			 tax holiday</header>
				<subsection id="HE6BE9B34B2FC4031B228E27324E92A85"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (c) of
			 section 601 of the Tax Relief, Unemployment Insurance Reauthorization, and Job
			 Creation Act of 2010 (26 U.S.C. 1401 note) is amended to read as
			 follows:</text>

						<subsection id="HDB6FD53B0D474818807B46E286411B80"><enum>(c)</enum><header>Payroll tax
				holiday period</header><text display-inline="yes-display-inline">The term
				<term>payroll tax holiday period</term> means—</text>
							<paragraph id="HF5CE9F2538E744A2B209186BAAFC5552"><enum>(1)</enum><text display-inline="yes-display-inline">in the case of the tax described in
				subsection (a)(1), calendar years 2011 and 2012, and</text>
							</paragraph><paragraph id="HB5AEA34B753C4B9AA38CA7506650800D"><enum>(2)</enum><text>in the case of the
				taxes described in subsection (a)(2), the period beginning January 1, 2011, and
				ending February 29,
				2012.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			 for 2012</header><text>Section 601 of such Act (26 U.S.C. 1401 note) is amended

								<subparagraph id="HE73E20D4FE9C46AEA0D9ED090E757B5D"><enum>(A)</enum><text>any taxable year
				beginning in 2012, subsection (a)(1) shall only apply with respect to so much
				of the taxpayer's self-employment income (as defined in section 1402(b) of the
				Internal Revenue Code of 1986) as does not exceed the excess (if any)
				of—</text>

									</clause><clause id="H4FE62457EA7A4FA891F803A598F0CFC2"><enum>(ii)</enum><text>the amount of
				wages and compensation taken into account under subparagraph (B), and</text>
									</clause></subparagraph><subparagraph id="H5A4C99938C274C25BC310B674AE5BB1F"><enum>(B)</enum><text>any remuneration
				received during the portion of the payroll tax holiday period occurring during
				2012, subsection (a)(2) shall only apply to so much of the sum of the
				taxpayer's wages (as defined in section 3121(a) of such Code) and compensation
				(as defined section 3231(e) of such Code) as does not exceed $18,350.</text>
								</subparagraph></paragraph><paragraph id="H5EA315CEEA714EFABBC01A24586C390E"><enum>(2)</enum><header>Coordination
				with deduction for employment taxes</header><text>In the case of a taxable year
				beginning in 2012, subparagraph (A) of subsection (b)(2) shall be applied as if
				it read as follows:</text>

				  exceed the amount of self-employment income described in paragraph (1)(A),
				  plus</text>
										</clause><clause id="HA9B04F54375E41E686A86D1CE38DDC00"><enum>(ii)</enum><text>one-half of the
				  portion of such taxes attributable to the tax imposed by section 1401(a) of
				  such Code (determined without regard to this section) on self-employment income
				  (as so defined) in excess of such amount,

			 general</header><text>Section 106(a) of division B of the Tax Relief and Health
			 Care Act of 2006 (42 U.S.C. 1395 note), as amended by section 117 of the
			 Medicare, Medicaid, and SCHIP Extension Act of 2007 (Public Law 110–173),
			 section 124 of the Medicare Improvements for Patients and Providers Act of 2008
			 (Public Law 110–275), sections 3137(a) and 10317 of the Patient Protection and
			 Affordable Care Act (Public Law 111–148), and section 102(a) of the Medicare
			 and Medicaid Extenders Act of 2010 (Public Law 111–309), is amended by striking

			 October and November 2011</header>
					<paragraph id="H2664EC0E7F204943920767E1700ED134"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), for purposes of implementation
			 of the amendment made by subsection (a), including for purposes of the
			 implementation of paragraph (2) of section 117(a) of the Medicare, Medicaid,
			 and SCHIP Extension Act of 2007 (Public Law 110–173), for the period beginning
			 on October 1, 2011, and ending on November 30, 2011, the Secretary of Health
			 and Human Services shall use the hospital wage index that was promulgated by
			 the Secretary of Health and Human Services in the Federal Register on August
			 18, 2011 (76 Fed. Reg. 51476), and any subsequent corrections.</text>
					</paragraph><paragraph id="H40F9FB428E224E0DAB352CAB186E76C6"><enum>(2)</enum><header>Exception</header><text>In
			 determining the wage index applicable to hospitals that qualify for wage index
