			<section id="H282C68889CAB41F7B964DC1472B11F17"><enum>101.</enum><header>Domestic
			 partnerships</header>
				<subsection id="H30D60735E54240B9B7F1F3C762B4D3B0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 21 is amended
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HD21EA96490FF4F1FBE4B25659F879F17" style="USC">
						<section id="HABFFF01E7EAF4494B2B752ADD4F2D69C"><enum>2110.</enum><header>Domestic
				partnerships</header>
							<subsection id="H8246A77EBC2F4E4F9F1654115B07C7B4"><enum>(a)</enum><header>Establishment</header><text>To
				establish the existence of a domestic partnership, between an employee, former
				employee, or annuitant and another individual, for purposes of the provisions
				of law to which this section applies, the employee, former employee, or
				annuitant (as the case may be) shall be required to file an affidavit, in such
				form and manner as the Office of Personnel Management shall by regulation
				prescribe, attesting to the following:</text>
								<paragraph id="H9FC64018438B43B385E532B53E0BE92E"><enum>(1)</enum><text>Both individuals
				are members of the same sex.</text>
								</paragraph><paragraph id="H6A4DE7C9C0814715BAFFD40CED021D22"><enum>(2)</enum><text>Both individuals
				are at least 18 years of age and competent to contract.</text>
								</paragraph><paragraph id="HAFD57F272BB94551ABC3B264FE3486DF"><enum>(3)</enum><text>The filing
				employee, former employee, or annuitant (as the case may be) has notified the
				other individual of the filing of the affidavit attesting that their
				partnership satisfies the requirements of this subsection.</text>
								</paragraph><paragraph id="HFF99A27D7BD343E8AB83F6F7121586BF"><enum>(4)</enum><text>Such individuals
				are in a domestic partnership with one another and intend to remain so
				indefinitely.</text>
								</paragraph><paragraph id="H89280F9A634047D7BA6DF7B417C60834"><enum>(5)</enum><text>Such
				individuals—</text>
									<subparagraph id="HEE6EDC366D45401594ABCBEA46861002"><enum>(A)</enum><text>have a common
				residence; or</text>
									</subparagraph><subparagraph id="H788F8FBB971044CC94D95DDE8CB109C4"><enum>(B)</enum><text>do not have a
				common residence because of financial, employment-related, or other reasons, as
				identified in the affidavit.</text>
									</subparagraph></paragraph><paragraph id="H6A5F461B42A546B19F953C689444E021"><enum>(6)</enum><text>Neither individual
				is married to or in a domestic partnership with anyone outside of the domestic
				partnership referred to in paragraph (4).</text>
								</paragraph><paragraph id="HDB2903DB4AC548A0991364A35DB71735"><enum>(7)</enum><text>The 2 individuals
				share responsibility for a significant measure of each other’s common welfare
				and financial obligations.</text>
								</paragraph><paragraph id="HAC6FE34A517C41BDB848FDD7840EACD5"><enum>(8)</enum><text>The 2 individuals
				are not related in a way that, if they were of the opposite sex, would prohibit
				legal marriage in the jurisdiction in which either individual resides.</text>
								</paragraph><paragraph id="H158ED7E511CB4471BD2942AE6519D7D1"><enum>(9)</enum><text display-inline="yes-display-inline">The filing employee, former employee, or
				annuitant (as the case may be) understands that willful falsification of
				information set forth in the affidavit or failure to provide appropriate
				notification of the termination of the domestic partnership may lead to the
				recovery of amounts obtained as a result of such falsification or failure (as
				the case may be), criminal or other penalties, and (in appropriate cases)
				disciplinary action.</text>
								</paragraph><continuation-text continuation-text-level="subsection">An
				affidavit shall not be effective for purposes of this section unless the filing
				individual is an employee, former employee, or annuitant as of the time of
				filing. No 2 individuals shall, for purposes of the provisions of law to which
				this section applies, be treated as being in a domestic partnership with one
				another unless there is in effect, in accordance with regulations prescribed by
				the Office, an affidavit filed in accordance with the preceding provisions of
				this subsection. An affidavit so filed shall remain in effect until the earlier
				of the date of the death of either individual or the date as of which the
				domestic partnership is otherwise terminated, as determined under such
				regulations.</continuation-text></subsection><subsection id="HAE91659934814314869CE979356CBE16"><enum>(b)</enum><header>Domestic
				partner</header><text>For purposes of the provisions of law to which this
				section applies, the term <term>domestic partner</term> means an individual who
				is in a domestic partnership, as described in subsection (a).</text>
							</subsection><subsection commented="no" id="H01CE8E69BC3B49258622158EAADB5C7A"><enum>(c)</enum><header>Employee
				defined</header><text display-inline="yes-display-inline">For purposes of this
				section, the term <term>employee</term> means an employee as defined by section
				2105, an employee of a nonappropriated fund instrumentality of the Department
				of Defense or the Coast Guard (as described in section 2105(c)), an employee of
				the United States Postal Service or of the Postal Regulatory Commission (as
				described in section 2105(e)), a Member of Congress, a member of the
				commissioned corps of the Public Health Service, a member of the commissioned
				corps of the National Oceanic and Atmospheric Administration, and any other
				individual who is employed by the Government (as determined under regulations
				of the President or a designee thereof), but does not include a technician
				(within the meaning of section 8337(h) or, notwithstanding any provision of
				chapter 43 of title 38, a member of the armed forces.</text>
							</subsection><subsection id="H112CC2AF4FDA4E9899DD3C6CA1972005"><enum>(d)</enum><header>Annuitant
				defined</header><text display-inline="yes-display-inline">For purposes of this
				section, the term <term>annuitant</term> means—</text>
								<paragraph id="H4A9C7A4E63764418B42CBBBA36FB55A0"><enum>(1)</enum><text>an annuitant
				within the meaning of section 8331 or 8401; and</text>
								</paragraph><paragraph id="H0DDC260A27B8419B901A0847BDC6D579"><enum>(2)</enum><text>as determined
				under regulations prescribed by the President or a designee thereof, any other
				individual who is entitled to benefits (based on the service of such
				individual) under a retirement system for employees of the Government.</text>
								</paragraph></subsection><subsection id="HE0A044EB172944B4A6B57F831624EA62"><enum>(e)</enum><header>Confidentiality</header><text>No
				individual may—</text>
								<paragraph id="H2AC55C5E74B34E3781415D1B4D662DF5"><enum>(1)</enum><text>use the
				information obtained under subsection (a) for any purpose other than the
				administration of any provision of law to which this section applies; or</text>
								</paragraph><paragraph id="H4C637C17F55A4E68AFAF14DECBA9525B"><enum>(2)</enum><text display-inline="yes-display-inline">furnish any information obtained under
				subsection (a) to anyone, or permit anyone to examine or otherwise gain access
				to any such information, except for—</text>

