		<official-title>To amend the Federal Election Campaign Act of 1971 to
		  require personal disclosure statements in all third-party communications
		  advocating the election or defeat of a candidate, to require the disclosure of
		  identifying information within communications made through the Internet, to
		  apply disclosure requirements to prerecorded telephone calls, and for other

		<section display-inline="no-display-inline" id="H2F09796F7B0E4C9DAD50D19240131412" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Stand By Every Ad Act of
			 2011</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H5EF810F0111647AAB1FEF6303D770C36"><enum>2.</enum><header>Requiring
			 Personal Disclosure Statements in Express Advocacy Communications</header>
			<subsection id="H830C64681BD64F07A83ADFB99C09EB4F"><enum>(a)</enum><header>Application of
			 Disclosure Requirements to Communications Consisting of Functional Equivalent
			 of Express Advocacy</header><text display-inline="yes-display-inline">Section
			 318(a) of the Federal Election Campaign Act of 1971 (2 U.S.C. 441d(a)) is
			 amended by striking <quote>clearly identified candidate,</quote> and inserting
			 <quote>clearly identified candidate or consisting of the functional equivalent
			 of express advocacy,</quote>.</text>
			</subsection><subsection id="HC43DC5C199DC482EB0CEA1B6422F4AFA"><enum>(b)</enum><header>Requiring
			 Statement Identifying Head of Entity Paying for Communication</header><text display-inline="yes-display-inline">Section 318(d) of such Act (2 U.S.C.
			 441d(d)) is amended—</text>
				<paragraph id="H60B576C43E37471EBFB82999E9CFA463"><enum>(1)</enum><text>in paragraph (2),
			 by striking <quote>Any communication</quote> and inserting <quote>Except as
			 provided in paragraph (3), any communication</quote>; and</text>
				</paragraph><paragraph id="HC9B56FA0985B4514862F77B3096594E3"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H6A7261C498D74D64B251CC3167FA0FE8" style="OLC">
						<paragraph id="HB565CB81603C4A3C96F74183F570D42E"><enum>(3)</enum><header>Special rules
				for express advocacy communications</header>
							<subparagraph id="HEA732DFCBC5E44C2965EC515EFB08C29"><enum>(A)</enum><header>Personal
				disclosure statement required</header><text display-inline="yes-display-inline">Any communication described in paragraph
				(3) of subsection (a) which expressly advocates the election or defeat of a
				clearly identified candidate, or which consists of the functional equivalent of
				express advocacy, and which is transmitted through radio or television shall
				include, in addition to the requirements of that paragraph—</text>
								<clause id="H577F5783BAA54E5AB764D776780B5E63"><enum>(i)</enum><text>the individual
				disclosure statement described in subparagraph (C) (if the person paying for
				the communication is an individual) or the organizational disclosure statement
				described in subparagraph (D) (if the person paying for the communication is
				not an individual); and</text>
								</clause><clause id="HE40B4C4EB7644E30B6CC6BB76F9432AC"><enum>(ii)</enum><text>if the person who
				paid for the communication received any disbursement from another person for
				purposes of financing the communication, a statement of the names of the
				persons providing the largest disbursements for such purposes, except that the
				number of persons identified in the statement may not exceed 5.</text>
								</clause></subparagraph><subparagraph id="H502FE90C643648309E9849EEEDAEEEA7"><enum>(B)</enum><header>Method of
				conveyance of statement</header>
								<clause id="HFE9758FE46DD46098E95C83B0E48BA13"><enum>(i)</enum><header>Communications
				transmitted through radio</header><text display-inline="yes-display-inline">In
				the case of a communication to which this paragraph applies which is
				transmitted through radio, the disclosure statements required under
				subparagraph (A)—</text>
									<subclause id="H0EBDDFB980684A6080B62DA9371A6E55"><enum>(I)</enum><text>shall be made by
				audio in a clearly spoken manner; and</text>
									</subclause><subclause id="H03B2803A68B247C58E8E2EE2BF0E865D"><enum>(II)</enum><text>in the case of
				the individual disclosure statement described in subparagraph (C) or the
				organization disclosure statement described in subparagraph (D), shall be made
				by the applicable individual.</text>
