			 transportation research</header><text>To carry out section 502 of title 23,
			 United States Code, $141,750,000 for each of fiscal years 2013 through
			 2016.</text>
				</paragraph><paragraph id="H8ADF00B8B031465DA2197AD1D0327A9F"><enum>(2)</enum><header>Technology
			 deployment program</header><text>To carry out section 503 of title 23, United
			 States Code, $60,750,000 for each of fiscal years 2013 through 2016.</text>
				</paragraph><paragraph id="H25943B3D5C9F4DF9A6D62C9BF7C0C33B"><enum>(3)</enum><header>Training and
			 education</header><text display-inline="yes-display-inline">To carry out
			 section 504 of title 23, United States Code, $25,500,000 for each of fiscal

			 carry out section 111 of title 49, United States Code, $27,000,000 for each of
			 fiscal years 2013 through 2016.</text>
				</paragraph></subsection><subsection id="HA1000AAA8D91467A85A64CEB58EDE71D"><enum>(b)</enum><header>Applicability of
			 title 23</header><text>Funds authorized to be appropriated by subsection (a)
			 shall—</text>
				<paragraph id="H6415A56363194ECB95ACD761C016B160"><enum>(1)</enum><text display-inline="yes-display-inline">be available for obligation in the same
			 manner as if those funds were apportioned under chapter 1 of title 23, United
			 States Code, except that the Federal share of the cost of a project or activity
			 carried out using those funds shall be 80 percent, unless otherwise expressly
			 provided by this Act (including the amendments made by this Act) or otherwise
			 determined by the Secretary;</text>
				</paragraph><paragraph id="H2B4AD5F618F9484DBE441C3D0AC486C6"><enum>(2)</enum><text>remain available
			 until expended; and</text>
				</paragraph><paragraph id="H3F842DC21FA64763A5C29FCDAF6CEEFB"><enum>(3)</enum><text>not be
			 transferable.</text>
				</paragraph></subsection><subsection id="H94B8EE0EFA31407389339045551849D6"><enum>(c)</enum><header>Obligation
			 ceiling</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of law, the total of all obligations from amounts made
			 available from the Highway Trust Fund by subsection (a) shall be $440,000,000
			 for each of fiscal years 2013 through 2016.</text>
			</subsection></section><section id="H819899BE7AD54BF2A6A8825815F58AF3"><enum>3.</enum><header>Surface
			 transportation research</header><text display-inline="no-display-inline">Section 502 of title 23, United States Code,
			 is amended—</text>
			<paragraph id="H49DFC4891ECF46F8B126FE2A10BBFC5D"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="HC3796FF1C6D041B19FCA48BEF20604A5"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
					<clause id="HEC42C1682ED34900BCEF6E6A6B73EE58"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>within the innovation
			 lifecycle</quote> after <quote>activities</quote>; and</text>
					</clause><clause id="HD31CED4B685B4BB2B090C0006E24BC92"><enum>(ii)</enum><text>by
			 inserting <quote>impact analysis,</quote> after
			 <quote>training,</quote>;</text>
					</clause></subparagraph><subparagraph id="H299164E5CF594F71845D35FD48ACA20B"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
					<clause id="H201BC5F4373945BE90E61789CBAC1A26"><enum>(i)</enum><text>in
			 subparagraph (B) by striking <quote>supports research in which there is</quote>
			 and insert <quote>delivers</quote>;</text>

			 subparagraph (C) by striking <quote>or</quote> after the semicolon;</text>

			 redesignating subparagraph (D) as subparagraph (F); and</text>
					</clause><clause id="H29516F31E45C4419BAC0B7FB3B3A7C0B"><enum>(iv)</enum><text>by
			 inserting after subparagraph (C) the following:</text>

							<subparagraph id="H7E0BC76972F5496E8BE9D96076DA145C"><enum>(D)</enum><text display-inline="yes-display-inline">presents the best means to align resources
				with multi-year plans and priorities;</text>
							</subparagraph><subparagraph id="HD7CE275B54A04C209AA8FEA9AAEB1A9F"><enum>(E)</enum><text>ensures the
				coordination of highway research and technology transfer activities, including
				through activities performed by university transportation centers;
				or</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</clause></subparagraph><subparagraph id="HC2D6AD3D9E954E54AC794EF4392F086D"><enum>(C)</enum><text>in paragraph (3)
			 by striking subparagraphs (B) through (D) and inserting the following:</text>

						<subparagraph id="HB372C1BB5CD44BC197BA233A3D786F17"><enum>(B)</enum><text display-inline="yes-display-inline">partner with State highway agencies and
				other stakeholders as appropriate, including international entities, to
				facilitate research and technology transfer activities;</text>
						</subparagraph><subparagraph id="HA89F0A0C096D43428D13B44DBE664B68"><enum>(C)</enum><text>communicate the
				results of ongoing and completed research;</text>
						</subparagraph><subparagraph id="H22C4F55E9C014C90A30D295ECD63073F"><enum>(D)</enum><text>lead efforts to
				coordinate national emphasis areas of highway research, technology, and
				innovation deployment; and</text>
						</subparagraph><subparagraph id="HA2D562C4348F4EC6A68D652E56071D5C"><enum>(E)</enum><text>leverage
				partnerships with industry, academia, and international
				entities.</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="H2675AA90A3E64ED0B387F4DAA3D94022"><enum>(D)</enum><text>in paragraph
			 (4)(C) by striking <quote>policy and planning</quote> and inserting <quote>all
			 highway objectives seeking to improve the performance of the transportation
			 system</quote>;</text>
				</subparagraph><subparagraph id="H7C4E462726C24428B2D9087D3F807EA5"><enum>(E)</enum><text>by striking
			 paragraph (7) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HB261B73AC5BA4B669C3CC1D87380666A" style="USC">
						<paragraph id="H1D0F1D39EB8C483B98961B990E6F92C6"><enum>(7)</enum><header>Performance
				review and evaluation</header>
							<subparagraph id="HDA86C18144744804BAF0A2E78FEA8864"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">To the maximum extent
				practicable, all surface transportation research and development projects shall
				include a component of performance measurement and evaluation.</text>
							</subparagraph><subparagraph id="HCEF12E124B644DE5A821AFFEB3282909"><enum>(B)</enum><header>Performance
				measures</header><text>Performance measures shall be established during the
				proposal stage of a research and development project and shall, to the maximum
				extent practicable, be outcome-based.</text>
							</subparagraph><subparagraph id="HF2F5D9E24B8D42489B59785A2B76B893"><enum>(C)</enum><header>Program
				plan</header><text>To the maximum extent practicable, each program pursued
				under this chapter shall be part of a data-driven, outcome-oriented program
				plan.</text>
							</subparagraph><subparagraph id="HB89B28850F3042DAA9D7ABD4208AEFB7"><enum>(D)</enum><header>Availability of
				evaluations</header><text>All evaluations under this paragraph shall be made
				readily available to the public.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="H10D34CCB460041429DD2CC901110F2A3"><enum>(F)</enum><text>in paragraph (8),
			 by striking <quote>surface</quote>;</text>
				</subparagraph></paragraph><paragraph id="HB48C632549AA4884BB95D30D671BF6AC"><enum>(2)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="H132BBB9703D948118186D98D3E0D2CA6"><enum>(A)</enum><text>by striking
			 paragraph (4) and inserting the following:</text>

