			 Congress regarding implementation of certain free trade agreements</header>
				<subsection id="HBDF45AA150194FB4BFC408DC5EB99CA4"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
					<paragraph id="H48AC770BB64A40EAB594577C7D90657D"><enum>(1)</enum><text>Ninety-five
			 percent of the world’s consumers live outside the United States.</text>
					</paragraph><paragraph id="H3A53B324B90342CF96DA735A14486789"><enum>(2)</enum><text>It is imperative
			 to the United States economy that United States businesses sell their goods and
			 services outside the United States.</text>
					</paragraph><paragraph id="HC96B8100173543938DDD5C8632B71316"><enum>(3)</enum><text>Congress and the
			 Administration are currently working to implement free trade agreements with
			 Colombia, Panama, and South Korea. The United States International Trade
			 Commission recently reported that implementation of the three free trade
			 agreements would increase United States exports by $13 billion, adding $10
			 billion to the Gross Domestic Product of the United States. Such an increase
			 would support 250,000 American jobs.</text>
					</paragraph></subsection><subsection id="H10FFE108A7F54C36B72999E3C1788811"><enum>(b)</enum><header>Sense of
			 Congress</header><text display-inline="yes-display-inline">It is the sense of
			 Congress that—</text>
					<paragraph id="H41054421828E4EC88540AD69E77FE048"><enum>(1)</enum><text>Congress should
			 continue to work with the Administration to expand trading markets;</text>
					</paragraph><paragraph id="H633E6F73840C43CA91BF189EDD7C4FF1"><enum>(2)</enum><text>the President
			 should pursue quick entry into force of the three trade agreements; and</text>
					</paragraph><paragraph id="HADCCF8C45026423AB71E24EAA7FD4214"><enum>(3)</enum><text>the future growth
			 of the United States economy requires this pro-growth strategy.</text>

			 Congress regarding China’s intellectual property rights violations</header>
				<subsection id="HE0443FDBF6F546A996E3577E639F2465"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
					<paragraph id="HCA4B865C1D05458E93F1495F5B3D5E6D"><enum>(1)</enum><text display-inline="yes-display-inline">United States copyright industries suffer
			 severe losses due to piracy in China.</text>
					</paragraph><paragraph id="H77FF52E37C24494A9E5938B04302895B"><enum>(2)</enum><text>Counterfeiting
			 remains pervasive in many retail and wholesale markets in China.</text>
					</paragraph><paragraph id="HEA2809F5EDF74F86AA1D008B3FC3B1AB"><enum>(3)</enum><text>China also
			 maintains market access barriers, which delay entry into China for legitimate
			 products and, thus, create commercial opportunities for infringing products.</text>
					</paragraph><paragraph id="H700BD1C84A9840EF80ADB3A1BB7C0651"><enum>(4)</enum><text>According to a
			 report by the United States International Trade Commission, Chinese piracy and
			 counterfeiting of United States software and a wide range of other intellectual
			 property cost American businesses an estimated $48 billion in 2009.</text>
					</paragraph><paragraph id="H8784A21C0DEA44C8829B9AFB50FC325D"><enum>(5)</enum><text>The report also
			 concluded that 2.1 million jobs could be created in the United States if China
			 complied with its current international obligations to protect and enforce
			 intellectual property rights.</text>
					</paragraph><paragraph id="H008EB32B9BF34BD092B3864174468C0F"><enum>(6)</enum><text>The most direct
			 jobs impact would come in high-tech and other innovative industries.</text>

			 Congress</header><text>It is the sense of Congress that China’s intellectual
			 property rights violations are a problem for our economy.</text>
				</subsection></section></title><title id="HE556E105FDFE45DEAA10758FD04B8EAA"><enum>II</enum><header>Tax
			 reform</header>
			<section id="HAFF1716C3EF5404EB53D32D54848208B"><enum>201.</enum><header>Sense of
			 Congress regarding tax reform</header>
				<subsection id="H62419C5319D6439A9EBCDA156B68FCF3"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
					<paragraph id="H13D06170207F4294908A672B75750CA1"><enum>(1)</enum><text display-inline="yes-display-inline">The Federal tax code is long, complex,
			 antiquated, and stifling growth in our economy.</text>
					</paragraph><paragraph id="H1ECBB44DF6D24445A62A218A52534F2E"><enum>(2)</enum><text>Comprehensive
			 reform of the Federal tax code is needed to get Americans working again and our
			 economy back on track.</text>
					</paragraph><paragraph id="HB72EE7FEE56E4E8491FBF1A7472F8CB1"><enum>(3)</enum><text>Independent
			 economists estimate that, when coupled with reduced Federal spending,
			 comprehensive tax reform could lead to the creation of 1 million jobs in the
			 first year alone.</text>
					</paragraph><paragraph id="HA093BF130BDE4257B21AD998D8A513B2"><enum>(4)</enum><text>The Federal tax
			 code has become so complex that even the Commissioner of the Internal Revenue
			 Service does not prepare his own taxes.</text>
					</paragraph><paragraph id="HBF4F6B7C874D4BB59E721DAA249B2F51"><enum>(5)</enum><text>The Internal
			 Revenue Service reports that the average person spends more than 21 hours to
			 fill out the tax forms.</text>
					</paragraph><paragraph id="H5B609F7AB0904BB18D82476399B781EF"><enum>(6)</enum><text>A
			 USA Today editorial lampooned the complexity by noting that the instruction
			 booklet for Apple’s Ipad is one page, while the instruction booklet for this
			 year’s IRS 1040 long form is 172 pages.</text>
					</paragraph><paragraph id="H4DB2037E382F4684937605EC2102FE4A"><enum>(7)</enum><text>The Federal tax
			 system needs to be reformed in order for the United States to once again be
			 competitive in the international market.</text>
					</paragraph><paragraph id="H14661217D9AF48948BC391D6378F6313"><enum>(8)</enum><text>Only Japan has a
			 higher corporate tax rate than America, which has a combined Federal-State rate
			 of 39.2 percent, and Japan has already indicated its intent to lower its rate.</text>
					</paragraph><paragraph id="H48458E1CE9EB434AA038B48C48A4D90F"><enum>(9)</enum><text>In 1960, 17
			 companies headquartered in the United States comprised 17 of the world’s
			 largest 20 companies—that’s 85 percent. By 2010, just 6 companies headquartered

			 Congress</header><text>It is the sense of Congress that reforming the Federal
			 tax code will benefit American taxpayers and our economy.</text>
				</subsection></section></title><title id="H4AF1F6625614484686E20FECA9259438"><enum>III</enum><header>Balanced budget
			 amendment</header>
			<section id="HA90007ACE6C04F04B98826FA355EE9A1"><enum>301.</enum><header>Sense of
			 Congress regarding a balanced budget amendment</header>
				<subsection id="H8C90F8F8F26341509E6717BBDF3B2F69"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress finds that a balanced budget
			 amendment would put the United States on a path to solvency and help bring
			 stability to the economy.</text>
				</subsection><subsection id="HDEAEF4301AEF471687C7111DBA7CCC65"><enum>(b)</enum><header>Sense of
			 Congress</header><text display-inline="yes-display-inline">It is the sense of
			 Congress that Congress needs to pass a balanced budget amendment to the United
			 States Constitution and send it to the States for ratification.</text>

			<section display-inline="no-display-inline" id="HDE358B1B1CA748519032AE543F06BF11" section-type="subsequent-section"><enum>401.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>American Energy Independence
			 and Price Reduction Act</short-title></quote>.</text>
			</section><section id="H9263B7F1C44446A0BE6AFC6D19702854"><enum>402.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="HD627931B11DA4E0C8027FBD0FEE3F68A"><enum>(1)</enum><header>Coastal
			 plain</header><text>The term <term>Coastal Plain</term> means that area
			 described in appendix I to part 37 of title 50, Code of Federal
			 Regulations.</text>
				</paragraph><paragraph id="HD81A80C72B6D438BBAE9883A29556CF6"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term>, except as otherwise provided, means the Secretary
			 of the Interior or the Secretary’s designee.</text>
				</paragraph></section><section id="H6A6BDCE3AB6943B5830B96FB406BD343"><enum>403.</enum><header>Leasing program
			 for lands within the Coastal Plain</header>
				<subsection id="H13DD5F7D00284BD6BAC32B22184EBF4B"><enum>(a)</enum><header>In
			 General</header><text>The Secretary shall take such actions as are
			 necessary—</text>
					<paragraph id="H02098955D1254E20A7E79BEDC7253DA0"><enum>(1)</enum><text>to establish and
			 implement, in accordance with this title and acting through the Director of the
			 Bureau of Land Management in consultation with the Director of the United
			 States Fish and Wildlife Service, a competitive oil and gas leasing program
			 that will result in an environmentally sound program for the exploration,
			 development, and production of the oil and gas resources of the Coastal Plain;
			 and</text>
					</paragraph><paragraph id="H79EA017E06F24309ACA90AB23C4E2200"><enum>(2)</enum><text>to administer the
			 provisions of this title through regulations, lease terms, conditions,
			 restrictions, prohibitions, stipulations, and other provisions that ensure the
			 oil and gas exploration, development, and production activities on the Coastal
			 Plain will result in no significant adverse effect on fish and wildlife, their
			 habitat, subsistence resources, and the environment, including, in furtherance
			 of this goal, by requiring the application of the best commercially available
			 technology for oil and gas exploration, development, and production to all
			 exploration, development, and production operations under this Act in a manner
			 that ensures the receipt of fair market value by the public for the mineral
			 resources to be leased.</text>
					</paragraph></subsection><subsection id="H1973C9FC5B6F42CAA69C383306DFAAE6"><enum>(b)</enum><header>Repeal</header>
					<paragraph id="H9400C27548314C67845CBB1869E7A833"><enum>(1)</enum><header>Repeal</header><text>Section
			 1003 of the Alaska National Interest Lands Conservation Act of 1980 (16 U.S.C.