									</subclause></clause><clause id="H8B194A31BDD045D0BE8CD1407F8DB4B7"><enum>(ii)</enum><header>Communications
				transmitted through television</header><text display-inline="yes-display-inline">In the case of a communication to which
				this paragraph applies which is transmitted through television, the disclosure
				statements required under subparagraph (A)—</text>
									<subclause id="HEEE30A7FB8AD4BD3940863025D3BE60E"><enum>(I)</enum><text>shall appear in
				writing at the end of the communication in a clearly readable manner, with a
				reasonable degree of color contrast between the background and the printed
				statement, for a period of at least 4 seconds; and</text>
									</subclause><subclause id="HE671A0ABA68549B39E384F499CD46B83"><enum>(II)</enum><text display-inline="yes-display-inline">in the case of the individual disclosure
				statement described in subparagraph (C) or the organization disclosure
				statement described in subparagraph (D), shall be conveyed by an unobscured,
				full-screen view of the applicable individual, or by the applicable individual
				making the statement in voice-over accompanied by a clearly identifiable
				photograph or similar image of the individual.</text>
									</subclause></clause></subparagraph><subparagraph id="H2697A3E8FCE845F4A63D3E609A8FD929"><enum>(C)</enum><header>Individual
				disclosure statement described</header><text>The individual disclosure
				statement described in this subparagraph is the following: <quote>I am _______,
				and I am responsible for the content of this advertising.</quote>, with the
				blank filled in with the name of the applicable individual.</text>
							</subparagraph><subparagraph id="HCADF4F25494C45E48D832DDF23D88F0C"><enum>(D)</enum><header>Organizational
				disclosure statement described</header><text>The organizational disclosure
				statement described in this subparagraph is the following: <quote>I am _______,
				the _______ of _______, and _______ is responsible for the content of this
				advertising.</quote>, with—</text>
								<clause id="H2AB35D00A06E46F9AE5CD006C2E1D5B4"><enum>(i)</enum><text>the first blank to
				be filled in with the name of the applicable individual;</text>
								</clause><clause id="HAF3ACB68C4644E919F4A7D0D8343310C"><enum>(ii)</enum><text>the second blank
				to be filled in with the title of the applicable individual; and</text>
								</clause><clause id="HBCEB06B02A2243ECB493E2CF072BB8D2"><enum>(iii)</enum><text>the third and
				fourth blank each to be filled in with the name of the person paying for the
				communication.</text>
								</clause></subparagraph><subparagraph id="HE9860875D8224646B837F936545AB3CF"><enum>(E)</enum><header>Applicable
				individual defined</header><text>In this paragraph, the term <term>applicable
				individual</term> means, with respect to a communication to which this
				paragraph applies—</text>
								<clause id="H215F5E5044D94B239EB5EB042E66468D"><enum>(i)</enum><text display-inline="yes-display-inline">if the communication is paid for by an
				individual, the individual paying for the communication;</text>
								</clause><clause id="H81569EB994874A98A0E5F79FD53083C0"><enum>(ii)</enum><text>if the
				communication is paid for by a corporation, the chief executive officer of the
				corporation (or, if the corporation does not have a chief executive officer,
				the highest ranking official of the corporation);</text>
								</clause><clause id="H315745687D594179B8F5039484472CA2"><enum>(iii)</enum><text>if the
				communication is paid for by a labor organization, the highest ranking officer
				of the labor organization; or</text>
								</clause><clause id="H92FB55C59D574554AEED7567835F6701"><enum>(iv)</enum><text>if the
				communication is paid for by any other person, the president, chief executive
				officer, highest ranking official, or similar officer of the person who serves
				in an executive, decision-making capacity with respect to the making of
				communications to which this paragraph applies.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H029466AB3AE54176AE3E66FFF0F55707"><enum>(c)</enum><header>Effective
			 Date</header><text>The amendment made by subsection (a) shall apply with
			 respect to communications made on or after the date of the enactment of this
			 Act.</text>
