		<section id="H6476B5193B134C9BABAC76DBEE960274" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>After School for America’s Children
			 Act of 2012</short-title></quote>.</text>
		</section><section id="HC202C743DA514AA4AD8FFAC61C877254"><enum>2.</enum><header>Purpose;
			 definitions</header><text display-inline="no-display-inline">Section 4201 of
			 the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7171) is
			 amended—</text>
			<paragraph id="H5368D019BEB3476F97CD3AC1CBB8B600"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="HEE8550F9D9E14553BC7B55CFD46E2907"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>, such as reading and mathematics</quote>;</text>
				</subparagraph><subparagraph id="H57C963868C864542B5D1AD0A82197BC6"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
					<clause id="HD236330BAD054E45887F4A0C59AD0F9D"><enum>(i)</enum><text>by
			 inserting <quote>service learning, nutrition and health education,</quote>
			 before <quote>drug and</quote>;</text>
					</clause><clause id="H8082EC98EB7243AF91C382CAD38ECD0A"><enum>(ii)</enum><text>by
			 striking <quote>and character education programs,</quote> and inserting
			 <quote>social and emotional learning programming, character education programs,
			 and physical fitness and wellness programs,</quote>; and</text>
					</clause></subparagraph><subparagraph id="HD9B5E3053A6D4F3398FB547850BB37D6"><enum>(C)</enum><text>by striking
			 paragraph (3) and inserting the following:</text>
					<quoted-block id="H7F455BCDA4114AC0A4EE3EE2764D4E91" style="OLC">
						<paragraph id="H5FD1B0EAD59F4D46A7DDE710E1D379E6"><enum>(3)</enum><text>offer families of
				students served by community learning centers opportunities for active and
				meaningful engagement in their children’s education, including opportunities
				for literacy and related educational
				development.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H4A3C1E35821B4B289CD390F3627F16AE"><enum>(2)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="HDBB329586D8145749F914DA652E2700F"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
					<clause id="H4C86A148153F4487BCEB8739BABECB1D"><enum>(i)</enum><text>by
			 striking subparagraph (A) and inserting the following:</text>
						<quoted-block id="H66E799D31CE94878932DC9652E6F0F57" style="OLC">
							<subparagraph id="H48EFC85A0BF64E81B7BB93FB46760D79"><enum>(A)</enum><text>assists students
				in meeting State and local academic achievement standards in core academic
				subjects by providing the students with academic and enrichment activities and
				a broad array of other activities (such as drug and violence prevention,
				physical education, wellness education, art, music, counseling, and technology
				programs) during nonschool hours or periods when school is not in session (such
				as before or after school or during summer recess) that—</text>
								<clause id="H92D7BB67C2084B17A2F3DD88EC162E5E"><enum>(i)</enum><text>reinforce and
				complement the regular academic programs of the schools attended by the
				students served; and</text>
								</clause><clause id="H91016CC3686F4040BF62BE58677A0C27"><enum>(ii)</enum><text>are targeted to
				the students’ academic needs and aligned with the instruction students receive
				during the school day; and</text>
								</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</clause><clause id="H1510C3B416C24AAEAC33FC4BB8F405AC"><enum>(ii)</enum><text>in
			 subparagraph (B), by inserting <quote>and opportunities for active and
			 meaningful engagement in their children’s education</quote> before the period
			 at the end;</text>
					</clause></subparagraph><subparagraph id="H22BA327A519146B19EFFA18E8686BE8E"><enum>(B)</enum><text>by redesignating
			 paragraph (4) as paragraph (7); and</text>
				</subparagraph><subparagraph id="H3D6963D18BBB448F8A50E20B1146F978"><enum>(C)</enum><text>be redesignating
			 paragraphs (2) and (3) as paragraphs (4) and (5), respectively;</text>
				</subparagraph><subparagraph id="H2FD3067CF0B34BFFB73652AEBE2056C0"><enum>(D)</enum><text>by inserting after
			 paragraph (1) the following:</text>
					<quoted-block id="HC441D06A35D64A6996637505BCDDA96A" style="OLC">
						<paragraph id="HB5562D7DEDE74B65880AE3AC20E6FA8A"><enum>(2)</enum><header>Social and
				emotional learning</header><text>The term <quote>social and emotional