			 reclassification, the Secretary shall, for the period beginning on October 1,
			 2011, and ending on November 30, 2011, include the average hourly wage data of
			 hospitals whose reclassification was extended pursuant to the amendment made by
			 subsection (a) only if including such data results in a higher applicable
			 reclassified wage index. Any revision to hospital wage indexes made as a result
			 of this paragraph shall not be effected in a budget neutral manner.</text>
					</paragraph></subsection><subsection id="H2F1ADDD3C8164A31A677CF91BAC5CF00"><enum>(c)</enum><header>Timeframe for
			 payments</header><text>The Secretary shall make payments required under
			 subsections (a) and (b) by not later than December 31, 2012.</text>

			 the qualifying individual (QI) program</header>
				<subsection id="H6CD4F38476A34D929D03F87C21C6157A"><enum>(a)</enum><header>Extension</header><text display-inline="yes-display-inline">Section 1902(a)(10)(E)(iv) of the Social
			 Security Act (42 U.S.C. 1396a(a)(10)(E)(iv)) is amended by striking
			 <quote>December 2011</quote> and inserting <quote>February 2012</quote>.</text>
				</subsection><subsection id="H3246B9C41EE04CB2BDAE79FD4E810257"><enum>(b)</enum><header>Extending total
			 amount available for allocation</header><text>Section 1933(g) of such Act (42
			 U.S.C. 1396u–3(g)) is amended—</text>

						</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HD8A8BCEF04144073BD65D6402B3B59CB" section-type="subsequent-section"><enum>311.</enum><header>Extension of
			 Transitional Medical Assistance (TMA)</header><text display-inline="no-display-inline">Sections 1902(e)(1)(B) and 1925(f) of the
			 Social Security Act (42 U.S.C. 1396a(e)(1)(B), 1396r–6(f)) are each amended by
			 striking <quote>December 31, 2011</quote> and inserting <quote>February 29,
			 2012</quote>.</text>
			</section><section id="H8BA0E4E6DB97483490A17A374EF91D43"><enum>312.</enum><header>Extension of
			 the temporary assistance for needy families program</header><text display-inline="no-display-inline">Activities authorized by part A of title IV
			 and section 1108(b) of the Social Security Act (other than under subsections
			 (a)(3) and (b) of section 403 of such Act) shall continue through February 29,
			 2012, in the manner authorized for fiscal year 2011, and out of any money in
			 the Treasury of the United States not otherwise appropriated, there are hereby
			 appropriated such sums as may be necessary for such purpose. Grants and
			 payments may be made pursuant to this authority through the applicable portion
			 of the second quarter of fiscal year 2012 at the pro rata portion of the level
			 provided for such activities through the second quarter of fiscal year
			 2011.</text>
			</section></title><title id="HDF091C9CDE5945E1B83D564831F392AB"><enum>IV</enum><header>Mortgage fees and
			 premiums</header>
			<section id="HE4F0AA26C87843B9A2DE42A5375C12DC"><enum>401.</enum><header>Guarantee
			 Fees</header><text display-inline="no-display-inline">Subpart A of part 2 of
			 subtitle A of title XIII of the Housing and Community Development Act of 1992
			 is amended by adding after section 1326 (12 U.S.C. 4546) the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="H7BA31913A3EA49CC88FC4093109213B8" style="OLC">
					<section id="H63DBE93AEBDF44FB9702342235DAA88A"><enum>1327.</enum><header>Enterprise
				guarantee fees</header>
						<subsection id="H3E50B5C489AA41E2A83009F547A77FC4"><enum>(a)</enum><header>Definitions</header><text>For
				purposes of this section, the following definitions shall apply:</text>
							<paragraph id="H74DD57D76BB7441A88A5518E9353C0CA"><enum>(1)</enum><header>Guarantee
				fee</header><text>The term <term>guarantee fee</term>—</text>
								<subparagraph id="HAC2E7C6B6C8B4E5BB9D8445F41C3877C"><enum>(A)</enum><text>means a fee
				described in subsection (b); and</text>
								</subparagraph><subparagraph id="HC2F32EB6A46D477FA311E2FCD5FDE137"><enum>(B)</enum><text>includes—</text>
									<clause id="HE7164BAA4FA84CCA9C7B1EF7B938005C"><enum>(i)</enum><text>the guaranty fee
				charged by the Federal National Mortgage Association with respect to
				mortgage-backed securities; and</text>
									</clause><clause id="HD9E7BD0E03BE4AA9B3FD00ED6D375B5A"><enum>(ii)</enum><text>the management