			 3143) is repealed.</text>
					</paragraph><paragraph id="H48652B1E92554C37AEAB5F1E162E0C72"><enum>(2)</enum><header>Conforming
			 amendment</header><text>The table of contents in section 1 of such Act is
			 amended by striking the item relating to section 1003.</text>
					</paragraph></subsection><subsection id="H33ECDAC55764470A8D8986C2EB95CA78"><enum>(c)</enum><header>Compliance With
			 Requirements Under Certain Other Laws</header>
					<paragraph id="H0FB9D2AF9AC048F58C232BC08BC91C82"><enum>(1)</enum><header>Compatibility</header><text>For
			 purposes of the National Wildlife Refuge System Administration Act of 1966 (16
			 U.S.C. 668dd et seq.), the oil and gas leasing program and activities
			 authorized by this section in the Coastal Plain are deemed to be compatible
			 with the purposes for which the Arctic National Wildlife Refuge was
			 established, and no further findings or decisions are required to implement
			 this determination.</text>
					</paragraph><paragraph id="H0ED1BC322AA8483B86F20F15525AF8C0"><enum>(2)</enum><header>Adequacy of the
			 department of the interior’s legislative environmental impact
			 statement</header><text>The <quote>Final Legislative Environmental Impact
			 Statement</quote> (April 1987) on the Coastal Plain prepared pursuant to
			 section 1002 of the Alaska National Interest Lands Conservation Act of 1980 (16
			 U.S.C. 3142) and section 102(2)(C) of the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (42
			 U.S.C. 4332(2)(C)) is deemed to satisfy the requirements under the
			 <act-name parsable-cite="NEPA69">National Environmental Policy Act of
			 1969</act-name> that apply with respect to prelease activities, including
			 actions authorized to be taken by the Secretary to develop and promulgate the
			 regulations for the establishment of a leasing program authorized by this title
			 before the conduct of the first lease sale.</text>
					</paragraph><paragraph id="H8669C08BDCB74B268D29475DEDE1F6E6"><enum>(3)</enum><header>Compliance with
			 nepa for other actions</header><text>Before conducting the first lease sale
			 under this title, the Secretary shall prepare an environmental impact statement
			 under the <act-name parsable-cite="NEPA69">National Environmental Policy Act of
			 1969</act-name> with respect to the actions authorized by this title that are
			 not referred to in paragraph (2). Notwithstanding any other law, the Secretary
			 is not required to identify nonleasing alternative courses of action or to
			 analyze the environmental effects of such courses of action. The Secretary
			 shall only identify a preferred action for such leasing and a single leasing
			 alternative, and analyze the environmental effects and potential mitigation
			 measures for those two alternatives. The identification of the preferred action
			 and related analysis for the first lease sale under this title shall be
			 completed within 18 months after the date of enactment of this Act. The
			 Secretary shall only consider public comments that specifically address the
			 Secretary’s preferred action and that are filed within 20 days after
			 publication of an environmental analysis. Notwithstanding any other law,
			 compliance with this paragraph is deemed to satisfy all requirements for the
			 analysis and consideration of the environmental effects of proposed leasing
			 under this title.</text>
					</paragraph></subsection><subsection id="HFE2CDCE61DAF415C87DE36F137776B00"><enum>(d)</enum><header>Relationship to
			 State and Local Authority</header><text>Nothing in this title shall be
			 considered to expand or limit State and local regulatory authority.</text>
				</subsection><subsection id="HB7529456DC034FEFA7A7086230C6C1FD"><enum>(e)</enum><header>Special
			 Areas</header>
					<paragraph id="HBCF91F9E3FAA4707A01CC6CA0B1544CD"><enum>(1)</enum><header>In
			 general</header><text>The Secretary, after consultation with the State of
			 Alaska, the city of Kaktovik, and the North Slope Borough, may designate up to
			 a total of 45,000 acres of the Coastal Plain as a Special Area if the Secretary
			 determines that the Special Area is of such unique character and interest so as
			 to require special management and regulatory protection. The Secretary shall
			 designate as such a Special Area the Sadlerochit Spring area, comprising
			 approximately 4,000 acres.</text>
					</paragraph><paragraph id="H8482514116274E0BBC11BA95402F1C21"><enum>(2)</enum><header>Management</header><text>Each
			 such Special Area shall be managed so as to protect and preserve the area’s
			 unique and diverse character including its fish, wildlife, and subsistence
			 resource values.</text>
					</paragraph><paragraph id="H5C0B9403A0244BAEA31FC92E1806DD39"><enum>(3)</enum><header>Exclusion from
			 leasing or surface occupancy</header><text>The Secretary may exclude any
			 Special Area from leasing. If the Secretary leases a Special Area, or any part
			 thereof, for purposes of oil and gas exploration, development, production, and
			 related activities, there shall be no surface occupancy of the lands comprising
			 the Special Area.</text>
					</paragraph><paragraph id="HFAAD3F851A8048A9933C0226DD96E584"><enum>(4)</enum><header>Directional
			 drilling</header><text>Notwithstanding the other provisions of this subsection,
			 the Secretary may lease all or a portion of a Special Area under terms that
			 permit the use of horizontal drilling technology from sites on leases located
			 outside the Special Area.</text>
					</paragraph></subsection><subsection id="HEA6E095481D846CB9B22E6FAA12D45B7"><enum>(f)</enum><header>Limitation on
			 Closed Areas</header><text>The Secretary’s sole authority to close lands within
			 the Coastal Plain to oil and gas leasing and to exploration, development, and
			 production is that set forth in this title.</text>
				</subsection><subsection id="H5FAEFA79FB7042BAB5FDEDAF5F3972DC"><enum>(g)</enum><header>Regulations</header>
					<paragraph id="H7D044DEC11334550B01760A57E1A8377"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall prescribe such regulations as may be
			 necessary to carry out this title, including rules and regulations relating to
			 protection of the fish and wildlife, their habitat, subsistence resources, and
			 environment of the Coastal Plain, by no later than 15 months after the date of
			 enactment of this Act.</text>
					</paragraph><paragraph id="H0B996738506F4EA2ACA4669D8EC43A99"><enum>(2)</enum><header>Revision of
			 regulations</header><text>The Secretary shall periodically review and, if
			 appropriate, revise the rules and regulations issued under subsection (a) to
			 reflect any significant biological, environmental, or engineering data that
			 come to the Secretary’s attention.</text>
					</paragraph></subsection></section><section id="H88598CBCBDD74431AACC213D10E18C12"><enum>404.</enum><header>Lease
			 sales</header>
				<subsection id="HA66F2C366B0949489865E8C0A0A94744"><enum>(a)</enum><header>In
			 General</header><text>Lands may be leased pursuant to this title to any person
			 qualified to obtain a lease for deposits of oil and gas under the
			 <act-name parsable-cite="MLA">Mineral Leasing Act</act-name> (30 U.S.C. 181 et
			 seq.).</text>
				</subsection><subsection id="HF03F5441D78848ADA74E1788641B80DD"><enum>(b)</enum><header>Procedures</header><text>The
			 Secretary shall, by regulation, establish procedures for—</text>
					<paragraph id="H5F7269EA98B34E7E9337ECD22697268D"><enum>(1)</enum><text>receipt and
			 consideration of sealed nominations for any area in the Coastal Plain for
			 inclusion in, or exclusion (as provided in subsection (c)) from, a lease
			 sale;</text>
					</paragraph><paragraph id="H5737371A49BA44EBA6762322DCCF9E69"><enum>(2)</enum><text>the holding of
			 lease sales after such nomination process; and</text>
					</paragraph><paragraph id="HD50BC859E967464093885B57871335A3"><enum>(3)</enum><text>public notice of
			 and comment on designation of areas to be included in, or excluded from, a
			 lease sale.</text>
					</paragraph></subsection><subsection id="HE070D70BB62548FAB179A12C0BFF2823"><enum>(c)</enum><header>Lease Sale
			 Bids</header><text>Bidding for leases under this title shall be by sealed
			 competitive cash bonus bids.</text>
				</subsection><subsection id="H0D8ABBB0492E4B89A21E7DB8F6D3219E"><enum>(d)</enum><header>Acreage Minimum
			 in First Sale</header><text>In the first lease sale under this title, the
			 Secretary shall offer for lease those tracts the Secretary considers to have
			 the greatest potential for the discovery of hydrocarbons, taking into
			 consideration nominations received pursuant to subsection (b)(1), but in no
			 case less than 200,000 acres.</text>
				</subsection><subsection id="HAF1F2F7596AB46EDB7C693E2C5021443"><enum>(e)</enum><header>Timing of Lease
			 Sales</header><text>The Secretary shall—</text>
					<paragraph id="HE1084C4FCF7F40858CE0777FA0FCC976"><enum>(1)</enum><text>conduct the first
			 lease sale under this title within 22 months after the date of the enactment of
			 this Act;</text>
					</paragraph><paragraph id="HBC27273239AB4689B7FBC8E8FD5203F3"><enum>(2)</enum><text>evaluate the bids
			 in such sale and issue leases resulting from such sale, within 90 days after
			 the date of the completion of such sale; and</text>
					</paragraph><paragraph id="H7953145815C341E2A2068AE342887D1C"><enum>(3)</enum><text>conduct additional
			 sales so long as sufficient interest in development exists to warrant, in the
			 Secretary’s judgment, the conduct of such sales.</text>
					</paragraph></subsection></section><section id="HABFC1F7C92484391997081094C0F076E"><enum>405.</enum><header>Grant of leases
			 by the Secretary</header>
				<subsection id="H510BBF753C9D4741848D47990329D4F0"><enum>(a)</enum><header>In
			 General</header><text>The Secretary may grant to the highest responsible
			 qualified bidder in a lease sale conducted pursuant to section 404 any lands to
			 be leased on the Coastal Plain upon payment by the lessee of such bonus as may
			 be accepted by the Secretary.</text>
				</subsection><subsection id="H658BF7259A1743EAA250436D462DA2DE"><enum>(b)</enum><header>Subsequent
			 Transfers</header><text>No lease issued under this title may be sold,
			 exchanged, assigned, sublet, or otherwise transferred except with the approval
			 of the Secretary. Prior to any such approval the Secretary shall consult with,
			 and give due consideration to the views of, the Attorney General.</text>
				</subsection></section><section id="HD386A08946C94EEC9B6529B03702BBA9"><enum>406.</enum><header>Lease terms and
			 conditions</header>
				<subsection id="HAEE4764FE00E4B54B8BBFC96C333FF07"><enum>(a)</enum><header>In
			 General</header><text>An oil or gas lease issued pursuant to this title
			 shall—</text>
					<paragraph id="HD4E1B4D436FD44849CF83F6D8D8C8F02"><enum>(1)</enum><text>provide for the
			 payment of a royalty of not less than 12<fraction>1/2</fraction> percent in
			 amount or value of the production removed or sold from the lease, as determined
			 by the Secretary under the regulations applicable to other Federal oil and gas
			 leases;</text>
					</paragraph><paragraph id="H9696AB31BE7A4A57A437B70E445CF92D"><enum>(2)</enum><text>provide that the
