			 of emissions of greenhouse gases under the Clean Air Act</header><text display-inline="no-display-inline">Title III of the Clean Air Act (42 U.S.C.
			 7601 et seq.) is amended by adding at the end the following:</text>

				<section id="H165DE46002AA49E0B6DC5525D7FADC1F"><enum>330.</enum><header>No regulation
				of emissions of greenhouse gases</header>
					<subsection id="H1DE2B0F07BC149D2A72272D5500011A6"><enum>(a)</enum><header>Definition</header><text>In
				this section, the term <term>greenhouse gas</term> means any of the
				following:</text>
						<paragraph id="HAACC11030066409684BA0D2ACD0D55CC"><enum>(1)</enum><text>Water
				vapor.</text>
						</paragraph><paragraph id="HA4F6F8796A1F42FDAE991C85F6798058"><enum>(2)</enum><text>Carbon
				dioxide.</text>
						</paragraph><paragraph id="H0C4173BED4174EE79BE7301345AE3CFD"><enum>(3)</enum><text>Methane.</text>
						</paragraph><paragraph id="HD923A7BBEDC94EECAEC8E62790CE9B51"><enum>(4)</enum><text>Nitrous
				oxide.</text>
						</paragraph><paragraph id="HA2AE51FE8D6941C4B3A445A2F245CD0F"><enum>(5)</enum><text>Sulfur
				hexafluoride.</text>
						</paragraph><paragraph id="H6E5F852EBA3A4361AEDD0645413DD43A"><enum>(6)</enum><text>Hydrofluorocarbons.</text>
						</paragraph><paragraph id="H14967D9F626345BB8B468116356B5797"><enum>(7)</enum><text>Perfluorocarbons.</text>
						</paragraph><paragraph id="H08F49D7169254E409BD15B267584474C"><enum>(8)</enum><text>Any other
				substance subject to, or proposed to be subject to, regulation, action, or
				consideration under this Act to address climate change.</text>
						</paragraph></subsection><subsection id="HFFAF4E7BC5364128877F9F19D6657E53"><enum>(b)</enum><header>Limitation on
				agency action</header>
						<paragraph id="HD9DA22AEB6CC4A5AA61D87EC175BEC1F"><enum>(1)</enum><header>Limitation</header>
							<subparagraph id="HD54C264D08A04D36A847C7874B81B61D"><enum>(A)</enum><header>In
				general</header><text>The Administrator may not, under this Act, promulgate any
				regulation concerning, take action relating to, or take into consideration the
				emission of a greenhouse gas to address climate change.</text>
							</subparagraph><subparagraph id="H3003E6AAB2CD41D48F1A4117B6A66B27"><enum>(B)</enum><header>Air pollutant
				definition</header><text>The definition of the term <term>air pollutant</term>
				in section 302(g) does not include a greenhouse gas. Notwithstanding the
				previous sentence, such definition may include a greenhouse gas for purposes of
				addressing concerns other than climate change.</text>
							</subparagraph></paragraph><paragraph id="H73100685A33C47AFACF4E30A1271D0B4"><enum>(2)</enum><header>Exceptions</header><text>Paragraph
				(1) does not prohibit the following:</text>
							<subparagraph id="H2F38CAE9DBDF407A8061FB38F47E4F8B"><enum>(A)</enum><text>Notwithstanding
				paragraph (4)(B), implementation and enforcement of the rule entitled
				<quote>Light-Duty Vehicle Greenhouse Gas Emission Standards and Corporate
				Average Fuel Economy Standards</quote> (as published at 75 Fed. Reg. 25324 (May
				7, 2010) and without further revision) and finalization, implementation,
				enforcement, and revision of the proposed rule entitled <quote>Greenhouse Gas
				Emissions Standards and Fuel Efficiency Standards for Medium- and Heavy-Duty
				Engines and Vehicles</quote> published at 75 Fed. Reg. 74152 (November 30,
				2010).</text>
							</subparagraph><subparagraph id="HDB4ADD275BAF4EDD8B537B6B0F1F5719"><enum>(B)</enum><text>Implementation and
				enforcement of section 211(o).</text>
							</subparagraph><subparagraph id="HB1A92017439B4188B3858D4BAB1D92C8"><enum>(C)</enum><text>Statutorily
				authorized Federal research, development, demonstration programs and voluntary
