			 authority to issue regulations under the Surface Mining Control and Reclamation
			 Act of 1977</header>
			<section id="H13FCBA86F53A411CBB6BE176BCBD8922"><enum>101.</enum><header>Limitation on
			 authority to issue regulations under the Surface Mining Control and Reclamation
			 Act of 1977</header><text display-inline="no-display-inline">The Secretary of
			 the Interior may not, before December 31, 2013, issue or approve any proposed
			 or final regulation under the Surface Mining Control and Reclamation Act of
			 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1201">30 U.S.C. 1201
			 et seq.</external-xref>) that would—</text>
				<paragraph id="H4698A62EA03E49D5AD79CD3C24DAD1CB"><enum>(1)</enum><text>adversely impact
			 employment in coal mines in the United States;</text>
				</paragraph><paragraph id="HF5C51A3022B840D89F8335895D49E37F"><enum>(2)</enum><text>cause a reduction
			 in revenue received by the Federal Government or any State, tribal, or local
			 government, by reducing through regulation the amount of coal in the United
			 States that is available for mining;</text>
				</paragraph><paragraph id="H09EE0D74792647D686E8D5EF892BBB33"><enum>(3)</enum><text display-inline="yes-display-inline">reduce the amount of coal available for
			 domestic consumption or for export;</text>
				</paragraph><paragraph id="HFBCC5C1888504C68B7B39745003BA291"><enum>(4)</enum><text>designate any area
			 as unsuitable for surface coal mining and reclamation operations; or</text>
				</paragraph><paragraph id="H6549F02FA038449F9BD2F65CD68F4C3F"><enum>(5)</enum><text>expose the United
			 States to liability for taking the value of privately owned coal through
			 regulation.</text>
				</paragraph></section><section id="H1DB61F90C3474B768559FE37E6255D93"><enum>102.</enum><header>Publication of
			 scientific studies for proposed rules</header>
				<subsection id="H54AEA5351C424CF887E8BCD3BAE48A16"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Title VI of the Surface Mining Control and
			 Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/16/1291">16 U.S.C. 1291 et seq.</external-xref>) is amended
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H7270B880CC1640878B0812C97B5FD61D" style="traditional">
						<section id="H933BA1FBDC7041E2A4DAA4AED8AEB7CB"><enum>722.</enum><header>Publication of scientific studies for proposed
		  rules</header><subsection commented="no" display-inline="yes-display-inline" id="HDBDC46D716E74EE88F68D33C3A762913"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Secretary, or any other Federal
				official proposing a rule under this Act, shall publish with each rule proposed
				under this Act each scientific study the Secretary or other official,
				respectively, relied on in developing the rule.</text>
							</subsection><subsection id="H3315FDD632FB40A0B5D796523FE9C163"><enum>(b)</enum><header>Scientific study
				defined</header><text display-inline="yes-display-inline">In this section the
				term <term>scientific study</term> means a study that—</text>
								<paragraph id="HB423E3D27A1C404CA16EF7083575DA81"><enum>(1)</enum><text display-inline="yes-display-inline">applies rigorous, systematic, and objective
				methodology to obtain reliable and valid knowledge relevant to the subject
				matter involved;</text>
								</paragraph><paragraph id="H070DF32ED3C44D4A901F1D786BEB93FF"><enum>(2)</enum><text display-inline="yes-display-inline">presents findings and makes claims that are
				appropriate to, and supported by, the methods that have been employed;
				and</text>
								</paragraph><paragraph id="H2BBF5EE473FE4DE5856204F0864E5A3D"><enum>(3)</enum><text display-inline="yes-display-inline">includes, appropriate to the rule being
				proposed—</text>
									<subparagraph id="H68D115AE155C461192CAF83208DF4CA4"><enum>(A)</enum><text display-inline="yes-display-inline">use of systematic, empirical methods that
				draw on observation or experiment;</text>
									</subparagraph><subparagraph id="HE0D0511396434C56B7000A0F2D90D2E2"><enum>(B)</enum><text display-inline="yes-display-inline">use of data analyses that are adequate to
				support the general findings;</text>
									</subparagraph><subparagraph id="HC7D906B5957046DDA497DD8F1EA90A0C"><enum>(C)</enum><text display-inline="yes-display-inline">reliance on measurements or observational
				methods that provide reliable and generalizable findings;</text>
									</subparagraph><subparagraph id="H6CF66CA77E6E48C4A77A99D445F3F345"><enum>(D)</enum><text display-inline="yes-display-inline">strong claims of causal relationships, only
				with research designs that eliminate plausible competing explanations for
				observed results, such as, but not limited to, random-assignment
				experiments;</text>
									</subparagraph><subparagraph id="H72E3B4518780408D8339729D711CFC8A"><enum>(E)</enum><text>presentation of
				studies and methods in sufficient detail and clarity to allow for replication
				or, at a minimum, to offer the opportunity to build systematically on the
				findings of the research;</text>
									</subparagraph><subparagraph id="HFA664EE002BF4E9C8A467144C13A66DA"><enum>(F)</enum><text display-inline="yes-display-inline">acceptance by a peer-reviewed journal or
				critique by a panel of independent experts through a comparably rigorous,
				objective, and scientific review; and</text>
									</subparagraph><subparagraph id="H7CBD7C5E8C0543CAA2BD336325E56F26"><enum>(G)</enum><text display-inline="yes-display-inline">consistency of findings across multiple
				studies or sites to support the generality of results and
				conclusions.</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H0FE50F5577A0430FB98908C70A3F3B15"><enum>(b)</enum><header>Clerical

			 of emissions of greenhouse gases</header><text display-inline="no-display-inline">Title III of the Clean Air Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/7601">42 U.S.C. 7601 et
			 seq.</external-xref>) is amended by adding at the end the following:</text>

							</paragraph><paragraph id="H4D906C4DF33748AD881B2B8CA60BFD0E"><enum>(4)</enum><text>Nitrous
				oxide.</text>
							</paragraph><paragraph id="HB53F0634666445C68161CD8D89D68EFE"><enum>(5)</enum><text>Sulfur
				hexafluoride.</text>
							</paragraph><paragraph id="HB6DD627E401F4972AB4DE10149E3DBF1"><enum>(6)</enum><text>Hydrofluorocarbons.</text>
							</paragraph><paragraph id="H47D1C640FF2D488B841AA316E351AAA9"><enum>(7)</enum><text>Perfluorocarbons.</text>
							</paragraph><paragraph id="HAE4E901E0A62424BA9759BC0B4AE0E48"><enum>(8)</enum><text>Any other
				substance subject to, or proposed to be subject to, regulation, action, or
				consideration under this Act to address climate change.</text>

				agency action</header>
							<paragraph commented="no" id="HD053DFFAA08441AF8843617865DCDE9B"><enum>(1)</enum><header>Limitation</header>
								<subparagraph commented="no" id="HAB87EA7AA4F543E6AF5E6FE54490F6B3"><enum>(A)</enum><header>In
				general</header><text>The Administrator may not, under this Act, promulgate any
				regulation concerning, take action relating to, or take into consideration the
				emission of a greenhouse gas to address climate change.</text>
								</subparagraph><subparagraph commented="no" id="HEC5F5F1FC6F840979B28BA979C131BF7"><enum>(B)</enum><header>Air pollutant
				definition</header><text>The definition of the term <term>air pollutant</term>
				in section 302(g) does not include a greenhouse gas. Notwithstanding the
				previous sentence, such definition may include a greenhouse gas for purposes of
				addressing concerns other than climate change.</text>
								</subparagraph></paragraph><paragraph id="HC7F2B3B77F4946B69117799E5080E5DC"><enum>(2)</enum><header>Exceptions</header><text>Paragraph
				(1) does not prohibit the following:</text>
								<subparagraph commented="no" id="H2CA78B18294B42C88635263956B477E5"><enum>(A)</enum><text display-inline="yes-display-inline">Notwithstanding paragraph (4)(B),
				implementation and enforcement of the rule entitled <quote>Light-Duty Vehicle
				Greenhouse Gas Emission Standards and Corporate Average Fuel Economy
				Standards</quote> (as published at 75 Fed. Reg. 25324 (May 7, 2010) and without
				further revision) and implementation and enforcement of the rule entitled
				<quote>Greenhouse Gas Emissions Standards and Fuel Efficiency Standards for
				Medium- and Heavy-Duty Engines and Vehicles</quote> (as published at 76 Fed.
				Reg. 57106 (September 15, 2011) and without further revision).</text>
								</subparagraph><subparagraph commented="no" id="HB39B790335C34A93AE60A05459DC8D6D"><enum>(B)</enum><text>Implementation and
				enforcement of section 211(o).</text>
								</subparagraph><subparagraph id="HCA8DDFDFBCDF49389CEA05A05A5BD6A6"><enum>(C)</enum><text display-inline="yes-display-inline">Statutorily authorized Federal research,
				development, demonstration programs and voluntary programs addressing climate
				change.</text>
								</subparagraph><subparagraph id="HCD3C7B9EBB2545D59AC149A1F8EA6CC7"><enum>(D)</enum><text>Implementation and
				enforcement of title VI to the extent such implementation or enforcement only
				involves one or more class I substances or class II substances (as such terms
				are defined in section 601).</text>
								</subparagraph><subparagraph id="H2DC8F7C4564D4FD485FE1F78F6D9C3A7"><enum>(E)</enum><text>Implementation and
				enforcement of section 821 (<external-xref legal-doc="usc" parsable-cite="usc/42/7651k">42 U.S.C. 7651k</external-xref> note) of
				<external-xref legal-doc="public-law" parsable-cite="pl/101/549">Public Law
				101–549</external-xref> (commonly referred to as the <quote>Clean Air Act
				Amendments of 1990</quote>).</text>
								</subparagraph></paragraph><paragraph id="H977D4E41FB8C4DEDA9834B4913CF135E"><enum>(3)</enum><header>Inapplicability
				of provisions</header><text>Nothing listed in paragraph (2) shall cause a
				greenhouse gas to be subject to part C of title I (relating to prevention of
				significant deterioration of air quality) or considered an air pollutant for
				purposes of title V (relating to permits).</text>
							</paragraph><paragraph id="HB996937313424BBA9477629F672A4FA7"><enum>(4)</enum><header>Certain prior
				agency actions</header><text>The following rules and actions (including any
				supplement or revision to such rules and actions) are repealed and shall have
				no legal effect:</text>

								</subparagraph></paragraph><paragraph id="H61AD6AB3DADA4D0EBCF234BD5207E069"><enum>(5)</enum><header>State
				action</header>
								<subparagraph id="HB6986D116DFE4AE4893C0CDC5DEC1AE7"><enum>(A)</enum><header>No
				limitation</header><text display-inline="yes-display-inline">This section does
				not limit or otherwise affect the authority of a State to adopt, amend,
				enforce, or repeal State laws and regulations pertaining to the emission of a
				greenhouse gas.</text>

			 national standard for automobiles<editorial></editorial></header>
				<subsection id="H5AB36B6652174B2BA655F7BFE1A53D5D"><enum>(a)</enum><header>Finding</header><text display-inline="yes-display-inline">Congress finds that the emissions of
			 greenhouse gases from a motor vehicle tailpipe are related to fuel
			 economy.</text>
				</subsection><subsection id="HB3637ACF360D4F8AB5D27AEE97204C5A"><enum>(b)</enum><header>Report
			 required</header><text display-inline="yes-display-inline">Not later than 60
			 days after the date of enactment of this Act, the Secretary of Transportation
			 shall submit a report to the Congress that, notwithstanding section 201,
			 assumes the implementation and enforcement of the final rule entitled
			 <quote>2017 and Later Model Year Light-Duty Vehicle Greenhouse Gas Emissions
			 and Corporate Average Fuel Economy Standards</quote> (issued on August 28,
			 2012) and estimates—</text>
					<paragraph id="H63986459F5464F20BFB45EAD2D8756F7"><enum>(1)</enum><text>the total number
			 of jobs that will be lost due to decreased demand by year caused by the
			 rule;</text>
					</paragraph><paragraph id="HFE15139FBC5744E28ECE74734974A565"><enum>(2)</enum><text>the number of
			 additional fatalities and injuries that will be caused by the rule; and</text>
					</paragraph><paragraph id="H3017AB94412040DBBD854870747BB1A3"><enum>(3)</enum><text>the additional
			 cost to the economy of the redundant regulation of fuel economy and greenhouse
			 gas emissions by the Environmental Protection Agency and State agencies for
			 model years 2011 through 2025.</text>
					</paragraph></subsection><subsection id="H356719AF1B1344F38F66B2077D84815E"><enum>(c)</enum><header>Consultation</header><text>Other
			 than to gather basic factual information, the Secretary of Transportation shall
			 not consult with the Administrator of the Environmental Protection Agency or
			 any official from the California Air Resources Board in fulfilling the
			 requirement described in subsection (b).</text>
				</subsection><subsection id="HE85FFD24A0B84861955A206B3A96AF07"><enum>(d)</enum><header>Amendment to the
			 Clean Air Act</header><text display-inline="yes-display-inline">Section 209(b)
			 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7543">42 U.S.C. 7543</external-xref>) is amended by
			 adding at the end the following:</text>

				enactment of this paragraph may be construed to waive the application of
				subsection

			 Regulatory Analysis of Impacts on Nation</header>
			<section id="HE860B05E1F41400AAFACF555746EFF2D"><enum>301.</enum><header>Committee for
			 the Cumulative Analysis of Regulations that Impact Energy and Manufacturing in
			 the United States</header>
				<subsection id="H80AFDD4DCF0748EC8B210FB513B28253"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The President shall establish a committee
			 to be known as the Committee for the Cumulative Analysis of Regulations that
			 Impact Energy and Manufacturing in the United States (in this Act referred to
			 as the <term>Committee</term>) to analyze and report on the cumulative and
			 incremental impacts of certain rules and actions of the Environmental
			 Protection Agency, in accordance with sections 302 and 303.</text>
				</subsection><subsection id="HAE04FB2EFF294B5881CA2CB5D7AE47E3"><enum>(b)</enum><header>Members</header><text display-inline="yes-display-inline">The Committee shall be composed of the
			 following officials (or their designees):</text>

