		  child care providers, family child care providers, and adults who reside in the
		  private residences of family child care providers in States that receive funds
		  from the Child Care and Development Block Grant Program, and for other

		<section id="HC57FA9DB1096456F95275B8912F5DB7E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Childcare Accountability and Responsibility Act of
			 2012</short-title></quote> or the <quote><short-title>CARE for Kids Act of
			 2012</short-title></quote>.</text>
		</section><section id="HB76C43B7D21241FA86A4DA8D750060ED"><enum>2.</enum><header>Requirement of a
			 criminal background check</header><text display-inline="no-display-inline">The
			 Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9858 et seq.) is
			 amended by inserting after section 658G the following new section:</text>
			<quoted-block display-inline="no-display-inline" id="H23CA7FE43ADB4F08B20198617D0CB41D" style="OLC">
				<section id="HF041B768E4784708894CC33A0F2E6F73"><enum>658H.</enum><header>Requirement of
				a criminal background check</header>
					<subsection id="HDB4DB8968FFD4FA58B6773E12B893FFA"><enum>(a)</enum><header>Criminal
				background check</header>
						<paragraph id="H2B53998D2F2D46CE9776912B89DF0648"><enum>(1)</enum><header>Requirement of a
				criminal background check</header><text display-inline="yes-display-inline">A
				State and national criminal background check for an individual who is a child
				care staff member, a family child care provider, or an adult who resides in the
				home of a family child care provider is required in any State that receives
				funds under this subchapter. The criminal background check of such individual
				shall include—</text>
							<subparagraph id="HD98DA8C3566848EE807949A841D3B3A1"><enum>(A)</enum><text>a search of the
				National Sex Offender Registry established pursuant to the Adam Walsh Child
				Protection and Safety Act of 2006 (42 U.S.C. 16901 et seq.);</text>
							</subparagraph><subparagraph id="HD78CB914DEAB4219A11E567C69CBC8D5"><enum>(B)</enum><text>a search of the
				National Crime Information Center;</text>
							</subparagraph><subparagraph id="HB06049A00D4145088B528819AF202D92"><enum>(C)</enum><text>a search of the
				State criminal registry or repository in the State in which the individual
				resides and each State where such individual previously resided;</text>
							</subparagraph><subparagraph id="H9418E8A8288A43D1B9098C3E976CFFA5"><enum>(D)</enum><text>a search of
				State-based abuse and neglect registries and databases, including the abuse and
				neglect registries and databases of each State where the individual previously
				resided; and</text>
							</subparagraph><subparagraph id="H84FBBF4F78C94C5DAA7E7FDE6CBD36A4"><enum>(E)</enum><text>a Federal Bureau
				of Investigation fingerprint check using the Integrated Automated Fingerprint
				Identification System.</text>
							</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H3CCEB18920074DF98C021595FC834217"><enum>(2)</enum><header>Ineligibility</header><text display-inline="yes-display-inline">A child care provider or family child care
				provider shall be ineligible for funds provided under this subchapter if a
				criminal background check of a child care staff member, a family child care
				provider, or an adult permitted to reside in such a family child care
				provider’s private residence reveals an adult felony conviction for—</text>
							<subparagraph id="HC5F24030AAC645EEB0495BDD591095C3"><enum>(A)</enum><text>child abuse or
				neglect;</text>
							</subparagraph><subparagraph id="HC6C73ADFD14443028C2799F9A718F1AD"><enum>(B)</enum><text>spousal
				abuse;</text>
							</subparagraph><subparagraph id="HBDA33186BE77484E8F35FE9C09F6A9E9"><enum>(C)</enum><text>a crime against
				children (including child pornography);</text>
							</subparagraph><subparagraph id="H322C8BB90AA244A8972F38B555C3AAF4"><enum>(D)</enum><text>a violent crime,
				including—</text>
								<clause id="H02B8CBB49E70458C8C2B0576E69F75A6"><enum>(i)</enum><text>physical assault
				or battery;</text>
								</clause><clause id="HC377C10C38C348A2BE19ECBA05870AED"><enum>(ii)</enum><text>rape;</text>
								</clause><clause id="HF8F146E0C8B1451EB2FBF2078669E42D"><enum>(iii)</enum><text>sexual assault;
				or</text>
								</clause><clause id="HAE538D2CA39540F9BC818D538C4ADE56"><enum>(iv)</enum><text>homicide;
				or</text>
								</clause></subparagraph><subparagraph id="HAA45928BEB944F1DAD3F14FF1F461E35"><enum>(E)</enum><text>distribution of,
				possession with intent to distribute, or importation of a controlled substance
				committed within 5 years prior to submission to a criminal background
				check.</text>
							</subparagraph></paragraph><paragraph id="HCB14B446381B4CEBB82B4753960687FB"><enum>(3)</enum><header>Submittal of
				requests</header><text display-inline="yes-display-inline">Subject to paragraph
				(4), a child care provider or a family child care provider shall submit a
				request for a State and national criminal background check to the appropriate
				State agency designated by the State—</text>
