			 Infrastructure</committee-name>, for a period to be subsequently determined by
			 the Speaker, in each case for consideration of such provisions as fall within
			 the jurisdiction of the committee concerned</action-desc>

		<official-title>To consolidate and streamline redundant and ineffective
		  Federal workforce development programs to increase accountability, reduce
		  administrative bureaucracies, and put Americans back to work.</official-title>

		<section id="HFE5CAAF068EB4374BCDA691E09DF3991" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Streamlining Workforce Development
			 Programs Act of 2011</short-title></quote>.</text>
		</section><section id="H4BA9F469D4EC4052B099036263ADEB50"><enum>2.</enum><header>References</header><text display-inline="no-display-inline">Except as otherwise expressly provided,
			 wherever in this Act an amendment or repeal is expressed in terms of an
			 amendment to, or repeal of, a section or other provision, the amendment or
			 repeal shall be considered to be made to a section or other provision of the
			 Workforce Investment Act of 1998 (20 U.S.C. 9201 et seq.).</text>
		</section><section id="H320DCF9339114EFDBB60294CA1848A8E"><enum>3.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">Except as otherwise
			 provided, this Act and the amendments made by this Act shall be effective with
			 respect to fiscal year 2013 and succeeding fiscal years.</text>
		</section><title id="HA91295B76E0D458CA52DE729C3E8672D"><enum>I</enum><header>Amendments to the
			 Workforce Investment Act</header>
			<section id="H1CB6F05FF6294F6B9966043ED84C8C86"><enum>101.</enum><header>State Workforce
			 Investment Boards</header><text display-inline="no-display-inline">Section 111
			 is amended—</text>
				<paragraph id="H1AA5FBAA1E3C49D5AD8AADA0F933AB46"><enum>(1)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="H7EF76E860D1E4AF5B54771CDDEB839A0"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
						<clause id="H43980E4150D24BEAB8CF849DF2EEF81F"><enum>(i)</enum><text>by
			 striking subparagraph (B);</text>
						</clause><clause id="H6993B6D7B5AE4BAAB7AAAA88F9785794"><enum>(ii)</enum><text>by
			 redesignating subparagraph (C) as subparagraph (B); and</text>

			 paragraph (3) to read as follows:</text>

							<paragraph id="H85A70C9258114FA5829506306860EBB2"><enum>(3)</enum><header>Majority</header><text display-inline="yes-display-inline">A <fraction>2/3</fraction> majority of the
				members of the board shall be representatives described in paragraph
				(1)(C)(i).</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HB84DAA22AA91416BA0794BF23B487196"><enum>(2)</enum><text>by amending
			 subsection (d) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H36699EC3DCA9437AB8CA5CB2F19F6B8E" style="OLC">
						<subsection id="H0F68A7E00DC04A96B47F160517A85991"><enum>(d)</enum><header>Functions</header><text>The
				State board shall assist the Governor of the State as follows:</text>
							<paragraph id="HB335C7AA188245A2B9EB7B82A4638B2F"><enum>(1)</enum><header>State
				plan</header><text>Consistent with section 112, develop a State plan.</text>
							</paragraph><paragraph id="H003AA421C39E467D8EDC9ABD7AD8EFA6"><enum>(2)</enum><header>Statewide
				Workforce Development System</header><text>Review and develop statewide
				policies and programs in the State in a manner that supports a comprehensive
				Statewide workforce development system that will result in meeting the
				workforce needs of the State and its local areas. Such review shall include
				determining whether the State should consolidate additional programs into the
				Workforce Investment Fund under section 132(b)(1).</text>
							</paragraph><paragraph id="HA8728A22B6B14001B875C6D59ACF3455"><enum>(3)</enum><header>Workforce and
				Labor Market Information System</header><text display-inline="yes-display-inline">Develop a statewide employment statistics
				system described in section 15(e) of the Wagner-Peyser Act, which may include
				using existing information conducted by the State economic development agency
				or related entity in developing such system.</text>
							</paragraph><paragraph id="HC259DFA07BAD46F8B75508E313519D49"><enum>(4)</enum><header>Employer
				Engagement</header><text>Develop strategies across local areas that meet the
				needs of employers and support economic growth in the State by enhancing
				communication, coordination, and collaboration among employers, economic
				development entities, and service providers.</text>
							</paragraph><paragraph id="HFBE2C9E953704B61B7D318F278AD3E08"><enum>(5)</enum><header>Designation of
				local areas</header><text>Designate local areas as required under section
				116.</text>
							</paragraph><paragraph id="HC27C3BE8511D406B984C013B1A0A34DD"><enum>(6)</enum><header>One-stop
				delivery system</header><text>Identify and disseminate information on best
				practices for effective operation of one-stop centers, including use of
				innovative business outreach, partnerships, and service delivery
				strategies.</text>
							</paragraph><paragraph id="H991B86CDEE98422F8DCEB53E8D28F6C4"><enum>(7)</enum><header>Program
				Oversight</header><text>Conduct the following program oversight:</text>
								<subparagraph id="HB09F58EBCB164461821CB17C7295DF97"><enum>(A)</enum><text>Reviewing local
				plans.</text>
								</subparagraph><subparagraph id="HCC516CD4DC6E4DB79DA5E41E39EB96A4"><enum>(B)</enum><text>Conducting
				oversight for State employment and training activities authorized under section
				134.</text>
								</subparagraph><subparagraph id="H2BA72BAFA03A4BC3A8D96BCD366862C6"><enum>(C)</enum><text>Preparing an
				annual report to the Secretary described in section 136(d).</text>
								</subparagraph></paragraph><paragraph id="H8A00AC99572A45DC93BFEFE03FE8EBFD"><enum>(8)</enum><header>Development of
				Performance Measures</header><text>Develop and ensure continuous improvement of
				comprehensive State performance measures, including State adjusted levels of
				performance, to assess under section 136(b) the effectiveness of the workforce
				investment activities in the State.</text>
							</paragraph></subsection><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H28703BD2A7234931B7FC50A335E5D27F"><enum>(3)</enum><text>by striking
			 subsection (e);</text>
				</paragraph><paragraph id="H242813399FA24B85A028A053204740B4"><enum>(4)</enum><text>by redesignating
			 subsection (f) as subsection (e);</text>

				skills of the workforce in the State; and</text>
								</subparagraph><subparagraph id="H48B40C1C9B514F55B61596C48CD07083"><enum>(D)</enum><text>workforce
				development activities (including education and training) in the
				State;</text>
								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HE8E41A51984C421589AC99B3C8352667"><enum>(B)</enum><text>by amending
			 paragraph (7) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H730F067FDB214F19A46532DF7F739EE3" style="OLC">
							<paragraph id="HC0AD11C9C3F94F45B405C117318B3F9C"><enum>(7)</enum><text display-inline="yes-display-inline">a description of the State criteria for
				determining the eligibility of training providers in accordance with section
				122, including how the State will take into account the performance of
				providers and whether the training programs relate to occupations that are
				in-demand;</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HB687958868AE4E4A8EF12906127D1D32"><enum>(C)</enum><text>by amending
			 paragraph (8) to read as follows:</text>

				duplication among, the programs and activities identified under section

				description of common data collection and reporting processes used for the
				programs and activities described in subparagraph (A) carried out by one-stop
				partners, including—</text>

				quarterly wage records for performance measures described in section
				136(b)(2)(A) that are applicable to such programs or activities; or</text>

				used for the performance measures, an identification of the barriers to using
				such wage records and a description of how the State will address such barriers
				within one year of the approval of the

									<clause id="H878BF08C753F40BAB5166A6BFCAC7318"><enum>(v)</enum><text>a
				description of how the State will—</text>
										<subclause id="HA0A72B3FE1C1461FA4B3055685F7E891"><enum>(I)</enum><text>consistent with
				section 188 and Executive Order 13217 (42 U.S.C. 12131 note), serve the
				employment and training needs of individuals with disabilities; and</text>
										</subclause><subclause id="H89605E007C564274A1AADB95EB6A06E9"><enum>(II)</enum><text>consistent with
				sections 504 and 508 of the Rehabilitation Act of 1973, include the provision
				of outreach, intake, assessments, and service delivery, the development of
				performance measures, the training of staff, and other aspects of accessibility
				to programs and services under this
				subtitle;</text>
										</subclause></clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
							</subclause></clause><clause id="H9D5D4607DD0540CDA8E2221967882F61"><enum>(ii)</enum><text>in
			 subparagraph (B), by striking <quote>to the extent practicable</quote> and
			 inserting <quote>in accordance with the requirements of the Jobs for Veterans
			 Act (Public Law 107–288) and the amendments made by such Act (except sections
			 4103A and 4104 of title 38, United States Code)</quote>;</text>
						</clause></subparagraph><subparagraph id="HE007C223D3564C1EAA1ABAAEE216DA2D"><enum>(I)</enum><text>by striking
			 paragraph (17) (as so redesignated) and inserting the following:</text>

