		  degree in Science, Engineering, Math or a technology-related

		<section id="H3BC8E6F38F9B4902B0C595CDB2A13C55" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Immigration and Naturalization
			 Investment Ventures for Engineering, Science, and Technology in America Act of
			 2011</short-title></quote> or <quote><short-title>INVEST
			 in America Act.</short-title></quote></text>
		</section><section id="H375B0E0740C94780B36DE5AF7A5BBF9B"><enum>2.</enum><header>Conditional
			 permanent resident status for certain STEM alien entrepreneurs, spouses, and
			 children</header><text display-inline="no-display-inline">The Immigration and
			 Nationality Act is amended by inserting after section 216A the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="HB43B022315634D7D9C6575A6F5FAF1B2" style="OLC">
				<section id="HF4E28DCA109549E9B090BDF5EF350A05"><enum>216B.</enum><header>Conditional
				permanent resident status for certain STEM alien entrepreneurs, spouses, and
				children</header>
					<subsection id="HE3E1F9E8E63D4CB0A7FD68267C0ACCC0"><enum>(a)</enum><header>In
				general</header>
						<paragraph id="HBF16A2DD29BA4E2FAF7892A105FA05C6"><enum>(1)</enum><header>Adjustment of
				status</header><text display-inline="yes-display-inline">Each fiscal year, the
				status of not more than 9,940 aliens having status under section
				101(a)(15)(F)(i) or 101(a)(15)(H)(i)(b) shall be adjusted to that of an alien
				lawfully admitted for permanent residence if each such alien files an
				application, at such time and in such manner as the Secretary of Homeland
				Security may require, that includes information sufficient to prove that the
				alien has fulfilled the following requirements:</text>
							<subparagraph id="HEE96E25E8B53400E97AEF6D97010698D"><enum>(A)</enum><text>The alien is in
				the process of completing, or has completed within the most recent 3 years
				preceding the date of application, a graduate level degree in science,
				technology, engineering, math or a related academic discipline from an
				accredited United States college, university or other institute of higher
				education.</text>
							</subparagraph><subparagraph id="HE4550EE914CF49ECA82FAAEBF2BD94C9"><enum>(B)</enum><text>The alien
				establishes and engages in a new commercial enterprise (including a limited
				partnership) that is relevant to the area of study of paragraph (1).</text>
							</subparagraph><subparagraph id="H8046C35179E94BD08808D4C11D1E15F4"><enum>(C)</enum><text>The alien submits
				a business plan (which may be updated and modified as a result of market
				conditions as long as the criteria specified in this section are met), which
				includes the creation of no less than 5 new full-time jobs and a minimum of 90
				total work months for United States citizens or aliens lawfully admitted for
				permanent residence or other immigrants lawfully authorized to be employed in
				the United States (other than the immigrant and the immigrant’s spouse, sons,
				or daughters) within 5 years and provides the prevailing wage level for the
				occupational classification in the area of employment.</text>
							</subparagraph><subparagraph id="H24A97947EC3C47909210220FC96EF051"><enum>(D)</enum><text>The alien is
				admissible as an immigrant, except that the numerical limitations of sections
				201 and 202 shall not apply to the adjustment of aliens to lawful permanent
				resident status under this subsection.</text>
							</subparagraph></paragraph><paragraph id="HD68DEC79FC004004B62746C1951CDEA1"><enum>(2)</enum><header>Conditional
				basis for status</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				Act, an alien entrepreneur (as defined in subsection (g)(1)), alien spouse, and
				alien child (as defined in subsection (g)(2)) shall be considered, at the time
				of obtaining the status of an alien lawfully admitted for permanent residence,
				to have obtained such status on a conditional basis subject to the provisions
				of this section.</text>
						</paragraph><paragraph id="H83C94B0D209B44CCB67193A370524892"><enum>(3)</enum><header>Notice of
				requirements</header>
							<subparagraph id="H9A26239A2E5E4B71BEEE461F689B8ED9"><enum>(A)</enum><header>At time of
				obtaining permanent residence</header><text display-inline="yes-display-inline">At the time an alien entrepreneur, alien
				spouse, or alien child obtains permanent resident status on a conditional basis
				under paragraph (1), the Secretary of Homeland Security shall provide for
				notice to such an entrepreneur, spouse, or child respecting the provisions of
				this section and the requirements of subsection (c)(1) to have the conditional
