		<official-title>To require the proposal for debarment from contracting
		  with the Federal Government of persons violating the Foreign Corrupt Practices
		  Act of 1977.</official-title>

		<section id="H5B74C3D81F374E019EB11F49591D7DFC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Overseas Contractor Reform
			 Act</short-title></quote>.</text>
		</section><section id="H5D098AF9A0EE42ECA7995D1F3570BE4A"><enum>2.</enum><header>Requirement to
			 propose for debarment persons violating the Foreign Corrupt Practices
			 Act</header>
			<subsection id="H2BBE702D1BA74261B7E097B8FCD8E5EF"><enum>(a)</enum><header>Requirement To
			 propose for debarment</header><text>Subject to subsections (b) and (c), any
			 person found to be in violation of the Foreign Corrupt Practices Act of 1977
			 shall be proposed for debarment from any contract or grant awarded by the
			 Federal Government within 30 days after the judgment finding such person to be
			 in violation becomes final.</text>
			</subsection><subsection id="HB17FA766BD6A47C99C401F2E188D50AE"><enum>(b)</enum><header>Waiver</header><text>The
			 head of a Federal agency may waive this Act for a Federal contract or grant.
			 Any such waiver shall be reported to Congress by the head of the agency
			 concerned within 30 days from the date of the waiver, along with an
			 accompanying justification.</text>
			</subsection><subsection id="H431FB9399C274057A8F1D4402D2C362A"><enum>(c)</enum><header>Exemption for
			 self-Reported violations</header><text>Upon a determination by the head of a
			 Federal agency that a person has reported a violation of the Foreign Corrupt
			 Practices Act of 1977 voluntarily to the Federal Government, the head of the
			 agency may exempt the person from the applicability of this Act.</text>
			</subsection><subsection id="H065231BF9C7B49269479AB28F5BFD060"><enum>(d)</enum><header>Final
			 judgment</header><text>For purposes of this Act, a judgment becomes final when
			 all appeals of the judgment have been finally determined, or all time for
			 filing such appeals has expired.</text>
			</subsection><subsection id="H606661A7667040628A46AC8DB7E75FCD"><enum>(e)</enum><header>Definitions</header><text>In
			 this Act:</text>
				<paragraph id="H6F12DA9E5FE24AA7BB836C479A91FCA2"><enum>(1)</enum><header>Contract</header><text>The
			 term <term>contract</term> means a binding agreement entered into by a Federal
			 agency for the purpose of obtaining property or services.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8CAA7F0B56134E65976D9234CEB55505"><enum>(2)</enum><header>Foreign Corrupt
			 Practices Act of 1977</header><text display-inline="yes-display-inline">The
			 term <quote>Foreign Corrupt Practices Act of 1977</quote> means—</text>
					<subparagraph commented="no" id="HD2D61E23AE1F44D5927AEBC89C602F8B"><enum>(A)</enum><text>section 30A of the
			 Securities Exchange Act of 1934 (15 U.S.C. 78dd–1); and</text>
					</subparagraph><subparagraph commented="no" id="H0A2B0C3908924AC4BFEB4992A0790636"><enum>(B)</enum><text>sections 104 and
			 104A of the Foreign Corrupt Practices Act (15 U.S.C. 78dd–2 and 78dd–3).</text>
					</subparagraph></paragraph></subsection></section><section id="HDC26723E649C456B84FE8D4ECA3C3BBA"><enum>3.</enum><header>Governmental
			 policy</header><text display-inline="no-display-inline">It is the policy of the
			 United States Government that no Government contracts or grants should be
			 awarded to individuals or companies who violate the Foreign Corrupt Practices
			 Act of 1977 after the date of the enactment of this Act.</text>