				are consistent with the transportation research and development strategic plan

				</subparagraph><subparagraph id="H09D81025E6AE4359B3501E40A893B300"><enum>(B)</enum><text>in paragraph (6)
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H657D320BCE874287A28FC8C2511D1F11" style="USC">
						<subparagraph id="H6C8278A532364F0FBAE39EF7892433A1"><enum>(C)</enum><header>Transfer of
				amounts among States or to Federal Highway Administration</header><text display-inline="yes-display-inline">The Secretary may, at the request of a
				State, transfer amounts apportioned or allocated to that State under this
				chapter to another State or the Federal Highway Administration to fund
				research, development, and technology transfer activities of mutual interest on
				a pooled funds basis.</text>
						</subparagraph><subparagraph id="HDAA6126AEF4A4C9B93F6BD3316DD4C15"><enum>(D)</enum><header>Transfer of
				obligation authority</header><text display-inline="yes-display-inline">Obligation authority for amounts
				transferred under this subsection shall be disbursed in the same manner and for
				the same amount as provided for the project being
				transferred.</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph commented="no" id="HB570FF48DE1B4593AB60EE95C002E9A6"><enum>(3)</enum><text>in subsection
			 (c)(3)(A) by striking <quote>50</quote> and inserting <quote>80</quote>;</text>
			</paragraph><paragraph id="H13007F8436FE45A884CD7BA63A6DB68E"><enum>(4)</enum><text>by striking
			 subsection (d) and inserting the following:</text>

						<paragraph id="HD1334BC667114ABA9789EA18229D3A31"><enum>(1)</enum><header>Objectives</header><text display-inline="yes-display-inline">In carrying out the surface transportation
				research and development program, the Secretary, to address current and
				emerging highway transportation needs, shall—</text>
							<subparagraph id="HE5237446254F47FB8C82537D5B0C7363"><enum>(A)</enum><text display-inline="yes-display-inline">identify research topics;</text>
							</subparagraph><subparagraph id="HD56FEC2C9F4E438B88F6106C3C628C12"><enum>(B)</enum><text>coordinate
				research and development activities;</text>
							</subparagraph><subparagraph id="HCDF28A0FE2694E1893AB1C517039B32C"><enum>(C)</enum><text>carry out
				research, testing, and evaluation activities;</text>
							</subparagraph><subparagraph id="H842D1A3B9366483AB5ADBAAECE0BE342"><enum>(D)</enum><text>ensure program
				activities are coordinated with the transportation research and development
				strategic plan developed under section 508; and</text>
							</subparagraph><subparagraph id="H7C6F9F29FD9347FEAEEF376170A25D99"><enum>(E)</enum><text>provide technology
				transfer and technical assistance.</text>
							</subparagraph></paragraph><paragraph id="HFE26DAFC95F84827A796FE0DC14F91F1"><enum>(2)</enum><header>Contents</header>
							<subparagraph id="H4047461A79EC42579048C7FFD3044236"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Research and
				development activities carried out under this section may include any of the
				activities in this paragraph.</text>
							</subparagraph><subparagraph id="HFA0D203AC19340A6A7DB9E3924DBD3EC"><enum>(B)</enum><header>Improving
				highway safety</header>
								<clause id="H947875FA12C84D5187A6628C3BEB7FFF"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary may
				carry out research and development activities from an integrated perspective to
				establish and implement systematic measures to improve highway safety.</text>
								</clause><clause id="HD8B4C1E827E348F386389A3349C3BF0F"><enum>(ii)</enum><header>Objectives</header><text display-inline="yes-display-inline">In carrying out this subparagraph, the
				Secretary may carry out research and development activities—</text>
									<subclause id="H9902B782D72F41E6B2B59B7B7CC3FF17"><enum>(I)</enum><text>to achieve greater
				long-term safety gains;</text>
									</subclause><subclause id="HB79ADA54F2DF4E6F86C26E3B27DBC19A"><enum>(II)</enum><text display-inline="yes-display-inline">to reduce the number of fatalities and
				serious injuries on public roads;</text>
									</subclause><subclause id="H3D2D749A28BC4170A1AD76104F685168"><enum>(III)</enum><text display-inline="yes-display-inline">to fill knowledge gaps that limit the
				effectiveness of research;</text>
									</subclause><subclause id="H066202498BA042C989613A9813C20D38"><enum>(IV)</enum><text display-inline="yes-display-inline">to support the development and
				implementation of State strategic highway safety plans;</text>
									</subclause><subclause id="H58F85F4518254C50B5CEB8C6B43E3622"><enum>(V)</enum><text display-inline="yes-display-inline">to advance improvements in, and use of,
				performance prediction analysis for decisionmaking;</text>
									</subclause><subclause id="H1D51436594A9422EAADE0147900CB805"><enum>(VI)</enum><text display-inline="yes-display-inline">to expand technology transfer to partners
				and stakeholders; and</text>
									</subclause><subclause id="H9F74A5C595DE46E99417761D72786A93"><enum>(VII)</enum><text>to enhance rural
				highway safety.</text>
									</subclause></clause></subparagraph><subparagraph id="HEFDC99F5099A4304865EDBBA04A5791F"><enum>(C)</enum><header>Improving
				infrastructure integrity</header>
								<clause id="H0131747DCCF2437AA0C053877D5D9083"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary may
				carry out and facilitate highway infrastructure research and development
				activities—</text>
									<subclause id="H487E8063C140459F8E8068735EF8532D"><enum>(I)</enum><text>to maintain
				infrastructure integrity;</text>
									</subclause><subclause id="H3B7FD4680BBC4F68AA962CB6FCCA89A3"><enum>(II)</enum><text>to meet user
				needs; and</text>
									</subclause><subclause id="H9BC317DB21194F70B7BB6D79CC7BE673"><enum>(III)</enum><text display-inline="yes-display-inline">to link Federal transportation investments
				to improvements in system performance.</text>
									</subclause></clause><clause id="HD92DE3B01A3D42DCAB305AEF1C73C05A"><enum>(ii)</enum><header>Objectives</header><text display-inline="yes-display-inline">In carrying out this subparagraph, the
				Secretary may carry out research and development activities—</text>
									<subclause id="H63EA03EDC2F5416196E9940EDC4FA088"><enum>(I)</enum><text display-inline="yes-display-inline">to reduce the number of fatalities
				attributable to infrastructure design characteristics and work zones;</text>
									</subclause><subclause id="H7307AFF2A52C42C9AA435D6EC27EF0BA"><enum>(II)</enum><text>to improve the
				safety and security of highway infrastructure;</text>
									</subclause><subclause id="H4DB732F4AD534497A659EE4AB2E7EDC0"><enum>(III)</enum><text>to increase the
				reliability of lifecycle performance predictions used in infrastructure design,
				construction, and management;</text>
									</subclause><subclause id="HBDC96222E267455D874566139BA88ADC"><enum>(IV)</enum><text>to improve the
				ability of transportation agencies to deliver projects that meet expectations
				for timeliness, quality, and cost;</text>
									</subclause><subclause id="H2677DC91638546C89215AB1939334E6E"><enum>(V)</enum><text>to reduce user
				delay attributable to infrastructure system performance, maintenance,
				rehabilitation, and construction;</text>
									</subclause><subclause id="H4E76E3C99BE34A7BB83896207A7BA873"><enum>(VI)</enum><text>to improve
				highway infrastructure condition and performance through increased use of
				design, materials, construction, and maintenance innovations;</text>
									</subclause><subclause id="H2C4678D8EF9D4A2C86C755309C5EEFA8"><enum>(VII)</enum><text>to improve the
				resiliency of roadways to heavy freight traffic;</text>
									</subclause><subclause id="H197235125E5D4F98A8D881E699DE10B9"><enum>(VIII)</enum><text>to reduce
				environmental impacts of highway infrastructure through innovations in design,
				construction, operation, preservation, and maintenance; and</text>
									</subclause><subclause id="H665F855FA8804A04BC0823CFCFB3CEBB"><enum>(IX)</enum><text>to study
				vulnerabilities of the transportation system to seismic activities and extreme
				events and methods to reduce those vulnerabilities.</text>
									</subclause></clause></subparagraph><subparagraph id="H7D8E0734A97D48079A4CA09A7B3A16AD"><enum>(D)</enum><header>Reducing
				congestion, improving highway operations, and enhancing freight
				productivity</header>
								<clause id="H364812095B904D289FAC9DC53AD8C250"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary may
				carry out research under this subparagraph with the goals of—</text>
									<subclause id="H5AEBFA26F64746968D43DD7B72ABF26D"><enum>(I)</enum><text>addressing
				congestion problems;</text>
									</subclause><subclause id="HECF38BC814424EE2A6EFCA37C76CD9C1"><enum>(II)</enum><text>reducing the
				costs of congestion;</text>
									</subclause><subclause id="H91797E5BFFA548B780C243E1408BF2F7"><enum>(III)</enum><text>improving
				freight movement in both rural corridors and metropolitan areas;</text>
									</subclause><subclause id="H496FA54E9EBF473BB25649FACC3C80D1"><enum>(IV)</enum><text>increasing
				productivity; and</text>
									</subclause><subclause id="HE8F0E8C402034BEFB12E8C6CB73EAC51"><enum>(V)</enum><text>improving the
				economic competitiveness of the United States.</text>

