		<official-title>To amend the Workforce Investment Act of 1998 to increase
		  business engagement and improve training opportunities for occupations that are
		  in-demand in order to get Americans back to work.</official-title>

		<section id="H5B9FB5F7FB17408F8C6840B7D2EF9FFD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Local Job Opportunities and Business
			 Success Act of 2011</short-title></quote>.</text>
		</section><section id="HA5001D5362DB447C9EDC6CC493E30612"><enum>2.</enum><header>Definition of
			 Industry or sector partnership</header><text display-inline="no-display-inline">Section 101 of the Workforce Investment Act
			 of 1998 (29 U.S.C. 2801) is amended—</text>
			<paragraph id="H5E15C70875C34336B3DDCBC9E800EFC2"><enum>(1)</enum><text>by redesignating
			 paragraphs (18) through (53) as paragraphs (19) through (54), respectively;
			 and</text>
			</paragraph><paragraph id="H2579B12BC1794CBA82FD843CA9D31ADC"><enum>(2)</enum><text>by inserting after
			 paragraph (17) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H70CE6E7985A04CD0AAA7C5E80A1D7191" style="OLC">
					<paragraph id="H5A638D99812440628493C63AA4EB8590"><enum>(18)</enum><header>Industry or
				Sector Partnership</header><text display-inline="yes-display-inline">The term
				<term>industry or sector partnership</term> means a partnership of a State or
				local board and one or more industries and other entities that can help
				determine the immediate and long-term skilled workforce needs of in-demand
				industries and other occupations important to the State or local
				economy.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H2C8522163A6E43DEB1BE10CB5B3D03DE"><enum>3.</enum><header>Functions of the
			 local board</header><text display-inline="no-display-inline">Section 117 of the
			 Workforce Investment Act of 1998 (29 U.S.C. 2832) is amended—</text>
			<paragraph id="H5D178708A1D8421C867A5E949F6AB2F5"><enum>(1)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="H7DC25B1B70344079AD0B0DBF5CCD42ED"><enum>(A)</enum><text>in subparagraph
			 (A) of paragraph (2)—</text>
					<clause id="HA40FFFE85057408587B9C38CFE200E5C"><enum>(i)</enum><text>by
			 striking <quote>include—</quote> and all that follows through
			 <quote>representatives</quote> and inserting <quote>include
			 representatives</quote>;</text>
					</clause><clause id="HE7BCF7CBC98640D3ABBE07CAACE7BA73"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking clauses (ii) through
			 (vi);</text>
					</clause><clause id="H1A6CCC3B68834599811A700A42996E3F"><enum>(iii)</enum><text>by
			 redesignating subclauses (I) through (III) as clauses (i) through (iii),
			 respectively;</text>
					</clause><clause id="H07E01936C10542E0AD4F5BA706C7E80E"><enum>(iv)</enum><text>by
			 striking clause (ii) (as so redesignated) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="HA2E57F1DFBA04EFB95B49B6575AB9A2B" style="OLC">
							<clause id="H91C53E39DFEF473FB8903F013EFB3F1E"><enum>(ii)</enum><text display-inline="yes-display-inline">represent businesses, including large and
				small businesses, with immediate and long-term employment opportunities in
				in-demand industries and other occupations important to the local economy;
				and</text>
							</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</clause><clause id="H37E39B757F2148C1B8C8F0AEE1DEF8EC"><enum>(v)</enum><text display-inline="yes-display-inline">by striking the semicolon at the end of
			 clause (iii) (as so redesignated) and inserting <quote>; and</quote>;
			 and</text>
					</clause></subparagraph><subparagraph id="H35D573DEFFD94A83B0EBDF89CEFCA138"><enum>(B)</enum><text>in paragraph (4),
			 by striking <quote>A majority</quote> and inserting <quote>A
			 <fraction>2/3</fraction> majority</quote>;</text>
				</subparagraph></paragraph><paragraph id="HE50973C1AB2D4649ABE94EE85B64BAF3"><enum>(2)</enum><text>by amending
			 subsection (d) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H953679D08DF440D195078C2B057946AB" style="OLC">
					<subsection id="H5B059FCB70294336A303ABC5B5D5F4A2"><enum>(d)</enum><header>Functions of
				Local Board</header><text display-inline="yes-display-inline">The functions of
				the local board shall include the following:</text>
