		<section id="HA960A0AA10CC4FE8B5BCEFD36F3F51E6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Dairy Pricing Deregulation Act</short-title></quote>.</text>
		</section><section id="H2218DB9961A040ADAB40B93A4504E9A5"><enum>2.</enum><header>Reform of Federal
			 milk marketing orders</header>
			<subsection id="H1DED81F2137E4CB0A2BB98773718C02D"><enum>(a)</enum><header>Terms and
			 conditions of milk and milk products orders</header><text display-inline="yes-display-inline">Section 8c of the Agricultural Adjustment
			 Act (7 U.S.C. 608c), reenacted with amendments by the Agricultural Marketing
			 Agreement Act of 1937, is amended—</text>
				<paragraph id="HF24D024444634817A4DEDEFDF40B6866"><enum>(1)</enum><text>in subsection
			 (5)—</text>
					<subparagraph id="H8134BCEDC3164907B1E2399CCF81D305"><enum>(A)</enum><text>by striking
			 paragraphs (C), (D), (H), (I), (J), and (K);</text>
					</subparagraph><subparagraph id="HE0123D9548E44408A98FB5DDE0E01547"><enum>(B)</enum><text>by amending
			 paragraph (A) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HF30504F45E784BE5BE88345DED59D920" style="OLC">
							<subparagraph id="HF73E3F2B4BCE4FFE93DB9095D80D2D70"><enum>(A)</enum><text display-inline="yes-display-inline">Fixing a differential which all handlers of
				milk used for fluid purposes shall pay with respect to such milk, and the time
				when payments shall be made, for milk purchased from producers or associations
				of producers. Such differential shall be uniform as to all such handlers,
				subject only to adjustment for the locations at which delivery of such milk is
				made to such handlers.</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HF97CC35B0E114B0782F9EA86B734F409"><enum>(C)</enum><text>by amending
			 paragraph (B) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HF2501C06DC7E42D2B337F5EF11240CF6" style="OLC">
							<subparagraph id="HAB107B131FAA42689D553F2ACE85945E"><enum>(B)</enum><text display-inline="yes-display-inline">Providing for the payment to all producers
				and associations of producers delivering milk to any fluid milk handler
				regulated by the order, or to any non-fluid milk handler which supplies milk to
				such fluid milk handler in conformity with such requirements as the Secretary
				may establish, a proportionate share, based on volume of delivered milk, of all
				differentials required to be paid under paragraph (A) of this subsection (5),
				subject only to adjustment for the locations at which delivery of such milk is
				made.</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HF8D7DE4429D746EF976794E016260839"><enum>(D)</enum><text>by amending
			 paragraph (F) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H78EDADB4CCDB4A1DA9C2C06AE7DD44F4" style="OLC">
							<subparagraph id="H8A3BA1C3DB914BD7B48FEE6A9B691F60"><enum>(F)</enum><text display-inline="yes-display-inline">Nothing contained in this subsection is
				intended or shall be construed to prevent a cooperative marketing association
				qualified under the provisions of the Act of Congress of February 18, 1922,
				known as the <quote>Capper-Volstead Act</quote> (7 U.S.C. 291 et seq.), engaged
				in making collective sales or marketing of milk or its products for the
				producers thereof, from blending the net proceeds of all of its sales of milk
				or its products in all markets, and making distribution thereof to its
				producers in accordance with the contract between the association and its
				producers.</text>
							</subparagraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H54CFA4C638334272B963E26097907232"><enum>(E)</enum><text>by amending
			 paragraph (L) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HAF1B4C8AF8DB4BA3AE3B1BBAA43A6B25" style="OLC">
							<subparagraph id="H40398BAF82F24BF3A33E4BA69BF607E4"><enum>(L)</enum><text display-inline="yes-display-inline">Providing that adjustments in payments by
				handlers under paragraph (A) need not be the same as adjustments to producers
				under paragraph
				(B).</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HF9B8FCE35A4C49D4BF15DF04C6168DFB"><enum>(F)</enum><text>by amending
			 paragraph (M) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HB6A0FF2DFE1944B68E397F1A48FD2A04" style="OLC">
							<subparagraph id="H74F26261C3524DBEAA1743B394DAEA4B"><enum>(M)</enum><clause commented="no" display-inline="yes-display-inline" id="HC13198ABFE584D37983DEEF6A580787F"><enum>(i)</enum><header>Application of