				Secretary may carry out research and development activities to identify,
				develop, and assess innovations that have the potential—</text>
									<subclause id="H3DEB2ECF9D0644BA9B14500C18F40788"><enum>(I)</enum><text display-inline="yes-display-inline">to reduce traffic congestion;</text>
									</subclause><subclause id="H8D832B50571348B0B1C35907993D0AEA"><enum>(II)</enum><text display-inline="yes-display-inline">to improve freight movement in both rural
				corridors and metropolitan areas; and</text>
									</subclause><subclause id="H833E309FA83D4D6DAA62343A58926818"><enum>(III)</enum><text>to reduce
				freight-related congestion throughout the transportation network.</text>
									</subclause></clause></subparagraph><subparagraph id="H142F4300E46043A79D6C2ED7878CE5D9"><enum>(E)</enum><header>Assessing Policy
				and System Financing Alternatives</header><text display-inline="yes-display-inline">The Secretary may conduct policy analysis
				on emerging issues in the transportation community to provide information to
				policy-makers and
				decisionmakers.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HA8CA7DAD6DE5462A9D2A6BD0CF8F35AA"><enum>(5)</enum><text>by striking
			 subsection (e) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC0F714E8D6E24814AB10AD67E8358ADE" style="USC">
					<subsection id="H6BD22C1EC944461AA9E1303A26CE9E7C"><enum>(e)</enum><header>Exploratory
				advanced research</header>
						<paragraph id="H8AD2DC1E5B5C474A99BB56E32EA60EC9"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				establish an exploratory advanced research program, consistent with the
				transportation research and development strategic plan of the Secretary, that
				addresses longer-term, higher-risk research with potentially dramatic
				breakthroughs.</text>
						</paragraph><paragraph id="H087445425D5843608F0ABCECDC95306E"><enum>(2)</enum><header>Research
				areas</header><text display-inline="yes-display-inline">In carrying out the
				program, the Secretary may make grants and enter into cooperative agreements
				and contracts in such areas of surface transportation research and technology
				as the Secretary determines appropriate.</text>
						</paragraph><paragraph id="H027D283CADCE40AC82E53441A1188781"><enum>(3)</enum><header>Authorization</header><text>Of
				the amounts authorized in section 2(a)(1) of the
				<short-title>Driving Research through Innovative Viable
				Economic Solutions Act of 2012</short-title>, $14,000,000 for each of fiscal
				years 2013 through 2016 shall be available to carry out this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HEB3E4B64CEA14058B1021AE76B0F4BD5"><enum>(6)</enum><text>by striking
			 subsections (f), (g), and (j);</text>
			</paragraph><paragraph id="H0008D77E09B64620B8ADD1FF0D22F77D"><enum>(7)</enum><text>by redesignating