						<paragraph id="H72544CAAAE054500BEE86E18AA52AEA9"><enum>(1)</enum><header>Local
				Plan</header><text>Consistent with section 118, each local board, in
				partnership with the chief elected official for the local area involved, shall
				develop and submit a local plan to the Governor.</text>
						</paragraph><paragraph id="H37C5842123AB4479961435018B462190"><enum>(2)</enum><header>Workforce
				Research and Regional Labor Market Analysis</header>
							<subparagraph id="H66F0E75691084A1DB7C2A15471332848"><enum>(A)</enum><header>In
				general</header><text>The local board shall—</text>
								<clause id="HA8B844C2AD2D40DF915CBA65A08F3810"><enum>(i)</enum><text>conduct, and
				regularly update, an analysis of—</text>
									<subclause id="HEE6C344E3AB24C4C96BA7165D5097EBF"><enum>(I)</enum><text>the economic
				conditions in the local area;</text>
									</subclause><subclause id="HE153689E77DB4794B9C5DAF6431129DE"><enum>(II)</enum><text>the immediate and
				long-term skilled workforce needs of in-demand industries and other occupations
				important to the local economy;</text>
									</subclause><subclause id="H72A70237F65645A7B5A01277700F0A6A"><enum>(III)</enum><text>the knowledge
				and skills of the workforce in the local area; and</text>
									</subclause><subclause id="H40647DEB1B0C4027A77832F05E67EB75"><enum>(IV)</enum><text>workforce
				development activities (including education and training) in the local area;
				and</text>
									</subclause></clause><clause id="H3CEE3F700D4D407584637979303589D2"><enum>(ii)</enum><text>assist the
				Governor in developing the statewide workforce and labor market information
				system described in section 15(e) of the Wagner-Peyser Act.</text>
								</clause></subparagraph><subparagraph id="HFC8CB3046A8E473191DE31CDC161AADA"><enum>(B)</enum><header>Existing
				analysis</header><text>A local board may use existing analysis by the local
				economic development agency or related entity in order to carry out
				requirements of subparagraph (A)(i).</text>
							</subparagraph></paragraph><paragraph id="HD83FFBBB85A24955A71EF5E1C4047678"><enum>(3)</enum><header>Employer
				Engagement</header><text>The local board shall lead efforts to engage employers
				in the local area, including small employers and employers in in-demand
				industries and occupations important to the local economy, including by—</text>
							<subparagraph id="H74AAE801D6ED4FD890B91FF892771BCE"><enum>(A)</enum><text>ensuring that
				workforce investment activities meet the needs of employers and support
				economic growth in the local area, by enhancing communication, coordination,
				and collaboration among employers, economic development entities, and service
				providers;</text>
							</subparagraph><subparagraph id="HC9DA9E8F06F84091AFAD3DA14F5C3C50"><enum>(B)</enum><text>developing
				effective linkages (including the use of intermediaries) with employers in the
				local area to support employer utilization of the local workforce development
				system and to support local workforce investment activities; and</text>
							</subparagraph><subparagraph id="H632607B529F54FFCAB9A4BAD3DCE7BBA"><enum>(C)</enum><text>developing and
				implementing industry or sector partnerships that lead to collaborative
				planning, resource alignment, and training efforts across multiple firms to
				address the immediate and long-term skilled workforce needs of in-demand
				industries and other occupations important to the local economy and to address
				critical skill gaps within and across industries.</text>
							</subparagraph></paragraph><paragraph id="H77182B14CCA14003BEEDB85B751B93D0"><enum>(4)</enum><header>Budget and
				Administration</header>
							<subparagraph id="H9468F876D0924BFD88EDB6EFE769DB7F"><enum>(A)</enum><header>Budget</header>
								<clause id="H2BDE11F127AF492898ABF8D6476BF30C"><enum>(i)</enum><header>In
				general</header><text>The local board shall develop a budget for the activities
				of the local board in the local area, consistent with the requirements of this
				subsection.</text>
								</clause><clause id="HCB036B269733428297347C72D58478F9"><enum>(ii)</enum><header>Training
				reservation</header><text>In developing a budget under clause (i), the local