							<paragraph id="H1937289DCFD645A78BEDDC34FB5A1967"><enum>(17)</enum><text>a description of
				the strategies and programs providing outreach to businesses, identifying
				workforce needs of businesses in the State, and ensuring that such needs will
				be met (including the needs of small businesses), which may include—</text>
								<subparagraph id="H843FDF412D4143509CA791D5CE4280BC"><enum>(A)</enum><text>implementing
				innovative programs and strategies designed to meet the needs of all businesses
				in the State, including small businesses, which may include incumbent worker
				training programs or industry or sector partnerships, and make the statewide
				workforce investment system more relevant to the needs of State and local
				businesses, consistent with the objectives of this title; and</text>
								</subparagraph><subparagraph id="HE1ABDE7FF1E446E9ADAD0A793ED1BBD0"><enum>(B)</enum><text>providing
				incentives and technical assistance to assist each local area in the State in
				more fully engaging all employers, including small employers, in local
				workforce investment activities—</text>
									<clause id="H827200A11F6D498F873E087CAA91D84E"><enum>(i)</enum><text>to
				make the workforce investment system more relevant to the needs of area
				businesses; and</text>
									</clause><clause id="HC7D23E840A9D44A785825746BC4B5518"><enum>(ii)</enum><text>to better
				coordinate workforce investment, economic development, and postsecondary
				education and training efforts to contribute to the economic well-being of the
				local area and region, as determined appropriate by the local board;</text>
									</clause></subparagraph></paragraph><paragraph id="H81B94BE437E44788A11F0EDAB836566C"><enum>(18)</enum><text>a description of
				how the State will utilize technology to facilitate access to services in
				remote areas, which may be used throughout the State;</text>
							</paragraph><paragraph id="H806D2886D25E44C898C00C4707F81AEA"><enum>(19)</enum><text>a description of
				the State strategy and assistance to be provided for encouraging regional
				cooperation within the State and across State borders, as appropriate;
				and</text>
							</paragraph><paragraph id="HEF698B36D2CE4D9DBFAEA194F54BDF2A"><enum>(20)</enum><text>a description of
				the actions that will be taken by the State to foster communication and
				partnerships with non-profit organizations (including community, faith-based,
				and philanthropic organizations) that provide employment-related, training, and
				complementary services, to enhance the quality and comprehensiveness of
				services available to participants under this
				title.</text>
							</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H186E6F2B61364F89909E93C67DF07F8F"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (c), by striking
			 <quote>period, that—</quote> all that follows through paragraph (2) and
			 inserting <quote>period, that the plan is inconsistent with the provisions of
			 this title.</quote>; and</text>

			 <quote>Except as provided in subsection (b), and consistent with paragraphs

				which such local areas are consistent with labor market areas.</text>
									</clause><clause id="H5CD517494435499491B56BC970FB2F15"><enum>(ii)</enum><text>The extent to
				which labor market areas align with economic development regions.</text>
									</clause><clause id="H3F29E51FC28045A38145E02B8F518622"><enum>(iii)</enum><text>Whether such
				local areas have the appropriate education and training providers to meet the
				needs of the local workforce.</text>
									</clause><clause id="HD6EB194184D64B0C8F3FDDDA51E348C0"><enum>(iv)</enum><text>The distance that
				individuals will need to travel to receive services provided in such local
				areas.</text>
									</clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="H45FA0E8FDA71495FB9F75A34F8F8B120"><enum>(B)</enum><text>by amending
			 paragraph (2) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H2DFBE514313C4BB08EDCE937FB5EB297" style="OLC">

				eligible to receive funding under this subparagraph upon entering into an
				agreement for extension of United States educational assistance under the
				Compact of Free Association (approved by the Compact of Free Association
				Amendments Act of 2003 (Public Law 108–188)) after the date of enactment of the
				Streamlining Workforce Development Programs Act of 2011.</text>
									</clause></subparagraph><subparagraph id="H4153F00E2AC5471F861FBE588D99EA80"><enum>(B)</enum><header>States</header>
									<clause id="H119B653009C1450EA7FDD354B39AF252"><enum>(i)</enum><header>In
				general</header><text>After determining the amount to be reserved under
				subparagraph (A), the Secretary shall allot the remainder of the amount
				referred to in subsection (a)(2) for a fiscal year to the States pursuant to
				clause (ii) for employment and training activities and statewide workforce
				investment activities.</text>
									</clause><clause id="H4BC3F8F1E398405E909E598FAF4141A8"><enum>(ii)</enum><header>Formula</header><text>Subject
				to clauses (iii) and (iv), of the remainder—</text>
										<subclause id="H2C22C25DF9AD4F899F40A20CC499C377"><enum>(I)</enum><text>33<fraction>1/3</fraction>
				percent shall be allotted on the basis of the relative number of unemployed
				individuals in areas of substantial unemployment in each State, compared to the
				total number of unemployed individuals in areas of substantial unemployment in
				all States;</text>
										</subclause><subclause id="HBF4C5B118BA145568B57D8F5473AA2E0"><enum>(II)</enum><text>33<fraction>1/3</fraction>
				percent shall be allotted on the basis of the relative number of individuals in
				the civilian labor force in each State as compared to the total number of such
				individuals in all States; and</text>
										</subclause><subclause id="HCE72EADB2B5C41A7BB04262B6CE99909"><enum>(III)</enum><text>33<fraction>1/3</fraction>
				percent shall be allotted on the basis of the relative number of individuals in
				a State who have been unemployed for 15 weeks or more, compared to the total
				number of individuals in all States who have been unemployed for 15 weeks or
				more.</text>
										</subclause></clause><clause id="HEF4FE4CA06E14E8A9EB0A436F5F0ACBC"><enum>(iii)</enum><header>Minimum and
				maximum percentages</header>
										<subclause id="HABC7714036F74703A3F7385B972645F0"><enum>(I)</enum><header>Minimum
				percentage</header><text>The Secretary shall ensure that no State shall receive
				an allotment under this subparagraph for a fiscal year that is less than 90
				percent of the allotment percentage of the State for the preceding fiscal
				year.</text>
										</subclause><subclause id="H5028652A3F8F4F208386889231F4290F"><enum>(II)</enum><header>Maximum
				percentage</header><text>Subject to subclause (I), the Secretary shall ensure
				that no State shall receive an allotment under this subparagraph for a fiscal
				year that is more than 130 percent of the allotment percentage of the State for
				the preceding fiscal year.</text>
										</subclause></clause><clause id="H26E625668035407FA05E158F5E10B59F"><enum>(iv)</enum><header>Small state
				minimum allotment</header><text>Subject to clause (iii), the Secretary shall
				ensure that no State shall receive an allotment under this subparagraph for a
				fiscal year that is less than <fraction>2/10</fraction> of 1 percent of the
				remainder described in clause (i) for the fiscal year.</text>
									</clause><clause id="H772E62AF4C234AA0AFCA5AEF38407C31"><enum>(v)</enum><header>Definitions</header><text>For
				the purpose of the formula specified in this subparagraph:</text>
										<subclause id="H1FCC5D132CA94525A0A720FE574170BD"><enum>(I)</enum><header>Individual</header><text>The
				term <term>individual</term> means an individual who is not less than age 16
				and not more than age 72.</text>
										</subclause><subclause id="HFF03407BE41B4646BCDDCBB58E41C6BC"><enum>(II)</enum><header>Allotment
				percentage</header><text>The term <term>allotment percentage</term>—</text>
											<item id="HB2B246C27FBC42DBB822004490D54EFE"><enum>(aa)</enum><text display-inline="yes-display-inline">used with respect to fiscal year 2012,
				means the percentage of the amounts allotted to States under the provisions
				listed in paragraphs (1) through (6) of section 201 of the Streamlining
				Workforce Development Programs Act of 2011 and chapter 5 of this title (as such
				provisions and chapter were in effect on the day before the date of enactment
				of such Act) that is received under such provisions and under such chapter by
				the State involved for fiscal year 2012; and</text>
											</item><item id="H2D8A63D1B88F46E8A9EDA407C51F4E65"><enum>(bb)</enum><text>used with respect
				to fiscal year 2013 or a subsequent year, means the percentage of the remainder
				described in clause (i) that is received through an allotment made under this
				subparagraph for the fiscal year.</text>
											</item></subclause></clause></subparagraph></paragraph><paragraph id="H3A16FAFFBF1C43A3BD998622AE997448"><enum>(2)</enum><header>State youth
				workforce investment fund</header>
								<subparagraph id="H066EE0EA786A45B787DC715503960349"><enum>(A)</enum><header>Reservation for
				outlying areas</header>
									<clause id="H32D0D0EDDE674C45BC41FB14B7D60BF6"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">From the amount made
				available under subsection (a)(3) for a fiscal year, the Secretary shall
				reserve not more than <fraction>1/4</fraction> of 1 percent to provide
				assistance to the outlying areas.</text>
									</clause><clause id="HEAD529C101E74896A92C83E9683C7324"><enum>(ii)</enum><header>Restriction</header><text display-inline="yes-display-inline">The Republic of Palau shall cease to be
				eligible to receive funding under this subparagraph upon entering into an
				agreement for extension of United States educational assistance under the
				Compact of Free Association (approved by the Compact of Free Association
				Amendments Act of 2003 (Public Law 108–188)) after the date of enactment of the
				Streamlining Workforce Development Programs Act of 2011.</text>
									</clause></subparagraph><subparagraph id="H078A881C03474EB5B0288873D0B20383"><enum>(B)</enum><header>States</header>
									<clause id="H2884767AF48541DEB7F98CD6A73CD235"><enum>(i)</enum><header>In
				general</header><text>After determining the amount to be reserved under
				subparagraph (A), the Secretary shall allot the remainder of the amount
				referred to in subsection (a)(3) for a fiscal year to the States pursuant to
				clause (ii) for State youth activities.</text>
									</clause><clause id="H59E27FB5A658442C95970A36782B8EC3"><enum>(ii)</enum><header>Formula</header><text>Subject
				to clauses (iii) and (iv), of the remainder—</text>
										<subclause id="H7864B94C56BE44BCB2B1C28038679CDA"><enum>(I)</enum><text>50 percent shall
				be allotted on the basis of the relative number of disadvantaged youth who are
				ages 16 through 24 in each State, compared to the total number of disadvantaged
				youth who are ages 16 through 24 in all States; and</text>
										</subclause><subclause id="H2570A33605994D44863DB16A66ACE3B3"><enum>(II)</enum><text>50 percent shall
				be allotted on the basis of the relative number of secondary school dropouts
				who are ages 16 and 17 compared to the total number of secondary school
				dropouts who are ages 16 and 17 in all States.</text>
										</subclause></clause><clause id="H06F7D90A412D49ADACEB44BE93608D82"><enum>(iii)</enum><header>Minimum and
				maximum percentages</header>
										<subclause id="H87F5F06C4DCA408FB05302BEE191E214"><enum>(I)</enum><header>Minimum
				percentage</header><text>The Secretary shall ensure that no State shall receive
				an allotment under this subparagraph for a fiscal year that is less than 90
				percent of the allotment percentage of the State for the preceding fiscal
				year.</text>
										</subclause><subclause id="H77255419624049CAA98B27DE9786C686"><enum>(II)</enum><header>Maximum
				percentage</header><text>Subject to subclause (I), the Secretary shall ensure
				that no State shall receive an allotment under this subparagraph for a fiscal
				year that is more than 130 percent of the allotment percentage of the State for
				the preceding fiscal year.</text>
										</subclause></clause><clause id="H79CED1261E0D406CB23A762D2EE6EBA1"><enum>(iv)</enum><header>Small State
				minimum allotment</header><text display-inline="yes-display-inline">Subject to
				clause (iii), the Secretary shall ensure that no State shall receive an
				allotment under this subparagraph for a fiscal year that is less than
				<fraction>2/10</fraction> of 1 percent of the remainder described in clause (i)
				for the fiscal year.</text>
									</clause><clause id="H820DD62D01A44AC38944CF3FFD621C27"><enum>(v)</enum><header>Definitions</header><text>For
				the purpose of the formula specified in this subparagraph:</text>
										<subclause id="H8B0C960D8B1D44439EAD556AF2C47114"><enum>(I)</enum><header>Allotment
				percentage</header><text>The term <term>allotment percentage</term>—</text>
											<item id="H785CDA2BF2A549DEAD5483AABE5346AB"><enum>(aa)</enum><text display-inline="yes-display-inline">used with respect to fiscal year 2012,
				means the percentage of the amounts allotted to States under the provisions
				listed in paragraphs (7) through (9) of section 201 of the Streamlining
				Workforce Development Programs Act of 2011 (as such provisions were in effect
				on the day before the date of enactment of such Act) that is received under
				such provisions by the State involved for fiscal year 2012; and</text>
											</item><item id="H1300A8B09D2A4ABDA3131B0402C704A3"><enum>(bb)</enum><text>used with respect
				to fiscal year 2013 or a subsequent year, means the percentage of the remainder
				described in clause (i) that is received through an allotment made under this