			 and preparing reports under section 303, the Committee shall consult with, and
			 consider pertinent reports issued by, the Electric Reliability Organization
			 certified under section 215(c) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C.
			 824o(c)</external-xref>).</text>
				</subsection><subsection id="H13C4B921CCE448C2AA9FB7E749FC555B"><enum>(e)</enum><header>Termination</header><text display-inline="yes-display-inline">The Committee shall terminate 60 days after
			 submitting its final report pursuant to section 303(c).</text>
				</subsection></section><section id="HEB00C5DA7CDC43B79AD6B341679CD1C5"><enum>302.</enum><header>Analyses</header>
				<subsection commented="no" id="H2CD930D3EBAD4B8483866C0D4E9EA6C7"><enum>(a)</enum><header>Scope</header><text>The
			 Committee shall conduct analyses, for each of the calendar years 2016, 2020,
			 and 2030, of the following:</text>
					<paragraph commented="no" id="HDD5972467BBC41F49C8E9038B9A17B83"><enum>(1)</enum><text display-inline="yes-display-inline">The cumulative impact of covered rules that
			 are promulgated as final regulations on or before January 1, 2013, in
			 combination with covered actions.</text>
					</paragraph><paragraph commented="no" id="H3F47859980F04FD2B8494B4558737500"><enum>(2)</enum><text display-inline="yes-display-inline">The cumulative impact of all covered rules
			 (including covered rules that have not been promulgated as final regulations on
			 or before January 1, 2013), in combination with covered actions.</text>
					</paragraph><paragraph commented="no" id="HBA061C7A6A664663AC9F61B7A03A42AA"><enum>(3)</enum><text display-inline="yes-display-inline">The incremental impact of each covered rule
			 not promulgated as a final regulation on or before January 1, 2013, relative to
			 an analytic baseline representing the results of the analysis conducted under
			 paragraph (1).</text>
					</paragraph></subsection><subsection id="H97F979385DD54A1EA05821A5A7D66BE9"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The Committee shall include in each
			 analysis conducted under this section the following:</text>
					<paragraph id="H1169D5B075A24B8FA3F64D98652C4224"><enum>(1)</enum><text>Estimates of the
			 impacts of the covered rules and covered actions with regard to—</text>
						<subparagraph id="H1470941437F04B7D9C40E58F92F5226F"><enum>(A)</enum><text display-inline="yes-display-inline">the global economic competitiveness of the
			 United States, particularly with respect to energy intensive and trade
			 sensitive industries;</text>
						</subparagraph><subparagraph id="H80DF4C99D14940869539BF48D9BFE229"><enum>(B)</enum><text display-inline="yes-display-inline">other cumulative costs and cumulative
			 benefits, including evaluation through a general equilibrium model
			 approach;</text>
						</subparagraph><subparagraph id="HD1FAF72937C544CFA1F9CD002F78C5F3"><enum>(C)</enum><text>any resulting
			 change in national, State, and regional electricity prices;</text>
						</subparagraph><subparagraph id="H54AA3A9F487543ECB13FFCC5A66B5F64"><enum>(D)</enum><text display-inline="yes-display-inline">any resulting change in national, State,
			 and regional fuel prices;</text>
						</subparagraph><subparagraph id="H6C98B308AB394643BDFC32F873B4F19C"><enum>(E)</enum><text display-inline="yes-display-inline">the impact on national, State, and regional
			 employment during the 5-year period beginning on the date of enactment of this
			 Act, and also in the long term, including secondary impacts associated with
			 increased energy prices and facility closures; and</text>
						</subparagraph><subparagraph id="H51A8711BB6494D23BAD88A41A076C677"><enum>(F)</enum><text>the reliability
			 and adequacy of bulk power supply in the United States.</text>
						</subparagraph></paragraph><paragraph id="HEE0753685F3944F48B36D1A4B2314EDB"><enum>(2)</enum><text display-inline="yes-display-inline">Discussion of key uncertainties and
			 assumptions associated with each estimate.</text>
					</paragraph><paragraph commented="no" id="H94843BB22A9246D799155EEC078BAD29"><enum>(3)</enum><text display-inline="yes-display-inline">A sensitivity analysis.</text>

			 assessment, of the cumulative impact of the covered rules and covered actions

			 associated with regulatory costs;</text>

			 industry-specific labor markets; and</text>
						</subparagraph><subparagraph id="H7807BEE17DA84736AE442D6271E87A60"><enum>(H)</enum><text>agriculture,</text>
						</subparagraph><continuation-text continuation-text-level="paragraph">as well as
			 key uncertainties associated with each topic.</continuation-text></paragraph></subsection><subsection id="HBDC3316EAE654DF9ACAEB5981181E557"><enum>(c)</enum><header>Methods</header><text display-inline="yes-display-inline">In conducting analyses under this section,
			 the Committee shall use the best available methods, consistent with guidance
			 from the Office of Information and Regulatory Affairs and the Office of
			 Management and Budget Circular A–4.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H87A510F6545B42D2A82FFFE4B2000B8D"><enum>(d)</enum><header>Data</header><text display-inline="yes-display-inline">In conducting analyses under this section,
			 the Committee—</text>

			 data that are available to the public or supplied to the Committee by its
			 members, including the most recent such data appropriate for this analysis
			 representing air quality, facility emissions, and installed controls;