				thereafter if the spouse (or domestic partner) is entitled, as a former spouse

				8341(h).</continuation-text><subparagraph id="H58F50B9651C84D8BB5DC34E59E070F77" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Any reduction in an annuity for the purpose
				of providing a survivor annuity for a former spouse (or a former domestic
				partner) of a retired employee or Member shall be terminated for each full
				month after the former spouse remarries (or the former domestic partner enters
				into a subsequent domestic partnership) before reaching age 55 or dies. This
				reduction shall be replaced by an appropriate reduction or reductions under
				paragraph (4) if the retired employee or Member has (i) another former spouse
				(or another former domestic partner) who is entitled to a survivor annuity
				under section 8341(h), (ii) a current spouse to whom the employee or Member was
				married (or a current domestic partner with whom the employee or Member was in
				a domestic partnership) at the time of retirement and with respect to whom a
				survivor annuity was not jointly waived under paragraph (1), or (iii) a current
				spouse whom the employee or Member married (or a current domestic partner with
				whom the employee or Member entered into domestic partnership) after retirement
				and with respect to whom an election has been made under subparagraph (C) or
				subsection (k)(2).</text>
								</subparagraph><subparagraph id="HDAB112FB6D494656971E33BFE27FE24E" indent="up1"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="HD15F1D15EDA24D7291C86DE20A4A285C"><enum>(i)</enum><text display-inline="yes-display-inline">Upon remarriage (or entry into a subsequent
				domestic partnership), a retired employee or Member who was married (or in a
				domestic partnership) at the time of retirement, including an employee or
				Member whose annuity was not reduced to provide a survivor annuity for the
				employee’s or Member's spouse or former spouse (or domestic partner or former
				domestic partner) as of the time of retirement, may irrevocably elect during
				such marriage (or domestic partnership), in a signed writing received by the
				Office—</text>
										<subclause id="HE42C27C6F30049C0AF357F4265D695BF" indent="up1"><enum>(I)</enum><text>within 2 years after such remarriage
				(or such subsequent domestic partnership), or</text>
										</subclause><subclause id="H96482F9FE10E48B39D21AF96F784C9EB" indent="up1"><enum>(II)</enum><text>if later, within 2 years
				after—</text>
											<item id="H025715F911EA4343B6EFCC36722493E9"><enum>(aa)</enum><text display-inline="yes-display-inline">the death or remarriage of any former
				spouse (or the death of or entry into a subsequent domestic partnership by any
				former domestic partner) of such employee or Member who was entitled to a
				survivor annuity under section 8341(h), or</text>
											</item><item id="H1F0DD97B63094D57A285B2A2C5791313"><enum>(bb)</enum><text>if there was more than 1, the
				death or remarriage of the last such surviving former spouse (or the death of
				or entry into a subsequent domestic partnership by the last such surviving
				former domestic partner),</text>
											</item><continuation-text continuation-text-level="subclause" indent="subsection">a reduction in the employee’s or Member's annuity
				under paragraph (4) for the purpose of providing an annuity for such employee’s
				or Member's spouse (or domestic partner) in the event such spouse (or domestic
				partner) survives the employee or Member.</continuation-text></subclause></clause><clause id="H07FEB4DF6BC54B45B46E5FD807F313E9" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">Such election and reduction shall be
				effective the first day of the second month after the election is received by
				the Office, but not less than 9 months after the date of the remarriage (or
				entry into the subsequent domestic partnership), and the retired employee or
				Member shall deposit in the Fund an amount determined by the Office of
				Personnel Management, as nearly as may be administratively feasible, to reflect
				the amount by which the annuity of such retired employee or Member would have
				been reduced if the election had been in effect since the date of retirement
				or, if later, the date the previous reduction in such retired employee’s or
				Member's annuity was terminated under subparagraph (A) or (B), plus interest.
				For the purposes of the preceding sentence, the annual rate of interest for
				each year during which an annuity would have been reduced if the election had
				been in effect on and after the applicable date referred to in such sentence
				shall be 6 percent.</text>
									</clause><clause id="H6EBCB521AD834DE29BEC695572DCDE4E" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">The Office shall, by regulation, provide
				for payment of the deposit required under clause (ii) by a reduction in the
				annuity of the employee or Member. The reduction shall, to the extent
				practicable, be designed so that the present value of the future reduction is
				actuarially equivalent to the deposit required under clause (ii), except that
				total reductions in the annuity of an employee or Member to pay deposits
				required by the provisions of this paragraph or paragraph (3) shall not exceed
				25 percent of the annuity computed under subsections (a) through (i), (n), (q),
				and (r), including adjustments under section 8340. The reduction required by
				this clause, which shall be effective on the same date as the election under
				clause (i), shall be permanent and unaffected by any future dissolution of the
				marriage (or termination of the domestic partnership). Such reduction shall be
				independent of and in addition to the reduction required under clause
				(i).</text>
									</clause><clause id="HB5C0364ED65D42549046EED7F65EE2F9" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				subparagraph, an election under this subparagraph may not be made for the
				purpose of providing an annuity in the case of a spouse by remarriage (or a
				domestic partner by a subsequent domestic partnership) if such spouse was
				married to (or if such domestic partner was in a domestic partnership with) the
				employee or Member at the time of such employee’s or Member's retirement, and
				all rights to survivor benefits for such spouse (or domestic partner) under
				this subchapter based on marriage (or domestic partnership) to such employee or
				Member were then waived under paragraph (1) or a similar prior provision of
				law.</text>
									</clause><clause id="HB25BD7D32A664CE9A73306AB70A02A5C" indent="up1"><enum>(v)</enum><text display-inline="yes-display-inline">An election to provide a survivor annuity
				to a person under this subparagraph—</text>
										<subclause id="HF5305FBBE17A4C529DA135E2504FC105"><enum>(I)</enum><text display-inline="yes-display-inline">shall prospectively void any election made
				by the employee or Member under subsection (k)(1) with respect to such person;
				or</text>
										</subclause><subclause id="H3808A71CEA194FE599F6D8FF79963A9F"><enum>(II)</enum><text display-inline="yes-display-inline">shall, if an election was made by the
				employee or Member under such subsection (k)(1) with respect to a different
				person, prospectively void such election if appropriate written application is
				made by such employee or Member at the time of making the election under this
				subparagraph.</text>
										</subclause></clause><clause id="H33EF22DC5F59462A8AEA1E4D43B3C201" indent="up1"><enum>(vi)</enum><text display-inline="yes-display-inline">The deposit provisions of clauses (ii) and
				(iii) shall not apply if—</text>
										<subclause id="H7E70C08D694F48BD8B1E7B57E7AC55FF"><enum>(I)</enum><text display-inline="yes-display-inline">the employee or Member makes an election
				under this subparagraph after having made an election under subsection (k)(1);
				and</text>

