			</subsection></section><section id="H75F1D1D11BDD4B1393404F48D20FA170"><enum>2.</enum><header>Sense of the
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 the Congress that—</text>
			<paragraph id="H343BDA8F6362466382894D9912BD9816"><enum>(1)</enum><text display-inline="yes-display-inline">residents of rural and frontier communities
			 should have access to affordable, quality health care;</text>
			</paragraph><paragraph id="H612C4BFFB6444BCFA234C5F4D1BB738E"><enum>(2)</enum><text display-inline="yes-display-inline">rural and frontier communities face unique
			 challenges in health care delivery and financing;</text>
			</paragraph><paragraph id="HB6360A465C454399B03158C743E1F727"><enum>(3)</enum><text display-inline="yes-display-inline">Federal health policy must reflect the
			 unique needs of residents of rural and frontier communities and such
			 communities in an equitable and sustainable manner; and</text>
			</paragraph><paragraph id="H1F97C8BC31E9462F8A8863E8C2A7F472"><enum>(4)</enum><text display-inline="yes-display-inline">stakeholders should work collectively to
			 identify innovative policies that address the availability, delivery, and
			 affordability of health care services in rural and frontier communities.</text>
			</paragraph></section><section id="H47FAF757BD31445BA9A9E4489FBBE965"><enum>3.</enum><header>Fairness in the
			 Medicare disproportionate share hospital (DSH) adjustment for rural
			 hospitals</header><text display-inline="no-display-inline">Section
			 1886(d)(5)(F)(xiv)(II) of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (42 U.S.C. 1395ww(d)(5)(F)(xiv)(II)) is amended by adding at the
			 end the following new sentence: <quote>The preceding sentence shall not apply
			 to any hospital with respect to discharges occurring on or after October 1,
			 2011, and before October 1, 2012.</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HE98743B33A7B4729AE44B91949591CA5"><enum>4.</enum><header>Extension and
			 expansion of the Medicare hold harmless provision under the prospective payment
			 system for hospital outpatient department (HOPD) services for certain
			 hospitals</header><text display-inline="no-display-inline">Section
			 1833(t)(7)(D)(i) of the Social Security Act (42 U.S.C. 1395l(t)(7)(D)(i)) is
			 amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H033E4C7F5AD64502847F7289A154344D"><enum>(1)</enum><text display-inline="yes-display-inline">in subclause (II)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H891B2A37ED36435CB06C93234C519779"><enum>(A)</enum><text display-inline="yes-display-inline">in the first sentence, by striking
			 <quote>March 1, 2012</quote> and inserting <quote>January 1, 2013</quote>;
			 and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HED9BC66547C3460580A20CBF8E8EAB05"><enum>(B)</enum><text display-inline="yes-display-inline">in the second sentence—</text>
					<clause commented="no" display-inline="no-display-inline" id="H1478A0A842584B99BF44A97DFE0701D6"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>and 85</quote> and
			 inserting <quote>85</quote>; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H21334D9B81A14541A2681CDB0DF213D3"><enum>(ii)</enum><text>by inserting the
			 following before the period at the end: <quote>, and 100 percent with respect
			 to such services furnished in the last 10 months of 2012</quote>; and</text>
					</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAA237817701143A3B4A9C1504E1A0489"><enum>(2)</enum><text>in subclause
			 (III)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H4E838E5FF72247FBBB199011323C50FC"><enum>(A)</enum><text>in the first
			 sentence—</text>
					<clause commented="no" display-inline="no-display-inline" id="H6FDFD357B00D432EA13F015CE91D52D9"><enum>(i)</enum><text>by striking
			 <quote>2009, and before March 1, 2012, for which</quote> and inserting
			 <quote>2009, and before January 1, 2013, for which</quote>; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="HB49A914EEBB344D78581210B490C8DCE"><enum>(ii)</enum><text>by striking
			 <quote>85 percent</quote> and inserting <quote>the applicable percentage (as
			 determined under the second sentence of subclause (II) for the year)</quote>;

