			 international trafficking in persons</header>
			<section display-inline="no-display-inline" id="H2A5A3D291F4347DEA0F89D0D6217C311" section-type="subsequent-section"><enum>101.</enum><header>Authority to
			 restrict passports</header>
				<subsection id="HAAE93C302D2740AB86E1A92F2B14EEC2"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of State is authorized to—</text>
					<paragraph id="HA6C9E0164F304D2D8074EAB12ED71FFF"><enum>(1)</enum><text>limit to 1 year or
			 such period of time as the Secretary of State shall determine appropriate the
			 period of validity of a passport issued to a sex offender; and</text>
					</paragraph><paragraph id="H4C725A2BA9ED460982664923B24ABA63"><enum>(2)</enum><text>revoke the
			 passport or passport card of an individual who has been convicted by a court of
			 competent jurisdiction in a foreign country of a sex offense.</text>
					</paragraph></subsection><subsection id="H552A4BA9D3D24B72A05B9AF00F6BD3E2"><enum>(b)</enum><header>Limitation for
			 return to United States</header><text>Notwithstanding subsection (a), in no
			 case shall a United States citizen convicted by a court of competent
			 jurisdiction in a foreign country of a sex offense be precluded from entering
			 the United States due to a passport revocation under such subsection.</text>
				</subsection><subsection id="H360CC6BD993E4B9D85272B68BC94440F"><enum>(c)</enum><header>Reapplication</header><text>An
			 individual whose passport or passport card was revoked pursuant to subsection
			 (a)(2) may reapply for a passport or passport card at any time after such
			 individual has returned to the United States.</text>
				</subsection><subsection id="H8E42EADB271545F2989AE56D83A95327"><enum>(d)</enum><header>Definitions</header><text>For
			 purposes of this section:</text>
					<paragraph id="HBE4CF26E5EFC4F05ADD4C00EBA121292"><enum>(1)</enum><header>Sex
			 Offender</header><text>The term <term>sex offender</term> means an individual
			 who is listed on the National Sex Offender Registry established pursuant to
			 section 119 of the Sex Offender Registration and Notification Act (42 U.S.C.
			 16915).</text>
					</paragraph><paragraph id="H7F0448B3744B431097511DAD11D78BAE"><enum>(2)</enum><header>Sex
			 Offense</header><text>The term <term>sex offense</term> means a sex offense as
			 defined in section 111(5) of the Sex Offender Registration and Notification Act
			 (42 U.S.C. 16915).</text>
					</paragraph></subsection></section><section id="H134FE5A2A6C64B0D89B85E44044C2819"><enum>102.</enum><header>Office To
			 Monitor and Combat Modern Slavery and Other Forms of Human Trafficking</header>
				<subsection id="HEDA2080ED6E248379691118F8A122B74"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 105(e) of the
			 Trafficking Victims Protection Act of 2000 (22 U.S.C. 7103(e)) is
			 amended—</text>
					<paragraph id="H868744CFF90249F7BD4A4B8A71F613F2"><enum>(1)</enum><text display-inline="yes-display-inline">in the heading, by striking
			 <quote><header-in-text level="subsection" style="OLC">office to monitor and
			 combat trafficking</header-in-text></quote> and inserting
			 <quote><header-in-text level="subsection" style="OLC">office To monitor and
			 combat modern slavery and Other forms of human
			 trafficking</header-in-text></quote>;</text>
					</paragraph><paragraph id="HD4D908FD23CB4A8199C64BE670B5909A"><enum>(2)</enum><text>in paragraph
			 (1)—</text>
						<subparagraph id="H7A6BFA39A2234685A918D9B7AA78D5C5"><enum>(A)</enum><text>in the first
			 sentence, by striking <quote>Office to Monitor and Combat Trafficking</quote>

			 Office to Monitor and Combat Trafficking or to the Director of the Office to
			 Monitor and Combat Trafficking shall be deemed to be a reference to the Office
			 To Monitor and Combat Modern Slavery and Other Forms of Human Trafficking or to
			 the Ambassador-at-Large for Combating Human Trafficking, respectively.</text>
				</subsection></section><section id="H71B864D3832C432FB5204C0CB7E0D125"><enum>103.</enum><header>Prevention of
			 trafficking</header>
				<subsection id="HFCB4E337976E46C6A1D5CC32FB5646D8"><enum>(a)</enum><header>Economic
			 alternatives To prevent and deter trafficking</header><text display-inline="yes-display-inline">Section 106(a) of the Trafficking Victims
			 Protection Act of 2000 (22 U.S.C. 7104(a)) is amended—</text>
					<paragraph id="H4A93409C95CE4BAAA67328822793C3AA"><enum>(1)</enum><text>by striking
			 <quote>The President</quote> and inserting the following:</text>

				of trafficking:</text>

								</subparagraph><subparagraph id="HAFE265CCA1E24EA6839F5DDADA36A353"><enum>(B)</enum><text>Refugees and
				internally displaced persons.</text>
								</subparagraph><subparagraph id="HB3124E4521AD417C88473EA1180D4CFF"><enum>(C)</enum><text>Persons who lack
				access to legal representation or are otherwise marginalized.</text>
								</subparagraph><subparagraph id="H22744DA61278435B87C5340D8D9F436F"><enum>(D)</enum><text>Persons from
				regions of limited social protections or educational or economic options for
				women, particularly persons who are victims of sexual abuse or
				exploitation.</text>
								</subparagraph><subparagraph id="H33B7F279EB924A53B132EB840612A8AF"><enum>(E)</enum><text>Persons from
				regions of high undocumented migration or displacement resulting from violent
				conflict or natural disasters.</text>
								</subparagraph><subparagraph id="HFBFBFA76D4CE430DB6FA76175A8CBB92"><enum>(F)</enum><text>Persons from
				regions with high rates of child labor, child abandonment, or child sex
				tourism.</text>
								</subparagraph><subparagraph id="H7E457167F32D4547BC422DD981B020DB"><enum>(G)</enum><text>Persons who meet
				one or more of the criteria in subparagraphs (A) through
				(F).</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HC31C5318CD264762B2347D6C17C9F7C1"><enum>(b)</enum><header>Prevention of
			 trafficking in conjunction with post-Conflict and humanitarian emergency
			 assistance</header><text display-inline="yes-display-inline">Section 106(h) of
			 the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7104(h)) is
			 amended—</text>