				becomes void under clause (v).</text>

				<paragraph id="HF7DAC6C48DA24A4D84D07A97249328FE"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="H3AEF3F9CEC524B5C9B590AD7A4D8666B"><enum>(A)</enum><text>by redesignating
			 paragraphs (3) and (4) as paragraphs (4) and (5), respectively;</text>
					</subparagraph><subparagraph id="HD82ECDDEA7174CC199805DBB91AFF502"><enum>(B)</enum><text>by inserting after
			 paragraph (2) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H9673A10D051B4E59A75D7A4131F6FE15" style="USC">
							<paragraph commented="no" id="H63CCD4FBD6C940718DDDC1401DB34D75"><enum>(3)</enum><text display-inline="yes-display-inline"><term>surviving partner</term> means the
				surviving domestic partner of an employee or Member who—</text>
								<subparagraph commented="no" id="HBB8761DD718E419A8C07D5A6C0FBDD2F"><enum>(A)</enum><text>was in a domestic
				partnership with such employee or Member for at least 9 months immediately
				before the death of such employee or Member; or</text>
								</subparagraph><subparagraph commented="no" id="HED5B30E4024E4E07BC129DD5CB82003F"><enum>(B)</enum><text>satisfies such
				other requirement, based on parenthood, as the Office of Personnel Management
				shall by regulation prescribe based on the definition of a widow or widower
				under this section;</text>
								</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H48E5A4F1291A436B9D597329BFB77D1F"><enum>(C)</enum><text>in paragraph (5)
			 (as so redesignated by subparagraph (A))—</text>
						<clause id="H4FC90E4D0315432A9273265B2308658D"><enum>(i)</enum><text>in
			 subparagraph (A), by inserting <quote>(or surviving domestic partner)</quote>
			 after <quote>the surviving spouse</quote>; and</text>
						</clause><clause id="HA5AE7D1E19BD426BA98DABE15D0F5BEB"><enum>(ii)</enum><text>by
			 adding at the end the following: <quote>The Office shall prescribe regulations
			 to provide that, for purposes of applying the provisions of paragraph
			 (5)(A)(ii) (relating to the treatment of a stepchild) in the case of a domestic
			 partnership, rules similar to those prescribed to carry out section 8901(5)(B)
			 in similar circumstances shall apply.</quote>;</text>
						</clause></subparagraph></paragraph><paragraph id="H2C1F61E4ED044EA9957F5C76F0457EFA"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="HFFE7B2110D15471E94B68DD978B282F8"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
						<clause id="HDB7D499AC66F46BEA2D515359C5EC2D5"><enum>(i)</enum><text>by
			 striking <quote>widow or widower</quote> each place it appears and inserting
			 <quote>widow or widower (or surviving partner)</quote>; and</text>
						</clause><clause id="H161D0C0B425C460682E40F024A44F4D2"><enum>(ii)</enum><text>by
			 striking <quote>remarriage,</quote> and inserting <quote>remarriage (or entry
			 into a subsequent domestic partnership)</quote>;</text>
						</clause></subparagraph><subparagraph id="H26ADC9CEBC49406F9028C4BE77A5184C"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
						<clause id="HF4AC6F7217AC45EB95C8D4A343940AD7"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>widow or widower</quote>
			 each place it appears and inserting <quote>widow or widower (or surviving
			 partner)</quote>; and</text>
						</clause><clause id="H62C0421CE68D4272BCE49B1632BC8BEA"><enum>(ii)</enum><text>by
			 inserting <quote>(or in a domestic partnership with)</quote> after
			 <quote>married to</quote>;</text>
						</clause></subparagraph><subparagraph id="H96C1DBD8AAFD4B9BB63638971FA1AED9"><enum>(C)</enum><text>in paragraph
			 (3)—</text>

			 the matter before subparagraph (A), by inserting <quote>(or domestic

					</subparagraph><subparagraph id="HB5584EC4F0E845699F5C89ED3BE6BEC1"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting

			 and</text>
					</subparagraph><subparagraph id="H1672E411D7704F5FA637AA2B546AA2BC"><enum>(C)</enum><text>in clause (ii), by
			 inserting <quote>(or enters into a subsequent domestic partnership)</quote>
			 after <quote>remarries</quote>;</text>
					</subparagraph></paragraph><paragraph id="H5F5640C5E4FB4C3D85342425B6001AC3"><enum>(4)</enum><text>in subsection
			 (e)—</text>
					<subparagraph id="H3A3F23A5B7944351819D1FAE97180DD3"><enum>(A)</enum><text>by striking the
			 matter before paragraph (2) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H5FFF990A55C6447CBB4B91A39790F4EE" style="USC">
							<subsection id="H5753228FC4414E45B147756151906A1B"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HC581DCA02397405291CD5A3A9EF29280"><enum>(1)</enum><text>For the purposes of this
				subsection—</text>
									<subparagraph id="H391A3796B1004F20B46B0D42B74C8368" indent="up1"><enum>(A)</enum><text>the term <term>former spouse</term>
				includes a former spouse who was married to an employee or Member for less than
				9 months and a former spouse of an employee or Member who completed less than
				18 months of service covered by this subchapter; and</text>
									</subparagraph><subparagraph id="H5592BACDB99A44C690A6E418F992B413" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>former domestic
				partner</term> includes a former domestic partner who was in a domestic
				partnership with an employee or Member for less than 9 months and a former
				domestic partner of an employee or Member who completed less than 18 months of
				service covered by this
				subchapter.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HE52CF4E229C540989F27372F0ACDE32F"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>a spouse or a former spouse</quote> each place it appears
			 and inserting <quote>a spouse or former spouse (or a domestic partner or former
			 domestic partner)</quote>;</text>
					</subparagraph><subparagraph id="H352B2A94F6354254A719C84E6F962993"><enum>(C)</enum><text>in paragraph
			 (3)—</text>
						<clause id="H281D1D9274AF4B1C8F754CA793F14B8F"><enum>(i)</enum><text>in
			 subparagraph (E), by striking <quote>dies or marries;</quote> and inserting
			 <quote>dies, marries, or enters into a domestic partnership;</quote>;
			 and</text>
						</clause><clause id="H8808DBB9BD72419DAE2EA48A39B4A512"><enum>(ii)</enum><text>in
			 the matter following subparagraph (E)—</text>
							<subclause id="H653D4FF25B1442C19B4999A700D619E8"><enum>(I)</enum><text>by inserting
			 <quote>(or domestic partner or former domestic partner)</quote> after
			 <quote>spouse or former spouse</quote>; and</text>
							</subclause><subclause id="H9D1FC89352E0463DA8A29769931C0ABF"><enum>(II)</enum><text>by striking
			 <quote>spouse, former spouse, or child</quote> and inserting <quote>spouse or
			 former spouse (or domestic partner or former domestic partner) or
			 child,</quote>; and</text>
							</subclause></clause></subparagraph><subparagraph display-inline="no-display-inline" id="HF49B8A4230574F38881FFC0F6904C58A"><enum>(D)</enum><text>in paragraph (4),
			 by striking <quote>marriage, then, if such marriage</quote> and inserting
			 <quote>marriage, then, if such marriage (or a domestic partnership, then, if
			 such domestic partnership)</quote>;</text>
					</subparagraph></paragraph><paragraph id="HFF202E5DE11441D5AAC143670C0156A7"><enum>(5)</enum><text>by striking
			 subsection (f) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HF9CF4E096C5F49B49DBF04BD1A86DBE7" style="USC">
						<subsection id="H8ACFD0BF917941D7BB25DE5DD304205E"><enum>(f)</enum><text display-inline="yes-display-inline">If a Member heretofore or hereafter
				separated from the service with title to deferred annuity from the Fund
				hereafter dies before having established a valid claim for annuity and is
				survived by a spouse to whom married (or a domestic partner to whom in a
				domestic partnership) at the date of separation, the surviving spouse (or
				surviving partner)—</text>
							<paragraph id="H7F56EF40214445FAA28699DCE43AE68E"><enum>(1)</enum><text display-inline="yes-display-inline">is entitled to an annuity equal to 55
				percent of the deferred annuity of the Member commencing on the day after the
				Member dies and terminating on the last day of the month before the surviving
				spouse dies or remarries (or the surviving domestic partner dies or enters into
				a subsequent domestic partnership); or</text>
							</paragraph><paragraph id="HD95B8DF165934B3993278E33DC29A2BE"><enum>(2)</enum><text>may elect to
				receive the lump-sum credit instead of annuity if the spouse (or domestic
				partner) is the individual who would be entitled to the lump-sum credit and
				files application therefor with the Office before the award of the
				annuity.</text>
							</paragraph><continuation-text continuation-text-level="subsection">Notwithstanding the preceding
				sentence, an annuity payable under this subsection to the surviving spouse (or
				surviving domestic partner) of a Member may not exceed the difference
				between—</continuation-text><paragraph id="HF563A908C1A848B392597D92A609D044"><enum>(A)</enum><text>the annuity which
				would otherwise be payable to such surviving spouse (or such surviving domestic
				partner) under this subsection, and</text>
							</paragraph><paragraph id="H7B2A6A5DAE164F6C8D7CFB2355E017A0"><enum>(B)</enum><text>the amount of the
				survivor annuity payable to any former spouse (or any former domestic partner)
				of such Member under subsection
				(h).</text>
							</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H4D8734B821AF40C588CEAA4B2B330BF6"><enum>(6)</enum><text>by striking
			 subsection (g) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H383D550808744E69A4867A8B16B3CAD5" style="USC">
						<subsection id="HE11953D48B494888B0989DECE058F88D"><enum>(g)</enum><text display-inline="yes-display-inline">In the case of a surviving spouse (or
				surviving domestic partner) whose annuity under this section is terminated
				because of remarriage (or entry into a subsequent domestic partnership) before
				becoming 55 years of age, annuity at the same rate shall be restored commencing
				on the day the remarriage (or subsequent domestic partnership) is dissolved by
				death, annulment, or divorce (or terminated), if—</text>
							<paragraph id="HFC5FE8DCCC274C1F89C605B0825F68D5"><enum>(1)</enum><text display-inline="yes-display-inline">the surviving spouse (or surviving domestic
				partner) elects to receive this annuity instead of a survivor benefit to which
				he may be entitled, under this subchapter or another retirement system for
				Government employees, by reason of the remarriage (or subsequent domestic
				partnership); and</text>
							</paragraph><paragraph id="H59FF119198B94790887CD649A5FED5E4"><enum>(2)</enum><text>any lump sum paid
				on termination of the annuity is returned to the
				Fund.</text>
							</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H7C0B5D0523E74EAA9861071EEA08EC5E"><enum>(7)</enum><text>by striking
			 subsection (h) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HB93F9C2DF81A43FD934F921D580876C8" style="USC">
						<subsection id="H20642976CDD747E29C1D97FDF9AB3361"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HE16713E6319F4916B85DE223542D21D2"><enum>(1)</enum><text display-inline="yes-display-inline">Subject to paragraphs (2) through (5), a
				former spouse (or former domestic partner) of a deceased employee, Member,
				annuitant, or former Member who was separated from the service with title to a
				deferred annuity under section 8338(b) is entitled to a survivor annuity under
				this subsection, if and to the extent expressly provided for in an election
				under section 8339(j)(3), or in the terms of any decree of divorce or annulment
				or any court order or court-approved property settlement agreement incident to
				such decree.</text>
							</paragraph><paragraph id="H67C49CFDEFFF4BA585435E6021E90F94" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HEF0BBC99D06C434198124482D62BE835"><enum>(A)</enum><text display-inline="yes-display-inline">The annuity payable to a former spouse (or
				former domestic partner) under this subsection may not exceed the difference
				between—</text>
									<clause id="H4DA49EE5B019447DBA6B22C92E2F85A8" indent="up1"><enum>(i)</enum><text>the amount applicable in the case of
				such former spouse (or former domestic partner), as determined under
				subparagraph (B), and</text>
									</clause><clause id="H0999530BC25A40CDB32DA913C34B00D0" indent="up1"><enum>(ii)</enum><text>the amount of any annuity payable
				under this subsection to any other former spouse (or former domestic partner)
				of the employee, Member, or annuitant, based on an election previously made
				under section 8339(j)(3), or a court order previously issued.</text>