					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE6DEFA52C5DA447C8308F4238E9D3A38"><enum>(B)</enum><text>in the second
			 sentence, by striking <quote>2010, and before March 1, 2012, the
			 preceding</quote> and inserting <quote>2010, and before January 1, 2013, the
			 preceding</quote>.</text>
				</subparagraph></paragraph></section><section id="HF7E01A242618465BAC376C07A3D6E354"><enum>5.</enum><header>Temporary
			 improvements to the Medicare inpatient hospital payment adjustment for
			 low-volume hospitals</header><text display-inline="no-display-inline">Section
			 1886(d)(12) of the Social Security Act (42 U.S.C. 1395ww(d)(12)) is
			 amended—</text>
			<paragraph id="H43A5757C53E24629885A5114C7B75B16"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (C)(i), by inserting
			 <quote>and 2,000 discharges, respectively,</quote> after <quote>1,600
			 discharges</quote>; and</text>
			</paragraph><paragraph id="HF0DD7487BF044E41996CFF381A917E70"><enum>(2)</enum><text>in subparagraph
			 (D)—</text>
				<subparagraph id="HA5CBCB3358C64E3B8E02327354176B88"><enum>(A)</enum><text>by striking
			 <quote>1,600</quote> and inserting <quote>the applicable number of</quote>;
			 and</text>
				</subparagraph><subparagraph id="H68F4EA145F274D4580DA05B2004557E7"><enum>(B)</enum><text>by adding at the
			 end the following new sentence: <quote>For purposes of the preceding sentence,
			 the term <term>applicable number of discharges</term> means 1,600 discharges
			 with respect to discharges occurring in fiscal year 2011 and 2,000 discharges
			 with respect to discharges occurring in fiscal year 2012</quote>.</text>
				</subparagraph></paragraph></section><section id="H8E4D59C08DA541278353C2B66E02D207"><enum>6.</enum><header>Extension of
			 Medicare wage index reclassifications for certain hospitals</header>
			<subsection id="HF7C2C70416A54924AF4F2B54A9A4ECDB"><enum>(a)</enum><header>Extension of
			 correction of mid-Year reclassification expiration for certain
			 hospitals</header>
				<paragraph id="HBD97AE1CF6D54978AF39D83DDF8E4EA3"><enum>(1)</enum><header>In
			 general</header><text>In the case of a hospital described in paragraph (2), the
			 Secretary of Health and Human Services shall apply subsection (a) of section
			 106 of division B of the Tax Relief and Health Care Act of 2006 (42 U.S.C.
			 1395ww note), as amended by section 117 of the Medicare, Medicaid, and SCHIP
			 Extension Act of 2007 (Public Law 110–173), section 124 of the Medicare
			 Improvements for Patients and Providers Act of 2008 (Public Law 110–275),
			 sections 3137(a) and 10317 of the Patient Protection and Affordable Care Act
			 (Public Law 111–148), and section 102 of the Medicare and Medicaid Extenders
			 Act of 2010 (Public Law 111–309), by substituting <quote>September 30,
			 2012</quote> for <quote>November 30, 2011</quote>.</text>
				</paragraph><paragraph id="H167E6845AEDF4D22BC9818D9114C8499"><enum>(2)</enum><header>Hospital
			 described</header><text>A hospital described in this paragraph is—</text>
					<subparagraph id="H7932659FA3BD4D948640B0351AFBAC68"><enum>(A)</enum><text>a hospital—</text>
						<clause id="HAD58FE34D7B34EDD9F644BD0ACE7D725"><enum>(i)</enum><text>that
			 is described in subsection (a) of such section 106; and</text>
						</clause><clause id="HA178141D5BD94A5F88697E804A60CFF6"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H156BB51BC68F4A96BDDBFF4C412B4627"><enum>(I)</enum><text>that is located in a
			 rural area; and</text>
							</subclause><subclause id="H51409A5FD1A34FEF81F0096F55A5853C" indent="up1"><enum>(II)</enum><text>for which the Secretary of Health and
			 Human Services has determined the extension under this subsection to be
			 appropriate; or</text>
							</subclause></clause></subparagraph><subparagraph id="H1D7DCB8C1354472B895B52DE3C7833B1"><enum>(B)</enum><text>a sole community
			 hospital located in a State with less than 10 people per square mile that was
			 provided with a special exception reclassification extension under section
			 117(a)(2) of the Medicare, Medicaid, and SCHIP Extension Act of 2007 (Public
			 Law 110–173).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9A09032CAF2B4B418414E082853FC2E2"><enum>(b)</enum><header>Not budget
			 neutral</header><text>The provisions of this section shall not be effected in a
