		<section id="H6DADE41B0BDD493D93849AE0B1DDA69A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Regulation of Mortgage Servicing Act of
			 2012</short-title></quote>.</text>
		</section><section id="H71443894FFE64B2880CCE67880E0A0BD"><enum>2.</enum><header>Standards for
			 mortgage servicers</header>
			<subsection id="HA7FCCF4C0820479885E10D89C829AD4A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 2 of the
			 Truth in Lending Act (15 U.S.C. 1631) is amended by adding at the end the
			 following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HFDED41B08F35444C9A8FFEF759EDE576" style="OLC">
					<section id="H3DBBF8F371E0481699A03C31CF33EECE"><enum>129I.</enum><header>Standards for
				servicers of residential mortgages</header>
						<subsection id="H0EFFAA97B4444105877E5E94E0935B02"><enum>(a)</enum><header>Definitions</header><text>In
				this section, the following definitions shall apply:</text>
							<paragraph id="H7615A2C10BA14064A1C3B134B420BE55"><enum>(1)</enum><header>Alternative to
				foreclosure</header><text>The term <term>alternative to
				foreclosure</term>—</text>
								<subparagraph id="HB67D3B2B6CE741E99C3E7E3A41AEE792"><enum>(A)</enum><text>means a course of
				action with respect to a mortgage offered by a servicer to a borrower as an
				alternative to a covered foreclosure action; and</text>
								</subparagraph><subparagraph id="H54A60886B06E492EAAAEA23D30505340"><enum>(B)</enum><text>includes a short
				sale and a deed in lieu of foreclosure.</text>
								</subparagraph></paragraph><paragraph id="HF0AE9B4D3BD74BE9990D3722A0CB57F6"><enum>(2)</enum><header>Borrower</header><text>The
				term <term>borrower</term> means a mortgagor under a mortgage who is in default
				or at risk of imminent default, as determined by the Director, by rule.</text>
							</paragraph><paragraph id="H7C57AE2B6CA04C0E99334082279D3CB9"><enum>(3)</enum><header>Covered
				foreclosure action</header><text>The term <term>covered foreclosure
				action</term> means a judicial or nonjudicial foreclosure.</text>
							</paragraph><paragraph id="HDD6E2DBFEDE94000822F88399CCA196B"><enum>(4)</enum><header>Independent
				reviewer</header><text>The term <term>independent reviewer</term>—</text>
								<subparagraph id="H5175FF299D4F477B895034A01894C854"><enum>(A)</enum><text>means an entity
				that has the expertise and capacity to determine whether a borrower is eligible
				to participate in a loan modification program; and</text>
								</subparagraph><subparagraph id="H3964576920084A81B8940BA7F7DA7264"><enum>(B)</enum><text>includes—</text>
									<clause id="H7767FBFD4E26460D86DF2555BA9D7064"><enum>(i)</enum><text>an
				entity that is not a servicer; or</text>
									</clause><clause id="H3E3A8A22EE454608A23DC21778935F33"><enum>(ii)</enum><text>a
				division within a servicer that is independent of, and not under the same
				immediate supervision as, any division that makes determinations with respect
				to applications for loan modifications or alternatives to foreclosure.</text>
									</clause></subparagraph></paragraph><paragraph id="HEA031224C673405BA0D3FE4DC1DC9B55"><enum>(5)</enum><header>Loan
				modification program</header><text>The term <term>loan modification
				program</term>—</text>
								<subparagraph id="HA8348060F4D94C3EB733A72C863A4E41"><enum>(A)</enum><text>means a program or
				procedure designed to change the terms of a mortgage in the case of the
				default, delinquency, or imminent default or delinquency of a mortgagor;
				and</text>
								</subparagraph><subparagraph id="H1964A5998D9F43E4AD9D36884DF26143"><enum>(B)</enum><text>includes—</text>
									<clause id="HF4BC9720F22943B48FB71C453D9BC657"><enum>(i)</enum><text>a
				loan modification program established by the Federal Government, including the
				Home Affordable Modification Program of the Department of the Treasury;
				and</text>
									</clause><clause id="H019958848A47481BAA11D244D0D52897"><enum>(ii)</enum><text>a
				loan modification program established by a servicer.</text>
									</clause></subparagraph></paragraph><paragraph id="HC0FAE9B51355498CAAD4850942070AF2"><enum>(6)</enum><header>Mortgage</header><text>The
				term <term>mortgage</term> means a federally related mortgage loan, as defined
				in section 3 of the Real Estate Settlement Procedures Act of 1974 (12 U.S.C.
