		<section id="HC80471D99C374267A4AA5308353D1586" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Partial Hospitalization Stabilization
			 and Integrity Act of 2011</short-title></quote>.</text>
		</section><section id="H059B610458F848AF908C2F6C5F89D45D"><enum>2.</enum><header>Medicare payment
			 for partial hospitalization services</header>
			<subsection id="HBA3750720D5D46468F17DCE6E5484B0E"><enum>(a)</enum><header>Establishment of
			 new payment methodology</header><text display-inline="yes-display-inline">Section 1833 of the Social Security Act (42
			 U.S.C. 1395l) is amended—</text>
				<paragraph id="H28B6410FD38141F5B8B6532F9791DC06"><enum>(1)</enum><text>in subsection
			 (a)(2)—</text>
					<subparagraph id="HB08350C9159140919CB81E6B5624461B"><enum>(A)</enum><text>in subparagraph
			 (B), by striking <quote>or (E)</quote> and inserting <quote>(E), or
			 (I)</quote>;</text>
					</subparagraph><subparagraph id="H64CBC59F1D8245978393791BFA83E719"><enum>(B)</enum><text>in subparagraph
			 (G), by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="HC140116329F94A0D9B0A9761FAFE0189"><enum>(C)</enum><text>in subparagraph
			 (H), by striking the comma at the end and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="H3040E41E43F742AE98ADC261A58062A6"><enum>(D)</enum><text>by inserting after
			 subparagraph (H) the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="H6E93D0F8B6B049A9A5EC98A66F93357D" style="traditional">
							<subparagraph id="HC5A1E96933F443B1A605227E58725337"><enum>(I)</enum><text>with respect to
				partial hospitalization services, the amount determined under subsection
				(z);</text>
							</subparagraph><after-quoted-block>; </after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HB2AE89009B8E43A588299AB032E2FE97"><enum>(2)</enum><text>in subsection
			 (t)(2)(B)—</text>
					<subparagraph id="H7B67389D7EFB4743B217400AD8D99849"><enum>(A)</enum><text>in clause (iii),
			 by striking <quote>but</quote>;</text>
					</subparagraph><subparagraph id="HD32008B1540C454188F7A66531F03FDB"><enum>(B)</enum><text>in clause (iv), by
			 striking the period at the end and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph id="H57A18FD693F543F79DEB61673FD61E27"><enum>(C)</enum><text>by adding at the
			 end the following new clause:</text>
						<quoted-block display-inline="no-display-inline" id="HB695166FAFD14633BB5BB6CE8966BA05" style="OLC">
							<clause id="H4BD31F2916CE400F8F10E9371438A782"><enum>(v)</enum><text display-inline="yes-display-inline">does not include partial hospitalization
				services.</text>
							</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H70A4B92EFE4D4B9EB6AD3722D22A5B73"><enum>(3)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H991AC4B864444B36B4D804A3DC4BC86C" style="OLC">
						<subsection id="H9BDD635F80A7472688BF617C88F62B40"><enum>(z)</enum><header>Payment for
				partial hospitalization services</header>
							<paragraph id="HF6B84FBEBBDB4E2A8B8D9904FF760604"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				establish consistent with this subsection a payment system for partial
				hospitalization services. Such payment system shall be designed to provide for
				the same payment rates without regard to whether the services are furnished by
				a hospital or by a community mental health center, to minimize annual
				fluctuations in overall rates, and to result in an aggregate amount of payment
				under this part for such services during the first 5 years in which this
				subsection is effective equal to the aggregate amount of payment that would
				have been made under this part for such services during such period if the
				<short-title>Partial Hospitalization Stabilization and
				Integrity Act of 2011</short-title> had not been enacted.</text>
							</paragraph><paragraph id="H266D287B30AD4E6296B162670F11C685"><enum>(2)</enum><header>Description of
				system</header><text>Under such payment system—</text>
								<subparagraph id="H2FAA9C7ADE2341C4AB667EED1688BF06"><enum>(A)</enum><text>payments shall be
				made based on a per diem rate (computed consistent with subparagraph (B)) and
				subject to an annual increase (consistent with subparagraphs (C) and (D) and
				paragraph (1));</text>
								</subparagraph><subparagraph id="HD49F401779F5458CB111F4A0E78E6860"><enum>(B)</enum><text>the base per diem
				rate for services furnished in 2011 under this subparagraph shall be deemed to
				be $238.33 for partial hospitalization services (including mental health
				services composite), $82.73 with respect to brief individual psychotherapy,
				$113.05 for extended individual psychotherapy, $128.82 for extended individual
				psychotherapy, and $54.87 for group psychotherapy;</text>
								</subparagraph><subparagraph id="H18F6A7017777438DBE31F0219B4052ED"><enum>(C)</enum><text>the annual