				programs addressing climate change.</text>
							</subparagraph><subparagraph id="HBF9C354AD2D74543B5CBE84EF36837EB"><enum>(D)</enum><text>Implementation and
				enforcement of title VI to the extent such implementation or enforcement only
				involves one or more class I substances or class II substances (as such terms
				are defined in section 601).</text>
							</subparagraph><subparagraph id="H28F33E99EEAB4DFAAD25F2C5EFD6C603"><enum>(E)</enum><text>Implementation and
				enforcement of section 821 (42 U.S.C. 7651k note) of Public Law 101–549
				(commonly referred to as the <quote>Clean Air Act Amendments of
				1990</quote>).</text>
							</subparagraph></paragraph><paragraph id="H5E6C10F952A34CC3AC015212C549DB78"><enum>(3)</enum><header>Inapplicability
				of provisions</header><text>Nothing listed in paragraph (2) shall cause a
				greenhouse gas to be subject to part C of title I (relating to prevention of
				significant deterioration of air quality) or considered an air pollutant for
				purposes of title V (relating to permits).</text>
						</paragraph><paragraph commented="no" id="H3E2D66DB7C3B43A6908FEC5BD2D701A7"><enum>(4)</enum><header>Certain prior
				agency actions</header><text>The following rules and actions (including any
				supplement or revision to such rules and actions) are repealed and shall have
				no legal effect:</text>
							<subparagraph commented="no" id="H951A44E77E7542879DB13F0BD1F53243"><enum>(A)</enum><text><quote>Mandatory
				Reporting of Greenhouse Gases</quote>, published at 74 Fed. Reg. 56260 (October
				30, 2009).</text>
							</subparagraph><subparagraph commented="no" id="H802FDDD9942A43549F754CFC48D96B30"><enum>(B)</enum><text><quote>Endangerment
				and Cause or Contribute Findings for Greenhouse Gases Under Section 202(a) of
				the Clean Air Act</quote>, published at 74 Fed. Reg. 66496 (December 15,
				2009).</text>
							</subparagraph><subparagraph commented="no" id="H4255708114B947829CE98EF8AC879D7B"><enum>(C)</enum><text><quote>Reconsideration

				action</header>
							<subparagraph commented="no" id="HB4019FD1AD03452FA9BB594EF5CE4843"><enum>(A)</enum><header>No
				limitation</header><text>This section does not limit or otherwise affect the
				authority of a State to adopt, amend, enforce, or repeal State laws and
				regulations pertaining to the emission of a greenhouse gas.</text>
							</subparagraph><subparagraph commented="no" id="H642535692ED24A0FA70FD39746087223"><enum>(B)</enum><header>Exception</header>
								<clause commented="no" id="HB35D2440506B4FB6BCDEEADCC3619AE5"><enum>(i)</enum><header>Rule</header><text>Notwithstanding
				subparagraph (A), any provision described in clause (ii)—</text>
									<subclause commented="no" id="HC5E53BAF6DE94262AEB026C02CC1AA10"><enum>(I)</enum><text>is not federally
				enforceable;</text>
									</subclause><subclause commented="no" id="HE6B9A051410E421585DBD62FC391B866"><enum>(II)</enum><text>is not deemed to
				be a part of Federal law; and</text>
									</subclause><subclause commented="no" id="H9BC57C1E9B8E432A81A94573DA212EA8"><enum>(III)</enum><text>is deemed to be
				stricken from the plan described in clause (ii)(I) or the program or permit
				described in clause (ii)(II), as applicable.</text>
									</subclause></clause><clause commented="no" id="H32ECD9BB5B1240288A9FCF4AE14B945D"><enum>(ii)</enum><header>Provision
				defined</header><text>For purposes of clause (i), the term
				<term>provision</term> means any provision that—</text>
									<subclause commented="no" id="H62096D90DC3741B481D7FA841C4060CF"><enum>(I)</enum><text>is contained in a
				State implementation plan under section 110 and authorizes or requires a
				limitation on, or imposes a permit requirement for, the emission of a