				basis of such status renewed, and the requirements of subsection (d)(1) to have
				the conditional basis of such status removed.</text>
							</subparagraph><subparagraph id="HEA8AEF2E3ECE4D34848F0BAF1C7127FF"><enum>(B)</enum><header>At time of
				required petition</header><text display-inline="yes-display-inline">In
				addition, the Secretary of Homeland Security shall attempt to provide notice to
				such an entrepreneur, spouse, or child, at or about the beginning of the 90-day
				period described in subsection (e)(2)(A), of the requirements of subsection
				(c)(1) and (d)(1).</text>
							</subparagraph><subparagraph id="HF7178D1B629A4F1F8ADF300B32956CB3"><enum>(C)</enum><header>Effect of
				failure to provide notice</header><text display-inline="yes-display-inline">The
				failure of the Secretary of Homeland Security to provide a notice under this
				paragraph shall not affect the enforcement of the provisions of this section
				with respect to such an entrepreneur, spouse, or child.</text>
							</subparagraph></paragraph></subsection><subsection id="H1E98E67594E14FDCA333C60D62AB5F78"><enum>(b)</enum><header>Termination of
				status if finding that qualifying entrepreneurship improper</header>
						<paragraph id="HD788BE91A25E494D88169831C5E34437"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of an
				alien entrepreneur with permanent resident status on a conditional basis under
				subsection (a), if the Secretary of Homeland Security determines, before the
				60-month anniversary of the alien's obtaining the status of lawful admission
				for permanent residence, that—</text>
							<subparagraph id="HC60C9530879E436DB2213FC1AB496EF4"><enum>(A)</enum><text display-inline="yes-display-inline">the establishment of the commercial
				enterprise was intended solely as a means of evading the immigration laws of
				the United States;</text>
							</subparagraph><subparagraph id="H1E4AA54C38A24E5987C35653E2D077D1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H9683F44BBB8E4A6DA02638097EAA9F03"><enum>(i)</enum><text display-inline="yes-display-inline">the alien did not establish and engage in a
				new commercial enterprise relevant to the graduate level degree in science,
				technology, engineering, math or a related academic discipline; or</text>
								</clause><clause id="HE407EF3AD1FE4B6EB8B44ED00E243D2B" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the alien was not sustaining the actions
				described in clause (i) throughout the period of the alien's residence in the
				United States; or</text>
								</clause></subparagraph><subparagraph id="H134C53F2BCD94402A69C52B58CEB9009"><enum>(C)</enum><text display-inline="yes-display-inline">the alien was otherwise not conforming to
				the requirements of this section, then the Secretary of Homeland Security shall
				so notify the alien involved and, subject to paragraph (2), shall terminate the
				permanent resident status of the alien (and the alien spouse and alien child)
				involved as of the date of the determination.</text>
							</subparagraph></paragraph><paragraph id="H799822A1179E48C9AD0149CBC1535245"><enum>(2)</enum><header>Hearing in
				removal proceeding</header><text display-inline="yes-display-inline">Any alien
				whose permanent resident status is terminated under paragraph (1) may request a
				review of such determination in a proceeding to remove the alien. In such
				proceeding, the burden of proof shall be on the Secretary of Homeland Security
				to establish, by a preponderance of the evidence, that a condition described in
				paragraph (1) is met.</text>
						</paragraph></subsection><subsection id="H46F0940566AB4616B8F7FEF93BECCF3E"><enum>(c)</enum><header>Requirements of
				Timely Petition and Interview for Renewal of Condition</header>
						<paragraph id="H5D46BE762B004B169FB4A6E0BDCE7973"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In order for the
				conditional basis established under subsection (a) for an alien entrepreneur,
				alien spouse, or alien child to be renewed—</text>
							<subparagraph id="H5272F844F8074EDDBCD833A1A5FE17DA"><enum>(A)</enum><text display-inline="yes-display-inline">the alien entrepreneur must submit to the
				Secretary of Homeland Security, during the period described in subsection
				(e)(2), a petition which requests the renewal of such conditional basis and
				which states, under penalty of perjury, the facts and information described in
				subsection (e)(1); and</text>
							</subparagraph><subparagraph id="H36EC515C7362410BA88786EB2EF243DC"><enum>(B)</enum><text>in accordance with
				subsection (e)(3), the alien entrepreneur must appear for a personal interview
				before an officer or employee of the Service respecting the facts and