			 create data or to use data that are not readily accessible.</text>

			 Representatives and the Committee on Environment and Public Works of the Senate
			 a preliminary report containing the results of the analyses conducted under
			 section 302.</text>
				</subsection><subsection id="H2C9A923E8E4641A5BADE53D9AA26F488"><enum>(b)</enum><header>Public comment
			 period</header><text>The Committee shall accept public comments regarding the
			 preliminary report submitted under subsection (a) for a period of 120 days
			 after such submission.</text>
				</subsection><subsection id="HD286102A40304A94877AEA95BF54CC05"><enum>(c)</enum><header>Final
			 report</header><text>Not later than September 30, 2013, the Committee shall
			 submit to Congress a final report containing the analyses conducted under
			 section 302, including any revisions to such analyses made as a result of
			 public comments, and a response to such comments.</text>
				</subsection></section><section id="H985712D0509E48DE93EB7764DFAF76FF"><enum>304.</enum><header>Additional
			 provisions relating to certain rules</header>
				<subsection id="HED120FCC6BCE43E2A68CDF99FC2EB687"><enum>(a)</enum><header>Cross-State Air
			 Pollution rule/Transport rule</header>
					<paragraph id="HB55D0C2CAAC84F88B4D112A45C68811F"><enum>(1)</enum><header>Earlier
			 rules</header><text display-inline="yes-display-inline">The rule entitled
			 <quote>Federal Implementation Plans: Interstate Transport of Fine Particulate
			 Matter and Ozone and Correction of SIP Approvals</quote>, published at 76 Fed.
			 Reg. 48208 (August 8, 2011), and any successor or substantially similar rule,
			 shall be of no force or effect, and shall be treated as though such rule had
			 never taken effect.</text>
					</paragraph><paragraph commented="no" id="H1FA8BF7CAE2E4C7C8159FF2814798F99"><enum>(2)</enum><header>Continued
			 applicability of Clean Air Interstate Rule</header><text display-inline="yes-display-inline">In place of any rule described in paragraph
			 (1), the Administrator of the Environmental Protection Agency (in this section
			 referred to as the <quote>Administrator</quote>) shall continue to implement
			 the Clean Air Interstate Rule.</text>
					</paragraph><paragraph commented="no" id="H64E8C95D27CB4DF0A84955CDC48B300A"><enum>(3)</enum><header>Additional
			 rulemakings</header>
						<subparagraph id="H1ED2A44BE8604E5BAAA439AAAE7D1ADA"><enum>(A)</enum><header>Issuance of new
			 rules</header><text>The Administrator—</text>
							<clause id="HDCA68638763D43E49F969526F516C24F"><enum>(i)</enum><text>shall not issue
			 any proposed or final rule under section 110(a)(2)(D)(i)(I) or section 126 of
			 the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7410">42 U.S.C. 7410(a)(2)(D)(i)(I)</external-xref>,
			 7426) relating to national ambient air quality standards for ozone or
			 particulate matter (including any modification of the Clean Air Interstate
			 Rule) before the date that is 3 years after the date on which the Committee
			 submits the final report under section 303(c);</text>
							</clause><clause commented="no" id="H1D3BB45EE4AC40CAA57E905D99A21FA6"><enum>(ii)</enum><text>in issuing any
			 rule described in clause (i), shall base the rule on actual monitored (and not
			 modeled) data and shall, notwithstanding section 110(a)(2)(D)(i)(I), allow the
			 trading of emissions allowances among entities covered by the rule irrespective
			 of the States in which such entities are located;</text>
							</clause><clause id="HD5F4CDBD1EE34A5686D14D1C6A1A1A4F"><enum>(iii)</enum><text display-inline="yes-display-inline">shall not issue any proposed or final rule
			 under section 109 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>) that relies upon
			 scientific or technical data that have not been made available to the public;
			 and</text>
							</clause><clause id="H3840D1C8BAFC4B23B64B02C6DC2D5EF0"><enum>(iv)</enum><text>shall not issue
			 any proposed or final rule under section 109 of the Clean Air Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C.
			 7409</external-xref>), unless the accompanying regulatory impact analysis, as
			 required under Executive Order No. 12866, is peer reviewed in a manner
			 consistent with the Office of Management and Budget’s <quote>Final Information
			 Quality Bulletin for Peer Review</quote> and the third edition of the
			 Environmental Protection Agency’s <quote>Peer Review Handbook</quote>.</text>
							</clause></subparagraph><subparagraph id="HA3A4088E5CC946019D80E6560BD8BC3E"><enum>(B)</enum><header>Implementation
			 schedule</header><text>In promulgating any final rule described in subparagraph
			 (A)(i), the Administrator shall establish a date for State implementation of
			 the standards established by such final rule that is not earlier than 3 years
			 after the date of publication of such final rule.</text>
						</subparagraph></paragraph><paragraph id="H770C9B6B964D4EBDA7DE9A21D47AA7C0"><enum>(4)</enum><header>Definition of
			 Clean Air Interstate Rule</header><text>For purposes of this section, the term
			 <term>Clean Air Interstate Rule</term> means the Clean Air Interstate Rule and
			 the rule establishing Federal Implementation Plans for the Clean Air Interstate
			 Rule as promulgated and modified by the Administrator (70 Fed. Reg. 25162 (May
			 12, 2005), 71 Fed. Reg. 25288 (April 28, 2006), 72 Fed. Reg. 55657 (October 1,
			 2007), 72 Fed. Reg. 59190 (October 19, 2007), 72 Fed. Reg. 62338 (November 2,
			 2007), 74 Fed. Reg. 56721 (November 3, 2009)).</text>
					</paragraph></subsection><subsection id="HA99D7C458B4744598E0028FA79CE636F"><enum>(b)</enum><header>Steam generating
			 unit rules</header>
					<paragraph commented="no" id="H7D733A91EA9A4A279662BE74807FE8D2"><enum>(1)</enum><header>Earlier
			 rules</header><text display-inline="yes-display-inline">The proposed rule
			 entitled <quote>National Emission Standards for Hazardous Air Pollutants From
			 Coal- and Oil-Fired Electric Utility Steam Generating Units and Standards of
			 Performance for Fossil-Fuel-Fired Electric Utility, Industrial-Commercial-
			 Institutional, and Small Industrial-Commercial-Institutional Steam Generating
			 Units</quote> published at 76 Fed. Reg. 24976 (May 3, 2011), and any final rule
			 that is based on such proposed rule and is issued prior to the date of the
			 enactment of this Act, shall be of no force and effect, and shall be treated as
			 though such proposed or final rule had never been issued. In conducting
			 analyses under section 302(a), the Committee shall analyze the rule described
			 in section 302(e)(1)(E) (including any successor or substantially similar rule)
			 as if the preceding sentence did not apply to such rule.</text>
					</paragraph><paragraph id="H6E9DA24F0720459281B96A518F36595B"><enum>(2)</enum><header>Promulgation of
			 final rules</header><text display-inline="yes-display-inline">In place of the
			 rules described in paragraph (1), the Administrator shall—</text>
						<subparagraph id="HDEEDF2520C464E43A8F728E1F1BAFC29"><enum>(A)</enum><text display-inline="yes-display-inline">issue regulations establishing national
			 emission standards for coal-and oil-fired electric utility steam generating
			 units under section 112 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412</external-xref>) with respect to
			 each hazardous air pollutant for which the Administrator finds such regulations
			 are appropriate and necessary pursuant to subsection (n)(1)(A) of such
			 section;</text>
						</subparagraph><subparagraph id="H6CEED234FBF348EAB3DE5B076EDC910B"><enum>(B)</enum><text>issue regulations
			 establishing standards of performance for fossil-fuel-fired electric utility,
			 industrial-commercial-institutional, and small
			 industrial-commercial-institutional steam generating units under section 111 of
			 the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/111">42
			 U.S.C. 111</external-xref>); and</text>
						</subparagraph><subparagraph commented="no" id="HFDEC721BC1AE416DA7548909ACD19260"><enum>(C)</enum><text>issue the final
			 regulations required by subparagraphs (A) and (B)—</text>
							<clause commented="no" id="H01ECD7CC9D8B47CD8C111123A6744D64"><enum>(i)</enum><text>after issuing
			 proposed regulations under such subparagraphs;</text>
							</clause><clause commented="no" id="HF06C78E406C34F759DBDAD2C7EF00BE1"><enum>(ii)</enum><text>after
			 consideration of the final report submitted under section 303(c); and</text>
							</clause><clause commented="no" id="HF28A85AA96234B53BBB51C3FDADB921A"><enum>(iii)</enum><text>not earlier than
			 the date that is 12 months after the date on which the Committee submits such
			 report to the Congress, or such later date as may be determined by the
			 Administrator.</text>
							</clause></subparagraph></paragraph><paragraph id="H8F530154294743A9ADAC7DBCE1020F6B"><enum>(3)</enum><header>Compliance
			 provisions</header>
						<subparagraph id="H4A0D8F0F58C7440C9CD82B64F3BCC9FC"><enum>(A)</enum><header>Establishment of
			 compliance dates</header><text display-inline="yes-display-inline">In
			 promulgating the regulations under paragraph (2), the Administrator—</text>
							<clause id="H2C195DED2B2C424E8CEE77EAEFA2B7CE"><enum>(i)</enum><text display-inline="yes-display-inline">shall establish a date for compliance with
			 the standards and requirements under such regulations that is not earlier than
			 5 years after the effective date of the regulations; and</text>
							</clause><clause id="H6B4A4D9438144093B434ED83AA377041"><enum>(ii)</enum><text>in
			 establishing a date for such compliance, shall take into consideration—</text>
								<subclause id="HC8989F9B22894190AF214F95D212E3D6"><enum>(I)</enum><text display-inline="yes-display-inline">the costs of achieving emissions
			 reductions;</text>
								</subclause><subclause id="HD0B189F083B1447DA5757A4C0BFA37E4"><enum>(II)</enum><text>any non-air
			 quality health and environmental impact and energy requirements of the
			 standards and requirements;</text>
								</subclause><subclause id="H0E597508799046E083C69EA04256882F"><enum>(III)</enum><text>the feasibility
			 of implementing the standards and requirements, including the time needed
			 to—</text>
									<item id="H0E36A5373B024AA58B830A4692015BF0"><enum>(aa)</enum><text display-inline="yes-display-inline">obtain necessary permit approvals; and</text>
									</item><item id="H1728C16FC515437E9587CEF9C91CCC85"><enum>(bb)</enum><text>procure, install,
			 and test control equipment;</text>
									</item></subclause><subclause id="H16343E4F700D4EFD927BF6E6EC5BC00B"><enum>(IV)</enum><text display-inline="yes-display-inline">the availability of equipment, suppliers,
			 and labor, given the requirements of the regulations and other proposed or
			 finalized regulations; and</text>
								</subclause><subclause id="H7049FB7235F6429085B9263C581DF6FD"><enum>(V)</enum><text>potential net
			 employment impacts.</text>
								</subclause></clause></subparagraph><subparagraph id="H6E059063EF6840469F57BC381DF9CBD7"><enum>(B)</enum><header>New
			 sources</header><text display-inline="yes-display-inline">With respect to the
			 regulations promulgated pursuant to paragraph (2)—</text>
							<clause id="HD565A6EA805944A19255C2DF3A840B69"><enum>(i)</enum><text display-inline="yes-display-inline">the date on which the Administrator
			 proposes a regulation pursuant to paragraph (2)(A) establishing an emission
			 standard under section 112 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412</external-xref>) shall be treated as
			 the date on which the Administrator first proposes such a regulation for
			 purposes of applying the definition of a new source under section 112(a)(4) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C.
			 7412(a)(4)</external-xref>);</text>
							</clause><clause commented="no" id="H4DB82242BE484537BBD17C88BFB8B1FB"><enum>(ii)</enum><text display-inline="yes-display-inline">the date on which the Administrator
			 proposes a regulation pursuant to paragraph (2)(B) establishing a standard of
			 performance under section 111 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7411">42 U.S.C. 7411</external-xref>)
			 shall be treated as the date on which the Administrator proposes such a
			 regulation for purposes of applying the definition of a new source under
			 section 111(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7411">42 U.S.C. 7411(a)(2)</external-xref>);</text>
							</clause><clause id="H058FB674E55F41058716F529A369877F"><enum>(iii)</enum><text display-inline="yes-display-inline">for purposes of any emission standard or
			 limitation applicable to electric utility steam generating units, the term
			 <term>new source</term> means a stationary source for which a preconstruction
			 permit or other preconstruction approval required under the Clean Air Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et
			 seq.</external-xref>) has been issued after the effective date of such
			 emissions standard or limitation; and</text>
							</clause><clause commented="no" id="H5F4CFA5DC8944C938A0B61A99A94517F"><enum>(iv)</enum><text display-inline="yes-display-inline">for purposes of clause (iii), the date of
			 issuance of a preconstruction permit or other preconstruction approval is
			 deemed to be the date on which such permit or approval is issued to the
			 applicant irrespective of any administrative or judicial review occurring after
			 such date.</text>
							</clause></subparagraph><subparagraph id="H0E9BBD9A140249FBB75EBA042BE46C9E"><enum>(C)</enum><header>Rule of
			 construction</header><text>Nothing in this subsection shall be construed to
			 restrict or otherwise affect the provisions of paragraphs (3)(B) and (4) of
			 section 112(i) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(i)</external-xref>).</text>
						</subparagraph></paragraph><paragraph id="H469B1CA3780949A18EC2604677EBE45E"><enum>(4)</enum><header>Other
			 provisions</header>
						<subparagraph commented="no" id="H4EAAEB6C13AD4C9ABE47B5B64AD3C200"><enum>(A)</enum><header>Establishment of
			 standards achievable in practice</header><text display-inline="yes-display-inline">The regulations promulgated pursuant to
			 paragraph (2)(A) of this section shall apply section 112(d)(3) of the Clean Air
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C.
			 7412(d)(3)</external-xref>) in accordance with the following:</text>
							<clause commented="no" id="HF121E3A38B7D4785845BEC13FD080BB1"><enum>(i)</enum><header>New
			 sources</header><text display-inline="yes-display-inline">With respect to new
			 sources:</text>
								<subclause commented="no" id="H5593A842E59241079E0FD39FCA7B1516"><enum>(I)</enum><text display-inline="yes-display-inline">The Administrator shall identify the best
			 controlled similar source for each source category or subcategory.</text>
								</subclause><subclause commented="no" id="HE3E746C82E134390979A449D5CE65EA3"><enum>(II)</enum><text>The best
			 controlled similar source for a category or subcategory shall be the single
			 source that is determined by the Administrator to be the best controlled, in
			 the aggregate, for all of the hazardous air pollutants for which the
			 Administrator intends to issue standards for such source category or
			 subcategory, under actual operating conditions, taking into account the
			 variability in actual source performance, source design, fuels, controls,
			 ability to measure pollutant emissions, and operating conditions.</text>
								</subclause></clause><clause commented="no" id="H0FC5F6675DA74AC79D673C73EBEC3110"><enum>(ii)</enum><header>Existing
			 sources</header><text display-inline="yes-display-inline">With respect to
			 existing sources:</text>
								<subclause commented="no" id="H26E47394CFF2470CAF9EAC497B29B427"><enum>(I)</enum><text display-inline="yes-display-inline">The Administrator shall identify one group
			 of sources that constitutes the best performing 12 percent of existing sources
			 for each source category or subcategory.</text>
								</subclause><subclause commented="no" id="H4349274204784FA5A9D88E34C29B4972"><enum>(II)</enum><text>The group
			 constituting the best performing 12 percent of existing sources for a category
			 or subcategory shall be the single group that is determined by the
			 Administrator to be the best performing, in the aggregate, for all of the
			 hazardous air pollutants for which the Administrator intends to issue standards
			 for such source category or subcategory, under actual operating conditions,
			 taking into account the variability in actual source performance, source
			 design, fuels, controls, ability to measure pollutant emissions, and operating
			 conditions.</text>
								</subclause></clause></subparagraph><subparagraph id="H5B2ABD1710694056BDBD35170E51CB3A"><enum>(B)</enum><header>Regulatory
			 alternatives</header><text display-inline="yes-display-inline">For the
			 regulations promulgated pursuant to paragraph (2) of this section, from among
			 the range of regulatory alternatives authorized under the Clean Air Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et
			 seq.</external-xref>), including work practice standards under section 112(h)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42
			 U.S.C. 7412(h)</external-xref>), the Administrator shall impose the least
			 burdensome, consistent with the purposes of such Act and Executive Order No.
			 13563 published at 76 Fed. Reg. 3821 (January 21, 2011).</text>
						</subparagraph></paragraph></subsection></section><section id="H2DD026C10B2E4BE4A7E6BD5BC4F225C5"><enum>305.</enum><header>Consideration
			 of feasibility and cost in establishing national ambient air quality
			 standards</header><text display-inline="no-display-inline">In establishing any
			 national primary or secondary ambient air quality standard under section 109 of
			 the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>), the Administrator
			 of the Environmental Protection Agency shall take into consideration
			 feasibility and cost.</text>
			</section></title><title id="HE7DB9970B1AD4A6C83A866F4BD7453C4"><enum>IV</enum><header>Management and
			 disposal of coal combustion residuals</header>
			<section id="HBB265F7259FE4ECA8B5A082F6315D2EE"><enum>401.</enum><header>Management and
			 disposal of coal combustion residuals</header>
				<subsection id="H872DBFBF697D4AA4944F61D6383CFE41"><enum>(a)</enum><header>In
			 general</header><text>Subtitle D of the Solid Waste Disposal Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/6941">42 U.S.C. 6941 et
			 seq.</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block id="H9E7B60121A8E4B93B87A16BAFA1462F5" style="OLC">
						<section id="H4B110CB353744153B278CD619BB65AA5"><enum>4011.</enum><header>Management and
				disposal of coal combustion residuals</header>
							<subsection id="HB49B935159CA4A36BE9734168E1CA868"><enum>(a)</enum><header>State permit
				programs for coal combustion residuals</header><text>Each State may adopt and
				implement a coal combustion residuals permit program.</text>
							</subsection><subsection id="H05348F3E29E94AE98F2EEDC3651A9247"><enum>(b)</enum><header>State
				actions</header>
								<paragraph id="HBFC0AC7FD6174D5FAAA636B94099CA4C"><enum>(1)</enum><header>Notification</header><text>Not
				later than 6 months after the date of enactment of this section (except as
				provided by the deadline identified under subsection (d)(3)(B)), the Governor
				of each State shall notify the Administrator, in writing, whether such State
				will adopt and implement a coal combustion residuals permit program.</text>
								</paragraph><paragraph id="H6D8651E49C1844F39E1A3143A8A4E178"><enum>(2)</enum><header>Certification</header>
									<subparagraph id="H57B9922B8B0E4561AA23048A42B56649"><enum>(A)</enum><header>In
				general</header><text>Not later than 36 months after the date of enactment of
				this section (except as provided in subsections (f)(1)(A) and (f)(1)(C)), in
				the case of a State that has notified the Administrator that it will implement
				a coal combustion residuals permit program, the head of the lead State agency
				responsible for implementing the coal combustion residuals permit program shall
				submit to the Administrator a certification that such coal combustion residuals
				permit program meets the specifications described in subsection (c).</text>
									</subparagraph><subparagraph id="H6430BEEB28084BE999ABBC14CC2A2909"><enum>(B)</enum><header>Contents</header><text>A
				certification submitted under this paragraph shall include—</text>
										<clause id="H66BF73AF3E3E47808C2A9A8F395BBC34"><enum>(i)</enum><text>a
				letter identifying the lead State agency responsible for implementing the coal
				combustion residuals permit program, signed by the head of such agency;</text>
										</clause><clause id="H78665D88720145749C477687C2BC8A43"><enum>(ii)</enum><text>identification of
				any other State agencies involved with the implementation of the coal
				combustion residuals permit program;</text>
										</clause><clause id="H20E976587FAE469A91B91AFFEE64703B"><enum>(iii)</enum><text>a narrative
				description that provides an explanation of how the State will ensure that the
				coal combustion residuals permit program meets the requirements of this
				section, including a description of the State’s—</text>
											<subclause id="H480814766579418CAE1E4D335F62A46A"><enum>(I)</enum><text>process to inspect
				or otherwise determine compliance with such permit program;</text>
											</subclause><subclause id="H697073741E3E44D9845DA5398C9F1389"><enum>(II)</enum><text>process to
				enforce the requirements of such permit program;</text>
											</subclause><subclause id="H74E3B671D94B427AAFEC5EC61B75BC13"><enum>(III)</enum><text>public
				participation process for the promulgation, amendment, or repeal of regulations
				for, and the issuance of permits under, such permit program; and</text>
											</subclause><subclause id="H6890EFF2EBE547CA8CE0AB8EF5C48D7D"><enum>(IV)</enum><text>statutes,
				regulations, or policies pertaining to public access to information, such as
				groundwater monitoring data;</text>
											</subclause></clause><clause id="H774621672F504AA6A0ACE3696AD06113"><enum>(iv)</enum><text>a
				legal certification that the State has, at the time of certification, fully
				effective statutes or regulations necessary to implement a coal combustion
				residuals permit program that meets the specifications described in subsection
				(c); and</text>
										</clause><clause id="H623277D56F3B42A09557DE9A522D8F81"><enum>(v)</enum><text>copies of State
				statutes and regulations described in clause (iv).</text>
										</clause></subparagraph><subparagraph id="HAF2316444FFC408EB92F1E1804398D58"><enum>(C)</enum><header>Updates</header><text>A
				State may update the certification as needed to reflect changes to the coal
				combustion residuals permit program.</text>
									</subparagraph></paragraph><paragraph id="HB382A7D25C56418AB9F47474F5B32611"><enum>(3)</enum><header>Maintenance of
				4005(c) or 3006 program</header><text>In order to adopt or implement a coal
				combustion residuals permit program under this section (including pursuant to
				subsection (f)), the State agency responsible for implementing a coal
				combustion residuals permit program in a State shall maintain an approved
				program under section 4005(c) or an authorized program under section
				3006.</text>
								</paragraph></subsection><subsection id="HB78DC8F91701485A993A6C6187102A87"><enum>(c)</enum><header>Permit program
				specifications</header>
								<paragraph id="H3D90AFFC2A2547FA8514568EFDF68B86"><enum>(1)</enum><header>Minimum
				requirements</header>
									<subparagraph id="H883C572119C841CA87A93226C313027D"><enum>(A)</enum><header>In
				general</header><text>A coal combustion residuals permit program shall apply
				the revised criteria described in paragraph (2) to owners or operators of
				structures, including surface impoundments, that receive coal combustion
				residuals.</text>
									</subparagraph><subparagraph id="HC46AE5FC350048F3A4FF3CBF857E7911"><enum>(B)</enum><header>Structural
				integrity</header>
										<clause id="H7F3A0B1738354F91BFE9C2F98FF45807"><enum>(i)</enum><header>Engineering
				certification</header><text>A coal combustion residuals permit program shall
				require that an independent registered professional engineer certify
				that—</text>
											<subclause id="H6A1E9DA4217144658B1244C80B5A9152"><enum>(I)</enum><text>the design of
				structures is in accordance with recognized and generally accepted good
				engineering practices for containment of the maximum volume of coal combustion
				residuals and liquids appropriate for the structure; and</text>
											</subclause><subclause id="HFE3BED7486214ABEA680ABAF2F729207"><enum>(II)</enum><text>the construction
				and maintenance of the structure will ensure dam stability.</text>
											</subclause></clause><clause id="H8A565BC1C0224820ACB2494A971B81FD"><enum>(ii)</enum><header>Inspection</header><text>A
				coal combustion residuals permit program shall require that structures that are
				surface impoundments be inspected not less than annually by an independent
				registered professional engineer to assure that the design, operation, and
				maintenance of the surface impoundment is in accordance with recognized and