			 <quote>The</quote> and inserting the following:</text>

			 Congress</header><text display-inline="no-display-inline">Section 110(b) of the
			 Trafficking Victims Protection Act of 2000 (22 U.S.C. 7107(b)(1)) is
			 amended—</text>

			 (1)—</text>

				<term>Refugee-Trafficking Connection</term> to highlight the vulnerability of
				refugee populations to human trafficking and to make recommendations for the
				prevention of refugee trafficking;</text>

							<paragraph id="H8FD77A69388F4C5780D748D3F755DF43"><enum>(1)</enum><header>Short
				title</header><text display-inline="yes-display-inline">This subsection may be
				cited as the <quote>Business Transparency on Trafficking and Slavery
				Act</quote>.</text>
							</paragraph><paragraph id="HCAC4D92192684086AF1DB4D0C7855807"><enum>(2)</enum><header>Disclosure</header><text display-inline="yes-display-inline">The Secretary of State, acting through the
				Ambassador-at-Large for Combating Human Trafficking, shall encourage any person
				described in paragraph (3)(B) to disclose on an annual basis on the person’s
				website and to the Secretary of State any measures such person has taken during
				the year to identify and address conditions of forced labor, slavery, human
				trafficking, and the worst forms of child labor within such person’s supply
				chains. Such disclosure should include the following information under a
				heading <quote>Policies to Address Forced Labor, Slavery, Human Trafficking and
				the Worst Forms of Child Labor</quote> describing to what extent, if any, the
				person conducts any of the following activities:</text>
								<subparagraph id="H083140F6E21944529EEC31B5272863B5"><enum>(A)</enum><text>Maintains a policy
				to identify and eliminate risks of forced labor, slavery, human trafficking,
				and the worst forms of child labor within its supply chain. If the person
				maintains such a policy, the disclosure should include the text of the policy
				or a substantive description of the elements of the policy.</text>
								</subparagraph><subparagraph id="HDF477335F7AB4C55BF4C336D89231338"><enum>(B)</enum><text>Maintains a policy
				prohibiting the use of the person’s corporate products, facilities, or services
				to obtain or maintain someone under conditions of forced labor, slavery, human
				trafficking, and the worst forms of child labor.</text>
								</subparagraph><subparagraph id="H78A93ECF11BE4B0A9251B9551BF3EF82"><enum>(C)</enum><text>Engages in
				verification of product supply chains to evaluate and address risks of forced
				labor, slavery, human trafficking and the worst forms of child labor. The
				disclosure should—</text>
									<clause id="HDDE2F503EB0F42C59B09D4100CC18841"><enum>(i)</enum><text>describe the
				greatest risks identified within the supply chain, and the measures taken
				toward eliminating those risks;</text>
									</clause><clause id="H396BC77EDB9A466A8CB14C6D958733EA"><enum>(ii)</enum><text>specify whether
				the verification was or was not conducted by a third party; and</text>
									</clause><clause id="HA9104EED903744FD8A8062BCD68D0A95"><enum>(iii)</enum><text>specify whether
				the verification process includes consultations with independent unions,
				workers’ associations, or workers within workplaces and incorporates the
				resulting certification or written comments from such independent union,
				workers’ associations, or workers.</text>
									</clause></subparagraph><subparagraph id="HE18B4D1F0D244800828D49EA10F7521C"><enum>(D)</enum><text>Ensures that
				audits of suppliers are conducted to evaluate supplier compliance with the
				person’s company standards for eliminating forced labor, slavery, human
				trafficking, and the worst forms of child labor in supply chains. The
				disclosure should specify if the verification was not an independent,
				unannounced audit.</text>
								</subparagraph><subparagraph id="HD5D2ABB89552436ABB65C8FB8EA04A11"><enum>(E)</enum><text>Assesses supply
				chain management and procurement systems of suppliers in the person’s supply
				chain, to verify whether said suppliers have in place appropriate systems to
				identify risks of forced labor, slavery, human trafficking, and the worst forms
				of child labor within their own supply chain.</text>
								</subparagraph><subparagraph id="HC859218A5116433D8F5F9269CB64168A"><enum>(F)</enum><text>Requires suppliers
				in its supply chain to certify that materials incorporated into the product
				comply with the laws regarding forced labor, slavery, human trafficking, and
				the worst forms of child labor of the country or countries in which they are
				doing business.</text>
								</subparagraph><subparagraph id="HC17673A420FD479B9F425B05C8D8D30E"><enum>(G)</enum><text>Maintains internal
				accountability standards, supply chain management and procurement systems, and
				procedures for employees or contractors failing to meet the person’s company
				standards regarding forced labor, slavery, human trafficking, and the worst
				forms of child labor. The disclosure should describe such standards and
				systems.</text>
								</subparagraph><subparagraph id="H77D59E253E8148998338FD7A7A2812C4"><enum>(H)</enum><text>Provides the
				person’s employees and management who have direct responsibility for supply
				chain management, training on forced labor, slavery, human trafficking and the
				worst forms of child labor, particularly with respect to mitigating risks
				within the supply chains of products.</text>
								</subparagraph><subparagraph id="H3C29F3C998B547D5BB2521E155661ACD"><enum>(I)</enum><text>Ensures that
				recruitment practices at all suppliers comply with the person’s company
				standards for eliminating exploitive labor practices that contribute to forced
				labor, slavery, human trafficking, and the worst forms of child labor,
				including by conducting audits of labor recruiters and disclosing the results
				of such audits.</text>
								</subparagraph><subparagraph id="HB0234567AC6C4510B0DE94129D5E9CCF"><enum>(J)</enum><text>In cases where
				forced labor, slavery, human trafficking, and the worst forms of child labor
				have been identified within the supply chain, ensures that remediation is
				provided to those who have been identified as victims.</text>
								</subparagraph></paragraph><paragraph id="H2063C3B7A54141C992BC73C585592520"><enum>(3)</enum><header>Definitions</header><text>In
				this subsection—</text>
								<subparagraph id="H0CB5C7061A194AEF8F56B19B58A18AED"><enum>(A)</enum><text>the term
				<quote>forced labor, slavery, human trafficking and the worst forms of child
				labor</quote> means child labor in violation of international standards
				including International Labor Organization Convention No. 182 and acts that
				would violate the criminal provisions related to slavery and human trafficking
				under chapter 77 of title 18 if they had been committed within the jurisdiction
				of the United States;</text>