				information described in subsection (e)(1).</text>
							</subparagraph></paragraph><paragraph id="HEE8D2901D0974968B014E472D4F79811"><enum>(2)</enum><header>Termination of
				permanent resident status for failure to file petition or have personal
				interview</header>
							<subparagraph id="H0BE6D913DEAD4BD5BE41D87A574FCA65"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of an
				alien with permanent resident status on a conditional basis under subsection
				(a), if—</text>
								<clause id="H747122A8F5B14C808F0C98AC3451EFCE"><enum>(i)</enum><text display-inline="yes-display-inline">no petition is filed with respect to the
				alien in accordance with the provisions of paragraph (1)(A); or</text>
								</clause><clause id="H13EE144123ED4021B4DAC025240D52B8"><enum>(ii)</enum><text>unless there is
				good cause shown, the alien entrepreneur fails to appear at the interview
				described in paragraph (1)(B) (if required under subsection (e)(3)), the
				Secretary of Homeland Security shall terminate the permanent resident status of
				the alien (and the alien's spouse and children if it was obtained on a
				conditional basis under this section) as of the 30 month anniversary of the
				alien's lawful admission for permanent residence.</text>
								</clause></subparagraph><subparagraph id="H7D409D244A9E42D5B9D6A3D27A283B78"><enum>(B)</enum><header>Hearing in
				removal proceeding</header><text display-inline="yes-display-inline">In any
				removal proceeding with respect to an alien whose permanent resident status is
				terminated under subparagraph (A), the burden of proof shall be on the alien to
				establish compliance with the conditions of paragraphs (1)(A) and
				(1)(B).</text>
							</subparagraph></paragraph><paragraph id="H8C93033F180749F4B0294C1FF357D291"><enum>(3)</enum><header>Determination
				after petition and interview</header>
							<subparagraph id="HEF6A60BDA2C94905B68066745222B171"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">If—</text>
								<clause id="H3DBB7ADA4B4B47FCB578DE27177D4468"><enum>(i)</enum><text display-inline="yes-display-inline">a petition is filed in accordance with the
				provisions of paragraph (1)(A); and</text>
								</clause><clause id="H081032793D1148A8B9465BBFD653AAD8"><enum>(ii)</enum><text>the alien
				entrepreneur appears at any interview described in paragraph (1)(B), the
				Secretary of Homeland Security shall make a determination, within 90 days of
				the date of the such filing or interview (whichever is later), as to whether
				the facts and information described in subsection (e)(1) and alleged in the
				petition are true with respect to the qualifying commercial enterprise.</text>
								</clause></subparagraph><subparagraph id="H9216A341A6F648C683F42F81EFB48826"><enum>(B)</enum><header>Renewal of
				conditional basis if favorable determination</header><text display-inline="yes-display-inline">If the Secretary of Homeland Security
				determines that such facts and information are true, the Secretary of Homeland
				Security shall so notify the alien involved and shall renew the conditional
				basis of the alien's status effective as of the 30 month anniversary of the
				alien's lawful admission for permanent residence.</text>
							</subparagraph><subparagraph id="HE7ADAA93871F4A308AE8F5B90691DB2D"><enum>(C)</enum><header>Termination if
				adverse determination</header><text display-inline="yes-display-inline">If the
				Secretary of Homeland Security determines that such facts and information are
				not true, the Secretary of Homeland Security shall so notify the alien involved
				and, subject to subparagraph (D), shall terminate the permanent resident status
				of an alien entrepreneur, alien spouse, or alien child as of the date of the
				determination.</text>
							</subparagraph><subparagraph id="H2964F3104F2A408CB4C3969E55911D45"><enum>(D)</enum><header>Hearing in
				removal proceeding</header><text display-inline="yes-display-inline">Any alien
				whose permanent resident status is terminated under subparagraph (C) may
				request a review of such determination in a proceeding to remove the alien. In
				such proceeding, the burden of proof shall be on the Secretary of Homeland
				Security to establish, by a preponderance of the evidence, that the facts and
				information described in subsection (e)(1) and alleged in the petition are not
				true with respect to the qualifying commercial enterprise.</text>
							</subparagraph></paragraph></subsection><subsection id="HA12000C984954C19A22BB730EB181184"><enum>(d)</enum><header>Requirements of
				Timely Petition and Interview for Removal of Condition</header>