				greenhouse gas to address climate change; or</text>
									</subclause><subclause commented="no" id="HAC2C949E2384404FBB72EBCEAAE08573"><enum>(II)</enum><text>is part of an
				operating permit program under title V, or a permit issued pursuant to title V,
				and authorizes or requires a limitation on the emission of a greenhouse gas to
				address climate change.</text>
									</subclause></clause></subparagraph><subparagraph commented="no" id="H195973F662B5474BB70A22424E74AC48"><enum>(C)</enum><header>Action by
				administrator</header><text>The Administrator may not approve or make federally
				enforceable any provision described in subparagraph
				(B)(ii).</text>
							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" id="HA6096BC13EA0415D92E586A5B12F02D3"><enum>102.</enum><header>Exemptions from
			 requirements for certain farm vehicles</header>
			<subsection commented="no" id="H9F9B3882E86C4CD8B83201C1B090F302"><enum>(a)</enum><header>Federal
			 requirements</header><text display-inline="yes-display-inline">A covered farm
			 vehicle, including the individual operating that vehicle, shall be exempt from
			 the following:</text>
				<paragraph commented="no" id="H9305686C1A5A4412A1063FA284A637CA"><enum>(1)</enum><text>Any requirement
			 relating to commercial driver’s licenses established under chapter 313 of title
			 49, United States Code.</text>
				</paragraph><paragraph commented="no" id="HE8FF75FB86ED44E49F6795974AB33D73"><enum>(2)</enum><text>Any requirement
			 relating to drug testing established under chapter 313 of title 49, United
			 States Code.</text>
				</paragraph><paragraph commented="no" id="H89D513FD1E28449FAB8704A205139050"><enum>(3)</enum><text>Any requirement
			 relating to medical certificates established under chapter 313 of title 49,
			 United States Code.</text>
				</paragraph><paragraph commented="no" id="H4ECF10296AE34102AAC82345AA45D9E2"><enum>(4)</enum><text>Any requirement
			 relating to hours of service established under—</text>
					<subparagraph commented="no" id="H789AFFDFF5EA428DB22516F70016FC82"><enum>(A)</enum><text display-inline="yes-display-inline">subchapter III of chapter 311 of title 49,
			 United States Code; or</text>
					</subparagraph><subparagraph commented="no" id="HBBE0CDE85A134CC7B07A8E1EC90ACEC3"><enum>(B)</enum><text>chapter 315 of
			 title 49, United States Code.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="H85812415CF2E4232AF56CAAB32DB4C40"><enum>(b)</enum><header>State
			 requirements</header>
				<paragraph commented="no" id="H802A54392CFF4C898FF2086BF7DB673D"><enum>(1)</enum><header>In
			 general</header><text>Federal transportation funding to a State may not be
			 terminated, limited, or otherwise interfered with as a result of the State
			 exempting a covered farm vehicle, including the individual operating that
			 vehicle, from any State requirement relating to the operation of that
			 vehicle.</text>
				</paragraph><paragraph commented="no" id="HB3AE13DE15C54E47AB05B7C166098240"><enum>(2)</enum><header>Exception</header><text>Paragraph
			 (1) does not apply with respect to a covered farm vehicle transporting
			 hazardous materials that require a placard.</text>
				</paragraph></subsection><subsection commented="no" id="HDF10FE55B4834BC794AD09322D2F9A30"><enum>(c)</enum><header>Covered farm
			 vehicle defined</header>
				<paragraph commented="no" id="H4A225CD3917C430BBAE4708002ABC646"><enum>(1)</enum><header>In
			 general</header><text>In this section, the term <term>covered farm
			 vehicle</term> means a motor vehicle that—</text>
					<subparagraph commented="no" id="HAE257E918BD44376B550B28C0917163A"><enum>(A)</enum><text>is
			 traveling—</text>