							<subparagraph id="HCF2E5F7EC0AF41F1B354BB6950E9D1BB"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to an individual who became a
				child care staff member or family child care provider, or an adult who began to
				reside in the private residence of such a provider, before the date of the
				enactment of the Child Care Accountability and Responsibility Act of
				2012—</text>
								<clause id="HEA72A52F04E1400CBEFE96559554EC2E"><enum>(i)</enum><text>not later than the
				date under subsection (b) in which a State implements the requirements of this
				section; and</text>
								</clause><clause id="H5F84307B2D57469290DB0C2924A4DC66"><enum>(ii)</enum><text>during each
				5-year period following the first submission date under this subparagraph for
				such staff member, family provider, or adult; and</text>
								</clause></subparagraph><subparagraph id="H42E2D2A9711F4841ACC5D54EEBF89EFC"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to an individual who is a
				prospective child care staff member or family child care provider, or an adult
				who begins to reside in the private residence of such a provider, on or after
				the date of the enactment of such Act—</text>
								<clause id="HBA75D916769C478CBA191F70ECE32B2E"><enum>(i)</enum><text>prior to the date
				the individual becomes a child care staff member, a family child care provider,
				or such adult begins to reside in such residence; and</text>
								</clause><clause id="H7C4400F651E7473A923A497C35A94721"><enum>(ii)</enum><text display-inline="yes-display-inline">during each 5-year period following the
				first submission date under this subparagraph for such staff member, family
				provider, or adult.</text>
								</clause></subparagraph></paragraph><paragraph id="H3EA020AE73334F1294122F4F94AA12D3"><enum>(4)</enum><header>Limitation on
				requests</header><text display-inline="yes-display-inline">Not more than 1
				request for a State and national criminal background check under paragraph (3)
				is required for any child care staff member, family child care provider, or
				adult who resides in the private residence of such provider, for each 5-year
				period described in such paragraph.</text>
						</paragraph><paragraph id="HEE87B27A69FC4D5D904651955AE9EF5C"><enum>(5)</enum><header>Results</header>
							<subparagraph id="HA89D6E83EE0A4208903791FB7B899E2A"><enum>(A)</enum><header>In
				general</header><text>Not later than 10 business days after the date on which a
				request under this section is made for a State and national criminal background
				check and is received by the appropriate State agency, such agency shall
				provide the results of the criminal background check to the individual or
				entity that made such a request.</text>
							</subparagraph><subparagraph id="HE891F404666A40F1A8C204968557BB6A"><enum>(B)</enum><header>Copy of
				background check</header><text display-inline="yes-display-inline">A State
				shall provide to a child care provider or an individual subject to a background
				check under this section, upon request, a copy of the criminal background check
				conducted pursuant to this section.</text>
							</subparagraph></paragraph><paragraph id="HF2E8CC51A416425F8AE07EED69E198EC"><enum>(6)</enum><header>Accuracy of
				information</header><text>A State shall reasonably attempt to insure that the
				information included in the background check conducted pursuant to this section
				is accurate and complete by—</text>
							<subparagraph id="HE14AB2CD705C443ABEF750AB2A40FBFA"><enum>(A)</enum><text>obtaining
				dispositions of arrests that occurred more than 1 year prior to the date that
				such background check was requested;</text>
							</subparagraph><subparagraph id="H277CC022C47B42E6A7F5F2DEF570FE5E"><enum>(B)</enum><text>correcting
				information included that it knows, or reasonably should know, is
				inaccurate;</text>
							</subparagraph><subparagraph id="HEF00FDC051494980A81260BEF11C716F"><enum>(C)</enum><text>completing
				incomplete entries, if possible; and</text>
							</subparagraph><subparagraph id="H840C18517A9C4B94B7001CC9348D7326"><enum>(D)</enum><text display-inline="yes-display-inline">taking any other steps that would improve
				upon the accuracy or such information.</text>
							</subparagraph></paragraph><paragraph id="HE7577B20D88545F6B41A76DAED0A6D43"><enum>(7)</enum><header>Appeals</header>
							<subparagraph id="HE487A8905F6748EC82A47E1A807572E7"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 30
				days after receipt of the results of a criminal background check conducted
				pursuant to this section, a child care provider or an individual subject to a
				background check under this section may appeal such results to the appropriate
				State agency designated by the State.</text>
							</subparagraph><subparagraph id="HE0719A50A00E4D069BB52E4415CAD8E2"><enum>(B)</enum><header>Final ruling by
				a State</header><text>Not later than 30 days after an appeal is made under
				subparagraph (A), a State shall—</text>
								<clause id="H243938C84C524B3EA737B32AE551E062"><enum>(i)</enum><text>make a