						<paragraph id="H43BE44E3C4CC4BD1A6E2EB1C9EFDDCCD"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In order for the
				conditional basis established under subsection (a) for an alien entrepreneur,
				alien spouse, or alien child to be removed—</text>
							<subparagraph id="H807CF1CA985C42AFB41DD6DFA8A7F333"><enum>(A)</enum><text display-inline="yes-display-inline">the alien entrepreneur must submit to the
				Secretary of Homeland Security, during the period described in subsection
				(e)(2), a petition which requests the removal of such conditional basis and
				which states, under penalty of perjury, the facts and information described in
				subsection (e)(1); and</text>
							</subparagraph><subparagraph id="H5E477140E24F4EBE8C74B3C7F09FB2F3"><enum>(B)</enum><text>in accordance with
				subsection (e)(3), the alien entrepreneur must appear for a personal interview
				before an officer or employee of the Service respecting the facts and
				information described in subsection (e)(1).</text>
							</subparagraph></paragraph><paragraph id="H97E9D3B6949347B7B000BC0376261A4C"><enum>(2)</enum><header>Termination of
				permanent resident status for failure to file petition or have personal
				interview</header>
							<subparagraph id="H0441E27E82CC4A4D8DC01FC8FE5CF7DD"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of an
				alien with permanent resident status on a conditional basis under subsection
				(a), if—</text>
								<clause id="H0AA4CB90DB834343879D7C1F107A5B35"><enum>(i)</enum><text display-inline="yes-display-inline">no petition is filed with respect to the
				alien in accordance with the provisions of paragraph (1)(A); or</text>
								</clause><clause id="H1D2F1AC7A72E4186AF30FF6B85E4ED21"><enum>(ii)</enum><text>unless there is
				good cause shown, the alien entrepreneur fails to appear at the interview
				described in paragraph (1)(B) (if required under subsection (e)(3)), the
				Secretary of Homeland Security shall terminate the permanent resident status of
				the alien (and the alien's spouse and children if it was obtained on a
				conditional basis under this section) as of the 60 month anniversary of the
				alien's lawful admission for permanent residence.</text>
								</clause></subparagraph><subparagraph id="H6F6507142C3044F1B21FAA189108E810"><enum>(B)</enum><header>Hearing in
				removal proceeding</header><text display-inline="yes-display-inline">In any
				removal proceeding with respect to an alien whose permanent resident status is
				terminated under subparagraph (A), the burden of proof shall be on the alien to
				establish compliance with the conditions of paragraphs (1)(A) and
				(1)(B).</text>
							</subparagraph></paragraph><paragraph id="H018B83FFCD124E6585C0C57E824CB009"><enum>(3)</enum><header>Determination
				after petition and interview</header>
							<subparagraph id="H60602FE4528F45C189E38F11F60EB47C"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">If—</text>
								<clause id="HD963371B04F949C79343DC061B191148"><enum>(i)</enum><text display-inline="yes-display-inline">a petition is filed in accordance with the
				provisions of paragraph (1)(A); and</text>
								</clause><clause id="H7769CAB59A754A67A458B5606E441EA1"><enum>(ii)</enum><text>the alien
				entrepreneur appears at any interview described in paragraph (1)(B), the
				Secretary of Homeland Security shall make a determination, within 90 days of
				the date of the such filing or interview (whichever is later), as to whether
				the facts and information described in subsection (e)(1) and alleged in the
				petition are true with respect to the qualifying commercial enterprise.</text>
								</clause></subparagraph><subparagraph id="H53FA06D3A5014ACF81A791521F47466E"><enum>(B)</enum><header>Removal of
				conditional basis if favorable determination</header><text display-inline="yes-display-inline">If the Secretary of Homeland Security
				determines that such facts and information are true, the Secretary of Homeland
				Security shall so notify the alien involved and shall remove the conditional
				basis of the alien's status effective as of the 60 month anniversary of the
				alien's lawful admission for permanent residence.</text>
							</subparagraph><subparagraph id="H11D03410467942DEACBD9DE32CDAFF1F"><enum>(C)</enum><header>Termination if
				adverse determination</header><text display-inline="yes-display-inline">If the
				Secretary of Homeland Security determines that such facts and information are
				not true, the Secretary of Homeland Security shall so notify the alien involved
				and, subject to subparagraph (D), shall terminate the permanent resident status
				of an alien entrepreneur, alien spouse, or alien child as of the date of the
				determination.</text>