				board shall reserve a percentage of funds to carry out the activities specified
				in section 134(d)(4). The local board shall use the analysis conducted under
				paragraph (2)(A)(i) to determine the appropriate percentage to reserve under
				this clause.</text>
								</clause></subparagraph><subparagraph id="H699C705C0D004817B8B42B010F12FDFC"><enum>(B)</enum><header>Administration</header>
								<clause id="HE919E791624D4BE89DECBB17047D6BCE"><enum>(i)</enum><header>Grant
				Recipient</header>
									<subclause id="H274463B4957E4C59976F84CEACCDFAA4"><enum>(I)</enum><header>In
				general</header><text>The chief elected official in a local area shall serve as
				the local grant recipient for, and shall be liable for any misuse of, the grant
				funds allocated to the local area under sections 128 and 133, unless the chief
				elected official reaches an agreement with the Governor for the Governor to act
				as the local grant recipient and bear such liability.</text>
									</subclause><subclause id="HF89A45DB5DE84701A77CDED5F29F1685"><enum>(II)</enum><header>Designation</header><text>In
				order to assist in administration of the grant funds, the chief elected
				official or the Governor, where the Governor serves as the local grant
				recipient for a local area, may designate an entity to serve as a local grant
				subrecipient for such funds or as a local fiscal agent. Such designation shall
				not relieve the chief elected official or the Governor of the liability for any
				misuse of grant funds as described in subclause (I).</text>
									</subclause><subclause id="H8F576406DF594E8189F2620F6E988665"><enum>(III)</enum><header>Disbursal</header><text>The
				local grant recipient or an entity designated under subclause (II) shall
				disburse the grant funds for workforce investment activities at the direction
				of the local board, pursuant to the requirements of this title. The local grant
				recipient or entity designated under subclause (II) shall disburse the funds
				immediately on receiving such direction from the local board.</text>
									</subclause></clause><clause id="HCBB3BDA378FE4A948105413D522C9443"><enum>(ii)</enum><header>Staff</header><text>The
				local board may employ staff to assist in carrying out the functions described
				in this subsection.</text>
								</clause><clause id="H49D19A9F220648F78EC8341F76C00039"><enum>(iii)</enum><header>Grants and
				Donations</header><text>The local board may solicit and accept grants and
				donations from sources other than Federal funds made available under this
				Act.</text>
								</clause></subparagraph></paragraph><paragraph id="H0559D297CCD94A469CCA7099B6C215E8"><enum>(5)</enum><header>Selection of
				Operators and Providers</header>
							<subparagraph id="HB13EE5FA1DB74B9BB72C1906A13B28B5"><enum>(A)</enum><header>Selection of
				One-Stop Operators</header><text>Consistent with section 121(d), the local
				board, with the agreement of the chief elected official—</text>
								<clause id="HB8FCD9BA53BF43069595ACE6E0D6DC14"><enum>(i)</enum><text>shall designate or
				certify one-stop operators as described in section 121(d)(2)(A); and</text>
								</clause><clause id="HC0A37649AB9C4EAEA8D2E7283ACC2287"><enum>(ii)</enum><text>may terminate for
				cause the eligibility of such operators.</text>
								</clause></subparagraph><subparagraph id="H28072EB66D3A43CA936780471C1C803F"><enum>(B)</enum><header>Identification
				of Eligible Service Providers</header><text>Consistent with this subtitle, the
				local board shall identify eligible service providers, including providers of
				services described in section 134(d)(4), in the local area.</text>
							</subparagraph></paragraph><paragraph id="HC3D15C361EFE4BDD8CE01EB11F3B8634"><enum>(6)</enum><header>Program
				Oversight</header><text>The local board, in partnership with the chief elected
				official, shall be responsible for—</text>
							<subparagraph id="H7F9CF11C53E44545ACC15DB948BCC85C"><enum>(A)</enum><text>conducting
				oversight for local employment and training activities authorized under section
				134(d);</text>
							</subparagraph><subparagraph id="H7176B94385244C43B5C5598647908344"><enum>(B)</enum><text>conducting