				and guarantee fee charged by the Federal Home Loan Mortgage Corporation with
				respect to participation certificates.</text>
									</clause></subparagraph></paragraph><paragraph id="H9C7B13817C7F413188FEB9BFC8FE3424"><enum>(2)</enum><header>Average
				fees</header><text>The term <term>average fees</term> means the average
				contractual fee rate of single-family guaranty arrangements by an enterprise
				entered into during 2011, plus the recognition of any up-front cash payments
				over an estimated average life, expressed in terms of basis points. Such
				definition shall be interpreted in a manner consistent with the annual report
				on guarantee fees by the Federal Housing Finance Agency.</text>
							</paragraph></subsection><subsection id="H460A1BB7F01E42878CDA7C23819D87AC"><enum>(b)</enum><header>Increase</header>
							<paragraph id="HAC42387051394EF8BEC8BE559F58B992"><enum>(1)</enum><header>In
				general</header>
								<subparagraph id="H7A3ACAFF546E4E9DB756B5E5D6DA4C74"><enum>(A)</enum><header>Phased increase
				required</header><text>Subject to subsection (c), the Director shall require
				each enterprise to charge a guarantee fee in connection with any guarantee of
				the timely payment of principal and interest on securities, notes, and other
				obligations based on or backed by mortgages on residential real properties
				designed principally for occupancy of from 1 to 4 families, consummated after
				the date of enactment of this section.</text>
								</subparagraph><subparagraph id="H69A35141B87344EEBD0A08DDB5884B13"><enum>(B)</enum><header>Amount</header><text>The
				amount of the increase required under this section shall be determined by the
				Director to appropriately reflect the risk of loss, as well the cost of capital
				allocated to similar assets held by other fully private regulated financial
				institutions, but such amount shall be not less than an average increase of 10
				basis points for each origination year or book year above the average fees
				imposed in 2011 for such guarantees. The Director shall prohibit an enterprise
				from offsetting the cost of the fee to mortgage originators, borrowers, and
				investors by decreasing other charges, fees, or premiums, or in any other
				manner.</text>
								</subparagraph></paragraph><paragraph id="H45BDCD583DE2425CBD8D8BC49A5445B9"><enum>(2)</enum><header>Authority to
				limit offer of guarantee</header><text>The Director shall prohibit an
				enterprise from consummating any offer for a guarantee to a lender for
				mortgage-backed securities, if—</text>
								<subparagraph id="H80D4CF83DFF14368AF0EE01BE08908F5"><enum>(A)</enum><text>the guarantee is
				inconsistent with the requirements of this section; or</text>
								</subparagraph><subparagraph id="HCCE5A76CE25C45E28EB1F7190ECA38AD"><enum>(B)</enum><text>the risk of loss
				is allowed to increase, through lowering of the underwriting standards or other
				means, for the primary purpose of meeting the requirements of this
				section.</text>
								</subparagraph></paragraph><paragraph id="H27A702DAACE44BDC94EDD963ABAD0DD0"><enum>(3)</enum><header>Deposit in
				Treasury</header><text>Amounts received from fee increases imposed under this
				section shall be deposited directly into the United States Treasury, and shall
				be available only to the extent provided in subsequent appropriations Acts. The
				fees charged pursuant to this section shall not be considered a reimbursement
				to the Federal Government for the costs or subsidy provided to an
				enterprise.</text>
							</paragraph></subsection><subsection id="HC856CEDFBB284AE8BD280A10494AE4D8"><enum>(c)</enum><header>Phase-In</header>
							<paragraph id="H5949E32EDBD6433A9C341BD402FC9598"><enum>(1)</enum><header>In
				general</header><text>The Director may provide for compliance with subsection
				(b) by allowing each enterprise to increase the guarantee fee charged by the
				enterprise gradually over the 2-year period beginning on the date of enactment
				of this section, in a manner sufficient to comply with this section. In
				determining a schedule for such increases, the Director shall—</text>
								<subparagraph id="H284FB71F5C9D48348ED77F7F1B6EE4B7"><enum>(A)</enum><text>provide for
				uniform pricing among lenders;</text>
