		  the definition of aircraft and the offenses penalized under the aviation
		  smuggling provisions under that Act, and for other purposes.</official-title>

		<section id="H8122840C39B64CBA98B345D828577FAB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may cited as the
			 <quote><short-title>Ultralight Aircraft Smuggling
			 Prevention Act of 2012</short-title></quote>.</text>
		</section><section id="H0B8658878116437FAED2E2C0B775F018" section-type="subsequent-section"><enum>2.</enum><header>Clarification of
			 definition of aircraft and offenses under aviation smuggling provisions of the
			 Tariff Act of 1930</header>
			<subsection id="HA56A5690AAFD40158B10A9FF16ECD48C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 590 of the
			 Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1590">19 U.S.C. 1590</external-xref>) is amended—</text>
				<paragraph id="H8604C25B41544214AE63CB67DAD51772"><enum>(1)</enum><text>by redesignating
			 subsection (g) as subsection (h); and</text>
				</paragraph><paragraph id="H44854C30BDCA4CA084C1BE762564D54B"><enum>(2)</enum><text>by inserting after
			 subsection (f) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HDB1A9B5086F14AC28156DECE5347D471" style="OLC">
						<subsection id="H2E06075A84EA4346812B15448225296A"><enum>(g)</enum><header>Definition of
				aircraft</header><text display-inline="yes-display-inline">In this section, the
				term <term>aircraft</term>—</text>
							<paragraph id="H0E75D17F6B7343C48E0957F7002C86A1"><enum>(1)</enum><text display-inline="yes-display-inline">has the meaning given that term in
				<external-xref legal-doc="usc" parsable-cite="usc/49/40102">section
				40102</external-xref> of title 49, United States Code; and</text>
							</paragraph><paragraph id="H84139E474E1549B7908B0CD893C35667"><enum>(2)</enum><text display-inline="yes-display-inline">includes a vehicle described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/14/103.1">section
				103.1</external-xref> of title 14, Code of Federal
				Regulations.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H0D2CA92953204E699A3DF780ECB89775"><enum>(b)</enum><header>Criminal
			 penalties</header><text>Subsection (d) of section 590 of the Tariff Act of 1930
			 (<external-xref legal-doc="usc" parsable-cite="usc/19/1590">19 U.S.C.
			 1590(d)</external-xref>) is amended in the matter preceding paragraph (1) by
			 inserting <quote>, or attempts or conspires to commit,</quote> after
			 <quote>commits</quote>.</text>
			</subsection><subsection id="HCC5C808CCC084A99A49088939848E72A"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section apply with respect to
			 violations of any provision of section 590 of the Tariff Act of 1930 on or
			 after the 30th day after the date of the enactment of this Act.</text>
			</subsection></section><section id="H46B1EE74296B4D7B80DE6E77B2190C6D"><enum>3.</enum><header>Interagency
			 collaboration</header>
			<subsection id="HB6682BD4B5264EB1BB19919A34E6C705"><enum>(a)</enum><header>Findings</header><text>Congress
			 makes the following findings:</text>
				<paragraph id="HC50395333F9F4CCB90AA3D9804347E66"><enum>(1)</enum><text>The Department of
			 Defense has worked collaboratively with the Department of Homeland Security to
			 identify equipment, technology, and expertise used by the Department of Defense
			 that could be leveraged by the Department of Homeland Security to help fulfill
			 its missions.</text>
				</paragraph><paragraph id="H6CE01B9685DF4FE696DBB328C858335C"><enum>(2)</enum><text>As part of that
			 collaborative effort, the Department of Homeland Security has leveraged
			 Department of Defense equipment, technology, and expertise to enhance the
			 ability of U.S. Customs and Border Protection to detect, track, and engage
			 illicit trafficking across the international borders between the United States
			 and Mexico and the United States and Canada.</text>
				</paragraph><paragraph id="H0E5D79B6909B4045B18F790F6EC12608"><enum>(3)</enum><text>Leveraging
			 Department of Defense equipment, technology, and expertise is a cost-effective
			 inter-agency approach to enhancing the effectiveness of the Department of
			 Homeland Security to protect the United States against a variety of threats and
			 risks.</text>
				</paragraph></subsection><subsection id="H1AE571A0B44B4DC4BE310F9561C69BB8"><enum>(b)</enum><header>Sense of
			 Congress</header><text>It is the sense of Congress that the Secretary of
			 Defense should—</text>
				<paragraph id="H78F01FC316DF4BE798F41AF6E867561F"><enum>(1)</enum><text>continue the broad
			 program of cooperation and collaboration with the Secretary of Homeland
			 Security described in subsection (a); and</text>
				</paragraph><paragraph id="H91D60DC247A042479DE8AFC06F83027E"><enum>(2)</enum><text>ensure that the
			 Department of Homeland Security is able to identify equipment and technology
			 used by the Department of Defense that could also be used by U.S. Customs and
			 Border Protection to enhance its efforts to combat illicit trafficking across
			 the international borders between the United States and Mexico and the United
			 States and Canada, including equipment and technology that could be used to
			 detect and track the illicit use of ultralight aircraft.</text>
				</paragraph></subsection></section></legis-body>