			 budget-neutral manner.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HFFA4C3C4D6794E10BA69EF886E8859A5"><enum>7.</enum><header display-inline="yes-display-inline">Extension of Medicare reasonable costs
			 payments for certain clinical diagnostic laboratory tests furnished to hospital
			 patients in certain rural areas</header><text display-inline="no-display-inline">Section 416(b) of the Medicare Prescription
			 Drug, Improvement, and Modernization Act of 2003 (42 U.S.C. 1395l–4), as
			 amended by section 105 of division B of the Tax Relief and Health Care Act of
			 2006 (42 U.S.C. 1395l note), section 107 of the Medicare, Medicaid, and SCHIP
			 Extension Act of 2007 (42 U.S.C. 1395l note), section 3122 of the Patient
			 Protection and Affordable Care Act (Public Law 111–148), and section 109 of the
			 Medicare and Medicaid Extenders Act of 2010 (Public Law 111–309), is amended by
			 striking <quote>the 2-year period beginning on July 1, 2010</quote> and
			 inserting <quote>the 30-month period beginning on July 1, 2010</quote>.</text>
		</section><section id="H3B1FF5FEA87F43919C5AA9E039C19C93"><enum>8.</enum><header>Elimination of
			 isolation test for cost-based ambulance reimbursement for critical access
			 hospitals</header>
			<subsection id="H7776F3EB7EEE401D8159BE2461E5FF12"><enum>(a)</enum><header>In
			 general</header><text>Section 1834(l)(8) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395m(l)(8)) is
			 amended—</text>
				<paragraph id="H2C9DB62C4BC148CB9B7BD634639138C4"><enum>(1)</enum><text>in subparagraph
			 (B)—</text>
					<subparagraph id="H29B612CF6C1445A5A8A0DD14AE618AE5"><enum>(A)</enum><text>by striking
			 <quote>owned and</quote>; and</text>
					</subparagraph><subparagraph id="H351C9AD105C043709F5F7FB6215090F2"><enum>(B)</enum><text>by inserting
			 <quote>(including when such services are provided by the entity under an
			 arrangement with the hospital)</quote> after <quote>hospital</quote>;
			 and</text>
					</subparagraph></paragraph><paragraph id="H5FC68DF3A2984F52A374B2DEE8017434"><enum>(2)</enum><text>by striking the
			 comma at the end of subparagraph (B) and all that follows and inserting a
			 period.</text>
				</paragraph></subsection><subsection id="H15D6754A779843F29B51D18547F85D3A"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to services
			 furnished on or after January 1, 2012.</text>
			</subsection></section><section id="H0F46DB1715D345BEAA18466FF32E741E" section-type="subsequent-section"><enum>9.</enum><header>Extension of Medicare
			 incentive payment program for physician scarcity areas</header><text display-inline="no-display-inline">Section 1833(u)(1) of the Social Security
			 Act (42 U.S.C. 1395l(u)(1)) is amended by inserting <quote>, and such services
			 furnished on or after January 1, 2012, and before January 1, 2013</quote> after
			 <quote>2008</quote>.</text>
		</section><section id="HE64E9AF2361646DB8A0C7B1890D82215"><enum>10.</enum><header>Extension of
			 floor on Medicare work geographic adjustment</header><text display-inline="no-display-inline">Section 1848(e)(1)(E) of the Social Security
			 Act (42 U.S.C. 1395w–4(e)(1)(E)) is amended by striking <quote>before March 1,
			 2012</quote> and inserting <quote>before January 1, 2013</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H0BEB0331986448D6BFD69DFA0CF29DFB" section-type="subsequent-section"><enum>11.</enum><header display-inline="yes-display-inline">Improving care planning for Medicare home
			 health services</header>
			<subsection commented="no" display-inline="no-display-inline" id="H9071CA07D8F54CD2B73291C1C6DB8423"><enum>(a)</enum><header display-inline="yes-display-inline">Part A provisions</header><text>Section
			 1814(a) of the Social Security Act (42 U.S.C. 1395f(a)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HFF9509A4BD064BD19E44CE87F4F13CD0"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H5441B1D105CC425B9920994927100379"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A),
			 by inserting <quote>, a nurse practitioner or clinical nurse specialist who is
			 working in collaboration with a physician in accordance with State law, a
			 certified nurse-midwife (as defined in section 1861(gg)) as authorized by State
			 law, or a physician assistant (as defined in section 1861(aa)(5)) under the