								</subparagraph><subparagraph id="HDB7191D400474E75A2FC8657172440F3"><enum>(B)</enum><text>the term
				<quote>person</quote> means any publicly-traded or private entity wherever
				located, carrying out business operations in the United States, and having
				annual worldwide global receipts in excess of $100,000,000;</text>
								</subparagraph><subparagraph id="H9BCBB31441D744A096140AC50EBE3B01"><enum>(C)</enum><text>the term
				<quote>remediation</quote> means the activities or systems that a company puts
				in place to address non-compliance with the standards identified through
				monitoring or verification, which may apply to individuals adversely affected
				by the non-compliant conduct or address broader systematic processes;</text>
								</subparagraph><subparagraph id="H58EC17144A48496B9436EBB2493E33EC"><enum>(D)</enum><text>the term
				<quote>supply chain</quote>, with respect to a person making the disclosure
				described in subsection (a), means all suppliers of products, component parts
				of products, and raw materials used by such person in the manufacturing of such
				person’s products or the provision of such person’s services, whether or not
				such person has a direct relationship with the supplier; and</text>
								</subparagraph><subparagraph id="H4EF7AB4535D94BFCAB1827DFBBC5ED10"><enum>(E)</enum><text>the term
				<quote>verification</quote> means the process by which a company is evaluated
				to determine compliance with its documented program, including standards on
				forced labor, slavery, human trafficking, and the worst forms of child labor,
				including an evaluation of—</text>
									<clause id="H45A732D3813E463F91E5BA5B21AC591E"><enum>(i)</enum><text>data gathered
				through monitoring activities to ensure results are reliable and process is
				credible; and</text>
									</clause><clause id="HC8D20144D06040A882C1C4ADBEB00143"><enum>(ii)</enum><text>the system
				established to remediate violations to determine if remediation is implemented
				and
				effective.</text>
									</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H9336D364E6A44801884745D25D7F1EAB"><enum>107.</enum><header>Enhancing
			 protection for children exploited abroad by United States citizens and
			 permanent resident aliens</header><text display-inline="no-display-inline">Section 2423 of title 18, United States
			 Code, is amended—</text>
				<paragraph id="HAD94C2CA271E4228AB1A2AC3F43057BB"><enum>(1)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="H205DCA4FA98F4F829BB16C206721CE87"><enum>(A)</enum><text>by inserting
			 <quote>or engages in travel affecting</quote> before <quote>foreign
			 commerce</quote>; and</text>
					</subparagraph><subparagraph id="HE2BDD292A923444C9A39A9948005CCF5"><enum>(B)</enum><text>by inserting
			 <quote>(even if residing, whether temporarily or permanently, in a foreign
			 jurisdiction)</quote> after <quote>foreign commerce</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H6909A005F30449F98545F2CB289B4C38"><enum>(2)</enum><text>by inserting after
			 subsection (g) the following:</text>
					<quoted-block id="H4CA72DCE3F194F1CA92D3EA07DBF9EC8" style="OLC">
						<subsection id="H031832AA562D413C8523DBE2128A531C"><enum>(h)</enum><header>Non-Defenses</header><text>It
				is not a defense to a prosecution under subsection (c), based on illicit sexual
				conduct, that the defendant is not criminally liable or is subject to reduced
				criminal liability due to the de jure or de facto acceptance of the illicit
				conduct in the foreign jurisdiction in which the defendant travels or
				resides.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HAD50D338346B4B93B054D5C0E989D7D6"><enum>108.</enum><header>Sense of
			 Congress on human trafficking in Cambodia</header>
				<subsection id="HDC087994253D4700A9A8D91027B09E61"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
					<paragraph id="H29D50814347C4AE3ABD33C6459B9C08C"><enum>(1)</enum><text display-inline="yes-display-inline">According to notable news sources, the
			 Kingdom of Cambodia remains a <quote>magnet</quote> for those who sexually prey
			 on the young.</text>
					</paragraph><paragraph id="HF2E0D3771D9D45CCB8FCBE09A3AB7E92"><enum>(2)</enum><text>Human Rights Watch
			 reports that <quote>human trafficking of women and girls into sex work is a
			 problem in Cambodia, fuelled by corruption and a lack of political will to
			 prosecute traffickers</quote>.</text>
					</paragraph><paragraph id="H8599CFC9115B4E7D9B86089A57F098FF"><enum>(3)</enum><text>According to Human
			 Rights Watch, <quote>Cambodia is plagued not only by widespread abuses
			 committed by officials, but impunity for perpetrators.</quote>.</text>
					</paragraph><paragraph id="HD591B2DEE9EF476C957DB12565DBC063"><enum>(4)</enum><text>The 2011
			 Department of State’s Trafficking in Persons Report (TIP) states that
			 <quote>the Government of Cambodia did not demonstrate progress in law
			 enforcement efforts against trafficking crimes during the year</quote>, and
			 that <quote>in some cases, Cambodian police were reportedly unwilling to pursue
			 investigations of several suspected trafficking establishments during the year
			 because the establishments were thought to be owned by or affiliated with
			 high-ranking officials</quote>.</text>
					</paragraph><paragraph id="HF0EB6291B4F0427C9BA8665CBE74A5EB"><enum>(5)</enum><text>The Government of
			 Cambodia convicted only 20 trafficking offenders during 2010, <quote>a decrease
			 from 36 the previous reporting period</quote>, according to the 2011 TIP
			 Report.</text>
					</paragraph><paragraph id="HB1F00763269747E7A52B31CF02D36E34"><enum>(6)</enum><text>There was no
			 improvement in efforts by the Government of Cambodia to identify and protect
			 trafficking victims during the previous reporting period, according to the 2011
			 TIP Report.</text>
					</paragraph><paragraph id="H3000EF432D78409CA1708F4CEFD72364"><enum>(7)</enum><text>According to the
			 2011 TIP Report, <quote>countries whose governments do not fully comply with
			 the minimum standards and are not making significant efforts to do so</quote>,
			 will be designated as Tier 3 countries pursuant to section 110 of the
			 Trafficking Victims Protection Act of 2000 (22 U.S.C. 7107).</text>
					</paragraph></subsection><subsection id="HF7798C8E6A5646B89F335108E1B0D959"><enum>(b)</enum><header>Sense of
			 Congress</header><text display-inline="yes-display-inline">It is the sense of
			 Congress that—</text>
					<paragraph id="H41B13BD086ED46E188D2FC30750D2FFC"><enum>(1)</enum><text>the measures taken
			 by the Government of Cambodia are insufficient in addressing the scope of
			 Cambodia’s human trafficking problem; and</text>
					</paragraph><paragraph id="H92292E354DF4478FAE83F3C6C65E960F"><enum>(2)</enum><text display-inline="yes-display-inline">Cambodia should be designated as a Tier 3
			 country pursuant to section 110 of the Trafficking Victims Protection Act of
			 2000 (22 U.S.C. 7107).</text>