							</subparagraph><subparagraph id="HEF8C0B1C0E1E4766B124FAF81E4890D8"><enum>(D)</enum><header>Hearing in
				removal proceeding</header><text display-inline="yes-display-inline">Any alien
				whose permanent resident status is terminated under subparagraph (C) may
				request a review of such determination in a proceeding to remove the alien. In
				such proceeding, the burden of proof shall be on the Secretary of Homeland
				Security to establish, by a preponderance of the evidence, that the facts and
				information described in subsection (e)(1) and alleged in the petition are not
				true with respect to the qualifying commercial enterprise.</text>
							</subparagraph></paragraph></subsection><subsection id="HBCAE0E49689C485DB20ABEAD9FDBC24E"><enum>(e)</enum><header>Details of
				Petition and Interview</header>
						<paragraph id="H80807E071EC04550B4CD472945C861B9"><enum>(1)</enum><header>Contents of
				petition</header>
							<subparagraph id="H637B7BCF55B649328051CCBD0A6E7045"><enum>(A)</enum><text display-inline="yes-display-inline">Each petition under subsection (c)(1)(A)
				shall contain facts and information demonstrating that the alien—</text>
								<clause id="H7BB491AE20664A58A78B424C6B33BD63"><enum>(i)</enum><text display-inline="yes-display-inline">established and engaged in a new commercial
				enterprise relevant to the graduate level degree in science, technology,
				engineering, math or a related academic discipline;</text>
								</clause><clause id="H202966EA2C40448C9F4FFFC7864695C7"><enum>(ii)</enum><text>sustained the
				actions described in clause (i) throughout the period of the alien's residence
				in the United States; and</text>
								</clause><clause id="H686AFEC9F37A440886BD5A1F024ECDDB"><enum>(iii)</enum><text display-inline="yes-display-inline">either—</text>
									<subclause id="H7198ABBBE54F432BA397097361EE5325"><enum>(I)</enum><text>created no less
				than 2 new full-time jobs for United States citizens or aliens lawfully
				admitted for permanent residence or other immigrants lawfully authorized to be
				employed in the United States (other than the immigrant and the immigrant’s
				spouse, sons, or daughters) for the duration of a 6-month minimum prior to the
				filing of the petition and provides the prevailing wage level for the
				occupational classification in the area of employment; or</text>
									</subclause><subclause id="H64779A2450174DD0BF2E78AA83352344"><enum>(II)</enum><text>invested not less
				than $200,000 in the new commercial enterprise.</text>
									</subclause></clause></subparagraph><subparagraph id="H15E0E5FD58754951B98C588A20CA0DC5"><enum>(B)</enum><text display-inline="yes-display-inline">Each petition under subsection (d)(1)(A)
				shall contain facts and information demonstrating that the alien—</text>
								<clause id="H97FF171FB9784CB7A1049F5A1DC6937E"><enum>(i)</enum><text display-inline="yes-display-inline">established and engaged in a new commercial
				enterprise relevant to the graduate level degree in science, technology,
				engineering, math or a related academic discipline;</text>
								</clause><clause id="H45622CAC11F9460D92514AADAB1C9CBF"><enum>(ii)</enum><text>sustained the
				actions described in clause (i) throughout the period of the alien's residence
				in the United States; and</text>
								</clause><clause id="H164F2F8FBD9A4C18A3C4DAB028B352C3"><enum>(iii)</enum><text>either—</text>
									<subclause id="HCCF57F104A0C444A9A44D5BFD9566D5A"><enum>(I)</enum><text>created no less
				than 5 new full-time jobs and a minimum of 90 total work months for a United
				States citizens or aliens lawfully admitted for permanent residence or other
				immigrants lawfully authorized to be employed in the United States (other than
				the immigrant and the immigrant’s spouse, sons, or daughters) within 5 years
				and provides the prevailing wage level for the occupational classification in
				the area of employment; or</text>
									</subclause><subclause id="H5C191DD2E3A840E2AE0BBC579789A63D"><enum>(II)</enum><text>invested not less
				than $500,000 in the new commercial enterprise.</text>
									</subclause></clause></subparagraph><subparagraph id="H017F517F9C5240D19E0A3A235C67A107"><enum>(C)</enum><text display-inline="yes-display-inline">is otherwise conforming to the requirements
				of this section.</text>
							</subparagraph></paragraph><paragraph id="HD352912003594FD8B02B16CD4E219CC6"><enum>(2)</enum><header>Period for
				filing petition</header>
							<subparagraph id="H4CC90F00AFD64560B2F8603E1D96118F"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				subparagraph (B)—</text>