			 Secretary may close, on a seasonal basis, portions of the Coastal Plain to
			 exploratory drilling activities as necessary to protect caribou calving areas
			 and other species of fish and wildlife;</text>
					</paragraph><paragraph id="H862C4C655E284D0B86D9E9FA6C188A1A"><enum>(3)</enum><text>require that the
			 lessee of lands within the Coastal Plain shall be fully responsible and liable
			 for the reclamation of lands within the Coastal Plain and any other Federal
			 lands that are adversely affected in connection with exploration, development,
			 production, or transportation activities conducted under the lease and within
			 the Coastal Plain by the lessee or by any of the subcontractors or agents of
			 the lessee;</text>
					</paragraph><paragraph id="HD78E764D6F774E14BEC62B8A5B72E4EE"><enum>(4)</enum><text>provide that the
			 lessee may not delegate or convey, by contract or otherwise, the reclamation
			 responsibility and liability to another person without the express written
			 approval of the Secretary;</text>
					</paragraph><paragraph id="HD1185B4AA18E4F1991AD0E3F18EE0244"><enum>(5)</enum><text>provide that the
			 standard of reclamation for lands required to be reclaimed under this title
			 shall be, as nearly as practicable, a condition capable of supporting the uses
			 which the lands were capable of supporting prior to any exploration,
			 development, or production activities, or upon application by the lessee, to a
			 higher or better use as approved by the Secretary;</text>
					</paragraph><paragraph id="H6EC027488A484F38B63341A2F2E023FB"><enum>(6)</enum><text>contain terms and
			 conditions relating to protection of fish and wildlife, their habitat,
			 subsistence resources, and the environment as required pursuant to section
			 403(a)(2);</text>
					</paragraph><paragraph id="H075342DF708C453E85A49036A0BC2D8B"><enum>(7)</enum><text>provide that the
			 lessee, its agents, and its contractors use best efforts to provide a fair
			 share, as determined by the level of obligation previously agreed to in the
			 1974 agreement implementing section 29 of the Federal Agreement and Grant of
			 Right of Way for the Operation of the Trans-Alaska Pipeline, of employment and
			 contracting for Alaska Natives and Alaska Native Corporations from throughout
			 the State;</text>
					</paragraph><paragraph id="HEAE954E198CF4AF8AC5E465B1FC962AB"><enum>(8)</enum><text>prohibit the
			 export of oil produced under the lease; and</text>
					</paragraph><paragraph id="H8BC8E72103EB4E8C80925AB13F7800A5"><enum>(9)</enum><text>contain such other
			 provisions as the Secretary determines necessary to ensure compliance with the
			 provisions of this title and the regulations issued under this title.</text>
					</paragraph></subsection><subsection id="H4A8EFC55DAC0464C9FD52343F8B8934E"><enum>(b)</enum><header>Project Labor
			 Agreements</header><text>The Secretary, as a term and condition of each lease
			 under this title and in recognizing the Government’s proprietary interest in
			 labor stability and in the ability of construction labor and management to meet
			 the particular needs and conditions of projects to be developed under the
			 leases issued pursuant to this title and the special concerns of the parties to
			 such leases, shall require that the lessee and its agents and contractors
			 negotiate to obtain a project labor agreement for the employment of laborers
			 and mechanics on production, maintenance, and construction under the
			 lease.</text>
				</subsection></section><section id="H45F196A77235450EA81E26602C2A0AE9"><enum>407.</enum><header>Coastal Plain
			 environmental protection</header>
				<subsection id="HF4822A2A79C8443A931366C02B3E7844"><enum>(a)</enum><header>No Significant
			 Adverse Effect Standard To Govern Authorized Coastal Plain
			 Activities</header><text>The Secretary shall, consistent with the requirements
			 of section 403, administer the provisions of this title through regulations,
			 lease terms, conditions, restrictions, prohibitions, stipulations, and other
			 provisions that—</text>
					<paragraph id="H2A56BDCE98EB4A708542AFD05E9BB88C"><enum>(1)</enum><text>ensure the oil and
			 gas exploration, development, and production activities on the Coastal Plain
			 will result in no significant adverse effect on fish and wildlife, their
			 habitat, and the environment;</text>
					</paragraph><paragraph id="H98C52DC18C264F65B16B3F6B8C59E313"><enum>(2)</enum><text>require the
			 application of the best commercially available technology for oil and gas
			 exploration, development, and production on all new exploration, development,
			 and production operations; and</text>
					</paragraph><paragraph id="H8D18A29E1F8C46ACBDD543710C1D01E5"><enum>(3)</enum><text>ensure that the
			 maximum amount of surface acreage covered by production and support facilities,
			 including airstrips and any areas covered by gravel berms or piers for support
			 of pipelines, does not exceed 2,000 acres on the Coastal Plain.</text>
					</paragraph></subsection><subsection id="H2BCE125CEE1348359B57ED9384B9B3FF"><enum>(b)</enum><header>Site-Specific
			 Assessment and Mitigation</header><text>The Secretary shall also require, with
			 respect to any proposed drilling and related activities, that—</text>
					<paragraph id="H4D2812BF933F470589515996073CDDC9"><enum>(1)</enum><text>a
			 site-specific analysis be made of the probable effects, if any, that the
			 drilling or related activities will have on fish and wildlife, their habitat,
			 subsistence resources, and the environment;</text>
					</paragraph><paragraph id="HE446E424BE114AFE8674C326EDF599CB"><enum>(2)</enum><text>a
			 plan be implemented to avoid, minimize, and mitigate (in that order and to the
			 extent practicable) any significant adverse effect identified under paragraph
			 (1); and</text>
					</paragraph><paragraph id="HD5B4C360D9D142BAA1C6F7055C442B02"><enum>(3)</enum><text>the development of
			 the plan shall occur after consultation with the agency or agencies having
			 jurisdiction over matters mitigated by the plan.</text>
					</paragraph></subsection><subsection id="H585A9221284F4FBD9D20CF534BA50335"><enum>(c)</enum><header>Regulations To
			 Protect Coastal Plain Fish and Wildlife Resources, Subsistence Users, and the
			 Environment</header><text>Before implementing the leasing program authorized by
			 this title, the Secretary shall prepare and promulgate regulations, lease
			 terms, conditions, restrictions, prohibitions, stipulations, and other measures
			 designed to ensure that the activities undertaken on the Coastal Plain under
			 this title are conducted in a manner consistent with the purposes and
			 environmental requirements of this title.</text>
				</subsection><subsection id="HB07E4E5348AB4A3F966F1D17706F58F5"><enum>(d)</enum><header>Compliance With
			 Federal and State Environmental Laws and Other Requirements</header><text>The
			 proposed regulations, lease terms, conditions, restrictions, prohibitions, and
			 stipulations for the leasing program under this title shall require compliance
			 with all applicable provisions of Federal and State environmental law, and
			 shall also require the following:</text>
					<paragraph id="H4AE5D514A2E648B29745904BD467A38C"><enum>(1)</enum><text>Standards at least
			 as effective as the safety and environmental mitigation measures set forth in
			 items 1 through 29 at pages 167 through 169 of the <quote>Final Legislative
			 Environmental Impact Statement</quote> (April 1987) on the Coastal
			 Plain.</text>
					</paragraph><paragraph id="H73B3C70894304E71BA4D7E5334A38116"><enum>(2)</enum><text>Seasonal
			 limitations on exploration, development, and related activities, where
			 necessary, to avoid significant adverse effects during periods of concentrated
			 fish and wildlife breeding, denning, nesting, spawning, and migration.</text>
					</paragraph><paragraph id="HF5E1B3581C44437682127A6BE6367829"><enum>(3)</enum><text>That exploration
			 activities, except for surface geological studies, be limited to the period
			 between approximately November 1 and May 1 each year and that exploration
			 activities shall be supported, if necessary, by ice roads, winter trails with
			 adequate snow cover, ice pads, ice airstrips, and air transport methods, except
			 that such exploration activities may occur at other times if the Secretary
			 finds that such exploration will have no significant adverse effect on the fish
			 and wildlife, their habitat, and the environment of the Coastal Plain.</text>
					</paragraph><paragraph id="HA4C568D860434856A1442A0E552E5F67"><enum>(4)</enum><text>Design safety and
			 construction standards for all pipelines and any access and service roads,
			 that—</text>
						<subparagraph id="HEF77949A763D4A8398F4D880224ABD35"><enum>(A)</enum><text>minimize, to the
			 maximum extent possible, adverse effects upon the passage of migratory species
			 such as caribou; and</text>
						</subparagraph><subparagraph id="HCF48145FC210490B8EE2D168CBE8AA6A"><enum>(B)</enum><text>minimize adverse
			 effects upon the flow of surface water by requiring the use of culverts,
			 bridges, and other structural devices.</text>
						</subparagraph></paragraph><paragraph id="H01C81ED7D9EC47788E21CD50BDC23E8D"><enum>(5)</enum><text>Prohibitions on
			 general public access and use on all pipeline access and service roads.</text>
					</paragraph><paragraph id="HAC00297B5EC644EEBFDB1979449E97EA"><enum>(6)</enum><text>Stringent
			 reclamation and rehabilitation requirements, consistent with the standards set
			 forth in this title, requiring the removal from the Coastal Plain of all oil
			 and gas development and production facilities, structures, and equipment upon
			 completion of oil and gas production operations, except that the Secretary may
			 exempt from the requirements of this paragraph those facilities, structures, or
			 equipment that the Secretary determines would assist in the management of the
			 Arctic National Wildlife Refuge and that are donated to the United States for
			 that purpose.</text>
					</paragraph><paragraph id="H3E7856D7ADD445D6B3676F1659BD547F"><enum>(7)</enum><text>Appropriate
			 prohibitions or restrictions on access by all modes of transportation.</text>
					</paragraph><paragraph id="HF70D78D941CB4E0AB8732C9763128D29"><enum>(8)</enum><text>Appropriate
			 prohibitions or restrictions on sand and gravel extraction.</text>
					</paragraph><paragraph id="H14D17FF207404E1EB59B822BB0108A4A"><enum>(9)</enum><text>Consolidation of
			 facility siting.</text>
					</paragraph><paragraph id="H5723A07EF7634FCF8C854E1DECF2C359"><enum>(10)</enum><text>Appropriate
			 prohibitions or restrictions on use of explosives.</text>
					</paragraph><paragraph id="H2EE3CDACBE35486FBFFFA494D3FAA330"><enum>(11)</enum><text>Avoidance, to the
			 extent practicable, of springs, streams, and river system; the protection of
			 natural surface drainage patterns, wetlands, and riparian habitats; and the
			 regulation of methods or techniques for developing or transporting adequate
			 supplies of water for exploratory drilling.</text>
					</paragraph><paragraph id="H762DD21AAF1F4C6D8C8740A8B8CB8EAB"><enum>(12)</enum><text>Avoidance or
			 minimization of air traffic-related disturbance to fish and wildlife.</text>