					</paragraph></subsection></section><section id="H525842DA77C34339808AE7FEB6B1DA31"><enum>109.</enum><header>Prohibition on
			 peacekeeping operations assistance to countries that recruit and use child
			 soldiers and revision to national interest waiver under the Child Soldiers
			 Prevention Act of 2008</header>
				<subsection id="H71BBBA340B324ADC9E485A576DC69AA6"><enum>(a)</enum><header>Prohibition on
			 peacekeeping operations assistance</header>
					<paragraph id="HDBF23971260E4B47A5CA56AA47B5AF18"><enum>(1)</enum><header>In
			 general</header><text>Section 404(a) of the Child Soldiers Prevention Act of
			 2008 (22 U.S.C. 2370c–1(a)) is amended—</text>
						<subparagraph id="H1DFE6F81CEBA45A48CF04DCD7C06306B"><enum>(A)</enum><text>by striking
			 <quote>or 541</quote> and inserting <quote>, 541, or 551</quote>; and</text>
						</subparagraph><subparagraph id="H4A6FAC8CE7E643499235FE16BAC61331"><enum>(B)</enum><text>by striking
			 <quote>or 2347</quote> and inserting <quote>, 2347, or 2348</quote>.</text>
						</subparagraph></paragraph><paragraph id="H1B4F6BA266724DE38FC65260AE69FC8F"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) take effect on the date
			 of the enactment of this Act and apply with respect to amounts made available
			 for assistance under section 551 of the Foreign Assistance Act of 1961 that are
			 unobligated or unexpended on or after such date.</text>
					</paragraph></subsection><subsection id="H6F8A2834984D4DEA8A5BF02E513FD0B0"><enum>(b)</enum><header>National
			 interest waiver</header><text display-inline="yes-display-inline">Section
			 404(c) of the Child Soldiers Prevention Act of 2008 (22 U.S.C. 2370c–1(c)) is
			 amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H0948EC85B1784B36B68703BEE063D74C" style="OLC">
						<subsection id="HC8F5CEDB3E3C44D681CF0C6526F29C47"><enum>(c)</enum><header>National
				interest waiver</header><text display-inline="yes-display-inline">The President
				may waive the application to a country of the prohibition in subsection (a)
				if—</text>
							<paragraph id="HBD8F220289E049EB8EB85294F202690B"><enum>(1)</enum><text>the President
				determines that such waiver is in the national interest of the United States;
				and</text>
							</paragraph><paragraph id="H3D191706AF454A62B6C0A549AF0559BC"><enum>(2)</enum><text>the President
				provides to the appropriate congressional committees at least 15 days in
				advance of exercising the waiver a justification for granting such a waiver,
				including a certification that the government of the country has taken credible
				and verifiable steps to implement a plan of action to end the recruitment and
				use of child soldiers, including the demobilization of child
				soldiers.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H8434E2F47DBD4FA9967AAAEFFEF580AB"><enum>110.</enum><header>Report on
			 Internet-facilitated human trafficking</header>
				<subsection id="H96B2A4051FFA44BC9B3C38583E62E57A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than
			 January 1, 2013, the Senior Policy Operating Group, in coordination with the
			 Office to Combat Modern Slavery and Other Forms of Human Trafficking of the
			 Department of State, shall submit to Congress a report on Internet-facilitated
			 human trafficking.</text>
				</subsection><subsection id="H63DC6506B6A34561BC3BC315BD563AD6"><enum>(b)</enum><header>Matters To be
			 included</header><text display-inline="yes-display-inline">The report shall
			 include the following:</text>
					<paragraph id="H045F75070F354E6FBE3706675F567D33"><enum>(1)</enum><text display-inline="yes-display-inline">Statistics and trends relating to
			 Internet-facilitated human trafficking cases over the last 10 years. To the
			 extent possible, the statistics and trends should be broken down by Federal
			 department and agency handling each case.</text>
					</paragraph><paragraph id="H5912A02D862F4602AF7686E602D7295D"><enum>(2)</enum><text>Factors that
			 impact the prevalence of Internet-facilitated trafficking, such as geography,
			 season, and large events.</text>
					</paragraph><paragraph id="H0D77862DDF0F422E9E4A0FDFE18A4743"><enum>(3)</enum><text>Specific
			 challenges faced by Federal departments and agencies in preventing
			 Internet-facilitated trafficking and prosecuting offenders.</text>
					</paragraph><paragraph id="H986919CBADAD4CE88360659FD4FF4D73"><enum>(4)</enum><text>Proposals to
			 assist the Federal government to prevent Internet-facilitated human
			 trafficking. In drafting the proposals, the Senior Policy Operating Group
			 should examine—</text>
						<subparagraph id="HD2405CCEC90146FCA011735F785184CD"><enum>(A)</enum><text>adoption of
			 cutting-edge technology;</text>
						</subparagraph><subparagraph id="H3B41FBF86ABB4838B1613625B5E515EC"><enum>(B)</enum><text>collaboration
			 between the private and public sectors;</text>
						</subparagraph><subparagraph id="H6DF7D56C39194E97B04EAEE8968E2E7A"><enum>(C)</enum><text>enforcement of
			 current laws;</text>
						</subparagraph><subparagraph id="H2D6266854B17473E8B783DA45EFC3E66"><enum>(D)</enum><text>improved
			 information gathering and interdepartmental collaboration; and</text>
						</subparagraph><subparagraph id="H9BDA21E808084625951EDC1E7686D7CF"><enum>(E)</enum><text>development of new
			 laws and policies.</text>
						</subparagraph></paragraph></subsection><subsection id="HF8F70DE22F4B4594866896E703090673"><enum>(c)</enum><header>Consultation</header><text display-inline="yes-display-inline">In preparing the report, the Senior Policy
			 Operating Group should consult with local law enforcement and private-sector
			 and non-profit agencies that have demonstrated a commitment to ending
			 Internet-facilitated human trafficking.</text>
				</subsection><subsection id="HBD0AF36A4F1A49EE84D2C74D06AB4CE5"><enum>(d)</enum><header>Definitions</header><text>In
			 this section—</text>
					<paragraph id="HA22A376BC831441CBE4DACF1C4A570BA"><enum>(1)</enum><text>the term
			 <quote>Internet-facilitated human trafficking</quote> means the use of the
			 Internet to engage in severe forms of trafficking in persons;</text>
					</paragraph><paragraph id="HE5991FB2F36B49458C41AF27EACC87D2"><enum>(2)</enum><text>the term
			 <quote>Senior Policy Operating Group</quote> means the Senior Policy Operating
			 Group—</text>
						<subparagraph id="H7E65E99B14EF45B5A414C995A662C4F0"><enum>(A)</enum><text>established under
			 section 105(f) of the Trafficking Victims Protection Act of 2000 (22 U.S.C.
			 7103(f)); and</text>
						</subparagraph><subparagraph id="H36911353B29840E89B294A8BB8AD0BD6"><enum>(B)</enum><text display-inline="yes-display-inline">chaired by the Ambassador-at-Large for
			 Combating Human Trafficking; and</text>
						</subparagraph></paragraph><paragraph id="H8C984C515969404FA43516B506355014"><enum>(3)</enum><text display-inline="yes-display-inline">the term <quote>severe forms of trafficking
			 in persons</quote> has the meaning given such term in section 103(8) of the
			 Trafficking Victims Protection Act of 2000 (22 U.S.C. 7102(8)).</text>