				generally accepted good engineering practices for containment of the maximum
				volume of coal combustion residuals and liquids which can be impounded, so as
				to ensure dam stability.</text>
										</clause><clause id="HE80FF0D354E14ADF883E203A94278D27"><enum>(iii)</enum><header>Deficiency</header>
											<subclause id="H5116937D8DE24F8EB9146912796B8052"><enum>(I)</enum><header>In
				general</header><text>If the head of the agency responsible for implementing
				the coal combustion residuals permit program determines that a structure is
				deficient with respect to the requirements in clauses (i) and (ii), the head of
				the agency has the authority to require action to correct the deficiency
				according to a schedule determined by the agency.</text>
											</subclause><subclause id="HF5D31A118A8A49FE9B2364743584DD5D"><enum>(II)</enum><header>Uncorrected
				deficiencies</header><text>If a deficiency is not corrected according to the
				schedule, the head of the agency has the authority to require that the
				structure close in accordance with subsection (h).</text>
											</subclause></clause></subparagraph><subparagraph id="HB56D4CF1FB1C4B109CA0C42876AC760D"><enum>(C)</enum><header>Location</header><text>Each
				structure that first receives coal combustion residuals after the date of
				enactment of this section shall be constructed with a base located a minimum of
				2 feet above the upper limit of the water table, unless it is demonstrated to
				the satisfaction of the agency responsible for implementing the coal combustion
				residuals permit program that—</text>
										<clause id="HDDE88F9FC05446A9A9CD4028089B07DD"><enum>(i)</enum><text>the hydrogeologic
				characteristics of the structure and surrounding land would preclude such a
				requirement; and</text>
										</clause><clause id="H8283E867CAFF4A939EC9A291A8DEA545"><enum>(ii)</enum><text>the function and
				integrity of the liner system will not be adversely impacted by contact with
				the water table.</text>
										</clause></subparagraph><subparagraph id="H611B9BB417FE4D59ADFA9D2D54F35686"><enum>(D)</enum><header>Wind
				dispersal</header>
										<clause id="H77AC041ED61C45BDB0D4BE134F86956D"><enum>(i)</enum><header>In
				general</header><text>The agency responsible for implementing the coal
				combustion residuals permit program shall require that owners or operators of
				structures address wind dispersal of dust by requiring cover, or by wetting
				coal combustion residuals with water to a moisture content that prevents wind
				dispersal, facilitates compaction, and does not result in free liquids.</text>
										</clause><clause id="H4952C3351E2B4DD58B44C3AEFA461473"><enum>(ii)</enum><header>Alternative
				methods</header><text>Subject to the review and approval by the agency, owners
				or operators of structures may propose alternative methods to address wind
				dispersal of dust that will provide comparable or more effective control of
				dust.</text>
										</clause></subparagraph><subparagraph id="HCA6A2061F3284267B5037C26AC6C129D"><enum>(E)</enum><header>Permits</header><text>The
				agency responsible for implementing the coal combustion residuals permit
				program shall require that the owner or operator of each structure that
				receives coal combustion residuals after the date of enactment of this section
				apply for and obtain a permit incorporating the requirements of the coal
				combustion residuals permit program.</text>
									</subparagraph><subparagraph id="H9F1BE456A0EB4B4099AF7CDB9C869DBA"><enum>(F)</enum><header>State
				notification and groundwater monitoring</header>
										<clause id="H38C8723FC35B4D90B5C782473EF47C9D"><enum>(i)</enum><header>Notification</header><text>Not
				later than the date on which a State submits a certification under subsection
				(b)(2), the State shall notify owners or operators of structures within the
				State of—</text>
											<subclause id="H5628FBFF28864F3AB60CD010F9F38F88"><enum>(I)</enum><text>the obligation to
				apply for and obtain a permit under subparagraph (E); and</text>
											</subclause><subclause id="H93BDA4F39D3A493BB398EA1984B1C095"><enum>(II)</enum><text>the groundwater
				monitoring requirements applicable to structures under paragraph
				(2)(A)(ii).</text>
											</subclause></clause><clause id="H7ED5AB816BEB4D99B7F3159862F87AA4"><enum>(ii)</enum><header>Groundwater
				monitoring</header><text>Not later than 1 year after the date on which a State
				submits a certification under subsection (b)(2), the State shall require the
				owner or operator of each structure to comply with the groundwater monitoring
				requirements under paragraph (2)(A)(ii).</text>
										</clause></subparagraph><subparagraph id="H2CA3D037B6C6444395EC78DCAAF8C951"><enum>(G)</enum><header>Agency
				requirements</header><text>Except for information described in
				<external-xref legal-doc="usc" parsable-cite="usc/18/1905">section
				1905</external-xref> of title 18, United States Code, the agency responsible
				for implementing the coal combustion residuals permit program shall ensure
				that—</text>
										<clause id="H778EA27C24634DEE9060D2EEABFCE6BB"><enum>(i)</enum><text>documents for
				permit determinations are made available for public review and comment under
				the public participation process described in subsection
				(b)(2)(B)(iii)(III);</text>
										</clause><clause id="HA9DA07590CB74104AA1004618137CEFA"><enum>(ii)</enum><text>final
				determinations on permit applications are made known to the public; and</text>
										</clause><clause id="H4BFE2538DB824C39AF27DEC96972E415"><enum>(iii)</enum><text>groundwater
				monitoring data collected under paragraph (2) is publicly available.</text>
										</clause></subparagraph><subparagraph id="H344E677EA002406E8F9108CA0A7B8B5C"><enum>(H)</enum><header>Agency
				authority</header>
										<clause id="H56E9C495D9B948CA8B361F95101DAA3A"><enum>(i)</enum><header>In
				general</header><text>The agency responsible for implementing the coal
				combustion residuals permit program has the authority to—</text>
											<subclause id="H439EC3EA293848488A050F44D38F01E7"><enum>(I)</enum><text>obtain information
				necessary to determine whether the owner or operator of a structure is in
				compliance with the coal combustion residuals permit program requirements of
				this section;</text>
											</subclause><subclause id="HDF9F8B1BAFDB40B09A87FAEBFA33BAFE"><enum>(II)</enum><text>conduct or
				require monitoring and testing to ensure that structures are in compliance with
				the coal combustion residuals permit program requirements of this section;
				and</text>
											</subclause><subclause id="HA5B7DDC3AD1848FF83783BA5A90EB728"><enum>(III)</enum><text>enter, at
				reasonable times, any site or premise subject to the coal combustion residuals
				permit program for the purpose of inspecting structures and reviewing records
				relevant to the operation and maintenance of structures.</text>
											</subclause></clause><clause id="H4D8C0D6533954CD69A40A82AB2598959"><enum>(ii)</enum><header>Monitoring and
				testing</header><text>If monitoring or testing is conducted under clause
				(i)(II) by or for the agency responsible for implementing the coal combustion
				residuals permit program, the agency shall, if requested, provide to the owner
				or operator—</text>
											<subclause id="HB78727F8EB0E44179FCE1DDBD5F697E6"><enum>(I)</enum><text>a written
				description of the monitoring or testing completed;</text>
											</subclause><subclause id="HCBBEA8DA928B4B03B8D8E094958AB989"><enum>(II)</enum><text>at the time of
				sampling, a portion of each sample equal in volume or weight to the portion
				retained by or for the agency; and</text>
											</subclause><subclause id="HA2A29F65A41C4A6495F8D32B3EAB24C6"><enum>(III)</enum><text>a copy of the
				results of any analysis of samples collected by or for the agency.</text>
											</subclause></clause></subparagraph><subparagraph id="H5271F0582FD14396B01E950B343AD1AF"><enum>(I)</enum><header>State
				authority</header><text>A State implementing a coal combustion residuals permit
				program has the authority to—</text>
										<clause id="HC58EEFE25269447986D6D3D9B5C50769"><enum>(i)</enum><text>inspect
				structures; and</text>
										</clause><clause id="HE4806F47EEBA4F3B8A1B01E6224129DB"><enum>(ii)</enum><text>implement and
				enforce the coal combustion residuals permit program.</text>
										</clause></subparagraph><subparagraph id="HF8E0A68C24AC4C8EA174DC77EBF1B36D"><enum>(J)</enum><header>Requirements for
				surface impoundments that do not meet certain criteria</header>
										<clause id="H8AD8E716C0394B8BA281963E5B00515A"><enum>(i)</enum><header>In
				general</header><text>In addition to the groundwater monitoring and corrective
				action requirements described in paragraph (2)(A)(ii), a coal combustion
				residuals permit program shall require a surface impoundment that receives coal
				combustion residuals after the date of enactment of this section to—</text>
											<subclause id="H0C01CAFE2D154109BF2369D3C4460E7E"><enum>(I)</enum><text>comply with the
				requirements in clause (ii)(I)(aa) and subclauses (II) through (IV) of clause
				(ii) if the surface impoundment—</text>
												<item id="HA1BC15865BD048C0887F1E44D3B421BF"><enum>(aa)</enum><text>does not—</text>
													<subitem id="HCCD7619787B74A8E98828FB10E93910D"><enum>(AA)</enum><text>have a liner
				system described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.40">section
				258.40(b)</external-xref> of title 40, Code of Federal Regulations; and</text>
													</subitem><subitem id="H421D81C07BA64B0080AAB877302249A6"><enum>(BB)</enum><text>meet the design
				criteria described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.40">section
				258.40(a)(1)</external-xref> of title 40, Code of Federal Regulations;
				and</text>
													</subitem></item><item id="H2A5F033DE1C84D83BA0A0CE709270D39"><enum>(bb)</enum><text>within 10 years
				after the date of enactment of this section, is required under
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.56">section
				258.56(a)</external-xref> of title 40, Code of Federal Regulations, to undergo
				an assessment of corrective measures for any constituent identified in
				paragraph (2)(A)(ii) for which assessment groundwater monitoring is required;
				and</text>
												</item></subclause><subclause id="HBAF045149F1347F88AB6273A7DBBD928"><enum>(II)</enum><text>comply with the
				requirements in clause (ii)(I)(bb) and subclauses (II) through (IV) of clause
				(ii) if the surface impoundment—</text>
												<item id="H084D270C200F4EC683F483ECA3026459"><enum>(aa)</enum><text>does not—</text>
													<subitem id="HC4015D9CF19E41FBBD26B2093D65AC07"><enum>(AA)</enum><text>have a liner
				system described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.40">section
				258.40(b)</external-xref> of title 40, Code of Federal Regulations; and</text>
													</subitem><subitem id="H6C5F4A330CBA47B990E3092BF709C441"><enum>(BB)</enum><text>meet the design
				criteria described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.40">section
				258.40(a)(1)</external-xref> of title 40, Code of Federal Regulations;
				and</text>
													</subitem></item><item id="HE4A6283C438D45978327E8F285EEFAEE"><enum>(bb)</enum><text>as
				of the date of enactment of this section, is subject to a State corrective
				action requirement.</text>
												</item></subclause></clause><clause id="HF57D612C4328483899DB5C1DB34820FC"><enum>(ii)</enum><header>Requirements</header>
											<subclause id="HC590897F5E8A45DD8BFEF328BE1CE1EB"><enum>(I)</enum><header>Deadlines</header>
												<item id="H023E6D3018984BBAB555AABC3C4F3644"><enum>(aa)</enum><header>In
				general</header><text>Except as provided in item (bb), subclause (IV), and
				clause (iii), the groundwater protection standard for structures identified in
				clause (i)(I) established by the agency responsible for implementing the coal
				combustion residuals permit program under section
				<external-xref legal-doc="usc" parsable-cite="usc/40/258">258.55(h)</external-xref> or
				<external-xref legal-doc="usc" parsable-cite="usc/40/258">258.55(i)</external-xref> of title 40, Code of
				Federal Regulations, for any constituent for which corrective measures are
				required shall be met—</text>
													<subitem id="HB1B529454E0E4084ADDA2A31C3DD8F87"><enum>(AA)</enum><text>as soon as
				practicable at the relevant point of compliance, as described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.40">section
				258.40(d)</external-xref> of title 40, Code of Federal Regulations; and</text>
													</subitem><subitem id="H1BDD55C8CB274956AC0BE6B2CA03CB83"><enum>(BB)</enum><text>not later than 10
				years after the date of enactment of this section.</text>
													</subitem></item><item id="H5CC47A160B3249E996D04B619D0E3297"><enum>(bb)</enum><header>Impoundments
				subject to State corrective action requirements</header><text>Except as
				provided in subclause (IV), the groundwater protection standard for structures
				identified in clause (i)(II) established by the agency responsible for
				implementing the coal combustion residuals permit program under section
				<external-xref legal-doc="usc" parsable-cite="usc/40/258">258.55(h)</external-xref> or
				<external-xref legal-doc="usc" parsable-cite="usc/40/258">258.55(i)</external-xref> of title 40, Code of
				Federal Regulations, for any constituent for which corrective measures are
				required shall be met—</text>
													<subitem id="H6C6F3A2B7A514051A1940DA7E8AC25DA"><enum>(AA)</enum><text>as soon as
				practicable at the relevant point of compliance, as described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.40">section
				258.40(d)</external-xref> of title 40, Code of Federal Regulations; and</text>
													</subitem><subitem id="HD9C24DBBECA343DE8A8F5A6E92596EC0"><enum>(BB)</enum><text>not later than 8
				years after the date of enactment of this section.</text>
													</subitem></item></subclause><subclause id="H6E468639FF184408A527169E9CA5C44E"><enum>(II)</enum><header>Closure</header><text>If
				the deadlines under clause (I) are not satisfied, the structure shall cease
				receiving coal combustion residuals and initiate closure under subsection
				(h).</text>
											</subclause><subclause id="H72AFED2B03DB43488F245DC86ABE0F45"><enum>(III)</enum><header>Interim
				measures</header>
												<item id="HBF79A20FDC6F492AA4A938AD6FF38EE3"><enum>(aa)</enum><header>In
				general</header><text>Except as provided in item (bb), not later than 90 days
				after the date on which the assessment of corrective measures is initiated, the
				owner or operator shall implement interim measures, as necessary, under the
				factors in <external-xref legal-doc="regulation" parsable-cite="cfr/40/258.58">section 258.58(a)(3)</external-xref> of title 40,
				Code of Federal Regulations.</text>
												</item><item id="HB7E446307FA94D21B3BA2DB0DFC3AFE1"><enum>(bb)</enum><header>Impoundments
				subject to state corrective action requirements</header><text>Item (aa) shall
				only apply to surface impoundments subject to a State corrective action
				requirement as of the date of enactment of this section if the owner or
				operator has not implemented interim measures, as necessary, under the factors
				in <external-xref legal-doc="regulation" parsable-cite="cfr/40/258.58">section
				258.58(a)(3)</external-xref> of title 40, Code of Federal Regulations.</text>
												</item></subclause><subclause id="HE5F0B2C86F164EB49BF746CBA7C96330"><enum>(IV)</enum><header>Extension of
				deadline</header>
												<item id="H2641762030234BC3855AF94C8C0AB41D"><enum>(aa)</enum><header>In
				general</header><text>Except as provided in item (bb), the deadline for meeting
				a groundwater protection standard under subclause (I) may be extended by the
				agency responsible for implementing the coal combustion residuals permit
				program, after opportunity for public notice and comment under the public
				participation process described in subsection (b)(2)(B)(iii)(III), based
				on—</text>
													<subitem id="H19BC40B74F9145CCAC3F3E09B2FCC8EC"><enum>(AA)</enum><text>the effectiveness
				of any interim measures implemented by the owner or operator of the facility
				under <external-xref legal-doc="regulation" parsable-cite="cfr/40/258.58">section 258.58(a)(3)</external-xref> of title 40,
				Code of Federal Regulations;</text>
													</subitem><subitem id="HA1393F2F4EB04C869321117ADA8F6B1D"><enum>(BB)</enum><text>the level of
				progress demonstrated in meeting the groundwater protection standard;</text>
													</subitem><subitem id="H7D8FFEF1920E4C51B2241299A92D21F4"><enum>(CC)</enum><text>the potential for
				other adverse human health or environmental exposures attributable to the
				contamination from the surface impoundment undergoing corrective action;
				and</text>
													</subitem><subitem id="H59BF3695ECE446A09D49203768E3A5D3"><enum>(DD)</enum><text>the lack of
				available alternative management capacity for the coal combustion residuals and
				related materials managed in the impoundment at the facility at which the
				impoundment is located if the owner or operator has used best efforts, as
				necessary, to design, obtain any necessary permits, finance, construct, and
				render operational the alternative management capacity during the time period
				for meeting a groundwater protection standard in subclause (I).</text>
													</subitem></item><item id="H401C6AFE852C4C158C09AF3103F8F33C"><enum>(bb)</enum><header>Exception</header><text>The
				deadlines under subclause (I) shall not be extended if there has been
				contamination of public or private drinking water systems attributable to a
				surface impoundment undergoing corrective action, unless the contamination has
				been addressed by providing a permanent replacement water system.</text>
												</item></subclause></clause><clause id="HB31FEC5A533A4E65AA8B89773DC0661D"><enum>(iii)</enum><header>Subsequent
				closure</header>
											<subclause id="H30CDB120B49242E2A77B87BB84B11BBB"><enum>(I)</enum><header>In
				general</header><text>In addition to the groundwater monitoring and corrective
				action requirements described in paragraph (2)(A)(ii), a coal combustion
				residuals permit program shall require a surface impoundment that receives coal
				combustion residuals after the date of enactment of this section to comply with
				the requirements in subclause (II) if the surface impoundment—</text>
												<item id="H7B59F44A2AC44A23A48DB930A0558285"><enum>(aa)</enum><text>does not—</text>
													<subitem id="HDE385AF7013D428E8B91BFBD94366106"><enum>(AA)</enum><text>have a liner
				system described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.40">section
				258.40(b)</external-xref> of title 40, Code of Federal Regulations; and</text>
													</subitem><subitem id="HA7B1B295551E45FF8E2C85DDFE1DBC10"><enum>(BB)</enum><text>meet the design
				criteria described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.40">section
				258.40(a)(1)</external-xref> of title 40, Code of Federal Regulations;</text>
													</subitem></item><item id="H6605F1173FF344F993617B08C3CB0F71"><enum>(bb)</enum><text>more than 10
				years after the date of enactment of this section, is required under
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.56">section
				258.56(a)</external-xref> of title 40, Code of Federal Regulations, to undergo
				an assessment of corrective measures for any constituent identified in
				paragraph (2)(A)(ii) for which assessment groundwater monitoring is required;
				and</text>
												</item><item id="H0C7EB633C4224C95A3D23BC2C3B8DBDA"><enum>(cc)</enum><text>is
				not subject to the requirements in clause (ii).</text>
												</item></subclause><subclause id="H790CB0D201364B6C819D87EA222A285F"><enum>(II)</enum><header>Requirements</header>
												<item id="H47079367AE904D57B6AA77DC84123272"><enum>(aa)</enum><header>Closure</header><text>The
				structures identified in subclause (I) shall cease receiving coal combustion
				residuals and initiate closure in accordance with subsection (h) after
				alternative management capacity for the coal combustion residuals and related
				materials managed in the impoundment at the facility is available.</text>
												</item><item id="HD906DF357B2C45078F1D07178B1787A6"><enum>(bb)</enum><header>Best
				efforts</header><text>The alternative management capacity shall be developed as
				soon as practicable with the owner or operator using best efforts to design,
				obtain necessary permits, finance, construct, and render operational the
				alternative management capacity.</text>
												</item><item id="H8448F8D23C474AACBFAC96A2E2685133"><enum>(cc)</enum><header>Alternative
				management capacity plan</header><text>The owner or operator shall, in
				collaboration with the agency responsible for implementing the coal combustion
				residuals permit program, prepare a written plan that describes the steps
				necessary to develop the alternative management capacity and includes a
				schedule for completion.</text>
												</item><item id="HECB4D5CD2DEC4112B308662D5CDDF4FF"><enum>(dd)</enum><header>Public
				participation</header><text>The plan described in item (cc) shall be subject to
				public notice and comment under the public participation process described in
				subsection (b)(2)(B)(iii)(III).</text>
												</item></subclause></clause></subparagraph></paragraph><paragraph id="H9B5403B413564E609335601EFB079EF5"><enum>(2)</enum><header>Revised
				criteria</header><text>The revised criteria described in this paragraph
				are—</text>
									<subparagraph id="H79C5175EC343455E919C7980D7698EE5"><enum>(A)</enum><text>the revised
				criteria for design, groundwater monitoring, corrective action, closure, and
				post-closure, for structures, including—</text>
										<clause id="H8A95A5A82184422BB2279B9A5CA43C1A"><enum>(i)</enum><text>for new
				structures, and lateral expansions of existing structures, that first receive
				coal combustion residuals after the date of enactment of this section, the
				revised criteria regarding design requirements described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.40">section
				258.40</external-xref> of title 40, Code of Federal Regulations, except that
				the leachate collection system requirements described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.40">section
				258.40(a)(2)</external-xref> of title 40, Code of Federal Regulations do not
				apply to structures that are surface impoundments;</text>
										</clause><clause id="H7AB3C04013484FCA8557EDCECEAA936C"><enum>(ii)</enum><text>for all
				structures that receive coal combustion residuals after the date of enactment
				of this section, the revised criteria regarding groundwater monitoring and
				corrective action requirements described in subpart E of part 258 of title 40,
				Code of Federal Regulations, except that, for the purposes of this paragraph,
				the revised criteria shall also include—</text>
											<subclause id="H484F3D78C8E5421AB461858DE9557024"><enum>(I)</enum><text>for the purposes
				of detection monitoring, the constituents boron, chloride, conductivity,
				fluoride, mercury, pH, sulfate, sulfide, and total dissolved solids; and</text>
											</subclause><subclause id="H1DC34C98C3E8469DB5B2532247B0360B"><enum>(II)</enum><text>for the purposes
				of assessment monitoring, establishing a groundwater protection standard, and
				assessment of corrective measures, the constituents aluminum, boron, chloride,
				fluoride, iron, manganese, molybdenum, pH, sulfate, and total dissolved
				solids;</text>
											</subclause></clause><clause id="H046F7722142347C299017DCD60A692D1"><enum>(iii)</enum><text>for all
				structures that receive coal combustion residuals after the date of enactment
				of this section, in a manner consistent with subsection (h), the revised
				criteria for closure described in subsections (a) through (c) and (h) through
				(j) of <external-xref legal-doc="regulation" parsable-cite="cfr/40/258.60">section 258.60</external-xref> of title 40, Code
				of Federal Regulations; and</text>
										</clause><clause id="H59949F4B2D5F4096B15430AA38D44076"><enum>(iv)</enum><text>for all
				structures that receive coal combustion residuals after the date of enactment
				of this section, the revised criteria for post-closure care described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.61">section
				258.61</external-xref> of title 40, Code of Federal Regulations, except for the
				requirement described in subsection (a)(4) of that section;</text>
										</clause></subparagraph><subparagraph id="H02B378F03EED41029A3C0D8171B07965"><enum>(B)</enum><text>the revised
				criteria for location restrictions described in—</text>
										<clause id="H17B0A510C712452CBFB5841F4D371E41"><enum>(i)</enum><text>for new
				structures, and lateral expansions of existing structures, that first receive
				coal combustion residuals after the date of enactment of this section, sections
				258.11 through 258.15 of title 40, Code of Federal Regulations; and</text>

