		<official-title>To amend the S.A.F.E. Mortgage Licensing Act of 2008 to
		  provide an exception from the definition of loan originator for certain loans
		  made with respect to manufactured homes, to amend the Truth in Lending Act to
		  modify the definition of a high-cost mortgage, and for other
		  purposes.</official-title>

		<section id="H1A3B373004D14F599D6AE889BFBBC627" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Preserving Access to Manufactured Housing
			 Act</short-title></quote>.</text>
		</section><section id="H32B51F99524948BFBA3F8EF35C15D0B2"><enum>2.</enum><header>Modifications to
			 definitions</header>
			<subsection id="H8DE66A5388EA4E9393B5BFD785BD4175"><enum>(a)</enum><header>Loan originator
			 definition</header><text display-inline="yes-display-inline">Section 1503(4) of
			 the S.A.F.E. Mortgage Licensing Act of 2008 (12 U.S.C. 5102(4)) is
			 amended—</text>
				<paragraph id="H66A76C44B6554199AB8E1038BCD7EDB1"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
					<subparagraph id="HEB1A4B9D5AD8409B8A644EF3E7641A57"><enum>(A)</enum><text>in clause (iii),
			 by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="HB8325179228A49D9A5E204DC42CD2891"><enum>(B)</enum><text>in clause (iv), by
			 striking the period and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph id="H6081C04132624D4595A33CDF6D172908"><enum>(C)</enum><text>by adding at the
			 end the following new clause:</text>
						<quoted-block display-inline="no-display-inline" id="H08564A0B21D842E69AFA6DFD426718D5" style="OLC">
							<clause id="H5CF9242D3CB540E0B29BCADF4001F500"><enum>(v)</enum><text display-inline="yes-display-inline">does not include an individual or entity
				that is a seller of manufactured homes unless such individual or entity is
				engaged in the business of a loan originator or receives compensation or gain
				for engaging in activities described under clause (i) that is in excess of any
				compensation or gain received in a comparable cash
				transaction.</text>
							</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HAB170C54931A40D8BE7C590645AF3A01"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3B1DC185553F486D8A22179031F3A314" style="OLC">
						<subparagraph id="H988023BD877D4DFA9314DD7A245EB77E"><enum>(E)</enum><header>Engaged in the
				business of a loan originator</header><text display-inline="yes-display-inline">For purposes of this paragraph, the term
				<quote>engaged in the business of a loan originator</quote> means to perform
				loan originator activities described under subparagraph (A)(i) as a regular
				course of trade or business in exchange for compensation or gain paid solely
				for engaging in the sale or distribution of residential mortgage
				loans.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HB3A78BCBADAF49CC8BD4B0D98C61A542"><enum>(b)</enum><header>High-Cost
			 mortgage definition</header><text display-inline="yes-display-inline">Section
			 103(bb)(1)(A)(i) of the Truth in Lending Act (15 U.S.C. 1602(bb)(1)(A)(i)), as
			 added by section 1431 of the Dodd-Frank Wall Street Reform and Consumer
			 Protection Act, is amended—</text>
				<paragraph id="H2CC4F5F47E3F4600A2A648357B4E0E9E"><enum>(1)</enum><text>in subclause
			 (I)—</text>
					<subparagraph id="HDF50221835B7418FB6EAAF62AA78B561"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>(8.5 percentage points,
			 if the dwelling is personal property and the transaction is for less than
			 $50,000)</quote>; and</text>
					</subparagraph><subparagraph id="H8D8BE859883844378DCC15EC4626B1F5"><enum>(B)</enum><text>by striking
			 <quote>or</quote> at the end;</text>
					</subparagraph></paragraph><paragraph id="HB98AD3EB53A84F81ACA37019C8E7B5DE"><enum>(2)</enum><text>in subclause (II),
			 by adding <quote>or</quote> at the end; and</text>
				</paragraph><paragraph id="HDCF6A3C062F04A768B45383AF1A093B1"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H310D880BDAFF4844AF972A4F061B861F" style="OLC">
						<subclause id="HF4E3D2828F3945E5A0C01BE721091A30"><enum>(III)</enum><text display-inline="yes-display-inline">by a first mortgage on a consumer’s
				principal dwelling that is considered personal property (or is a consumer
				credit transaction that does not include the purchase of real property on which
				a dwelling is to be placed), the annual percentage rate at consummation of the
				transaction will exceed the average prime offer rate, as defined in section
				129C(b)(2)(B), for a comparable transaction, by more than—</text>
							<item id="HA992F8C49A4E4EBA9120E45D3B7A8FB0"><enum>(aa)</enum><text>8.5
				percentage points, in the case of a transaction in an amount of $50,000 or
				more, but less than $75,000 (as such amounts are adjusted by the Bureau to
				reflect the change in the Consumer Price index);</text>
							</item><item id="HB929A1438C1A4181980A33B677C576A4"><enum>(bb)</enum><text>10.5 percentage
				points, in the case of a transaction in an amount of $30,000 or more, but less
				than $50,000 (as such amounts are adjusted by the Bureau to reflect the change
				in the Consumer Price index); or</text>
							</item><item id="H02616D6C43F84292A4061582428C12AF"><enum>(cc)</enum><text>such percentage
				points, above those described under item (bb), as the Bureau shall prescribe,
				in the case of a transaction that is in an amount of $30,000 or less (as such
				amount is adjusted by the Bureau to reflect the change in the Consumer Price
				Index);</text>
							</item></subclause><after-quoted-block>.</after-quoted-block></quoted-block>