			 supervision of a physician</quote> after <quote>1866(j)</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5504B06FA13F4174B3463B7AAA5DFD9A"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (C)—</text>
						<clause commented="no" display-inline="no-display-inline" id="H9206E0E153BD4B84AE2EC2E7936FBE3D"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>, a nurse practitioner,
			 a clinical nurse specialist, a certified nurse-midwife, or a physician
			 assistant (as the case may be)</quote> after <quote>physician</quote> the first
			 2 times it appears; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HA6B604BF0DC74C81A98F1E994C34689D"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>, and, in the case of a
			 certification made by a physician</quote> and all that follows through
			 <quote>face-to-face encounter</quote> and inserting <quote>, and, in the case
			 of a certification made by a physician after January 1, 2010, or by a nurse
			 practitioner, clinical nurse specialist, certified nurse-midwife, or physician
			 assistant (as the case may be) after January 1, 2012, prior to making such
			 certification the physician, nurse practitioner, clinical nurse specialist,
			 certified nurse-midwife, or physician assistant must document that the
			 physician, nurse practitioner, clinical nurse specialist, certified
			 nurse-midwife, or physician assistant has had a face-to-face
			 encounter</quote>;</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H74D30C192CFF4781974C02F107083A16"><enum>(2)</enum><text display-inline="yes-display-inline">in the second sentence, by inserting
			 <quote>certified nurse-midwife,</quote> after <quote>clinical nurse
			 specialist,</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H549628EFC0874BEC9D9357798C64A145"><enum>(3)</enum><text display-inline="yes-display-inline">in the third sentence—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HDCAD8BCF468045A489BE28340D99010F"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>physician
			 certification</quote> and inserting <quote>certification</quote>;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H614FFB4BB77D4292B00E32CFB4A6D41E"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>(or on January 1, 2012,
			 in the case of regulations to implement the amendments made by section 11 of
			 the <short-title>Rural Hospital and Provider Equity Act of
			 2012</short-title>)</quote> after <quote>1981</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC259BB7D84F649608D2115C7A5E6B31E"><enum>(C)</enum><text display-inline="yes-display-inline">by striking <quote>a physician who</quote>
			 and inserting <quote>a physician, nurse practitioner, clinical nurse
			 specialist, certified nurse-midwife, or physician assistant who</quote>;
			 and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9227EAD85ECE4004B9637E2175C96553"><enum>(4)</enum><text display-inline="yes-display-inline">in the fourth sentence, by inserting
			 <quote>, nurse practitioner, clinical nurse specialist, certified
			 nurse-midwife, or physician assistant</quote> after
			 <quote>physician</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H12E6A431A8A748C9AA0649ECED1738F3"><enum>(b)</enum><header>Part B

			 who is working in collaboration with a physician in accordance with State law,
			 a certified nurse-midwife (as defined in section 1861(gg)) as authorized by
			 State law, or a physician assistant (as defined in section 1861(aa)(5)) under
			 the supervision of a physician</quote> after <quote>1866(j)</quote>; and</text>

						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H706033AE0D344D5FB72E01DC8C3BDA40"><enum>(2)</enum><text display-inline="yes-display-inline">in the third sentence, by inserting
			 <quote>, nurse practitioner, clinical nurse specialist, certified
			 nurse-midwife, or physician assistant (as the case may be)</quote> after
			 <quote>physician</quote>;</text>

			 Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (Public
			 Law 108–173; 117 Stat. 2283), as amended by section 5201(b) of the Deficit
			 Reduction Act of 2005 (Public Law 109–171; 120 Stat. 46) and section 3131(c) of
			 the Patient Protection and Affordable Care Act (Public Law 111–148; 124 Stat.