			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC9AB23367DAE47E7A9A849A1C641091C" style="USC">
					<subsection id="H7C01B01F80774A579FFC8030477CEDCB"><enum>(h)</enum><header>Prize
				competition</header><text display-inline="yes-display-inline">Consistent with
				section 24 of the Stevenson-Wydler Technology Innovation Act of 1980, the
				Secretary may carry out a program to award prizes competitively to stimulate
				innovation in the area of surface transportation that has the potential to
				advance the Federal Highway Administration’s research and technology objectives
				and activities under section 502.</text>
					</subsection><subsection id="H29EE103A2AF843F285446F931F3124D5"><enum>(i)</enum><header>Centers for
				Surface Transportation Excellence</header>
						<paragraph id="H477347E74C974B4AAD541C0B81239457"><enum>(1)</enum><header>Establishment</header><text>The
				Secretary may establish not more than 4 centers for surface transportation
				excellence.</text>
						</paragraph><paragraph id="H10E70114E22F4408B2CC9D71E11842C8"><enum>(2)</enum><header>Goals</header><text>The
				goals of the centers for surface transportation excellence are to promote and
				support strategic national surface transportation programs and activities
				relating to the work of State departments of transportation.</text>
						</paragraph><paragraph id="H674091D3D2254DF681745D4A170FE913"><enum>(3)</enum><header>Role of the
				centers</header><text>To achieve the goals set forth in paragraph (2), the
				Secretary shall establish centers that provide technical assistance,
				information sharing of best practices, and training in the use of tools and
				decisionmaking processes that can assist States in effectively implementing
				surface transportation programs, projects, and policies.</text>
						</paragraph><paragraph id="H69016043B49046C88C33CED98C17B6E8"><enum>(4)</enum><header>Program
				administration</header>
							<subparagraph id="HF950E1461E344C2D883FCEB109918F34"><enum>(A)</enum><header>Competition</header><text>A
				party entering into a contract, cooperative agreement, or other transaction
				with the Secretary under this subsection, or receiving a grant to perform
				research or provide technical assistance under this subsection, shall be
				selected on a competitive basis.</text>
							</subparagraph><subparagraph id="H8B668BFBD9194F499FB47CF6FF50F405"><enum>(B)</enum><header>Strategic
				plan</header><text>The Secretary shall require each center to develop a
				multiyear strategic plan, and submit the plan to the Secretary at such time as
				the Secretary requires, that describes—</text>
								<clause id="H43EBE668CD43411DB9A8C4053D323F1E"><enum>(i)</enum><text>the activities to
				be undertaken by the center; and</text>
								</clause><clause id="H796F02C22F914C3DBB317CFDDC6708E9"><enum>(ii)</enum><text>how the work of
				the center will be coordinated with the activities of the Federal Highway
				Administration and the various other research, development, and technology
				transfer activities authorized by this chapter.</text>
								</clause></subparagraph></paragraph><paragraph id="H5FD61A49B8F2440DBC8B04C5E6BD5AD0"><enum>(5)</enum><header>Funding</header><text>Of
				the amounts made available by section 2(a)(1) of the
				<short-title>Driving Research through Innovative Viable
				Economic Solutions Act of 2012</short-title>, not more than $3,000,000 for each
				of fiscal years 2013 through 2016 shall be available to carry out this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HDD0A2D91854D40FF84EBED4EAD427E35"><enum>4.</enum><header>Technology
			 deployment</header><text display-inline="no-display-inline">Section 503 of
			 title 23, United States Code, is amended—</text>
			<paragraph id="H22F4FEE7DDF4484C8C942512DBC44700"><enum>(1)</enum><text>by redesignating
			 subsection (e) as subsection (f); and</text>
			</paragraph><paragraph id="HDE14D00919494125B7C78EA13A97CE07"><enum>(2)</enum><text>by striking
			 subsections (a) through (d) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H8A48B6B7B1B7477E9F05678B65D83DD7" style="USC">
					<subsection id="H75554F5F998B4AA48CB849EAC55885DB"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				carry out a technology deployment program relating to all aspects of highway
				transportation with the goals of—</text>
						<paragraph id="H0CB406FF899844CC98B3CA01D77D4196"><enum>(1)</enum><text>significantly
				accelerating the adoption of innovative technologies by the surface
				transportation community;</text>
						</paragraph><paragraph id="HFBB3A2F3CB34490BB0DB5881ACE6C0D3"><enum>(2)</enum><text>providing
				leadership and incentives to demonstrate and promote state-of-the-art
				technologies, elevated performance standards, and new business practices in
				highway construction processes that result in improved safety, faster
				construction, reduced congestion from construction, and improved quality and
				user satisfaction;</text>
						</paragraph><paragraph display-inline="no-display-inline" id="H07B840F5FC4241E3A564EC6634B2A655"><enum>(3)</enum><text>constructing
				longer-lasting highways through the use of innovative technologies and
				practices that lead to faster construction of efficient and safe highways and
				bridges;</text>
						</paragraph><paragraph id="HAA7ADA80C9164B5AB04F440D7846AE0E"><enum>(4)</enum><text>improving highway
				efficiency, safety, mobility, reliability, service life, and environmental
				protection; and</text>
						</paragraph><paragraph id="H8E728C8AEF4D4DBEBFBDB610A720BC8B"><enum>(5)</enum><text>developing and
				deploying new tools, techniques, and practices to accelerate the adoption of
				innovation in all aspects of highway transportation.</text>
						</paragraph></subsection><subsection id="HF4F8901131F24E24AC0D5FA30E678D0B"><enum>(b)</enum><header>Implementation</header><text display-inline="yes-display-inline">The Secretary shall promote, facilitate,
				and carry out the program established under subsection (a) to distribute the
				products, technologies, tools, methods, or other findings that result from
				highway research and development activities, including research and development
				activities carried out under this chapter and subtitle C of title V of
				SAFETEA-LU.</text>
					</subsection><subsection id="H254529AC640440E4BCFB28EE14317549"><enum>(c)</enum><header>Accelerated
				innovation deployment</header><text>In carrying out the program established
				under subsection (a), the Secretary shall—</text>
						<paragraph id="H474792871C634663A1293EC52A575C5C"><enum>(1)</enum><text>establish and
				carry out demonstration programs;</text>
						</paragraph><paragraph id="H55EFA2F93775400A9540C5648D10EDB7"><enum>(2)</enum><text>provide
				incentives, technical assistance, and training to researchers and developers;
				and</text>
						</paragraph><paragraph id="H36F337A703424C56B968B192CAD3D092"><enum>(3)</enum><text>develop improved
				tools and methods to accelerate the adoption of proven innovative practices and
				technologies as standard practices.</text>
						</paragraph></subsection><subsection id="HF5D904A91D474237ACB71BE4DB9714B1"><enum>(d)</enum><header>Grants,
				cooperative agreements, and contracts</header>
						<paragraph id="H4B3ADD502DB24BEBB81078A0EB6EFD2E"><enum>(1)</enum><header>In
				General</header><text>Under the program, the Secretary may make grants to, and
				enter into cooperative agreements and contracts with, States, other Federal
				agencies, institutions of higher education, private sector entities, and
				nonprofit organizations to pay the Federal share of the cost of research,
				development, and deployment activities.</text>
						</paragraph><paragraph id="HD4E09CD8919A4E85871A5B88029104F8"><enum>(2)</enum><header>Applications</header><text>To
				receive a grant under this subsection, an entity described in paragraph (1)
				shall submit an application to the Secretary. The application shall be in such
				form and contain such information and assurances as the Secretary may
				require.</text>
						</paragraph><paragraph id="HADF2416CED2048E69B46DBCBE7E86E37"><enum>(3)</enum><header>Technology and
				information transfer</header><text>The Secretary shall ensure that the
				information and technology resulting from research conducted under this
				subsection is made available to State and local transportation departments and
				other interested parties as specified by the Secretary.</text>
						</paragraph></subsection><subsection commented="no" id="HFF98630AFB4043C28A3C6D677F29B4BB"><enum>(e)</enum><header>Implementation
				of future strategic highway research program findings and results</header>
						<paragraph commented="no" id="H3B4791A740294F9D83B90C5F1D563ACF"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary, in
				consultation with the American Association of State Highway and Transportation
				Officials and the Transportation Research Board of the National Academy of
				Sciences, shall, as appropriate, implement the findings and recommendations
				developed under the Strategic Highway Research Program 2 administered by the
				Transportation Research Board of the National Academy of Sciences.</text>
						</paragraph><paragraph commented="no" id="HC449C4C977834393A30AE3F49EFF7A0F"><enum>(2)</enum><header>Basis for
				findings</header><text>The activities carried out under this subsection shall
				be based on the Transportation Research Board Special Report 296 entitled
				<quote>Implementing the Results of the Second Strategic Highway Research
				Program: Saving Lives, Reducing Congestion, Improving Quality of
				Life</quote>.</text>
						</paragraph><paragraph commented="no" id="HB9F7D0C30567469EBAC26E718C857686"><enum>(3)</enum><header>Administrative
				costs</header><text>The Secretary may use 1 percent of the funds made available
				to carry out this subsection for the administrative costs under this
				subsection.</text>
						</paragraph><paragraph commented="no" id="HC8DA1FDD87F441A88278304809F16204"><enum>(4)</enum><header>Fees</header>
							<subparagraph commented="no" id="H990C297ADA5C456B9EC64F199E80E9EC"><enum>(A)</enum><header>In
				General</header><text>The Secretary may impose and collect fees to recover
				costs associated with special data or analysis requests relating to safety
				naturalistic driving databases developed under the future strategic highway
				research program.</text>
							</subparagraph><subparagraph commented="no" id="HC907DEA22DB14792A75C7F791C1A6B48"><enum>(B)</enum><header>Use of Fee
				Amounts</header>
								<clause commented="no" id="H4C5EC6668D0A40EF96086FD8F20698E3"><enum>(i)</enum><header>In
				General</header><text>Any fees collected under this paragraph shall be made
				available to the Secretary to carry out this subsection and shall remain
				available until expended.</text>
								</clause><clause commented="no" id="HAB47EC2F6CE640E28E5F7739C5D81B64"><enum>(ii)</enum><header>Supplement, Not
				Supplant</header><text>Any fee amounts collected under this paragraph shall
				supplement, but not supplant, amounts made available to the Secretary to carry
				out this
				section.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H108A66D9AED24F01AC9D39902BCDEB3A"><enum>5.</enum><header>Training and
			 education</header><text display-inline="no-display-inline">Section 504 of title
			 23, United States Code, is amended—</text>
			<paragraph id="H16E98F8DFDFC48F0A4C4CC124F6EC8EB"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="H9C05E34F087349579E3901DFD73C15C6"><enum>(A)</enum><text>in paragraph
			 (2)(A) by inserting <quote>and the employees of any other applicable Federal
			 agency</quote> after <quote>employees</quote>; and</text>
				</subparagraph><subparagraph id="HDEB13757361F40A9B9299A9C5D6EE533"><enum>(B)</enum><text>in paragraph
			 (3)(A)(ii)(V) by striking <quote>expediting</quote> and inserting
			 <quote>reducing the amount of time required for</quote>;</text>