					</paragraph><paragraph id="HF6C72BD2799843CCA4251A38675B63B4"><enum>(13)</enum><text>Treatment and
			 disposal of hazardous and toxic wastes, solid wastes, reserve pit fluids,
			 drilling muds and cuttings, and domestic wastewater, including an annual waste
			 management report, a hazardous materials tracking system, and a prohibition on
			 chlorinated solvents, in accordance with applicable Federal and State
			 environmental law.</text>
					</paragraph><paragraph id="HF49476DC4AF347DB8BCD13E9A4CDE781"><enum>(14)</enum><text>Fuel storage and
			 oil spill contingency planning.</text>
					</paragraph><paragraph id="HF7D5FAEF19904BF580BDA3C3D72D9D83"><enum>(15)</enum><text>Research,
			 monitoring, and reporting requirements.</text>
					</paragraph><paragraph id="HCF52367C9FC345698D6EE78B8BCB4662"><enum>(16)</enum><text>Field crew
			 environmental briefings.</text>
					</paragraph><paragraph id="HCEFC857E74D24F4CBEF6DF51E43BCB22"><enum>(17)</enum><text>Avoidance of
			 significant adverse effects upon subsistence hunting, fishing, and trapping by
			 subsistence users.</text>
					</paragraph><paragraph id="HEFF73CC7CC68405FAE2F9F83346B3417"><enum>(18)</enum><text>Compliance with
			 applicable air and water quality standards.</text>
					</paragraph><paragraph id="H857B26E9FF4841FDAE45435C10AFD4E8"><enum>(19)</enum><text>Appropriate
			 seasonal and safety zone designations around well sites, within which
			 subsistence hunting and trapping shall be limited.</text>
					</paragraph><paragraph id="H09E7FAE5B536438FBEC440136C84503A"><enum>(20)</enum><text>Reasonable
			 stipulations for protection of cultural and archeological resources.</text>
					</paragraph><paragraph id="HF961A226169645EDB241D660F28F7B32"><enum>(21)</enum><text>All other
			 protective environmental stipulations, restrictions, terms, and conditions
			 deemed necessary by the Secretary.</text>
					</paragraph></subsection><subsection id="H25D64BADCE2A47BBB9218DE7F36B79E8"><enum>(e)</enum><header>Considerations</header><text>In
			 preparing and promulgating regulations, lease terms, conditions, restrictions,
			 prohibitions, and stipulations under this section, the Secretary shall consider
			 the following:</text>
					<paragraph id="H5E7E0B77C97248AB8BDECAD3F48B6513"><enum>(1)</enum><text>The stipulations
			 and conditions that govern the National Petroleum Reserve-Alaska leasing
			 program, as set forth in the 1999 Northeast National Petroleum Reserve-Alaska
			 Final Integrated Activity Plan/Environmental Impact Statement.</text>
					</paragraph><paragraph id="H3972A624F4FA48439B1330E61B8B3963"><enum>(2)</enum><text>The environmental
			 protection standards that governed the initial Coastal Plain seismic
			 exploration program under parts 37.31 to 37.33 of title 50, Code of Federal
			 Regulations.</text>
					</paragraph><paragraph id="H995366CE8BBF4ECDB93A07827430912C"><enum>(3)</enum><text>The land use
			 stipulations for exploratory drilling on the KIC–ASRC private lands that are
			 set forth in appendix 2 of the August 9, 1983, agreement between Arctic Slope
			 Regional Corporation and the United States.</text>
					</paragraph></subsection><subsection id="HDFB17FDD4A48486289A111F013B031E4"><enum>(f)</enum><header>Facility
			 Consolidation Planning</header>
					<paragraph id="H0503564584B542B0997CC0FDAFBB160A"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall, after providing for public notice
			 and comment, prepare and update periodically a plan to govern, guide, and
			 direct the siting and construction of facilities for the exploration,
			 development, production, and transportation of Coastal Plain oil and gas
			 resources.</text>
					</paragraph><paragraph id="H76BFE95C05654A6E9F38BDAF50995D0F"><enum>(2)</enum><header>Objectives</header><text>The
			 plan shall have the following objectives:</text>
						<subparagraph id="H984CDC2799984756B5D53BDE7BAE7BE7"><enum>(A)</enum><text>Avoiding
			 unnecessary duplication of facilities and activities.</text>
						</subparagraph><subparagraph id="H8299DBCED02546448AF4854867BE257C"><enum>(B)</enum><text>Encouraging
			 consolidation of common facilities and activities.</text>
						</subparagraph><subparagraph id="H6E1F259F00054E598078A454378861AB"><enum>(C)</enum><text>Locating or
			 confining facilities and activities to areas that will minimize impact on fish
			 and wildlife, their habitat, and the environment.</text>
						</subparagraph><subparagraph id="H43EFC44EAB834F2A99AF6E0DCAA1CA5C"><enum>(D)</enum><text>Utilizing existing
			 facilities wherever practicable.</text>
						</subparagraph><subparagraph id="H7D7D6DF8DF2645CBBE49A26071388830"><enum>(E)</enum><text>Enhancing
			 compatibility between wildlife values and development activities.</text>
						</subparagraph></paragraph></subsection><subsection id="HA7933C32968340C180E78F38BF8DE5A8"><enum>(g)</enum><header>Access to Public
			 Lands</header><text>The Secretary shall—</text>
					<paragraph id="HCA0326B6E4D747E9840738BE481A752D"><enum>(1)</enum><text>manage public
			 lands in the Coastal Plain subject to subsections (a) and (b) of section 811 of
			 the Alaska National Interest Lands Conservation Act (16 U.S.C. 3121);
			 and</text>
					</paragraph><paragraph id="H16474BC0BA4946E0BA2332CF6F5BC1AC"><enum>(2)</enum><text>ensure that local
			 residents shall have reasonable access to public lands in the Coastal Plain for
			 traditional uses.</text>
					</paragraph></subsection></section><section id="H8996C2288C784187879EED042FDD28C4"><enum>408.</enum><header>Expedited
			 judicial review</header>
				<subsection id="HB785D4E7B5A04547BA9283B87541260A"><enum>(a)</enum><header>Filing of
			 Complaint</header>
					<paragraph id="H6C929F066D0245A4B57C84D90598864F"><enum>(1)</enum><header>Deadline</header><text>Subject
			 to paragraph (2), any complaint seeking judicial review of any provision of
			 this title or any action of the Secretary under this title shall be
			 filed—</text>
						<subparagraph id="H90D7A4F4E23E468795C57DB4C9A5B53C"><enum>(A)</enum><text>except as provided
			 in subparagraph (B), within the 90-day period beginning on the date of the
			 action being challenged; or</text>
						</subparagraph><subparagraph id="H9A0857E759F24F9090398857728A6BED"><enum>(B)</enum><text>in the case of a
			 complaint based solely on grounds arising after such period, within 90 days
			 after the complainant knew or reasonably should have known of the grounds for
			 the complaint.</text>
						</subparagraph></paragraph><paragraph id="H31B098957E794D72A1DA38DDA4CEFE90"><enum>(2)</enum><header>Venue</header><text>Any
			 complaint seeking judicial review of any provision of this title or any action
			 of the Secretary under this title may be filed only in the United States Court
			 of Appeals for the District of Columbia.</text>
					</paragraph><paragraph id="HFC8C38C645F344B0BB37E4F1E42B517B"><enum>(3)</enum><header>Limitation on
			 scope of certain review</header><text>Judicial review of a Secretarial decision
			 to conduct a lease sale under this title, including the environmental analysis
			 thereof, shall be limited to whether the Secretary has complied with the terms
			 of this title and shall be based upon the administrative record of that
			 decision. The Secretary’s identification of a preferred course of action to
			 enable leasing to proceed and the Secretary’s analysis of environmental effects
			 under this title shall be presumed to be correct unless shown otherwise by
			 clear and convincing evidence to the contrary.</text>
					</paragraph></subsection><subsection id="H61DC158587CF495789164F6DBABF3CE5"><enum>(b)</enum><header>Limitation on
			 Other Review</header><text>Actions of the Secretary with respect to which
			 review could have been obtained under this section shall not be subject to
			 judicial review in any civil or criminal proceeding for enforcement.</text>
				</subsection></section><section id="HDD1B2D7F01C740AA854E92A9B4B9DAFE"><enum>409.</enum><header>Federal and
			 State distribution of revenues</header>
				<subsection id="HA307B759B2644D028F59113979B88216"><enum>(a)</enum><header>In
			 General</header><text>Notwithstanding any other provision of law, of the amount
			 of adjusted bonus, rental, and royalty revenues from Federal oil and gas
			 leasing and operations authorized under this title—</text>
					<paragraph id="H1D34506CA9F447E5B0A695F88B988F22"><enum>(1)</enum><text>50 percent shall
			 be paid to the State of Alaska; and</text>
					</paragraph><paragraph id="H03930021C02E406CA5CCDA6E681B50EF"><enum>(2)</enum><text>except as provided
			 in section 412(d), the balance shall be transferred to the ANWR Alternative
			 Energy Trust Fund established by this title.</text>
					</paragraph></subsection><subsection id="HF9A02034DB134B14BF0C31FE4184A2BD"><enum>(b)</enum><header>Payments to
			 Alaska</header><text>Payments to the State of Alaska under this section shall
			 be made semiannually.</text>
				</subsection></section><section id="H7BAAA60302C94BE7AA444840F862985B"><enum>410.</enum><header>Rights-of-way
			 across the Coastal Plain</header>
				<subsection id="HA3E7389DF3E0438DA56EC095EBA0C9A9"><enum>(a)</enum><header>In
			 General</header><text>The Secretary shall issue rights-of-way and easements
			 across the Coastal Plain for the transportation of oil and gas—</text>
					<paragraph id="H822FEE5CC2674CD0BA0D33AB23CC4421"><enum>(1)</enum><text>except as provided
			 in paragraph (2), under section 28 of the <act-name parsable-cite="MLA">Mineral
			 Leasing Act</act-name> (30 U.S.C. 185), without regard to title XI of the
			 Alaska National Interest Lands Conservation Act (30 U.S.C. 3161 et seq.);
			 and</text>
					</paragraph><paragraph id="H59AD19D9973C4AB0815483AC2698C8F1"><enum>(2)</enum><text>under title XI of
			 the Alaska National Interest Lands Conservation Act (30 U.S.C. 3161 et seq.),
			 for access authorized by sections 1110 and 1111 of that Act (16 U.S.C. 3170 and
			 3171).</text>
					</paragraph></subsection><subsection id="H07F73397EE424D8BAC3BFCE1C8D23CE1"><enum>(b)</enum><header>Terms and
			 Conditions</header><text>The Secretary shall include in any right-of-way or
			 easement issued under subsection (a) such terms and conditions as may be
			 necessary to ensure that transportation of oil and gas does not result in a
			 significant adverse effect on the fish and wildlife, subsistence resources,
			 their habitat, and the environment of the Coastal Plain, including requirements
			 that facilities be sited or designed so as to avoid unnecessary duplication of
			 roads and pipelines.</text>
				</subsection><subsection id="H05F58E2FB2C945BEAC5E1A657D5F3BD7"><enum>(c)</enum><header>Regulations</header><text>The
			 Secretary shall include in regulations under section 403(g) provisions granting
			 rights-of-way and easements described in subsection (a) of this section.</text>
				</subsection></section><section id="H981EBF566B744B7989F3B32C562CEA2B"><enum>411.</enum><header>Conveyance</header><text display-inline="no-display-inline">In order to maximize Federal revenues by
			 removing clouds on title to lands and clarifying land ownership patterns within
			 the Coastal Plain, the Secretary, notwithstanding the provisions of section
			 1302(h)(2) of the Alaska National Interest Lands Conservation Act (16 U.S.C.
