		<official-title>To amend title 5, United States Code, to provide that
		  payment for services may not be made to an individual appointed during a recess
		  of the Senate to fill a vacancy in an existing office, if the vacancy existed
		  while the Senate was in session and was by law required to be filled by and
		  with the advice and consent of the Senate, and for other
		  purposes.</official-title>

		<section id="H0CC1FA58FE154B4DB4BF279E1CB2F6CA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Executive Appointments Reform Act</short-title></quote>.</text>
		</section><section id="HF9EA084B62B844AAA8AD8ED1CB84A31F"><enum>2.</enum><header>Recess
			 appointments pay reform</header><text display-inline="no-display-inline">Section 5503 of title 5, United States Code,
			 is amended—</text>
			<paragraph id="H5524160743D7469A8BE3B244E3D5C58C"><enum>(1)</enum><text>by striking the
			 second sentence of subsection (a);</text>
			</paragraph><paragraph id="HB90E1942910E444B8A98FC2B6D19BF4F"><enum>(2)</enum><text>by striking
			 subsection (b); and</text>
			</paragraph><paragraph id="HCFED6F6260C14F0CA99B69BB20CC09C0"><enum>(3)</enum><text>by striking
			 <quote>(a) Payment</quote> and inserting <quote>Payment</quote>.</text>
			</paragraph></section><section id="H4092C32296B249798A146CC4F36F32BC"><enum>3.</enum><header>Limitation on
			 voluntary services</header><text display-inline="no-display-inline">Section
			 1342 of title 31, United States Code, is amended—</text>
			<paragraph id="H18BE4CC652C24D6184E2BAECCE58D4B4"><enum>(1)</enum><text>by redesignating
			 the text of such section as subsection (a); and</text>
			</paragraph><paragraph id="H985CC062FE7D46C0B6009DEBDE4F543F"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H705EB37F0B3741CC88E57C08BFCBADC7" style="USC">
					<subsection id="H4C641159D4B6452CB901C888A6B1AAA2"><enum>(b)</enum><text display-inline="yes-display-inline">No officer or employee of the United States
				Government serving in a position required by law to be filled with the advice
				and consent of the Senate may provide voluntary or gratuitous services.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H4E18B5225966470C830F35A8A2EE29B8"><enum>4.</enum><header>Requirement
			 relating to a quorum for the National Labor Relations Board</header><text display-inline="no-display-inline">Section 3(b) of the National Labor Relations
			 Act (29 U.S.C. 153(b)) is amended by adding at the end the following: <quote>A
			 quorum shall not be constituted by any member of the Board who shall not have
			 been confirmed by the Senate.</quote>.</text>
		</section><section id="HA81C8BCBA6D24435A66BC671989C64CD"><enum>5.</enum><header>Amendments
			 relating to the Bureau of Consumer Financial Protection</header>
			<subsection id="H7FE7FD4714CF425BAD4564A484F4692F"><enum>(a)</enum><header>Effectiveness of
			 rules</header><text display-inline="yes-display-inline">Section 1022(b)(1) of
			 the Dodd-Frank Wall Street Reform and Consumer Protection Act (12 U.S.C.
			 5512(b)(1)) is amended by adding at the end the following: <quote>No rule,
			 order, or other administrative action shall be considered final if the Director
			 was appointed during a recess of the Senate and the position of Director was
			 vacant while the Senate was in session, until the Director has been confirmed
			 by the Senate.</quote>.</text>
			</subsection><subsection id="H02D99DE0D57644FCA6EC7BD3498D0A32"><enum>(b)</enum><header>Repeal</header><text>Section
			 1017(c) of the Dodd-Frank Wall Street Reform and Consumer Protection Act (12
			 U.S.C. 5497(c)) is amended by striking paragraph (2) and redesignating
			 paragraph (3) as paragraph (2).</text>
			</subsection><subsection id="H1B2F6A0ABFCC4624AD648EA2BC4C9054"><enum>(c)</enum><header>Treatment of
			 recess appointments; limitation on voluntary services</header><text display-inline="yes-display-inline">Section 1011(b) of the Dodd-Frank Wall
			 Street Reform and Consumer Protection Act (12 U.S.C. 5491(b)) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDB70AB6CD41A41278D66785E82EE416B" style="OLC">
					<paragraph id="H37F85E0FD4154AD09BCE2C1691C14A54"><enum>(6)</enum><header>Treatment of
				recess appointees; limitation on voluntary services</header>
						<subparagraph id="HF5F196B8262D4F1DBD7824A0A74F75B2"><enum>(A)</enum><header>Recess
				appointees not to receive pay</header><text display-inline="yes-display-inline">Payment for services may not be made to an
				individual appointed during a recess of the Senate to fill a vacancy in the
				Bureau, if the vacancy existed while the Senate was in session and was by law
				required to be filled by and with the advice and consent of the Senate, until
				the appointee has been confirmed by the Senate.</text>
						</subparagraph><subparagraph id="HB03A2599D7ED49D3B44E94B38065A0C1"><enum>(B)</enum><header>Limitation on
				voluntary services</header><text display-inline="yes-display-inline">No officer
				or employee of the Bureau serving in a position required by law to be filled
				with the advice and consent of the Senate may provide voluntary or gratuitous
				services.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HA0A61731EF5247B48B9EE76D0DE766A6"><enum>6.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act and the
			 amendments made by this Act shall be effective as of January 1, 2012.</text>