				structures that receive coal combustion residuals after the date of enactment
				of this section, sections
				<external-xref legal-doc="usc" parsable-cite="usc/40/258">258.11</external-xref> and
				<external-xref legal-doc="usc" parsable-cite="usc/40/258">258.15</external-xref> of title 40, Code of Federal
				Regulations;</text>
										</clause></subparagraph><subparagraph id="HAEEA2DFDE685472BAD9B7CB77D33246E"><enum>(C)</enum><text>for all structures
				that receive coal combustion residuals after the date of enactment of this
				section, the revised criteria for air quality described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.24">section
				258.24</external-xref> of title 40, Code of Federal Regulations;</text>
									</subparagraph><subparagraph id="H5571EC625BEA45AF9BC093803AC74115"><enum>(D)</enum><text>for all structures
				that receive coal combustion residuals after the date of enactment of this
				section, the revised criteria for financial assurance described in subpart G of
				part 258 of title 40, Code of Federal Regulations;</text>
									</subparagraph><subparagraph id="H649538CD5EE341ED9525339EAD67A3DC"><enum>(E)</enum><text>for all structures
				that receive coal combustion residuals after the date of enactment of this
				section, the revised criteria for surface water described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.27">section
				258.27</external-xref> of title 40, Code of Federal Regulations;</text>
									</subparagraph><subparagraph id="H4F0144C8CECF4910ADF4C11CFC90D409"><enum>(F)</enum><text>for all structures
				that receive coal combustion residuals after the date of enactment of this
				section, the revised criteria for recordkeeping described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.29">section
				258.29</external-xref> of title 40, Code of Federal Regulations;</text>
									</subparagraph><subparagraph id="H36574D65B69C4362A73468155C9D493D"><enum>(G)</enum><text>for landfills and
				other land-based units, other than surface impoundments, that receive coal
				combustion residuals after the date of enactment of this section, the revised
				criteria for run-on and run-off control systems described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.26">section
				258.26</external-xref> of title 40, Code of Federal Regulations; and</text>
									</subparagraph><subparagraph id="H81DB240CBEE04511BD0D3F48A5B5E1C3"><enum>(H)</enum><text>for surface
				impoundments that receive coal combustion residuals after the date of enactment
				of this section, the revised criteria for run-off control systems described in
				<external-xref legal-doc="regulation" parsable-cite="cfr/40/258.26">section
				258.26(a)(2)</external-xref> of title 40, Code of Federal Regulations.</text>
									</subparagraph></paragraph></subsection><subsection id="H2AA3E95DAA5A49659FD210AF74586686"><enum>(d)</enum><header>Written notice
				and opportunity to remedy</header>
								<paragraph id="H7D8F231D810A4D7C9C3A075F752B6587"><enum>(1)</enum><header>In
				general</header><text>The Administrator shall provide to a State written notice
				and an opportunity to remedy deficiencies in accordance with paragraph (2) if
				at any time the State—</text>
									<subparagraph id="HA738B41F44EE40088F4477F1BC76CD4F"><enum>(A)</enum><text>does not satisfy
				the notification requirement under subsection (b)(1);</text>
									</subparagraph><subparagraph id="H9FB1B74A41CB456382128851949237BB"><enum>(B)</enum><text>has not submitted
				a certification under subsection (b)(2);</text>
									</subparagraph><subparagraph id="H23F5F5F08B514B34BA8AEF0DFCFD6ADC"><enum>(C)</enum><text>does not satisfy
				the maintenance requirement under subsection (b)(3);</text>
									</subparagraph><subparagraph id="H2C344E24D555470CBB911C647B073B40"><enum>(D)</enum><text>is not
				implementing a coal combustion residuals permit program that—</text>
										<clause id="HE30468C2D19043D2B1CA359F5F434CD0"><enum>(i)</enum><text>meets the
				specifications described in subsection (c); or</text>
										</clause><clause id="H0BE7C8BB61AF44C58E637F6B288A15CF"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H4BA94082F84044DCBD91F69195FDF98D"><enum>(I)</enum><text>is consistent with the
				certification under subsection (b)(2)(B)(iii); and</text>
											</subclause><subclause id="H3CD0822F645B4403AA9EA84F4E2D4BAD"><enum>(II)</enum><text>maintains fully
				effective statutes or regulations necessary to implement a coal combustion
				residuals permit program; or</text>
											</subclause></clause></subparagraph><subparagraph id="H1B0969D6AB3C4A618BABA13CF68D70EC"><enum>(E)</enum><text>does not make
				available to the Administrator, within 90 days of a written request, specific
				information necessary for the Administrator to ascertain whether the State has
				complied with subparagraphs (A) through (D).</text>
									</subparagraph></paragraph><paragraph id="H3B0CDB4330A9440C9324CC961DCD13E4"><enum>(2)</enum><header>Request</header><text>If
				the request described in paragraph (1)(E) is made pursuant to a petition of the
				Administrator, the Administrator shall only make the request if the
				Administrator does not possess the information necessary to ascertain whether
				the State has complied with subparagraphs (A) through (D) of paragraph
				(1).</text>
								</paragraph><paragraph id="HC18E0230304B4E3A937F1F48C004A3E0"><enum>(3)</enum><header>Contents of
				notice; deadline for response</header><text>A notice provided under this
				subsection shall—</text>
									<subparagraph id="H0158DE3CD5284F219F907BA02A9424C8"><enum>(A)</enum><text>include findings
				of the Administrator detailing any applicable deficiencies in—</text>
										<clause id="HDEECD069393748B5AF1B96A08610EFA6"><enum>(i)</enum><text>compliance by the
				State with the notification requirement under subsection (b)(1);</text>
										</clause><clause id="HEC8040A96D604C8A9BB7594B66B564A0"><enum>(ii)</enum><text>compliance by the
				State with the certification requirement under subsection (b)(2);</text>
										</clause><clause id="H5718E5A1FD58434287D15264DEE00AFF"><enum>(iii)</enum><text>compliance by
				the State with the maintenance requirement under subsection (b)(3);</text>
										</clause><clause id="HF293A155DD4E49FABA3CE5AD09075438"><enum>(iv)</enum><text>the State coal
				combustion residuals permit program in meeting the specifications described in
				subsection (c); and</text>
										</clause><clause id="H5317B9FF41BD46F4BB720F0AF97CA6C7"><enum>(v)</enum><text>compliance by the
				State with the request under paragraph (1)(E); and</text>
										</clause></subparagraph><subparagraph id="HB2B9A8BE6F4C4A0BA303BAEFADC414C3"><enum>(B)</enum><text>identify, in
				collaboration with the State, a reasonable deadline, by which the State shall
				remedy the deficiencies detailed under subparagraph (A), which shall be—</text>
										<clause id="H2C458FFC8FEE40889551C7352544AB20"><enum>(i)</enum><text>in
				the case of a deficiency described in clauses (i) through (iv) of subparagraph
				(A), not earlier than 180 days after the date on which the State receives the
				notice; and</text>
										</clause><clause id="H46F83E39C89E4CEBB74DB32D64BC312A"><enum>(ii)</enum><text>in the case of a
				deficiency described in subparagraph (A)(v), not later than 90 days after the
				date on which the State receives the notice.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="HE65E96B4A78A4E75B224CB4866EB13FE"><enum>(e)</enum><header>Implementation
				by administrator</header>
								<paragraph id="H6244CF2766564DDC9E1457707F332FB7"><enum>(1)</enum><header>In
				general</header><text>The Administrator shall implement a coal combustion
				residuals permit program for a State only if—</text>
									<subparagraph id="HDBA61AE2F3974C098F776CB80F1C4AEF"><enum>(A)</enum><text>the Governor of
				the State notifies the Administrator under subsection (b)(1) that the State
				will not adopt and implement a permit program;</text>
									</subparagraph><subparagraph id="HA70EE56177E946E0BACEDD64CC6367EF"><enum>(B)</enum><text>the State has
				received a notice under subsection (d) and the Administrator determines, after
				providing a 30-day period for notice and public comment, that the State has
				failed, by the deadline identified in the notice under subsection (d)(3)(B), to
				remedy the deficiencies detailed in the notice under subsection (d)(3)(A);
				or</text>
									</subparagraph><subparagraph id="HDA60564EA50040F299CFDDC8D1CC6E02"><enum>(C)</enum><text>the State informs
				the Administrator, in writing, that such State will no longer implement such a
				permit program.</text>
									</subparagraph></paragraph><paragraph id="H1ED088962DD2468FBA1671D0EDAEF37A"><enum>(2)</enum><header>Review</header><text>A
				State may obtain a review of a determination by the Administrator under this
				subsection as if the determination was a final regulation for purposes of
				section 7006.</text>
								</paragraph><paragraph id="H4187786638934BCBA74EAE1D69BB9851"><enum>(3)</enum><header>Other
				structures</header><text>For structures located on property within the exterior
				boundaries of a State for which the State does not have authority or
				jurisdiction to regulate, the Administrator shall implement a coal combustion
				residuals permit program only for those structures.</text>
								</paragraph><paragraph id="H372E453BFCC14781A907524C84188F18"><enum>(4)</enum><header>Requirements</header><text>If
				the Administrator implements a coal combustion residuals permit program for a
				State under paragraph (1) or (3), the permit program shall consist of the
				specifications described in subsection (c).</text>
								</paragraph><paragraph id="H7D1E44DE17764E44AE367748AA4F797D"><enum>(5)</enum><header>Enforcement</header>
									<subparagraph id="HAA30EA3E34224EE4A374D52175A5BBCE"><enum>(A)</enum><header>In
				general</header><text>If the Administrator implements a coal combustion
				residuals permit program for a State under paragraph (1)—</text>
										<clause id="HB5FD7864450B41BAA771EAD4DC34024D"><enum>(i)</enum><text>the authorities
				referred to in section 4005(c)(2)(A) shall apply with respect to coal
				combustion residuals and structures for which the Administrator is implementing
				the coal combustion residuals permit program; and</text>
										</clause><clause id="HBB6CF6C916D14DE8991EC1533DAEA7CB"><enum>(ii)</enum><text>the Administrator
				may use those authorities to inspect, gather information, and enforce the
				requirements of this section in the State.</text>
										</clause></subparagraph><subparagraph id="H207D7A2573DC434DB832DD71BD37EA4E"><enum>(B)</enum><header>Other
				structures</header><text>If the Administrator implements a coal combustion
				residuals permit program for a State under paragraph (3)—</text>
										<clause id="HA04E5461A7CD4CAFBF17C000CF5FE5FF"><enum>(i)</enum><text>the authorities
				referred to in section 4005(c)(2)(A) shall apply with respect to coal
				combustion residuals and structures for which the Administrator is implementing
				the coal combustion residuals permit program; and</text>
										</clause><clause id="H8B5B067C7B8742A381EB8DF348A8982D"><enum>(ii)</enum><text>the Administrator
				may use those authorities to inspect, gather information, and enforce the
				requirements of this section for the structures for which the Administrator is
				implementing the coal combustion residuals permit program.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="H5FB5463D27694E7F87C98714B052A5CF"><enum>(f)</enum><header>State control
				after implementation by administrator</header>
								<paragraph id="HCA0794BDDA3F4B32BF6449CBA087D22C"><enum>(1)</enum><header>State
				control</header>
									<subparagraph id="H6CC06AF1DA374AE49ACE173AF55E70D5"><enum>(A)</enum><header>New adoption and
				implementation by state</header><text>For a State for which the Administrator
				is implementing a coal combustion residuals permit program under subsection
				(e)(1)(A), the State may adopt and implement such a permit program by—</text>
										<clause id="H9C60CE04C28440848A297BFD0C6F17FB"><enum>(i)</enum><text>notifying the
				Administrator that the State will adopt and implement such a permit
				program;</text>
										</clause><clause id="H40CFA3FCE1A2436DBC00507352B4C13E"><enum>(ii)</enum><text>not later than 6
				months after the date of such notification, submitting to the Administrator a
				certification under subsection (b)(2); and</text>
										</clause><clause id="HD7376AB7185649F8A7C77FA0ED28423C"><enum>(iii)</enum><text>receiving from
				the Administrator—</text>
											<subclause id="HE610E3AB95CB4CE0BBF5A07AA11E7FC3"><enum>(I)</enum><text>a determination,
				after providing a 30-day period for notice and public comment that the State
				coal combustion residuals permit program meets the specifications described in
				subsection (c); and</text>
											</subclause><subclause id="H5654644FECE94155890598B61E5BACD7"><enum>(II)</enum><text>a timeline for
				transition of control of the coal combustion residuals permit program.</text>
											</subclause></clause></subparagraph><subparagraph id="H601559C19BFB4721978A17E98DE7FFE0"><enum>(B)</enum><header>Remedying
				deficient permit program</header><text>For a State for which the Administrator
				is implementing a coal combustion residuals permit program under subsection
				(e)(1)(B), the State may adopt and implement such a permit program by—</text>
										<clause id="H12A7230E5E954D47BDEDAB4841475332"><enum>(i)</enum><text>remedying only the
				deficiencies detailed in the notice provided under subsection (d)(3)(A);
				and</text>
										</clause><clause id="H3485FA55995A4475A912DAD8B3E2F24D"><enum>(ii)</enum><text>receiving from
				the Administrator—</text>
											<subclause id="H78E12B0D62B6425D80684DA6162B4808"><enum>(I)</enum><text>a determination,
				after providing a 30-day period for notice and public comment, that the
				deficiencies detailed in such notice have been remedied; and</text>
											</subclause><subclause id="H1FED4891D4264619A20D754DE5B64FCF"><enum>(II)</enum><text>a timeline for
				transition of control of the coal combustion residuals permit program.</text>
											</subclause></clause></subparagraph><subparagraph id="H09E6BEFC989C499BBCCCF38A11FE5B77"><enum>(C)</enum><header>Resumption of
				implementation by state</header><text>For a State for which the Administrator
				is implementing a coal combustion residuals permit program under subsection
				(e)(1)(C), the State may adopt and implement such a permit program by—</text>
										<clause id="H1FBC65116F524EC5ACA62F22357C9AF1"><enum>(i)</enum><text>notifying the
				Administrator that the State will adopt and implement such a permit
				program;</text>
										</clause><clause id="H4F574AAAE89B428DA253F5A7FF8BDC31"><enum>(ii)</enum><text>not later than 6
				months after the date of such notification, submitting to the Administrator a
				certification under subsection (b)(2); and</text>
										</clause><clause id="HA79478DD40CD4C99A8768A8850366DE0"><enum>(iii)</enum><text>receiving from
				the Administrator—</text>
											<subclause id="HB1259290A4BD4A4A92774ADBA02FF521"><enum>(I)</enum><text>a determination,
				after providing a 30-day period for notice and public comment, that the State
				coal combustion residuals permit program meets the specifications described in
				subsection (c); and</text>
											</subclause><subclause id="H37FB47DF05DF4FBE93475BEFD0106582"><enum>(II)</enum><text>a timeline for
				transition of control of the coal combustion residuals permit program.</text>
											</subclause></clause></subparagraph></paragraph><paragraph id="H7F99BD097A784699BDF832561CA74186"><enum>(2)</enum><header>Review of
				determination</header>
									<subparagraph id="H4B155E61CBBB4F458025AE0869D8EA61"><enum>(A)</enum><header>Determination
				required</header><text>The Administrator shall make a determination under
				paragraph (1) not later than 90 days after the date on which the State submits
				a certification under paragraph (1)(A)(ii) or (1)(C)(ii), or notifies the
				Administrator that the deficiencies have been remedied pursuant to paragraph
				(1)(B)(i), as applicable.</text>
									</subparagraph><subparagraph id="HE2877CB71555413E899A7293E7D115B2"><enum>(B)</enum><header>Review</header><text>A
				State may obtain a review of a determination by the Administrator under
				paragraph (1) as if such determination was a final regulation for purposes of
				section 7006.</text>
									</subparagraph></paragraph><paragraph id="HCE9C75022DBB48C1B55B3ADFA61FD7A6"><enum>(3)</enum><header>Implementation
				during transition</header>
									<subparagraph id="HEAE23ECF2CD14CBB8BA5DDF5E6788105"><enum>(A)</enum><header>Effect on
				actions and orders</header><text>Actions taken or orders issued pursuant to a
				coal combustion residuals permit program shall remain in effect if—</text>
										<clause id="HE7EE40AD207C48B0AB412F4A2154FA4F"><enum>(i)</enum><text>a
				State takes control of its coal combustion residuals permit program from the
				Administrator under paragraph (1); or</text>
										</clause><clause id="H3B97103798C54271921F94CD085C7D49"><enum>(ii)</enum><text>the Administrator
				takes control of a coal combustion residuals permit program from a State under
				subsection (e).</text>
										</clause></subparagraph><subparagraph id="HD15B4339BBC64CD5B1299AEC152BCA59"><enum>(B)</enum><header>Change in
				requirements</header><text>Subparagraph (A) shall apply to such actions and
				orders until such time as the Administrator or the head of the lead State
				agency responsible for implementing the coal combustion residuals permit
				program, as applicable—</text>
										<clause id="H361AC32E36C147D0A029BD8BB9C9338D"><enum>(i)</enum><text>implements changes
				to the requirements of the coal combustion residuals permit program with
				respect to the basis for the action or order; or</text>
										</clause><clause id="H8601BCA1905646F8BE1E02407C396458"><enum>(ii)</enum><text>certifies the
				completion of a corrective action that is the subject of the action or
				order.</text>
										</clause></subparagraph></paragraph><paragraph id="HE6EF33EC77454CEF983F8796891AADAC"><enum>(4)</enum><header>Single permit
				program</header><text>If a State adopts and implements a coal combustion
				residuals permit program under this subsection, the Administrator shall cease
				to implement the permit program implemented under subsection (e)(1) for such
				State.</text>
								</paragraph></subsection><subsection id="HF3CB3969D8324529B418FB7A9E1E1BFD"><enum>(g)</enum><header>Effect on
				determination under 4005(c) or 3006</header><text>The Administrator shall not
				consider the implementation of a coal combustion residuals permit program by
				the Administrator under subsection (e) in making a determination of approval
				for a permit program or other system of prior approval and conditions under
				section 4005(c) or of authorization for a program under section 3006.</text>
							</subsection><subsection id="H48A6C89F3F23428DA07D6AC4A64B5AC3"><enum>(h)</enum><header>Closure</header>
								<paragraph id="H0E42ACFE24094385864FF5D61B9E8AE1"><enum>(1)</enum><header>In
				general</header><text>If it is determined, pursuant to a coal combustion
				residuals permit program, that a structure should close, the time period and
				method for the closure of such structure shall be set forth in a closure plan
				that establishes a deadline for completion and that takes into account the
				nature and the site-specific characteristics of the structure to be
				closed.</text>
								</paragraph><paragraph id="HE59B45DD8E694197BD94C916F84F5760"><enum>(2)</enum><header>Surface
				impoundment</header><text>In the case of a surface impoundment, the closure
				plan under paragraph (1) shall require, at a minimum, the removal of liquid and
				the stabilization of remaining waste, as necessary to support the final
				cover.</text>
								</paragraph></subsection><subsection id="HC3CD131E8D3C4DFB8CCF12D408B03001"><enum>(i)</enum><header>Authority</header>
								<paragraph id="HE2B48258A1144F74BA4125E80D252252"><enum>(1)</enum><header>State
				authority</header><text display-inline="yes-display-inline">Nothing in this
				section shall preclude or deny any right of any State to adopt or enforce any
				regulation or requirement respecting coal combustion residuals that is more
				stringent or broader in scope than a regulation or requirement under this
				section.</text>
								</paragraph><paragraph id="H6E6DEC15A1EA49DFBE9E2E0CCD9C9C9F"><enum>(2)</enum><header>Authority of the
				administrator</header>
									<subparagraph id="H8B12CFE38E5A46798A79A1C8C4EA894A"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				subsections (d) and (e) and section 6005, the Administrator shall, with respect
				to the regulation of coal combustion residuals, defer to the States pursuant to
				this section.</text>
									</subparagraph><subparagraph id="HFBDCA23243F84925B9E547C295C2E85B"><enum>(B)</enum><header>Imminent
				hazard</header><text>Nothing in this section shall be construed as affecting
				the authority of the Administrator under section 7003 with respect to coal
				combustion residuals.</text>
									</subparagraph><subparagraph id="HFBF2D8BE85D6441B88C2950B5FD5A7A1"><enum>(C)</enum><header>Enforcement
				assistance only upon request</header><text>Upon request from the head of a lead
				State agency that is implementing a coal combustion residuals permit program,
				the Administrator may provide to such State agency only the enforcement
				assistance requested.</text>
									</subparagraph><subparagraph id="HC63C6AD9A2EF435CBC5DBE3B3DC6A0BA"><enum>(D)</enum><header>Concurrent
				enforcement</header><text>Except as provided in subparagraph (C), the
				Administrator shall not have concurrent enforcement authority when a State is
				implementing a coal combustion residuals permit program.</text>
									</subparagraph><subparagraph commented="no" id="H8274860C5F9C47F6A9CAD047E1D9708E"><enum>(E)</enum><header>Other
				authority</header><text>The Administrator shall not have authority to finalize
				the proposed rule published at pages 35128 through 35264 of volume 75 of the
				Federal Register (June 21, 2010).</text>
									</subparagraph></paragraph><paragraph id="H9A69E296EA74471FA7015B2183AD1311"><enum>(3)</enum><header>Citizen
				suits</header><text>Nothing in this section shall be construed to affect the
				authority of a person to commence a civil action in accordance with section
				7002.</text>
								</paragraph></subsection><subsection id="H33A190535B434867B5F79A5B311DCD3A"><enum>(j)</enum><header>Mine reclamation
				activities</header><text>A coal combustion residuals permit program implemented
				by the Administrator under subsection (e) shall not apply to the utilization,
				placement, and storage of coal combustion residuals at surface mining and
				reclamation operations.</text>
							</subsection><subsection id="HE5A80E9F58B0433F996118CC0746BA46"><enum>(k)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="H7851C294C0054FFEBB0A73A0E8571A23"><enum>(1)</enum><header>Coal combustion
				residuals</header><text>The term <term>coal combustion residuals</term>
				means—</text>
									<subparagraph id="H86A9DADD927547F58F4151A9C33FE6B3"><enum>(A)</enum><text>the solid wastes
				listed in section 3001(b)(3)(A)(i), including recoverable materials from such
				wastes;</text>
									</subparagraph><subparagraph id="HC5DAB7176FB741E388018181088152DB"><enum>(B)</enum><text>coal combustion
				wastes that are co-managed with wastes produced in conjunction with the
				combustion of coal, provided that such wastes are not segregated and disposed
				of separately from the coal combustion wastes and comprise a relatively small
				proportion of the total wastes being disposed in the structure;</text>
									</subparagraph><subparagraph id="H53B92A2F9158455597B0D137B28D4374"><enum>(C)</enum><text>fluidized bed
				combustion wastes;</text>
									</subparagraph><subparagraph id="H631404B3548D42CCB53D6CF0C0601D9C"><enum>(D)</enum><text>wastes from the
				co-burning of coal with non-hazardous secondary materials, provided that coal
				makes up at least 50 percent of the total fuel burned; and</text>
									</subparagraph><subparagraph id="H432F5BE9D9F846F5BB95DF19158EC87D"><enum>(E)</enum><text>wastes from the
				co-burning of coal with materials described in subparagraph (A) that are
				recovered from monofills.</text>
									</subparagraph></paragraph><paragraph id="H94BFC694B27649DFA4DDADA388B83C50"><enum>(2)</enum><header>Coal combustion
				residuals permit program</header><text>The term <term>coal combustion residuals
				permit program</term> means all of the authorities, activities, and procedures
				that comprise the system of prior approval and conditions implemented by or for
				a State to regulate the management and disposal of coal combustion
				residuals.</text>
								</paragraph><paragraph id="H1A854C32732243F89FC39AA36D837958"><enum>(3)</enum><header>Code of federal
				regulations</header><text>The term <term>Code of Federal Regulations</term>
				means the Code of Federal Regulations (as in effect on the date of enactment of
				this section) or any successor regulations.</text>
								</paragraph><paragraph id="HFA23CC0F308D44E183DEC4C26AE07028"><enum>(4)</enum><header>Permit; prior
				approval and conditions</header><text>The terms <term>permit</term> and
				<term>prior approval and conditions</term> mean any authorization, license, or
				equivalent control document that incorporates the requirements and revised
				criteria described in paragraphs (1) and (2) of subsection (c),
				respectively.</text>
								</paragraph><paragraph id="H8691047CA2C346C9A7DF18ECE950E69A"><enum>(5)</enum><header>Revised
				criteria</header><text>The term <term>revised criteria</term> means the
				criteria promulgated for municipal solid waste landfill units under section
				4004(a) and under section 1008(a)(3), as revised under section 4010(c).</text>
								</paragraph><paragraph id="H63A41BFF37094006B0F5A9134985DFCD"><enum>(6)</enum><header>Structure</header>
									<subparagraph id="H9531098EE3124893B729C409F94D2C41"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), the term
				<term>structure</term> means a landfill, surface impoundment, or other
				land-based unit which may receive coal combustion residuals.</text>
									</subparagraph><subparagraph id="HEF2D14F4284543ED808066DA8C12D9D6"><enum>(B)</enum><header>De minimis
				receipt</header><text>The term <term>structure</term> does not include any
				land-based unit that receives only de minimis quantities of coal combustion
				residuals if the presence of coal combustion residuals is incidental to the
				material managed in the
				unit.</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H7BB06CB2A1DE442E8C9D488DF69B2DDE"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents contained in section 1001 of the
			 Solid Waste Disposal Act is amended by inserting after the item relating to
			 section 4010 the following:</text>