			 3192(h)(2)), shall convey—</text>
				<paragraph id="H45D2F7C9EF6B4DA5AF2C1860EDCC3E24"><enum>(1)</enum><text>to the Kaktovik
			 Inupiat Corporation the surface estate of the lands described in paragraph 1 of
			 Public Land Order 6959, to the extent necessary to fulfill the Corporation’s
			 entitlement under sections 12 and 14 of the Alaska Native Claims Settlement Act
			 (43 U.S.C. 1611 and 1613) in accordance with the terms and conditions of the
			 Agreement between the Department of the Interior, the United States Fish and
			 Wildlife Service, the Bureau of Land Management, and the Kaktovik Inupiat
			 Corporation effective January 22, 1993; and</text>
				</paragraph><paragraph id="H56B6C707494F4A01A11416F63E4D53CC"><enum>(2)</enum><text>to the Arctic
			 Slope Regional Corporation the remaining subsurface estate to which it is
			 entitled pursuant to the August 9, 1983, agreement between the Arctic Slope
			 Regional Corporation and the United States of America.</text>
				</paragraph></section><section id="H2F36696DE9314FA89907764555DF8A71"><enum>412.</enum><header>Local
			 government impact aid and community service assistance</header>
				<subsection id="HFD9D315DD52A4E1A89BCFD24AD0F1941"><enum>(a)</enum><header>Financial
			 Assistance Authorized</header>
					<paragraph id="H7CF98540D7184E91B3B4F9197A504E6F"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may use amounts available from the Coastal
			 Plain Local Government Impact Aid Assistance Fund established by subsection (d)
			 to provide timely financial assistance to entities that are eligible under
			 paragraph (2) and that are directly impacted by the exploration for or
			 production of oil and gas on the Coastal Plain under this title.</text>
					</paragraph><paragraph id="H1ECE85EDAFD14D3C9F70903A1EA7A2C2"><enum>(2)</enum><header>Eligible
			 entities</header><text>The North Slope Borough, the City of Kaktovik, and any
			 other borough, municipal subdivision, village, or other community in the State
			 of Alaska that is directly impacted by exploration for, or the production of,
			 oil or gas on the Coastal Plain under this title, as determined by the
			 Secretary, shall be eligible for financial assistance under this
			 section.</text>
					</paragraph></subsection><subsection id="H66355989974A4C52BFD5B2879B866DF5"><enum>(b)</enum><header>Use of
			 Assistance</header><text>Financial assistance under this section may be used
			 only for—</text>
					<paragraph id="HFEBB5D6C6ED84556A2E4AD9799BBF909"><enum>(1)</enum><text>planning for
			 mitigation of the potential effects of oil and gas exploration and development
			 on environmental, social, cultural, recreational, and subsistence
			 values;</text>
					</paragraph><paragraph id="H6416C052FE4E43FAA9DF766A6DF83425"><enum>(2)</enum><text>implementing
			 mitigation plans and maintaining mitigation projects;</text>
					</paragraph><paragraph id="HB8BC3ED8753E43A399DC20E3DB377B5C"><enum>(3)</enum><text>developing,
			 carrying out, and maintaining projects and programs that provide new or
			 expanded public facilities and services to address needs and problems
			 associated with such effects, including fire-fighting, police, water, waste
			 treatment, medivac, and medical services; and</text>
					</paragraph><paragraph id="HC23DA411309249C682FD0FDF46A43054"><enum>(4)</enum><text>establishment of a
			 coordination office, by the North Slope Borough, in the City of Kaktovik, which
			 shall—</text>
						<subparagraph id="HC8E6A81BF0AA44808905E478BFBD9274"><enum>(A)</enum><text>coordinate with
			 and advise developers on local conditions, impact, and history of the areas
			 utilized for development; and</text>
						</subparagraph><subparagraph id="H40F964ADEE2F46CF9C68995565EC6273"><enum>(B)</enum><text>provide to the
			 Committee on Resources of the House of Representatives and the Committee on
			 Energy and Natural Resources of the Senate an annual report on the status of
			 coordination between developers and the communities affected by
			 development.</text>
						</subparagraph></paragraph></subsection><subsection id="H5F029A9E910E4CD99999FAB5A685D0BB"><enum>(c)</enum><header>Application</header>
					<paragraph id="HA7B38E2BAA9A4F4181213DB19CD2A65F"><enum>(1)</enum><header>In
			 general</header><text>Any community that is eligible for assistance under this
			 section may submit an application for such assistance to the Secretary, in such
			 form and under such procedures as the Secretary may prescribe by
			 regulation.</text>
					</paragraph><paragraph id="H049CE8CC6CFC4E289070D9CD90891DB2"><enum>(2)</enum><header>North slope
			 borough communities</header><text>A community located in the North Slope
			 Borough may apply for assistance under this section either directly to the
			 Secretary or through the North Slope Borough.</text>
					</paragraph><paragraph id="H546C1059631D48FF81CAF30DFBB70350"><enum>(3)</enum><header>Application
			 assistance</header><text>The Secretary shall work closely with and assist the
			 North Slope Borough and other communities eligible for assistance under this
			 section in developing and submitting applications for assistance under this
			 section.</text>
					</paragraph></subsection><subsection id="HFB1CE37E8AA34235A1845A9D24E4C6C1"><enum>(d)</enum><header>Establishment of
			 Fund</header>
					<paragraph id="HA5F2B7AC71EC42C48B7BD56C61D44769"><enum>(1)</enum><header>In
			 general</header><text>There is established in the Treasury the Coastal Plain
			 Local Government Impact Aid Assistance Fund.</text>
					</paragraph><paragraph id="H6F03F62BFF974FED88183DCA244C15B2"><enum>(2)</enum><header>Use</header><text>Amounts
			 in the fund may be used only for providing financial assistance under this
			 section.</text>
					</paragraph><paragraph id="H1A21ADE7B56D4B3DB346653A5FA72C51"><enum>(3)</enum><header>Deposits</header><text>Subject
			 to paragraph (4), there shall be deposited into the fund amounts received by
			 the United States as revenues derived from rents, bonuses, and royalties from
			 Federal leases and lease sales authorized under this title.</text>
					</paragraph><paragraph id="H33F080D26E6F4CD589DF717F2F6E02F2"><enum>(4)</enum><header>Limitation on
			 deposits</header><text>The total amount in the fund may not exceed
			 $11,000,000.</text>
					</paragraph><paragraph id="H02E8F371045E43E38D50D2730677C3C8"><enum>(5)</enum><header>Investment of
			 balances</header><text>The Secretary of the Treasury shall invest amounts in
			 the fund in interest bearing government securities.</text>
					</paragraph></subsection><subsection id="H95F35F46C7504904ADE6040E03466FB8"><enum>(e)</enum><header>Authorization of
			 Appropriations</header><text>To provide financial assistance under this section
			 there is authorized to be appropriated to the Secretary from the Coastal Plain
			 Local Government Impact Aid Assistance Fund $5,000,000 for each fiscal
			 year.</text>
				</subsection></section><section id="HE71290141F8A47E9BFB21BB97FC18252"><enum>413.</enum><header>ANWR
			 Alternative Energy Trust Fund</header>
				<subsection id="H665960F5A6FE4F7681E3CF042E5BD42C"><enum>(a)</enum><header>Establishment of
			 Trust Fund</header><text>There is established in the Treasury of the United
			 States a trust fund to be known as the <quote>ANWR Alternative Energy Trust
			 Fund</quote>, consisting of such amounts as may be transferred to the ANWR
			 Alternative Energy Trust Fund as provided in section 409.</text>
				</subsection><subsection id="H73015BA67106421593E4052579845080"><enum>(b)</enum><header>Expenditures
			 From ANWR Alternative Energy Trust Fund</header>
					<paragraph id="H8843603B17F04970A6DE861E914D0344"><enum>(1)</enum><header>In
			 general</header><text>Amounts in the ANWR Alternative Energy Trust Fund shall
			 be available without further appropriation to carry out specified provisions of
			 the Energy Policy Act of 2005 (Public Law 109–58; in this section referred to

					</paragraph></subsection></section></title><title id="HF4E2889B31374A0BAED5000CC9FD66BA"><enum>V</enum><header>Reduction in
			 Federal workforce</header>
			<section id="HE7F2BC78DCB54CEF8AA9FFAB2C3F62AE"><enum>501.</enum><header>Reduction in
			 Federal workforce</header>
				<subsection id="H8B97615FA5B94552B044DB83AE62C206"><enum>(a)</enum><header>Definition</header><text>For
			 the purpose of this section—</text>
					<paragraph id="H14DAD86B972E4E649D210F6970D1598C"><enum>(1)</enum><text>the term
			 <term>total number of Federal employees</term> means the total number of
			 Federal employees in all agencies;</text>
					</paragraph><paragraph id="HAB5997FDAD35446FB19832BB8AC625EE"><enum>(2)</enum><text>the term
			 <term>Federal employee</term> means an employee as defined by section 2105 of
			 title 5, United States Code; and</text>
					</paragraph><paragraph id="HC3B914B17FA548FD929C28B3B19C6ABB"><enum>(3)</enum><text>the term
			 <term>agency</term> means an Executive agency as defined by section 105 of
			 title 5, United States Code, excluding the Government Accountability
			 Office.</text>
					</paragraph></subsection><subsection id="H9CFE57EFFB1B426A86DDDC1395ADC831"><enum>(b)</enum><header>Limitation</header><text>The
			 President, through the Office of Management and Budget (in consultation with
			 the Office of Personnel Management), shall take appropriate measures to ensure
			 that, effective beginning in fiscal year 2015, the total number of Federal
			 employees (as determined under subsection (c)) shall not exceed 90 percent of
			 the total number of Federal employees as of September 30, 2011 (as so
			 determined).</text>
				</subsection><subsection id="HCEF897D0CA45480A9E30418F5EC85DEF"><enum>(c)</enum><header>Monitoring and
			 notification</header><text>The Office of Management and Budget (in consultation
			 with the Office of Personnel Management)—</text>
					<paragraph id="H3231FFE612694D17A5D27F441E35AC1B"><enum>(1)</enum><text>shall continuously
			 monitor all agencies and make a determination, as of September 30, 2011, and
			 the last day of each quarter of each fiscal year beginning thereafter, as to
			 whether or not the total number of Federal employees exceeds the maximum number
			 allowable under subsection (b); and</text>
					</paragraph><paragraph id="H9283CF0C8A1A452389908EADDBFE5EBB"><enum>(2)</enum><text>whenever a
			 determination under paragraph (1) is made that the total number of Federal
			 employees exceeds the maximum number allowable under subsection (b), shall
			 provide written notice to that effect to the President and Congress within 14
			 days after the last day of the quarter to which such determination
			 relates.</text>
					</paragraph></subsection><subsection id="HA102EE28860A4683B6E61CB25521677C"><enum>(d)</enum><header>Compliance</header><text>Whenever,
			 with respect to the quarter ending on September 30, 2014, or any subsequent
			 quarter, the Office of Management and Budget provides written notice under
			 subsection (c)(2) that the total number of Federal employees exceeds the
			 maximum number allowable under subsection (b), no agency may thereafter appoint
			 any employee to fill any vacancy within such agency until the Office of
			 Management and Budget provides written notice to the President and Congress of
			 a determination under subsection (c)(1) that the total number of Federal
			 employees no longer exceeds the maximum number allowable under subsection (b).