				the content of any existing protocols of the human trafficking taskforce for
				reporting trafficking and points of entry into the criminal investigation and
				service provision

						</paragraph></subsection></section><section id="HEA310E08F104476DAC435E8960138A83"><enum>203.</enum><header>Ensuring timely
			 response to requests for continued presence</header><text display-inline="no-display-inline">Section 107(c)(3)(A)(i) of the Trafficking
			 Victims Protection Act of 2000 (22 U.S.C. 7105 (c)(3)(A)(i)) is amended—</text>

			 presence with the Secretary of Homeland Security and, if not, whether the
			 official expects to do so. Not later than one month after the date on which
			 such an application is filed, the Secretary of Homeland Security shall approve

				violate section 1351 of this title or section 274 of the Immigration and

				without lawful authority, maintain, prevent, or restrict the labor of services

			 end the following: <quote>In the course of building or remodeling existing
			 immigration facilities, consideration should be given to including separate
			 child-friendly space conducive to disclosing information relating to human
			 trafficking or exploitation.</quote>.</text>
							</subparagraph></paragraph><paragraph id="HC186F442C5094B8B9166896668EC4E30"><enum>(3)</enum><text display-inline="yes-display-inline">Section 235(a)(5) of the William
			 Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (8
			 U.S.C. 1232(a)(5)) is amended by adding at the end the following:</text>