						<clause commented="no" id="H94E122DB6C0F4B91BC12AC79BFB81CAB"><enum>(i)</enum><text>in the State in
			 which the vehicle is registered; or</text>
						</clause><clause commented="no" id="HB131BFE748734F9DA48C360763A6B6D4"><enum>(ii)</enum><text>in a State other
			 than the State in which the vehicle is registered;</text>
						</clause></subparagraph><subparagraph commented="no" id="H4075ECEC38B44FAC803F729C646F9943"><enum>(B)</enum><text>is operated
			 by—</text>
						<clause commented="no" id="H8EF18B93A0B7480DA31D22A16F9481C2"><enum>(i)</enum><text>a farm
			 owner;</text>
						</clause><clause commented="no" id="H6410213B70FE4CB39EEC250F84328EC1"><enum>(ii)</enum><text>a ranch
			 owner;</text>
						</clause><clause commented="no" id="HB7C345093C2245059C42936D01AD64DB"><enum>(iii)</enum><text>a farm
			 operator;</text>
						</clause><clause commented="no" id="H29047C8A96684D34A7A46DAC87EE0CAD"><enum>(iv)</enum><text>a ranch operator;
			 or</text>
						</clause><clause commented="no" id="H2816BE801B4142BDA6B1C8B98BF4BD4B"><enum>(v)</enum><text>an employee or
			 family member of an individual specified in clauses (i) through (iv);</text>
						</clause></subparagraph><subparagraph commented="no" id="H012EA31141494AC6A51A21FFA9343646"><enum>(C)</enum><text>is
			 transporting—</text>
						<clause commented="no" id="H7DE900155EF4497AAE0CC7FAA2DEB042"><enum>(i)</enum><text>agricultural
			 commodities;</text>
						</clause><clause commented="no" id="H6C35B33B08134666A46099D889EA0909"><enum>(ii)</enum><text>livestock;
			 or</text>
						</clause><clause commented="no" id="HF2C7D24802EC464180FD36F156FD8500"><enum>(iii)</enum><text>machinery or
			 supplies to or from a farm or ranch;</text>
						</clause></subparagraph><subparagraph commented="no" id="HABF1603F14854E088671CA1AAE57B4ED"><enum>(D)</enum><text>except as provided
			 in paragraph (2), is not used in the operations of a for-hire motor carrier;
			 and</text>
					</subparagraph><subparagraph commented="no" id="HFE2A46A193874394BDA0B9A0AB4D45A5"><enum>(E)</enum><text>is equipped with a
			 special license plate or other designation by the State in which the vehicle is
			 registered to allow for identification of the vehicle as a farm vehicle by law
			 enforcement personnel.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H469999EBA2524291BD0DC2883667484A"><enum>(2)</enum><header>Inclusion</header><text>In
			 this section, the term <term>covered farm vehicle</term> includes a motor
			 vehicle—</text>
					<subparagraph commented="no" id="H3318DD2B58494E9C88187ED168B4AAA4"><enum>(A)</enum><text>operated pursuant
			 to a crop share farm lease agreement;</text>
					</subparagraph><subparagraph commented="no" id="H9C71D0D83D974520B75E7C734F917CD8"><enum>(B)</enum><text>owned by a tenant
			 with respect to that agreement; and</text>
					</subparagraph><subparagraph commented="no" id="H10643D1E280B471289A14BA14431E29F"><enum>(C)</enum><text>transporting the
			 landlord’s portion of the crops under that agreement.</text>
					</subparagraph></paragraph></subsection></section><section id="H788487D3805C48C8A85D85CA93604403"><enum>103.</enum><header>Prohibition of
			 revision to coarse particulate matter air quality standards</header>
			<subsection id="H74714B404E0E4AA28F339F295EEBE5FE"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The Administrator of the Environmental
			 Protection Agency may not propose, finalize, implement, or enforce any
			 regulation described in subsection (c) if the Administrator determines pursuant
			 to subsection (b) that such regulation will incur compliance costs in the
			 United States of more than $100,000,000 annually.</text>
			</subsection><subsection id="HCBE2C27C45014EB6A0688F1ED79E2555"><enum>(b)</enum><header>Determination</header><text display-inline="yes-display-inline">In developing any regulation described in
