		  Chief of the National Guard Bureau as a member of the Joint Chiefs of Staff and
		  to reestablish the position of Vice Chief of the National Guard

			 the National Guard Bureau on the Joint Chiefs of Staff</header>
			<subsection commented="no" display-inline="no-display-inline" id="H4439B3EE139B4AB9AE243D30AEE80B7D"><enum>(a)</enum><header>Membership on
			 Joint Chiefs of Staff</header><text>Section 151(a) of title 10, United States
			 Code, is amended by adding at the end the following new paragraph:</text>

					<paragraph commented="no" display-inline="no-display-inline" id="H1D9E52A5EB244373B0B241BC798A1B0F"><enum>(7)</enum><text display-inline="yes-display-inline">The Chief of the National Guard
				Bureau.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H464E5E9AFC7942A88D2B8219911A7655"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 10502 of such title, as amended by section
			 2(b)(1) of this Act, is further amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HF6CB399EEF7F45B3B170344FAC63C115"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (d) as
			 subsection (e); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H764595B5D0D247B9AD08899ED8E2355A"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (c) the
			 following new subsection (d):</text>

				Chiefs of Staff</header><text display-inline="yes-display-inline">The Chief of
				the National Guard Bureau shall perform the duties prescribed for him or her as
				a member of the Joint Chiefs of Staff under section 151 of this
				title.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H5933C8C7FA6A479DA8E8EAADF47DBE5A" section-type="subsequent-section"><enum>2.</enum><header>Reestablishment of
			 position of Vice Chief of the National Guard Bureau and termination of position
			 of Director of the Joint Staff of the National Guard Bureau</header>
			<subsection id="H3337B0E21E9A4D579A124BC6D3D7123B"><enum>(a)</enum><header>Reestablishment
			 and termination of positions</header><text>Section 10505 of title 10, United
			 States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H3841467267294338AD8BCEF8C59B8586" style="USC">
					<section id="HCA29BB5173774F5F9DF1B898672B98A8"><enum>10505.</enum><header>Vice Chief of
				the National Guard Bureau</header>
						<subsection id="HE214B4911AF14B45B3D43D1CDA117351"><enum>(a)</enum><header>Appointment</header><paragraph commented="no" display-inline="yes-display-inline" id="HB40A81E5B3C8443E950C6AE5E4C42D52"><enum>(1)</enum><text display-inline="yes-display-inline">There is a Vice Chief of the National Guard
				Bureau, selected by the Secretary of Defense from officers of the Army National
				Guard of the United States or the Air National Guard of the United States
				who—</text>
								<subparagraph id="H8ACFF628057C4BD283D93C272CDCA5CE" indent="up1"><enum>(A)</enum><text>are recommended for such appointment
				by their respective Governors or, in the case of the District of Columbia, the
				commanding general of the District of Columbia National Guard;</text>
								</subparagraph><subparagraph id="H38BBEBD4934043678DD018A65B47FEF5" indent="up1"><enum>(B)</enum><text>have had at least 10 years of
				federally recognized service in an active status in the National Guard;
				and</text>
								</subparagraph><subparagraph id="H4AE0A269387341CC873985870A5B28FB" indent="up1"><enum>(C)</enum><text>are in a grade above the grade of
				brigadier general.</text>
								</subparagraph></paragraph><paragraph id="H9BF5380523FF45DF80EDE991D8E11104" indent="up1"><enum>(2)</enum><text>The Chief and Vice Chief of the
				National Guard Bureau may not both be members of the Army or of the Air
				Force.</text>
							</paragraph><paragraph id="H3FD27266D6D4470499344312A9712A70" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HAD950D87369146479813377AD552C521"><enum>(A)</enum><text>Except as provided in
				subparagraph (B), an officer appointed as Vice Chief of the National Guard
				Bureau serves for a term of four years, but may be removed from office at any
				time for cause.</text>
								</subparagraph><subparagraph id="H54F180BCF23444AB82910FACC3B6C275" indent="up1"><enum>(B)</enum><text>The term of the Vice Chief of the
				National Guard Bureau shall end within a reasonable time (as determined by the
				Secretary of Defense) following the appointment of a Chief of the National
				Guard Bureau who is a member of the same armed force as the Vice Chief.</text>
								</subparagraph></paragraph></subsection><subsection id="HF37A84EBD76B45E1B493191EE0BECEDC"><enum>(b)</enum><header>Duties</header><text>The
				Vice Chief of the National Guard Bureau performs such duties as may be
				prescribed by the Chief of the National Guard Bureau.</text>
						</subsection><subsection id="HD6AE4FCDDFE04C08BE38B2E47DDF159F"><enum>(c)</enum><header>Grade</header><text>The
				Vice Chief of the National Guard Bureau shall be appointed to serve in the
				grade of lieutenant general.</text>
						</subsection><subsection id="H58D853D2A97F4146BE14712E89EBB36E"><enum>(d)</enum><header>Functions as
				Acting Chief</header><text>When there is a vacancy in the office of the Chief
				of the National Guard Bureau or in the absence or disability of the Chief, the
				Vice Chief of the National Guard Bureau acts as Chief and performs the duties
				of the Chief until a successor is appointed or the absence of disability
				ceases.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H18386951A2CB499E951C0C92F2CB975E"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="HF1E655255B14490493C846CD6FA190DB"><enum>(1)</enum><text>Section 10502 of
			 such title is amended by striking subsection (e).</text>
				</paragraph><paragraph id="HE51E161C42D5439BB0121340A5E5EFC9"><enum>(2)</enum><text>Section
			 10506(a)(1) of such title is amended by striking <quote>and the Director of the
			 Joint Staff of the National Guard Bureau</quote> and inserting <quote>and the
			 Vice Chief of the National Guard Bureau</quote>.</text>
				</paragraph></subsection><subsection id="HAC253A65BDE94A0FB84EB40CA7900047"><enum>(c)</enum><header>Clerical
			 amendments</header>

			 amendment</header><text>The heading of section 10502 of such title is amended
			 to read as follows:</text>