											</item></subclause><subclause id="HF213A84D3BAD49F0AF78D204EE59D806"><enum>(II)</enum><header>Disadvantaged
				youth</header><text display-inline="yes-display-inline">The term
				<term>disadvantaged youth</term> means an individual who is age 16 through 24
				who receives an income, or is a member of a family that received a total family
				income, that, in relation to family size, does not exceed the higher of—</text>
											<item id="H053A120C81444040AEDFD1CB88B26131"><enum>(aa)</enum><text>the
				poverty line; or</text>
											</item><item id="HC63361AC829C45ABABDFC684FB4CD620"><enum>(bb)</enum><text>70
				percent of the lower living standard income level.</text>
											</item></subclause></clause></subparagraph></paragraph><paragraph id="H05E8FA53B62E4018BB0A452E1B0852F4"><enum>(3)</enum><header>Veterans
				workforce investment fund</header>
								<subparagraph id="H61C4FC8207224003A8C9E52C817127F2"><enum>(A)</enum><header>Reservation for
				outlying areas</header>
									<clause id="HAD6B1F5E76EA4623B07B8CA40204B4AD"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">From the amount made
				available under subsection (a)(4) for a fiscal year, the Secretary shall
				reserve not more than <fraction>1/4</fraction> of 1 percent to provide
				assistance to the outlying areas.</text>
									</clause><clause id="H008DFD12E52242629C09FAFC86753D9A"><enum>(ii)</enum><header>Restriction</header><text display-inline="yes-display-inline">The Republic of Palau shall cease to be
				eligible to receive funding under this paragraph upon entering into an
				agreement for extension of United States educational assistance under the
				Compact of Free Association (approved by the Compact of Free Association
				Amendments Act of 2003 (Public Law 108–188)) after the date of enactment of the
				Streamlining Workforce Development Programs Act of 2011.</text>
									</clause></subparagraph><subparagraph id="H94DDBD0C5A1C4489BB4800EEA8C5A2AD"><enum>(B)</enum><header>States</header>
									<clause id="HDD3ECC16A5D54BB4AAD53156F3A66922"><enum>(i)</enum><header>In
				general</header><text>After determining the amount to be reserved under
				subparagraph (A), the Secretary shall allot the remainder of the amount
				referred to in subsection (a)(4) for a fiscal year to the States pursuant to
				clause (ii) for veterans employment and training activities.</text>
									</clause><clause id="H71821085920747FFBFDA7185013D92CB"><enum>(ii)</enum><header>Formula</header><text>Subject
				to clauses (iii) and (iv), the remainder shall be allotted on the basis of the
				relative number of unemployed veterans in each State, compared to the total
				number of unemployed veterans in all States.</text>
									</clause><clause id="HAD1A38C0151945E78F4A68DDF4DF530E"><enum>(iii)</enum><header>Minimum and
				maximum percentages</header>
										<subclause id="H0752E5F909114078A0DAC3AC5746AF90"><enum>(I)</enum><header>Minimum
				Percentage</header><text>The Secretary shall ensure that no State shall receive
				an allotment under this subparagraph for a fiscal year that is less than 90
				percent of the allotment percentage of the State for the preceding fiscal
				year.</text>
										</subclause><subclause id="H07C94FBC1ACB48FCB87198D800DBB012"><enum>(II)</enum><header>Maximum
				Percentage</header><text>Subject to subclause (I), the Secretary shall ensure
				that no State shall receive an allotment under this subparagraph for a fiscal
				year that is more than 130 percent of the allotment percentage of the State for
				the preceding fiscal year.</text>
										</subclause></clause><clause id="H7AB6C3E926A842CEBBC21A84DA803B81"><enum>(iv)</enum><header>Small State
				minimum allotment</header><text display-inline="yes-display-inline">Subject to
				clause (iii), the Secretary shall ensure that no State shall receive an
				allotment under this subparagraph for a fiscal year that is less than
				<fraction>2/10</fraction> of 1 percent of the remainder described in clause (i)
				for the fiscal year.</text>
									</clause><clause id="H5979BD97298644A0A921092EBC2441B7"><enum>(v)</enum><header>Definition</header><text display-inline="yes-display-inline">For the purpose of the formula specified in
				this subparagraph, the term <term>allotment percentage</term>—</text>
										<subclause id="H33C0A34844D04E0186909A41EA563A43"><enum>(I)</enum><text display-inline="yes-display-inline">used with respect to fiscal year 2012,
				means the percentage of the amounts allotted to States under the provisions
				listed in paragraphs (12) through (15) of section 201 of the Streamlining
				Workforce Development Programs Act of 2011 (as such provisions were effect on
				the day before the date of enactment of such Act) that is received under such
				provisions by the State involved for fiscal year 2012; and</text>
										</subclause><subclause id="H7DEBBB7AB1D3493EAA907FB495D32474"><enum>(II)</enum><text>used with respect
				to fiscal year 2013 or a subsequent year, means the percentage of the remainder
				described in clause (i) that is received through an allotment made under this
				subparagraph for the fiscal year.</text>
										</subclause></clause></subparagraph></paragraph><paragraph commented="no" id="H6860965B2971427DB659FBC0E5761E2D"><enum>(4)</enum><header>Targeted
				populations workforce investment fund</header>
								<subparagraph commented="no" id="HF1863633429141579CC14B0179733126"><enum>(A)</enum><header>Reservation for
				outlying areas</header>
									<clause commented="no" id="H1D481F0DCCAB45C0BB71AD3CAB828351"><enum>(i)</enum><header>In
				general</header><text>From the amount made available under subsection (a)(5)
				for a fiscal year, the Secretary shall reserve—</text>
										<subclause id="H680684407D5A4B2BB24B2B6BB0E2C5A9"><enum>(I)</enum><text>not more than
				<fraction>1/4</fraction> of 1 percent to provide assistance to the outlying
				areas; and</text>
										</subclause><subclause id="H59DEB655C21E4C4C9E45121CC6144889"><enum>(II)</enum><text>not more than 1.5
				percent to provide assistance to Indian Tribes.</text>
										</subclause></clause><clause commented="no" id="HA074D34CA0B0466E8BB64241F63F5F87"><enum>(ii)</enum><header>Restriction</header><text display-inline="yes-display-inline">The Republic of Palau shall cease to be

