		<legis-type>A BILL</legis-type>
		<official-title>To deem any adjournment of the House of Representatives
		  which is in effect on the date of the regularly scheduled general election for
		  Federal office held during a Congress to be adjournment sine die, and to amend
		  title 31, United States Code, to provide for automatic continuing
		  appropriations if a regular appropriation bill for a fiscal year does not
		  become law before the date of the regularly scheduled general election for
		  Federal office held during such fiscal year.</official-title>

	<legis-body id="H5E39AF12D2AD4A01B6B62626E40CB209" style="OLC">
		<section id="H19E987B65A304926AE750CCCAAFA7C76" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>End the Lame Duck
			 Act</short-title></quote>.</text>
		</section><section id="H6C59B3071038480F8983F07E5C716F45" section-type="subsequent-section"><enum>2.</enum><header>Mandatory sine die
			 adjournment after general election date</header>
			<subsection id="H734E0F03F9B842D7A11C680855BF4270"><enum>(a)</enum><header>Mandatory sine
			 die adjournment</header><text display-inline="yes-display-inline">Except as
			 provided in subsection (b), if the House of Representatives stands adjourned on
			 the date of the regularly scheduled general election for Federal office during
			 a Congress (beginning with the One Hundred Twelfth Congress) pursuant to a
			 concurrent resolution providing for the adjournment of the House, the House
			 shall be considered to be adjourned sine die.</text>
			</subsection><subsection id="H80D65DD103D142A4A9ECE9C4557047A2"><enum>(b)</enum><header>Reassembly of
			 Congress in certain circumstances</header>
				<paragraph id="H650DAC4B3BB443B6BA02F851BF0D8635"><enum>(1)</enum><header>Counting of
			 electors</header><text display-inline="yes-display-inline">Nothing in
			 subsection (a) shall be construed to prohibit the Congress from meeting to
			 count electoral votes pursuant to section 15 of title 3, United States
			 Code.</text>
				</paragraph><paragraph id="H928CC943D71648B2A1AA2F09F6BFE972"><enum>(2)</enum><header>Permitting
			 reassembly upon agreement of leadership</header><text display-inline="yes-display-inline">After the date described in subsection (a),
			 the Speaker of the House of Representatives and the majority leader of the
			 Senate, or their respective designees, acting jointly and with the written
			 agreement of the minority leader of the House and the minority leader of the
			 Senate, may notify the Members of the House and Senate, respectively, to
			 reassemble if each determines that it is in the interest of the United States
			 to do so.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="HAB8820167BB8438DAAFDF0F062CE1342" section-type="subsequent-section"><enum>3.</enum><header>Automatic continuing
			 appropriations</header>
			<subsection id="H136053B6F05346E38AE8A9F5ADC02C35"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 13 of title
			 31, United States Code, is amended by inserting after section 1310 the
			 following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HD6C65DB3192D4CA7BE273307DC68731F" style="USC">
					<section id="H197EADB6DFE849D3A05B1793C96E670E"><enum>1311.</enum><header>Continuing
				appropriations</header>
						<subsection id="H81DFB7C6288C46D2AFA56E37508BB4A6"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HCE3305B41FA9499CBDE5923B42F55C61"><enum>(1)</enum><text display-inline="yes-display-inline">If any regular appropriation bill for a
				fiscal year does not become law before the date of the regularly scheduled
				general election for Federal office held during such fiscal year or a joint
				resolution making continuing appropriations is not in effect, there are
				appropriated, out of any money in the Treasury not otherwise appropriated, and
				out of applicable corporate or other revenues, receipts, and funds, such sums
				as may be necessary to continue any project or activity for which funds were
				provided in the preceding fiscal year—</text>
								<subparagraph id="H77BAED8DF56543C486FC6043F4D31B21" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">in
				the corresponding regular appropriation Act for such preceding fiscal year;
				or</text>
								</subparagraph><subparagraph id="HE52A746BC76245849A1C18CF749EF33E" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">if
				the corresponding regular appropriation bill for such preceding fiscal year did
				not become law, then in a joint resolution making continuing appropriations for
				such preceding fiscal year.</text>
								</subparagraph></paragraph><paragraph id="H7E74B85D7DA040828FF5067A92215DDC" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Appropriations and funds made available,
				and authority granted, for a project or activity for any fiscal year pursuant
				to this section shall be at a rate of operations not in excess of the lower
				of—</text>
								<subparagraph id="HC0018046F716488C896883DC92A1789A"><enum>(A)</enum><text display-inline="yes-display-inline">the rate of operations provided for in the
				regular appropriation Act providing for such project or activity for the
				preceding fiscal year;</text>
								</subparagraph><subparagraph id="H62AEC3CFF70A43FFBA33A93C397571C9"><enum>(B)</enum><text display-inline="yes-display-inline">in
				the absence of such an Act, the rate of operations provided for such project or
				activity pursuant to a joint resolution making continuing appropriations for
				such preceding fiscal year;</text>
								</subparagraph><subparagraph id="HF790A56EA5FF437892463DF065C1D2D5"><enum>(C)</enum><text display-inline="yes-display-inline">the rate of operations provided for in the
				regular appropriation bill as passed by the House of Representatives or the
				Senate for the fiscal year in question, except that the lower of these two
				versions shall be ignored for any project or activity for which there is a
				budget request if no funding is provided for that project or activity in either
				version; or</text>
								</subparagraph><subparagraph id="H88DE2558F3F14D9A9763760B2FEC1086"><enum>(D)</enum><text display-inline="yes-display-inline">the annualized rate of operations provided