			 Fossil Fuels</quote>, published at 65 Fed. Reg. 32214 (May 22, 2000), that the
			 fossil fuel combustion wastes addressed in that determination do not warrant
			 regulation under subtitle C of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6921">42 U.S.C. 6921 et
			 seq.</external-xref>).</text>
			</section><section id="HD9B5979C061F4D048A4282413C90F94D"><enum>403.</enum><header>Technical
			 assistance</header><text display-inline="no-display-inline">Nothing in this
			 title, or the amendments made by this title, shall be construed to affect the
			 authority of a State to request, or the Administrator of the Environmental
			 Protection Agency to provide, technical assistance under the Solid Waste
			 Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42
			 U.S.C. 6901 et seq.</external-xref>).</text>
			</section><section id="H8B082C0D5BA24AF58E29EF1B93424D20"><enum>404.</enum><header>Federal Power
			 Act</header><text display-inline="no-display-inline">Nothing in this title, or
			 the amendments made by this title, shall be construed to affect the obligations
			 of the owner or operator of a structure (as defined in section 4011 of the
			 Solid Waste Disposal Act, as added by this title) under section 215(b)(1) of
			 the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(b)(1)</external-xref>).</text>
			</section></title><title id="HA3B54160AAE7415E862191107A31D18D"><enum>V</enum><header>Preserving State
			 authority to make determinations relating to water quality standards</header>
			<section id="HEC9B973BD82749CDB7759054D6FF491E"><enum>501.</enum><header>State water
			 quality standards</header>
				<subsection id="HF102829E73A64DB187EF99F1E0EBF0A3"><enum>(a)</enum><header>State water
			 quality standards</header><text display-inline="yes-display-inline">Section
			 303(c)(4) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1313">33 U.S.C.
			 1313(c)(4)</external-xref>) is amended—</text>
					<paragraph id="H2DF8DAE20ADF4A269038F453C3714DE9"><enum>(1)</enum><text>by redesignating
			 subparagraphs (A) and (B) as clauses (i) and (ii), respectively;</text>
					</paragraph><paragraph id="H8F9C44397D3C41AAB13A58D41A36A05D"><enum>(2)</enum><text>by striking
			 <quote>(4)</quote> and inserting <quote>(4)(A)</quote>;</text>
					</paragraph><paragraph id="H9994CDED3D024101B0A5EA32BF8885C2"><enum>(3)</enum><text>by striking
			 <quote>The Administrator shall promulgate</quote> and inserting the