				subparagraph (A), the Secretary shall allot the remainder of the amount
				referred to in subsection (a)(5) for a fiscal year to the States pursuant to
				clause (ii) for refugee and entrant, ex-offender, migrant and seasonal
				farmworker, and Native American employment and training activities.</text>
									</clause><clause commented="no" id="HDD8BC7D36DC244788E52A5330F4AFE45"><enum>(ii)</enum><header>Formula</header><text display-inline="yes-display-inline">Subject to clauses (iii) and (iv), the
				remainder shall be allotted on the basis of the relative number of refugee and
				entrants, ex-offenders, migrant and seasonal farmworkers, and Native Americans

				Percentage</header><text>The Secretary shall ensure that no State shall receive
				an allotment under this subparagraph for a fiscal year that is less than 90
				percent of the allotment percentage of the State for the preceding fiscal
				year.</text>
										</subclause><subclause commented="no" id="H797EEF81B81A430FB0F1B09B5AFC30AA"><enum>(II)</enum><header>Maximum
				Percentage</header><text>Subject to subclause (I), the Secretary shall ensure
				that no State shall receive an allotment under this subparagraph for a fiscal
				year that is more than 130 percent of the allotment percentage of the State for
				the preceding fiscal year.</text>
										</subclause></clause><clause commented="no" id="HC7FD5DFB43D8413F88479AEB76342BEE"><enum>(iv)</enum><header>Small State
				Minimum Allotment</header><text display-inline="yes-display-inline">Subject to
				clause (iii), the Secretary shall ensure that no State shall receive an
				allotment under this subparagraph for a fiscal year that is less than
				<fraction>2/10</fraction> of 1 percent of the remainder described in clause (i)
				for the fiscal year.</text>
									</clause><clause commented="no" id="H8D4D0409CBDB4F2F9762C26F35357354"><enum>(v)</enum><header>Definition</header><text display-inline="yes-display-inline">For the purpose of the formula specified in
				this subparagraph, the term <term>allotment percentage</term>—</text>
										<subclause id="H0214FD6BFE304C1ABBE2D34DD14B779B"><enum>(I)</enum><text display-inline="yes-display-inline">used with respect to fiscal year 2012,
				means the percentage of the amounts allotted to States under the provisions
				listed in paragraphs (16) through (23) of section 201 of the Streamlining
				Workforce Development Programs Act of 2011 (as such provisions were effect on
				the day before the date of enactment of such Act) that is received under such
				provisions by the State involved for fiscal year 2012; and</text>
										</subclause><subclause id="H2A71FDA7AB0B40DDAA35284F8B8E1D28"><enum>(II)</enum><text>used with respect
				to fiscal year 2013 or a subsequent year, means the percentage of the remainder
				described in clause (i) that is received through an allotment made under this
				subparagraph for the fiscal
				year.</text>
										</subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H8B7EE476464A43819A35777E8F4CB27B"><enum>111.</enum><header>Within State
			 allocations</header><text display-inline="no-display-inline">Section 133 is
			 amended—</text>
				<paragraph id="H9BCAAAFD873249BEBECB3A751751CF31"><enum>(1)</enum><text>by amending
			 subsection (a) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H66D1967047C34C298007412FACE0718B" style="OLC">
						<subsection id="HCE706E75901540ADA68F024790F5E6B9"><enum>(a)</enum><header>Reservations for
				State activities</header>
							<paragraph id="H2AA9DAAC4E9C4EAC9E6EBD5CE5088F54"><enum>(1)</enum><header>Statewide
				employment and training activities</header>
								<subparagraph id="H10A2CB39143842A9949F92F53F8AB709"><enum>(A)</enum><header>In
				general</header><text>The Governor of a State shall reserve up to 15 percent of
				the total amount allotted to the State under section 132(b)(1)(B) for a fiscal
				year to carry out the statewide activities described in section 134(a).</text>
								</subparagraph><subparagraph id="HE59C865F2966485AB142C103C3B37A13"><enum>(B)</enum><header>Statewide rapid
				response activities</header><text>Of the amount reserved under subparagraph (A)
				for a fiscal year, the Governor of the State shall reserve not more than 10
				percent for statewide rapid response activities described in section
				134(a)(2)(A).</text>
								</subparagraph></paragraph><paragraph id="H7453A2135FBD446EB069144D3F331975"><enum>(2)</enum><header>Statewide Youth
				Workforce Investment Fund</header><text>The Governor of a State may reserve up
				to 2 percent of the total amount allotted to the State under section
				132(b)(2)(B) for a fiscal year to carry out the statewide activities described
				in section 134(a).</text>
							</paragraph><paragraph id="HBC30251841324222936C66B17C95A0AD"><enum>(3)</enum><header>Statewide
				Veterans Workforce Investment Fund Activities</header><text>The Governor of a
				State may reserve up to 2 percent of the total amount allotted to the State
				under section 132(b)(3)(B) for a fiscal year to carry out statewide activities
				described in section 134(a).</text>
							</paragraph><paragraph id="HA3E30F2098C84460B0888A4CD17D2596"><enum>(4)</enum><header>Statewide
				Targeted Population Workforce Investment Fund Activities</header><text>The
				Governor of a State may reserve up to 2 percent of the total amount allotted to
				the State under section 132(b)(4)(B) for a fiscal year to carry out the
				statewide activities described in section
				134(a).</text>
							</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H71D31C5B5A254E3FB8332D5460A4913E"><enum>(2)</enum><text>by amending
			 subsection (b) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HD3443852FCF64B71878BDB1AA6B18858" style="OLC">
						<subsection id="HD5373AA366A34DB19C2247F147EE8362"><enum>(b)</enum><header>Within State
				allocation</header>
							<paragraph id="H46891E3F5E5547E584D5FFF136111D16"><enum>(1)</enum><header>Statewide
				employment and training activities</header><text>The Governor, acting in
				accordance with the State plan, and after consulting with chief elected
				officials in the local areas, shall—</text>
								<subparagraph id="HAE7C6F7208C945038B3BC9DB76129C18"><enum>(A)</enum><text>allocate the funds
				that are allotted to the State for employment and training activities and
				statewide workforce investment activities under section 132(b)(1)(B) and not
				reserved under subsection (a)(1), in accordance with paragraph (2)(A);</text>
								</subparagraph><subparagraph id="H9FF77085125D448FA207999615E41A04"><enum>(B)</enum><text display-inline="yes-display-inline">award the funds that are allotted to the
				State for State youth activities under section 132(b)(2)(B) and not reserved
				under subsection (a)(2) through competitive grants to eligible entities, in
				accordance with section 135;</text>
								</subparagraph><subparagraph id="HF6797CC731954132AB6C2188A90708BE"><enum>(C)</enum><text>allocate the funds
				that are allotted to the State for veterans employment and training activities
				under section 132(b)(3)(B) and not reserved under subsection (a)(3), in
				accordance with paragraph (2)(B); and</text>
								</subparagraph><subparagraph id="H654691A72A074182BF5A131D6E08CC83"><enum>(D)</enum><text>allocate the funds
				that are allotted to the State for targeted populations employment and training
				activities under section 132(b)(4)(B) and not reserved under subsection (a)(4),
				in accordance with paragraph (2)(C).</text>
								</subparagraph></paragraph><paragraph id="H26FEC1B1D804406DAA019DD7747905F1"><enum>(2)</enum><header>Formula
				allocations</header>
								<subparagraph id="HC54CD168AE434E198D8CB6BCE1D566A0"><enum>(A)</enum><header>Workforce
				investment fund</header>
									<clause id="HF816A206E13B4825B4D893F1C0A2691B"><enum>(i)</enum><header>Allocation</header><text>In
				allocating the funds described in paragraph (1)(A) to local areas, a State
				shall allocate—</text>

				percent on the basis described in section 132(b)(B)(ii)(I);</text>

				percent on the basis described in section 132(b)(B)(ii)(II); and</text>

				percent on the basis described in section 132(b)(B)(ii)(III).</text>
										</subclause></clause><clause id="HD60EDCC30FFB4E23A60C86668A70CDB4"><enum>(ii)</enum><header>Minimum and