				technical assistance center under paragraphs (1) and (2) shall be 50
				percent.</text>
							</clause><clause commented="no" id="HEA796B3087D243BEAB8FAA0FD4DA5726"><enum>(ii)</enum><header>Non-Federal
				share</header><text display-inline="yes-display-inline">Up to 100 percent of
				the non-Federal share of the cost of an activity described in clause (i) may
				consist of amounts provided to a recipient under subsection (e) or section
				505.</text>
							</clause></subparagraph><subparagraph commented="no" id="HD4709BD852EB49DAA7916E5CB2AB1606"><enum>(B)</enum><header>Tribal technical
				assistance centers</header><text display-inline="yes-display-inline">The
				Federal share of the cost of an activity carried out by a tribal technical
				assistance center under paragraph (2)(D)(ii) shall be 100
				percent.</text>
						</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HC5C0446F1C064FCEA729DAA9595EF7D5"><enum>(3)</enum><text>in subsection (c)

				known as the <quote>Dwight David Eisenhower Transportation Fellowship
				Program</quote>, for the purpose of attracting qualified students to the field
				of transportation.</text>
						</subparagraph><subparagraph id="HE2E451548A544096AC4174344D279254"><enum>(B)</enum><header>Use of
				amounts</header><text display-inline="yes-display-inline">Amounts provided to
				an institution of higher education to carry out this paragraph shall be used to
				provide direct support of student
				expenses.</text>
						</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H3CD6253B4B1A45BA95087A7DE5F2E7FC"><enum>(4)</enum><text>in subsection (d)

			</paragraph></section><section id="H234F649C2DD24DA5B0762B6DB84BB06A"><enum>6.</enum><header>Repeals</header><text display-inline="no-display-inline">Sections 506 and 507 of title 23, United
			 States Code, and the items relating to such sections in the analysis of chapter
			 55 of such title, are repealed.</text>
		</section><section id="H92E12F2BD2A94319B2919D54F4E2F723"><enum>7.</enum><header>Transportation
			 research and development strategic planning</header><text display-inline="no-display-inline">Section 508(a) of title 23, United States
			 Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H9A1C133BFCAD4297B9B4D390F933D66B" style="USC">
				<subsection id="H88A56A73655F46B6B1B7C6A53475D039"><enum>(a)</enum><header>In
				general</header>
					<paragraph id="H96DED12A1C3B4B0AB60002B7DE967CA2"><enum>(1)</enum><header>Development</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of the <short-title>Driving Research through
				Innovative Viable Economic Solutions Act of 2012</short-title>, the Secretary,
				acting through the Administrator of the Research and Innovative Technology
				Administration, shall develop a 5-year transportation research and development
				strategic plan to guide Federal transportation research and development
				activities. This plan shall be consistent with section 306 of title 5, sections
				1115 and 1116 of title 31, and any other research and development plan within
				the Department of Transportation.</text>
					</paragraph><paragraph id="HE875450DB7BC4AA19B9E2B7E155F172A"><enum>(2)</enum><header>Contents</header><text>The
				strategic plan developed under paragraph (1) shall describe the primary
				purposes of the transportation research and development program, which shall
				include, at a minimum—</text>
						<subparagraph id="HE78E646866E742D9AA920711F08820B3"><enum>(A)</enum><text>reducing
				congestion and improving mobility;</text>
						</subparagraph><subparagraph id="H81E4242F2D814022886E895291E38A62"><enum>(B)</enum><text display-inline="yes-display-inline">promoting safety in both rural corridors
				and metropolitan areas;</text>
						</subparagraph><subparagraph id="H76CEA1B8BC3A427AA551292FBEE70025"><enum>(C)</enum><text display-inline="yes-display-inline">improving goods movement in both rural
				corridors and metropolitan areas;</text>

				discretion</header><text>The Secretary may authorize exceptions to paragraph
				(1) for—</text>

				to achieve specific research objectives outlined in the national intelligent
				transportation system program plan or the surface transportation research and
				development strategic plan developed under section 508 of title 23, United
				States Code; or</text>
								</subparagraph><subparagraph id="HA898E0A1C936437994A48E842106D141"><enum>(B)</enum><text display-inline="yes-display-inline">the upgrade or expansion of an intelligent
				transportation system in existence on the date of enactment of this Act if the
				Secretary determines that the upgrade or expansion—</text>
									<clause id="H11453B9D0B4C4B1F97450E70E28E2D37"><enum>(i)</enum><text>would not
				adversely affect the goals or purposes of this subtitle;</text>
									</clause><clause id="H0EE0556555B9413CA476E546669D1717"><enum>(ii)</enum><text>is carried out
				before the end of the useful life of such system; and</text>
									</clause><clause id="HF5154A60907C46C9BCA36E4DEB793233"><enum>(iii)</enum><text>is
				cost-effective as compared to alternatives that would meet the conformity
				requirement of paragraph
				(1).</text>
									</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				Research Council review</header><text display-inline="yes-display-inline">The
				Secretary shall enter into an agreement with the National Research Council for
				the review by the National Research Council of the report described in
				subsection
				(a).</text>