				requirements</header><text display-inline="yes-display-inline">Notwithstanding
				any other provision of this section, a milk handler described in clause (ii)
				shall be subject to all of the fluid milk differential requirements of a
				Federal milk marketing order issued pursuant to this section applicable to the
				county in which the plant of the handler is located, if the handler has
				packaged fluid milk product route dispositions, or sales of packaged fluid milk
				products to other plants, in a marketing area located in a State that requires
				handlers to pay minimum prices for raw milk purchases.</text>
								</clause><clause id="HF7D3ECED857549878E1283A33D17B46E" indent="up1"><enum>(ii)</enum><header>Covered milk
				handlers</header><text display-inline="yes-display-inline">Except as provided
				in clause (iv), clause (i) applies to a handler of Class I milk products
				(including a producer-handler or producer operating as a handler) that—</text>
									<subclause id="H1694DB533D154F12A6360F9D66423539" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">operates a plant that is located within the
				boundaries of a Federal order milk marketing area (as those boundaries are in
				effect as of April 11, 2006);</text>
									</subclause><subclause id="H8463831A8BF847F3970272EA0BF7D625" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">has packaged fluid milk product route
				dispositions, or sales of packaged fluid milk products to other plants, in a
				milk marketing area located in a State that requires handlers to pay fluid milk
				differentials for raw milk purchases; and</text>
									</subclause><subclause id="HC22B834333E24E11B39FA80E71B8AF5A" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">is not otherwise obligated by a Federal
				milk marketing order, or a regulated milk pricing plan operated by a State, to
				pay minimum class prices or fluid milk differentials for the raw milk that is
				used for such dispositions or sales.</text>
									</subclause></clause><clause id="H37D2D0A5C39C4E09AC55E5A151F88059" indent="up1"><enum>(iii)</enum><header>Obligation to pay fluid milk
				differentials</header><text display-inline="yes-display-inline">For purposes of
				clause (ii)(III), the Secretary may not consider a handler of Class I milk
				products to be obligated by a Federal milk marketing order to pay fluid milk
				differentials for raw milk unless the handler operates the plant as a fully
				regulated fluid milk distributing plant under a Federal milk marketing
				order.</text>
								</clause><clause id="H8D52C7F043B84DEDB0116E55C9985618" indent="up1"><enum>(iv)</enum><header>Certain handlers
				exempted</header><text display-inline="yes-display-inline">Clause (i) does not
				apply to—</text>
									<subclause id="HFE842F69ADC743EE9CE3FFA766BBBDEA" indent="up1"><enum>(I)</enum><text>a handler (otherwise described in
				clause (ii)) that operates a nonpool plant (as defined in section 1000.8(e) of
				title 7, Code of Federal Regulations, as in effect on the date of the enactment
				of this subparagraph);</text>
									</subclause><subclause id="H7BFB4D59BA1F4741BED9190790A67153" indent="up1"><enum>(II)</enum><text>a producer-handler (otherwise
				described in clause (ii)) for any month during which the producer-handler has
				route dispositions, and sales to other plants, of packaged fluid milk products
				equaling less than 3,000,000 pounds of milk; or</text>
									</subclause><subclause id="H34326D8E075D43778A1B5662D7D8922E" indent="up1"><enum>(III)</enum><text>a handler (otherwise described in
				clause (ii)) for any month during which—</text>
										<item id="H233DBAFDAEF44A5599CFAFB0909BFF58" indent="up1"><enum>(aa)</enum><text>less than 25 percent of the total
				quantity of fluid milk products physically received at the plant of the handler
				(excluding concentrated milk received from another plant by agreement for other
				than Class I use) is disposed of as route disposition or is transferred in the
				form of packaged fluid milk products to other plants; or</text>
										</item><item id="H9FABEFE196984E8FA3AE1110DD48CEDC" indent="up1"><enum>(bb)</enum><text>less than 25 percent in aggregate
				of the route disposition or transfers are in a marketing area or areas located
				in one or more States that require handlers to pay minimum prices for raw milk