				Percentage</header><text>The State shall ensure that no local area shall
				receive an allotment under this subparagraph for a fiscal year that is less
				than 90 percent of the allocation percentage of the local area for the
				preceding fiscal year.</text>
										</subclause><subclause id="HE13D113DE10E427C88F0B79EEF91D72D"><enum>(II)</enum><header>Maximum
				Percentage</header><text>Subject to subclause (I), the State shall ensure that
				no local area shall receive an allocation for a fiscal year under this
				subparagraph for a fiscal year that is more than 130 percent of the allocation
				percentage of the local area for the preceding fiscal year.</text>
										</subclause></clause><clause id="HDB8E3B54AC4E4B119F2FBA875DCA2610"><enum>(iii)</enum><header>Definitions</header><text>For
				the purpose of the formula specified in this subparagraph:</text>
										<subclause id="HAB154AF5EDBC4B2182089F95779D6C43"><enum>(I)</enum><header>Individual</header><text>The
				term <term>individual</term> means an individual who is not less than age 16
				and not more than age 72.</text>
										</subclause><subclause id="H906D4D000E5B4D8C9D49FD8134C0D5FE"><enum>(II)</enum><header>Allocation
				percentage</header><text display-inline="yes-display-inline">The term
				<term>allocation percentage</term>—</text>
											<item id="HB726EA724BC6479CA2527596D42F3AD9"><enum>(aa)</enum><text display-inline="yes-display-inline">used with respect to fiscal year 2012,
				means the percentage of the amounts allocated to local areas under paragraphs
				(1) through (6) of section 201 of the Streamlining Workforce Development
				Programs Act of 2011 and chapter 5 of this title (as such provisions and such
				chapter were in effect on the day before the date of enactment of such Act)
				that is received under such provisions and such chapter by the local area
				involved for fiscal year 2012; and</text>
											</item><item id="HC6E350841F874210BF77C4E29ABF78E9"><enum>(bb)</enum><text>used with respect
				to fiscal year 2013 or a subsequent year, means the percentage of the funds
				described in clause (i) that is received through an allocation made under this
				subparagraph for the fiscal year.</text>
											</item></subclause></clause></subparagraph><subparagraph id="H67508B3EE62745DBAD7599BFDBEEA2C3"><enum>(B)</enum><header>Veterans
				Workforce Investment Fund</header>
									<clause id="H62D1D1FF5AAF4057BB7BFE7E4407BD6A"><enum>(i)</enum><header>Allocation</header><text>In
				allocating the funds described in
				<internal-xref idref="HF6797CC731954132AB6C2188A90708BE" legis-path="(b)(1)(C)">paragraph (1)(C)</internal-xref> to local areas, a State
				shall allocate the funds on the basis described in section
				132(b)(3)(B)(ii).</text>
									</clause><clause id="H8FEA44405978428DA5739E8B0FEAA567"><enum>(ii)</enum><header>Minimum and
				maximum percentages</header>
										<subclause id="HF85B871F3CBF4D1F9AB3535E5BB627CA"><enum>(I)</enum><header>Minimum
				Percentage</header><text>The State shall ensure that no local area shall
				receive an allocation under this subparagraph for a fiscal year that is less
				than 90 percent of the allotment percentage of the local area under this
				subparagraph for the preceding fiscal year.</text>
										</subclause><subclause id="H14CCCB43C7B0422C961BDEE5F31789E4"><enum>(II)</enum><header>Maximum
				Percentage</header><text>Subject to subclause (I), the State shall ensure that
				no local area shall receive an allocation for a fiscal year under this
				subparagraph for a fiscal year that is more than 130 percent of the allotment
				percentage of the local area for the preceding fiscal year.</text>
										</subclause></clause><clause id="H6C531FD8548243FC9F07AD3F243F0348"><enum>(iii)</enum><header>Definition</header><text>For
				the purpose of the formula specified in this subparagraph, the term
				<term>allocation percentage</term>—</text>
										<subclause id="H4F04895353684DD5A17DA1CB17714F0A"><enum>(I)</enum><text display-inline="yes-display-inline">used with respect to fiscal year 2012,
				means the percentage of the amounts allocated to local areas under paragraphs
				(12) through (15) of section 201 of the Streamlining Workforce Development
				Programs Act of 2011 (as such provisions were in effect on the day before the
				date of enactment of such Act) that is received under such provisions by the
				local area involved for fiscal year 2012; and</text>
										</subclause><subclause id="H4EAC858CA1ED44DFA6226ED34E5AACEB"><enum>(II)</enum><text>used with respect
				to fiscal year 2013 or a subsequent year, means the percentage of the funds
				described in clause (i) that is received through an allocation made under this
				subparagraph for the fiscal year.</text>
										</subclause></clause></subparagraph><subparagraph id="H55F898F2993A4A749A741AD22B17799C"><enum>(C)</enum><header>Targeted
				populations workforce investment fund</header>
									<clause id="HA302DF5B49664512B789A875A2386FBA"><enum>(i)</enum><header>Allocation</header><text>In
				allocating the funds described in
				<internal-xref idref="H654691A72A074182BF5A131D6E08CC83" legis-path="(b)(1)(D)">paragraph (1)(D)</internal-xref> to local areas, a State
				shall allocate funds on the basis described in section 132(b)(4)(B)(ii).</text>
									</clause><clause id="HE2B2562C6AA44130A2A7E53D4C379ECC"><enum>(ii)</enum><header>Minimum and
				maximum percentages</header>
										<subclause id="H5E26D53363734FC6944CA50F688FF0D3"><enum>(I)</enum><header>Minimum
				Percentage</header><text>The State shall ensure that no local area shall
				receive an allotment under this paragraph for a fiscal year that is less than
				90 percent of the allotment percentage of the local area under this
				subparagraph for the preceding fiscal year.</text>
										</subclause><subclause id="HB2CDBEBE127A4379BB5A8A12AD555374"><enum>(II)</enum><header>Maximum
				Percentage</header><text>Subject to subclause (I), the State shall ensure that
				no local area shall receive an allotment for a fiscal year under this paragraph
				that is more than 130 percent of the allotment percentage of the local area
				under this subparagraph for the preceding fiscal year.</text>

				</paragraph><paragraph id="HF000A3DF74FB401AB1EDB303D20E02BA"><enum>(3)</enum><text>in subsection

			 paragraph (1) to read as follows:</text>

				accordance with this subsection, reallocate to eligible local area within the
				State amounts that are allocated under subsection (b) for employment and
				training activities and that are available for
				reallocation.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HA3E5B27325524E9595F42FBA10BD9E53"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>paragraph (2)(A) or (3) of subsection (b) for such
			 activities</quote> and inserting <quote>subsection (b) for such
			 activities</quote>;</text>
					</subparagraph><subparagraph id="H50D8277239A74952800FDFC724C3AE89"><enum>(C)</enum><text>by amending
			 paragraph (3) to read as follows:</text>

				Governor shall allocate to each eligible local area within the State an amount
				based on the relative amount allocated to such local area under subsection
				(b)(2) for such activities for such prior program year, as compared to the
				total amount allocated to all eligible local areas in the State under
				subsection (b)(2) for such activities for such prior program
				year.</text>

				</paragraph></section><section id="H18F91E0359F946EB9D2DD18E1203FADF"><enum>112.</enum><header>Use of funds
			 for employment and training activities</header><text display-inline="no-display-inline">Section 134 is amended—</text>
				<paragraph id="H265C45545CA341B49933E06EDCC55F4E"><enum>(1)</enum><text>in subsection
			 (a)—</text>

