		<official-title>To require the Secretary of the Interior to convey
		  certain Federal land to Elko County, Nevada, and to take land into trust for
		  the Te-moak Tribe of Western Shoshone Indians of Nevada, and for other
		  purposes.</official-title>

		<section id="H72DA6AE6785E4BA0AE869E13B90478A3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Elko Motocross and Tribal Conveyance
			 Act</short-title></quote>.</text>
		</section><section id="H906A948EFF4C4F9EA936A7BAD064FDDF"><enum>2.</enum><header>Definition of
			 Secretary</header><text display-inline="no-display-inline">In this Act, the
			 term <term>Secretary</term> means the Secretary of the Interior, acting through
			 the Bureau of Land Management.</text>
		</section><title id="HC38633449BA1457DA439F54E401D5E52"><enum>I</enum><header>Elko
			 Motocross land conveyance</header>
			<section id="H36A09A9CE2344FFB8E5F07415794E221"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="HD19CE8513D4347EAB877B3293F9187F9"><enum>(1)</enum><header>City</header><text>The
			 term <term>city</term> means the city of Elko, Nevada.</text>
				</paragraph><paragraph id="HD6400D54B252456AA9D060606696054C"><enum>(2)</enum><header>County</header><text>The
			 term <term>county</term> means the county of Elko, Nevada.</text>
				</paragraph><paragraph id="HD5CC5A136D564D8CB2827957C426D09E"><enum>(3)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>Elko Motocross Park</quote>
			 and dated January 9, 2010.</text>
				</paragraph></section><section id="HCE8DA175F5194BD0935A7BC48DE9DAA5"><enum>102.</enum><header>Conveyance of
			 land to county</header>
				<subsection id="HD0B717D6F1AC441E9F726D4C86853269"><enum>(a)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, subject to valid existing rights and the provisions of this section,
			 the Secretary shall convey to the county, without consideration, all right,
			 title, and interest of the United States in and to the land described in
			 subsection (b).</text>
				</subsection><subsection id="HFDC54AEB24664CD486A5C0D2C105A9B4"><enum>(b)</enum><header>Description of
			 land</header><text>The land referred to in subsection (a) consists of
			 approximately 275 acres of land managed by the Bureau of Land Management, Elko
			 District, Nevada, as generally depicted on the map as <quote>Elko Motocross
			 Park</quote>.</text>
				</subsection><subsection id="H5D6D4407B8C04EC3A3F53BE961133C8E"><enum>(c)</enum><header>Map and legal
			 description</header>
					<paragraph id="H163C7D5EB3414EC88C8B895AECF36717"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall finalize the legal description of the parcel to
			 be conveyed under this section.</text>
					</paragraph><paragraph id="H5FAB8780D1BE4A47801F57FC3566A877"><enum>(2)</enum><header>Minor
			 errors</header><text>The Secretary may correct any minor error in—</text>
						<subparagraph id="H5CA7AEE07F6C4CB182F1D729E44E199B"><enum>(A)</enum><text>the map; or</text>
						</subparagraph><subparagraph id="HDBD46F0543574C4AA5EEEB8920C9CEFB"><enum>(B)</enum><text>the legal
			 description.</text>
						</subparagraph></paragraph><paragraph id="H899A7F2CD4E74EB1BF7D668957F9ABE5"><enum>(3)</enum><header>Availability</header><text>The
			 map and legal description shall be on file and available for public inspection
			 in the appropriate offices of the Bureau of Land Management.</text>
					</paragraph></subsection><subsection id="H1FE705BE9B8F48CBA11DEE085BCFFBFC"><enum>(d)</enum><header>Use of conveyed
			 land</header><text>The land conveyed under this section shall be used only as a
			 motocross, bicycle, off-highway vehicle, or stock car racing area, or for any
			 other public purpose consistent with uses allowed under the Act of June 14,
			 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>),
			 (43 U.S.C. 869 et seq.).</text>
				</subsection><subsection id="H97FE1D7F452E4076893B42EDC8899F95"><enum>(e)</enum><header>Administrative
			 costs</header><text>The Secretary shall require the county to pay all survey
			 costs and other administrative costs necessary for the preparation and
			 completion of any patents for, and transfers of title to, the land described in
			 subsection (b).</text>
				</subsection><subsection id="HF706249468274FF1898952DCF49C9B8D"><enum>(f)</enum><header>Reversion</header><text>If
			 the land conveyed under this section ceases to be used for a public purpose in
			 accordance with subsection (d), the land shall, at the discretion of the