								</subparagraph><subparagraph id="H6DF463D18ABB4D239CFCEF381B21F317"><enum>(B)</enum><text>provide for
				adjustments in pricing based on risk levels; and</text>
								</subparagraph><subparagraph id="H457E2426080745DB8E3A358983C8E0C0"><enum>(C)</enum><text>take into
				consideration conditions in financial markets.</text>
								</subparagraph></paragraph><paragraph id="H5478B12EA880469286659C4BA8C8D195"><enum>(2)</enum><header>Rule of
				construction</header><text>Nothing in this subsection shall be interpreted to
				undermine the minimum increase required by subsection (b).</text>
							</paragraph></subsection><subsection id="H17E50B33B16A4AC68DBDA819C25E7BBD"><enum>(d)</enum><header>Information
				collection and annual analysis</header><text>The Director shall require each
				enterprise to provide to the Director, as part of its annual report submitted
				to Congress—</text>
							<paragraph id="HFD3731FA6435424A961FACC397CC60A1"><enum>(1)</enum><text>a description
				of—</text>
								<subparagraph id="HE64B8A2D0E794E5A997A70E7956239D9"><enum>(A)</enum><text>changes made to
				up-front fees and annual fees as part of the guarantee fees negotiated with
				lenders;</text>
								</subparagraph><subparagraph id="HD2A1214E03A348F8872E693F99E439E9"><enum>(B)</enum><text>changes to the
				riskiness of the new borrowers compared to previous origination years or book
				years; and</text>
								</subparagraph><subparagraph id="H4372D9571C584560A34C6DC08CDE7C78"><enum>(C)</enum><text>any adjustments
				required to improve for future origination years or book years, in order to be
				in complete compliance with subsection (b); and</text>
								</subparagraph></paragraph><paragraph id="H3543182B5928411785359C270C7E7779"><enum>(2)</enum><text>an assessment of
				how the changes in the guarantee fees described in paragraph (1) met the
				requirements of subsection (b).</text>
							</paragraph></subsection><subsection id="HA17F1DED81C0429F92A75363CCBC5379"><enum>(e)</enum><header>Enforcement</header>
							<paragraph id="HBCD6405C46B24E3CAE8D4D45C3468783"><enum>(1)</enum><header>Required
				adjustments</header><text>Based on the information from subsection (d) and any
				other information the Director deems necessary, the Director shall require an
				enterprise to make adjustments in its guarantee fee in order to be in
				compliance with subsection (b).</text>
							</paragraph><paragraph id="H5B14DE91F6064BFC8DC4BB7F13D2A6D5"><enum>(2)</enum><header>Noncompliance
				penalty</header><text>An enterprise that has been found to be out of compliance
				with subsection (b) for any 2 consecutive years shall be precluded from
				providing any guarantee for a period, determined by rule of the Director, but
				in no case less than 1 year.</text>
							</paragraph><paragraph id="H1A91CB14A40F412F95D2C07D043041CB"><enum>(3)</enum><header>Rule of
				construction</header><text>Nothing in this subsection shall be interpreted as
				preventing the Director from initiating and implementing an enforcement action
				against an enterprise, at a time the Director deems necessary, under other
				existing enforcement authority.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H66610D83D9764E8495B7EB0E1D8ABFE2"><enum>(f)</enum><header>Expiration</header><text>The
				provisions of this section shall expire on October 1,
				2021.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HBE074184AE9D4381BD9CDE72753F98DC"><enum>402.</enum><header>FHA guarantee
			 fees</header>
				<subsection id="H83F7EEF14C8948D084DAFED631C7664E"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 203(c)(2) of the National Housing
			 Act (12 U.S.C. 1709(c)(2)) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H8FA61C905BDD4A87B6C3AB0FAC3E6D63" style="OLC">
						<subparagraph id="H4720461216AA4D7499F25A99C8CED1DC" indent="up1"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H8791FBC4475445B68E0DF16072F384C8"><enum>(i)</enum><text>In addition to the
				premiums under subparagraphs (A) and (B), the Secretary shall establish and
				collect annual premium payments for any mortgage for which the Secretary
				collects an annual premium payment under subparagraph (B), in an amount
				described in clause (ii).</text>
