		<official-title>To amend the Controlled Substances Act to authorize
		  physicians, pursuant to an agreement with the Attorney General, to transport
		  controlled substances from a practice setting to another practice setting or to
		  a disaster area.</official-title>

		<section id="H5FBFDB510BFF479B8756EF70E980E2EB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medical Controlled Substances
			 Transportation Act of 2011</short-title></quote>.</text>
		</section><section id="H0C4218DF3D3C4A44AAB001C4616D3BB3"><enum>2.</enum><header>Transport by
			 physicians of controlled substances to another practice setting or to a
			 disaster area</header><text display-inline="no-display-inline">Section 303(f)
			 of the Controlled Substances Act (21 U.S.C. 823(f)) is amended—</text>
			<paragraph id="HDDA19E4B9AE741E994138223F9AF5130"><enum>(1)</enum><text>by redesignating
			 paragraphs (1) through (5) as subparagraphs (A) through (E);</text>
			</paragraph><paragraph id="H7ABDA93915264143A9AA98EFA10B641D"><enum>(2)</enum><text>by striking
			 <quote>(f) The Attorney General</quote> and inserting <quote>(f)(1) The
			 Attorney General</quote>; and</text>
			</paragraph><paragraph id="HBD9BF9486B304E4CB7E4491B0240DABA"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HCC86133697A44291B873820EDC70DE5E" style="OLC">
					<paragraph id="H5B29062B0C32455781350532E0F26103" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If a physician registered under paragraph
				(1) enters into an agreement with the Attorney General described in paragraph
				(3), the Attorney General shall authorize the physician to transport one or
				more controlled substances—</text>
						<subparagraph id="H0FCE41ECB2BC4C4D85C4DD643F58A660"><enum>(A)</enum><text>from a practice setting to another
				practice setting in order to administer the substances (under applicable State
				law) to one or more patients; or</text>
						</subparagraph><subparagraph id="H767D011DD3D044319C88585BEB8C6579"><enum>(B)</enum><text>from a practice setting to a disaster
				area in order to administer the substances (under applicable State law) for
				purposes of treating injuries or conditions resulting from a major
				disaster.</text>
						</subparagraph></paragraph><paragraph id="H654926AA0A4F4232974AC0A4F7A6A65C" indent="up1"><enum>(3)</enum><text>An agreement referred to in paragraph
				(2) shall require the physician—</text>
						<subparagraph id="H084609A092F448D1848851B92FD00099"><enum>(A)</enum><text>to notify the Attorney General in
				advance of any such transport;</text>
						</subparagraph><subparagraph id="HC44523441466456AA5706D07D3677AD3"><enum>(B)</enum><text>to identify in any such
				notification—</text>
							<clause id="HB86EEECA10174B169A715C801C3B174E"><enum>(i)</enum><text display-inline="yes-display-inline">the controlled substances to be
				transported;</text>
							</clause><clause id="HCF0FA5B1700B4CAFBB0F72B213AEC1E7"><enum>(ii)</enum><text>the practice setting from which
				the controlled substances will be transported;</text>
							</clause><clause id="HF8E0CBB5D74B409B9747F8F5BEC6D872"><enum>(iii)</enum><text>the practice setting or disaster
				area, as applicable, to which the controlled substances will be
				transported;</text>
							</clause><clause display-inline="no-display-inline" id="H4ECA20BEA8384CF98C334140EF55B3CB"><enum>(iv)</enum><text>the intended dates of
				transport;</text>
							</clause><clause id="H87E9C5D358AD430EB9E12B0B688F7A0E"><enum>(v)</enum><text>the anticipated travel time;
				and</text>
							</clause><clause id="H7010C970CB1845AD91EB58ED93903A68"><enum>(vi)</enum><text>the intended mode of
				transport;</text>
							</clause></subparagraph><subparagraph id="H67E4E00886704A36A728CCC932B943A9"><enum>(C)</enum><text display-inline="yes-display-inline">to
				limit the time of transport of any controlled substance pursuant to this
				paragraph (between practice settings or between a practice setting and a
				disaster area) to not more than 72 consecutive hours; and</text>
						</subparagraph><subparagraph id="H8766F140723249B5AE930074FBBA1F01"><enum>(D)</enum><text display-inline="yes-display-inline">to
				maintain records in the physician’s primary practice setting on the dispensing
				of any controlled substance transported pursuant to this paragraph, including
				identification of—</text>
							<clause id="H70D0B08EFABA4522BCF113C656B2F95D"><enum>(i)</enum><text>the location where the controlled
				substance was dispensed; and</text>
							</clause><clause id="HD472CA376EA84BDBB81A7CDEA78691D9"><enum>(ii)</enum><text>the quantity of the controlled
				substance dispensed.</text>
							</clause></subparagraph></paragraph><paragraph id="H9880557CB1B34A148673F750BA129CEF" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">For purposes of paragraphs (2) and
				(3):</text>
						<subparagraph id="HE01DC660B95D4915BECE80707643EBA2"><enum>(A)</enum><text>The term <term>disaster area</term>
				means the area for which the President has declared a major disaster, during
				the period of the declaration.</text>
						</subparagraph><subparagraph id="H5EC13E89C2904A7BB96E559680A630BB"><enum>(B)</enum><text display-inline="yes-display-inline">The term <term>major disaster</term> has
				the meaning given the term under section 102 of the Robert T. Stafford Disaster
				Relief and Emergency Assistance
				Act.</text>