				2602(3)), that is secured by a first or subordinate lien on residential real
				property that is the primary residence of the borrower.</text>
							</paragraph><paragraph id="H3AD3D528F802489980DF8E8E713EE021"><enum>(7)</enum><header>Servicer</header><text>The
				term <term>servicer</term>—</text>
								<subparagraph id="H9FE542FD525C4E3CB39E971105423C72"><enum>(A)</enum><text>has the same
				meaning as in section 6(i) of the Real Estate Settlement Procedures Act of 1974
				(12 U.S.C. 2605(i)); and</text>
								</subparagraph><subparagraph id="HAA817920D69D4514A7C76055F90D5DF5"><enum>(B)</enum><text>includes a person
				responsible for servicing a pool of mortgages.</text>
								</subparagraph></paragraph></subsection><subsection id="HC82EB3EB70614207BF0842A42B696DF0"><enum>(b)</enum><header>Single point of
				contact</header>
							<paragraph id="H4BF193AF300A4B7C9808E8B6317BCC1D"><enum>(1)</enum><header>Case Manager
				Required</header><text>A servicer shall assign 1 case manager to each borrower
				that seeks a loan modification or an alternative to foreclosure.</text>
							</paragraph><paragraph id="H97C5CB8988B249239DD2B1FFC157FC47"><enum>(2)</enum><header>Duties of Case
				Manager</header><text>The case manager assigned under paragraph (1) shall be an
				individual who—</text>
								<subparagraph id="H3482E786AA2E4CA1ACF1B4CECC405E00"><enum>(A)</enum><text>manages the
				communications between the servicer and the borrower;</text>
								</subparagraph><subparagraph id="H9C8C4C4894244B02B4DDAFCA95647C15"><enum>(B)</enum><text>has the authority
				to make decisions about the eligibility of the borrower for a loan modification
				or an alternative to foreclosure;</text>
								</subparagraph><subparagraph id="HD810ED887F264B8E8B3B6EEFD94D469E"><enum>(C)</enum><text>is available to
				communicate with the borrower by telephone and email during business hours;
				and</text>
								</subparagraph><subparagraph id="H3885B689849F468CB7CFBC4865AA25E2"><enum>(D)</enum><text>remains assigned
				to the borrower until the earliest of—</text>
									<clause id="H3B6291801C7342F6B89DAC905B69B384"><enum>(i)</enum><text>the date on which
				the borrower accepts a loan modification or an alternative to
				foreclosure;</text>
									</clause><clause id="H658134CC04BD4AEB86B147ECE8C37164"><enum>(ii)</enum><text>the date on which
				the servicer forecloses on the mortgage of the borrower; or</text>
									</clause><clause id="HCBD9E7F02DFE4775B729A3B5018238E5"><enum>(iii)</enum><text>the date on
				which a release of the mortgage of the borrower is recorded in the appropriate
				land records office, as determined by the Director, by rule.</text>
									</clause></subparagraph></paragraph><paragraph id="HEA70AB54B524460FBE63F0C36C2E0D3F"><enum>(3)</enum><header>Assistance for
				Case Managers</header><text>A servicer may assign an employee to assist a case
				manager assigned under paragraph (1), if the case manager remains available to
				communicate with the borrower by telephone and email.</text>
							</paragraph></subsection><subsection id="H6770F08CEA5C4DD2A3C6117B5D6FE333"><enum>(c)</enum><header>Determination of
				eligibility for loan modification program or alternative to foreclosure
				required before foreclosure</header>
							<paragraph id="HA16E41DAD9BF41F09117C874FDB4A637"><enum>(1)</enum><header>Initiation of
				Covered Foreclosure Actions</header><text>A servicer may not initiate a covered
				foreclosure action against a borrower unless the servicer has—</text>
								<subparagraph id="H9A76C687FADB4F80989260D3D2B8A143"><enum>(A)</enum><text>completed a full
				review of the file of the borrower to determine whether the borrower is
				eligible for a loan modification or an alternative to foreclosure;</text>
								</subparagraph><subparagraph id="H63F9F4ECFB1049E5ACE1E9B8B6899B60"><enum>(B)</enum><text>made a reasonable
				effort to obtain the information necessary to determine whether the borrower is
				eligible for a loan modification or an alternative to foreclosure, as described
				in paragraph (3); and</text>
								</subparagraph><subparagraph id="H0076823A89894C008E84F97B749D39F7"><enum>(C)</enum><text>offered the
				borrower a loan modification or an alternative to foreclosure, if the borrower