				alien children screened for severe forms of human trafficking.</text>
									</clause><clause id="H5332FDEFD9F24A91AF38C39582F17DD7"><enum>(iii)</enum><text>Whether the
				screening was conducted by an individual with expertise in child
				welfare.</text>
									</clause><clause id="H08516B8BE282443D950B4D73B54A37FF"><enum>(iv)</enum><text>How many of these
				children were repatriated and how many were diverted into
				services.</text>
									</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="H26E5AD871DED4F7AAD323E2E2DE533E9"><enum>(b)</enum><header>Combating Child
			 Trafficking and Exploitation in the United States</header><text>Section
			 235(b)(2) of the William Wilberforce Trafficking Victims Protection
			 Reauthorization Act of 2008 (8 U.S.C. 1232(b)(2)) is amended by striking

				that he or she is not a danger to the community or a flight risk; and</text>
								</subparagraph><subparagraph id="HB0B8527C64654D6AB02AB65BA25F6AC1"><enum>(C)</enum><text>has become
				ineligible, by reason of age, for placement as a
				child.</text>
								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph><paragraph id="H30750F01511544079C0642044DBF7CC6"><enum>(2)</enum><text display-inline="yes-display-inline">Section 235(c)(3)(B) of the William
			 Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (8
			 U.S.C. 1232(c)(3)(B)) is amended as follows:</text>
							<subparagraph id="H34A0636DF6E84C5AB1C366D4621F57EF"><enum>(A)</enum><text>After <quote>is
			 first necessary.</quote> insert the following: <quote>If the sponsor is a
			 parent, a home study shall be conducted where there are allegations of current
			 or past abuse or neglect of the child by the parent or where, based on all
			 available objective evidence, the parent clearly presents a risk of abuse,
			 maltreatment, exploitation, or trafficking to the child.</quote>.</text>
							</subparagraph><subparagraph id="HEADC91BAC9034572AE32B25FA1BD90E8"><enum>(B)</enum><text>Strike <quote>A
			 home study</quote> and insert the following: <quote>If the sponsor is anyone
			 other than the parent, a home study</quote>.</text>
							</subparagraph><subparagraph id="HBAA786272041469E9D8F2C626D04DEDB"><enum>(C)</enum><text>Strike
			 <quote>shall conduct follow-up services</quote> and all that follows through
			 <quote>for whom a home study was conducted</quote> and insert the following:
			 <quote>shall provide at least 1 visit for follow-up services on all children
			 not later than 45 days after placement,</quote>.</text>
							</subparagraph></paragraph></subsection></section><section commented="no" id="H6BEC89AE204D40E7BCC1B421E0108B8D"><enum>222.</enum><header>Improving local
			 efforts to combat trafficking and sexual exploitation of children</header><text display-inline="no-display-inline">Section 471(a) of the Social Security Act
			 (42 U.S.C. 671(a)) is amended—</text>
					<paragraph id="H36023C1E3005413C938E13E784353845"><enum>(1)</enum><text>in paragraph (32),