									</clause></subparagraph><subparagraph id="HD887AB036E3A49299E000656E1404D23" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The applicable amount, for purposes of
				subparagraph (A)(i) in the case of a former spouse (or former domestic
				partner), is the amount which would be applicable—</text>
									<clause id="HF860E6F693AF46C1973146589FE1D163"><enum>(i)</enum><text>under subsection (b)(4)(A) in the case
				of a widow or widower (or surviving partner), if the deceased was an employee
				or Member who died after retirement;</text>
									</clause><clause id="H1AB895217EF24EBEB01F44CA39C2C996"><enum>(ii)</enum><text>under subparagraph (A) of subsection
				(d) in the case of a widow or widower (or surviving partner), if the deceased
				was an employee or Member described in the first sentence of such subsection;
				or</text>
									</clause><clause commented="no" id="HCF7A2DD693BA4694B727B44C9805F7D4"><enum>(iii)</enum><text display-inline="yes-display-inline">under subparagraph (A) of subsection (f) in
				the case of a surviving spouse (or surviving domestic partner), if the deceased
				was a Member described in the first sentence of such subsection.</text>
									</clause></subparagraph></paragraph><paragraph id="H962249BF61DE4E44B5E53DD92B585B21" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The commencement and termination of an
				annuity payable under this subsection shall be governed by the terms of the
				applicable order, decree, agreement, or election, as the case may be, except
				that any such annuity—</text>
								<subparagraph id="H5FEA785D47CD4D3FA63FD6491EACDB55"><enum>(A)</enum><text display-inline="yes-display-inline">shall not commence before—</text>
									<clause id="H04D8446C7C9148118CB58A3C8A5EFBF7"><enum>(i)</enum><text>the day after the employee, Member,
				or annuitant dies, or</text>
									</clause><clause id="HDB8FBF02B6E44BAD9C9E2C9C9F5F8B2E"><enum>(ii)</enum><text>the first day of the second month
				beginning after the date on which the Office receives written notice of the
				order, decree, agreement, or election, as the case may be, together with such
				additional information or documentation as the Office may prescribe,</text>
									</clause><continuation-text continuation-text-level="subparagraph">whichever is later, and</continuation-text></subparagraph><subparagraph id="H18640082D6D44B8FB87BA821A280F11F"><enum>(B)</enum><text display-inline="yes-display-inline">shall terminate—</text>
									<clause id="HABE3C290272E4BF290CC129F115920E5"><enum>(i)</enum><text>except as provided in subsection
				(k), in the case of an annuity computed by reference to clause (i) or (ii) of
				paragraph (2)(B), no later than the last day of the month before the former
				spouse remarries (or former domestic partner enters into a subsequent domestic
				partnership) before becoming 55 years of age or dies; or</text>
									</clause><clause id="HF0E1B5CA021F4712A05DB172C3A47CF1"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of an annuity computed by
				reference to clause (iii) of such paragraph, no later than the last day of the
				month before the former spouse remarries or dies (or the former domestic
				partner enters into a subsequent domestic partnership or dies).</text>
									</clause></subparagraph></paragraph><paragraph id="H0A9F0FF7AECE48A4B675B3DCE9AEA884" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">For purposes of this subchapter, a
				modification in a decree, order, agreement, or election referred to in
				paragraph (1) shall not be effective—</text>
								<subparagraph id="HAC6E8C4E845540BFBFFF86B5067A91DC"><enum>(A)</enum><text>if such modification is made after the
				retirement or death of the employee or Member concerned, and</text>
								</subparagraph><subparagraph id="HEF593D88B037449197EF66740864440E"><enum>(B)</enum><text>to the extent that such modification
				involves an annuity under this subsection.</text>
								</subparagraph></paragraph><paragraph id="HFBBE831B05724FEE8439D3C0B1769B0F" indent="up1"><enum>(5)</enum><text>For purposes of this subchapter, a
				decree, order, agreement, or election referred to in paragraph (1) shall not be
				effective, in the case of a former spouse (or former domestic partner), to the
				extent that it is inconsistent with any joint designation or waiver previously
				executed with respect to such former spouse (or former domestic partner) under
				section 8339(j)(1) or a similar prior provision of law.</text>
							</paragraph><paragraph id="H9E6CB86F5D2A451D81B823736F9661A7" indent="up1"><enum>(6)</enum><text>Any payment under this subsection to
				a person bars recovery by any other person.</text>
							</paragraph><paragraph id="HD8CCAE8F1C164134A2DB4EB167D193B9" indent="up1"><enum>(7)</enum><text>As used in this subsection,
				<term>court</term> means any court of any State, the District of Columbia, the
				Commonwealth of Puerto Rico, Guam, the Northern Mariana Islands, or the Virgin
				Islands, and any Indian
				court.</text>
							</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H5C6154566B21406783DB8FAF13D07448"><enum>(8)</enum><text>by striking
			 subsection (i) and inserting the following:</text>
					<quoted-block id="HCFFDC7AFF9BB42EB96E724398BF22858" style="OLC">
						<subsection id="HC8DCF6B4A53F4F83B197DF323633BD8F"><enum>(i)</enum><text>The requirement in
				subsections (a)(1)(A), (a)(2)(A), and (a)(5)(A) that the surviving spouse (or
				surviving domestic partner) of an employee or Member have been married to (or
				in a domestic partnership with) such employee or Member for at least 9 months
				immediately before the employee’s or Member’s death in order to qualify as the
				widow or widower (or surviving partner) of such employee or Member shall be
				deemed satisfied in any case in which the employee or Member dies within the
				applicable 9-month period, if—</text>
							<paragraph id="HBC63C1497BDE4EE6965C785F688DF930"><enum>(1)</enum><text>the death of the
				employee or Member was accidental; or</text>
							</paragraph><paragraph id="H00635FA4210C4C4EB40525C3C02C9E77"><enum>(2)</enum><text>the surviving
				spouse (or surviving domestic partner) of such individual had been previously
				married to (or in a domestic partnership with) the individual that was
				subsequently dissolved (or terminated), and the aggregate time married (or in a
				domestic partnership) is at least 9
				months.</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H8784892FE67043A19340473624430495"><enum>(9)</enum><text>by redesignating
			 subsection (k) as subsection (j) and amending such subsection to read as
			 follows:</text>
					<quoted-block id="H0CACB686700247A7B20051E3A2416282" style="OLC">
						<subsection id="H270BA541FD0D472FA5550228FB04B5D6"><enum>(j)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H31F6D01D9C8F4B619ABDD5AE7067E780"><enum>(1)</enum><text>Subsections (b)(3)(B),
				(d)(ii), and (h)(3)(B)(i), to the extent that they provide for termination of a
				survivor annuity because of a remarriage (or entry into a subsequent domestic
				partnership) before age 55, shall not apply if the widow, widower or former
				spouse was married to (or the surviving partner or former domestic partner was
				in a domestic partnership with) the individual on whose service the survivor
				annuity is based for at least 30 years.</text>
							</paragraph><paragraph id="H695F24FE560549618DDF7AAF2378BBA3" indent="up1"><enum>(2)</enum><text>A remarriage (or entry into a
				subsequent domestic partnership) described in paragraph (1) shall not be taken
				into account for purposes of subparagraph (B) or (C) of section 8339(j)(5) or
				any other provision of this chapter which the Director of the Office of
				Personnel Management may by regulation identify in order to carry out the
				purposes of this
				subsection.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section display-inline="no-display-inline" id="H5F6ED7AEC8A049838447713565A3E07F" section-type="subsequent-section"><enum>206.</enum><header>Lump-sum benefits;
			 designation of beneficiary; order of precedence</header><text display-inline="no-display-inline">Section 8342 is amended—</text>
				<paragraph id="H8138F45DFB734BD288F5B079DDE6585E"><enum>(1)</enum><text>in subsection (c),
			 by inserting <quote>(or surviving partner)</quote> after <quote>widow or
			 widower</quote> ; and</text>
				</paragraph><paragraph id="HC30EB9580322430F85D31E850D9BCC93"><enum>(2)</enum><text>in subsection
			 (j)—</text>
					<subparagraph id="H67853FCAEEB14B5DA536652FD60666FD"><enum>(A)</enum><text>in paragraph
			 (1)(A), by inserting <quote>(or the domestic partner, if any, and any former
			 domestic partner)</quote> after <quote>the spouse, if any, and any former
			 spouse</quote>; and</text>

