		<section id="H25ED8294F78B4A97A78A7D2D38E9920B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Research Works
			 Act</short-title></quote>.</text>
		</section><section id="H6CB7C4E41F024902A5156E92111870A4"><enum>2.</enum><header>Limitation on
			 Federal agency action</header><text display-inline="no-display-inline">No
			 Federal agency may adopt, implement, maintain, continue, or otherwise engage in
			 any policy, program, or other activity that—</text>
			<paragraph id="HC0F45CB604B541BCB650ACA8A6C3E442"><enum>(1)</enum><text>causes, permits,
			 or authorizes network dissemination of any private-sector research work without
			 the prior consent of the publisher of such work; or</text>
			</paragraph><paragraph id="H244572E408F648FA9B9D6C8D49656042"><enum>(2)</enum><text display-inline="yes-display-inline">requires that any actual or prospective
			 author, or the employer of such an actual or prospective author, assent to
			 network dissemination of a private-sector research work.</text>
			</paragraph></section><section id="H9684BEC885584B3DA1195A3A014BCE7D"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HB84C00934CAC41B48D53AE4B35CF72F3"><enum>(1)</enum><header>Author</header><text display-inline="yes-display-inline">The term <quote>author</quote> means a
			 person who writes a private-sector research work. Such term does not include an
			 officer or employee of the United States Government acting in the regular
			 course of his or her duties.</text>
			</paragraph><paragraph id="H3F81076290B9416583BBA8B728476061"><enum>(2)</enum><header>Network
			 dissemination</header><text display-inline="yes-display-inline">The term
			 <quote>network dissemination</quote> means distributing, making available, or
			 otherwise offering or disseminating a private-sector research work through the
			 Internet or by a closed, limited, or other digital or electronic network or
			 arrangement.</text>
			</paragraph><paragraph id="HD7121B32944A40F8A521B5DC0E8CEDB0"><enum>(3)</enum><header>Private-sector
			 research work</header><text display-inline="yes-display-inline">The term
			 <quote>private-sector research work</quote> means an article intended to be
			 published in a scholarly or scientific publication, or any version of such an
			 article, that is not a work of the United States Government (as defined in
			 section 101 of title 17, United States Code), describing or interpreting
			 research funded in whole or in part by a Federal agency and to which a
			 commercial or nonprofit publisher has made or has entered into an arrangement
			 to make a value-added contribution, including peer review or editing. Such term
			 does not include progress reports or raw data outputs routinely required to be
			 created for and submitted directly to a funding agency in the course of
			 research.</text>