							</clause><clause id="H2E256E80D93545DD8E4B8EBB99F4BA0E" indent="up1"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H10872AD0170A4BA884F20B3A5CF6121E"><enum>(I)</enum><text>Subject to subclause
				(II), with respect to a mortgage, the amount described in this clause is 10
				basis points of the remaining insured principal balance (excluding the portion
				of the remaining balance attributable to the premium collected under
				subparagraph (A) and without taking into account delinquent payments or
				prepayments).</text>
								</subclause><subclause id="HEC1AAAA33E6E45B1B4BEAD45BA737F65" indent="up1"><enum>(II)</enum><text>During the 2-year period beginning on
				the date of enactment of this subparagraph, the Secretary shall increase the
				number of basis points of the annual premium payment collected under this
				subparagraph incrementally, as determined appropriate by the Secretary, until
				the number of basis points of the annual premium payment collected under this
				subparagraph is equal to the number described in subclause
				(I).</text>
								</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H9DA36515B2A746BCAE68446B76971C43"><enum>(b)</enum><header>Prospective
			 repeal</header><text>Section 203(c)(2) of the National Housing Act (12 U.S.C.
			 1709(c)(2)) is amended by striking subparagraph (C), as added by subsection
			 (a), effective on October 1, 2021.</text>
				</subsection><subsection id="H24199C654306449B9EE6ABEFF78408E2"><enum>(c)</enum><header>Report
			 required</header><text>Not later than 30 days before the date on which the
			 Secretary of Housing and Urban Development makes a determination under
			 subsection (b)(2), the Secretary shall submit to the Committee on Banking,
			 Housing, and Urban Affairs of the Senate and the Committee on Financial
			 Services of the House of Representatives a report that—</text>
					<paragraph id="HAB8C3730D56644CF9F88CF4E24631608"><enum>(1)</enum><text>explains the basis
			 for the determination; and</text>
					</paragraph><paragraph id="HE299F8E1EC7148A9B737C7993DBB920D"><enum>(2)</enum><text>identifies the
			 date on which the Secretary plans to make the determination.</text>
					</paragraph></subsection></section></title><title id="H0EC9590C7D764446A1AE317FEC0E8DFE"><enum>V</enum><header>Other
			 provisions</header>
			<subtitle id="H4130C35BA8E145F89B1A4BB3E43669A3"><enum>A</enum><header>Keystone XL
			 pipeline</header>
				<section commented="no" display-inline="no-display-inline" id="HC4870057642F472CB441ECF55C05D0BC" section-type="subsequent-section"><enum>501.</enum><header display-inline="yes-display-inline">Permit for Keystone XL pipeline</header>
					<subsection commented="no" display-inline="no-display-inline" id="H171AB898B3314BCBA3B4F3A036EB4DEB"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), not
			 later than 60 days after the date of enactment of this Act, the President,
			 acting through the Secretary of State, shall grant a permit under Executive
			 Order 13337 (3 U.S.C. 301 note; relating to issuance of permits with respect to
			 certain energy-related facilities and land transportation crossings on the
			 international boundaries of the United States) for the Keystone XL pipeline
			 project application filed on September 19, 2008 (including amendments).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H9556D48CA41445E8B12EC56B4C7BD625"><enum>(b)</enum><header display-inline="yes-display-inline">Exception</header>
						<paragraph commented="no" display-inline="no-display-inline" id="H7B10C5B2564C41E2A3B8545518E5D24A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The President shall not be required to
			 grant the permit under subsection (a) if the President determines that the
			 Keystone XL pipeline would not serve the national interest.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H970C4043C166457D8FAB145045282919"><enum>(2)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">If the President determines that the
			 Keystone XL pipeline is not in the national interest under paragraph (1), the
			 President shall, not later than 15 days after the date of the determination,
			 submit to the Committee on Foreign Relations of the Senate, the Committee on
			 Foreign Affairs of the House of Representatives, the majority leader of the
			 Senate, the minority leader of the Senate, the Speaker of the House of