				made by the employee or Member under section 8420 with respect to such
				individual; or</text>
									</subparagraph><subparagraph id="H1EE9C88E00824ACDA632190464236F16"><enum>(B)</enum><text>shall, if an election was made by the
				employee or Member under section 8420 with respect to a different individual,
				prospectively void such election if appropriate written application is made by
				such employee or Member at the time of making the election under this
				subsection.</text>
									</subparagraph></paragraph><paragraph id="HC26B6CEF0AE94AD3B41A79D22D366B9B" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Any election under this subsection made by
				an employee or Member on behalf of an individual after the retirement of such

				of providing a survivor annuity for a former spouse (or former domestic
				partner) of a retired employee or Member shall be terminated for each full
				month after the former spouse remarries (or the former domestic partner enters
				into a subsequent domestic partnership) before reaching age 55 or dies. This
				reduction shall be replaced by appropriate reductions under subsection (a) if
				the retired employee or Member has—</text>

				domestic partner) who is entitled to a survivor annuity under section

				current spouse to whom the employee or Member was married (or a current
				domestic partner with whom the employee or Member was in a domestic
				partnership) at the time of retirement and with respect to whom a survivor
				annuity was not waived under section 8416(a) or, if waived, with respect to
				whom an election under section 8416(d) has been made; or</text>

				portion of a survivor annuity under section 8341(h) or 8445 (or benefits
				similar to either of the aforementioned annuity benefits under a retirement
				system for Government employees other than the Civil Service Retirement System
				or the Federal Employees’ Retirement System),</text>

			 transferred</header>
				<subsection commented="no" id="H938B17F70AB246F19DA82E93D7C9AF0F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 5724b(a) is
			 amended—</text>

			 work injuries</header>
			<section id="H623F7F2410E649808C260D16EAF2254D"><enum>601.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 8101 is amended—</text>

			 by inserting <quote>children (including adopted children) of a domestic

				consistent with the requirements that—</text>
							<subparagraph id="H42ADB44A3E0646898AF4698B9CC3A4D8"><enum>(A)</enum><text>both individuals
				are at least 18 years of age and competent to contract;</text>
							</subparagraph><subparagraph id="HB4646BFE82354EBC8E64040BE57C41F7"><enum>(B)</enum><text>both individuals
				intend to remain in the domestic partnership indefinitely;</text>
							</subparagraph><subparagraph id="H6445D48ED1E342A3A9DF5ABE903BC08B"><enum>(C)</enum><text>such
				individuals—</text>
								<clause id="HC2BF62ACFD114F0ABA1E260FA0B14CC0"><enum>(i)</enum><text>have a common
				residence; or</text>
								</clause><clause id="HB80835DF2B0942E1A2D65CAEE72ACD1E"><enum>(ii)</enum><text>do not have a
				common residence because of financial, employment-related, or other
				reasons;</text>
								</clause></subparagraph><subparagraph id="HBDA6E167A7574190AB1A10449CA9F38C"><enum>(D)</enum><text>neither individual
				is married to or in a domestic partnership with anyone outside of the domestic
				partnership referred to in subparagraph (B);</text>
							</subparagraph><subparagraph id="HCD6288122960464892D05DA0874CD88A"><enum>(E)</enum><text>the 2 individuals
				share responsibility for a significant measure of each other’s common welfare
				and financial obligations;</text>
							</subparagraph><subparagraph id="H2E2520F24ACE43D0B034A5A3D57000A5"><enum>(F)</enum><text>the 2 individuals
				are not related in a way that, if they were of the opposite sex, would prohibit
				legal marriage in the jurisdiction in which either of them resides;</text>
							</subparagraph><subparagraph id="H01C9DA58DD8D42139F762A9F94A0D1A5"><enum>(G)</enum><text>at least 1 of them
				is an employee or an individual otherwise eligible for coverage under this
				subchapter based on such individual’s employment or other service; and</text>
							</subparagraph><subparagraph id="HD9B2C585ED9C4753A70EF705747CAFC1"><enum>(H)</enum><text>both individuals
				understand that willful falsification of information within the affidavit or
				failure to provide appropriate notification of the termination of the domestic
				partnership may lead to the recovery of the amounts obtained as a result of
				such falsification or failure (as the case may be), criminal or other
				penalties, and (in appropriate circumstances) disciplinary action; and</text>
							</subparagraph></paragraph><paragraph id="H16C6582706E247ACAF6A6B0C4F4FA7E5"><enum>(22)</enum><text><term>surviving
				partner</term> means the domestic partner living with or dependent for support
				on the decedent at the time of his or her death, or living apart for reasonable
				cause or because of his or her
				desertion.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H407549DEE3AC491CA929AB0EF61CBCE3"><enum>602.</enum><header>Death gratuity
			 for injuries incurred in connection with employee’s service with an Armed
			 Force</header><text display-inline="no-display-inline">Section 8102a(d) is
			 amended—</text>

			 right to receive compensation</header><text display-inline="no-display-inline">Section 8116(c) is amended by striking