				learning</quote> means the process through which children and adults acquire
				the knowledge, attitudes, and skills associated with the core areas of social
				and emotional competency including—</text>
							<subparagraph id="H6EEB05FF80FA4C3089015922426143EF"><enum>(A)</enum><text>self-awareness and
				self management to achieve school and life success, such as identifying and
				recognizing strengths, needs, emotions, values and self-efficacy, impulse
				control and stress management, self-motivation and discipline, and goal setting
				and organization skills;</text>
							</subparagraph><subparagraph id="HBD8DF3214E3E48C881FC357A982B4ED8"><enum>(B)</enum><text>social awareness
				and interpersonal skills to establish and maintain positive relationships, such
				as perspective taking and respect for others, communication, working
				cooperatively, negotiation, conflict management, and help-seeking; and</text>
							</subparagraph><subparagraph id="HE243E7F3788A414DAEC97C8A59F8907E"><enum>(C)</enum><text>decision-making
				skills and responsible behaviors in personal, academic and community contexts,
				such as situational analysis, problem solving, reflection, and social and
				ethical responsibility.</text>
							</subparagraph></paragraph><paragraph id="H68D25DD6368E456CAF4D48E398B41B34"><enum>(3)</enum><header>Social and
				emotional learning programming</header><text>The term <quote>social and
				emotional learning programming</quote> refers to classroom instruction and
				schoolwide activities and initiatives that—</text>
							<subparagraph id="H9B479BCFBCAE48D09A886FF91514AAE0"><enum>(A)</enum><text>integrate social
				and emotional learning into school curriculum;</text>
							</subparagraph><subparagraph id="H6FF78361971D48069B0132283CA55BC4"><enum>(B)</enum><text>provide systematic
				instruction whereby social and emotional skills are taught, modeled, practiced,
				and applied so that students use them as part of their daily behavior;</text>
							</subparagraph><subparagraph id="H8CD8D9B258CC4C1B8158FD35B5A8E4F6"><enum>(C)</enum><text>teach children to
				apply social and emotional skills to prevent specific problem behaviors such as
				substance use, violence, bullying, and school failure, and to promote positive
				behaviors in class, school, and community activities; and</text>
							</subparagraph><subparagraph id="H2ABF4C81C9FB42ADB59E4577A8E3945A"><enum>(D)</enum><text>establish safe and
				caring learning environments that foster student participation, engagement, and
				connection to learning and
				school.</text>
							</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="H0B1E9B0D8F6744B0AE7A7E73718104F3"><enum>(E)</enum><text>in paragraph (5)
			 (as so redesignated), by inserting <quote>Indian tribe or tribal organization
			 (as such terms are defined in section 4 of the Indian Self-Determination and
			 Education Act (25 U.S.C. 450b)),</quote> after <quote>community-based
			 organization,</quote>; and</text>
				</subparagraph><subparagraph id="HD6DC2EEA374C4508AB2FCD8D90EA5B14"><enum>(F)</enum><text>by inserting after
			 paragraph (5) the following:</text>
					<quoted-block id="H67D03E24ED2642E58B713E255F6E39D4" style="OLC">
						<paragraph id="H4084F23B98524F5B911671E27F25DDA7"><enum>(6)</enum><header>External
				organizations</header><text>The term <quote>external organization</quote> means
				a nonprofit organization with a record of success in running or working with
				after school
				programs.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="H1BCE06C162DA4443A9B2E5FF260519C2"><enum>3.</enum><header>Allotments to
			 States</header><text display-inline="no-display-inline">Section 4202(c) of such
			 Act (20 U.S.C. 7172(c)) is amended—</text>
			<paragraph id="H43BCCAA297204CDCB7EE8A0A22243B34"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>95 percent</quote> and inserting <quote>93
			 percent</quote>;</text>
			</paragraph><paragraph id="H1BBCA49EF3CB47879AC5EC2CA7BD9996"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
				<subparagraph id="HE71DE38E34A24012A8B2587A49E73300"><enum>(A)</enum><text>in subparagraph
			 (B), by inserting <quote>rigorous</quote> before <quote>peer review</quote>;
			 and</text>
				</subparagraph><subparagraph id="HE1A5A04EFA864FCFB8980112407280FF"><enum>(B)</enum><text>by striking
			 <quote>supervising the</quote> and inserting the following:</text>