				Administrator may not promulgate a revised or new standard for a pollutant in
				any case in which the State has submitted to the Administrator and the
				Administrator has approved a water quality standard for that pollutant, unless
				the State concurs with the Administrator’s determination that the revised or
				new standard is necessary to meet the requirements of this
				Act.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H5E787DFAF45F401B86B82F32A9B806AD"><enum>(b)</enum><header>Federal licenses
			 and permits</header><text>Section 401(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1341">33 U.S.C. 1341(a)</external-xref>)
			 is amended by adding at the end the following:</text>
					<quoted-block id="HC09CAC5CFEE64E5DB342D53EB1125146" style="OLC">
						<paragraph id="HA8BCD7A0D8124CF4894E69A794EAA855" indent="up1"><enum>(7)</enum><text>With respect to any discharge, if a
				State or interstate agency having jurisdiction over the navigable waters at the
				point where the discharge originates or will originate determines under
				paragraph (1) that the discharge will comply with the applicable provisions of
				sections 301, 302, 303, 306, and 307, the Administrator may not take any action
				to supersede the
				determination.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H9E6CE0E3DD9846B098FBFB3076457499"><enum>(c)</enum><header>State NPDES
			 permit programs</header><text>Section 402(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1342">42 U.S.C. 1342(c)</external-xref>)
			 is amended by adding at the end the following:</text>
					<quoted-block id="H2332CEADE8BD48638F7048F8119FBDC3" style="OLC">
						<paragraph id="H9F1187629D5D4F74A082F04AC1D13996"><enum>(5)</enum><header>Limitation on
				authority of Administrator to withdraw approval of State
				programs</header><text>The Administrator may not withdraw approval of a State
				program under paragraph (3) or (4), or limit Federal financial assistance for
				the State program, on the basis that the Administrator disagrees with the State
				regarding—</text>
							<subparagraph id="HCEE7621128EA4B4CB33504DCE9BC825E"><enum>(A)</enum><text>the implementation
				of any water quality standard that has been adopted by the State and approved
				by the Administrator under section 303(c); or</text>
							</subparagraph><subparagraph id="HBA5DA404F3BE4338B7369D5C0A6F2615"><enum>(B)</enum><text>the implementation
				of any Federal guidance that directs the interpretation of the State’s water
				quality
				standards.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HD0776E9746084399BC03BD0C46A43403"><enum>(d)</enum><header>Limitation on
			 authority of Administrator To object to individual
			 permits</header><text>Section 402(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342(d)</external-xref>)
			 is amended by adding at the end the following:</text>
					<quoted-block id="H463727C6AF2F4F13B2F1370E6689416B" style="OLC">
						<paragraph id="HBED6396D60C3431BBA0A99D0DC0CF06D" indent="up1"><enum>(5)</enum><text>The Administrator may not object
				under paragraph (2) to the issuance of a permit by a State on the basis
				of—</text>
							<subparagraph id="H7B04C88A4D5E457B9B21387FD29741BD"><enum>(A)</enum><text>the Administrator’s interpretation of
				a water quality standard that has been adopted by the State and approved by the
				Administrator under section 303(c); or</text>
							</subparagraph><subparagraph id="H3AC2DD524A8A4ADC830AA11EB7AAA0E0"><enum>(B)</enum><text>the implementation of any Federal
				guidance that directs the interpretation of the State’s water quality
				standards.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H559420E655684D9EA81B292947EF4868"><enum>502.</enum><header>Permits for
			 dredged or fill material</header>
				<subsection id="H398DD2E71B6B4DE3BB52B0667F3A37B2"><enum>(a)</enum><header>Authority of EPA
			 Administrator</header><text>Section 404(c) of the Federal Water Pollution
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33
			 U.S.C. 1344(c)</external-xref>) is amended—</text>
					<paragraph id="H994D4DC8406E435C812391899329F3D8"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(c)</quote> and
			 inserting <quote>(c)(1)</quote>; and</text>
					</paragraph><paragraph id="HCD1563EF8B6D4A479C2BBD1131D413A1"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="HC6BAB4C4EAA64BEE8C903E5737DA9423" style="OLC">
							<paragraph id="H607C26293BDA4A6FBAEFE9513758BA8C" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Paragraph (1) shall not apply to any permit
				if the State in which the discharge originates or will originate does not
				concur with the Administrator’s determination that the discharge will result in
				an unacceptable adverse effect as described in paragraph (1).</text>
							</paragraph><paragraph id="H359411ACF52A43AAB5737BDAE77BCEA2" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Following the date of issuance of a permit
				by the Secretary in accordance with this section, the Administrator may not
				take any action under paragraph (1) to retroactively invalidate the
				permit.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H35B83A73BA554F8B92F995280E16646F"><enum>(b)</enum><header>State permit
			 programs</header><text>The first sentence of section 404(g)(1) of such Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C.
			 1344(g)(1)</external-xref>) is amended by striking <quote>The Governor of any
			 State desiring to administer its own individual and general permit program for
			 the discharge</quote> and inserting <quote>The Governor of any State desiring
			 to administer its own individual and general permit program for some or all of
			 the discharges</quote>.</text>
				</subsection></section><section id="HC367569D54044CA49670E6DAEBEF34B6"><enum>503.</enum><header>Deadlines for
			 agency comments</header><text display-inline="no-display-inline">Section 404 of
			 the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>) is amended—</text>
				<paragraph id="H81F8D2DE11CB473D9B10447B92D11BC3"><enum>(1)</enum><text>in subsection (m)
			 by striking <quote>ninetieth day</quote> and inserting <quote>30th day (or the
			 60th day if additional time is requested)</quote>; and</text>
				</paragraph><paragraph id="HF6E81F54CE67453287C068D27EAEE50A"><enum>(2)</enum><text>in subsection
			 (q)—</text>
					<subparagraph id="H57A4101D1A364B39812DB24357E67B05"><enum>(A)</enum><text>by striking
			 <quote>(q)</quote> and inserting <quote>(q)(1)</quote>; and</text>
					</subparagraph><subparagraph id="HF0047A820E17490389F5C7B13076EBF0"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H82194F6F47CE4BAAB5780ECBC3539001" style="OLC">
							<paragraph id="H0E525D9016964760856F24B6097CD35C" indent="up1"><enum>(2)</enum><text>The Administrator and the head of a
				department or agency referred to in paragraph (1) shall each submit any
				comments with respect to an application for a permit under subsection (a) or
				(e) not later than the 30th day (or the 60th day if additional time is
				requested) after the date of receipt of an application for a permit under that
				subsection.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></section><section id="H5F2B3061886B45A1BC3EC38012EDF082"><enum>504.</enum><header>Applicability
			 of amendments</header><text display-inline="no-display-inline">The amendments
			 made by this title shall apply to actions taken on or after the date of
			 enactment of this Act, including actions taken with respect to permit
			 applications that are pending or revised or new standards that are being
			 promulgated as of such date of enactment.</text>
			</section><section id="H076891D743874CF6BE3F0C5032125B9C"><enum>505.</enum><header>Reporting on
			 harmful pollutants</header><text display-inline="no-display-inline">Not later
			 than 1 year after the date of enactment of this Act, and annually thereafter,
			 the Administrator of the Environmental Protection Agency shall submit to
			 Congress a report on any increase or reduction in waterborne pathogenic
			 microorganisms (including protozoa, viruses, bacteria, and parasites), toxic
			 chemicals, or toxic metals (such as lead and mercury) in waters regulated by a
			 State under the provisions of this title, including the amendments made by this
			 title.</text>
			</section><section id="H52476F65F20146748AAF0E48633A83FE"><enum>506.</enum><header>Pipelines
			 crossing streambeds</header><text display-inline="no-display-inline">None of
			 the provisions of this title, including the amendments made by this title,
			 shall be construed to limit the authority of the Administrator of the
			 Environmental Protection Agency, as in effect on the day before the date of
			 enactment of this Act, to regulate a pipeline that crosses a streambed.</text>
			</section><section id="H7B5588F251924FCEBF3CA08A86B0E166"><enum>507.</enum><header>Impacts of EPA
			 regulatory activity on employment and economic activity</header>
				<subsection id="H3262431066334F7F99340DD725B41346"><enum>(a)</enum><header>Analysis of
			 impacts of actions on employment and economic activity</header>
					<paragraph id="H567BADEA5A2941999D97468C7E86ED9D"><enum>(1)</enum><header>Analysis</header><text display-inline="yes-display-inline">Before taking a covered action, the
			 Administrator shall analyze the impact, disaggregated by State, of the covered
			 action on employment levels and economic activity, including estimated job
			 losses and decreased economic activity.</text>
					</paragraph><paragraph id="H153238A34C154CDD9A63E72B2D6E7A77"><enum>(2)</enum><header>Economic
			 models</header>
						<subparagraph id="H158EFBE99F9A4A74A9781E330D58630F"><enum>(A)</enum><header>In
			 general</header><text>In carrying out paragraph (1), the Administrator shall
			 utilize the best available economic models.</text>
						</subparagraph><subparagraph id="HB6D75513906C493BAE146629C1B4611F"><enum>(B)</enum><header>Annual GAO
			 report</header><text>Not later than December 31st of each year, the Comptroller
			 General of the United States shall submit to Congress a report on the economic
			 models used by the Administrator to carry out this subsection.</text>
						</subparagraph></paragraph><paragraph id="H63BD2897C5BF48368FD0D09133DC2FB0"><enum>(3)</enum><header>Availability of
			 information</header><text>With respect to any covered action, the Administrator
			 shall—</text>
						<subparagraph id="HFA58EF4F23F44F0DAAE27B56F3A2E54D"><enum>(A)</enum><text>post the analysis
			 under paragraph (1) as a link on the main page of the public Internet Web site
			 of the Environmental Protection Agency; and</text>
						</subparagraph><subparagraph id="H5CB63F3B676545EFA726B43B8DB5B6F8"><enum>(B)</enum><text display-inline="yes-display-inline">request that the Governor of any State
			 experiencing more than a de minimis negative impact post such analysis in the
			 Capitol of such State.</text>
						</subparagraph></paragraph></subsection><subsection id="HACDEC660C8AB44F8A37503A9B5B5CDCC"><enum>(b)</enum><header>Public
			 hearings</header>
					<paragraph id="H5ABE66E69E2B485DA3C09048D54C6A87"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">If the Administrator
			 concludes under subsection (a)(1) that a covered action will have more than a
			 de minimis negative impact on employment levels or economic activity in a
			 State, the Administrator shall hold a public hearing in each such State at
			 least 30 days prior to the effective date of the covered action.</text>
					</paragraph><paragraph id="H308A2071DA36498588B36E77DF56A6E4"><enum>(2)</enum><header>Time, location,
			 and selection</header><text>A public hearing required under paragraph (1) shall
			 be held at a convenient time and location for impacted residents. In selecting
			 a location for such a public hearing, the Administrator shall give priority to
			 locations in the State that will experience the greatest number of job
			 losses.</text>
					</paragraph></subsection><subsection id="H34B7245B5D8945E7A61BD1D20202A886"><enum>(c)</enum><header>Notification</header><text display-inline="yes-display-inline">If the Administrator concludes under
			 subsection (a)(1) that a covered action will have more than a de minimis
			 negative impact on employment levels or economic activity in any State, the
			 Administrator shall give notice of such impact to the State’s Congressional
			 delegation, Governor, and Legislature at least 45 days before the effective
			 date of the covered action.</text>
				</subsection><subsection id="H3220B60C6D8D4DD79636F68E93091AF5"><enum>(d)</enum><header>Definitions</header><text>In
			 this section, the following definitions apply:</text>
					<paragraph id="H2945DD00933D432E81A83D5A62464330"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means
			 the Administrator of the Environmental Protection Agency.</text>
					</paragraph><paragraph id="H382986655C2047828F7DC19523DC088C"><enum>(2)</enum><header>Covered
			 action</header><text>The term <term>covered action</term> means any of the
			 following actions taken by the Administrator under the Federal Water Pollution
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1201">33
			 U.S.C. 1201 et seq.</external-xref>):</text>
						<subparagraph id="H5CA093F8B52B4CA8B607F3E2C382E7C7"><enum>(A)</enum><text display-inline="yes-display-inline">Issuing a regulation, policy statement,
			 guidance, response to a petition, or other requirement.</text>
						</subparagraph><subparagraph id="H0647B65A69DD431B9274E05A2B413663"><enum>(B)</enum><text display-inline="yes-display-inline">Implementing a new or substantially altered
			 program.</text>
						</subparagraph></paragraph><paragraph id="H860FC44795354CE5ACD0327B01603EE3"><enum>(3)</enum><header>More than a de
			 minimis negative impact</header><text>The term <term>more than a de minimis
			 negative impact</term> means the following:</text>
						<subparagraph id="H3155EE4D364144EA8E4A69B5E4D0D8DC"><enum>(A)</enum><text>With respect to
			 employment levels, a loss of more than 100 jobs. Any offsetting job gains that
			 result from the hypothetical creation of new jobs through new technologies or
			 government employment may not be used in the job loss calculation.</text>
						</subparagraph><subparagraph id="HD69DEB9FC9234B2E8011048A0E1919DE"><enum>(B)</enum><text>With respect to
			 economic activity, a decrease in economic activity of more than $1,000,000 over
			 any calendar year. Any offsetting economic activity that results from the
			 hypothetical creation of new economic activity through new technologies or
			 government employment may not be used in the economic activity
			 calculation.</text>
						</subparagraph></paragraph></subsection></section></title><title id="H984B1A5265AB4CF388C5750E0F0121EB"><enum>VI</enum><header>REGIONAL HAZE
			 REGULATORY RELIEF</header>
			<section id="HEC486FD497DE47E89ECE997E4CB689B8"><enum>601.</enum><header>Implementation
			 plans</header><text display-inline="no-display-inline">Section 110 of the Clean
			 Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7410">42 U.S.C.
			 7410</external-xref>) is amended—</text>
				<paragraph id="H107C0057267442C988CABC634921348C"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c), by striking
			 <quote>(c)(1) The Administrator</quote> and all that follows through the end of
			 paragraph (1) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H103160DC661F436397D8DB141B06D38E" style="OLC">
						<subsection id="H6FC61CB3928D441DA351D4EAEF2CBD3F"><enum>(c)</enum><header>Federal