			</subsection></section><section id="H830EDE65B81746CF80CF3CEDB482C557"><enum>3.</enum><header>Application of
			 disclosure requirements for audio and video communications to audio and video
			 portions of communications transmitted through Internet or electronic
			 mail</header>
			<subsection id="HD67E12E83E9540F8AE76F57AFA444F6E"><enum>(a)</enum><header>Communications
			 by Candidates or Authorized Persons</header><text display-inline="yes-display-inline">Section 318(d)(1) of the
			 <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name>
			 (2 U.S.C. 441d(d)(1)) is amended by adding at the end the following new
			 subparagraph:</text>
				<quoted-block act-name="Federal Election Campaign Act of 1971" id="HE711EFEBF8AD4B47B3F45CE394E39FCC">
					<subparagraph id="HCC02CF60C95445189F37FF9E5ED7AF5F"><enum>(C)</enum><header>Audio and video
				portions of communications transmitted through Internet or electronic
				mail</header><text>In the case of a communication described in paragraph (1) or
				(2) of subsection (a) which is transmitted through the Internet or through any
				form of electronic mail—</text>
						<clause id="H5A678E8E6F5A474699436F96D73FC90B"><enum>(i)</enum><text>any audio portion
				of the communication shall meet the requirements applicable under subparagraph
				(A) to communications transmitted through radio; and</text>
						</clause><clause id="HCF1A198BEB314A38963EAD520F66AAF4"><enum>(ii)</enum><text>any video portion
				of the communication shall meet the requirements applicable under subparagraph
				(B) to communications transmitted through
				television.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H40BBCE83B37845B6B3C00870C5D8C2BD"><enum>(b)</enum><header>Communications
			 by Others</header>
				<paragraph id="H4474CFFE9F88400AA94675A0D24B0FF1"><enum>(1)</enum><header>In
			 general</header><text>Section 318(d)(2) of such Act (2 U.S.C. 441d(d)(2)) is
			 amended by adding at the end the following: <quote>In the case of a
			 communication described in paragraph (3) of subsection (a) which is transmitted
			 through the Internet or through any form of electronic mail, any audio portion
			 of the communication shall meet the requirements applicable under this
			 paragraph to communications transmitted through radio and any video portion of
			 the communication shall meet the requirements applicable under this paragraph
			 to communications transmitted through television.</quote>.</text>
				</paragraph><paragraph id="HF7D1045CFBE84827AFBCDE80E03D0321"><enum>(2)</enum><header>Application of
			 special personal disclosure rules for express advocacy
			 communications</header><text>Section 318(d)(3) of such Act, as added by section
			 2(a), is amended—</text>
					<subparagraph id="HE1ED52C991264E1EBEE5255C18B4B8F7"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>radio or television</quote> and inserting <quote>radio
			 or television, through the Internet, or through any form of electronic
			 mail</quote>; and</text>
					</subparagraph><subparagraph id="HF8D68567E5FE4A3C99B20F0972E7BA1C"><enum>(B)</enum><text>in subparagraph
			 (B), by adding at the end the following new clause:</text>
						<quoted-block display-inline="no-display-inline" id="H571D65E8068C4511AA7E9D1705E91FA7" style="OLC">
							<clause id="H028F4E6C360C4DB1ABB277D82699316C"><enum>(iii)</enum><header>Communications
				transmitted through Internet or electronic mail</header><text display-inline="yes-display-inline">In the case of a communication to which
				this paragraph applies which is transmitted through the Internet or through any
				form of electronic mail, any audio portion of the communication shall meet the
				requirements applicable under this paragraph to communications transmitted
				through radio and any video portion of the communication shall meet the
				requirements applicable under this paragraph to communications transmitted
				through television.</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection></section><section id="HC8980472B62641D8B04F7059084CF661"><enum>4.</enum><header>Disclosure
			 requirements for campaign communications made through prerecorded telephone
			 calls</header>
			<subsection id="H862D9B41CE634651B2647D3474CF2399"><enum>(a)</enum><header>Application of
			 requirements</header><text>Section 318(a) of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (2 U.S.C.