			 Secretary, revert to the United States.</text>
				</subsection></section></title><title id="H046569E2BF3D473B9B0F73A5946C2480"><enum>II</enum><header>Elko
			 Indian Colony expansion</header>
			<section id="H36B5F70D042F477AB129B24D4474AB0B"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="HD9AB82411020401FBF939857E22663AD"><enum>(1)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>Te-moak Tribal Land
			 Expansion</quote>, dated September 30, 2008, and on file and available for
			 public inspection in the appropriate offices of the Bureau of Land
			 Management.</text>
				</paragraph><paragraph id="H483586F250344AD0BEFB43D122315A84"><enum>(2)</enum><header>Tribe</header><text>The
			 term <term>Tribe</term> means the Te-moak Tribe of Western Shoshone Indians of
			 Nevada, which is a federally recognized Indian tribe.</text>
				</paragraph></section><section id="H22399051467E42CF8E7AD2F532AD13A3"><enum>202.</enum><header>Land to be held
			 in trust for the Te-moak Tribe of Western Shoshone Indians of Nevada</header>
				<subsection id="H979653E0B49749C7A0A689E97AB16DFD"><enum>(a)</enum><header>In
			 general</header><text>Subject to valid existing rights, all right, title, and
			 interest of the United States in and to the land described in subsection
			 (b)—</text>
					<paragraph id="H7258479B61EC4915BE633D451FF62C67"><enum>(1)</enum><text>shall be held in
			 trust by the United States for the benefit and use of the Tribe; and</text>
					</paragraph><paragraph id="H2840BA0CFADB4CA3A44D46C423D9E117"><enum>(2)</enum><text>shall be part of
			 the reservation of the Tribe.</text>
					</paragraph></subsection><subsection id="HA993787DC6A643E4A2413DA3617D72FF"><enum>(b)</enum><header>Description of
			 land</header><text>The land referred to in subsection (a) consists of
			 approximately 373 acres of land administered by the Bureau of Land Management,
			 as generally depicted on the map as <quote>Lands to be Held in
			 Trust</quote>.</text>
				</subsection><subsection id="HE47BAEDABC034DA4A5B0F58FC6D26E7C"><enum>(c)</enum><header>Survey</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Secretary
			 shall complete a survey of the boundary lines to establish the boundaries of
			 the land taken into trust under subsection (a).</text>
				</subsection><subsection id="H76D913E874354A2A95EA44C9A184B82F"><enum>(d)</enum><header>Conditions</header>
					<paragraph id="H43666B0A1446408B90A9BCBD797A1006"><enum>(1)</enum><header>Gaming</header><text>Land
			 taken into trust under subsection (a) shall not be eligible, or considered to
			 have been taken into trust, for class II gaming or class III gaming (as those
			 terms are defined in section 4 of the Indian Gaming Regulatory Act (25 U.S.C.
			 2703)).</text>
					</paragraph><paragraph id="H13EBDCD6EE814F96BDB741947B331FC3"><enum>(2)</enum><header>Use of trust
			 land</header>
						<subparagraph id="H40F02E045893472E86D6144284847FF3"><enum>(A)</enum><header>In
			 general</header><text>The Tribe shall use the land taken into trust under
			 subsection (a) only for—</text>
							<clause id="H1E3DD5E03A964D9D8E91DF5953BD2174"><enum>(i)</enum><text>traditional and
			 customary uses;</text>
							</clause><clause id="H051AE0985060463B95441DE8D26A7480"><enum>(ii)</enum><text>stewardship
			 conservation for the benefit of the Tribe; or</text>
							</clause><clause id="H84D6E444059A4FD188B3D3237CD32139"><enum>(iii)</enum><text>residential or
			 recreational development.</text>
							</clause></subparagraph><subparagraph id="H4387B942674A4994B37BAC6E91E715EE"><enum>(B)</enum><header>Other
			 uses</header><text>If the Tribe uses any portion of the land taken into trust
			 under subsection (a) for a purpose other than a purpose described in
			 subparagraph (A), the Tribe shall pay to the Secretary an amount that is equal
			 to the fair market value of the portion of the land, as determined by an
			 appraisal.</text>
						</subparagraph></paragraph><paragraph id="H7CFEF91B3B894B389FB259DBA32D6B87"><enum>(3)</enum><header>Thinning;
			 landscape restoration</header><text>With respect to the land taken into trust
			 under subsection (a), the Secretary, in consultation and coordination with the
			 Tribe, may carry out any fuels reduction and other landscape restoration
			 activities on the land that is beneficial to the Tribe and the Bureau of Land
			 Management.</text>
					</paragraph></subsection></section></title></legis-body>