						</clause></subparagraph></paragraph></section><section id="HF4924D3CB1F14A62902AD3D8B5A60828"><enum>607.</enum><header>Lump-sum
			 payment</header><text display-inline="no-display-inline">Section 8135(b) is
			 amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H5CAFDB2974A64A4BB432268B52E1730F" style="USC">
					<subsection id="H48A2948782AE4072B8FBEEE65D2FE3E2"><enum>(b)</enum><text display-inline="yes-display-inline">On remarriage (or entry into a subsequent
				domestic partnership) before reaching age 55 a widow or widower (or surviving
				partner) entitled to compensation under section 8133 of this title, shall be
				paid a lump sum equal to twenty-four times the monthly compensation payment
				(excluding compensation on account of another individual) to which that
				individual was entitled immediately before the remarriage (or subsequent
				domestic partnership).</text>
					</subsection><after-quoted-block>.
				</after-quoted-block></quoted-block>
			</section><section id="H6EFAFD38A3954C0AA46694050BA040AF"><enum>608.</enum><header>Regulations</header>
				<subsection id="H334EA79F375C4A45A6239ED91FC0BBC0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Labor may prescribe regulations to carry out this title and the amendments made
			 by this title.</text>
				</subsection><subsection id="H9F94BF95040B41E5BF10F4B188180F60"><enum>(b)</enum><header>Consultation</header><text>The
			 Secretary of Labor shall consult with the Director of the Office of Personnel
			 Management and the heads of any other agencies whose programs are affected by
			 this Act in order to standardize, to the extent possible, the process for
			 establishing the existence of a domestic partnership under each such
			 program.</text>
				</subsection></section><section id="HB179CB6AA66B4BE1BAE03A138BD5F315"><enum>609.</enum><header>Effective
			 date</header>
				<subsection id="H7BC490579EC94C19A2E7075D528DC374"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to succeeding
			 provisions of this section, this title and the amendments made by this
			 title—</text>
					<paragraph id="HBA0173E0AB2141FC8EC92FD756AFA8C7"><enum>(1)</enum><text>shall take effect
			 on the date of enactment of this Act; and</text>
					</paragraph><paragraph id="H7F068CC89681457EB45B0D5CF635214F"><enum>(2)</enum><text>shall apply with
			 respect to any injury or death occurring before, on, or after such date of
			 enactment.</text>
					</paragraph></subsection><subsection id="H15CAA8B134C64D4B9D30EB9D7DF1FF04"><enum>(b)</enum><header>Timely claim
			 required; limitation on payments</header><text>No compensation shall be
			 payable, by virtue of the enactment of this title—</text>
					<paragraph id="H0A3B9CCEDAEC4E21B0BD30B1594B648E"><enum>(1)</enum><text>unless timely
			 claim therefor is filed in accordance with the provisions of sections 8122 or
			 8193 of title 5, United States Code (as applicable), and subsection (c);
			 or</text>
					</paragraph><paragraph id="H4F89AB581B51444C8D835C9A4E5A5058"><enum>(2)</enum><text>with respect to
			 any period commencing before the date of enactment of this Act.</text>
					</paragraph></subsection><subsection id="HC9188514CF6345CBBFA29511FCCFAF29"><enum>(c)</enum><header>Allowability of
			 claims</header><text>In the case of an original claim for compensation for a
			 disability or death that occurred before the date of enactment of this Act (and
			 which would not otherwise be payable, but for the enactment of the amendments
			 made by this title)—</text>
					<paragraph id="HE369FBBB1CA3464CB046421401B5CF75"><enum>(1)</enum><text>such claim shall
			 not be allowed if, as of such date of enactment, a claim based on such
			 disability or death would no longer be timely (determined in accordance with
			 such section 8122 or 8193 (as applicable), before the application of paragraph
			 (2)); and</text>
					</paragraph><paragraph id="H919C8763D2034F6DAD2BA31569E1B684"><enum>(2)</enum><text>the timeliness of
			 any such claim, if not precluded by paragraph (1), shall be determined—</text>
						<subparagraph id="HCF8C4878C5014FCBA97661B8F0C58685"><enum>(A)</enum><text>by applying the
			 provisions of such section 8122 or 8193 (as applicable); and</text>
						</subparagraph><subparagraph id="HBE8C877BCDC044A99938CDB9A39DDD08"><enum>(B)</enum><text>as if the time
			 limitations of such section 8122 or 8193 (as applicable) did not begin to run
			 until the date on which implementing regulations under section 608 become
			 effective.</text>
						</subparagraph></paragraph></subsection><subsection id="H75CBEB5CB6EF445EA791255B62A8A2E7"><enum>(d)</enum><header>Payments for
			 prior periods not affected</header><text>No recovery shall be made of
			 compensation paid to any individual whose entitlement to compensation is
			 terminated or reduced as a result of the enactment of this title.</text>
				</subsection></section></title><title id="H21C8F911A4884C749358ABF20681F5DD"><enum>VII</enum><header>Provisions
			 relating to employment of relatives and other matters </header>

			 captives</header><text display-inline="no-display-inline">Section 5569(j) is
			 amended by adding at the end the following: <quote>Such regulations shall
			 include provisions to ensure that, in the administration of this section, a
			 domestic partner shall be afforded the same status as a spouse.</quote>.</text>
			</section><section id="HA144D50219E0436B9F61C0A6C3A57718"><enum>704.</enum><header>Compensation
			 for disability or death</header><text display-inline="no-display-inline">Section 5570 is amended by adding at the end
			 the following:</text>

				domestic partner shall be afforded the same status as a
				spouse.</text>

			</section><section id="H4C64906ACF7E4EB0ACA9EF3D064A5E58"><enum>705.</enum><header>Family and
			 medical leave</header>
				<subsection id="HB24680A1FD9145A0B93400046647328E"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 6381(6) is amended (in the matter
			 before subparagraph (A)), by inserting <quote>or a biological, adopted, or
			 foster child of the domestic partner of the employee,</quote> before <quote>who
			 is</quote>.</text>