				oversight of the one-stop delivery system in the local area authorized under
				section 121; and</text>
							</subparagraph><subparagraph id="HE2D8AB49B4B1416894C3144BD2EF868D"><enum>(C)</enum><text>ensuring the
				appropriate use and management of the funds provided for such activities under
				this title.</text>
							</subparagraph></paragraph><paragraph id="H9797F12D153C4841A9FBD2682F01F92E"><enum>(7)</enum><header>Negotiation of
				Local Performance Measures</header><text>The local board, the chief elected
				official, and the Governor shall negotiate and reach agreement on local
				performance measures as described in section 136(c).</text>
						</paragraph><paragraph id="HA9A9F62ABE9348A7B1F298D1D2CC3553"><enum>(8)</enum><header>Technology
				Improvements</header><text>The local board shall develop strategies for
				technology improvements to facilitate access to services authorized under this
				subtitle and carried out in the local area, including in remote
				areas.</text>
						</paragraph></subsection><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H25A2B0DC1EE44649BDC510B98A68665B"><enum>(3)</enum><text>in subsection
			 (e)—</text>
				<subparagraph id="HDB7EE528E09B42769B8BD1E582248F0A"><enum>(A)</enum><text>by inserting
			 <quote>electronic means and</quote> after <quote>regular basis through</quote>;
			 and</text>
				</subparagraph><subparagraph id="HEE09FFFB76514C8BA2796D48022EF839"><enum>(B)</enum><text>by striking
			 <quote>and the award of grants or contracts to eligible providers of youth
			 activities,</quote>;</text>
				</subparagraph></paragraph><paragraph id="HD1D9FD332563465C83BB2EB057A5132E"><enum>(4)</enum><text>by striking
			 subsection (h) and redesignating subsection (i) as subsection (h); and</text>
			</paragraph><paragraph id="H14570E2FB0F04EDBA03C8098F873993D"><enum>(5)</enum><text>in subsection (i)
			 (as so redesignated), by striking <quote>and paragraphs (1) and (2) of
			 subsection (h)</quote> each place it appears.</text>
			</paragraph></section><section id="H887DE37973DE4DB4BC7B0488858007D9"><enum>4.</enum><header>Contents of the
			 local plan</header><text display-inline="no-display-inline">Section 118(b) of
			 the Workforce Investment Act of 1998 (29 U.S.C. 2832(b)) is amended to read as
			 follows:</text>
			<quoted-block display-inline="no-display-inline" id="H3F6AF73132464F9E912867AEF8354F42" style="OLC">
				<subsection id="H315A1D06FD3A4198AFEC020D21FA96A1"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The local plan shall include—</text>
					<paragraph id="H2A451393C8AE4B76B6E595EBAB9428D7"><enum>(1)</enum><text>a description of
				the analysis of the local area’s economic and workforce conditions conducted
				under section 117(d)(2)(A)(i), and an assurance that the local board will use
				such analysis to carry out the activities under this subtitle;</text>
					</paragraph><paragraph id="HCE0B6C589DAA4566B99BB9377D6188E8"><enum>(2)</enum><text>a description of
				the one-stop delivery system in the local area, including—</text>
						<subparagraph id="HBA2D6E5A878E475EB3C2AC6E07A627F6"><enum>(A)</enum><text>a description of
				how the local board will ensure the continuous improvement of eligible
				providers of services through the system and ensure that such providers meet
				the employment needs of local employers and participants; and</text>
						</subparagraph><subparagraph id="H93C711FFA3E643D282BD14E9B6EED31C"><enum>(B)</enum><text>a description of
				how the local board will facilitate access to services provided through the
				one-stop delivery system consistent with section 117(d)(8);</text>
						</subparagraph></paragraph><paragraph id="HF3F4C1FB4E1B4E448D81EA3104A1EE42"><enum>(3)</enum><text>a description of
				the strategies and services that will be used in the local area—</text>
						<subparagraph id="H915625DF2BB043F994A59E00684A6D2E"><enum>(A)</enum><text>to more fully
				engage employers, including small employers and employers in in-demand
				industries and occupations important to the local economy;</text>
						</subparagraph><subparagraph id="H24C1C665CCB74EBE9C1977AFE09457EB"><enum>(B)</enum><text>to meet the needs
				of businesses in the local area; and</text>
						</subparagraph><subparagraph id="H053C1D70128148778F8CAE2D701BB37F"><enum>(C)</enum><text>to better