				<subparagraph id="H3575DDCC126643DAA5F575529E9488F6"><enum>(A)</enum><text>in the matter
			 preceding subparagraph (A), by striking <quote>3 percent</quote> and inserting
			 <quote>5 percent</quote>; and</text>
				</subparagraph><subparagraph id="HBC2A9BE57A9B48F8B884864C9F0F20C0"><enum>(B)</enum><text>by adding at the
			 end the following:</text>

				eligible entity that receives an award under this part from the State aligns
				the activities provided by the afterschool program with State academic
				standards.</text>
						</subparagraph><subparagraph id="H0F60F17D878F4D95B8ECE0178676B2A2"><enum>(F)</enum><text>Ensuring that any
				such eligible entity identifies and partners with external organizations, if
				available, in the community.</text>
						</subparagraph><subparagraph id="H12E2BA5983C14D9583B0300A463D0317"><enum>(G)</enum><text>Working with
				teachers, principals, parents, and other stakeholders to review and improve
				State policies and practices to support the implementation of effective
				programs.</text>
						</subparagraph><subparagraph id="H1C14E08CB6EC4A01987B30AD1C7F889D"><enum>(H)</enum><text>Coordinating funds
				received under this program with other Federal and State funds to implement
				high-quality programs.</text>
						</subparagraph><subparagraph id="H68335FFAE6E6446EB64857C9714425E4"><enum>(I)</enum><text>Providing a list
				of prescreened external organizations, as described in section
				4203(a)(12).</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="H36FA082060364416AC53006B2123E47A"><enum>4.</enum><header>State
			 application</header>
			<subsection id="HACBDCB7B5A064EEB823D71096D49CF78"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 4203(a) of
			 such Act (20 U.S.C. 7173(a)) is amended—</text>
				<paragraph id="H24F8C9FB4D3C46D490B47FAACD587B7E"><enum>(1)</enum><text>in paragraph (6),
			 by inserting <quote>and coordinating professional development for staff in
			 specific content areas as well as youth development</quote> before the
			 semicolon at the end;</text>
				</paragraph><paragraph id="H5EA01DE68E704D60B7854B990929C7EF"><enum>(2)</enum><text>in paragraph
			 (11)—</text>
					<subparagraph commented="no" id="HA4E4682A0161459489F244AF50FFF029"><enum>(A)</enum><text>by striking
			 <quote>provides an assurance</quote> and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H0D84FB4F2F584214996EC2F99207DEBF" style="OLC">

			 networks (where applicable), representatives of teachers, local educational
			 agencies, and community-based organizations; and</quote>; and</text>
					</subparagraph><subparagraph id="HE3DAFCB582FF4295B3EC04968C90B4BE"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H088743A1F1E14EB1BD5EB663223FB8BF" style="OLC">
							<subparagraph id="H53C428A7665D4628BCCC0FF0FA870388"><enum>(B)</enum><text>a description of
				any other representatives of teachers, parents, students, or the business
				community that the State has selected to assist in the development of the
				application, if
				applicable;</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HD39B5AB35BF442BDB95A60CF942BAA7F"><enum>(3)</enum><text>by redesignating
			 paragraphs (13) and (14) as paragraphs (14) and (15), respectively;</text>
				</paragraph><paragraph id="HD2FADCAE61044041A6E423119908B09E"><enum>(4)</enum><text>by inserting after
			 paragraph (12) the following:</text>
					<quoted-block id="HE2FFA492365F471180E7CEB77663209F" style="OLC">
						<paragraph id="HD1C8F37213CA44BEBBEF27736A081F20"><enum>(13)</enum><text>describes how the
				State will prescreen external organizations that could provide assistance in
				carrying out the activities under this section, and develop and make available
				to eligible entities a list of external organizations that successfully
				completed the prescreening process; and</text>

				</paragraph><paragraph id="H22172237A62F477591F2360B2BF88505"><enum>(5)</enum><text>in paragraph (14)
			 (as redesignated by paragraph (3))—</text>
					<subparagraph id="H4D10A1E609104B98862BE94145165E5D"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>activities; and</quote> at the end and insert the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="H488D09DAFF7B494F98FB080564220D50" style="OLC">
							<quoted-block-continuation-text quoted-block-continuation-text-level="subparagraph">activities, with emphasis on
				alignment with the regular academic program of the school and the academic
				needs of participating students, including performance indicators and measures

				student success and improvement over time; and</text>
							</clause><clause id="HF6410CAE13184372A3393018152FE0DC"><enum>(ii)</enum><text>include State
				assessment results and other indicators of students success and improvement,
				such as improved attendance during the school day, better classroom grades,
				regular (or consistent) program attendance, and on-time advancement to the next
				grade
				level;</text>
							</clause><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HA1A5EEF4912C4793B5E148806874364D"><enum>(B)</enum><text>by redesignating
			 subparagraph (B) as subparagraph (C); and</text>
					</subparagraph><subparagraph id="H8AB28F43F1C5434DB2B9FC3D04EAA54F"><enum>(C)</enum><text>by inserting after
			 subparagraph (A) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H2670A7E345E9455D85984C60DF494280" style="OLC">
							<subparagraph id="H6A357F8776734833B941A72E4ADECD88"><enum>(B)</enum><text display-inline="yes-display-inline">a description of how data collected for the
				purposes of subparagraph (A) will be collected;
				and</text>