				is eligible for the loan modification or alternative to foreclosure.</text>
								</subparagraph></paragraph><paragraph id="H3E98EE36DEBF4877AAAC2BB58C64BA23"><enum>(2)</enum><header>Suspension of
				Covered Foreclosure Actions</header>
								<subparagraph id="H6F6F9C25141C46EC8D515E6665C66EAE"><enum>(A)</enum><header>In
				general</header><text>A servicer shall suspend a covered foreclosure action
				that was initiated before the date of enactment of this section until the
				servicer—</text>
									<clause id="H6EEA02BEC861410C9FB397088ACD4DC0"><enum>(i)</enum><text>completes a full
				review of the file of the borrower to determine whether the borrower is
				eligible for a loan modification or an alternative to foreclosure;</text>
									</clause><clause id="H3C18B6FD3FE8479EB5E63059F8DBE9FF"><enum>(ii)</enum><text>notifies the
				borrower of the determination under clause (i); and</text>
									</clause><clause id="H56738FED7F984EB18FBA7F8AF1B7B054"><enum>(iii)</enum><text>offers the
				borrower a loan modification or an alternative to foreclosure, if the borrower
				is eligible for a loan modification or an alternative to foreclosure.</text>
									</clause></subparagraph><subparagraph id="HA1CE2626CE7E4B0E9CB335FB743D47E7"><enum>(B)</enum><header>Suspension</header><text>During
				the period of the suspension under subparagraph (A), a servicer may not—</text>
									<clause id="H06C4E6F9A8034CF2885A64DDDA580055"><enum>(i)</enum><text>send a notice of
				foreclosure to a borrower;</text>
									</clause><clause id="H4E65162B51F946FEA607C2E0F23CEAED"><enum>(ii)</enum><text>conduct or
				schedule a sale of the residential real property securing the mortgage of the
				borrower; or</text>
									</clause><clause id="H45B49821FCE34C12A05C61B9199DBCF4"><enum>(iii)</enum><text>cause final
				judgment to be entered against the borrower.</text>
									</clause></subparagraph><subparagraph id="H910C4968FF2B42D191E38895CE208DB0"><enum>(C)</enum><header>Reasonable
				efforts</header><text>A servicer is not required to suspend a covered
				foreclosure action under subparagraph (A) if the servicer—</text>
									<clause id="H36161E6E35B8494C94E0E2F2B6F38761"><enum>(i)</enum><text>makes a reasonable
				effort to obtain information necessary to determine whether the borrower is
				eligible for a loan modification or an alternative to foreclosure, as described
				in paragraph (3); and</text>
									</clause><clause id="HE501CAEF58554AE7AC041B6A999BA945"><enum>(ii)</enum><text>documents that
				the servicer has not received information necessary to determine whether the
				borrower is eligible for a loan modification or an alternative to foreclosure
				before the end of the applicable period under paragraph (3).</text>
									</clause></subparagraph><subparagraph id="H3FB7C278587B445483D7365400CEBB34"><enum>(D)</enum><header>Rule of
				construction</header><text>Nothing in this section may be construed to require
				a servicer to delay an unavoidable foreclosure, such as foreclosure that
				results from a borrower abandoning the residential real property securing the
				mortgage of such borrower.</text>
								</subparagraph></paragraph><paragraph id="H10E5FF0B0B374A9AB1015258A41999F3"><enum>(3)</enum><header>Reasonable
				effort to obtain necessary information</header><text>A servicer shall be deemed
				to have made a reasonable effort to obtain information necessary to determine
				whether the borrower is eligible for a loan modification or an alternative to
				foreclosure if such servicer takes the following steps:</text>
								<subparagraph id="H356B6675E3E1495C9047823954A1B919"><enum>(A)</enum><header>30-day period
				after delinquency</header>
									<clause id="H93DD970ED2AF47979921E5A144B7BFCD"><enum>(i)</enum><header>In
				general</header><text>During the 30-day period beginning on the date of
				delinquency of the borrower, the servicer shall attempt to establish contact
				with the borrower by—</text>
										<subclause id="H144D0906DB614319B6A5ECB96E281C0B"><enum>(I)</enum><text>making not fewer
				than 4 telephone calls to the telephone number on record for the borrower, at
				different times of the day; and</text>
										</subclause><subclause id="H8DAB584087AE48E69B3ED6F0593C424D"><enum>(II)</enum><text>sending not fewer