				adjustment under this subparagraph shall be, subject to subparagraph (D) and
				paragraph (1), a uniform inflation factor, such as the consumer price index for
				all urban consumers, to be specified by the Secretary;</text>
								</subparagraph><subparagraph id="HECF2BA0CB0524F64BB651428E5757490"><enum>(D)</enum><text>such annual
				adjustment—</text>
									<clause id="HDE122698AABD47D89174CE6ECAA6CE0A"><enum>(i)</enum><text>if
				an increase, shall be—</text>
										<subclause id="H68714B5857494F7A9FE14465FEB814A3"><enum>(I)</enum><text>provided in full
				only for those providers of partial hospitalization services that meet
				performance standards specified by the Secretary consistent with the quality
				service criteria established under paragraph (3) and paragraph (4); and</text>
										</subclause><subclause id="H17478B29E8E54E47B13A025B8C14D8A7"><enum>(II)</enum><text>reduced for those
				providers of such services that fail to meet such performance standards;
				and</text>
										</subclause></clause><clause id="H57E927A98EB948349B02090A8BDBD4E6"><enum>(ii)</enum><text>if a decrease,
				shall be—</text>
										<subclause id="HE22BCE723D1B4342A82F715C0AE555C5"><enum>(I)</enum><text>provided in full
				for those providers of such services that fail to meet such standards;
				and</text>
										</subclause><subclause id="H83B9D05C3DD9441EBC3E81EEFF15A1AF"><enum>(II)</enum><text>reduced for those
				providers of such services that meet such standards; and</text>
										</subclause></clause></subparagraph><subparagraph id="HF1A8274D55584BB4A61504302AA539E7"><enum>(E)</enum><text>payment shall not
				be made for partial hospitalization services with a level of care of fewer than
				4 services per service day.</text>
								</subparagraph></paragraph><paragraph id="H41092F888CDC489D8F2F79676A0CDA6E"><enum>(3)</enum><header>Establishment of
				quality service criteria to judge performance</header><text>In order to carry
				out paragraph (2)(D), the Secretary shall establish criteria to measure
				performance of providers of partial hospitalization services. Such criteria
				shall include criteria relating to at least the following:</text>
								<subparagraph id="HD66A9D8CCDFA4D349265A70F9C357693"><enum>(A)</enum><header>Access</header><text>The
				number of program days of scheduled operation from the time of a request for
				services to the first scheduled day of service.</text>
								</subparagraph><subparagraph id="H2664BE05C1C04DE89065D112970FA2F1"><enum>(B)</enum><header>Treatment
				intensity</header><text>The percentage of scheduled attendance consistent with
				a minimum attendance average of 4 days per calendar week over an episode of
				care.</text>
								</subparagraph><subparagraph id="H1E4CAF2F5A4C48E09A9A493D68B27015"><enum>(C)</enum><header>Discharge
				planning</header><text>The percentage of patients with a scheduled follow-up
				appointment within 14 days after the date of discharge (as needed).</text>
								</subparagraph><subparagraph id="H8DBD4F53FCD7476C9DEB1FF322A697C7"><enum>(D)</enum><header>Continuity of
				care</header><text>The percentage of post-discharge continuity of care plans
				provided to next level of care providers upon discharge.</text>
								</subparagraph></paragraph><paragraph id="HA3A9FE827174490E9C06A1E4E7B8020D"><enum>(4)</enum><header>Requirement for
				accreditation</header><text display-inline="yes-display-inline">Effective 2
				years after the date of the enactment of this subsection, a provider of partial
				hospitalization services shall not be considered to meet performance standards
				under paragraph (2)(D) unless the provider is accredited by the Joint
				Commission on Accreditation of Healthcare Organizations, the Commission on
				Accreditation of Rehabilitation Facilities, or such other accreditation body as
				may be recognized by the
				Secretary.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HA6DBCD5BF3C2490FA4ACE3CF99E42F73"><enum>(b)</enum><header>Conforming
			 coverage of mental health services composite furnished by community mental
			 health centers</header><text display-inline="yes-display-inline">Under section
			 1861(ff)(2)(I) of the Social Security Act (42 U.S.C. 1395x(ff)(2)(I)), the
			 Secretary of Health and Human Services shall include such items and services as
			 would result in the same scope of items and services covered under partial
			 hospitalization services if furnished by a community mental health center as
			 would be covered as partial hospitalization services if furnished by a
			 hospital.</text>
			</subsection><subsection id="HEABAC032B92947B9A376274527944B25"><enum>(c)</enum><header>Effective
			 date</header><text>This section, and the amendments made by this section, shall
			 apply to services furnished on or after January 1, 2012.</text>