			 subsection (c), the Administrator shall determine the annual compliance costs
			 of such regulation in the United States.</text>
			</subsection><subsection id="H8F47A2BA50B8480DBF8D0E82E8AE018B"><enum>(c)</enum><header>Regulation
			 described</header><text display-inline="yes-display-inline">A regulation
			 described in this subsection is a regulation that—</text>
				<paragraph id="HA2620C1259A74882AB940C1BB84D491D"><enum>(1)</enum><text>revises the
			 national primary ambient air quality standard or the national secondary ambient
			 air quality standard applicable to coarse particulate matter (generally
			 referred to as <term>PM10</term>) under section 109 of the Clean Air Act (42
			 U.S.C. 7409); and</text>
				</paragraph><paragraph id="H04609037722E4F58B4FCF30135D2802E"><enum>(2)</enum><text>is proposed or
			 finalized on or after the date of enactment of this Act.</text>
				</paragraph></subsection></section><section id="H89765B4B89564CBCBBF58FBE68D88EA4" section-type="subsequent-section"><enum>104.</enum><header>Rule of construction
			 of OSHA safety standard relating to the use of sweep augers</header><text display-inline="no-display-inline">Neither section 1910.272(g)(1)(ii) of title
			 29, Code of Federal Regulations, nor any other occupational safety and health
			 standard shall be construed by the Occupational Safety and Health Commission as
			 prohibiting an employee from working inside a grain bin while a sweep auger is
			 in operation.</text>
		</section><section id="H5D0388149DD248FCAA3D26273F081213" section-type="subsequent-section"><enum>105.</enum><header>Hazardous material
			 endorsement exemption</header>
			<subsection id="HED7C7D3B31494DA4B6377879DFEF2D74"><enum>(a)</enum><header>Exclusion</header><text display-inline="yes-display-inline">Section 5117(d)(1) of title 49, United
			 States Code, is amended—</text>
				<paragraph id="H27AA42666597463FB1C74755A226CAB6"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking
			 <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="HEE309C5B349046339C933E8B0BCF27BD"><enum>(2)</enum><text>in subparagraph
			 (C), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="H59743F13FF444E37ABE4B5517FF04075"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HD1CCC71683FF404EA1C43B0F04B2A84E" style="OLC">
						<subparagraph id="HF9272116C9CC441F998CE6341C88DC37"><enum>(D)</enum><text>a service vehicle
				carrying diesel fuel in quantities of 3,785 liters (1,000 gallons) or less that
				is—</text>
							<clause id="H98250A6C60B14377A31AACC324D19135"><enum>(i)</enum><text>driven by a class
				A commercial driver’s license holder who is a custom harvester, an agricultural
				retailer, an agricultural business employee, an agricultural cooperative
				employee, or an agricultural producer; and</text>
							</clause><clause id="H3D4998E5373949BCA9FB621BEFF482A4"><enum>(ii)</enum><text>clearly marked
				with a placard reading <term>Diesel
				Fuel</term>.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HE61BEBC144C649D88AA19255CBAFC889"><enum>(b)</enum><header>Exemption</header><text display-inline="yes-display-inline">Section 31315(b) of title 49, United States
			 Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H49396E51B5424D089FF31ED99B71680E" style="OLC">
					<paragraph id="HEC493C4064684AD1AE2ECFB0B0FBC4ED"><enum>(8)</enum><header>Hazardous
				materials endorsement exemption</header><text>The Secretary shall exempt all
				class A commercial driver’s license holders who are custom harvesters,
				agricultural retailers, agricultural business employees, agricultural
				cooperative employees, or agricultural producers from the requirement to obtain