				general</header><text>Except as provided in subparagraph (C), unless the
				conditions described in subparagraph (B) are met, the Administrator shall
				promulgate a Federal implementation plan at any time after the date that is 2
				years after the date on which the Administrator—</text>
									<clause id="HB12040499D224D03AE3E89CC9B4FCBA1"><enum>(i)</enum><text>finds that a State
				has failed to make a required submission or finds that the plan or plan
				revision submitted by the State does not satisfy the minimum criteria
				established under subsection (k)(1)(A); or</text>
									</clause><clause id="H860C4EBDAB2D419591439B177C16FCAA"><enum>(ii)</enum><text>disapproves a
				State implementation plan submission.</text>
									</clause></subparagraph><subparagraph id="H53581CF81CF8474C882C260B2594BD40"><enum>(B)</enum><header>Conditions</header><text>The
				conditions described in this subparagraph are that, before the date on which
				the Administrator promulgates a Federal implementation plan—</text>
									<clause id="H626A53B46D3446E6A24DE596C63698F0"><enum>(i)</enum><text>a
				State corrects a deficiency in a State implementation plan or plan revision
				submitted by the State; and</text>
									</clause><clause id="H8BACBB9A6D304A4BA65CEF422FDE6D9C"><enum>(ii)</enum><text>the Administrator
				approves the plan or plan revision.</text>
									</clause></subparagraph><subparagraph id="HB0676538F30A4C4B9DA86CB8C6263BD3"><enum>(C)</enum><header>Visibility
				protection plans</header><text>In the case of a Federal implementation plan
				promulgated after the date of enactment of this subparagraph in place of a
				State implementation plan under section 169A—</text>
									<clause id="HECBEE312A3BC4D5F967288FC67E9C646"><enum>(i)</enum><text>the Administrator
				shall promulgate such Federal implementation plan only if the Administrator
				makes a finding that the State submitting the State implementation plan failed
				to consider the factors described in paragraphs (1) and (2) of section 169A(g)
				in preparing and submitting the plan; and</text>
									</clause><clause id="H076DC3262A4C4C1790E225FB8C32635B"><enum>(ii)</enum><text>compliance with
				the requirements of such Federal implementation plan shall not be required
				earlier than 5 years after the date of
				promulgation.</text>
									</clause></subparagraph></paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HEFD6DDB17FBE4EFDA69D7E274E95B221"><enum>(2)</enum><text>in subsection
			 (k)—</text>
					<subparagraph id="HE79E122002CB49BE8C8F6BDB7F0FA296"><enum>(A)</enum><text>by striking
			 paragraph (3) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H06F1F54AE6CA4BCEA6BDA02303DCB194" style="OLC">
							<paragraph id="H061E6DB47B6F4A6C8632FBC9D9CBE4EC"><enum>(3)</enum><header>Full approval
				and disapproval</header>
								<subparagraph id="H12BE667689CC430A930F08FFD1523B31"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraphs (B) and (C), in the
				case of any submission for which the Administrator is required to act under
				paragraph (2), the Administrator shall approve the submission as a whole if the
				submission meets all of the applicable requirements of this Act.</text>
								</subparagraph><subparagraph id="H584355EC994A472180328EFC224B410F"><enum>(B)</enum><header>Review</header><text>In
				reviewing any State implementation plan submitted pursuant to section 169A, the
				Administrator shall limit the review only to a determination of whether the
				State submitting the State implementation plan considered the factors described
				in paragraphs (1) and (2) of section 169A(g) in preparing and submitting the
				plan.</text>
								</subparagraph><subparagraph id="H865B244F9A094566B81A7856D1BB22FE"><enum>(C)</enum><header>Visibility
				plans</header><text>The Administrator shall approve as a whole any
				implementation plan submitted pursuant to section 169A that was prepared and
				submitted after consideration of the factors described in paragraphs (1) and
				(2) of section 169A(g).</text>
								</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HF8BC3DF8B5B747E3BEDBFBDA6DE87B81"><enum>(B)</enum><text>in paragraph
			 (5)—</text>
						<clause id="HA437026654B04ABD9CB06588AA2FFAC0"><enum>(i)</enum><text>in
			 the first sentence, by striking <quote>Whenever</quote> and inserting the
			 following:</text>
							<quoted-block display-inline="no-display-inline" id="H9029AF645B564A55856B39FB3E5838F9" style="OLC">
								<subparagraph id="H37C6B1BBF9E3448198578125BA7A5A3B"><enum>(A)</enum><header>In
				general</header><text>Whenever</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause><clause id="HEFC6FCA5DD2A416C9B1DCD98A34A3725"><enum>(ii)</enum><text>by
			 adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="H38307292576D45CE91EDCB68C6BFF72E" style="OLC">
								<subparagraph id="H032DA5CDB7B149BAAB3C11508BE021C7"><enum>(B)</enum><header>Visibility
				plans</header><text>Notwithstanding subparagraph (A), with respect to an
				implementation plan approved pursuant to section 169A, the Administrator shall
				only find that such a plan is substantially inadequate to meet standards for
				air pollutants that cause or contribute to the impairment of visibility, or any
				other applicable standard or requirement, under that section if the
				Administrator makes a finding that, in preparing the plan, the submitting State
				failed to consider the factors described in paragraphs (1) and (2) of section
				169A(g).</text>
								</subparagraph><subparagraph id="H185265D65AF743FEA0F41629EB6C7EDC"><enum>(C)</enum><header>Existing
				visibility plans</header>
									<clause id="HD2351D5D67374969BC3B6E3CDC8A9EAF"><enum>(i)</enum><header>Request for
				revocation</header><text>At any time after the date of enactment of this
				subparagraph—</text>
										<subclause id="HBAEAA6EBB0DE4EA499B64BD414ED8DFB"><enum>(I)</enum><text>a State may
				request that the existing Federal or State implementation plan for the State
				regarding visibility, or any determination made in calendar year 2012 or 2013
				of best available retrofit technology pursuant to section 169A, be revoked;
				and</text>
										</subclause><subclause id="H753B929A9752430CA27B01966ADE085C"><enum>(II)</enum><text>upon receipt of
				such a request, the Administrator shall revoke the implementation plan.</text>
										</subclause></clause><clause id="H724E27520D6849788877047714543CF8"><enum>(ii)</enum><header>Submission of
				new or revised plan</header><text>Upon a revocation under clause (i)(II), the
				State that requested the revocation shall, not later than 2 years after such
				revocation, submit to the Administrator a new or revised visibility plan in
				accordance with this
				Act.</text>
									</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph></section><section id="H3B13B32E2914450DAAEAFDADF6042455"><enum>602.</enum><header>Visibility
			 protection for Federal Class I areas</header><text display-inline="no-display-inline">Section 169A of the Clean Air Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/7491">42 U.S.C.
			 7491</external-xref>) is amended—</text>
				<paragraph id="H4F5B6D9D49424AFEB6DC9492B3757195"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(2), in the matter
			 preceding subparagraph (A), by striking <quote>as may be necessary</quote> and
			 inserting <quote>as the State determines, at the sole discretion of the State
			 after considering factors described in this section and providing adequate
			 opportunity for public comment, may be necessary</quote>; and</text>
				</paragraph><paragraph id="H8A45968E73BD4B578C10B63B1315A7A5"><enum>(2)</enum><text>in subsection
			 (g)—</text>
					<subparagraph id="HC884EBF258DD4BDCA725A90408705F46"><enum>(A)</enum><text>by striking
			 paragraph (1) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H979C73BD6C3B40D6B704F4E01D45CF53" style="OLC">
							<paragraph id="HA57475B3D6E24699AC2FC03C8B6AB34F"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H5CEBABE1B0B64276BE14FFCEA3D95D76"><enum>(A)</enum><text>in determining
				reasonable progress, there shall be taken into consideration—</text>
									<clause id="H30DAC499C54A43BD935A2EDC416D1923"><enum>(i)</enum><text>the costs of
				compliance;</text>
									</clause><clause id="HE136B711F0E8438D8220001867663EF6"><enum>(ii)</enum><text>the time
				necessary for compliance;</text>
									</clause><clause id="HBCAC54C0EDC646ABB9756CCAA21D4982"><enum>(iii)</enum><text>the energy and
				nonair quality environmental impacts of compliance;</text>
									</clause><clause id="HBC503F36DA0B478EAB0ED38F29E0FA8E"><enum>(iv)</enum><text>the remaining
				useful life of any existing source subject to requirements under this
				section;</text>
									</clause><clause id="HABFB51C860084FC385BC8C5B65AFA9B3"><enum>(v)</enum><text>the degree of
				improvement in visibility that may reasonably be anticipated to result from
				measures described in the applicable implementation plan; and</text>
									</clause><clause id="H6D74937FF9D8479DB7D9FCFEDCC78BAF"><enum>(vi)</enum><text>the economic
				impacts to the State (including people of the State);</text>
									</clause></subparagraph><subparagraph id="H388BBDAB4BCA4200B090C429D9123E4D"><enum>(B)</enum><text>in consideration
				of costs of compliance pursuant to subparagraph (A)(i), the State may use
				source-specific cost estimations developed by a licensed professional engineer
				as an alternate to other methods of estimation approved by the Administrator;
				and</text>
								</subparagraph><subparagraph commented="no" id="H5777416A18B245BEBF68BBE2B69F21D9"><enum>(C)</enum><text>in consideration
				of the degree of improvement in visibility pursuant to subparagraph (A)(v), the
				State may use alternate modeling techniques or methods than those prescribed by
				the Administrator in the Agency’s <quote>Guideline on Air Quality
				Models</quote> under appendix W to part 51 of title 40, Code of Federal
				Regulations, and, where available, measured emissions and monitoring data shall
				be used;</text>
								</subparagraph></paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H0E02D6FB21FB4823A89A7C595ADC0514"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
						<clause id="H4FE5CE2AD1CA40B695440307D220CB7A"><enum>(i)</enum><text>by
			 striking <quote>(2) in determining best available retrofit technology the
			 State</quote> and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="HCAC2204B34E1409A832414D5B843A232" style="OLC">
								<paragraph id="HA78ADDB2661A4DA4A9930AFF791271DF"><enum>(2)</enum><text>in determining the
				best available retrofit technology—</text>
									<subparagraph id="H4C6FF9764DE24887A776B861E290B1C5"><enum>(A)</enum><text>the
				State</text>
									</subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
						</clause><clause id="H391BC0EF9BD44BF3BA8036F4476CA545"><enum>(ii)</enum><text>in
			 subparagraph (A) (as designated by clause (i)), by inserting <quote>the
			 economic impacts to the State (including people of the State),</quote> after
			 <quote>life of the source,</quote>;</text>
						</clause><clause id="H74AFC4B772524134AEC854FA77808085"><enum>(iii)</enum><text>by
			 striking <quote>technology;</quote> and inserting <quote>technology;
			 and</quote>; and</text>
						</clause><clause id="H7A6D7139494E4A2780506E5879746395"><enum>(iv)</enum><text>by
			 adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="HC61C05297F5343D1B178836A414CD5EA" style="OLC">
								<subparagraph id="HDCC938BF126147DBA763DA12378E8A60"><enum>(B)</enum><text>in consideration
				of the costs of compliance pursuant to subparagraph (A), the State may use
				source-specific cost estimations developed by a licensed professional engineer
				as an alternate to other methods of estimation approved by the
				Administrator;</text>
								</subparagraph><subparagraph id="H15FD747D7A754B30B08E1F7CE4402365"><enum>(C)</enum><text>with respect to
				consideration of the degree of improvement in visibility pursuant to
				subparagraph (A)—</text>
									<clause id="H7B60DB74E9924B4CB0A4AA7BA25A3026"><enum>(i)</enum><text>the State may use
				alternate modeling techniques or methods than those prescribed by the
				Administrator in the Agency’s <quote>Guideline on Air Quality Models</quote>
				under appendix W to part 51 of title 40, Code of Federal Regulations;</text>
									</clause><clause id="H63691B05BDF94827AFAF5A2EDF9C6F13"><enum>(ii)</enum><text>the State may
				consider the degree of improvement in visibility in the mandatory class I
				Federal area that is most affected by emissions from the source without
				considering the degree of improvement in visibility in any other such area;
				and</text>
									</clause><clause id="H1BA3126E86734FE780520C4305DE10BD"><enum>(iii)</enum><text>the
				Administrator (in any case in which the Administrator has authority to
				determine emission limitations which reflect such technology) may not consider
				the degree of improvement in visibility in any area other than the mandatory
				class I Federal area that is most affected by emissions from the source;
				and</text>
									</clause></subparagraph><subparagraph id="H755487F05C34495B87A78A29EC5CF0E4"><enum>(D)</enum><text>the determination
				of best available retrofit technology by the State for any source shall be
				subject to review by the Administrator, an administrative entity, or a Federal
				or State court only pursuant to a clearly erroneous standard of
				review;</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="H3FF5A11E9E644857B1B4D950E6C3EEE0"><enum>(C)</enum><text>in paragraph (4),
			 by striking <quote>(or the date of promulgation of such a plan revision in the
			 case of action by the Administrator under section 110(c) for purposes of this
			 section)</quote>.</text>
					</subparagraph></paragraph></section></title><title id="HB6F7DD1FA5944F3CB92F9028C7963A47"><enum>VII</enum><header>No
			 regional haze regulation on the coal-powered Navajo generating station</header>
			<section id="H5B956417FBEF48D5BBDE1EC67002D0A8"><enum>701.</enum><header>Limitation on
			 authority to issue regulations</header><text display-inline="no-display-inline">The Administrator of the Environmental
			 Protection Agency shall not promulgate any Federal implementation plan pursuant
			 to section 169A or 169B of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7491">42 U.S.C. 7491</external-xref>, 7492; relating to
			 visibility protection) that would—</text>
				<paragraph id="H18CD3C2B457943B1840C5ECB17EDDFAE"><enum>(1)</enum><text>adversely impact
			 employment at the coal-powered Navajo Generating Station or other coal-fired
			 power plants and coal mines on tribal lands in northern Arizona;</text>
				</paragraph><paragraph id="HEBC475C6B9844192915BAA26EA77513C"><enum>(2)</enum><text>directly or
			 indirectly diminish the revenue received by the Federal Government or any
			 State, tribal or local government by reducing through regulation the amount of
			 coal that is available for mining on Navajo and Hopi Reservation lands;</text>
				</paragraph><paragraph id="H92BA5E04D1DB4A62B99077CCA4E919AE"><enum>(3)</enum><text display-inline="yes-display-inline">cause a reduction in coal-based revenue to
			 meet financial obligations required by federally authorized Indian water rights
			 settlements, pursuant to section 403(f) of the Colorado River Basin Project Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/43/1543">43 U.S.C.
			 1543(f)</external-xref>):</text>
				</paragraph><paragraph id="HD07E092FE53A4A1EAAB79551C6D9011C"><enum>(4)</enum><text>reduce the amount
			 of coal, or increase the cost of coal, available for the Navajo Generating
			 Station’s Federal responsibility to deliver water and power, as authorized by
			 the Colorado River Basin Project Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1501">43 U.S.C. 1501 et seq.</external-xref>); or</text>
				</paragraph><paragraph id="H163555F192164323955DE80B45C935FD"><enum>(5)</enum><text>expose the United
			 States to liability for taking the value of tribally-owned coal in northern
			 Arizona through regulation.</text>