				transportation problems and stimulate the deployment of new technology, the
				Administrator may carry out, on a cost-shared basis, collaborative research and
				development with—</text>
						<subparagraph id="HBCA7E497856944F5801BA1BFD9D61F78"><enum>(A)</enum><text>non-Federal
				entities, including State and local governments, foreign governments,
				institutions of higher education, corporations, institutions, partnerships,
				sole proprietorships, and trade associations that are incorporated or
				established under the laws of any State;</text>
						</subparagraph><subparagraph id="HBF894617A5884C50936EF6A544A9617E"><enum>(B)</enum><text>Federal
				laboratories; and</text>
						</subparagraph><subparagraph id="HBAC838FA524E4E06B00CA4E0FA42A510"><enum>(C)</enum><text>other Federal
				agencies.</text>
						</subparagraph></paragraph><paragraph id="H0984F62891F84451B1E0D9FA1BCFBB2B"><enum>(2)</enum><header>Cooperation,
				grants, contracts, and agreements</header><text>Notwithstanding any other
				provision of law, the Administrator may directly initiate contracts, grants,
				cooperative research and development agreements (as defined in section 12 of
				the Stevenson-Wydler Technology Innovation Act of 1980 (15 U.S.C. 3710a)), and
				other agreements to fund, and accept funds from, the Transportation Research
				Board of the National Research Council of the National Academy of Sciences,
				State departments of transportation, cities, counties, institutions of higher
				education, associations, and the agents of those entities to carry out joint
				transportation research and technology efforts.</text>
					</paragraph><paragraph id="HEEA0309717C94CB6B9268BDADA8D73D7"><enum>(3)</enum><header>Federal
				share</header>
						<subparagraph commented="no" id="H51ECAD297E9641DE90668951F461D6B7"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraph (B), the Federal share of the
				cost of an activity carried out under paragraph (2) shall not exceed 50
				percent.</text>
						</subparagraph><subparagraph id="H9C0D0FB695EF4F518E7D9E54CCD03BE6"><enum>(B)</enum><header>Exception</header><text>If
				the Secretary determines that the activity is of substantial public interest or
				benefit, the Secretary may approve a greater Federal share.</text>

				of 1980 (15 U.S.C. 3701 et

			 transportation centers</header>
			<subsection id="H9671A52F05A44ADDA1522544410A08DB"><enum>(a)</enum><header>Program</header><text display-inline="yes-display-inline">Section 5505 of title 49, United States
			 Code, is amended to read as follows:</text>

				and operation</header><text display-inline="yes-display-inline">The Secretary,
				acting through the Administrator of the Research and Innovative Technology
				Administration, shall make grants under sections 5506 and 5507 to institutions
				of higher education, including multiple institutions of higher education acting
				in consortia, to establish and operate university transportation centers to
				address the research topics identified under section 502(d) of title 23.</text>
							</paragraph><paragraph id="HAF81B9FED6FB4F63A945B86D6A8F7779"><enum>(2)</enum><header>Role of
				centers</header><text>The role of each university transportation center
				referred to in paragraph (1) shall be—</text>
								<subparagraph id="HF60D845C79A14EC9AE183E2530CF1626"><enum>(A)</enum><text>to advance
				significant transportation research on critical national transportation issues
				in the varied disciplines that comprise the field of transportation through
				research, education, and technology transfer activities;</text>
								</subparagraph><subparagraph id="H3CB74ABF13914BF29F46A29E296AF020"><enum>(B)</enum><text>to provide for a
				critical transportation knowledge base outside of the Department of
				Transportation; and</text>
								</subparagraph><subparagraph id="H26D28CFCA0614C8581B7C073F783BF30"><enum>(C)</enum><text>to address
				critical workforce needs and educate the next generation of transportation
				leaders.</text>
								</subparagraph></paragraph></subsection><subsection id="HD1088186F5644675B5CB356B3E546AF7"><enum>(b)</enum><header>Competitive
				selection process</header>
							<paragraph id="HBB9FE192D793476FB83D2D99581E07FE"><enum>(1)</enum><header>Applications</header><text>To
				receive a grant under either section 5506 or 5507, an institution of higher
				education, or a consortia thereof, shall submit to the Secretary an application
				that is in such form and contains such information and assurances as the
				Secretary may require.</text>
							</paragraph><paragraph id="H44DAB40657554C359D91BB93154F83C8"><enum>(2)</enum><header>Selection
				criteria</header><text display-inline="yes-display-inline">The Secretary shall
				select each recipient of a grant under section 5506 or 5507 through a
				competitive process based on the assessment of the Secretary relating
				to—</text>
								<subparagraph id="HE369AB94719F44B2B47D4D38D20DE196"><enum>(A)</enum><text>the demonstrated
				ability of the recipient to address each specific topic area described in the
				research and strategic plans of the recipient;</text>
								</subparagraph><subparagraph id="H8175921C7087405589D9869AC945A523"><enum>(B)</enum><text>the demonstrated
				research, education, and technology transfer resources available to the
				recipient to carry out this section;</text>
								</subparagraph><subparagraph id="HE2C75941BFB846788427AE8A9D18B030"><enum>(C)</enum><text>the ability of the
				recipient to provide leadership in solving long-range national and regional
				transportation problems;</text>
								</subparagraph><subparagraph id="H1841703402CA446D91767B4DB7F54659"><enum>(D)</enum><text>the ability of the
				recipient to carry out research, education, and technology transfer activities
				that are multimodal and multidisciplinary in scope;</text>
								</subparagraph><subparagraph id="H64EF9FFA89A14765BE9C3E4E1C2F4AB9"><enum>(E)</enum><text>the demonstrated
				ability of the recipient to disseminate results and spur the implementation of
				transportation research and education programs through national or statewide
				continuing education programs;</text>
								</subparagraph><subparagraph id="H130B78B40A8144F0824A0383D032D269"><enum>(F)</enum><text>the demonstrated
				commitment of the recipient to the use of peer review principles and other
				research best practices in the selection, management, and dissemination of
				research projects;</text>
								</subparagraph><subparagraph id="HC4EFBCF1FF784660AFA79E1548AF6B24"><enum>(G)</enum><text>the strategic plan
				submitted by the recipient describing the proposed research to be carried out
				by the recipient and the performance metrics to be used in assessing the
				performance of the recipient in meeting the stated research and technology
				transfer goals; and</text>
								</subparagraph><subparagraph commented="no" id="H0CDDF5A222AE4E9BAE5600D8FF58F5B9"><enum>(H)</enum><text>the ability of the
				recipient to implement the proposed program in a cost-efficient manner, such as
				through consortia-based approaches with cost sharing aimed at reducing
				overhead, facilities, and administrative costs.</text>
								</subparagraph></paragraph><paragraph commented="no" id="H3D24D419F7944B89A4D6840F5842D2A0"><enum>(3)</enum><header>Additional
				eligibility requirement</header><text display-inline="yes-display-inline">An
				institution of higher education that receives a grant for a fiscal year under
				either section 5506 or section 5507 or the lead institution of a consortia of
				institutions that receives a grant for a fiscal year under section 5506 or
				section 5507 is ineligible to receive an additional grant under either section
				in such fiscal year.</text>
							</paragraph></subsection><subsection id="H5E27C994E87B4975A7706E1861E63F13"><enum>(c)</enum><header>Non-Federal
				share</header>
							<paragraph id="HC67100F63A184E9F803CFE34A77BB026"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The non-Federal share
				of the costs of activities carried out using a grant made under this section
				shall be 35 percent of such costs.</text>
							</paragraph><paragraph commented="no" id="H822EB21024B9487C8BF598E1A2230C7A"><enum>(2)</enum><header>Source</header><text>The
				non-Federal share may include amounts made available to a recipient under
				section 504(b) or 505 of title 23.</text>