			 Representatives, and the minority leader of the House of Representatives a
			 report that provides a justification for determination, including consideration
			 of economic, employment, energy security, foreign policy, trade, and
			 environmental factors.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1463A571288741CEAA5DBBD4B4E34ED8"><enum>(3)</enum><header display-inline="yes-display-inline">Effect of no finding or
			 action</header><text display-inline="yes-display-inline">If a determination is
			 not made under paragraph (1) and no action is taken by the President under
			 subsection (a) not later than 60 days after the date of enactment of this Act,
			 the permit for the Keystone XL pipeline described in subsection (a) that meets
			 the requirements of subsections (c) and (d) shall be in effect by operation of
			 law.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC0AA2AB73CC942FE814D749751DC4A52"><enum>(c)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The permit granted under subsection (a)
			 shall require the following:</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H849D0681C1374D4C892476B69E611719"><enum>(1)</enum><text display-inline="yes-display-inline">The permittee shall comply with all
			 applicable Federal and State laws (including regulations) and all applicable
			 industrial codes regarding the construction, connection, operation, and
			 maintenance of the United States facilities.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE0B385EB4973493BAFDF2A65F0715535"><enum>(2)</enum><text display-inline="yes-display-inline">The permittee shall obtain all requisite
			 permits from Canadian authorities and relevant Federal, State, and local
			 governmental agencies.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H14B3A3F10DA1467580122F45CC4BCAC0"><enum>(3)</enum><text display-inline="yes-display-inline">The permittee shall take all appropriate
			 measures to prevent or mitigate any adverse environmental impact or disruption
			 of historic properties in connection with the construction, operation, and
			 maintenance of the United States facilities.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7C1A2113BF4A4AA7B637ECBE3827F762"><enum>(4)</enum><text display-inline="yes-display-inline">For the purpose of the permit issued under
			 subsection (a) (regardless of any modifications under subsection (d))—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H4208102A8A7F4FD88B5527DAE6D23FB1"><enum>(A)</enum><text display-inline="yes-display-inline">the final environmental impact statement
			 issued by the Secretary of State on August 26, 2011, satisfies all requirements
			 of the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) and
			 section 106 of the National Historic Preservation Act (16 U.S.C. 470f);</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0073683D2BFD40AAB18D35F0F636CBCF"><enum>(B)</enum><text display-inline="yes-display-inline">any modification required by the Secretary
			 of State to the Plan described in paragraph (5)(A) shall not require
			 supplementation of the final environmental impact statement described in that
			 paragraph; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H76EC20FD8BFB4482BEBA4451CC4F5A7D"><enum>(C)</enum><text display-inline="yes-display-inline">no further Federal environmental review
			 shall be required.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5A51AA293F43429F8D12813C6817EB57"><enum>(5)</enum><text display-inline="yes-display-inline">The construction, operation, and
			 maintenance of the facilities shall be in all material respects similar to that
			 described in the application described in subsection (a) and in accordance
			 with—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H8BB0F7F68D2E43288BDD4D822E064A21"><enum>(A)</enum><text display-inline="yes-display-inline">the construction, mitigation, and
			 reclamation measures agreed to by the permittee in the Construction Mitigation
			 and Reclamation Plan found in appendix B of the final environmental impact
			 statement issued by the Secretary of State on August 26, 2011, subject to the
			 modification described in subsection (d);</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H546909196658492FB627A779285B5068"><enum>(B)</enum><text display-inline="yes-display-inline">the special conditions agreed to between
