		  penalties with respect to employers’ conduct relating to persons engaging in
		  sexual conduct with children, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="HE135466D7989459DBE13833F6C9B54A5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Jeremy Bell Act of
			 2011</short-title></quote>.</text>
		</section><section id="HF240A49155124F96885318F96E7F1BF1" section-type="subsequent-section"><enum>2.</enum><header>Offense</header>
			<subsection id="H442E383F3916485FB0482D05EB344E8B"><enum>(a)</enum><header>In
			 general</header><text>Chapter 98 of title 18, United States Code, is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDAC5A2B71E594F83B5B10CC2198B2EDC" style="USC">
					<section id="H6A50EDC241A34F659757B7E19B58994A"><enum>1822.</enum><header>Transfers for
				employment of individuals engaging in child sex acts</header>
						<subsection id="H01AC87BB09D6433F978A2F0E848CC77A"><enum>(a)</enum><header>Prohibition on
				the interstate transfer of child sex offenders</header><text display-inline="yes-display-inline">Whoever, being an employer, directs,
				causes, persuades, induces, or entices the travel in interstate commerce of an
				employee in one State with the purpose or effect of facilitating the employment
				of such employee in another State, if the employer knows that such employee
				engaged in a sexual conduct with an individual who has not attained the age of
				18 years, shall be fined under this title or imprisoned not more than 5 years,
				or both.</text>
						</subsection><subsection id="H80E8FD8DF24F4FD6A39A049F5E331FFE"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">As used in this section—</text>
							<paragraph id="H900D2EFE6F2A4ECE8DE33B7AF266038B"><enum>(1)</enum><text>the term
				<term>sexual conduct</term> means any sexual conduct, unless the employee was
				convicted of a crime for that conduct and has satisfied the terms and
				conditions imposed as a result of that conviction, if the conduct—</text>
								<subparagraph id="H44EEBDBBDEA448BF8F56B4AA506649B8"><enum>(A)</enum><text>is a sexual act or
				sexual contact as those terms are defined in section 2246;</text>
								</subparagraph><subparagraph id="HACABFC55869E44B394588DC3F19BB4CB"><enum>(B)</enum><text>occurred during
				the course of employment; and</text>
								</subparagraph><subparagraph id="HB24C6B4BB35048F4B347323DB5B00C88"><enum>(C)</enum><text>would constitute a
				felony violation of the criminal law applicable where it took place; and</text>
								</subparagraph></paragraph><paragraph id="H27E15441C3994EBE9DF37CF89E968B4D"><enum>(2)</enum><text>the term
				<term>State</term> includes the District of Columbia and any other territory or
				possession of the United
				States.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HED2BA2CFA22D48139E11B815F22B4F3D"><enum>(b)</enum><header>Clerical
			 Amendment</header><text>The table of contents for chapter 98 of title 18,
			 United States Code, is amended by adding after the item relating to section
			 1821 the following new item:</text>

			</subsection></section><section display-inline="no-display-inline" id="H71082FF990D84EB3A111D030C51E65AF" section-type="subsequent-section"><enum>3.</enum><header>Schools required to
			 carry out background checks on all employees</header><text display-inline="no-display-inline">The Elementary and Secondary Education Act
			 of 1965 is amended as follows:</text>
			<paragraph id="H10CFE43357084F29A00820FD363E46F4"><enum>(1)</enum><header>Amendment to
			 ESEA</header><text>Subpart 2 of part E of title IX is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H6290003632A64E8F80D93567ED662112" style="OLC">
					<section id="HDF2F7E1D3415468D90AAE84DCCD8628A"><enum>9537.</enum><header> Background
				checks on all employees</header><text display-inline="no-display-inline">A
				private or public elementary school, a private or public secondary school, a
				local educational agency, or State educational agency may receive funds under
				this Act for a fiscal year only if the school or agency has in effect a policy
				that ensures that every individual employed by the school or agency has
				undergone a fingerprint-based check of the national crime information databases
				(as described in subsection (b) of section 153 of the Adam Walsh Child
				Protection and Safety Act of 2006 (42 U.S.C. 16962)) and, where possible, a
				fingerprint-based check of State criminal history databases (as described in
				subsection (c) of such
				section).</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H70465AFDC8E44E28A706030F85AACD40"><enum>(2)</enum><header>Table of
			 contents</header><text>The table of contents at the beginning of such Act is
			 amended by adding after the item relating to section 9536 the following new
			 item:</text>

			</paragraph></section><section id="H2C52F602D0204B42B64BEF6AC0E91DA7"><enum>4.</enum><header>State
			 Law</header>
			<subsection id="H9DB2CADE236B43A8924C62B6C4883CFA"><enum>(a)</enum><header>Amendment to
			 ESEA</header><text display-inline="yes-display-inline">The Elementary and