			 428), is amended by striking <quote>2016, 3 percent</quote> and inserting
			 <quote>2011, and episodes and visits ending on or after January 1, 2013, and
			 before January 1, 2016, 3 percent</quote>.</text>
		</section><section id="H2D77C3300E694F97A903AFD7851FA8F0"><enum>14.</enum><header>Extension of
			 increased Medicare payments for rural ground ambulance services</header>
			<subsection id="HD134B84A2D00403B9D5EDDB74BE31869"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section
			 1834(l)(13)(A) of the Social Security Act (42 U.S.C. 1395m(l)(13)(A)) is
			 amended—</text>

			</subsection></section><section commented="no" id="HE70AA0B882084129939F8989E27E21A3"><enum>15.</enum><header>Extension of
			 payment for technical component of certain physician pathology
			 services</header><text display-inline="no-display-inline">Section 542(c) of the
			 Medicare, Medicaid, and SCHIP Benefits Improvement and Protection Act of 2000
			 (as enacted into law by section 1(a)(6) of Public Law 106–554), as amended by
			 section 732 of the Medicare Prescription Drug, Improvement, and Modernization
			 Act of 2003 (42 U.S.C. 1395w–4 note), section 104 of division B of the Tax
			 Relief and Health Care Act of 2006 (42 U.S.C. 1395w–4 note), section 104 of the
			 Medicare, Medicaid, and SCHIP Extension Act of 2007 (Public Law 110–173),
			 section 136 of the Medicare Improvements for Patients and Providers Act of 2008
			 (Public Law 110–275), section 3104 of the Patient Protection and Affordable
			 Care Act (Public Law 111–148), section 105 of the Medicare and Medicaid
			 Extenders Act of 2010 (Public Law 111–309), and section 305 of the Temporary
			 Payroll Tax Cut Continuation Act of 2011 (Public Law 112–78) is amended by
			 striking <quote>the first two months of</quote>.</text>
		</section><section id="H3A0D9EE9B9534411BBF44907B6BF04F3"><enum>16.</enum><header>Facilitating the
			 provision of telehealth services across State lines</header>
			<subsection id="HFBE592B039AA41A0AA21F1C9D3B55B8F"><enum>(a)</enum><header>In
			 general</header><text>For purposes of expediting the provision of telehealth
			 services, for which payment is made under the Medicare program, across State
			 lines, the Secretary of Health and Human Services shall, in consultation with
			 representatives of States, physicians, health care practitioners, and patient
			 advocates, encourage and facilitate the adoption of provisions allowing for
			 multistate practitioner practice across State lines.</text>
			</subsection><subsection id="H70FE9F4AE4C24703B0F16D40687B288A"><enum>(b)</enum><header>Definitions</header><text>In
			 subsection (a):</text>
				<paragraph id="H99A61C0D8D7D4E469AB25EA8E798BA60"><enum>(1)</enum><header>Telehealth
			 service</header><text>The term <term>telehealth service</term> has the meaning
			 given that term in subparagraph (F) of section 1834(m)(4) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395m(m)(4)).</text>
				</paragraph><paragraph id="H14EF43CD4FF9453AB78939870E504D21"><enum>(2)</enum><header>Physician,
			 practitioner</header><text>The terms <term>physician</term> and
			 <term>practitioner</term> have the meaning given those terms in subparagraphs
			 (D) and (E), respectively, of such section.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H98A6D9ACA27448C0BD309555F3730A9C"><enum>(3)</enum><header>Medicare
			 program</header><text>The term <term>Medicare program</term> means the program
			 of health insurance administered by the Secretary of Health and Human Services
			 under title XVIII of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (42 U.S.C. 1395 et seq.).</text>