			 Any notice under the preceding sentence shall be provided within 14 days after
			 the last day of the quarter to which the determination relates.</text>
				</subsection><subsection id="HA2C7105FC8C642778D835F28B96BB5A5"><enum>(e)</enum><header>Waiver</header>
					<paragraph id="H6081284326F74BDB8197E79AF9836459"><enum>(1)</enum><header>Emergencies</header><text>This
			 section may be waived upon a determination by the President that—</text>
						<subparagraph id="HB0C31BDD0535448A982A37FCDA413B41"><enum>(A)</enum><text>the existence of a
			 state of war or other national security concern so requires; or</text>
						</subparagraph><subparagraph id="HD802D6A8FDEE4B31B1CC6879ECF1FF16"><enum>(B)</enum><text>the existence of
			 an extraordinary emergency threatening life, health, public safety, property,
			 or the environment so requires.</text>
						</subparagraph></paragraph><paragraph id="H7D77CC6848334FCDA10A960BCC3F447E"><enum>(2)</enum><header>Agency
			 efficiency or critical mission</header><text display-inline="yes-display-inline">This section may be waived, with respect to
			 a particular position or category of positions in an agency, upon a
			 determination by the President that the efficiency of the agency or the
			 performance of a critical agency mission so requires.</text>
					</paragraph></subsection><subsection id="H49A5998CCE05405DBF9678BDAA29EAA0"><enum>(f)</enum><header>Replacement
			 rate</header><text>To the extent necessary to achieve the workforce reduction
			 required by subsection (b), the Office of Management and Budget (in
			 consultation with the Office of Personnel Management) shall take appropriate
			 measures to ensure that agencies shall appoint no more than 1 employee for
			 every 3 employees retiring or otherwise separating from Government service
			 after the date of the enactment of this Act. This subsection shall cease to
			 apply after September 30, 2014.</text>
				</subsection><subsection id="H7BC56DC9B11249E3BE6372ED36CB9E2F"><enum>(g)</enum><header>Counting
			 rule</header><text>For purposes of this Act, any determination of the number of
			 employees in an agency shall be expressed on a full-time equivalent
			 basis.</text>
				</subsection><subsection id="H9A9E7B873CEC458CA19C279F451266C9"><enum>(h)</enum><header>Limitation on
			 procurement of service contracts</header><text>The President, through the
			 Office of Management and Budget (in consultation with the Office of Personnel
			 Management), shall take appropriate measures to ensure that there is no
			 increase in the procurement of service contracts by reason of the enactment of
			 this Act, except in cases in which a cost comparison demonstrates that such
			 contracts would be to the financial advantage of the Government.</text>
				</subsection><subsection id="HDD60BEA3875049CA9B63C552F80BFC01"><enum>(i)</enum><header>Regulations</header><text>Any
			 regulations necessary to carry out this Act may be prescribed by the President
			 or his designee.</text>
				</subsection></section></title><title id="H91B02B84EA3B44BBA883F7C2DFF73F2E"><enum>VI</enum><header>Repeal of
			 employer health insurance mandate</header>
			<section id="HF3910BDCBD184A678981CAC19C573A72"><enum>601.</enum><header>Repeal of
			 employer health insurance mandate</header>
				<subsection id="H635623BB3EA24D3F8C245D6B761BC729"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 43 of the
			 Internal Revenue Code of 1986 is amended by striking section 4980H.</text>
				</subsection><subsection id="H4A3B4F80273C40F39FA2B24230B646A4"><enum>(b)</enum><header>Repeal of

			 Protection Act</header>
			<section display-inline="no-display-inline" id="H0D5719FE546E40F6A3A5C05F89EB33C7" section-type="subsequent-section"><enum>701.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Secret Ballot Protection
			 Act</short-title></quote>.</text>
			</section><section id="HD0078A77CBDA4BF8AEB62901271DFE0B"><enum>702.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
				<paragraph id="H6DADE576C3BB425699453EB254EAB529"><enum>(1)</enum><text display-inline="yes-display-inline">the importance of a secret ballot election
			 has been recognized by the United States for over 100 years;</text>
				</paragraph><paragraph id="H3E81D3540610488097F924AB0FEAAFEE"><enum>(2)</enum><text>the fundamental
			 democratic right to choose by secret ballot is the only method that ensures a
			 choice free of coercion, intimidation, irregularity, or illegality;</text>
				</paragraph><paragraph id="H6D647FF421F94AA78EEC7BA84424A19C"><enum>(3)</enum><text>the recognition of
			 a labor organization by way of a private agreement, rather than a secret ballot
			 election supervised by a neutral third party, threatens an employee’s right,
			 codified in the National Labor Relations Act, to choose whether or not to be
			 represented by a labor organization; and</text>
				</paragraph><paragraph id="H2381A4DC86E74458A9CA3CF73BBE60CA"><enum>(4)</enum><text>preserving
			 workers’ right to choose whether or not to be represented by a labor
			 organization through a secret ballot election is important to the strength of
			 the national economy.</text>
				</paragraph></section><section id="H8C2D6228651945498342D91DDC7F347E"><enum>703.</enum><header>National Labor
			 Relations Act</header>
				<subsection id="HC5DFE351B2E445D2AAAEF4C233C5E8DC"><enum>(a)</enum><header>Recognition of
			 representative</header>
					<paragraph id="HCD88DE1390B448BB8635D2FA11AE883F"><enum>(1)</enum><header>In
			 general</header><text>Section 8(a)(2) of the National Labor Relations Act (29
			 U.S.C. 158(a)(2)) is amended by inserting before the colon the following:
			 <quote>or to recognize or bargain collectively with a labor organization that
			 has not been selected by a majority of employees in a unit appropriate for such
			 purposes in a secret ballot election conducted by the National Labor Relations
			 Board in accordance with section 9</quote>.</text>
					</paragraph><paragraph id="HE54525BB866E41FA9BD35EF8AC419625"><enum>(2)</enum><header>Application</header><text>The
			 amendment made by paragraph (1) shall not apply to collective bargaining
			 relationships that were recognized before the date of enactment of this
			 Act.</text>
					</paragraph></subsection><subsection id="HF65EB70C39D34D4A963B8E7BEB1C9296"><enum>(b)</enum><header>Election
			 required</header>
					<paragraph id="HB02C1A14031F40729DC40A977282ECBA"><enum>(1)</enum><header>In
			 general</header><text>Section 8(b) of the National Labor Relations Act (29
			 U.S.C. 158(b)), as amended by subsection (c) of this section, is
			 amended—</text>
						<subparagraph id="H72AB06C10D2E474291EB49444BA2E605"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (6);</text>
						</subparagraph><subparagraph id="H1E523ED05CF844A1883B2507555596E1"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (7) and inserting <quote>; and</quote>;
			 and</text>

						</subparagraph></paragraph><paragraph id="H2B02DC66BEA54AED911D7F5849A9ED97"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall
			 not apply to collective bargaining relationships that were recognized before
			 the date of enactment of this Act.</text>
					</paragraph></subsection><subsection id="HBEECD55D79444864AFF63A7AC67995CD"><enum>(c)</enum><header>Secret ballot
			 election required</header><text>Section 9(a) of the National Labor Relations
			 Act (29 U.S.C. 159(a)), is amended—</text>
					<paragraph id="H7F60BEE5FFB24936AC14B66F43B559B9"><enum>(1)</enum><text>by inserting
			 <quote>(1)</quote> after <quote>(a)</quote>;</text>
					</paragraph><paragraph id="H866A3CBC7BF245C9BC11328AB42CC8C4"><enum>(2)</enum><text>by inserting after
			 <quote>designated or selected</quote> the following: <quote>by a secret ballot
			 election conducted by the National Labor Relations Board in accordance with
			 this section</quote>; and</text>
					</paragraph><paragraph id="H43F54E25BD934CC2BCBEB2DA95C45C20"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H9BFC078F44274B9B8229D9D9E5DB4B6F">
							<paragraph id="HB6A0498E9F7A4E669E0308DBAD270232"><enum>(2)</enum><text display-inline="yes-display-inline">The secret ballot election requirement of
				paragraph (1) shall not apply to collective bargaining relationships that were
				recognized before the date of enactment of the Secret Ballot Protection
				Act.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H43E95A3EF00A4C1EB2AA1F3878C2EB3F"><enum>(d)</enum><header>Conforming
			 amendments</header><text>Section 9(c)(1) of such Act (29 U.S.C. 159(c)(1)) is
			 amended—</text>
					<paragraph id="H5BC6DB1AED194747A754DFFD1442A18B"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
						<subparagraph id="H972CBDDA368F4E07A879BC4BAECCEDD6"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>and that their employer declines to recognize their
			 representative as the representative defined in section 9(a)</quote> and
			 inserting <quote>by a representative</quote>; and</text>
						</subparagraph><subparagraph id="HD4F17066882C4FDBA9DD4F45E96F002C"><enum>(B)</enum><text>in clause (ii), by
			 striking <quote>section 9(a);</quote> and inserting <quote>subsection
			 (a),</quote>; and</text>
						</subparagraph></paragraph><paragraph id="H49D2309D2FE54D7F94BC7B53E670ED9C"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>alleging</quote> and all that follows through
			 <quote>defined in section 9(a)</quote>.</text>
					</paragraph></subsection></section><section id="H92DE91AAE9884C31BDA2DC920F39B45E"><enum>704.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 6 months after the date of
			 the enactment of this Act the National Labor Relations Board shall review and
			 revise all regulations promulgated before such date to implement the amendments
			 made in this title to the National Labor Relations Act.</text>
			</section></title><title id="H0BEC9A77237E478C859154A98C5DFB65"><enum>VIII</enum><header>Federal Rules
			 of Civil Procedure improvements</header>
			<section id="H6D2F607E5E5940DE8E8561FFD90AD4C7"><enum>801.</enum><header>Attorney
			 accountability</header><text display-inline="no-display-inline">Rule 11(c) of
			 the Federal Rules of Civil Procedure is amended—</text>
				<paragraph id="H540A2AB812274A35BF9AE6778C360B87"><enum>(1)</enum><text>by amending the
			 first sentence to read as follows: <quote>If a pleading, motion, or other paper
			 is signed in violation of this rule, the court, upon motion or upon its own
			 initiative, shall impose upon the attorney, law firm, or parties that have
			 violated this subdivision or are responsible for the violation, an appropriate
			 sanction, which may include an order to pay the other party or parties for the
			 reasonable expenses incurred as a direct result of the filing of the pleading,
			 motion, or other paper, that is the subject of the violation, including a
			 reasonable attorney's fee.</quote>;</text>
				</paragraph><paragraph id="H7C0E906EB9F14AC0A11F46C860A9603A"><enum>(2)</enum><text>in paragraph
			 (1)(A)—</text>
					<subparagraph id="H57FE53B936764D82863570181623BB6B"><enum>(A)</enum><text>by striking
			 <quote>Rule 5</quote> and all that follows through <quote>corrected.</quote>
			 and inserting <quote>Rule 5.</quote>; and</text>
					</subparagraph><subparagraph id="H56ED232E18114E5EA4F2A9F489493C9F"><enum>(B)</enum><text>by striking
			 <quote>the court may award</quote> and inserting <quote>the court shall
			 award</quote>; and</text>
					</subparagraph></paragraph><paragraph id="HB6B9E9F1E1104D32987033228F188DB1"><enum>(3)</enum><text>in paragraph (2),
			 by striking <quote>shall be limited to what is sufficient</quote> and all that
			 follows through the end of the paragraph (including subparagraphs (A) and (B))
			 and inserting <quote>shall be sufficient to deter repetition of such conduct or
			 comparable conduct by others similarly situated, and to compensate the parties
			 that were injured by such conduct. The sanction may consist of an order to pay