				coordinate workforce development programs with economic development;</text>
						</subparagraph></paragraph><paragraph id="HB1AD4A101D024A2DA0AE0BEFCE03F625"><enum>(4)</enum><text>a description of
				how the local board will convene (or help to convene) industry or sector
				partnerships that lead to collaborative planning, resource alignment, and
				training efforts across multiple firms for a range of workers employed or
				potentially employed by a targeted industry cluster—</text>
						<subparagraph id="H106258E354EC436BAB5AF525B8DC46AA"><enum>(A)</enum><text>to encourage
				industry growth and competitiveness and to improve worker training, retention,
				and advancement in targeted industry clusters;</text>
						</subparagraph><subparagraph id="HCC2ECE8943884EF093B33C3DFA94BE2E"><enum>(B)</enum><text>to address the
				immediate and long-term skilled workforce needs of in-demand industries and
				other occupations important to the local economy, and</text>
						</subparagraph><subparagraph id="H3E4EC347896143C6999FCEB2918914C4"><enum>(C)</enum><text>to address
				critical skill gaps within and across industries;</text>
						</subparagraph></paragraph><paragraph id="H30EB9180755142F5B378CFEFB2AE873E"><enum>(5)</enum><text>a description of
				how the funds reserved under section 117(d)(4)(A)(ii) will be used to carry out
				activities described in section 134(d)(4);</text>
					</paragraph><paragraph id="HB3C06F93FC3041798989E33EEB6D7C9E"><enum>(6)</enum><text>a description of
				how the local board will coordinate workforce investment activities carried out
				in the local area with statewide activities, as appropriate;</text>
					</paragraph><paragraph id="H05DDE85904CC4BE19E76FDF47653D832"><enum>(7)</enum><text>a description of
				how the local area will—</text>
						<subparagraph id="HCAAFD0C897484D909A54B384D28B685E"><enum>(A)</enum><text>coordinate
				activities with the local area’s disability community to make available
				comprehensive, high-quality services to individuals with disabilities;</text>
						</subparagraph><subparagraph id="H793827B073B649488CB112FC9F00D489"><enum>(B)</enum><text>consistent with
				section 188 and Executive Order 13217 (42 U.S.C. 12131 note), serve the
				employment and training needs of individuals with disabilities; and</text>
						</subparagraph><subparagraph id="HFE50846AEF2B408B9B00EAC821190935"><enum>(C)</enum><text>consistent with
				sections 504 and 508 of the Rehabilitation Act of 1973, include the provision
				of outreach, intake, assessments, and service delivery, the development of
				performance measures, the training of staff, and other aspects of accessibility
				to programs and services under this subtitle;</text>
						</subparagraph></paragraph><paragraph id="H25169FBB4F2642B4A84591B7329CF4A1"><enum>(8)</enum><text>a description of
				the local levels of performance negotiated with the Governor and chief elected
				official pursuant to section 136(c), to be—</text>
						<subparagraph id="H6A6B7623B1654DD2AF8E9FF5CF94AC13"><enum>(A)</enum><text>used to measure
				the performance of the local area; and</text>
						</subparagraph><subparagraph id="H1663A09651934E40A254A26F71403BA5"><enum>(B)</enum><text>used by the local
				board for measuring performance of the local fiscal agent (where appropriate),
				eligible providers, and the one-stop delivery system, in the local area;</text>
						</subparagraph></paragraph><paragraph id="H1F6EC2CF54E5474DAC4E15991785E3BE"><enum>(9)</enum><text>a description of
				the process used by the local board, consistent with subsection (c), to provide
				an opportunity for public comment prior to submission of the plan;</text>
					</paragraph><paragraph id="HA5E18343B5A34CC0AC7E82E7F0C10115"><enum>(10)</enum><text>an identification
				of the entity responsible for the disbursal of grant funds described in
				subclause (III) of section 117(d)(4)(B)(i), as determined by the chief elected
				official or the Governor under such section; and</text>
					</paragraph><paragraph id="H8CB3F15D993448F2972F90A7E08CB628"><enum>(11)</enum><text>such other
				information as the Governor may
				require.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