				determination on the eligibility or ineligibility of the individual;</text>
								</clause><clause id="H92D3752795F9431FB43635853F4C7BF2"><enum>(ii)</enum><text>provide the
				individual with specific findings with respect to the appeal;</text>
								</clause><clause id="HC0DB10AFB0794C5CBE8BA5AA88C2C2BE"><enum>(iii)</enum><text>if possible,
				promptly make any changes to the individual’s criminal record, if any
				information was inaccurate or incomplete; and</text>
								</clause><clause id="H7B65DBC20B54441B8CA86CBBA0078364"><enum>(iv)</enum><text>report those
				changes to the individual who requested such appeal.</text>
								</clause></subparagraph></paragraph><paragraph id="HD3688DD4F75C42ECA3AB0F5526E110E1"><enum>(8)</enum><header>Fees</header><text display-inline="yes-display-inline">To defray the costs of carrying out the
				duties described in this subsection, a State may collect one fee per criminal
				background check from a child care provider or family child care provider in an
				amount not to exceed the actual costs to the State for the administration of
				all required criminal background checks, and such fee for all required criminal
				background checks may not exceed a total of $36.</text>
						</paragraph></subsection><subsection id="HE2AFDD4C94C9452697088E6643DB278E"><enum>(b)</enum><header>State
				Compliance</header>
						<paragraph id="HD7C176726EFE4E69AA0111C3A229AD60"><enum>(1)</enum><header>Time
				limitation</header><text display-inline="yes-display-inline">A State shall
				implement the requirements of this section not later than 3 years after the
				date of the enactment of the Childcare Accountability and Responsibility Act of
				2012.</text>
						</paragraph><paragraph id="H4CB3AA5B80654E69A76DCADDCD6C8F2E"><enum>(2)</enum><header>Extension of
				time</header><text display-inline="yes-display-inline">The Secretary may grant
				an extension to the date described in paragraph (1), not longer than 2 years,
				to a State that makes a good faith effort to satisfy the requirements of this
				section.</text>
						</paragraph></subsection><subsection display-inline="no-display-inline" id="H8F5A55127459465B8326699FF561FDFE"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
						<paragraph id="HE8342C1B72BC43668179A8DE83BDCB31"><enum>(1)</enum><header>Adult</header><text display-inline="yes-display-inline">The term <term>adult</term> means a person
				who has attained 18 years of age.</text>
						</paragraph><paragraph id="HB24033326FB64F838C3007450B114CA5"><enum>(2)</enum><header>Child care
				provider</header><text>The term <term>child care provider</term> means a
				center-based child care provider, a group home child care provider, or other
				provider of child care services for compensation and on a regular basis (other
				than a family child care provider) that—</text>
							<subparagraph id="H6AB8337EB82C429C84AC2D7181870B28"><enum>(A)</enum><text>is not an
				individual who is related to all children for whom child care services are
				provided; and</text>
							</subparagraph><subparagraph id="H9292269EB1EB4725AE0E0E608C22B385"><enum>(B)</enum><text>is licensed,
				regulated, or registered under State law or receives funds provided under this
				subchapter.</text>
							</subparagraph></paragraph><paragraph id="HAEBEA2A7359F45FAB4FF09C5583DB6E4"><enum>(3)</enum><header>Child care staff
				member</header><text>The term <term>child care staff member</term> means an
				individual that provides child care services for compensation and on a regular
				basis (other than an individual who is related to the child or children for
				whom services are provided), regardless of whether the services are provided
				for a child care provider or a family child care provider.</text>
						</paragraph><paragraph id="HC6C3433F32FD474C8203AD9DBFD9C1A2"><enum>(4)</enum><header>Family child
				care provider</header><text>The term <term>family child care provider</term>
				means one individual who—</text>
							<subparagraph id="HA0CF21F15A1C4CD7AE1F09651AAB462A"><enum>(A)</enum><text>provides child
				care services for fewer than 24 hours per day, as the sole caregiver, in a
				private residence;</text>
							</subparagraph><subparagraph id="HD9710693697C44D997C209A698805A59"><enum>(B)</enum><text>is not an
				individual who is related to all children for whom child care services are
				provided; and</text>
							</subparagraph><subparagraph id="H05391418BE0E4FBEB5D8CD6B3F632BAF"><enum>(C)</enum><text>is licensed,
				regulated, or registered under State law or receives funds provided under this
				subchapter.</text>
							</subparagraph></paragraph></subsection><subsection id="H75E092AB8ADC4675A55FCF8D7D0F146A"><enum>(d)</enum><header>Authorization of
				appropriations To conduct criminal background checks</header><text>There are
				authorized to be appropriated such sums as necessary to offset the
				administrative costs to conduct State and national criminal background checks
				under this section.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