				than 2 written notices to the borrower at the address on record for the
				borrower, at least 1 of which shall be delivered by certified mail, requesting
				that the borrower contact the servicer.</text>
										</subclause></clause><clause id="H1418D2F0A33940C69912BDC144025B9E"><enum>(ii)</enum><header>Contact not
				established</header><text display-inline="yes-display-inline">In the case that
				a servicer is not able to establish contact with the borrower by telephone
				under subclause (I) of clause (i) or such borrower does not respond to the
				notices sent under subclause (II) of such clause, such servicer shall,
				following a third party review under subsection (d), notify the borrower that
				the servicer intends to initiate or continue a covered foreclosure action.</text>
									</clause></subparagraph><subparagraph id="H87C15A08A16543A1B64FA45A3BBF9175"><enum>(B)</enum><header>Contact
				established with borrower</header><text>In the case that a servicer is able to
				establish contact with the borrower under subparagraph (A)(i), the servicer
				shall—</text>
									<clause id="H863767ECBBA1445696B89B8C0E34DB5A"><enum>(i)</enum><text>notify the
				borrower, in writing, that the servicer lacks information necessary to
				determine whether the borrower is eligible for a loan modification or an
				alternative to foreclosure; and</text>
									</clause><clause id="HC320784A67D0416AA038782B42A820E1"><enum>(ii)</enum><text display-inline="yes-display-inline">send the borrower a written request that
				the borrower transmit to the servicer, not later than 30 days after the date on
				which such request sent by the servicer is postmarked, all information
				necessary to determine whether the borrower is eligible for a loan modification
				or an alternative to foreclosure.</text>
									</clause></subparagraph><subparagraph id="HFEE01215C6FE44D597561CFD02975B23"><enum>(C)</enum><header>Necessary
				information not received</header><text display-inline="yes-display-inline">In
				the case that the servicer does not receive from the borrower all information
				requested under clause (ii) of subparagraph (B) within the time period
				described in such subparagraph, the servicer shall send the borrower an
				additional written request that the borrower transmit to the servicer, not
				later than 15 days after the date on which such request sent by the servicer is
				postmarked, all information necessary to determine whether the borrower is
				eligible for a loan modification or an alternative to foreclosure.</text>
								</subparagraph><subparagraph id="HC9F05F1B6226495DA53F4B2E8C8BDC52"><enum>(D)</enum><header>Notification of
				foreclosure</header><text display-inline="yes-display-inline">In the case that
				the servicer does not receive from the borrower all information requested under
				subparagraph (C) within the time period described in such subparagraph, the
				servicer shall, following a third party review under subsection (d), notify the
				borrower that the servicer intends to initiate or continue a covered
				foreclosure action.</text>
								</subparagraph></paragraph></subsection><subsection id="HB3BD386624A449248BE0F7D601F87EB9"><enum>(d)</enum><header>Third party
				review</header>
							<paragraph id="H984DFE47C39646D3ADEA4D77F15DBC90"><enum>(1)</enum><header>In
				general</header><text>Unless otherwise provided for in this subsection, before
				a servicer notifies a borrower that the borrower is not eligible for a loan
				modification or an alternative to foreclosure, the servicer shall obtain the
				services of an independent reviewer to—</text>
								<subparagraph id="H4C01F72EA9E14FB39DB1CA96F3E819FA"><enum>(A)</enum><text>review the file of
				the borrower; and</text>
								</subparagraph><subparagraph id="H622F5E7853D44D48A95B00103FACA9EB"><enum>(B)</enum><text>determine whether
				the borrower is eligible for a loan modification or an alternative to
				foreclosure.</text>
								</subparagraph></paragraph><paragraph id="HF1DFD9F2ED5E44B39956BBA51800F30C"><enum>(2)</enum><header>Exemption</header><text>Paragraph
				(1) shall not apply to a servicer that is a community financial institution, as
				defined in section 2(10) of the Federal Home Loan Bank Act (12 U.S.C.