								<subparagraph id="H528B87971F864FEF95669BF89E888C3F"><enum>(A)</enum><text>collaborations
				with local and State agencies and non-profit organizations to identify and care
				for children believed or confirmed to be, or at-risk of becoming victims of a
				severe form of human trafficking;</text>
								</subparagraph><subparagraph id="H425AA5EB55294F7FB3FECCBB6D448B89"><enum>(B)</enum><text>training for the
				child welfare employees who are likely to come into contact with child victims
				of human trafficking;</text>
								</subparagraph><subparagraph id="H2EFBB82DF6C34139BF9B5B20D06C3779"><enum>(C)</enum><text>jurisdictional
				limits and other issues that hinder State child welfare response to aid child
				victims of human trafficking;</text>
								</subparagraph><subparagraph id="HE1010CCF2D3947A08176E6F4D4FA5341"><enum>(D)</enum><text>data collection
				regarding children identified by child welfare services as victims of
				trafficking and, if known, relationship to exploiter; and</text>
								</subparagraph><subparagraph id="HC77B27F226DB4561A69F0DCEE3AE786D"><enum>(E)</enum><text>prevention
				education to families and at-risk children, including runaway and homeless
				youth, regarding human trafficking and commercial sexual
				exploitation.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="HAC7B2C22908B4275AD0F24C33BB0B36C"><enum>223.</enum><header>Efforts to
			 publicize the National Human Trafficking Resource Center hotline</header>
					<subsection id="H17B50060A9D741EB9950F3D975BBAB3B"><enum>(a)</enum><header>Grantee hotline
			 information</header><text display-inline="yes-display-inline">The Attorney
			 General shall consult with the Secretary of Health and Human Services to make
			 reasonable efforts to distribute information to enable grantees under section
			 107(b) of the Trafficking Victims Protection Act of 2000 to publicize the
			 National Human Trafficking Resource Center hotline on their Web sites, within
			 the program’s headquarters as well as field offices across the United
			 States.</text>
					</subsection><subsection id="HE207CEC8897041E5B148383CA6BE9656"><enum>(b)</enum><header>Hotline
			 information</header>
						<paragraph id="H12A0A265A0F9481884DE32F501E23C37"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Health and Human Services, in
			 coordination with the Attorney General, shall make reasonable efforts to
			 encourage States to adopt legislation to raise public awareness of the National
			 Human Trafficking Resource Center hotline in every mandated establishment where
			 victims of human trafficking may possibly work or visit.</text>
						</paragraph><paragraph id="HD9E6C766768A40E5A0BF88FC511FEF1E"><enum>(2)</enum><header>Posting of model
			 hotline information</header><text display-inline="yes-display-inline">The
			 legislation described in paragraph (1) should include a requirement that
			 information relating to the National Human Trafficking Resource Center hotline
			 be posted in accordance with the following specifications:</text>
							<subparagraph id="HB2AF9EE8A83F4BA1B3526BDF98A47E55"><enum>(A)</enum><header>Poster
			 location</header><text display-inline="yes-display-inline">The poster should be
			 publicly displayed in a conspicuous place near the entrance of mandated
			 establishments or where such posters and notices are customarily posted in such
			 establishments.</text>
							</subparagraph><subparagraph id="H3C7B0FFC81B54756A25D640B2B433D08"><enum>(B)</enum><header>Poster
			 specifications</header><text display-inline="yes-display-inline">The poster
			 should be no smaller than 8½ by 11 inches in size and state the following:
			 <quote>If you or someone you know is being forced to engage in any activity and
			 cannot leave—whether it is commercial sex, housework, farm work, or any other
			 activity—call the National Human Trafficking Resource Center Hotline at
			 1–888–373–7888 to access help and services. Victims of human trafficking are
			 protected under United States and State law. The Hotline is: Available 24 hours
			 a day, 7 days a week. Toll-free. Operated by a non-profit, nongovernmental
			 organization. Anonymous &amp; Confidential. Accessible in 170 languages. Able
			 to provide help, referral to services, training, and general
			 information.</quote>.</text>
							</subparagraph><subparagraph id="HC08B94A231114E0C99B56CED25E8B506"><enum>(C)</enum><header>Languages</header><text display-inline="yes-display-inline">The poster should be printed in English,
			 Spanish, and any other languages required by the Voting Rights Act in the
			 county in which the poster will be posted.</text>
							</subparagraph><subparagraph id="HFAA503B2675E400B95D02DB3E05004A1"><enum>(D)</enum><header>Notice</header><text display-inline="yes-display-inline">The licensing authority should provide each
			 mandated establishment with notice of this section and with the required poster
			 upon licensing and should place the poster on its public Web site for mandated
			 establishments to print as needed.</text>
							</subparagraph></paragraph><paragraph id="H1CF414F0CA5241F6B8CCA56EAB376409"><enum>(3)</enum><header>Definition of
			 Mandated Establishment</header><text display-inline="yes-display-inline">For
			 purposes of this section, a <term>mandated establishment</term> means—</text>
							<subparagraph id="HCC2D87BC5A0043DAA828A09F9E911083"><enum>(A)</enum><text>a massage parlor,
			 spa, or other similar establishment;</text>
							</subparagraph><subparagraph id="H91D033618EAB4F88A13E73FB93EB2C6F"><enum>(B)</enum><text>an establishment
			 that receives a liquor license;</text>
							</subparagraph><subparagraph id="H058F29AF3F5A4AFEBF3916FE95B22385"><enum>(C)</enum><text>a strip club or
			 other sexually oriented business;</text>
							</subparagraph><subparagraph id="HA5F3267886874784A2E8527661F401F8"><enum>(D)</enum><text>a
			 restaurant;</text>
							</subparagraph><subparagraph id="H0E66736FE17648DEB6651BAB0DA384A9"><enum>(E)</enum><text>an airport;</text>
							</subparagraph><subparagraph id="H82AEADD6D76043429D1EB0F4CDF4AB91"><enum>(F)</enum><text>a train
			 station;</text>