			 to the party or parties the amount of the reasonable expenses incurred as a
			 direct result of the filing of the pleading, motion, or other paper that is the
			 subject of the violation, including a reasonable attorney's
			 fee.</quote>.</text>
				</paragraph></section><section id="HBB277B1DEF904271BDC2D791E60E13C1"><enum>802.</enum><header>Applicability
			 of Rule 11 to State cases affecting interstate commerce</header><text display-inline="no-display-inline">In any civil action in State court, the
			 court, upon motion, shall determine within 30 days after the filing of such
			 motion whether the action substantially affects interstate commerce. Such court
			 shall make such determination based on an assessment of the costs to the
			 interstate economy, including the loss of jobs, were the relief requested
			 granted. If the court determines such action substantially affects interstate
			 commerce, the provisions of Rule 11 of the Federal Rules of Civil Procedure
			 shall apply to such action.</text>
			</section><section id="HCBD2FE9A7CDB47AFA4639312EC9A9A84"><enum>803.</enum><header>Prevention of
			 forum-shopping</header>
				<subsection id="H4C6051DB89CF439EB301A942A8074366"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to subsection
			 (b), a personal injury claim filed in State or Federal court may be filed only
			 in the State and, within that State, in the county (or if there is no State
			 court in the county, the nearest county where a court of general jurisdiction
			 is located), or Federal district in which—</text>
					<paragraph id="HE82F9068DF424C30AD56F285A89CC3B2"><enum>(1)</enum><text>the person
			 bringing the claim, including an estate in the case of a decedent and a parent
			 or guardian in the case of a minor or incompetent—</text>
						<subparagraph id="H8310F818A4D04852B1A737F212DA06D8"><enum>(A)</enum><text>resides at the
			 time of filing; or</text>
						</subparagraph><subparagraph id="H4BD1BA4DBF114225B5B0A28BC4D4B755"><enum>(B)</enum><text>resided at the
			 time of the alleged injury;</text>
						</subparagraph></paragraph><paragraph id="H8A8D0C361B184BBCA2F1B9589FE8DACC"><enum>(2)</enum><text>the alleged injury
			 or circumstances giving rise to the personal injury claim allegedly
			 occurred;</text>
					</paragraph><paragraph id="H73BAB5BC987D472885DAFBDC7EB61F1D"><enum>(3)</enum><text>the defendant's
			 principal place of business is located, if the defendant is a corporation;
			 or</text>
					</paragraph><paragraph id="H37F6BCD42EDC42C3BDD1ABFA14155D13"><enum>(4)</enum><text>the defendant
			 resides, if the defendant is an individual.</text>
					</paragraph></subsection><subsection id="HCBE202BADFB846A6B02827B326B18306"><enum>(b)</enum><header>Determination of
			 Most Appropriate Forum</header><text>If a person alleges that the injury or
			 circumstances giving rise to the personal injury claim occurred in more than
			 one county (or Federal district), the trial court shall determine which State
			 and county (or Federal district) is the most appropriate forum for the claim.
			 If the court determines that another forum would be the most appropriate forum
			 for a claim, the court shall dismiss the claim. Any otherwise applicable
			 statute of limitations shall be tolled beginning on the date the claim was
			 filed and ending on the date the claim is dismissed under this
			 subsection.</text>
				</subsection><subsection id="H503E8428BE654AB89B59A0BCC2D53543"><enum>(c)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="H33E39D53DED9407A918920A35F5A3274"><enum>(1)</enum><text>The term
			 <term>personal injury claim</term>—</text>
						<subparagraph id="H528F7024721545D4B760D76FEDB8C663"><enum>(A)</enum><text>means a civil
			 action brought under State law by any person to recover for a person's personal
			 injury, illness, disease, death, mental or emotional injury, risk of disease,
			 or other injury, or the costs of medical monitoring or surveillance (to the
			 extent such claims are recognized under State law), including any derivative
			 action brought on behalf of any person on whose injury or risk of injury the
			 action is based by any representative party, including a spouse, parent, child,
			 or other relative of such person, a guardian, or an estate;</text>
						</subparagraph><subparagraph id="HB69ED29DC49F491BA5BA21CD9690113A"><enum>(B)</enum><text>does not include a
			 claim brought as a class action; and</text>
						</subparagraph><subparagraph id="H2730290AD9164386AF93FAB890150BFC"><enum>(C)</enum><text>does not include a
			 claim against a debtor in a case pending under title 11 of the United States
			 Code that is a personal injury tort or wrongful death claim within the meaning
			 of <external-xref legal-doc="usc" parsable-cite="usc/28/157">section
			 157(b)(5)</external-xref> of title 28, United States Code.</text>
						</subparagraph></paragraph><paragraph id="H0E8D66CF5AD4452EBBD2D67125C3DADB"><enum>(2)</enum><text>The term
			 <term>person</term> means any individual, corporation, company, association,
			 firm, partnership, society, joint stock company, or any other entity, but not
			 any governmental entity.</text>
					</paragraph><paragraph id="H5CEDF722CED749319B07307B222A4D06"><enum>(3)</enum><text>The term
			 <term>State</term> includes the District of Columbia, the Commonwealth of
			 Puerto Rico, the United States Virgin Islands, Guam, and any other territory or
			 possession of the United States.</text>
					</paragraph></subsection><subsection id="H65C5D93813A344A5AB73C6F498677A05"><enum>(d)</enum><header>Applicability</header><text>This
			 section applies to any personal injury claim filed in Federal or State court on
			 or after the date of the enactment of this Act.</text>
				</subsection></section><section id="HFC93E5993E62436FB985515A564BD05B"><enum>804.</enum><header>Rule of
			 construction</header><text display-inline="no-display-inline">Nothing in
			 section 402 or in the amendments made by section 401 shall be construed to bar
			 or impede the assertion or development of new claims or remedies under Federal,
			 State, or local civil rights law.</text>
			</section><section id="H6C5C130ED7B54E698F449F205619EF24"><enum>805.</enum><header>Three-strikes
			 rule for suspending attorneys who commit multiple Rule 11 violations</header>
				<subsection id="H562DECB315864CC98B19FE7B8C4850AA"><enum>(a)</enum><header>Mandatory
			 Suspension</header><text display-inline="yes-display-inline">Whenever a Federal
			 district court determines that an attorney has violated Rule 11 of the Federal
			 Rules of Civil Procedure, the court shall determine the number of times that
			 the attorney has violated that rule in that Federal district court during that
			 attorney's career. If the court determines that the number is three or more,
			 the Federal district court—</text>
					<paragraph id="H66B77C4FAD90487FB2947733687084DD"><enum>(1)</enum><text>shall suspend that
			 attorney from the practice of law in that Federal district court for one year;
			 and</text>
					</paragraph><paragraph id="H40C68D1445F04B1F8733DE2ED54FE7A4"><enum>(2)</enum><text>may suspend that
			 attorney from the practice of law in that Federal district court for any
			 additional period that the court considers appropriate.</text>
					</paragraph></subsection><subsection id="H968B8DF8AECB4FCDB695FD8103DA5A9D"><enum>(b)</enum><header>Appeal;
			 Stay</header><text>An attorney has the right to appeal a suspension under
			 subsection (a). While such an appeal is pending, the suspension shall be
			 stayed.</text>
				</subsection><subsection id="HCC16721BA91C4169A19E8A09AF5901A7"><enum>(c)</enum><header>Reinstatement</header><text>To
			 be reinstated to the practice of law in a Federal district court after
			 completion of a suspension under subsection (a), the attorney involved must
			 first petition the court for reinstatement under such procedures and conditions
			 as the court may prescribe.</text>
				</subsection></section><section id="HAF9C4FCC3D384E5CAB5BAA5ADF9D4BDF"><enum>806.</enum><header>Presumption of
			 rule 11 violation for repeatedly relitigating same issue</header><text display-inline="no-display-inline">Whenever a party presents to a Federal court
			 a pleading, written motion, or other paper, that includes a claim or defense
			 that the party has already litigated and lost on the merits in any forum in
			 final decisions not subject to appeal on three consecutive occasions, and the
			 claim or defense, respectively, involves the same plaintiff and the same
			 defendant on each occasion, there shall be a rebuttable presumption that the
			 presentation of such paper is in violation of Rule 11 of the Federal Rules of
			 Civil Procedure.</text>
			</section><section id="HE17C0904448C4909AA5CECFBC84FBFD5"><enum>807.</enum><header>Enhanced
			 sanctions for document destruction in pending Federal court
			 proceedings</header><text display-inline="no-display-inline">Whoever willfully
			 and intentionally influences, obstructs, or impedes, or attempts to influence,
			 or obstruct, or impede, a pending Federal court proceeding through the willful
			 and intentional destruction of documents sought pursuant to the rules of such
			 Federal court proceeding and highly relevant to that proceeding—</text>
				<paragraph id="H7BD70BA1C41E4C0581C64D7DD87164CE"><enum>(1)</enum><text>shall be punished
			 with mandatory civil sanctions of a degree commensurate with the civil
			 sanctions available under Rule 11 of the Federal Rules of Civil Procedure, in
			 addition to any other civil sanctions that otherwise apply; and</text>
				</paragraph><paragraph id="H211F5CD1E5E9491EBC4C22C8F046F66D"><enum>(2)</enum><text>shall be held in
			 contempt of court; and if an attorney, referred to one or more appropriate
			 State bar associations for disciplinary proceedings.</text>
				</paragraph></section><section id="H71FF68AAE57C44E59E28663FCA6C9562"><enum>808.</enum><header>Ban on
			 concealment of unlawful conduct</header>
				<subsection id="HDAB65C1849284C3CBF9A145BB67CD6C9"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In any Rule 11 of the
			 Federal Rules of Civil Procedure proceeding, a court may not order that a court
			 record not be disclosed unless the court makes a finding of fact that
			 identifies the interest that justifies the order and determines that interest
			 outweighs any interest in the public health and safety that the court
			 determines would be served by disclosing the court record.</text>
				</subsection><subsection id="HB9FB8EDF3C8F4F298AA96DB8FB192151"><enum>(b)</enum><header>Applicability</header><text>This
			 section applies to any record formally filed with a court, but shall not
			 include any records subject to—</text>

			 attorney-client privilege or any other privilege recognized under Federal or
			 State law that grants the right to prevent disclosure of certain information
			 unless the privilege has been waived; or</text>

			 or Federal laws that protect the confidentiality of crime victims, including
			 victims of sexual abuse.</text>

			 general</header><text>Section 608 is amended to read as follows:</text>

				the enactment of the Regulatory Flexibility Reform Act, the Chief Counsel for
				Advocacy of the Small Business Administration shall, after opportunity for
				notice and comment under section 553, issue rules governing agency compliance
				with this chapter. The Chief Counsel may modify or amend such rules after
				notice and comment under section 553. This chapter (other than this subsection)
				shall not apply with respect to the issuance, modification, and amendment of
				rules under this paragraph.</text>
								</paragraph><paragraph id="H928CCF03164B4D9D9BC77FE06423A3C5" indent="up1"><enum>(2)</enum><text>An agency shall not issue rules which
				supplement the rules issued under subsection (a) unless such agency has first
