		<section id="HD4675DA828CF4840A979DF76DA1F240A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Counterfeit Drug Penalty Enhancement
			 Act of 2011</short-title></quote>.</text>
		</section><section id="H7DF0190AB6A64003A2C97BF0C0E22C6D"><enum>2.</enum><header>Counterfeit drug
			 prevention</header><text display-inline="no-display-inline">Section 2320(a) of
			 title 18, United States Code, is amended—</text>
			<paragraph id="HA69E9E1184F14258ACCAAB7F7212D0FB"><enum>(1)</enum><text>by redesignating
			 paragraph (2) as paragraph (3);</text>
			</paragraph><paragraph id="HCC09B5F8CB6A4C079DE42B94C785D60E"><enum>(2)</enum><text>by inserting after
			 paragraph (1) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H83871280A3DC4255AC24213484D1256A" style="OLC">
					<paragraph id="HC2CDBBA3C4FB4B3B95293C35B342922E"><enum>(2)</enum><header>Counterfeit
				drugs</header>
						<subparagraph id="H961388CAD0D44CB7BE2E6EF092DEB0BE"><enum>(A)</enum><header>In
				general</header><text>Whoever commits an offense in violation of paragraph (1)
				with respect to a drug (as defined in section 201 of the Federal Food, Drug,
				and Cosmetic Act (21 U.S.C. 321)) shall—</text>
							<clause id="H1E18F5402DC44D2EB50C4A8877B21CA8"><enum>(i)</enum><text>if
				an individual, be fined not more than $4,000,000, imprisoned for life or for
				any term of years, or both; and</text>
							</clause><clause id="H93FE3DD0A3A341D58B0C81D21038C308"><enum>(ii)</enum><text>if a person other
				than an individual, be fined not more than $10,000,000.</text>
							</clause></subparagraph><subparagraph id="H5A1D527C5D2746FFB4C44B0C0E04586D"><enum>(B)</enum><header>Multiple
				offenses</header><text>In the case of an offense by a person under this
				paragraph that occurs after that person is convicted of another offense under
				this paragraph, the person convicted—</text>
							<clause id="HB24BD3869E744312938272FE517F2591"><enum>(i)</enum><text>if
				an individual, shall be fined not more than $8,000,000, imprisoned for life or
				for any term of years, or both; and</text>
							</clause><clause id="H34C596152F1C4173B7A1B68D485F7D6C"><enum>(ii)</enum><text>if other than an
				individual, shall be fined not more than
				$20,000,000.</text>
							</clause></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HA389D6BF510B4BD992EDF06B3BE6CD5E"><enum>(3)</enum><text>in paragraph
			 (3)(B), as redesignated, by striking <quote>paragraph (1)</quote> and inserting
			 <quote>paragraph (1) or (2)</quote>.</text>
			</paragraph></section><section id="HE8478ACE60C3490E978DDAB02DEA730A"><enum>3.</enum><header>Rule of
			 construction</header><text display-inline="no-display-inline">Nothing in this
			 Act, or the amendments made by this Act, shall be construed to apply to a drug
			 (as defined in section 201 of the Federal Food, Drug, and Cosmetic Act (21
			 U.S.C. 321)) solely because the drug is manufactured in or imported from a
			 foreign country.</text>