						<subsection id="H160B87B770564F829DD265E80C873286"><enum>(f)</enum><header>Local Veterans’
				Employment Representative</header>
							<paragraph id="H183AAEA6954249D782D871F92B6EBE71"><enum>(1)</enum><header>In
				general</header><text>From the funds allocated to a local area under section
				133(b)(2)(B)(ii), a local area shall hire and employ one or more local
				veterans’ employment representatives to carry out employment, training, and
				placement services under this subsection.</text>
							</paragraph><paragraph id="HE9F441BECC63406B8683FEA221D04B08"><enum>(2)</enum><header>Principal
				duties</header><text>A local veterans’ employment representative in a local
				area shall—</text>
								<subparagraph id="HF61EBC29CD364C2983F9411629480D31"><enum>(A)</enum><text>conduct outreach
				to employers in the local area to assist veterans, including disabled veterans,
				in gaining employment, including—</text>
									<clause id="H07ED7F0480DA4FC6AA45BC81FE832BF9"><enum>(i)</enum><text>conducting
				seminars for employers; and</text>
									</clause><clause id="H63FCB6E424DC4DB3A416A47625B1D3EC"><enum>(ii)</enum><text>in conjunction
				with employers, conducting job search workshops, and establishing job search
				groups; and</text>
									</clause></subparagraph><subparagraph id="HFAAFC6B26E794237A1E89F36C984B143"><enum>(B)</enum><text>facilitate
				employment, training, and placement services furnished to veterans, including
				disabled veterans, in the local area under the one-stop delivery system under
				section 121.</text>
								</subparagraph></paragraph><paragraph id="H671F409965254BCE8BA2F7EEC2EA6400"><enum>(3)</enum><header>Hiring
				preference for veterans and individuals with expertise in serving
				veterans</header><text display-inline="yes-display-inline">A local area shall,
				to the maximum extent practicable, employ veterans or individuals with
				expertise in serving veterans to serve as the local veterans’ employment
				representative and carry out the services described in paragraph (2). In hiring
				an individual to serve as a local veterans’ representative, a local board shall
				give preference to veterans and other individuals in the following
				order:</text>
								<subparagraph id="H5397A83F57BD434EA53ECC963932E8AA"><enum>(A)</enum><text>To qualified
				service-connected disabled veterans.</text>
								</subparagraph><subparagraph id="HC2BA30B6345D4B269C8A68DC965546A4"><enum>(B)</enum><text>If no veteran
				described in subparagraph (A) is available, to any other veterans.</text>
								</subparagraph><subparagraph id="H859F9182EDC742048AE58E761BD19DA0"><enum>(C)</enum><text>If no veteran
				described in subparagraph (A) or (B) is available, to any other individuals
				with expertise in serving veterans.</text>
								</subparagraph></paragraph><paragraph id="HB9CC6F3B395448FEA63E01DE0C4A6714"><enum>(4)</enum><header>Reporting</header><text display-inline="yes-display-inline">Each local veterans’ employment
				representative shall be administratively responsible to the manager of the
				one-stop delivery center in the local area and shall provide reports, not less
				frequently than quarterly, to the manager of such center and to the Director
				for Veterans’ Employment and Training for the State on compliance by the
				representative with Federal law and regulations with respect to the special
				services and hiring preferences described in paragraph (3) for veterans and
				individuals with expertise in serving
				veterans.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H9A1A6BE32C9B44FC833E1DF514D42AB4"><enum>113.</enum><header>State youth
			 workforce investment fund activities</header><text display-inline="no-display-inline">Chapter 5 of subtitle B of title I is
			 amended by adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H5AD4F952CC3040B8B595226DFA27CD55" style="OLC">
					<section id="H85F436EFCAE94F249EEEAAA50CF36093"><enum>135.</enum><header>State youth
				workforce investment fund activities</header>
						<subsection id="H69D190B1D3A94977BA36F26A3882A5ED"><enum>(a)</enum><header>In
				General</header><text>Of the funds allotted to a State under section
				132(b)(2)(B), the Governor of a State—</text>
							<paragraph id="H9D419D700E4E4ACEB4E43493C1A9203B"><enum>(1)</enum><text>may reserve up to
				5 percent to provide technical assistance to, and conduct evaluations as
				described in section 172 of the programs and activities carried out under this
				section; and</text>
							</paragraph><paragraph id="H952A4E004B454E628DD82CCB932119FE"><enum>(2)</enum><text>using the
				remainder, shall award grants, on a competitive basis, to eligible entities to
				carry out programs and activities authorized under this section to assist
				eligible youth in acquiring the education and skills, credentials, and
				employment experience necessary to succeed in the labor market.</text>
							</paragraph></subsection><subsection id="H4752BFC677D0495EB0950D33BEFC61D7"><enum>(b)</enum><header>Eligible entity
				defined</header><text display-inline="yes-display-inline">For purposes of this
				section, the term <term>eligible entity</term> means—</text>
							<paragraph id="H746FB4D2CA2D47328880795A8EB0901F"><enum>(1)</enum><text display-inline="yes-display-inline">a local board or a consortium of local
				boards;</text>
							</paragraph><paragraph id="H373A72E45148421F803853A915595245"><enum>(2)</enum><text>a nonprofit
				entity, for-profit entity, or a consortium of nonprofit or for-profit entities
				with a demonstrated record of—</text>
								<subparagraph id="H19E0E9F8E89D494688DAEFA27F35961E"><enum>(A)</enum><text>placing youth into
				year-round employment;</text>
								</subparagraph><subparagraph id="H26D36DF7BFBD4E7DB5B3A1B84BB3540F"><enum>(B)</enum><text>successfully
				implementing dropout recovery activities, or</text>
								</subparagraph><subparagraph id="HFAD08105409E4887B6B75B77DA555F08"><enum>(C)</enum><text>successfully
				implementing intensive and fully supervised programs of education, career
				training, and work experience; or</text>
								</subparagraph></paragraph><paragraph id="HB6016ED261B94A21B784E755EBEFB499"><enum>(3)</enum><text>a consortium of
				the entities described in paragraphs (1) and (2).</text>
							</paragraph></subsection><subsection id="H2FC6BF0D322A47FFA5F3C9595D505128"><enum>(c)</enum><header>Grant
				period</header>
							<paragraph id="HA7F3A63E6A9B4F1781A3EE26E9411FDB"><enum>(1)</enum><header>In
				general</header><text>A grant under this subsection shall be awarded for a
				period of 1 year.</text>
							</paragraph><paragraph id="H04973A2D3E16489B80EE421E957B3B8C"><enum>(2)</enum><header>Grant
				renewal</header><text>A Governor of a State may renew, for up to 4 additional
				1-year periods, a grant awarded under this section.</text>
							</paragraph></subsection><subsection id="HE329082706924DC2B65C7E237D9A28B3"><enum>(d)</enum><header>Authority To
				require match</header><text>A Governor of a State may require that eligible
				entities receiving grants under this section provide a non-Federal share of the
				cost of activities carried out under this section.</text>
						</subsection><subsection id="H85F914F9F46A47E2B09B34DF9FF439C3"><enum>(e)</enum><header>Eligible
				youth</header><text display-inline="yes-display-inline">To be eligible to
				participate in activities under this section, an individual shall be a youth
				between the ages 16 and 24 as of the time the eligibility determination is made
				by the Governor of the State who is—</text>
							<paragraph id="HD64D504EAB224C978E320E420F9C4680"><enum>(1)</enum><text>a secondary school
				dropout;</text>
							</paragraph><paragraph id="H1168D75F04F14EA0B6DDC52AEDE1F6E3"><enum>(2)</enum><text>a member of a
				low-income family;</text>
							</paragraph><paragraph id="H9DBA6F2987CD4B28B4246016F89A9519"><enum>(3)</enum><text>a youth in foster
				care (including youth aging out of foster care);</text>
							</paragraph><paragraph id="H8C0298B5AA804230856E689988A1965C"><enum>(4)</enum><text>a youth
				offender;</text>
							</paragraph><paragraph id="H28DF2DC40D29424A97AAA955035B7E3B"><enum>(5)</enum><text>a youth who is an
				individual with a disability;</text>
							</paragraph><paragraph id="H4ECECAAA5AA64B54AD3EC340192FBEA8"><enum>(6)</enum><text>a child of
				incarcerated parents; or</text>
							</paragraph><paragraph id="HA628D336D601415CB06EAD291FB84F33"><enum>(7)</enum><text>a migrant
				youth.</text>
							</paragraph></subsection><subsection id="H719711BEDCFE42819E5DCAAC73C25CBF"><enum>(f)</enum><header>Use of
				funds</header><text>An eligible entity receiving a grant under this section
				shall use such funds for activities that are designed to assist eligible youth
				in acquiring the education and skills, credentials, and employment experience
				that are necessary to succeed in the labor market by carrying out at least one
				of the following:</text>
							<paragraph id="H4505BEFC8C984ED08F9A142013B21752"><enum>(1)</enum><text>Training and
				internships for out-of-school youth in in-demand industries or occupations
				important to the State and local economy.</text>
							</paragraph><paragraph id="H16F76C8A1B02479580E4127CB7644FBA"><enum>(2)</enum><text>Dropout recovery
				activities that are designed to lead to the attainment of a secondary school
				diploma, General Education Development (GED) credential, or other
				State-recognized equivalent (including recognized alternative standards for
				individuals with disabilities).</text>
							</paragraph><paragraph id="H9757ECF95F3D4169A3A22FC0B6D7D954"><enum>(3)</enum><text>Activities
				designed to assist special youth populations, such as court-involved youth,
				homeless youth, foster-children, young parents, and youth with
				disabilities.</text>
							</paragraph><paragraph id="HE7F666B3D06A4D33AE68ED40E0EE3F29"><enum>(4)</enum><text>Activities
				combining remediation of academic skills, work readiness training, and work
				experience, and including linkages to postsecondary education and training,
				apprenticeships, and career-ladder employment.</text>
							</paragraph><paragraph id="H479873300A0D424BA24049F3F0237064"><enum>(5)</enum><text display-inline="yes-display-inline">Operating a residential center, such as a
				Job Corps Center described in subsection (i) if the requirements described in
				paragraph (3) of such subsection are met, that shall be operated so as to
				provide enrollees, in a well-supervised setting, with access to activities
				described in this subsection.</text>
							</paragraph><paragraph id="HBC03663E51B0413687A9ADEEAF2FB629"><enum>(6)</enum><text>Other
				evidence-based strategies or activities designed to improve the education and
				employment outcomes for youth.</text>
							</paragraph></subsection><subsection id="HF0E7EB24F58E4F269FF27298F1233A7C"><enum>(g)</enum><header>Applications</header><text>To
				be eligible to receive a grant under this section, an eligible entity shall
				submit an application to a State at such time, in such manner, and containing
				such information as the State may require, including—</text>
							<paragraph id="H24274EAD7BB4446183F8AB61E62E53D1"><enum>(1)</enum><text>a description of
				how the strategies and activities will be aligned with the State plan submitted
				under section 112 and the local plans submitted under section 118 with respect
				to the areas of the State that will be the focus of grant activities under this
				section;</text>
							</paragraph><paragraph id="H31C510DCD74C4E4C8C9018FEE9BA3321"><enum>(2)</enum><text>a description of
				the educational and skills training programs and activities the eligible entity
				will provide to eligible youth under this section;</text>
							</paragraph><paragraph id="H7EC259019A5C43258EFA4A923DF861C8"><enum>(3)</enum><text>how the eligible
				entity will collaborate with State and local workforce investment systems
				established under this title in the provision of such programs and
				activities;</text>
							</paragraph><paragraph commented="no" id="HE1ECC43CFDCA4325AF5D4209D45DADFB"><enum>(4)</enum><text display-inline="yes-display-inline">a description of the programs of
				demonstrated effectiveness on which the provision of such educational and
				skills training programs and activities are based, and a description of how
				such programs and activities will improve the education and skills training for
				eligible youth;</text>
							</paragraph><paragraph commented="no" id="H5110488E3A534DE08AC8BF02EAFA49AA"><enum>(5)</enum><text>a description of
				youth populations to be served and the skill needs of those populations, and
				the manner in which eligible youth will be recruited and selected as
				participants;</text>
							</paragraph><paragraph id="H470E1A4A43AB4A3B89C798EB1B7C6213"><enum>(6)</enum><text>a description of
				the private and public, and local and State resources that will be leveraged,
				in addition to the grant funds provided under this section, to provide the
				programs and activities under this section, and how the entity will ensure the
				sustainability of such programs and activities after grant funds are no longer
				available;</text>
							</paragraph><paragraph id="HCBAF21BE7D374BD69301E7145CD770E6"><enum>(7)</enum><text>a description of
				the extent of the involvement of employers in such programs and
				activities;</text>
							</paragraph><paragraph id="H92D41A31754C4E47A85D7490DEE0A059"><enum>(8)</enum><text>a description of
				the levels of performance the eligible entity expects to achieve with respect
				to the indicators of performance for youth specified in section
				136(b)(2)(A)(ii); and</text>
							</paragraph><paragraph id="H5C53E475B2FE466E87A48659434D89EC"><enum>(9)</enum><text>a detailed budget
				and a description of the system of fiscal controls, and auditing and
				accountability procedures that will be used to ensure fiscal soundness for the
				programs and activities provided under this section.</text>
							</paragraph></subsection><subsection id="H3BBE6FCE322B491D8C06528F85C6718C"><enum>(h)</enum><header>Factors for
				award</header>
							<paragraph id="HD683A024902A45E59DBE4FEF55084D5C"><enum>(1)</enum><header>In
				general</header><text>In awarding grants under this section, a State shall
				consider—</text>
								<subparagraph id="HBA05CB886CCA434CA572CDB0654785D9"><enum>(A)</enum><text>the quality of the
				proposed programs and activities;</text>
								</subparagraph><subparagraph id="HF4C9B9155D9C47CEA0036DCC8C7AA07E"><enum>(B)</enum><text>the goals to be
				achieved;</text>
								</subparagraph><subparagraph id="HC67B980553B9479EA9431F31E46FD732"><enum>(C)</enum><text>the likelihood of
				successful implementation;</text>
								</subparagraph><subparagraph id="H0546E0555CCA49C0ABDA9D5EA32DF544"><enum>(D)</enum><text>the extent to
				which the proposed programs and activities—</text>
									<clause id="H48015C3914EF4148AC13CC7FE250E266"><enum>(i)</enum><text>are based on
				proven strategies or demonstrated results; or</text>
									</clause><clause id="H9E4021B485454EBFB89C17BD801D7EF6"><enum>(ii)</enum><text>will expand the
				education and skills training for eligible youth;</text>
									</clause></subparagraph><subparagraph id="HC77DD52CBEA74459BC43FC4C11DDE775"><enum>(E)</enum><text>the extent of
				collaboration with the State and local workforce investment systems in carrying
				out the proposed programs and activities;</text>
								</subparagraph><subparagraph id="H4FF329A02265492E9DB50737D24FED0B"><enum>(F)</enum><text>the extent of
				employer involvement in the proposed programs and activities;</text>
								</subparagraph><subparagraph id="H22A8E086C8A04F5FA7533BC9CB4B10A1"><enum>(G)</enum><text>whether there are
				other Federal and non-Federal funds available for similar activities to the
				proposed programs and activities, and the additional State, local, and private
				resources that will be provided to carry out the proposed programs and
				activities;</text>
								</subparagraph><subparagraph id="HC5E85521D76C46529BD54A69B2DF3F4C"><enum>(H)</enum><text>the quality of the
				proposed programs and activities in meeting the needs of the eligible youth to
				be served; and</text>
								</subparagraph><subparagraph id="HC6CA9F567F244081B6D75241B2EE8019"><enum>(I)</enum><text>the extent to
				which the proposed programs and activities will expand on services provided to
				individuals between 16 and 24 years of age provided under section 134.</text>
								</subparagraph></paragraph><paragraph id="HFBE930216DBE4503B843FC3D2B260E28"><enum>(2)</enum><header>Equitable
				geographic distribution</header><text>In awarding grants under this section the
				State shall ensure an equitable distribution of such grants across
				geographically diverse areas.</text>
							</paragraph></subsection><subsection id="HEB38C1897F14487C8AC243607B2496AF"><enum>(i)</enum><header>Additional uses
				of funds</header>
							<paragraph id="H1B602C2BD6284D52A97DE36B9A2AD20B"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">If the requirements
				described in paragraph (3) are met, an eligible entity may use a grant received
				under this section to operate a Job Corps Center that was established under
				subtitle C (as in effect on the day before the enactment of the Streamlining
				Workforce Development Programs Act of 2011) and in existence on the day before
				the enactment of such Act to—</text>
								<subparagraph id="H993F630D2B6E49FF973534680B5A96D8"><enum>(A)</enum><text>provide work-based
				learning throughout the enrollment of the enrollees of such Center; and</text>
								</subparagraph><subparagraph id="H0D16AEFE477C4554B99ACD298C7960F1"><enum>(B)</enum><text>assist the
				enrollees in obtaining meaningful unsubsidized employment, participating in
				secondary or postsecondary education programs, enrolling in other suitable
				career training programs, or satisfying Armed Forces requirements, on
				completion of their enrollment.</text>
								</subparagraph></paragraph><paragraph id="H9E8ADBCA4C614D65904C24930DCA3E11"><enum>(2)</enum><header>Limitation</header><text>An
				eligible entity may use not more than 10 percent of the grant funds received
				under this section for construction and facilities improvement of a Job Corps
				Center.</text>
							</paragraph><paragraph commented="no" id="H9123B123200849F38010AFCAB748D229"><enum>(3)</enum><header>Requirements</header><text display-inline="yes-display-inline">In order for an eligible entity to operate
				a Job Corps Center under paragraph (1), the following requirements shall be
				met:</text>
								<subparagraph commented="no" id="HC1E53C85CE2F44CF96FCA0AEA94B732C"><enum>(A)</enum><text>The State has
				submitted to the Secretary, a written request for the appropriate title and
				deed for such Job Corps Center, and has been granted such title and deed under
				paragraph (4)(A).</text>
								</subparagraph><subparagraph commented="no" id="HB2D19AD9C1594B528F4111E5693FC65A"><enum>(B)</enum><text>The State agency,
				or appropriate agency responsible for inspecting public buildings and
				safeguarding the health of disadvantaged students, has conducted an in-person
				review of the physical condition and health-related activities of the Job Corps
				Center. Such review shall include a passing rate of occupancy under State and
				local ordinances.</text>
								</subparagraph><subparagraph commented="no" id="H0A852184B78141F5AD64ABF5E6DF8575"><enum>(C)</enum><text>The State has
				demonstrated, as part of the State plan in section 112, that it has developed
				and will enforce professional standards of conduct.</text>
								</subparagraph></paragraph><paragraph commented="no" id="HFECB025560C5489E8E288FCAB56212C2"><enum>(4)</enum><header>Secretarial
				Actions</header>
								<subparagraph commented="no" id="H50DCB8252B0347D79D1162CA2CE45B7A"><enum>(A)</enum><header>In
				general</header><text>Upon receiving a written request from a State under
				paragraph (3)(A), the Secretary, in coordination with the Administrator of the
				General Services Administration, shall transfer the title and deed for the
				appropriate Job Corps Center to the State within 30 days. The Secretary shall
				be prohibited from imposing any requirement on a State in exchange for such
				title and deed.</text>
								</subparagraph><subparagraph commented="no" id="HFE1603E0661444F5A6ABD187BDF7438B"><enum>(B)</enum><header>Transition</header><text>After
				365 calendar days after the date of enactment of Streamlining Workforce
				Development Programs Act of 2011, the Secretary shall transfer all Job Corps
				Centers with respect to which the Secretary has not received a written request
				under paragraph (3)(A) to the Administrator of the General Services
				Administration for disposal of excess Federal real
				property.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H92652A4ACCEB4E2C933DB3C191E8D000"><enum>114.</enum><header>Performance
			 accountability system</header><text display-inline="no-display-inline">Section
			 136 is amended—</text>
				<paragraph id="H3319056BAC934164A89009A6BFFB7F9C"><enum>(1)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="H902C3EF22C474B9093C9A5C015ECAC28"><enum>(A)</enum><text>by amending