				consulted with the Chief Counsel for Advocacy to ensure that such supplemental
				rules comply with this chapter and the rules issued under paragraph (1).</text>
								</paragraph></subsection><subsection id="H2070B7B3284A41D5810E9DEA8BADA594"><enum>(b)</enum><text>Notwithstanding
				any other law, the Chief Counsel for Advocacy of the Small Business
				Administration may intervene in any agency adjudication (unless such agency is
				authorized to impose a fine or penalty under such adjudication), and may inform
				the agency of the impact that any decision on the record may have on small
				entities. The Chief Counsel shall not initiate an appeal with respect to any
				adjudication in which the Chief Counsel intervenes under this

				of the United States; or</text>

							</subparagraph></paragraph></subsection><subsection id="HF70F84EE4E3145A6A545069183B98D43"><enum>(c)</enum><text display-inline="yes-display-inline">Not later than 15 days after the receipt of
				such materials and information under subsection (b), the Chief Counsel for
				Advocacy of the Small Business Administration shall—</text>
						<paragraph id="H015327B35581436F8B7FB92923EE9A52"><enum>(1)</enum><text>identify small
				entities or representatives of small entities or a combination of both for the
				purpose of obtaining advice, input, and recommendations from those persons
				about the potential economic impacts of the proposed rule and the compliance of
				the agency with section 603 of this title; and</text>
						</paragraph><paragraph id="H1D126EBE394C4672844AA885C02C99C3"><enum>(2)</enum><text>convene a review
				panel consisting of an employee from the Office of Advocacy of the Small
				Business Administration, an employee from the agency making the rule, and in
				the case of an agency other than an independent regulatory agency (as defined
				in section 3502(5) of title 44, United States Code), an employee from the
				Office of Information and Regulatory Affairs of the Office of Management and
				Budget to review the materials and information provided to the Chief Counsel
				under subsection (b).</text>
						</paragraph></subsection><subsection id="H5258B27E13E84E8F93B8E63FE9184DA7"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H086718E7FFC747A68537C9365D6DAAD6"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than 60 days after the review
				panel described in subsection (c)(2) is convened, the Chief Counsel for
				Advocacy of the Small Business Administration shall, after consultation with
				the members of such panel, submit a report to the agency and, in the case of an
				agency other than an independent regulatory agency (as defined in section
				3502(5) of title 44, United States Code), the Office of Information and
				Regulatory Affairs of the Office of Management and Budget.</text>
						</paragraph><paragraph id="HEF75A9C0EF7F42CC897DF7EC9FA402B8" indent="up1"><enum>(2)</enum><text>Such report shall include an
				assessment of the economic impact of the proposed rule on small entities and a
				discussion of any alternatives that will minimize adverse significant economic
				impacts or maximize beneficial significant economic impacts on small
				entities.</text>
						</paragraph><paragraph id="H46F0B8D2F20B4F228C98E0C0E82816A6" indent="up1"><enum>(3)</enum><text>Such report shall become part of the
				rulemaking record. In the publication of the proposed rule, the agency shall
				explain what actions, if any, the agency took in response to such
				report.</text>
						</paragraph></subsection><subsection id="HEA8572140F44468D8E532647E32B4655"><enum>(e)</enum><text>A proposed rule is
				described by this subsection if the Administrator of the Office of Information
				and Regulatory Affairs of the Office of Management and Budget, the head of the
				agency (or the delegatee of the head of the agency), or an independent
				regulatory agency determines that the proposed rule is likely to result
				in—</text>
						<paragraph id="H3F63395CBFFE468C82193565B08BC747"><enum>(1)</enum><text>an annual effect
				on the economy of $100,000,000 or more;</text>
						</paragraph><paragraph id="H5071F6F4EC1744748F6345A17BED965C"><enum>(2)</enum><text>a major increase
				in costs or prices for consumers, individual industries, Federal, State, or
				local governments, tribal organizations, or geographic regions;</text>
						</paragraph><paragraph id="H7E4F4322B9DC46C48CA7F4AA75F40882"><enum>(3)</enum><text>significant
				adverse effects on competition, employment, investment, productivity,
				innovation, or on the ability of United States-based enterprises to compete
				with foreign-based enterprises in domestic and export markets; or</text>
						</paragraph><paragraph id="HAC8CBD116D9047DB8211B7CF4821A5D9"><enum>(4)</enum><text>a significant
				economic impact on a substantial number of small entities.</text>
						</paragraph></subsection><subsection id="H9907DB857BDE43B78119023BF4A2FA65"><enum>(f)</enum><text display-inline="yes-display-inline">Upon application by the agency, the Chief
				Counsel for Advocacy of the Small Business Administration may waive the
				requirements of subsections (b) through (e) if the Chief Counsel determines
				that compliance with the requirements of such subsections are impracticable,
				unnecessary, or contrary to the public
				interest.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HAC9F5DD123D1423DAD69473B1CC128AD"><enum>906.</enum><header>Periodic review
			 of rules</header><text display-inline="no-display-inline">Section 610 of title
			 5, United States Code, is amended to read as follows:</text>
				<quoted-block id="HB2236A0F851F4BA2BFC5FE7285EA64B3" style="USC">
					<section id="HD13900DCCEB54FE6BE6D70C1BE4BD891"><enum>610.</enum><header>Periodic review
				of rules</header>
						<subsection id="H8CB6BA53D2C24FB78B678909A56F0542"><enum>(a)</enum><text>Not later than 180
				days after the enactment of the Regulatory Flexibility Improvements Act of
				2011, each agency shall publish in the Federal Register and place on its
				website a plan for the periodic review of rules issued by the agency which the
				head of the agency determines have a significant economic impact on a
				substantial number of small entities. Such determination shall be made without
				regard to whether the agency performed an analysis under section 604. The
				purpose of the review shall be to determine whether such rules should be
				continued without change, or should be amended or rescinded, consistent with
				the stated objectives of applicable statutes, to minimize any adverse
				significant economic impacts or maximize any beneficial significant economic
				impacts on a substantial number of small entities. Such plan may be amended by
				the agency at any time by publishing the revision in the Federal Register and
				subsequently placing the amended plan on the agency’s website.</text>
						</subsection><subsection id="H44E93A87E0FF43DA80512A374161AB13"><enum>(b)</enum><text display-inline="yes-display-inline">The plan shall provide for the review of
				all such agency rules existing on the date of the enactment of the Regulatory
				Flexibility Improvements Act of 2011 within 10 years of the date of publication
				of the plan in the Federal Register and for review of rules adopted after the
				date of enactment of the Regulatory Flexibility Improvements Act of 2011 within
				10 years after the publication of the final rule in the Federal Register. If
				the head of the agency determines that completion of the review of existing
				rules is not feasible by the established date, the head of the agency shall so
				certify in a statement published in the Federal Register and may extend the
				review for not longer than 2 years after publication of notice of extension in
				the Federal Register. Such certification and notice shall be sent to the Chief
				Counsel for Advocacy of the Small Business Administration and the
				Congress.</text>
						</subsection><subsection id="HDEF395B30B164F2992E4692571DFB71B"><enum>(c)</enum><text>Each agency shall
				annually submit a report regarding the results of its review pursuant to such
				plan to the Congress, the Chief Counsel for Advocacy of the Small Business
				Administration, and, in the case of agencies other than independent regulatory
				agencies (as defined in section 3502(5) of title 44, United States Code) to the
				Administrator of the Office of Information and Regulatory Affairs of the Office
				of Management and Budget. Such report shall include the identification of any
				rule with respect to which the head of the agency made a determination
				described in paragraph (5) or (6) of subsection (d) and a detailed explanation
				of the reasons for such determination.</text>
						</subsection><subsection id="H443E683E809B428EA33C37E8E287ED52"><enum>(d)</enum><text display-inline="yes-display-inline">In reviewing a rule pursuant to subsections
				(a) through (c), the agency shall amend or rescind the rule to minimize any
				adverse significant economic impact on a substantial number of small entities
				or disproportionate economic impact on a specific class of small entities, or
				maximize any beneficial significant economic impact of the rule on a
				substantial number of small entities to the greatest extent possible,
				consistent with the stated objectives of applicable statutes. In amending or
				rescinding the rule, the agency shall consider the following factors:</text>
							<paragraph id="H56BE7CD452E147B7B2A96A64791C28DF"><enum>(1)</enum><text>The continued need
				for the rule.</text>
							</paragraph><paragraph id="HB3D6ECBF417C459DB026A80DAB604BE0"><enum>(2)</enum><text>The nature of
				complaints received by the agency from small entities concerning the
				rule.</text>
							</paragraph><paragraph id="HF3040AFF353D40A7ADB7EFB2FE19CA34"><enum>(3)</enum><text display-inline="yes-display-inline">Comments by the Regulatory Enforcement
				Ombudsman and the Chief Counsel for Advocacy of the Small Business
				Administration.</text>
							</paragraph><paragraph id="HBA9E21AEA3FC4726870ECCD8A600A7CC"><enum>(4)</enum><text>The complexity of
				the rule.</text>
							</paragraph><paragraph id="H2F259F18D8514C9F85FA278361108000"><enum>(5)</enum><text>The extent to
				which the rule overlaps, duplicates, or conflicts with other Federal rules and,
				unless the head of the agency determines it to be infeasible, State and local
				rules.</text>
							</paragraph><paragraph id="H8ACA7B6EFC7742D9B248385B6652E8D4"><enum>(6)</enum><text>The contribution
				of the rule to the cumulative economic impact of all Federal rules on the class
				of small entities affected by the rule, unless the head of the agency
				determines that such calculations cannot be made and reports that determination
				in the annual report required under subsection (c).</text>
							</paragraph><paragraph id="HBCB3FA7181574682A4158B7279ADBC7D"><enum>(7)</enum><text>The length of time
				since the rule has been evaluated or the degree to which technology, economic
				conditions, or other factors have changed in the area affected by the
				rule.</text>
							</paragraph></subsection><subsection id="HCEA59D10C9DD4A41A0F0F3F598E824DC"><enum>(e)</enum><text display-inline="yes-display-inline">The agency shall publish in the Federal
				Register and on its website a list of rules to be reviewed pursuant to such
				plan. Such publication shall include a brief description of the rule, the
				reason why the agency determined that it has a significant economic impact on a
				substantial number of small entities (without regard to whether it had prepared
				a final regulatory flexibility analysis for the rule), and request comments
				from the public, the Chief Counsel for Advocacy of the Small Business
				Administration, and the Regulatory Enforcement Ombudsman concerning the
				enforcement of the
				rule.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