				</paragraph></subsection></section><section id="H724A3DAA12D545999820F992AB628A98"><enum>17.</enum><header>Medicare Part A
			 payment for anesthesiologist services in certain rural hospitals based on CRNA
			 pass-through rules</header>
			<subsection id="HC1525B836A3F4932BB227C6015F772C3"><enum>(a)</enum><header>In
			 general</header><text>Section 1814 of the Social Security Act (42 U.S.C. 1395f)
			 is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HC44727B75FB840F6BA105D366647EE00" other-style="archaic" style="other">
					<subsection id="H36694269718B4F8CA0AE9DC67813BBD7"><enum>(m)</enum><header>Anesthesiologist services provided in certain rural
		  hospitals</header><paragraph commented="no" display-inline="yes-display-inline" id="H8A3CCB5C9B494F34BFEA1A0CFA7CE342"><enum>(1)</enum><text>Notwithstanding any
				other provision of this title, coverage and payment shall be provided under
				this part for physicians' services that are anesthesia services furnished by a
				physician who is an anesthesiologist in a rural hospital described in paragraph
				(3) in the same manner as payment is made under the exception provided in
				section 9320(k) of the Omnibus Budget Reconciliation Act of 1986, as added by
				section 608(c)(2) of the Family Support Act of 1988 and amended by section 6132
				of the Omnibus Budget Reconciliation Act of 1989, (relating to payment on a
				reasonable cost, pass-through basis) for certified registered nurse anesthetist
				services furnished by a certified registered nurse anesthetist in a hospital
				described in such section 9320(k).</text>
						</paragraph><paragraph id="H1692E6E39F1144CAA07FEBA9A8F5CA05" indent="up1"><enum>(2)</enum><text>No payment shall be made under any
				other provision of this title for physicians' services for which payment is
				made under this subsection.</text>
						</paragraph><paragraph id="H1B83666F6C4E4D0D860DFF75543DA48B" indent="up1"><enum>(3)</enum><text>A rural hospital described in this
				paragraph is a hospital described in section 9320(k) of the Omnibus Budget
				Reconciliation Act of 1986, as so added and amended, except that—</text>
							<subparagraph id="HE25B582A87F94551AA4D56FBE24DACA9"><enum>(A)</enum><text>any reference in such section to a
				<term>certified registered nurse anesthetist</term> or an
				<term>anesthetist</term> is deemed a reference to a <term>physician who is an
				anesthesiologist</term> or an <term>anesthesiologist</term>, respectively;
				and</text>
							</subparagraph><subparagraph id="HDB4B671322CD445A87221C3B103A6F07"><enum>(B)</enum><text>any reference to <term>January 1,
				1988</term> or <term>1987</term> is deemed a reference to such date and year as
				the Secretary shall
				specify.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7749435C865342169C8480C946E4FAC6"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to services
			 furnished during cost reporting periods beginning on or after the date of the
			 enactment of this Act.</text>
			</subsection></section><section id="H125AAE6A1E51459B980714E8B86B217A"><enum>18.</enum><header>Temporary floor
			 on the practice expense geographic index for services furnished in rural areas
			 outside of frontier States under the Medicare physician fee
			 schedule</header><text display-inline="no-display-inline">Section 1848(e)(1) of
			 the Social Security Act (42 U.S.C. 1395w–4(e)(1)) is amended—</text>
			<paragraph commented="no" id="H09D8D8B32AC4408A9F90545C440B9A26"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>and (I)</quote> and inserting <quote>(I), and