			 441d(a)) is amended by inserting after <quote>mailing,</quote> each place it
			 appears the following: <quote>telephone call which consists in substantial part
			 of a prerecorded audio message,</quote>.</text>
			</subsection><subsection id="HDF204A70FCF14AD79CF672A43F54A6AC"><enum>(b)</enum><header>Treatment as
			 audio communication</header>
				<paragraph id="HC76D5EADCD3F4348B2BE6F8C2BBC93FF"><enum>(1)</enum><header>Communications
			 by candidates or authorized persons</header><text>Section 318(d)(1) of such Act
			 (2 U.S.C. 441d(d)(1)), as amended by section 3(a), is further amended by adding
			 at the end the following new subparagraph:</text>
					<quoted-block id="H0E2EFA4EBBEE4199AE5F9588F82102D2">
						<subparagraph id="HC0DF25E4A8FA484E82D594AD7FC2EFD3"><enum>(D)</enum><header>Prerecorded
				telephone calls</header><text>Any communication described in paragraph (1) or
				(2) of subsection (a) which is a telephone call which consists in substantial
				part of a prerecorded audio message shall meet the requirements applicable
				under subparagraph (A) to communications transmitted through radio, except that
				the statement required under such subparagraph shall be made at the beginning
				of the telephone
				call.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H0EB80BCD32184E85AB07A7CA1D5722E9"><enum>(2)</enum><header>Communications
			 by others</header>
					<subparagraph id="H9E625D328AA846D2BC6AB1A587FA6B28"><enum>(A)</enum><header>In
			 general</header><text>Section 318(d)(2) of such Act (2 U.S.C. 441d(d)(2)), as
			 amended by section 3(b), is further amended by adding at the end the following:
			 <quote>Any communication described in paragraph (3) of subsection (a) which is
			 a telephone call which consists in substantial part of a prerecorded audio
			 message shall meet the requirements applicable under this paragraph to
			 communications transmitted through radio, except that the statement required
			 shall be made at the beginning of the telephone call.</quote>.</text>
					</subparagraph><subparagraph id="H0DC849C9A6A143C3B22E40A7E4785F26"><enum>(B)</enum><header>Application of
			 special personal disclosure rules for express advocacy
			 communications</header><text display-inline="yes-display-inline">Section
			 318(d)(3) of such Act, as added by section 2(a) and as amended by section
			 3(b)(2), is further amended—</text>
						<clause id="HAC375239B1D44BCC89C8C6677ACD3EAE"><enum>(i)</enum><text>in
			 subparagraph (A), by striking <quote>electronic mail</quote> and inserting
			 <quote>electronic mail, or which is a telephone call which consists in
			 substantial part of a prerecorded audio message,</quote>; and</text>
						</clause><clause id="H641BD42CEF8C41658714E549CFEF07DE"><enum>(ii)</enum><text>in
			 subparagraph (B), by adding at the end the following new clause:</text>
							<quoted-block display-inline="no-display-inline" id="HD39803C6BFA84C8FA25ED377A710DCB7" style="OLC">
								<clause id="H3687107C4DF94A668C5B763E78315B88"><enum>(iv)</enum><header>Communications
				made through prerecorded telephone calls</header><text display-inline="yes-display-inline">Any communication to which this paragraph
				applies which is a telephone call which consists in substantial part of a
				prerecorded audio message shall meet the requirements applicable under this
				paragraph to communications transmitted through
				radio.</text>
								</clause><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph></subsection></section><section id="HC6D52D8FCC48467288187F633CFABEBB"><enum>5.</enum><header>No
			 Expansion of Persons Subject to Disclaimer Requirements on Internet
			 Communications</header><text display-inline="no-display-inline">Nothing in this
			 Act or the amendments made by this Act may be construed to require any person
			 who is not required under section 318 of the Federal Election Campaign Act of
			 1971 (as provided under section 110.11 of title 11 of the Code of Federal
			 Regulations) to include a disclaimer on communications made by the person
			 through the Internet to include any disclaimer on any such
			 communications.</text>
		</section><section id="HF56C6C798A5C4F8BB738936B8CE355A9"><enum>6.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">Except as provided in
			 section 2(c), the amendments made by this Act shall apply with respect to
			 communications made on or after the expiration of the 90-day period which
			 begins on the date of the enactment of this Act.</text>
