year of foster care for a child in New
			 York City in 2010.</text>
			</paragraph><paragraph id="H118B6C4727EE427FA6E3A71B32DCFE23"><enum>(5)</enum><text display-inline="yes-display-inline">Training and standards of representation
			 are necessary to ensure qualified representation. According to the American Bar
			 Association Center on Children and the Law, parental representation is “often
			 substandard, resulting in the failure of due process in these cases. As a
			 result, numerous children are needlessly separated from their parents for
			 extended periods of time and in many cases families are permanently severed
			 through termination of parental rights orders” and most states have no standard
			 training requirements for attorneys representing parents in their state.</text>
			</paragraph></section><section id="H4B72754AE17C481E9AF9F281CA1D52ED"><enum>3.</enum><header>Amendments to the
			 Court Improvement Program</header>
			<subsection id="H36879B3EF0E9449DBE9CFD3F2CB5021C"><enum>(a)</enum><header>Provision of
			 legal representation for parents and legal guardians with respect to child
			 welfare cases</header><text display-inline="yes-display-inline">Section 438(a)
			 of the Social Security Act (42 U.S.C. 629h(a)) is amended—</text>
				<paragraph id="H0C4CE3457BB440809E718AE963F50E49"><enum>(1)</enum><text>in paragraph (3),
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="HDAACBBB99B044A79AF2A4695018A38A5"><enum>(2)</enum><text>in paragraph
			 (4)(B), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="H1C6406A682A84B3E90FA0F5F0154D079"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HFBAE4759C7FB4E10AF959E9C9DE94CEC" style="OLC">
						<paragraph id="H97E55F8942854C19AB2DC7D47F0E1C68"><enum>(5)</enum><text display-inline="yes-display-inline">to provide legal representation for parents
				and legal guardians with respect to proceedings described in paragraph
				(1).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H65E552CA39BB4F6D8C8B7B84708FCC9A"><enum>(b)</enum><header>Application</header><text>Section
			 438(b) of such Act (42 U.S.C. 629h(b)) is amended—</text>
				<paragraph id="HD16F5F4D58A44DA69DAD7F4CAE77269D"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="HDD3C9202F1E64DEABF53F87AD3E73ECF"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (B);</text>
					</subparagraph><subparagraph id="H7A982BF5B74F4D18A91C5DA624B728EE"><enum>(B)</enum><text>by striking the
			 period at the end of subparagraph (C) and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="H8825368EBF5D4782858BE21C719C3F0E"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H1EB98361767F4C1AA45089DCD222CF93" style="OLC">
							<subparagraph id="H33F4175231004556949210278705F0FD"><enum>(D)</enum><text display-inline="yes-display-inline">in the case of a grant for any purpose
				described in subsection (a)(5)—</text>
								<clause id="HC97E93D875244CBCAFEFB87F30088E0D"><enum>(i)</enum><text display-inline="yes-display-inline">a description of how the grant will be used
				to provide legal representation to parents and legal guardians;</text>
								</clause><clause id="H3A8C31B0CC02447F83F0727EAB4BA88F"><enum>(ii)</enum><text>a
				description of how the court will prioritize the provision of legal
				representation, including how and when attorneys will be assigned to represent
				a parent or legal guardian; and</text>
								</clause><clause id="HF11714B2A8D647BF816059C44603DDFE"><enum>(iii)</enum><text display-inline="yes-display-inline">a description of how courts and child
				welfare agencies on the local and State levels will collaborate and jointly
				plan for the collection and sharing of all relevant data and information to
				demonstrate how increased quality representation of parents and legal guardians
				with respect to child welfare cases will improve child and family
				outcomes.</text>

					</subparagraph></paragraph><paragraph id="HBA81C2367CF947C295127948C6BB560F"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="HD31252B7192343069F82EE116A168341"><enum>(A)</enum><text>in subparagraph
			 (C), by striking <quote>or</quote>;</text>
					</subparagraph><subparagraph id="HF0181F077D714DAFA13049BD2140700E"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking <quote>and

					</subparagraph></paragraph></subsection><subsection id="H6C723A90EE5A47529A3EE7F3A422792E"><enum>(c)</enum><header>Amount of
			 grant</header><text>Section 438(c)(1) is amended by striking <quote>and
			 (C)</quote> and inserting <quote>(C), and (D)</quote>.</text>
			</subsection><subsection id="H27ECEFF03759462EA768767774EEAAC9"><enum>(d)</enum><header>Allocation of
			 Funds</header><text>Section 438(c)(3)(A) of such Act (42 U.S.C. 629h(c)(3)(A))
			 is amended—</text>
				<paragraph id="H5CF7981C9DFB42B782C7352F95DA3833"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of clause (iii);</text>
				</paragraph><paragraph id="H9113E40199E34324956A87ED771A10D0"><enum>(2)</enum><text>by redesignating
			 clause (iv) as clause (v); and</text>
				</paragraph><paragraph id="H8D171AB0E536466EB164C5683E006FF7"><enum>(3)</enum><text>by inserting after
			 clause (iii) the following:</text>

				</paragraph></subsection><subsection id="H8EBC0C1F0CBB4F509B10508A04DED273"><enum>(e)</enum><header>Funding</header><text>Section
			 436 of such Act (42 U.S.C. 629g) is amended—</text>
				<paragraph id="HC7C10FEC3D3A4B519631651BB6AFCC99"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote>$345,000,000</quote> and inserting
			 <quote>$355,000,000</quote>; and</text>
				</paragraph><paragraph id="H286EC3CBE869475099D4DE441786EFB2"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(2), by striking
			 <quote>$30,000,000</quote> and inserting <quote>$40,000,000</quote>.</text>