				for in the most recently enacted joint resolution making continuing
				appropriations for part of that fiscal year or any funding levels established
				under the provisions of this Act.</text>
								</subparagraph></paragraph><paragraph id="HC98E2106944D4780A4BE97E55D50BF53" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Appropriations and funds made available,
				and authority granted, for any fiscal year pursuant to this section for a
				project or activity shall be available for the period beginning with the first
				day of a lapse in appropriations and ending with the earlier of—</text>
								<subparagraph id="H97D10B51D21840CD9950405DD954A58A"><enum>(A)</enum><text display-inline="yes-display-inline">the date on which the applicable regular
				appropriation bill for such fiscal year becomes law (whether or not such law
				provides for such project or activity) or a continuing resolution making
				appropriations becomes law, as the case may be; or</text>
								</subparagraph><subparagraph id="H21D4A54E1F844D0884D1D92C7CE660A3"><enum>(B)</enum><text display-inline="yes-display-inline">the last day of such fiscal year.</text>
								</subparagraph></paragraph></subsection><subsection id="H9FFEE36A89544409A650C78DE6014E95"><enum>(b)</enum><text display-inline="yes-display-inline">An appropriation or funds made available,
				or authority granted, for a project or activity for any fiscal year pursuant to
				this section shall be subject to the terms and conditions imposed with respect
				to the appropriation made or funds made available for the preceding fiscal
				year, or authority granted for such project or activity under current
				law.</text>
						</subsection><subsection id="H15E37150917145C193AC02BA11662BA1"><enum>(c)</enum><text display-inline="yes-display-inline">Appropriations and funds made available,
				and authority granted, for any project or activity for any fiscal year pursuant
				to this section shall cover all obligations or expenditures incurred for such
				project or activity during the portion of such fiscal year for which this
				section applies to such project or activity.</text>
						</subsection><subsection id="H95FBA1D092484EDAB0522B81E72AB547"><enum>(d)</enum><text display-inline="yes-display-inline">Expenditures made for a project or activity
				for any fiscal year pursuant to this section shall be charged to the applicable
				appropriation, fund, or authorization whenever a regular appropriation bill or
				a joint resolution making continuing appropriations until the end of a fiscal
				year providing for such project or activity for such period becomes law.</text>
						</subsection><subsection id="HDDB0B122D6AE4724A3B9270C10F99038"><enum>(e)</enum><text display-inline="yes-display-inline">This section shall not apply to a project
				or activity during a fiscal year if any other provision of law (other than an
				authorization of appropriations)—</text>
							<paragraph id="H3DCA5B83AED94BDE8CF1760B0CBE6B2D"><enum>(1)</enum><text display-inline="yes-display-inline">makes an appropriation, makes funds
				available, or grants authority for such project or activity to continue for
				such period; or</text>
							</paragraph><paragraph id="HE8A0A36399534194BF8BCBF7EB1D077B"><enum>(2)</enum><text display-inline="yes-display-inline">specifically provides that no appropriation
				shall be made, no funds shall be made available, or no authority shall be
				granted for such project or activity to continue for such period.</text>
							</paragraph></subsection><subsection id="H03B6826D3BC24C84951C640CAB35F057"><enum>(f)</enum><text display-inline="yes-display-inline">For purposes of this section, the term
				<term>regular appropriation bill</term> means any annual appropriation bill
				making appropriations, otherwise making funds available, or granting authority,
				for any of the following categories of projects and activities:</text>
							<paragraph id="H2669D8635527465CA30E2C8E74DBA623"><enum>(1)</enum><text display-inline="yes-display-inline">Agriculture, Rural Development, Food and
				Drug Administration, and Related Agencies.</text>
							</paragraph><paragraph id="H8F28DF30CC3C437486525251DD242132"><enum>(2)</enum><text>Commerce, Justice,
				Science, and Related Agencies.</text>
							</paragraph><paragraph id="H51B2CC2FD8F848ADA68A45057260E573"><enum>(3)</enum><text>Department of
				Defense.</text>
							</paragraph><paragraph id="HD47E101AB0E34CCEB03995C9B73D48E6"><enum>(4)</enum><text>Energy and Water
				Development and Related Agencies.</text>
							</paragraph><paragraph id="HD4830F8AFC3B4A46B3FDF17A72E7A5FD"><enum>(5)</enum><text>Financial Services
				and General Government.</text>
							</paragraph><paragraph id="H3384C02D31B943689BBB98A7EE015EC7"><enum>(6)</enum><text>Department of
				Homeland Security.</text>
							</paragraph><paragraph id="H06F0D17B0F024C07B3E8BE207A96BB47"><enum>(7)</enum><text>Department of the
				Interior, Environment, and Related Agencies.</text>
							</paragraph><paragraph id="H9138EA9BDCAA48ADA8322E000F968861"><enum>(8)</enum><text>Departments of
				Labor, Health and Human Services, Education, and Related Agencies.</text>
							</paragraph><paragraph id="H0A3CC0380D9D45E3BD330B6A8750CEC1"><enum>(9)</enum><text>Legislative

							</paragraph><paragraph id="H0D3A9591DB094C28BDEFD4C8EE84492A"><enum>(10)</enum><text>Military
				Construction and Veterans' Affairs.</text>
							</paragraph><paragraph id="H613308A163A8487CA8C86D4883F27BA5"><enum>(11)</enum><text>Department of
				State, Foreign Operations, and Related Programs.</text>
							</paragraph><paragraph id="HDE292FA6C1BE4D319B670C498B0190F3"><enum>(12)</enum><text>Transportation,
				Housing and Urban Development, and Related
				Agencies.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5BD0129E405840498DD36360C622843A"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The analysis of
			 chapter 13 of title 31, United States Code, is amended by inserting after the
			 item relating to section 1310 the following new item:</text>

			</subsection><subsection id="H0F6A808A02344089A718F42B09CE2629"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to fiscal years beginning after September 30,
			 2012.</text>