				a hazardous material endorsement under part 383 of title 49, Code of Federal
				Regulations, while operating a service vehicle carrying diesel fuel in
				quantities of 3,785 liters (1,000 gallons) or less if the tank containing such
				fuel is clearly marked with a placard reading <term>Diesel
				Fuel</term>.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" id="H0E9B1D66B78A4A59B836AB3B302003DC"><enum>106.</enum><header>Definition of
			 waters of the United States</header><text display-inline="no-display-inline">The Administrator of the Environmental
			 Protection Agency and the Secretary of the Army may not alter the meaning of
			 the terms <term>navigable waters</term> and <term>waters of the United
			 States</term> in relation to regulations promulgated pursuant to the Federal
			 Water Pollution Control Act as such terms are understood on the date of the
			 enactment of this Act.</text>
		</section><section id="H5485B42D7CD14415815E24CD6707616C"><enum>107.</enum><header>Prohibition of
			 imposition of fee or tax on gaseous emissions by livestock</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
			 in carrying out any Act or program to reduce the effects of greenhouse gas
			 emissions on climate change, no Federal agency or official shall impose a fee
			 or tax on gaseous emissions emitted directly by livestock.</text>
		</section><section id="H580BCDD8175C453CA5D6877CEC84D39A"><enum>108.</enum><header>Pesticide
			 regulations</header>
			<subsection id="HE0730B79552A4FE2AC7377BC51287A7B"><enum>(a)</enum><header>Use of
			 authorized pesticides</header><text display-inline="yes-display-inline">Section
			 3(f) of the Federal Insecticide, Fungicide, and Rodenticide Act (7 U.S.C.
			 136a(f)) is amended by adding at the end the following:</text>
				<quoted-block id="HF99AF3B82B294470865C88E79C52D600" style="OLC">
					<paragraph id="H5C65BB1D536642A1A027CA50E88AF8F0"><enum>(5)</enum><header>Use of
				authorized pesticides</header><text>Except as provided in section 402(s) of the
				Federal Water Pollution Control Act, the Administrator or a State may not
				require a permit under such Act for a discharge from a point source into
				navigable waters of a pesticide authorized for sale, distribution, or use under
				this Act, or the residue of such a pesticide, resulting from the application of
				such
				pesticide.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H79132679E72A4AD8AC8B34FF68564D25"><enum>(b)</enum><header>Discharges of
			 pesticides</header><text>Section 402 of the Federal Water Pollution Control Act
			 (33 U.S.C. 1342) is amended by adding at the end the following:</text>
				<quoted-block id="HA2C63808B9274446A749A4BCAF1D6B44" style="OLC">
					<subsection id="H2D67C400D414401999EE84194B54B809"><enum>(s)</enum><header>Discharges of
				pesticides</header>
						<paragraph id="H94340C6A47974340BAB9B0E1B43C4FED"><enum>(1)</enum><header>No permit
				requirement</header><text>Except as provided in paragraph (2), a permit shall
				not be required by the Administrator or a State under this Act for a discharge
				from a point source into navigable waters of a pesticide authorized for sale,
				distribution, or use under the Federal Insecticide, Fungicide, and Rodenticide
				Act, or the residue of such a pesticide, resulting from the application of such
				pesticide.</text>
						</paragraph><paragraph id="H185F428B4D6A423F972EF142B7DBC035"><enum>(2)</enum><header>Exceptions</header><text>Paragraph
				(1) shall not apply to the following discharges of a pesticide or pesticide
				residue:</text>
							<subparagraph id="H24DF15ACC9A84F65972DB47768E06F7F"><enum>(A)</enum><text>A discharge
				resulting from the application of a pesticide in violation of a provision of