			 the permittee and the Administrator of the Pipeline Hazardous Materials Safety
			 Administration of the Department of Transportation found in appendix U of the
			 final environmental impact statement described in subparagraph (A);</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H82D52F2E52CE47028E4D0CB477CE4873"><enum>(C)</enum><text display-inline="yes-display-inline">if the modified route submitted by the
			 Governor of Nebraska under subsection (d)(3)(B) crosses the Sand Hills region,
			 the measures agreed to by the permittee for the Sand Hills region found in
			 appendix H of the final environmental impact statement described in
			 subparagraph (A); and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA98234A2B0E44855A0F241C67A0AAADC"><enum>(D)</enum><text display-inline="yes-display-inline">the stipulations identified in appendix S
			 of the final environmental impact statement described in subparagraph
			 (A).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAD628E5B47EE4E569EEBA9F31E9B2891"><enum>(6)</enum><text display-inline="yes-display-inline">Other requirements that are standard
			 industry practice or commonly included in Federal permits that are similar to a
			 permit issued under subsection (a).</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7F5A9D632DB747829AC39FDA63ABACF8"><enum>(d)</enum><header display-inline="yes-display-inline">Modification</header><text display-inline="yes-display-inline">The permit issued under subsection (a)
			 shall require—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H151ECE7EB6B947EFADBD3112145464CC"><enum>(1)</enum><text display-inline="yes-display-inline">the reconsideration of routing of the
			 Keystone XL pipeline within the State of Nebraska;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H832C4A7429304D0DAE80B4007B059713"><enum>(2)</enum><text display-inline="yes-display-inline">a review period during which routing within
			 the State of Nebraska may be reconsidered and the route of the Keystone XL
			 pipeline through the State altered with any accompanying modification to the
			 Plan described in subsection (c)(5)(A); and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD795386D99B3430C962E10413C8BA8C8"><enum>(3)</enum><text display-inline="yes-display-inline">the President—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="HA7ED0843A687428793B28CD1EB8DBD2B"><enum>(A)</enum><text display-inline="yes-display-inline">to coordinate review with the State of
			 Nebraska and provide any necessary data and reasonable technical assistance
			 material to the review process required under this subsection; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H875C2FEFC9EA41C29BC2DC30B99F9C30"><enum>(B)</enum><text display-inline="yes-display-inline">to approve the route within the State of
			 Nebraska that has been submitted to the Secretary of State by the Governor of
			 Nebraska.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC36D88E14E5146E493ED5607C889AA89"><enum>(e)</enum><header display-inline="yes-display-inline">Effect of no approval</header><text display-inline="yes-display-inline">If the President does not approve the route
			 within the State of Nebraska submitted by the Governor of Nebraska under
			 subsection (d)(3)(B) not later than 10 days after the date of submission, the
			 route submitted by the Governor of Nebraska under subsection (d)(3)(B) shall be
			 considered approved, pursuant to the terms of the permit described in
			 subsection (a) that meets the requirements of subsection (c) and this
			 subsection, by operation of law.</text>
					</subsection><subsection commented="no" id="H24633BA40A0646D5B81D3A898F223AF4"><enum>(f)</enum><header>Private property
			 savings clause</header><text>Nothing in this section alters the Federal, State,
			 or local processes or conditions in effect on the date of enactment of this Act
			 that are necessary to secure access from private property owners to construct
			 the Keystone XL pipeline.</text>
					</subsection></section></subtitle><subtitle id="H8D05C2D30FF14701BC4FD4ADC00A3DFD"><enum>B</enum><header>Budgetary
			 provisions</header>
				<section id="H5EFA7874EA04431B8E304743A42A8341"><enum>511.</enum><header>Senate point of
