		  categorical exclusions from environmental assessment requirements for certain
		  highway construction activities, and for other purposes.</official-title>

		<section id="HA6C8D2BACDA742BE8C9ECC269A38DCDE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Beneficial Upgrades for Investment and Local Development of
			 Bridges Act of 2011</short-title></quote>.</text>
		</section><section id="HA1559BE2BBCA4031AA14C1CF1CBA28CE"><enum>2.</enum><header>Categorical
			 exclusions for certain highway construction activities</header>
			<subsection id="HE309B10E51244AC88DEA23ACE46888A4"><enum>(a)</enum><header>Issuance</header><text display-inline="yes-display-inline">The Secretary of Transportation shall issue
			 categorical exclusions from the requirement that an environmental assessment or
			 an environmental impact statement under section 102 of the National
			 Environmental Policy Act of 1969 (42 U.S.C. 4332) be prepared for the following
			 actions:</text>
				<paragraph id="HCFFB9F9A35F24C3CAD7DE4FCAAB1E8BD"><enum>(1)</enum><text display-inline="yes-display-inline">Bridge preventative maintenance,
			 rehabilitation, or replacement activities that—</text>
					<subparagraph id="HCF6A8B9925094B9AA8F0B9F07DD8628C"><enum>(A)</enum><text>occur on a bridge
			 that is not on the Interstate System; and</text>
					</subparagraph><subparagraph id="HB186E8B1422C4D4795F4D5A9DB8CEF0D"><enum>(B)</enum><text>in the case of a
			 bridge replacement, occur on a bridge that is on or near the existing roadway
			 alignment, with a width functionally consistent with the existing or planned
			 roadway.</text>
					</subparagraph></paragraph><paragraph id="H2C3987B2C0814E8CAC6599E2B896BDC7"><enum>(2)</enum><text display-inline="yes-display-inline">Modernization of a highway (other than a
			 highway on the Interstate System) by resurfacing, restoration, rehabilitation,
			 reconstruction, adding shoulders, or adding auxiliary lanes (e.g., parking,
			 weaving, turning, climbing).</text>
				</paragraph><paragraph id="HA4D3DFE8CF0041DD88BB451FE4B959E6"><enum>(3)</enum><text>Public and private
			 utilities rehabilitation, reconstruction, and replacement along or within an
			 existing or planned highway right-of-way.</text>
				</paragraph></subsection><subsection id="HA0C6BB4C30404D8594F0BBF8AF11FB7C"><enum>(b)</enum><header>Effect of
			 categorical exclusions</header><text display-inline="yes-display-inline">In
			 developing categorical exclusions under subsection (a), the Secretary shall
			 ensure that the actions described in subsection (a) receive the treatment
			 provided for actions under section 771.117(c) of title 23, Code of Federal
			 Regulations, as in effect on the date of enactment of this Act.</text>
			</subsection><subsection id="H47E3C26ADEAD47E49D06C5F7269A19E0"><enum>(c)</enum><header>Definitions</header><text>In
			 this section, the following definitions apply:</text>
				<paragraph id="H66AC0F76E8DA4323BC09C1D291490F71"><enum>(1)</enum><header>Interstate
			 System</header><text>The term <quote>Interstate System</quote> has the meaning
			 given that term in section 101 of title 23, United States Code.</text>
				</paragraph><paragraph id="H2CD9D84E98A2455DAC299EBC8E200D6A"><enum>(2)</enum><header>Public and
			 private utilities</header><text>the term <quote>public and private
			 utilities</quote> means public and private highway and drainage appurtenances,
			 including water, sewer, street lighting, gas, and telecommunications facilities
			 and equipment.</text>
				</paragraph></subsection></section></legis-body>