								<clause id="HF74ACF9A5BE640B48738A03AA9779C42"><enum>(i)</enum><text display-inline="yes-display-inline">the petition under subsection (c)(1)(A)
				must be filed during the 90-day period before the 36 month anniversary of the
				alien's lawful admission for permanent residence; and</text>
								</clause><clause id="HC70B52EED0CC4F24A6622571F5096796"><enum>(ii)</enum><text>the petition
				under subsection (d)(1)(A) must be filed during the 90-day period before the 60
				month anniversary of the alien's lawful admission for permanent
				residence.</text>
								</clause></subparagraph><subparagraph id="H48807F94A2C74267B4450F523CA9C174"><enum>(B)</enum><header>Date petitions
				for good cause</header><text display-inline="yes-display-inline">Such a
				petition may be considered if filed after such date, but only if the alien
				establishes to the satisfaction of the Secretary of Homeland Security good
				cause and extenuating circumstances for failure to file the petition during the
				period described in subparagraph (A).</text>
							</subparagraph><subparagraph id="HAE1836A951454210B3C170744E170955"><enum>(C)</enum><header>Filing of
				petitions during removal</header><text display-inline="yes-display-inline">In
				the case of an alien who is the subject of removal hearings as a result of
				failure to file a petition on a timely basis in accordance with subparagraph
				(A), the Secretary of Homeland Security may stay such removal proceedings
				against an alien pending the filing of the petition under subparagraph
				(B).</text>
							</subparagraph></paragraph><paragraph id="H29E8B6852E904E31B4795607E3B354D4"><enum>(3)</enum><header>Personal
				interview</header><text display-inline="yes-display-inline">The interview under
				subsection (c)(1)(B) and (d)(1)(B) shall be conducted within 90 days after the
				date of submitting a petition under subsection (c)(1)(A) and (d)(1)(A),
				respectively, and at a local office of the Service, designated by the Secretary
				of Homeland Security, which is convenient to the parties involved. The
				Secretary of Homeland Security, in the Secretary of Homeland Security's
				discretion, may waive the deadline for such an interview or the requirement for
				such an interview in such cases as may be appropriate.</text>
						</paragraph></subsection><subsection id="H76140F1AC5BD4AD88F395F45B939024D"><enum>(f)</enum><header>Treatment of
				Period for Purposes of Naturalization</header><text display-inline="yes-display-inline">For purposes of title III, in the case of
				an alien who is in the United States as a lawful permanent resident on a
				conditional basis under this section, the alien shall be considered to have
				been admitted as an alien lawfully admitted for permanent residence and to be
				in the United States as an alien lawfully admitted to the United States for
				permanent residence.</text>
					</subsection><subsection id="H0CE09C18775646ACAC043F6D8A720C48"><enum>(g)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
						<paragraph id="H50E4C64F423B4120A4DC210BA9C81122"><enum>(1)</enum><header>Alien
				entrepreneur</header><text display-inline="yes-display-inline">The term
				<quote>alien entrepreneur</quote> means an alien who obtains the status of an
				alien lawfully admitted for permanent residence (whether on a conditional basis
				or otherwise) under this section.</text>
						</paragraph><paragraph id="H86A5823FEFA74718A59170DDAD30B8AF"><enum>(2)</enum><header>Alien spouse;
				alien child</header><text display-inline="yes-display-inline">The term
				<quote>alien spouse</quote> and the term <quote>alien child</quote> mean an
				alien who obtains the status of an alien lawfully admitted for permanent
				residence (whether on a conditional basis or otherwise) by virtue of being the
				spouse or child, respectively, of an alien entrepreneur.</text>
						</paragraph><paragraph id="HD68C15BB90494EF1AAD5A7AB2CBFEA3F"><enum>(3)</enum><header>Commercial
				Enterprise</header><text>The term <quote>commercial enterprise</quote> includes
				a limited partnership.</text>
						</paragraph><paragraph id="H9EAF388F40224D418335A960BEA4C8A2"><enum>(4)</enum><header>Investment</header><text>The
				term <quote>investment</quote> includes investments by venture capitalists,
				qualified angel investors, or the entrepreneur, and also includes reinvested
				profits.</text>
						</paragraph><paragraph id="HC8CBEE8648B646B9B3F3D5FD8440452D"><enum>(5)</enum><header>Full-time
				employment</header><text>The term <quote>full-time employment</quote> means
				employment in a position that requires at least 35 hours of service per week at
				any time, regardless of who fills the
				position.</text>
						</paragraph></subsection></section><after-quoted-block>.