					</subparagraph></paragraph></subsection><subsection commented="no" id="H7CFA2952500F42DFB692637FAEC2605B"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">Section 4203 of such Act (20 U.S.C. 7173)
			 is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HE031FD9077454645AADECFD3F51AB3B3" style="OLC">
					<subsection commented="no" id="H081584E69B054AB09F6ED55989BB1122"><enum>(g)</enum><header>Limitation</header><text>The
				Secretary may not impose a priority or preference for eligibility for, or
				applications by, States or eligible entities that seek to use funds made
				available under this part to extend the regular school
				day.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HD4F95CA637F74297B5E26F007D7CD69A"><enum>5.</enum><header>Local competitive
			 grant program</header><text display-inline="no-display-inline">Section 4204 of
			 such Act (20 U.S.C. 7174) is amended—</text>
			<paragraph id="H078190183AB54BC983136D0D07430D73"><enum>(1)</enum><text>in subsections
			 (b), (c), (d), (g), (h), and (i), by striking <quote>under this part</quote>
			 each place the term appears and inserting <quote>under this section</quote>;
			 and</text>
			</paragraph><paragraph id="H26662F66E0DD403593E4E618650EA5E5"><enum>(2)</enum><text>in subsection
			 (b)(2)—</text>
				<subparagraph id="H45BFB7860FEC4891A5920144467A8AF4"><enum>(A)</enum><text>in subparagraph
			 (A)(ii), by inserting <quote>, if applicable</quote> after
			 <quote>home</quote>;</text>
				</subparagraph><subparagraph id="H21D6336FEC204E2FB16B3DC03850147A"><enum>(B)</enum><text>in subparagraph
			 (B), by inserting <quote>, as well as overall student success</quote> before

				how the proposed program will coordinate Federal, State, and local programs and
				make the most effective use of public

				</subparagraph><subparagraph id="H4A6DB3F4E56A4C5D84213CEFFC96D564"><enum>(D)</enum><text>in subparagraph
			 (D)—</text>
					<clause id="H1F76B3BD1CEA4F25A08D5EE24CFEEC90"><enum>(i)</enum><text>by
			 inserting <quote>and alignment</quote> after <quote>collaboration</quote>;
			 and</text>
					</clause><clause id="H3DD082665B19485FB510F8F0E7D2FAE9"><enum>(ii)</enum><text>by
			 inserting <quote>, including the sharing of relevant student data among the
			 schools, all participants in the eligible entity, and any partnering entities
			 described in subparagraph (H) while complying with applicable laws relating to
			 privacy and confidentiality</quote> before the semicolon; and</text>
					</clause></subparagraph><subparagraph id="HCF8B1B3E8FEE4E19A5912EB15A0CFC87"><enum>(E)</enum><text>by striking
			 subparagraph (J) and inserting the following:</text>
					<quoted-block id="HDDE609B67AF14341A2C2836F4DDAE492" style="OLC">
						<subparagraph id="H50887090858341CD9D5C03F6A86027B4"><enum>(J)</enum><text>a demonstration
				that the eligible entity uses research or evidence-based practices to provide
				educational and related activities that will complement and enhance the
				academic performance, achievement, and positive youth development of the
				students;</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HF485C439E9E244DCB2720A6BB7601DF4"><enum>(3)</enum><text>in subsection (e),
			 by inserting <quote>rigorous</quote> before <quote>peer review</quote>;</text>
			</paragraph><paragraph id="H5EDA82CDB87F499AB07A7571BF4DBDBA"><enum>(4)</enum><text>in subsection
			 (i)(1)—</text>
				<subparagraph id="HAA164095BFAA4593977229426729A4E8"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>and</quote> after the semicolon;</text>
				</subparagraph><subparagraph id="H855AE0A0E8484F75B09A29E0F2434E5C"><enum>(B)</enum><text>in subparagraph
			 (B)(ii), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>

				the activities proposed in the application—</text>
							<clause id="H43A7D975A23B45A0819847840A769562"><enum>(i)</enum><text>are, as of the
				date of the submission of the application, not accessible to students who would
				be served; or</text>
							</clause><clause id="H423229EE83B64673B7ADC0A162FAB5CE"><enum>(ii)</enum><text>would expand
				accessibility to high-quality services that may be available in the
				community.</text>
							</clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph commented="no" id="H8DCD50DF316B4BB29DDD37990F79FF6A"><enum>(5)</enum><text display-inline="yes-display-inline">by adding at the end of subsection (i) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H33DD646F94C042EE8B76C80B7272211E" style="OLC">
					<paragraph commented="no" id="H52BB2ECDAF5049E6B570A30443570C71"><enum>(3)</enum><header>Limitation</header><text>A
				State educational agency may not impose a priority or preference for
				eligibility for, or applications by, eligible entities that seek to use funds
				made available under this part to extend the regular school
				day.</text>
					</paragraph><after-quoted-block>;

			 under part B of title IV of the Elementary and Secondary Education Act of 1965
			 (20 U.S.C. 7171 et seq.), as such Act was in effect on the day before the date
			 of enactment of this Act, shall continue to receive funds in accordance with
			 the terms and conditions of such award.</text>