			 Secondary Education Act of 1965 is amended by inserting after section 9537 (as
			 added by section 3), the following:</text>
				<quoted-block display-inline="no-display-inline" id="H94E3B9EFCED24545AD7A49F50B75517D" style="OLC">
					<section id="H852CBBA30A6649E3AE62A796B2259C50"><enum>9538.</enum><header>State
				Law</header>
						<subsection id="HE7E4AB4C5C904EE5A60C1905E032AD74"><enum>(a)</enum><header>State law on
				reporting incidents of sexual conduct involving a minor</header><text display-inline="yes-display-inline">As a condition of receiving funds under
				this Act, a State shall have in effect and be enforcing a State law and State
				policy that, as determined by the Secretary, ensures the following:</text>
							<paragraph id="H12173FD4F758445AA97E92EBF76DA86A"><enum>(1)</enum><text display-inline="yes-display-inline">Individuals employed at a school located in
				the State report to law enforcement officials any known or suspected incidents
				of sexual conduct involving a minor and an individual employed at the school or
				any other school in the State.</text>
							</paragraph><paragraph id="H0E8736D4589F476CA2E33BD427E6AE52"><enum>(2)</enum><text>The State ensures
				that any individual who violates
				<internal-xref idref="H12173FD4F758445AA97E92EBF76DA86A" legis-path="9538.(a)(1)">paragraph (1)</internal-xref> by failing to report to
				law enforcement officials any such incidents is fined or otherwise
				penalized.</text>
							</paragraph><paragraph id="H3CC6A3F63E1346338BFFC142B2CB6D73"><enum>(3)</enum><text display-inline="yes-display-inline">The State makes available in an interstate
				clearinghouse to schools, local educational agencies, and State educational
				agencies, the identity of any individual—</text>
								<subparagraph id="H2A44F35DCD034B72AD413D1291EA9BEA"><enum>(A)</enum><text>who was reported
				under
				<internal-xref idref="H12173FD4F758445AA97E92EBF76DA86A" legis-path="9538.(a)(1)">paragraph (1)</internal-xref> as being involved in an
				incident of sexual conduct with a minor; and</text>
								</subparagraph><subparagraph id="H8D317625551E4876A6EDBA9D3080F426"><enum>(B)</enum><text>whose employment
				at a school in the State was terminated as a result of the incident.</text>
								</subparagraph></paragraph><paragraph id="HF203F59E4D9447AA8281E1C5262DC35E"><enum>(4)</enum><text display-inline="yes-display-inline">The State creates safeguards to ensure that
				the information described in
				<internal-xref idref="H3CC6A3F63E1346338BFFC142B2CB6D73" legis-path="9538.(a)(3)">paragraph (3)</internal-xref> is only made available
				to schools, local educational agencies, and State educational agencies, and not
				the general public.</text>
							</paragraph></subsection><subsection id="H694EE1DBD0CE4D619E731FBE25DE24F7"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary shall prescribe regulations
				on—</text>
							<paragraph id="HAB6CDA942B6A497D85FDB06ABB4B934F"><enum>(1)</enum><text>how a State shall
				carry out the requirements of subsection (a); and</text>
							</paragraph><paragraph id="H064EFEA3DFB7498A9BB46CEB70600556"><enum>(2)</enum><text display-inline="yes-display-inline">how a State shall report to the schools in
				the State, the termination of the employment at a school of an individual
				described in subsection (a)(3).</text>
							</paragraph></subsection><subsection id="H418A113C40F04CAA91ABE69370845AAF"><enum>(c)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
							<paragraph id="HAA7189E95C7C4051B17BC4A6159DB9C5"><enum>(1)</enum><header>Minor</header><text>The
				term <term>minor</term> means an individual who is under 18 years of age.</text>
							</paragraph><paragraph id="H4749C2F3CBDE4A66B6A1E8331796B0C0"><enum>(2)</enum><header>School</header><text>The
				term <term>school</term> means an entity that—</text>
								<subparagraph id="HAA9572103AB64D89857E574A32C9233E"><enum>(A)</enum><text>is a public or
				private—</text>
									<clause id="HCBD551783A5E4C8F9D43173F38348086"><enum>(i)</enum><text>day or residential
				elementary school or secondary school; or</text>
									</clause><clause id="H2CD655F7016F4E8FB3F21904BE257738"><enum>(ii)</enum><text>early childhood,
				elementary school, or secondary school program that is under the jurisdiction
				of a school, local educational agency, educational service agency, or other
				educational institution or program; and</text>
									</clause></subparagraph><subparagraph id="H5A09AF1185DB4F699ACF6A44DC90082C"><enum>(B)</enum><text>receives, or
				serves students who receive, support in any form from any program supported, in
				whole or in part, with funds appropriated to the Department of
				Education.</text>
								</subparagraph></paragraph><paragraph id="HEDC07C7EA87B4CC48313093BDF7B9DA2"><enum>(3)</enum><header>Sexual
				conduct</header><text display-inline="yes-display-inline">The term <term>sexual
				conduct</term> has the meaning given the term in section 1822 of title 18,
				United States
				Code.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