			 assistance</header>
				<subsection id="H611F04FEBE924A82A84793C8F039F42E"><enum>(a)</enum><header>Prohibition
			 against discrimination</header>
					<paragraph id="H13FF7814FE9B487898006AF8073F1F1A"><enum>(1)</enum><header>In
			 general</header><text>An organization, including a faith-based organization,
			 that is otherwise eligible to receive assistance under any provision of law
			 referenced in subsection (d) shall not be—</text>
						<subparagraph id="H215AAB0513384C8F97150C07DFDB2BF5"><enum>(A)</enum><text>required, as a
			 condition of receiving such assistance, to endorse, utilize, provide, make a
			 referral to, become integrated with, or otherwise participate in any program,
			 project, or activity to which the organization has a religious or moral
			 objection; or</text>
						</subparagraph><subparagraph id="HD250FCE22D634154BFB90A1F444D2878"><enum>(B)</enum><text>discriminated
			 against in the solicitation or issuance of grants, contracts, cooperative
			 agreements, or other Federal funding under any provision of law referenced in
			 subsection (d) for refusing to meet any requirements described in subparagraph
			 (A).</text>
						</subparagraph></paragraph><paragraph commented="no" id="H20F4289A99C149948D6A4740866D179F"><enum>(2)</enum><header>Rule of
			 construction</header><text display-inline="yes-display-inline">Nothing in this
			 subsection shall be construed to prohibit the Federal government from making
			 alternative arrangements for any program, project, or activity to which an
			 organization has a moral or religious objection, if such arrangements—</text>
						<subparagraph commented="no" id="H4BF23FA879CC49F0BFDC0ECDB6FE3C30"><enum>(A)</enum><text>do not violate the
			 provisions of paragraph (1); and</text>
						</subparagraph><subparagraph commented="no" id="HC6709BC848E04B6C8E4DFA22FC72B663"><enum>(B)</enum><text>are not made for
			 any program, project, or activity for which Federal funding is otherwise
			 prohibited.</text>
						</subparagraph></paragraph></subsection><subsection id="H18216D8CE71E4DF69D99FB6C7E58DBCC"><enum>(b)</enum><header>Remedies</header>
					<paragraph id="H90367281AB194662908B4657E6EAF974"><enum>(1)</enum><header>In
			 general</header><text>The courts of the United States shall have jurisdiction
			 to prevent and redress actual or threatened violations of this section by
			 issuing any form of legal or equitable relief, including—</text>
						<subparagraph id="H0FC2F9B3B1244B69BA777A9C417E565C"><enum>(A)</enum><text>injunctions
			 prohibiting conduct that violates this section; and</text>
						</subparagraph><subparagraph id="HBD9B06C08C834AB69387297E6225E18C"><enum>(B)</enum><text>orders preventing
			 the disbursement of all or a portion of Federal financial assistance to a
			 specific offending department, agency, or program, project, or activity until
			 such time as the conduct prohibited by this section has ceased.</text>
						</subparagraph></paragraph><paragraph id="H57546A3C2E1F4601AC3E1877CD86FED3"><enum>(2)</enum><header>Commencement of
			 action</header><text>An action under this section may be instituted by—</text>
						<subparagraph id="H0D2CFD27773A47EFB29384052EBEB0EC"><enum>(A)</enum><text>any organization
			 that has standing to complain of an actual or threatened violation of this
			 section; or</text>
						</subparagraph><subparagraph id="HFA2B32E64C6E4CAAB8833D52C51C83FA"><enum>(B)</enum><text>the Attorney
			 General of the United States.</text>
						</subparagraph></paragraph><paragraph id="HE27CF7D2D6C94204BC02A6403601F81A"><enum>(3)</enum><header>Relation to
			 administrative remedies</header><text>A party may commence or continue an
			 action and obtain relief under this subsection without regard to whether a
			 complaint under subsection (c) has been filed or is pending.</text>
					</paragraph></subsection><subsection id="H1FB10C36A9EF41878A98F2E3219A7CE8"><enum>(c)</enum><header>Administration</header><text>The
			 President shall designate an official within each Federal department or agency
			 that receives funding to carry out any provision of law referenced in
			 subsection (d)—</text>
					<paragraph id="HFDCF23FBCDE34E9D835F85B69554F891"><enum>(1)</enum><text>to receive
			 complaints alleging a violation of this section; and</text>
					</paragraph><paragraph id="HB476DBE636A74D439C7D109C6DFBC465"><enum>(2)</enum><text>to pursue the
			 investigation of such complaints, in coordination with the Attorney
			 General.</text>
					</paragraph></subsection><subsection id="H50A7B95E53D2423CAF12A1B646FAC3D9"><enum>(d)</enum><header>Provisions of
			 law</header><text display-inline="yes-display-inline">The provisions of law
			 referenced in this subsection are the following:</text>
					<paragraph id="HAA81A18FA9D94AD1A358AD7777D2D33D"><enum>(1)</enum><text>This Act or any
			 amendment made by this Act.</text>
					</paragraph><paragraph id="HEA3AAD8E8401422384DBB320AEECBED0"><enum>(2)</enum><text>The Trafficking
			 Victims Protection Act of 2000.</text>
					</paragraph><paragraph id="HE176320AEDC74B8AB4583979E0DC200B"><enum>(3)</enum><text>The Trafficking
			 Victims Protection Reauthorization Act of 2005.</text>
					</paragraph><paragraph id="H4AD6FE73768649DCB6E508D7ADCD03BF"><enum>(4)</enum><text>The William
			 Wilberforce Trafficking Victims Protection Reauthorization Act of 2008.</text>
					</paragraph></subsection></section><section id="H725BA668E3F54C559368528FC8021E2C"><enum>304.</enum><header>Reporting
			 requirements</header>
				<subsection id="H8F014C1830B34C51840A1CB6D7B3684D"><enum>(a)</enum><header>Appropriations</header><text display-inline="yes-display-inline">Not later than March 31 of 2012 and 2013,
			 the President shall submit to Congress a report for the prior fiscal year that
			 shall include—</text>
					<paragraph id="HEEBD2D2296C2494C8E40A78671059EE5"><enum>(1)</enum><text display-inline="yes-display-inline">the amount of appropriations that each
			 department or agency for which such appropriations were authorized under the
			 Trafficking Victims Protection Act of 2000 or the Trafficking Victims
			 Protection Reauthorization Act of 2005 directed to activities described in such
			 Acts;</text>
					</paragraph><paragraph id="H63B0555DEBD144A5A11B25F76EEC1CD9"><enum>(2)</enum><text>a
			 list of the activities funded through the appropriations identified in
			 paragraph (1), including the responsible department or agency and the section
			 of the Trafficking Victims Protection Act of 2000 or the Trafficking Victims
			 Protection Reauthorization Act of 2005 that authorizes such activity;
			 and</text>
					</paragraph><paragraph id="HF6B1070DBE7D494CA8CD3D726B9692C7"><enum>(3)</enum><text>the appropriations
			 account from which each activity described in paragraph (2) was funded and the
			 amount contributed from such account for each activity.</text>
					</paragraph></subsection><subsection id="H8768A38282914AAAB9DC2A12FD5217A9"><enum>(b)</enum><header>Nondiscrimination</header>
					<paragraph id="H2DFDBA3E82734751823072F1AEC72E2D"><enum>(1)</enum><header>Initial
			 report</header><text>Not later than 90 days after the enactment of this Act,
			 the President shall submit to Congress a report indicating the official
			 designated in accordance with the requirement set forth in section
			 303(c).</text>
					</paragraph><paragraph id="H9F03ACF0561444C0BE7F47715933B741"><enum>(2)</enum><header>Subsequent
			 reports</header><text>Not later than one year after the enactment of this Act,
			 and every year thereafter for 4 years, the President shall submit to Congress a
			 report indicating—</text>
						<subparagraph id="HE2E354CEBFBD43E780AE68DBD2C85F5A"><enum>(A)</enum><text>any actions filed
			 pursuant to section 303(b);</text>
						</subparagraph><subparagraph id="H65745AF8FC774E2EAA5F492024FC775C"><enum>(B)</enum><text>any complaints
			 filed pursuant to section 303(c)(1); and</text>
						</subparagraph><subparagraph id="H6CAFCDE3DFE9492783A64E1E96590943"><enum>(C)</enum><text>the status and
			 results, if available, of any investigation undertaken pursuant to section
			 303(c)(2).</text>