				coordination</header>

				general</header><text>The Secretary shall—</text>

				research, education, and technology transfer activities carried out by grant
				recipients under this section; and</text>

				results of that research through the establishment and operation of an
				information clearinghouse.</text>
								</subparagraph></paragraph><paragraph id="H9F451B7189884FCCA8D94BE5CCF6457A"><enum>(2)</enum><header>Annual review
				and evaluation</header><text>Not less frequently than annually, and consistent
				with the transportation research and development strategic plan developed under
				section 508, the Secretary shall review and evaluate the programs carried out
				under this section and sections 5506 and 5507 by grant recipients.</text>
							</paragraph><paragraph id="HAB5EE866D38D41418A9EFA6CCF3EDF78"><enum>(3)</enum><header>Program
				evaluation and oversight</header><text>For each of fiscal years 2013 through
				2016, the Secretary shall expend not more than 1<fraction>½</fraction> percent
				of the amounts made available to the Secretary under section 2(a)(4) of the
				<short-title>Driving Research through Innovative Viable
				Economic Solutions Act of 2012</short-title> for any coordination, evaluation,
				and oversight activities of the Secretary, including efforts to combat waste,
				fraud, and abuse, under this section, section 5506, and section 5507.</text>
							</paragraph></subsection><subsection id="HC329BEAB7DA0485DAA56BA191216CC36"><enum>(e)</enum><header>Limitation on
				availability of amounts</header><text>Amounts made available to the Secretary
				to carry out this section and sections 5506 and 5507 shall remain available for
				obligation by the Secretary for a period of 2 years after the last day of the
				fiscal year for which the amounts are appropriated.</text>
						</subsection><subsection display-inline="no-display-inline" id="H8439B97ECFFB4C408734C74FE8B6C239"><enum>(f)</enum><header>Institution of
				higher education defined</header><text>For purposes of this section and
				sections 5506 and 5507, the term <quote>institution of higher education</quote>
				has the meaning given such term in section 101 of the Higher Education Act of
				1965 (20 U.S.C.
				1001).</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB34D97EA4FCF4912B0E41E2427E7975C"><enum>(b)</enum><header>Regional
			 university transportation centers</header><text>Section 5506 of such title is
			 amended to read as follows:</text>

				years 2013 through 2016, the Secretary shall make grants to institutions of
				higher education, or a consortia thereof, to establish and operate 10 regional
				university transportation centers.</text>
						</subsection><subsection id="HCA17BA9E371D484097B5B167E22AF41C"><enum>(b)</enum><header>Location</header><text>The
				Secretary shall make a grant under subsection (a) to the institution, or the
				lead institution of a consortia, located in each of the 10 United States
				Government regions that comprise the Standard Federal Regional Boundary System
				that the Secretary determines best meets the criteria described in section
				5505(b).</text>
						</subsection><subsection id="HE14365181E5A4AC9A2775D270916165B"><enum>(c)</enum><header>Funding</header><text>For
				each of fiscal years 2013 through 2016, the Secretary may not award a grant
				under this section that exceeds
				$3,500,000.</text>

				years 2013 through 2016, the Secretary shall make grants to 20 institutions of
				higher education or consortia thereof that the Secretary determines best meet
				the criteria described in section 5505(b).</text>
						</subsection><subsection id="H34A6E6C78ED84DA890B8D90E404CBBB2"><enum>(b)</enum><header>Funding</header><text>For
				each of fiscal years 2013 through 2016, the Secretary may not award a grant
				under this section that exceeds

				connectivity, and condition of the transportation system, building on the
				national transportation atlas database developed under subsection (g);</text>
						</subparagraph><subparagraph id="HA274094B366A47889706FB6495D47D3E"><enum>(D)</enum><text>economic
				efficiency across the entire transportation sector;</text>
						</subparagraph><subparagraph id="H79D8D651E8404770B079717457189549"><enum>(E)</enum><text>the effects of the
				transportation system on global and domestic economic competitiveness;</text>
						</subparagraph><subparagraph id="H2DD15B6995DD4B42B82D01483EF8397E"><enum>(F)</enum><text>demographic,
				economic, and other variables influencing travel behavior, including choice of
				transportation mode and goods movement;</text>
						</subparagraph><subparagraph id="HCEE7F71D77944BE7B568CE8C1BB38DC9"><enum>(G)</enum><text>transportation-related
				variables that influence the domestic economy and global
				competitiveness;</text>
						</subparagraph><subparagraph id="H45B9A9F4793642309A9377E9B3C0E799"><enum>(H)</enum><text>economic costs and
				impacts for passenger travel and freight movement;</text>
						</subparagraph><subparagraph id="HBB68F7D9F0AC4C0BA8F35BEC196942A2"><enum>(I)</enum><text>intermodal and
				multimodal passenger movement; and</text>
						</subparagraph><subparagraph id="H1A6BD875AB274A3F9310D91A2A5BB61B"><enum>(J)</enum><text>consequences of
				transportation for the
				environment.</text>
						</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HE4B6D51F39C341F887939B2B461D2A28"><enum>(2)</enum><text>by striking
			 subsection (d) and inserting the following:</text>

				request and subject to any statutory or regulatory restrictions, to all such
				data held by any other Federal Government agency, that is germane to carrying
				out subsection

					</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HB94A41F252734FFEB6771F530152CA5A"><enum>(3)</enum><text>by striking
			 subsection (f) and inserting the following:</text>