			 order against an emergency designation</header><text display-inline="no-display-inline">Section 314 of the Congressional Budget Act
			 of 1974 is amended by—</text>
					<paragraph id="H47EAB0D357D743FA8F4F288B955378CF"><enum>(1)</enum><text>redesignating
			 subsection (e) as subsection (f); and</text>
					</paragraph><paragraph id="H9B999DB515174A76B506B4BFA8F81D36"><enum>(2)</enum><text>inserting after
			 subsection (d) the following:</text>
						<quoted-block display-inline="no-display-inline" id="HA16C16670ADD4D79969BD4D77E116A7E" style="OLC">
							<subsection id="H049B802BD631496C9C051F920D98889E"><enum>(e)</enum><header>Senate point of
				order against an emergency designation</header>
								<paragraph id="H53B53C40DB044057AC18E9CF5B821E5A"><enum>(1)</enum><header>In
				general</header><text>When the Senate is considering a bill, resolution,
				amendment, motion, amendment between the Houses, or conference report, if a
				point of order is made by a Senator against an emergency designation in that
				measure, that provision making such a designation shall be stricken from the
				measure and may not be offered as an amendment from the floor.</text>
								</paragraph><paragraph id="H8D40CF102C534921A64F95164AAA8789"><enum>(2)</enum><header>Supermajority
				waiver and appeals</header>
									<subparagraph id="HD16861CFD9824314BCE348D4DC242830"><enum>(A)</enum><header>Waiver</header><text>Paragraph
				(1) may be waived or suspended in the Senate only by an affirmative vote of
				three-fifths of the Members, duly chosen and sworn.</text>
									</subparagraph><subparagraph id="H42BE011636DE4AE295B84DC13894159C"><enum>(B)</enum><header>Appeals</header><text>Appeals
				in the Senate from the decisions of the Chair relating to any provision of this
				subsection shall be limited to 1 hour, to be equally divided between, and
				controlled by, the appellant and the manager of the bill or joint resolution,
				as the case may be. An affirmative vote of three-fifths of the Members of the
				Senate, duly chosen and sworn, shall be required to sustain an appeal of the
				ruling of the Chair on a point of order raised under this subsection.</text>
									</subparagraph></paragraph><paragraph id="H514D526B00E9481DB81EB124D7673FD1"><enum>(3)</enum><header>Definition of an
				emergency designation</header><text>For purposes of paragraph (1), a provision
				shall be considered an emergency designation if it designates any item pursuant
				to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control
				Act of 1985.</text>
								</paragraph><paragraph id="H404B258D23604E3B9D7048F878D82DAC"><enum>(4)</enum><header>Form of the
				point of order</header><text>A point of order under paragraph (1) may be raised
				by a Senator as provided in section 313(e) of the Congressional Budget Act of
				1974.</text>
								</paragraph><paragraph id="H2ED9833FE60B41139E8615B026B9D96A"><enum>(5)</enum><header>Conference
				reports</header><text>When the Senate is considering a conference report on, or
				an amendment between the Houses in relation to, a bill, upon a point of order
				being made by any Senator pursuant to this section, and such point of order
				being sustained, such material contained in such conference report shall be
				deemed stricken, and the Senate shall proceed to consider the question of
				whether the Senate shall recede from its amendment and concur with a further
				amendment, or concur in the House amendment with a further amendment, as the
				case may be, which further amendment shall consist of only that portion of the
				conference report or House amendment, as the case may be, not so stricken. Any
				such motion in the Senate shall be debatable. In any case in which such point
				of order is sustained against a conference report (or Senate amendment derived
				from such conference report by operation of this subsection), no further
				amendment shall be in
				order.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="HB661AFD2C5854CB6AA47C7BAA7EB2129"><enum>512.</enum><header>PAYGO scorecard
			 estimates</header><text display-inline="no-display-inline">The budgetary
			 effects of this Act shall not be entered on either PAYGO scorecard maintained
			 pursuant to section 4(d) of the Statutory Pay-As-You-Go Act of 2010.</text>