					</subparagraph><subparagraph commented="no" id="H08B8E12D271A40B99761E84AFEB72D86"><enum>(B)</enum><text>section 1599b of
			 title 10, United States Code;</text>
					</subparagraph></paragraph><paragraph id="HB56F42C4C3CB4C328DEEA614D317525E"><enum>(3)</enum><text>benefits for
			 members of the commissioned officer corps of the National Oceanic and
			 Atmospheric Administration, as provided for under—</text>
					<subparagraph id="H147890380D7B443D918E0473BEC4D8E7"><enum>(A)</enum><text>section 261 of the
			 National Oceanic and Atmospheric Administration Commissioned Officer Corps Act
			 of 2002 (33 U.S.C. 3071); or</text>
					</subparagraph><subparagraph id="HEC091DC6541A44B38592B88F2D5C27E9"><enum>(B)</enum><text>any other
			 provisions of title 10, United States Code (apart from those made applicable by
			 the provision of law cited in subparagraph (A)); and</text>
					</subparagraph></paragraph><paragraph id="HBFD3BB83BA8948DD98CFDF2097F5EFB1"><enum>(4)</enum><text>benefits, provided
			 for under any other provisions of law, which (as determined by the President or
			 a designee)—</text>
					<subparagraph id="H868D6DF208C84FD8B8957F84A39DE910"><enum>(A)</enum><text>relate to
			 employees or annuitants (as those terms are defined by section 2110 of title 5,
			 United States Code); and</text>
					</subparagraph><subparagraph id="HD9EDB693A380426692D4A239D9DE6F88"><enum>(B)</enum><text>are necessary to
			 carry out the purposes of this Act with respect to benefits.</text>
					</subparagraph></paragraph></section><section id="HB24956508619471699784DEA983F99F0"><enum>802.</enum><header>Regulations</header><text display-inline="no-display-inline">The President (or designee) shall prescribe
			 any regulations necessary to ensure that the provisions of law identified in or
			 under section 801 are administered in a manner consistent with the purposes of
			 this Act.</text>
			</section></title><title commented="no" id="H3670BE5349244F2BB00D48E4E633551C"><enum>IX</enum><header>Amendment to the
			 Ethics in Government Act of 1978</header>
			<section commented="no" id="HF9320572CE014AD18252DBE96457FFDB"><enum>901.</enum><header>Amendment to
			 the Ethics in Government Act of 1978</header><text display-inline="no-display-inline">The Ethics in Government Act of 1978 (5
			 U.S.C. App.) is amended by adding at the end of title I the following:</text>
				<quoted-block display-inline="no-display-inline" id="H97C70D81E54E42CAA086635909354282" style="traditional">
					<section commented="no" id="HE8FE359807CB412DA44AFA6226C522EB"><enum>112.</enum><header>Domestic partners</header><subsection commented="no" display-inline="yes-display-inline" id="H025ECC567E8C4A8D83B0E538FD667367"><enum>(a)</enum><text display-inline="yes-display-inline">An employee, former employee, or annuitant
				and the domestic partner of such employee, former employee, or annuitant (as
				the case may be) shall be subject to the provisions of law cited in subsection
				(b) to the same extent and in the same manner as in the case of a married
				employee, former employee, or annuitant and the spouse of such employee, former
				employee, or annuitant (as the case may be).</text>
						</subsection><subsection commented="no" id="H3A778D7DBD784A7C91740819F94B2C49"><enum>(b)</enum><text>The provisions of
				law cited in this subsection are as follows:</text>
							<paragraph commented="no" id="HF2B9F2810A9741B09218A541F1638FAC"><enum>(1)</enum><text>The preceding
				provisions of this title (relating to financial disclosure requirements of
				Federal personnel) and the provisions of title V (relating to Government-wide
				limitations on outside earned income and employment).</text>
							</paragraph><paragraph commented="no" id="HA54D8701CEBC487286BBC3F3C6348712"><enum>(2)</enum><text>Regulations
				prescribed under section 7301 of title 5, United States Code (relating to
				regulations for the conduct of employees in the executive branch).</text>
							</paragraph><paragraph commented="no" id="H51FD9FB86C2348B7B0B31055A845EB6C"><enum>(3)</enum><text>Section 7351 of
				title 5, United States Code (relating to gifts to superiors).</text>
							</paragraph><paragraph commented="no" id="H4D63BF536AA749038B336E0080D9C102"><enum>(4)</enum><text>Section 7353 of
				title 5, United States Code (relating to gifts to Federal employees).</text>
							</paragraph><paragraph commented="no" id="H0470DA4EC7DA42E184AB5276B0A67B1F"><enum>(5)</enum><text>Chapter 11 of
				title 18, United States Code (relating to bribery, graft, and conflicts of
				interest).</text>
							</paragraph><paragraph commented="no" id="HF16E412FBF73490DA69DB66660DFCD59"><enum>(6)</enum><text>Section 7342 of
				title 5, United States Code (relating to receipt and disposition of foreign
				gifts and decorations).</text>
							</paragraph><paragraph commented="no" id="H389A9634A32C4693A2F599EA23B7013B"><enum>(7)</enum><text>Section 1353 of
				title 31, United States Code (relating to acceptance of travel and related
				expenses from non-Federal sources).</text>
							</paragraph><paragraph commented="no" id="HE15D982C912C48BD932F8D736ED923D6"><enum>(8)</enum><text>Sections 4941 and
				4946 of the Internal Revenue Code of 1986 (relating to taxes on self-dealing
				and definitions and special rules).</text>
							</paragraph><paragraph id="H11142A23FE254551B6FF5F386B9C65C7"><enum>(9)</enum><text display-inline="yes-display-inline">Section 455 of title 28, United States Code
				(relating to disqualification of justice, judge, or magistrate judge).</text>
							</paragraph></subsection><subsection commented="no" id="H9AF284E7D3424EDBAD1B72F14C8787B3"><enum>(c)</enum><text display-inline="yes-display-inline">For purposes of this section, the term
				<term>domestic partner</term> has the meaning given such term by section 2110
				of title 5, United States
				Code.</text>

			</section></title><title id="HAD8FDC0F529F4743B59CA4FD074812C8"><enum>X</enum><header>Reporting
			 requirements</header>
			<section id="H03DDC7A388C44FFEB7DA5E82486E72C5"><enum>1001.</enum><header>Report of the
			 president</header><text display-inline="no-display-inline">Not later than 6
			 months after the date of the enactment of this Act, the President shall
			 transmit to the Committee on Oversight and Government Reform of the House of
			 Representatives and the Committee on Homeland Security and Governmental Affairs
			 of the Senate—</text>
				<paragraph id="H6177945747524FFF83E9BAC06CCF5690"><enum>(1)</enum><text>a
			 report on the implementation of this Act, including the amendments made by this
			 Act; and</text>
				</paragraph><paragraph id="HC34EEE3E05FE4293BF5A1B70133DE57F"><enum>(2)</enum><text>a
			 description of any further measures that should be taken in order to carry out
			 the purposes of this Act, including recommendations for any legislation or
			 administrative action that may be necessary.</text>
				</paragraph></section><section id="HC384154AB9494789933993EF2E09D7D6"><enum>1002.</enum><header>GAO
			 report</header><text display-inline="no-display-inline">Not later than 2 years
			 after the date of the enactment of this Act, the Government Accountability
			 Office shall transmit to the Committee on Oversight and Government Reform of
			 the House of Representatives and the Committee on Homeland Security and
			 Governmental Affairs of the Senate a report on the effect that this Act and any
			 amendments made by this Act have had on premiums or any other periodic charges
			 payable by enrollees under chapter 89 of title 5, United States Code (relating
			 to the Federal employees health benefits program), and the impact of extending
			 benefits to domestic partners on the employee retention and recruitment efforts
			 by the Federal government.</text>