				1422(10)).</text>
							</paragraph></subsection><subsection id="H3AD5B072EFB74F07997A16306AB5483D"><enum>(e)</enum><header>Bar to
				foreclosure actions</header>
							<paragraph id="H79EA31E2C4B645D29C4D4A1CF16EAF0C"><enum>(1)</enum><header>In
				General</header><text>Subject to paragraph (2), a violation of this Act shall
				be a bar to a covered foreclosure action.</text>
							</paragraph><paragraph id="H26125773578D456AB4EC3BABBE12A7AD"><enum>(2)</enum><header>Effect of
				Subsequent Compliance</header><text>If a servicer is in compliance with this
				section, the servicer may bring or proceed with a covered foreclosure action,
				without regard to a prior violation of this section by the servicer.</text>
							</paragraph></subsection><subsection id="H9C055136F6714622A4C15CEABD6434A1"><enum>(f)</enum><header>Liability</header>
							<paragraph id="HECECA50C90904586BF7D143A86F30745"><enum>(1)</enum><header>In
				general</header><text>A servicer that fails to comply with any requirement
				imposed under this section shall be liable to a borrower in the same manner
				that a creditor who fails to comply with any requirement under this chapter is
				liable to a person under section 130.</text>
							</paragraph><paragraph id="H299F9F8C45E94A08AF46756A34B72A1F"><enum>(2)</enum><header>Joint and
				several liability</header><text>A creditor or assignee that is connected to a
				mortgage serviced by a servicer that fails to comply with any requirement
				imposed under this section shall, with respect to that mortgage, have joint and
				several liability with such servicer for such failure to
				comply.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBAF985D346D849708BA0618A4A24B6B3"><enum>(b)</enum><header>Table of
			 contents</header><text>The table of contents of chapter 2 of such Act is
			 amended by adding at the end the following new item:</text>

						<toc-entry level="section">129I. Standards for servicers of

					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H6A68C383CDB34BC194FF145F800CC99E"><enum>3.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 90 days after the date of
			 enactment of this Act, the Director of the Bureau of Consumer Financial
			 Protection, in consultation with the Secretary of Housing and Urban Development
			 and the Secretary of the Treasury, shall issue regulations to carry out the
			 amendments made by this Act.</text>
		</section><section id="H7328784AE3C04C5EBA3C9BE7F62E4033"><enum>4.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Director of the Bureau of Consumer Financial
			 Protection shall submit to Congress a report that contains—</text>
			<paragraph id="H00990BFF48A04A209083AB534707D52F"><enum>(1)</enum><text>an evaluation of
			 the effect of the amendments made by this Act on—</text>
				<subparagraph id="H552A0957AA454E61AB33F3F18E36E179"><enum>(A)</enum><text>State law;
			 and</text>
				</subparagraph><subparagraph id="H42922CF9EFA34FFEB9AA3329EB1A0E15"><enum>(B)</enum><text>communication
			 between servicers and borrowers; and</text>
				</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HB4BD4033277F4BF99D0D9D63456DE173"><enum>(2)</enum><text>a description of
			 any problems concerning the implementation of this Act.</text>
			</paragraph></section></legis-body>