				purchases.</text>
										</item></subclause></clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H77F4D54FEB8B43BB9B929DDE1CFF4904"><enum>(G)</enum><text>by amending
			 paragraph (N) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HC1BC94546D97447B864BDE7418ED3780" style="OLC">
							<subparagraph id="HD25EC2603F6F4E69A437FC95D6EFE534"><enum>(N)</enum><header>Exemption for
				certain milk handlers</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				section, no handler with distribution of Class I milk products in the marketing
				area described in Order No. 131 shall be exempt during any month from any fluid
				milk differential requirement established by the Secretary under this
				subsection if the total distribution of Class I products during the preceding
				month of any such handler’s own farm production exceeds 3,000,000
				pounds.</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HBA4F98D48E644E88A1975DE2F8DFDB0F"><enum>(2)</enum><text>by amending
			 subsection (18) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HC96050F469F045B6B1751B9730B1764C" style="OLC">
						<paragraph id="H13BEE4156EFE4B1AB3A3111C1B20C40E"><enum>(18)</enum><header>Fluid milk
				differentials</header><text display-inline="yes-display-inline">The Secretary
				of Agriculture, in prescribing any term in any marketing agreement or order, or
				amendment thereto, relating to milk or its products, if such term is to fix the
				differential to be paid to producers or associations of producers, shall fix
				such differential as follows. Such differentials shall during the first year
				after the effective date of the Dairy Pricing Deregulation Act be equal to the
				differentials for milk used for fluid purposes as they existed under federal
				milk marketing orders on January 1, 2011, subject to all location adjustments
				as they existed under federal milk marketing orders on such date. Such
				differentials shall in each successive year be reduced by an amount equal to 20
				percent of the differentials that existed during the first year after the
				effective date of such Act, and shall be discontinued in the fifth year after
				the effective date of such Act.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HB90AB34288E441E5809B0960132B103F"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section 10(b)(2)(i)
			 of the Agricultural Adjustment Act (7 U.S.C. 610(b)(2)(i)), reenacted with
			 amendments by the Agricultural Marketing Agreement Act of 1937, is amended by
			 striking <quote>each handler subject thereto</quote> and inserting <quote>each
			 fluid milk handler subject thereto and each non-fluid milk handler which
			 supplies milk to such fluid milk handler</quote>.</text>
			</subsection><subsection id="H783B0727511F4F87A8C46B540B86407F"><enum>(c)</enum><header>Notice and
			 comment</header><text display-inline="yes-display-inline">The Secretary of
			 Agriculture shall use the notice and comment procedures provided in section 553
			 of title 5, United States Code, to implement the requirements of the amendments
			 made by subsection (a) of this section.</text>
			</subsection><subsection id="HD1D0152C80FD4AE2AD95DEBCAB36F87F"><enum>(d)</enum><header>Surveys</header>
				<paragraph id="HA9722C87D8B84D66B5334A101F48EAE7"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Agriculture shall survey and publish on
			 a regular basis data regarding the payments made by all handlers of milk used
			 for any purpose for milk purchased from producers or associations of
			 producers.</text>
				</paragraph><paragraph id="H0F888336E8674DC69308E923937EECC9"><enum>(2)</enum><header>Bases for
			 publication</header><text>The Secretary shall publish such data on a national
			 weighted-average basis and on a regional basis with respect to as many
			 multi-state regions as the Secretary determines to be of practical use.</text>
				</paragraph><paragraph id="H07A530F70E2C42A4A943FFDA891DED81"><enum>(3)</enum><header>Mandatory
			 participation</header><text>Participation in such surveys by handlers shall be
			 mandatory.</text>
				</paragraph></subsection></section><section id="HF4582D0CC4854D9A8ACF2D6EC1FFA4F9"><enum>3.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall be effective on the first day of the first month beginning one
			 year after the date of the enactment of this Act.</text>