								</subparagraph></paragraph><paragraph id="H15954587012740228E9F2D4DB937E1E6"><enum>(2)</enum><header>Indicators of
				Performance</header>
								<subparagraph id="HBD69BC439BD441D4B46825635A3A9EF4"><enum>(A)</enum><header>Core Indicators
				of Performance</header>
									<clause id="H18F11CBA778A475293C820F3042FF158"><enum>(i)</enum><header>In
				general</header><text>The core indicators of performance for the program of
				employment and training activities authorized under section 134, the program of
				adult education and literacy activities authorized under title II, and the
				program authorized under title I of the Rehabilitation Act of 1973 (29 U.S.C.
				720 et seq.), other than section 112 or part C of that title (29 U.S.C. 732,
				741), shall consist of—</text>
										<subclause id="HB68F0A73155C4FEA9AEC05F5A2FB1D94"><enum>(I)</enum><text>the percentage of
				program participants who are employed during the first or second full calendar
				quarter after exit from the program;</text>
										</subclause><subclause id="H306D32FC65754968BC84CEC4C3862507"><enum>(II)</enum><text>the percentage of
				program participants who are employed during the 2 full calendar quarters
				subsequent to the earliest full calendar quarter during which the participant
				was employed as described in subclause (I);</text>
										</subclause><subclause id="HEB687D92DAA74B48B18F3DB8AB06B7E2"><enum>(III)</enum><text>the median
				earnings of program participants who are employed during the 2 subsequent full
				calendar quarters described in subclause (II); and</text>
										</subclause><subclause id="H773C895743D24C019BB04B06D4061F01"><enum>(IV)</enum><text>the percentage of
				program participants who obtain a recognized postsecondary credential, or a
				secondary school diploma or its recognized equivalent (subject to clause
				(iii)), during participation in or within 1 year after exit from
				program.</text>
										</subclause></clause><clause id="HD4C3B93A756A41EABAD798F2B0C58EAA"><enum>(ii)</enum><header>Core indicators
				for eligible youth</header><text>The core indicators of performance for the
				program of youth activities authorized under section 135, shall include—</text>
										<subclause id="H2F8F91283258494A9B8D79F66BB8EFC0"><enum>(I)</enum><text>the percentage of
				program participants who are in education or training activities, employed, or
				in the military service, during the first or second full calendar quarter after
				exit from the program;</text>
										</subclause><subclause id="H097825DE01FD4CADA4556D33C689AB55"><enum>(II)</enum><text>the percentage of
				program participants who obtain a recognized postsecondary credential described
				in clause (i)(IV), or a secondary school diploma or its recognized equivalent
				(subject to clause (iii)), during participation in or within 1 year after exit
				from the program; and</text>
										</subclause><subclause id="H4316C0948E79423AA49573572A65E459"><enum>(III)</enum><text>the median
				earnings of program participants who are employed during the 2 subsequent full
				calendar quarters described in subclause (II).</text>
										</subclause></clause><clause id="HA73405AC095B41A6BF8E1BD65D329EF8"><enum>(iii)</enum><header>Indicator
				relating to credential</header><text>For purposes of clause (i)(IV) or
				(ii)(II), program participants who obtain a secondary school diploma or its
				recognized equivalent shall be included in the percentage counted as meeting
				the criterion under such clause only if such participants, in addition to
				obtaining such diploma or its recognized equivalent, have obtained employment
				or are in an education or training program leading to a recognized
				postsecondary credential described in clause (i)(IV) within 1 year after exit
				from the program.</text>
									</clause></subparagraph><subparagraph id="HFD5354F9B6534A90B4334C5BCD1F124C"><enum>(B)</enum><header>Additional
				indicators</header><text>A State may identify in the State plan additional
				indicators for workforce investment activities authorized under this
				subtitle.</text>
								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H7C2DBC8940824554BAAC440AE5610422"><enum>(B)</enum><text>in paragraph