				the Federal Insecticide, Fungicide, and Rodenticide Act that is relevant to
				protecting water quality, if—</text>
								<clause id="HA466A88ED14843EDBD614B28E7FE13B6"><enum>(i)</enum><text>the discharge
				would not have occurred but for the violation; or</text>
								</clause><clause id="H1453B8ED65ED49E3AE46319EEFEED2C8"><enum>(ii)</enum><text>the amount of
				pesticide or pesticide residue in the discharge is greater than would have
				occurred without the violation.</text>
								</clause></subparagraph><subparagraph id="HA6396E525D8644129418EA32BD4EF123"><enum>(B)</enum><text>Stormwater
				discharges subject to regulation under subsection (p).</text>
							</subparagraph><subparagraph id="H385188FD59844004A12D71BBDB0236AB"><enum>(C)</enum><text>The following
				discharges subject to regulation under this section:</text>
								<clause id="HB78CDE72D3DE4EF2915AB9C1B0DE5A85"><enum>(i)</enum><text>Manufacturing or
				industrial effluent.</text>
								</clause><clause id="H085BED0B33D746E192D37F6F3EDD0FA3"><enum>(ii)</enum><text>Treatment works
				effluent.</text>
								</clause><clause id="H817DCA5C032348108A0692A655E4A93C"><enum>(iii)</enum><text>Discharges
				incidental to the normal operation of a vessel, including a discharge resulting
				from ballasting operations or vessel biofouling
				prevention.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H2C93A9C6386844CA9D221BA2B8E90412" section-type="subsequent-section"><enum>109.</enum><header>Gross income
			 exception for dealers under the Animal Welfare Act</header><text display-inline="no-display-inline">Section
			 2(f)(ii) of the Animal Welfare Act (7 U.S.C. 2132(f)) is amended—</text>
			<paragraph id="HA0A3857D89284919A327574DBABE02FD"><enum>(1)</enum><text>by striking
			 <quote>$500</quote> and inserting <quote>$5,000</quote>; and</text>
			</paragraph><paragraph id="HF2A545ABF8494217813F53CAEBADF079"><enum>(2)</enum><text>by adding after
			 <quote>year</quote> the following: <quote>, except that the Secretary shall
			 annually increase the dollar amount in this clause to reflect changes for the
			 12-month period ending on the most recent date for which data are available in
			 the Consumer Price Index for All Urban Consumers published by the Bureau of
			 Labor Statistics of the Department of Labor</quote>.</text>
			</paragraph></section><section id="H600B22385D244E3E8CBAC242865685E3" section-type="subsequent-section"><enum>110.</enum><header>Prohibition on
			 provision of Department of Agriculture funds and administrative support for
			 White House Rural Council</header><text display-inline="no-display-inline">The
			 Secretary of Agriculture may not use funds appropriated or otherwise made
			 available to the Department of Agriculture to provide funds or administrative
			 support for the White House Rural Council established pursuant to Executive
			 Order No. 86 of June 9, 2011.</text>
		</section><section commented="no" id="H4E0CCBC1F5D04689A8A9BB9A07397FA4"><enum>111.</enum><header>Prohibition
			 against inclusion of indirect emissions from land use changes</header>
			<subsection commented="no" id="H1076DD1BE56F4B6BBB71F89BC99C1373"><enum>(a)</enum><header>General
			 exclusion of indirect emissions land use change</header><text display-inline="yes-display-inline">For purposes of establishing or determining
			 compliance with any requirement or limitation under the Clean Air Act (42
			 U.S.C. 7401 et seq.), including the renewable fuel program under section 211(o)
			 of such Act, the Administrator of the Environmental Protection Agency shall not
			 take into consideration indirect emissions from land use changes.</text>
			</subsection><subsection commented="no" id="H7364B59158A247CF83CA6113A4246EF9"><enum>(b)</enum><header>Exclusion of