			 (J)</quote>; and</text>
			</paragraph><paragraph id="H183D81DCE57D47538C7851D0B7524991"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>
				<quoted-block id="H11165E5A4BDD440CB25FC1BD96B63432" style="OLC">
					<subparagraph id="H219BCB632CC34C10888CB8B56791B46C"><enum>(J)</enum><header>Floor at 1.0 on
				practice expense geographic index for services furnished in rural areas outside
				of frontier States</header><text>For purposes of payment for services furnished
				in a rural area (other than a rural area located in a State to which
				subparagraph (I) applies) on or after January 1, 2012, and before January 1,
				2013, after calculating the practice expense index under subparagraph (A)(i),
				the Secretary shall increase any such index to 1.0 if such index would
				otherwise be less than 1.0. The preceding sentence shall not be applied in a
				budget neutral manner.</text>
					</subparagraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
			</paragraph></section><section id="HBC7098E208F74027A2F983B4CBE5EE42"><enum>19.</enum><header>Revisions to
			 standard for designation of sole community hospitals</header><text display-inline="no-display-inline">Section 1886(d)(5)(D)(iv) of the Social
			 Security Act (42 U.S.C. 1395ww(d)(5)(D)(iv)) is amended by adding at the end
			 the following new sentence: <quote>Under such standard, the time required for
			 an individual to travel to the nearest alternative source of care shall be
			 measured over improved roads maintained by a local, State, or Federal
			 Government entity for use by the general public which is the most expeditious
			 and accessible route as designated by law enforcement for emergency vehicle
			 travel.</quote>.</text>
		</section><section id="HA2F7F6587D9C478ABC9A27B37F5D6E22"><enum>20.</enum><header>State offices of
			 rural health</header><text display-inline="no-display-inline">Section
			 338J(j)(1) of the Public Health Service Act (42 U.S.C. 254r(j)(1)) is amended
			 by inserting <quote>and 2012 through 2013</quote> before the period.</text>
		</section><section id="HE4066D016EAA49829667217104F71429"><enum>21.</enum><header>Ensuring
			 proportional representation of interests of rural areas on MEDPAC</header>
			<subsection id="HB0B8EAA3536E4AF5A3608F727F4F91E6"><enum>(a)</enum><header>In
			 general</header><text>Section 1805(c)(2) of the Social Security Act (42 U.S.C.
			 1395b–6(c)(2)) is amended—</text>
				<paragraph id="H9142A6B0F55D41B78CF5F2A8AB77D5D7"><enum>(1)</enum><text>in subparagraph
			 (A), by inserting <quote>(consistent with the requirements of subparagraph
			 (E))</quote> after <quote>rural representatives</quote>; and</text>
				</paragraph><paragraph id="H80E98EBD91BD421FBBDB5A01E521FB1E"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block id="H2653F036783A4657BDE2A9238926F438" style="OLC">
						<subparagraph id="H0642256FFC194A4D80BE905A600CAAB3"><enum>(E)</enum><header>Proportional
				representation of interests of rural areas</header><text>In order to provide a
				balance between urban and rural representatives under subparagraph (A), the
				proportion of members who represent the interests of health care providers and
				Medicare beneficiaries located in rural areas shall be no less than the
				proportion of the total number of Medicare beneficiaries who reside in rural
				areas.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H11DED3A8C01544C1912D1F327E02B88E"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall apply to
			 appointments made to the Medicare Payment Advisory Commission after the date of
			 the enactment of this Act.</text>