				</after-quoted-block></quoted-block>
		</section><section id="HB104A24849874E36901E8A965F4764AB"><enum>3.</enum><header>Government
			 Accountability Office Study</header>
			<subsection id="H85995CB91F1A43F6BBB814CBB0C2F3D6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 5
			 years after the date of enactment of this Act, and again not later than 10
			 years after the date of enactment, the Comptroller General of the United States
			 shall submit to Congress a report on the entrepreneur-based immigrant category
			 established under section 216B of the Immigration and Nationality Act.</text>
			</subsection><subsection id="H8E54B67FDA1F4EF6B18001BD5F4700BF"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">A report described in subsection (a) shall
			 include information regarding—</text>
				<paragraph id="H4578D0254AF841108C72CC31824A9997"><enum>(1)</enum><text display-inline="yes-display-inline">the number of immigrant entrepreneurs who
			 have obtained conditional permanent residency under the entrepreneur-based
			 immigrant category;</text>
				</paragraph><paragraph id="H2C766DD6EB6F4BA697783C338AC575A2"><enum>(2)</enum><text>the number of jobs
			 created through the program;</text>
				</paragraph><paragraph id="H85EEF63E61134A76A861CEFC911F2378"><enum>(3)</enum><text>the titles and
			 wages of the created employment positions;</text>
				</paragraph><paragraph id="H5E1C602E5ADA4308B4650386868666CE"><enum>(4)</enum><text>the length of
			 employment for the created employment positions;</text>
				</paragraph><paragraph id="H9EC5FD8D751D4BFFB57DF77CB3D74BE8"><enum>(5)</enum><text>the number of
			 immigrant entrepreneurs who were approved for removal of conditional permanent
			 residence status at the end of the 5 year conditional status period;</text>
				</paragraph><paragraph id="H1AFD7603C95841C8B47A2EDC6AECA04E"><enum>(6)</enum><text display-inline="yes-display-inline">the economic impact of the commercial
			 activity generated in the United States as a result of immigrant entrepreneurs;
			 and</text>
				</paragraph><paragraph id="H70C9CB845521447395CC43D23F7DA2AE"><enum>(7)</enum><text>any additional
			 information regarding the effects of the Program.</text>
				</paragraph></subsection></section><section id="H4626221C7BC849D69D3F9FBF34109C9A"><enum>4.</enum><header>Recruit, Retain,
			 and Invest Strategic Plan</header>
			<subsection id="H1920B9E71F7F4F29B4D55E8ED581DD3B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 2
			 years after the date of the enactment of this Act, the Secretary of Homeland
			 Security, the Secretary of Commerce, and the Secretary of Education shall
			 jointly submit a strategic plan to be known as the <quote>Recruitment,
			 Retainment, and Investment Strategic Plan</quote> to Congress.</text>
			</subsection><subsection id="HA232DF9852554EEDB831F70F51E35DEE"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The strategic plan described in subsection
			 (a) shall study and recommend coordinated strategies to attract the highest
			 skilled and most talented foreign nationals to immigrate to the United States
			 in order to create American jobs and grow the United States economy.</text>
