<official-title display="yes">To amend title 28, United States Code, to clarify and improve certain provisions relating to the removal of litigation against Federal officers or agencies to Federal courts, and for other purposes.</official-title>

<section id="HB49FDA632D004E0D8DAC43EB2DDFCFBA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Removal Clarification Act of 2011</short-title></quote>.</text> </section> 
<section id="HCB024E2A252A4F9CA7E52EF2B6B2D9B3"><enum>2.</enum><header>Removal of certain litigation to Federal courts</header> 
<subsection id="HFB05C5755EC64C95ACDD153B9040CFE5"><enum>(a)</enum><header>Clarification of inclusion of certain types of proceedings</header><text display-inline="yes-display-inline">Section 1442 of title 28, United States Code, is amended—</text> 
<paragraph id="HC410B3E743B246DEB3B17B4340E29CA7"><enum>(1)</enum><text>in subsection (a), in the matter preceding paragraph (1)—</text> 
<subparagraph id="H1BB69A08B6A04C48840D0C9D11FDF23A"><enum>(A)</enum><text>by inserting <quote>that is</quote> after <quote>or criminal prosecution</quote>;</text> </subparagraph> 
<subparagraph id="HE10609B2A4D74DE1A7BB69D5AC0E17B8"><enum>(B)</enum><text>by inserting <quote>and that is</quote> after <quote>in a State court</quote>; and</text> </subparagraph> 
<subparagraph id="H45B560F5B8E24CB48B22B581594FFC2F"><enum>(C)</enum><text>by inserting <quote>or directed to</quote> after <quote>against</quote>; and</text> </subparagraph></paragraph> 
<paragraph id="H1C5C84D15BF84E008E0398B903F77AA6"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="H0546E91184B049F5A4F07335A65C8B07"><enum>(c)</enum><text>As used in subsection (a), the terms <quote>civil action</quote> and <quote>criminal prosecution</quote> include any proceeding (whether or not ancillary to another proceeding) to the extent that in such proceeding a judicial order, including a subpoena for testimony or documents, is sought or issued. If removal is sought for a proceeding described in the previous sentence, and there is no other basis for removal, only that proceeding may be removed to the district court.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="HC396AAED944D4624815F68D0B345E5F1"><enum>(b)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Section 1442(a) of title 28, United States Code, is amended—</text> 
<paragraph id="HF63E6174673F4D05A08C779D807FE5ED"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="H5B0585833AEA400AB161717F78774733"><enum>(A)</enum><text>by striking <quote>capacity for</quote> and inserting <quote>capacity, for or relating to</quote>; and</text> </subparagraph> 
<subparagraph id="H0806C8C17E1D4AAEA80F3CAEC2B3C94B"><enum>(B)</enum><text>by striking <quote>sued</quote>; and</text> </subparagraph></paragraph> 
<paragraph id="H6B7D1DC72B6942EE8537311E9B617EB5"><enum>(2)</enum><text>in each of paragraphs (3) and (4), by inserting <quote>or relating to</quote> after <quote>for</quote>.</text> </paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H6A1C609DAB514DF288B61F7F8A004E95"><enum>(c)</enum><header>Application of timing requirement</header><text display-inline="yes-display-inline">Section 1446 of title 28, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HB60D8C65F65B4E59848766C29A98BD05" style="OLC"> 
<subsection id="HD0C39D2169B64C53999FD41BE67EC17C"><enum>(g)</enum><text display-inline="yes-display-inline">Where the civil action or criminal prosecution that is removable under section 1442(a) is a proceeding in which a judicial order for testimony or documents is sought or issued or sought to be enforced, the 30-day requirement of subsections (b) and (c) is satisfied if the person or entity desiring to remove the proceeding files the notice of removal not later than 30 days after receiving, through service, notice of any such proceeding.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="HCF5F4C191D4A47A194718D40C7CE39C2"><enum>(d)</enum><header>Reviewability on appeal</header><text>Section 1447(d) of title 28, United States Code, is amended by inserting <quote>1442 or</quote> before <quote>1443</quote>.</text> </subsection></section>