			 indirect emissions from land use changes in calculation of lifecycle greenhouse
			 gas emissions</header><text>Section 211(o)(1)(H) of the Clean Air Act (42
			 U.S.C. 7545(o)(1)(H)) is amended by striking <quote>(including direct emissions
			 and significant indirect emissions such as significant emissions from land use
			 changes)</quote> and inserting <quote>(excluding indirect emissions from land
			 use changes)</quote>.</text>
			</subsection></section><section id="H71601BE8959E44B08238DDE7E807F59B"><enum>112.</enum><header>Delay of
			 effective date of derivatives regulations pending cumulative
			 analysis</header><text display-inline="no-display-inline">Notwithstanding the
			 effective date in section 774 of the Dodd-Frank Wall Street Reform and Consumer
			 Protection Act (15 U.S.C. 77b note), the Commodity Futures Trading Commission
			 shall, prior to implementing final regulations prescribed pursuant to title VII
			 of such Act, conduct a comprehensive analysis of the economic impact of such
			 regulations, including a determination of the cumulative costs and benefits of
			 such regulations, and shall transmit to Congress a report containing its
			 conclusions.</text>
		</section><section id="H528BE1EF8C9A43A694943FD70644C593"><enum>113.</enum><header>Transportation
			 of agricultural commodities and farm supplies</header><text display-inline="no-display-inline">Section 229(a)(1) of the Motor Carrier
			 Safety Improvement Act of 1999 (49 U.S.C. 31136 note) is amended to read as
			 follows:</text>
			<quoted-block display-inline="no-display-inline" id="H5A190ADC396E42CB85A44FEF9E035917" style="OLC">
				<paragraph id="H6DE2A17A8C18431B8A0E51FFB2065EF4"><enum>(1)</enum><header>Transportation
				of agricultural commodities and farm supplies</header><text display-inline="yes-display-inline">Regulations prescribed by the Secretary
				under sections 31136 and 31502 of title 49, United States Code, regarding
				maximum driving and on-duty time for drivers used by motor carriers shall not
				apply during planting and harvest periods, as determined by each State, to
				drivers—</text>
					<subparagraph id="H9CAD21AC635A41A7A9EA4B21D7199286"><enum>(A)</enum><text display-inline="yes-display-inline">transporting agricultural commodities in
				the State from the source of the agricultural commodities to a location within
				a 150 air mile radius from the source;</text>
					</subparagraph><subparagraph id="H25E2EF5AE28144FCAFE358A96C8FDC11"><enum>(B)</enum><text>transporting farm
				supplies for agricultural purposes in the State from a wholesale or retail
				distribution point of the farm supplies to a farm or other location where the
				farm supplies are intended to be used within a 150 air mile radius from the
				distribution point; or</text>
					</subparagraph><subparagraph id="H393BB23E7E8649A5893EDF25C3340279"><enum>(C)</enum><text>transporting farm
				supplies for agricultural purposes in the State from a wholesale distribution
				point of the farm supplies to a retail distribution point of the farm supplies
				within a 150 air mile radius from the wholesale distribution
				point.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HD2E31F99FA1D4E8281F8C944679BC981"><enum>114.</enum><header>Restriction on
			 rulemaking related to child agricultural labor</header><text display-inline="no-display-inline">The Secretary of Labor shall not initiate
			 the rulemaking proposed and published in the Federal Register on September 2,
			 2011 (76 Fed. Reg 171) nor promulgate any regulations or revisions described in
			 such proposed rulemaking related to permissible employment of minors in
			 agricultural and nonagricultural occupations.</text>