				amount of grant</header><text display-inline="yes-display-inline">If such
				failure continues for a third consecutive year, the Governor of a State shall
				reduce the amount of the grant that would (in the absence of this subparagraph)
				be payable to the local area under such program for the program year after such
				third consecutive year. Such penalty shall be based on the degree of failure to
				meet local levels of
				performance.</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HF2B5507E91EC493EAB02A2091F83AAEC"><enum>(D)</enum><text>in subparagraph
			 (C)(i) (as so redesignated), by striking <quote>a reorganization plan under

			 reorganization plan, appeal to the Governor to rescind or revise such a

						</subsection><subsection id="H094B9935C80F48B380EE2E92D3C0864E"><enum>(d)</enum><header>Targeted
				Populations Employment and Training Activities</header><text display-inline="yes-display-inline">There are authorized to be appropriated to
				carry out the activities described in section 132(a)(5), $581,000,000 for
				fiscal year 2013 and each of the 5 succeeding fiscal
				years.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				with industry</header>
							<subsection id="H28237BBEF7354A0B942F0A1A70F77A02"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">A State shall use not less than one-half of
				one percent of the payment the State received under section 111 for a fiscal
				year to award grants to eligible entities to create practical job and career
				readiness and training programs, and to provide job placements and career
				advancement.</text>
							</subsection><subsection id="H69D6D70BA21943648FA46450AA4366B0"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">To receive a grant under this section, an
				eligible entity shall submit an application to a designated State agency at
				such time, in such manner, and containing such information as such agency shall
				require. Such application shall include, at a minimum—</text>
								<paragraph id="H41ECE0573F5A4B418A54E336FBE542AF"><enum>(1)</enum><text>a plan for
				evaluating the effectiveness of the program;</text>
								</paragraph><paragraph id="HD7E23270004342F4A62CA3B6B4957191"><enum>(2)</enum><text>a plan for
				collecting and reporting the data and information described under subparagraphs
				(A) through (C) of section 101(a)(10), as determined appropriate by the
				designated State agency; and</text>
								</paragraph><paragraph id="H293C75E6DB174A2F935063C3D04A4474"><enum>(3)</enum><text display-inline="yes-display-inline">a plan for providing for the non-Federal
				share of the costs of the program.</text>
								</paragraph></subsection><subsection id="HA7314DB178A54DC795ABD9D758D47623"><enum>(c)</enum><header>Activities</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under
				this section shall use the grant funds to carry out a program that provides one
				or more of the following.</text>
								<paragraph id="H1E71B620F5B24191B8D4B3E071D0E55A"><enum>(1)</enum><text>Job development,
				job placement, and career advancement services for individuals with
				disabilities.</text>
								</paragraph><paragraph id="H48F69AE7DA54445AA0AC5730D62B1636"><enum>(2)</enum><text display-inline="yes-display-inline">Training in realistic work settings in
				order to prepare individuals with disabilities for employment and career
				advancement in the competitive market.</text>
								</paragraph><paragraph id="HE9F04929A1614D14B165432875417902"><enum>(3)</enum><text>Providing
				individuals with disabilities with such support services as may be required in
				order to maintain the employment and career advancement for which the
				individuals have received training.</text>
								</paragraph></subsection><subsection id="HF52075C42BE848F9B9C9E227DB1A2F31"><enum>(d)</enum><header>Awards</header><text display-inline="yes-display-inline">Grants under this section shall—</text>
								<paragraph id="H4572693A5F6E4720A31487160AEE654F"><enum>(1)</enum><text>be awarded for a
				period not to exceed 5 years; and</text>
								</paragraph><paragraph id="H7F3053E2A2064F6A982653D450AD9FD0"><enum>(2)</enum><text>be awarded
				competitively.</text>
								</paragraph></subsection><subsection id="H56C3EA9E07224A7EA39CB441E7F23FDD"><enum>(e)</enum><header>Eligible entity
				defined</header><text display-inline="yes-display-inline">For the purposes of
				this section, the term <term>eligible entity</term> means a for-profit
				business, alone or in partnership with one or more of the following—</text>
								<paragraph id="H8FC652379FA6477EB8981370E0B76D4C"><enum>(1)</enum><text>community
				rehabilitation providers;</text>
								</paragraph><paragraph id="HE1EEC853BAB14A55B354C005699C8391"><enum>(2)</enum><text>Indian tribes;
				and</text>
								</paragraph><paragraph id="HA37EF69C14B7445199025CD2814E13B2"><enum>(3)</enum><text display-inline="yes-display-inline">tribal organizations.</text>
								</paragraph></subsection><subsection id="HC6884A1B90E8445A8375710112028E62"><enum>(f)</enum><header>Federal
				Share</header><text display-inline="yes-display-inline">The Federal share of a
				program under this section shall not exceed 80 percent of the costs of the
				program.</text>
							</subsection><subsection id="H5C0BB92DC7404C4497DCDE6278070FCE"><enum>(g)</enum><header>Eligibility for
				services</header><text display-inline="yes-display-inline">An individual shall
				be eligible for services provided under a program under this section if the
				individual is determined under section 102(a)(1) to be eligible for assistance
				under this
				title.</text>