					<subsection id="H70EBEA8AD5E74FAFB84C1769BA88CDFC"><enum>(f)</enum><header>National
				transportation library</header>
						<paragraph id="H803AE29E271745B88055BFECDC7A5F8B"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">To support the
				information management and decisionmaking needs of transportation officials at
				the Federal, State, and local levels, the Bureau of Transportation Statistics
				shall maintain a National Transportation Library that shall—</text>
							<subparagraph id="H95FAEC9F75B749E39721D4B148F43612"><enum>(A)</enum><text display-inline="yes-display-inline">be headed by an individual who is highly
				qualified in library and information science;</text>
							</subparagraph><subparagraph id="H4A8D425218EA4032B8584008477DD81C"><enum>(B)</enum><text>acquire, preserve,
				and manage transportation information and information products and services for
				use by the Department, other Federal agencies, and the general public;</text>
							</subparagraph><subparagraph id="H2464654F641845AAA49B52B042CA9835"><enum>(C)</enum><text>provide reference
				and research assistance;</text>
							</subparagraph><subparagraph id="H0EC78EE867AB47A3B9EC3CA54F6AF052"><enum>(D)</enum><text>serve as a central
				depository for research results and technical publications of the
				Department;</text>
							</subparagraph><subparagraph id="H36A5C40F4B2B4380AEED272C6E7DBAE1"><enum>(E)</enum><text>provide a central
				clearinghouse for transportation data and information of the Federal
				Government;</text>
							</subparagraph><subparagraph id="H145EBAA134C242F7AF2FF9A80305D619"><enum>(F)</enum><text>serve as
				coordinator and policy lead for transportation data and information of the
				Federal Government;</text>
							</subparagraph><subparagraph id="H42230BBD7BF44AE59775F6BA0A5AF153"><enum>(G)</enum><text>provide
				transportation information and information products and services to—</text>
								<clause id="H65D4DD5E23CB448CABC05943F4A80905"><enum>(i)</enum><text>the
				Department;</text>
								</clause><clause id="HA4AB79D184474B66AB35594D11FEC6C6"><enum>(ii)</enum><text>other Federal
				agencies;</text>
								</clause><clause id="HA9472554614240FF9498F6626E4FA989"><enum>(iii)</enum><text>public and
				private organizations; and</text>
								</clause><clause id="H980F01C5F4384F19AD49D9049645ACF4"><enum>(iv)</enum><text>individuals,
				within the United States as well as internationally;</text>
								</clause></subparagraph><subparagraph id="H170D564787CC4F2BB44BEFA861665038"><enum>(H)</enum><text>coordinate efforts
				among, and cooperate with, transportation libraries, information providers, and
				technical assistance centers, with the goal of developing a comprehensive
				transportation information and knowledge network that supports the activities
				described in subsection (c)(5); and</text>
							</subparagraph><subparagraph id="HC8289A5512F94AB69E15B9267DF54AC9"><enum>(I)</enum><text>engage in such
				other activities as the Director determines to be necessary and as the
				resources of the Library permit.</text>
							</subparagraph></paragraph><paragraph id="H9C09E9F7085D40B080B355004B53D036"><enum>(2)</enum><header>Access</header><text display-inline="yes-display-inline">The Director shall publicize, facilitate,
				and promote access to the products and services described in subsection (a),
				with the goal of improving the ability of the transportation community to share
				information and the ability of the Director to make statistics readily
				accessible under subsection (c)(9).</text>
						</paragraph><paragraph id="HAAB72DB16EC74094A004ACCC8010FB59"><enum>(3)</enum><header>Agreements</header>
							<subparagraph id="H32640D14F7A646ABB7EFAA1D952466F7"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">To carry out this
				subsection, the Director may enter into agreements with, provide grants to, and
				receive amounts from, any—</text>
								<clause id="H8F5C22368B6542E9B4A738E81ED7C8B2"><enum>(i)</enum><text>State or local
				government;</text>
								</clause><clause id="H7D12D9CE8E064DB09C2AD159D90EC4D7"><enum>(ii)</enum><text>organization;</text>
								</clause><clause id="H1C3BCCA0A5E44066A277EA619A66F9C9"><enum>(iii)</enum><text>business;
				or</text>
								</clause><clause id="H0ADF0A7E4AEC4E84A555796B6325A4D8"><enum>(iv)</enum><text>individual.</text>
								</clause></subparagraph><subparagraph id="H5E354F034BE14BD79E1DCF4CF7A1211F"><enum>(B)</enum><header>Contracts,
				grants, and agreements</header><text display-inline="yes-display-inline">The
				Library may initiate and support specific information and data management,
				access, and exchange activities relating to the strategic goals of the
				Department, knowledge networking, and national and international cooperation,
				by entering into contracts or other agreements or providing grants.</text>
							</subparagraph><subparagraph id="H3EAA976EF8C14D179F9249B0D3AE40C7"><enum>(C)</enum><header>Amounts</header><text display-inline="yes-display-inline">Any amounts received by the Library as
				payment for library products and services or other activities shall be made
				available to the Director to carry out this subsection and remain available
				until
				expended.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H219BE5FE48654A0CBC9FEB92CDE8133E"><enum>(4)</enum><text>by striking
			 subsection (m);</text>
			</paragraph><paragraph id="HB9D69FECE0CE4070962C193ADB2EFB29"><enum>(5)</enum><text>by redesignating
			 subsections (n) and (o) as subsections (m) and (n), respectively;</text>
			</paragraph><paragraph display-inline="no-display-inline" id="HDFA5E9890B1F448FAFF46EC7F465D979"><enum>(6)</enum><text>in subsection (m)
			 (as so redesignated) by striking <quote>(other than the Mass Transit

				appointed by the Director, who are not officers or employees of the United
				States. Members shall include representation of a cross-section of
				transportation community stakeholders and shall include individuals with
				expertise or knowledge of statistics, economics, transportation safety, or
				transportation data analysis, collection, or
				application.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HACF08E4021934CD68B863A3A1ED0A8F4"><enum>(8)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H885862A0AF024AA686411D3CD477181D" style="USC">
					<subsection id="H606F8819BC0B42FD83DB1F88A1AFD688"><enum>(o)</enum><header>Transportation
				statistical collection, analysis, and dissemination</header><text display-inline="yes-display-inline">To ensure that all transportation
				statistical collection, analysis, and dissemination is carried out in a
				coordinated manner, the Director may—</text>
						<paragraph id="HFCEBBD18C8FD4E5E8DC170C1D2776F08"><enum>(1)</enum><text display-inline="yes-display-inline">use the services, equipment, records,
				personnel, information, and facilities of other Federal agencies, or State,
				local, and private agencies and instrumentalities, subject to the conditions
				that the applicable agency or instrumentality consents to that use;</text>
						</paragraph><paragraph id="HCD634BDF855B4F9AAAA0E4E2A18F5DB4"><enum>(2)</enum><text>enter into
				agreements with the agencies and instrumentalities described in paragraph (1)
				for purposes of data collection and analysis;</text>
						</paragraph><paragraph id="HCFAA8FE8AAA44ED1B1E72FC834009EBE"><enum>(3)</enum><text>confer and
				cooperate with foreign governments, international organizations, and State,
				municipal, and other local agencies;</text>
						</paragraph><paragraph id="H88122F57F0E545E6AF9CABA41C543646"><enum>(4)</enum><text>request such
				information, data, and reports from any Federal agency as the Director
				determines necessary to carry out this section, including by entering into
				cooperative data sharing agreements in conformity with all laws and regulations
				applicable to the disclosure and use of data; and</text>
						</paragraph><paragraph id="H5F3B62F49DEA4C898CC3E1A8195419D5"><enum>(5)</enum><text>encourage
				replication, coordination, and sharing among transportation agencies regarding
				information systems, information policy, and data.</text>
						</paragraph></subsection><subsection commented="no" id="HD64EE2CF94FF4EAFA58C62E3A1A675B6"><enum>(p)</enum><header>Furnishing of
				information, data, or reports by Federal agencies</header><text display-inline="yes-display-inline">Except in a case in which the disclosure of
				information, data, or reports by a Federal agency is expressly prohibited by
				law, a Federal agency requested to furnish information, data, or reports under
				subsection (d) shall provide such information to the
				Bureau.</text>
